THE NATIONAL HISPANIC LEADERSHIP AGENDA he National Hispanic Leadership Agenda (NHLA) was founded in 1991 as a nonpartisan coalition of major Hispanic national organizations and distinguished Hispanic leaders from across the nation. NHLA’s mission calls for a spirit of unity among Latinos nationwide to provide the Hispanic community with greater visibility and a clearer, stronger voice in our country’s affairs. NHLA seeks a consensus among Hispanic leaders to help create policy that promotes public awareness of the major issues facing Latinos.

NHLA has a 40-member board of directors composed of the chief officers of 35 national Hispanic civil rights and public policy organizations, elected officials, corporate executives, and prominent Hispanic Americans. NHLA coalition members represent the diversity of the Latino community - Mexican Americans, Puerto Ricans, Cubans, and other Hispanic Americans. NHLA promotes consensus among Hispanic leaders and uses its collective voice to frame public policies and raise public awareness of the major issues that affect Latinos at the national level. The goals that guide the NHLA’s mission are: 1.
To identify, analyze, and shape public policies on Latino issues based on a national consensus of Latino leaders.
2.
To prepare and disseminate a consensus-based policy agenda that specifies the nature and scope of Latino concerns and needs throughout the country.
3.
To promote greater awareness of and attention to Latino concerns among the nation’s policy-makers, Corporate America, civic community leaders, and the general public.
To accomplish these goals NHLA issues reports, policy documents, and statements on issues affecting the Hispanic American community including the following documents.
CONGRESSIONAL SCORECARD NHLA issues a Congressional Scorecard rating members of Congress on votes taken in the House and Senate, which affect the social, economic, and political advancement and quality of life of Hispanic Americans.

ADMINISTRATION AND CABINET AGENCY REPORT CARDS NHLA periodically issues a Report Card rating the Administration on its efforts to ensure the full inclusion of Hispanic Americans throughout the federal workforce and issues a separate Report Card on the level of Hispanic employment within each federal agency.
POLICY AGENDA NHLA issues a comprehensive national policy document providing issue analyses and policy recommendations for issues affecting Hispanic Americans. The national policy agenda is distributed to the Administration, federal agencies, Congress, state and municipal governments, Corporate America, and Hispanic-Serving Institutions throughout the nation.

FOREWORD Saludos, he National Hispanic Leadership Agenda (NHLA) is pleased to issue the Congressional Scorecard covering the first and second sessions of the 108th Congress. The Scorecard identifies key votes for a broad range of issues and it documents how members of Congress acted on them.

NHLA is a nonpartisan coalition of public policy and civil rights organizations, which advocates for policies that address socioeconomic issues and the civil rights of a diverse community of 40 million Americans of Hispanic descent. NHLA’s policy recommendations seek to ensure that the growing Hispanic community has the fullest opportunity for social, economic, and political advancement - together with every American who is a part of this great nation. The NHLA Congressional Scorecard is a consensus document that reflects the views of the leading national Hispanic organizations in the United States. The votes included in the Scorecard have been identified by NHLA member organizations as having an impact on Hispanic Americans and each member of Congress who received a formal communication from one or more NHLA members to advise them of their concerns on the legislation being considered. Therefore, the Scorecard is an effective measure of the responsiveness of members of Congress on issues of concern to the Hispanic community. As useful as the Scorecard is for monitoring the performance of Congress, it is equally important to recognize that an assessment of the contributions of any individual member of Congress should include actions that are not reflected by their voting record. Many Senators and Representatives contribute in ways other than through voting in Congress, such as by sponsoring and co-sponsoring important bills through services they offer to their constituents, and by ensuring that their districts receive adequate federal funding to support economic development and other programs. Conversely, some members of Congress have done little to address the concerns of Hispanic Americans - they have worked against legislation that would further assist the advancement of Latinos or have opposed programs that have proven to be effective in fostering the advancement of Hispanic Americans. Therefore, we encourage you to consider other sources of information before passing judgment on any particular member of Congress.

METHODOLOGY ontinuing a practice initiated in the 107th Congress, the Board of Directors of the National Hispanic Leadership Agenda (NHLA), in May 2005, authorized the publication of its 2005 Hispanic Legislative Scorecard covering the first and second sessions of the 108th Congress. Prior to the 107th Congress, NHLA Scorecards have encompassed key votes taken only in a given session. However, as the NHLA Scorecard Committee began the process of identifying and gathering key votes to recommend to the Board, it concluded that there was not a sufficient number of votes on Latino issues taken during the first session of the 108th Congress to justify the creation of a Scorecard for this period only. NHLA members were particularly concerned that the dearth of votes available for the second session did not fairly represent a member’s voting record on issues affecting the Hispanic community. Thus, the NHLA Board of Directors decided to produce a Scorecard that included votes from both sessions of the 108th Congress. By combining first and second session votes, NHLA members believe that the Scorecard more accurately reflects members’ voting records on measures that impact the Latino community than either a single session Scorecard or no Scorecard at all.

