Kyam Maher – South Australia’s first Aboriginal Attorney-General You are South Australia’s first Aboriginal Attorney-General.

What does holding this title mean to you?

It’s something I’m really, really proud of. I think it creates a unique opportunity in South Australia, especially being both the Minister for Aboriginal Affairs and the Attorney-General. The Attorney-General is designated the state’s first law officer, charged with looking after the justice system and for more than 200 years it’s been the laws of South Australia and the British colony that preceded it that did so much to dispossess and disadvantage Aboriginal people. To have those laws in concert with Aboriginal Affairs policy so we can ensure that doesn’t happen again and have them instead work for Aboriginal people – I’m excited about that.

You grew up in Mount Gambier, what was that like?

I spent the end of primary and all high school in Mount Gambier and until recently, my parents lived there, so I was back regularly.

So much of my time growing up was amongst the Boandik community, Ngarrindjeri people and other South Australians that call Mount Gambier home. It’s a wonderful place, big enough that you’ve got everything you need, but small enough to have that community feel where sports are a central element to daily life. I think I was really fortunate to grow up in regional South Australia.

But your Aboriginal heritage comes from Tasmania? What role did it play in your life as you were growing up?

Yes, that was my mum’s heritage. My mum, growing up, was told not to talk about it which, back then, was not an uncommon story. I think as a society we’ve come a long way in being much more proud of the link everyone in this country has to the oldest living culture in the world but also, people are becoming increasingly proud of their identity. It didn’t play a huge role in my early life but certainly did as my Mum got more involved in the local Aboriginal community. By the time she passed away nearly five years ago, she was the chair of the board at Pangula Mannamurna, the Aboriginal health service, where she’d worked before retiring. And in 2016, she was the NAIDOC Lifetime Achievement Award Winner for the South East. So, it didn’t play a huge part in my early days, but it gave me a great sense of pride when I’d walk down the street with my Mum and a kid would call out ‘Auntie Viv!’ (his Mum).

That was pretty special.

Do you think it was your Mum’s role in that organisation that got you in touch with your heritage?

Absolutely. And my passion for Aboriginal affairs. My mum was a member of the Labor party and passed down that passion for social justice, particularly in Aboriginal affairs policy.

It was really strong in my background and I think about what she used to do in much of my own work.

Can you tell us about your career and how you’ve got to where you are?

I came up to Adelaide to go to Uni and graduated with an economics degree and a law degree, then spent almost five years as a lawyer at the crown solicitor’s office. Then in 2002, when Labor won government, I was in my late twenties, a young crown lawyer and they were looking for government lawyers to be members of the Labor party to help new Ministers set up offices. So just by coincidence and very good luck and circumstance, I helped set up office for the then Aboriginal Affairs Minister and went on for the four years before he passed away to be his Chief of Staff. I can remember thinking pretty early on working for him that the way I wanted to make a difference in the world wasn’t by being a lawyer, it was through that intersection of politics and Aboriginal affairs policy. So nearly 20 years ago I thought this is what I would love to do, what my boss, the then Minister for Aboriginal Affairs did, and with some very good fortune I’ve been able to do that.

So that position made you think about what you would want to do within the Aboriginal sector?

Yes, absolutely. It certainly occurred to me quickly just how difficult this area of public policy is. A lot of people have turned their minds to overcoming the huge levels of disadvantage and discrimination so many Aboriginal people face, and yes, we have made steps, but it’s slow going. Each year when Federal Parliament tables the closing of the gap report, you see that their progress has been slow, but it occurs to me that some of the most difficult things are the most important things. And I think that certainly is the case with Aboriginal affairs policy.

An area you have plans around is, of course, the Uluru Statement from the Heart – Voice, Treaty, Truth?

Absolutely. I remember well when the most involved consultation that’s ever happened with Aboriginal Australians culminated in the Uluru Statement from the Heart in May 2017.

It was a really exciting time. I was at the Garma festival in East Arnhem Land soon after it was released and the feeling there was what I imagine the feeling preceding the 1967 referendum was. There was so much positivity, so much cause for optimism; these are the next steps, things are going to change. It was only a short time afterwards that then Prime Minister Malcolm Turnbull basically said no, we’re not doing that. It really was crushing.

