MEMBERSHIP

With over 1,650 members, NAIOP Massachusetts membership is at an all-time high and remains the largest chapter in the nation. The Chapter has reached record numbers for individual, corporate, and Gavel memberships. NAIOP’s strength in recruiting and retaining members is due in large part to a very active and creative Membership and Marketing Committee, with support from the Board of Directors and staff.

STUDENT ASSOCIATION MEMBERSHIP - NEW! With the help of the Developing Leaders Committee, the Chapter launched a Student Association Membership (SAM) for currently enrolled undergraduate and graduate students. The goal of this membership plan is to develop university partnerships, and introduce local students interested in real estate to the Chapter through networking events, career development panels, and a Developing Leader Ambassador Support program. A kick-off networking social took place in October on the rooftop at the Viridian in the Fenway and the Chapter has already seen an increase in Student members.

GOVERNMENT AFFAIRS

ADVOCAT E + I NFLUE NCE As the voice of the commercial real estate industry, NAIOP fights tirelessly to encourage economic growth and development in Massachusetts. If laws, policies or regulations affecting the industry are being considered, NAIOP is at the table, providing members with strong and effective representation. NAIOP works to ensure legislators and regulators understand the industry’s key issues and the government affairs team works to enact important changes. The year brought the start of a new legislative session on Beacon Hill, a new Senate President, and a new governor. The Baker Administration introduced new cabinet secretaries and commissioners. All of these changes, combined with an unforgettable winter, resulted in noticeable shifts on Beacon Hill. In 2015, NAIOP aggressively worked to shape a wide range of regulations, policies, and legislation affecting the industry. The following are just some of this year’s government affairs activities:

ADVOCACY • Developed a detailed briefing book for the Baker Administration on important policy issues affecting the commercial real estate industry including transportation, housing, climate change adaptation, and more. • Met frequently with new cabinet secretaries and commissioners to provide input on draft policies and to discuss issues of interest to the real estate industry.

DID YOU KNOW? NAIOP represents the interests of all product types.

• Filed Motion to Intervene in Conservation Law Foundation, Inc. v. United States Environmental Protection Agency. The plaintiffs in the case sought to create a costly new stormwater permitting program for many commercial and multifamily properties in 35 communities. The plaintiffs dropped the suit shortly after NAIOP filed its Motion. This will remain a top priority for NAIOP in 2016. • Provided extensive input on draft 9th edition of building code and changes to the energy code. NAIOP held an educational session for members on the draft codes, met with regulators, and will provide detailed written comments when it moves to public comment next year. • Created and helped lead the Coalition for a World-Class Public Transit System, 29 business groups who successfully advocated for passage of transportation legislation in response to the transit system’s failure during the winter of 2015. The legislation created an independent Fiscal and Management Control Board to implement needed reforms. • Provided extensive input and made substantial changes to MassDEP’s soil reclamation policy, designed to increase disposal and reuse options for soil from development sites. • Appointed to Baker Administration’s Economic Development Planning Council. NAIOP provided input on the Governor’s comprehensive economic development policy for the Commonwealth. • Joined New England Coalition for Affordable Energy. The Coalition issued a study illustrating the economic impact of failing to build adequate energy infrastructure in the region. • Fought new carbon monoxide requirement for commercial properties. NAIOP successfully opposed budget language that would have required carbon monoxide detectors in nonresidential buildings in areas containing any device that burned fossil fuel. • Submitted detailed technical comments on the Draft Massachusetts Small Municipal Separate Storm Sewer Systems (MS4) General Permit. • Appointed to a special Senate Committee on Housing. The Committee was created to “engage in a comprehensive review of housing policy in the Commonwealth” and is made up of members of the Senate, the administration, advocates, academics, and business representatives. • Sought feedback from Gavel members on creative solutions to produce middle-income housing. Met with representatives from Baker Administration to discuss concepts and next steps.

• Supported Governor Baker’s Executive Order 562, which initiated a comprehensive review process for all regulations. Provided detailed suggestions on regulations in need of reform. Appointed to MassDEP’s EO562 Advisory Committee to provide input on the agency’s Regulatory Reform Initiative. • Participated on numerous climate change task forces, often as the only representative of the business community. Submitted detailed comments on MEPA’s Draft Climate Change Adaptation and Resiliency Policy, and proposed alternative approach to regulating the issue. Opposing climate change legislation that, if passed, could halt development. NAIOP will continue to advocate for flexible adaptation strategies and a shared response between the public and private sectors. • Proposing changes to MassDOT access permit regulations to ensure increased predictability and certainty for developers. • Representing industry on newly formed Department of challenges affecting development in Massachusetts.

Public Utilities Commission designed to address utility delays and

• Filed new legislation to address a wide range of issues including energy, transportation, brownfields, and more. Met with legislative leaders and new legislative committee chairs on specific bills. • Tracking more than 200 bills before the Legislature affecting the real estate industry. Legislative advocacy will continue through the close of the legislative session in July 2016.

EDUCATION: INCREASING AWARENESS Educating NAIOP members on the various government affairs issues that affect the industry is a vital part of the association’s mission. This year NAIOP continued its very popular government affairs series with the following educational programs: • Transportation Conference: The Road to Change & Economic Growth - The event included presentations by representatives from the U.S. Department of Transportation, EOHED Secretary Jay Ash, MassDOT Secretary Stephanie Pollack, the U.S. Department of Housing & Urban Development (HUD), and industry experts on the trends that will shape the needs of the nation’s transportation system over the next three decades and the role of transportation in a growing Massachusetts economy. • Lunch with BRA Director Brian Golden - Golden discussed the recent operational review of the BRA, the agency’s action plan for reforming the management, culture and operations of the agency, and what it means for real estate development in Boston. • Government Affairs Roundup - This event featured a presentation by MBTA General Manager Frank DePaola on how the T is preparing for winter, as well as a presentation on legislative and regulatory changes affecting the real estate industry.

POLITICAL SPEAKERS In 2015, NAIOP developed and strengthened relationships with the new Baker Administration, legislative leaders, and City of Boston officials. NAIOP met with members of the Administration and the Legislature to communicate its concerns and advocate for its agenda. Government affairs committee meetings, events, one-on-one meetings, and Gavel programs featured: Governor Charlie Baker; Lieutenant Governor Karyn Polito; Speaker of the House Robert DeLeo; Senate President Stan Rosenberg; MassDOT Secretary Stephanie Pollack; Executive Office of Housing & Economic Development Secretary Jay Ash; Executive Office of Energy & Environmental Affairs Secretary Mathew Beaton; MassDEP Commissioner Martin Suuberg; MBTA General Manager Frank DePaola; Boston Mayor Marty Walsh; Boston Redevelopment Authority Director Brian Golden; and Boston’s Chief of Environment, Energy & Open Space Austin Blackmon.