Remaining unchanged is the fundamental purpose of the Scorecard, which is to ensure that Latino leaders, organizations, and voters are fully informed about the performance of federal legislators on issues of importance to the Hispanic community. In addition, NHLA seeks to ensure that U.S. Representatives and U.S. Senators are fully aware that their key votes on issues of particular significance to Hispanic Americans will be scrutinized and published. Pursuant to discussions of the NHLA Board, the Committee used three basic criteria to select key votes: ■
Importance of the vote to the Hispanic community, measured both substantively and symbolically
■
Prior notice to members of Congress regarding the position of NHLA member organizations, as evidenced by a formal communication by at least one NHLA member organization to the Congress
■
Substantial consensus, although not necessarily unanimity, among NHLA member organizations regarding the "pro-NHLA" position

All Scorecard Committee recommendations were arrived at by consensus. Member organizations identified potential votes, which were then discussed, sometimes at length. Only those votes reflecting a consensus of the Committee were recommended to the Board for inclusion. On May 13, 2005, after much consideration and solicitation of input from various members of NHLA regarding the Committee’s recommendations, the NHLA Board of Directors decided to proceed with the votes included herein for inclusion in the Scorecard.

n the section below, each key House and Senate vote is characterized by a bill or amendment number, the lead sponsor, a brief description, and identification of the "pro-NHLA" position.
HOUSE WORKFORCE First Session 1.
The Personal Responsibility, Work, and Family Promotion Act of 2003, H.R. 4 - Sponsored by Representative Deborah Pryce (R-OH). The bill, to reauthorize the Temporary Assistance for Needy Families program, will negatively impact Latino families by implementing unreasonable work requirements, provide inadequate funding for child care and other programs, reduce work support systems, and limit the amount of educational and job training available. In order successfully transition from welfare to work, NHLA members believe Latino recipients must be provided with the necessary tools required to help them reach selfsufficiency. NHLA opposed the measure because it failed to address the needs of Latino families and did not offer viable solutions to the real problems that they face. Bill passed 230-193, (Roll No. 30), February 13, 2003. (NHLA Position: NO)
2.
Workforce Reinvestment and Adult Education Act of 2003, H.R.1261 Sponsored by Howard P. McKeon (R-CA). The bill reauthorizes the Workforce Investment Act, the principal federal program supplying job training and related assistance. According to NHLA members, the bill did not adequately address the rigid sequence of services that prevented many people with limited-English proficiency from receiving needed training, reduced funding for the Workforce Investment Act (WIA), and did not recognize the unique needs of a diverse pool of jobseekers. Bill passed 220-204, (Roll No. 175), May 8, 2003. (NHLA Position: NO)
ECONOMIC MOBILITY First Session 1.
Motion to Instruct Conferees on the Labor-HHS Appropriations Act, H.R. 2660 - Sponsored by Representative David R. Obey (D-WI). The motion instructed conferees to agree to block a possible Labor

Department change in overtime pay rules. Specifically, the motion instructed conferees to agree to the Senate provision that prohibits funds from being used to implement any regulation that would remove eligibility for overtime pay from workers currently entitled to such pay. NHLA members support Hispanic workers’ right to overtime compensation. Motion passed 221-203, (Roll No. 531), October 2, 2003. (NHLA Position: YES) 2.
The Jobs and Growth Tax Reconciliation Act of 2003, H.R. 2 Sponsored by Representative William M. Thomas (R-CA). The bill aims to provide tax incentives to encourage economic growth. NHLA members opposed the bill because it provided tax cuts to the nation’s most affluent Americans while ignoring the needs of low-income Americans. In addition, NHLA members believe that the enormous cost of the tax cut would ultimately result in spending cuts in programs important to the Latino community. Bill passed 222-203, (Roll No. 182), May 9, 2003. (NHLA Position: NO)
3.
Amending the Foreign Relations Authorization Act of 2003, H. Amdt. 246 to H.R. 1950 - Sponsored by Representative John N. Hostettler (RIN). This amendment required the Secretary of State to issue regulations with respect to the issuance of consular identification cards by foreign governments to their nationals residing in the United States. If the State Department determines that a foreign government is not in compliance with the regulations, it requires the State Department to notify the foreign government that it must suspend issuance of the identification documents, and the U.S. could stop issuing any visas to individuals from that country. NHLA believes that this amendment would restrict Latinos’ access to consular identification cards, such as the Mexican Matrícula Consular (I.D. issued by the Mexican Consular). As a result, many Hispanics will be unable to identify themselves, leading to reduced public safety and access to financial services. Amendment passed 226-198, (Roll No. 367), July 15, 2003. (NHLA Position: NO)
4.
Resolution Relating to Consideration of Senate Amendments to the Increased Child Tax Credit Bill, H. Res. 270 to H.R. 1308 - Sponsored by Representative Thomas M. Reynolds (R-NY). NHLA opposed the House rule limiting debate on the child credit. In essence, the resolution prohibited the introduction of an amendment that would have adopted a Senate bill to allow low-income families to benefit from recently passed tax benefit increases for which they are now