In 2019, talking to the now Premier Peter Malinauskas, we decided that we couldn’t wait for a federal government to decide to take this up. We needed to do something if we got elected. So three years ago we made a commitment that if we formed government in 2022, we would implement a state-based version of the Uluru Statement involving voice to parliament; a treaty process, which we were well on the path with before we lost government, and a truth telling process.

These are big but important commitments.

Indigenous leaders are calling for a referendum on First Nations’ voice to Federal Parliament within the next two years. Is a viable timeframe? What do you think needs to happen for this to occur?

Yeah, I think it is. I think it’s the important next step. The government of the day asked Aboriginal Australia what the next steps were, and this was a crucial element. It’s been five years since the statement was handed down. Now it’s time to get on with it. I was pleased to see ABC’s Vote Compass published updated figures recently, showing increased support with over 70% supporting a constitutional Aboriginal voice to parliament. The time is right; I’m looking forward to something happening over the next couple of years federally.

Let’s talk about the Aboriginal Heritage Act. A lot of people in South Australia feel it’s not adequate; that it’s not offering the protections it should. What do you think?

This has had a lot of national attention with what we’ve seen in WA with the destruction of extremely sacred Aboriginal heritage in Juukan Gorge, and elsewhere in Australia. It’s something we are looking at.

The Aboriginal Heritage Act was one of the first schemes in the country when it came into force in South Australia in 1988. It is in need of updating after 35 years, and land use proponents where the mining companies are, I think, recognise that it probably needs updating as well.

Looking at the fines that are imposed, there’s the specific performance of how you remedy those, but also how Aboriginal people have more control over their own heritage. There were amendments that passed about five years ago to institute regional Aboriginal heritage bodies so that, rather than it just be a minister of the day saying yes or no, you can damage this to have this wind farm or road or whatever is go ahead, actually give some control and power back to Aboriginal groups to be able to discuss and negotiate with developers.

So, it will be updated?

I think yes, there will be updates. I’d like to see progress made on some of those provisions about regional heritage bodies, but I’d also like to talk to my Federal Labor counterparts and see how we can take the best elements from different states and have a more consistent system around Australia for Aboriginal heritage protection.

Lastly, why is it so important for Aboriginal people to be involved in the design of these decisions from the forefront?

I can remember former Premier Jay Weatherall who held the Minister for Aboriginal Affairs portfolio early in his career chatting to me when I first took it over.

One thing he reflected on, which has certainly been my experience after 20 years working in and out of Aboriginal affairs, is that policies and services for Aboriginal people just don’t work if they aren’t at the front driving them. If Aboriginal people don’t get a say in the decisions that directly affect their life, there’s little chance of success. And that was the experience when we started treaty negotiations with Aboriginal nations. One big thing that came up consistently as part of signing agreements with the State Government, was that enforceable mechanisms should be part of the decision-making process for Aboriginal people in areas like health, education and the justice system. It is absolutely critical. We will just repeat mistakes of the past if Aboriginal people aren’t at the forefront of designing the programs that affect their lives.

Is there anything else you’d like to say to the Aboriginal community of South Australia?

It is such a privilege to do what I do.

I used to get asked when I was last minister, Aboriginal affairs, how I find the job. And I used to be honestly able to say that there’s not a morning I’d wake up, that I could think of something else I’d rather do. It is a remarkable privilege and we will do everything we can to repay the faith that Aboriginal people have, who have voted us into government.

Modernising Aboriginal and Torres Strait Islander Cultural Heritage Protections My peers on the First Nations Heritage Protection Alliance, including its co-chair, Gamilaraay woman Cr Anne Dennis, are keen to see reform after the engagement process is complete.

This time, the Government needs to actively listen to Indigenous people who have already identified many of the issues that lead to the destruction of our sacred sites.

Cr Dennis put it well when she said:

“First Nations people need to be in control of our cultural heritage, and our free, prior and informed consent should be obtained in any dealings with that heritage.”

In the past 30 years, there have been at least five previous reviews into both the ATSIHP Act, and the cultural protections provided in the Environment Protection and Biodiversity Conservation Act 1999.

Recently the First Nations Protection Alliance and the Australian Government released a discussion paper on the modernisation of Aboriginal and Torres Strait Islander Cultural Heritage.

They also started a national engagement process that is asking First Nations people and relevant stakeholders how the Government can protect Indigenous cultural heritage.

Firstly, the Aboriginal and Torres Strait Islander Heritage Protection Act 1984 (ATSIHP Act) needs to be replaced with more comprehensive legislation.

Following the national engagement process due to be complete in October, a report will be put to the Minister for Environment and the First Nations Heritage Protection Alliance, who will then consider the reform options.

I hope this review will result in much needed systemic change and specifically the development of national heritage standards.

I would also urge all groups in SA to read the document, Dhawura Ngilan, developed by heritage experts in Australia and New Zealand. This document provides a vision for the management of Aboriginal culture in a way that recognises and celebrates people and culture.

More than just Rusted Tin

Scott Rathman is the contemporary Aboriginal artist behind the name Rusted Tin, and a cultural learning consultant who integrates his heritage with modern-day stories through colourful, recognisable artworks on everything from largescale outdoor murals to coffee mugs.

“What I really like about largescale work is that it’s a way of reminding non-Aboriginal people that we’re still here and that our culture is still as important today as it has always been.”

His larger work can be seen on corrugated iron fences, sheds, roller doors, brick walls and most recently a scooter pump track in Whyalla. Scott sees his work as a modern version of the rock art and cave paintings that distinguished Aboriginal art of the past.

“I use a lot of swirls and line work that honours that sand painting style of telling stories that would have been used in a traditional sense for the learning that young people did with their Elders,” Scott said.

“But for me, it’s about telling stories.

I guess what’s unique about my work is that I’m not trying to tell stories of the past: I’m telling new stories about things that have happened in my life or lessons I’ve learnt or I’m helping tell the stories of the people I work with… In traditional Aboriginal art there’s lots of iconography; lots of symbols used to represent things. But rather than regurgitating that same stuff, I like to put a bit of effort into creating new iconography that’s more relevant to the stories we’re telling today.”

Born in Loxton in the Riverland region, Scott grew up in the northern suburbs of Adelaide, but his grandmother’s Country was the Arltunga region of the East MacDonnell Ranges and the Eastern Arrente people of Central Australia.

Every new piece of art he creates is in some way inspired by this grandmother, a member of the Stolen Generation.

“I think when you’re growing up you know you’re Aboriginal, but you don’t really have a good grasp of what that means… but then once you get to a certain age you start to question stuff and want to know more,” Scott said.

“Learning more and more about her past helps me get a better understanding of who we are. I guess the really important message from her was that that’s her story; it doesn’t have to be our story – we need to create our own story, not live hers.”

“The name ‘Rusted Tin’ comes from a representation or a symbolic gesture of the mission where my grandmother was; all that’s left is the rusted tin.”

“It’s me standing up and saying something and honouring her by creating my own new journey for myself. Not living her story or her journey but creating my own.”

Scott does a lot of work with schools because he enjoys working with young people and changing their perceptions of Aboriginal and Torres Strait Islanders.

He begins by asking them what Aboriginal people look like and is met with answers like ‘dark skin’, ‘paint on their bodies’ or ‘dark curly hair’. Scott doesn’t meet any of those criteria and is able to open a two-way dialogue and answer questions the students have.

“It’s starting to change now, but the images that are put in front of them (whether by us, as Aboriginal people, or by nonAboriginal people through teaching), is that we live in the bush; we’re running around in loin-cloths with paint on our bodies; we’re killing animals to eat.” Scott said.

“There are a lot more books and images out there now to change that perception, but a lot of it is because around Reconciliation Week and NAIDOC Week we roll out the dancers, all painted up with a spear and a boomerang or a digeridoo – and that’s the lasting image that young people have because that’s the only image they see. They don’t realise that there are Aboriginal people everywhere, doing all sorts of different jobs and careers. So just being there and being able to break that stereotype is a really important thing.”