ineligible. Resolution passed 224-201, (Roll No. 274), June 12, 2003. (NHLA Position: NO) 5.
Conference Report for the Jobs and Growth Tax Act of 2003, H.R. 2 Sponsored by Representative William M. Thomas (R-CA). This bill provides for $350 billion in tax cuts. NHLA members were concerned that budget deficits resulting from this tax cut package would result in proposals that cut public programs and services important to Hispanic families. Conference Report passed 231-200, (Roll No. 225), May 23, 2003. (NHLA Position: NO)
Second Session 6.
Oxley/Frank/Kolbe/Pastor/Hinojosa Amendment to FY05 Transportation, Treasury, and Independent Agencies Appropriations Bill - Sponsored by Representatives Michael Oxley (R-OH), Barney Frank (D-MA), Jim Kolbe (R-AZ), Ed Pastor (D-AZ), and Ruben Hinojosa (D-TX). The amendment struck language inserted by Representative John Culberson (R-TX) that would have undermined the final rules adopted by the Department of the Treasury that allow financial institutions to accept foreign-issue identification, including the Matricula Consular. NHLA members support immigrant access to secure identification systems. Amendment passed 222-177, (Roll No. 452), September 14, 2004. (NHLA Position: YES)
EDUCATION First Session 1.
Labor, Health, and Human Services, Education Appropriations Act for FY04, H.R. 2660 - Sponsored by Representative Ralph Regula (R-OH). The bill makes appropriations for the Departments of Labor, Health and Human Services, and Education, and related agencies for the fiscal year ending September 30, 2004. According to NHLA members, H.R. 2660 underfunded programs serving English language learner students, migrant children, and adult learners. In addition, the bill eliminated parent assistance and dropout prevention programs. Bill passed 215-208, (Roll No. 353), July 10, 2003. (NHLA Position: NO)
2.
Motion to Recommit with Instructions, H.R. 2210 - Offered by Representative Raul Grijalva (D-AZ). The motion to recommit H.R. 2210, a bill to reauthorize the Head Start Act, instructed the Education and Workforce Committee to address the funding shortfall that prevents the Migrant and Seasonal Head Start program from serving 80% of its eligible child population. Specifically, the motion,

supported by NHLA members, would have provided an additional $69 million for migrant and seasonal Head Start expansion. Motion failed 203-227, (Roll No. 443), July 25, 2003. (NHLA Position: YES) 3.
The Ready to Teach Act, H.R. 2211 - Sponsored by Representative Phil Gingrey (R-GA). The bill amends Title II, Teacher Quality Enhancement, of the Higher Education Act of 1965 (HEA). This bill included a measure to establish the Centers of Excellence to address the severe shortage of minority teachers. NHLA members believe the Centers of Excellence would strengthen and improve teacher preparation programs at minority-serving institutions, including Hispanic-serving institutions. Bill passed 404-17, (Roll No. 340), July 9, 2003. (NHLA Position: YES)
Second Session 4.
Fiscal Year Budget, H. Con. Res. 393 - Sponsored by Representative Jim Nussle (R-IA). The measure established the budget for the U.S. Government for FY 2005 and set budgetary targets for FY 2006 through 2009. The budget resolution eliminated or severely cut back funding for Hispanic education and other key programs, according to NHLA members. Resolution passed 215-212, (Roll No. 92), March 25, 2004. (NHLA Position: NO)
CIVIL RIGHTS First Session 1.
Motion to Suspend the Rules and Pass the Advancing Justice Through DNA Technology Act of 2003, H.R. 3214 - Sponsored by Representative F. James Sessenbrenner, Jr. (R-WI). The motion provided over $1 billion for expanding the use of DNA technology and research. NHLA members supported the provisions that granted federal inmates access to DNA testing, established a post-conviction DNA testing program, authorized grants to improve the quality of legal representation for indigent and other defendants in capital cases, and increased the compensation for federal inmates found to be unjustly imprisoned. Motion passed 357-67, (Roll No. 608), November 5, 2003. (NHLA Position: YES)
Second Session 2.
The Marriage Protection Act, H.R. 3313 - Sponsored by Representative John Hostettler (R-IN). This bill would have effectively stripped federal courts of jurisdiction to review constitutional challenges to the