Scott knows that positive interaction with an Aboriginal person is something that will stick with students as many of them go home and talk about the discussions they’ve had. He hopes that attitudes will start to change amongst young people from that.

Scott believes that changing one attitude at a time can be enough as it has a roll-on effect, as he illustrates by telling us the starfish story.

“There’s a girl walking along a beach where there are a lot of washed-up starfish.

She’s picking up starfish, one at a time, and throwing them back out into the ocean.

A guy comes walking along in the other direction and says to her ‘there are so many starfish all over the beach, you’ll never save them all!’ and she picks up one and throws it into the ocean and says, ‘well I saved that one’. The moral of that story is that you don’t have to change the world, but you can change one person at a time, in your own community.”

Scott also intends to help other Aboriginal artists create and sell their work through his gallery and shop, Sugarbag Creative, where people can pick up their own piece of original Aboriginal art.

“There are times when you’ve just got to stand up and say something.

If you’ve got a strong voice, then you need to speak up, because you’re the voice for the people who don’t necessarily feel that they have a strong enough voice to speak up… you don’t have to be a big public voice, you can be a voice in your own community.”

Digital map will reveal historical locations of colonial violence

Reconciling with the Frontier is an opportunity for Aboriginal people to share historical accounts that have been left out of colonial records.

During the European invasion of Australia in the 1800s, violent conflicts broke out between settlers and Aboriginal people.

Now, researchers are working on a project called ‘Reconciling with the Frontier’ that will educate the public about the South Australian settler conflicts.

The research is being used to develop an online interactive map of South Australia that includes reports of settler violence against Aboriginal people from 1836 to 1900.

University of Adelaide researcher, Dr Skye Krichauff (pictured above), has studied court reports, newspaper clippings, settler diaries, government records, and police reports held in the South Australian Library and State Records.

She’s discovered brutal accounts of murder, sexual assault and deaths in custody during the 1800s.

“Each Aboriginal group had different experiences, but overall, Europeans occupied Aboriginal people’s land and inevitably within one year or less, conflict broke out and Aboriginal people were killed defending their land,” said Dr Krichauff.

“We are very aware of the cultural bias of the newspapers (from the 1800s). When we are looking at the written records, they’re all written by the colonists.”

Dr Krichauff is asking Aboriginal people with any information to share their stories to help provide Indigenous perspectives that are missing from the archives.

“Across South Australia, Aboriginal people have oral histories about violence, and we think it’s important to include that on this map so that it’s a resource for future generations.

“Transcripts and audio recordings will be provided to interviewees for checking and approval before being made available outside the research team.”

The University of Adelaide research team works in partnership with History Trust SA, the South Australian Museum, the State Library of South Australia, State Records of South Australia, and Reconciliation SA. The online map will launch in early 2023.

Teaching Ngarrindjeri language and culture in Riverland School A local Elder, Uncle Barney, also comes in some weeks and talks to the students about the importance of treating one another with respect, linking his lessons to local dreamtime stories. He breaks down the stories by focusing on specific words from them and teaching the moral lessons behind them.

“It’s a bit of a hybrid, how we go about the class. We sit down with the other language teachers and ask them how and why they go about teaching languages. These teachers are so dedicated to what they do, and they absolutely love their work. This makes our job so much easier as they can help us link what we’re doing to the teaching framework. They also help us understand better why language is so important and how to keep it alive.”

Just like a French or Japanese class, the students’ grasp of Ngarrindjeri will be properly assessed at the end of the school term. This comes with its own challenges, as Daniel explains.

“We were slowly trying to get something in the curriculum that involved Aboriginal culture, and our best way in was through a language class,” said Daniel Giles, Aboriginal Officer at Renmark High School, about the introduction of a Ngarrindjeri language and culture class in year eight at the Riverland school this year.

There’s been so much interest in the class they’ve had to split it to teach half the year eights in the first half the year and the other half in the second.

“It’s about showing them how language affects people, rather than learning certain words… One word in Ngarrindjeri might have four different English meaning words.

It’s all about context too – how you’re saying it, and who you’re saying it to.” Daniel is a Ngintait Nganguruku Yankunytjatjara man who’s worked at Renmark High School for about five years.

“Unfortunately, we don’t know the local language here (Erawirung) that well, so we decided to teach Ngarrindjeri as the language, as that’s what most people around here do know. That’s something that I teach the students; the language we’re speaking is not actually from here, but it came here, and everyone picked it up, so we’re going with what we know,” Daniel said.

He goes on to share that the local Aboriginal community is in the process of trying to revive the local language in the Riverland, and he hopes to be able to bring it into schools from there.

Daniel thinks the considerable interest is because he and the Aboriginal Education Teacher, Martine Turnbull, built relationships with a lot of the students by working at some of the local primary schools in the region over the last few years.

“They know that our teaching methods are a bit different, and they find it a bit fun.

Generally, just knowing us and having that relationship with us helped. They’re going to learn about Aboriginal culture not just by sitting and reading a book but by doing a lot of outdoor stuff as well. There’s lot of contextual teaching.”

“When I’m leading the class, I don’t get them to put their hand up because that’s not how I’ve been taught through my language and culture. I teach them about respectfully saying something and making sure everyone has an equal say but making sure you don’t butt into other people when they’re speaking.

It’s totally different to what they do in most other classes – in every other class!”

“Because Aboriginal languages are not really written languages, we’re trying to figure out how best to assess students without them having to write the language.”

“There could be two or three different ways to write one word. That’s something I’m trying to teach them; it’s not a one shoe fits all when it comes to Aboriginal language.

If I live here, I’m going to say it this way.

You could only live 10 km down the road and you might say it differently because that’s how you were brought up. There’s never usually a wrong answer if you’re asking two people from the same language group; they might just have a different swing on it because they were taught a bit differently. We really wanted to teach the kids to be proud of their identity and language is a big part of that.”

While it’s not without its challenges, Daniel believes the Ngarrindjeri program is a good starting point which is just that; the beginning of what could come.

“I think everyone’s just happy we’re doing something with it. It may not always be right; you may not always agree with it, but I think everyone’s just happy something is happening.

And this is just the start. We’re going to nail this out over a few years, I think. It’s going to be an ongoing thing. We’re always going to be trying to perfect it.”

Applications open for Pirku-itya, SA Water’s 2022 Reconciliation Partnership Program Don’t miss your chance to access up to $10,000 in funding for a community project or event that contributes to reconciliation in South Australia.

Pirku-itya, SA Water’s 2022 Reconciliation Partnerships Program, has opened for applications providing support for not-for-profit organisations that contribute to reconciliation in South Australia.

Pirku-itya, a Kaurna word meaning ‘for community’, is a program which runs annually and is available for organisations to apply for sponsorship of up to $10,000 per partnership.

As part of SA Water’s Stretch Reconciliation Action Plan 2020–2023, the program provides an opportunity for projects and events that support stronger communities through reconciliation-based activities and have a clear link to water use and SA Water’s vision of delivering trusted water services for a sustainable and healthy South Australia.

Pirku-itya has a tangible positive impact on the important work of local community organisations.

A recipient of the 2021 program was Housing Choices SA, which used partnership funding to increase

knowledge, skills and social inclusion for residents by creating regular financial literacy education sessions.

The Glossop community in the Riverland was also successful in receiving funding and worked together to create an Aboriginal cultural garden reflecting Aboriginal culture of the past, present and future.

The garden provides a space for Aboriginal students, their families and the wider community to engage in cultural activities and sustainable practices that create pathways for educational and cultural opportunities in the spirit of reconciliation.

Pirku-itya provides a valuable opportunity to build meaningful partnerships and connections with SA Water and the community.

iDreaming TV iDreaming tv is a South Australian Indigenous screen and new media arts organisation which has just launched a brand new online channel, dedicated to showcasing Aboriginal and Torres Strait Islander artwork and media content.