Defense of Marriage Act. NHLA members expressed concern with laws that reduce judicial review for a class of individuals, especially when fundamental rights such as the right to marry are involved. Bill passed 233-194, (Roll No. 410), July 22, 2004. (NHLA Position: NO)
HEALTH Second Session 1.
The Undocumented Alien Emergency Medical Assistance Amendments of 2004, H.R. 3722 - Sponsored by Representative Dana Rorhabacher (R-CA). This legislation would have forced health providers receiving reimbursement under Section 1011 of the Medicare Modernization Act (MMA) to collect extremely sensitive information from emergency room patients, including immigration status. Hospitals would have been required to identify and report undocumented individuals to the Department of Homeland Security (DHS). The amendment also threatened emergency care standards put in place by the Emergency Medical Treatment and Active Labor Act (EMTALA) known as the "anti-dumping law," by permitting hospitals to refuse treatment of undocumented patients and allowing undocumented women in labor to be transported to their country of origin under certain circumstances. NHLA members vehemently opposed this bill because of the extreme deterrent effect it would have had on Latino communities and its threat to public health. The bill failed 88-331, (Roll No. 182), May 18, 2004. (NHLA Position: NO)
IMMIGRATION First Session 1.
Motion to Instruct Conferees on the National Defense Authorization Act for FY04, H.R. 1588 – Sponsored by Representative Ciro D. Rodriguez (D-TX). This motion instructed Congress to recede to Senate language, which included two important provisions for immigrant soldiers and their families (expedited naturalizations for reservists and protections for undocumented family members of fallen soldiers). Motion passed 298-118, (Roll No. 511), September 23, 2003. (NHLA Position: YES).
Second Session 2.
Amending the 9/11 Recommendations Implementation Act, H.R. 10, H. Substitute Amendment to H.R. 10 - Sponsored by Rep. Robert Menendez (D-NJ). H.R. 10 included many provisions that were not

included in the 9/11 Commission’s recommendations, including federal restrictions on immigrant access to driver’s licenses, restrictions on the use of foreign-government-issued identification documents, an expansion of expedited removal, reductions in due process rights for legal immigrants, and provisions to make political asylum much more difficult to obtain. This amendment would have replaced H.R. 10 with a substitute bill, which preserved the 9/11 commission’s recommendations without what NHLA members believe are antiimmigrant provisions. Amendment failed 203-213, (Roll No. 510), October 8, 2004. (NHLA Position: YES) 3.
Amending the 9/11 Recommendations Implementation Act, H.R. 10, H. Amendment 14 to H.R. 10 - Sponsored by Rep. Chris Smith (R-NJ). HEALTH First Session 1.
Amendment Blocking Immigrant Restorations to Health Care, S. Amdt. 1011 to the S.1., the Medicare Modernization Act (MMA) of 2003 Sponsored by Senator Jeff Sessions (R-AL). The amendment would have stripped language from the bill that provides states with the option to restore health care benefits to legal, immigrant pregnant women and children. Because nearly a third of Latinos are uninsured (32.7%), in part, due to harsh immigrant eligibility restrictions to Medicaid and the State Children’s Health Insurance Program (SCHIP), NHLA members opposed this amendment. Snowe/Dodd Child Care Amendment, S. Amdt. 2397, to the Temporary Assistance for Needy Families (TANF) Reauthorization Bill PRIDE (H.R. 4) - Sponsored by Senators Olympia Snowe (R-ME) and Christopher Dodd (D-CT). The amendment increased child care funding by $6 billion over five years and ensures that families are provided with the child care assistance needed to reach self-sufficiency.

CIVIL RIGHTS Second Session 1.
The Internet Tax Non-Discrimination Act, S. 150 - Sponsored by Senator George F. Allen (R-VA). The bill continues to ban Internet access taxes and keeps Internet access tax-free for all Americans. The measure fosters a national policy of encouraging businesses and individuals to connect to the Internet by preempting state and local taxation of all Internet access, regardless of the type of technology source used to access the Internet. According to NHLA members, this is significant for Latinos because Internet penetration rates are dismally low, standing at 32%, compared to a 70% penetration rate experienced by Whites.