Funded by the Australian Government’s Indigenous Languages and Arts program, the online channel 12 years in the making aims to change the landscape for Aboriginal artists by offering them a platform where they can display or sell their work and connect with other artists. iDreaming tv is the result of a strategy called ‘In Front of the Future’, the Aboriginal and Torres Strait Islander Screen and New Media Arts Strategy for South Australia 2020–2030, which came from Aboriginal and Torres Strait Islander individuals, agencies and community organisations across SA surveyed.

Coming together for Closing the Gap Day this May You’re invited to a free, family friendly Closing the Gap Day event welcoming Aboriginal and Torres Strait Islander people of all ages and mobs.

This news is welcomed as the large indoor and outdoor spaces will allow a more relaxed atmosphere with COVID restrictions easing.

With hundreds of stalls to browse, a deadly lineup of entertainment and a free shared lunch for all to enjoy, there is something for everyone in the family.

This year, Sonder is also hosting a Nunga Marketplace where First Nations businesses and creatives will sell artworks and other merchandise.

Kids and young people will have the opportunity to participate in cultural and fun activities as well as ‘Chill-space,’ a special activity area hosted by SA headspace centres.

Live entertainment in the past has included musicians, comedians and dancing groups. This year, Sonder is anticipating another deadly program of performers on the main stage.

Closing the Gap Day is a time for all Australians to come together and commit to achieving health equality for Aboriginal and/or Torres Strait Islander people. The event provides an opportunity to experience Aboriginal culture and learn about services available across South Australia to support Aboriginal people to improve their health, wellbeing and other areas of their lives.

Sonder is a not-for-profit organisation that has been helping people live better lives by providing high quality care, health and support services since 1993.

Sonder’s range of services includes mental health counselling, addiction services, Aboriginal health and employment support.

This annual event brings all these important services together in one place to share information and provide the public with the opportunity to have a yarn with the people behind the services.

“Closing the Gap Day is about empowering the Aboriginal and Torres Strait Islander community to make informed decisions over their own lives.

This celebration is one way to bring the community together, to have fun and to increase the awareness of Aboriginal people’s health needs,” said Sageran Naidoo, CEO at Sonder.

Sonder has celebrated Closing the Gap Day annually for the past eight years, across different regions of South Australia.

In 2022, with the event growing more popular, the event is being held on Kaurna Country at Adelaide Showground in the Jubilee Pavilion.

Nunga Screen 2022

A free showcase of First Nations film and culture right across South Australia during National Reconciliation Week 27 May–3 June 2022.

Nunga Screen (formally Black Screen) is an annual celebration of First Nations culture, stories and language through the screen. Running right across regional South Australia, Nunga Screen provides the opportunity for established and emerging First Nations filmmakers from around the country to showcase their films to a wide audience.

Ngarrindjeri filmmaker Josh Trevorrow returns to program the event for the second year running in 2022. This role allows him to further grow the platform for uniquely First Nations stories and talent, something he is passionate about.

“Film, visual media and other forms of digital content are such powerful mediums for storytelling, and the accessibility means so much more freedom for filmmakers,” said Josh,

who last year was awarded the highly competitive Documentary Australia Foundation’s Centralised Indigenous Fellowship, established to support the professional development of First Nations documentary filmmakers from South Australia or the Northern Territory.

Nunga Screen’s entertaining program will feature independent films for all ages, from inspiring documentaries and dramas to quirky animations.

The films will be shown in a variety of locations around South Australia during Reconciliation Week, from town halls to cinemas.

Schools: Teachers are encouraged to book in their students and talk to their local venue about other classroom activities that could contribute to Reconciliation Week and the Nunga Screen events – from a music or dance performance to making short films to creating artwork about Reconciliation for display on the venue walls. Contact your local venue to discuss your ideas.

Aimed at kids aged seven to 12, readers of any age would enjoy a book that encourages an appreciation of science and respect for Indigenous knowledge.

Six main chapters cover astronomy, engineering, forensic science, chemistry, land management and ecology and introduce readers to ‘scientists’ of the past and present day.
