DIMAPUR/KOHIMA, FEB 11 (NPN): Joint Co-ordination Committee (JCC) and Nagaland Tribes Action Committee (NTAC) have called for a total indefinite state-wide bandh starting Monday (February 13). from 8 a.m. to 5 p.m. The bandh in Dimapur will be enforced by DNYF while in Kohima AYO will enforce the bandh from 6 a.m. to 6 p.m. Co-convenor JCC Vikhosayi Nyekha told media persons that the bandh from Monday would be enforced on the district administration and police in addition to the ongoing shutdown on all government offices and prohibiting the plying of government registered vehicles. There will be no relaxation whatsoever for those not exempted from the purview of the bandh, and JCC appealed to government employees to bear with the bandh. However, JCC did not mention about imposing restrictions on train and air services in Dimapur. The following would however be exempted from the purview of the bandh-paramilitary forces, invitees

to weddings on production of invitation cards, funerals, press, medical (ambulance and private vehicles carrying patients), postal services and fire and emergency services. The JCC has also requested volunteers to maintain strict discipline and not to consume alcohol while enforcing the bandh. Further JCC also reiterated the bandh will be non-violent and urged JCC volunteers not to cause any damage in any manner to public properties. Meanwhile, JCC has also expressed its resentment over the transfer of former police commissioner Dimapur which it did not consider as a punishment but routine transfer. JCC also called upon the tribal hohos to enforce the bandh in their respective jurisdictions. KOHIMA: AYO has called for bandh in Kohima starting February 13 from 6 a.m. to 6 p.m. in response to NTAC and JCC’s clarion call to intensify the agitation in view of chief minister, T.R. Zeliang’s failure to own moral responsibility and to step down for the event that led to the death of innocent Naga youths.

Reiterating its full support for the bandh, AYO appealed to all right thinking Nagas to bear with the bandh and extend support to the movement. In a press note, AYO president Neinguvotuo Krose and general secretary Kekhrie Pfukha have called upon all Angami villages and its entire populace with the exception of the elderly and juveniles to be prepared for any eventuality. The following have been exempted from the purview of the bandh— press media and newspaper hawkers, paramilitary, administration on duty, medical, North/South police station under SP Kohima office, students appearing exams and teachers on exam duty. Meanwhile, AYO has called for a meeting with the presidents/representatives of all colony youth organizations of Kohima town at APO hall on February 12 at 2 p.m. Other districts were also going to launch the indefinite bandh, sources informed. Adds Correspondent, Kohima: Nagaland has been on the boil after the indefinite statewide bandh imposed since January 28,2017 in protest against the state government’s refusal to postpone ULB elections as demanded by apex Naga tribe organisations. Since January 31 night, there was hardly any presence of the government law and order machinery in both Kohima and Dimapur as tensions ran high . By February 1 night, the situation reached its highest boiling point as the anger rose against the government headed by chief minister T.R. Zeliang over police firings and deaths of two youths. When there was no sign of any positive response from the government over the demand, it ignited a few hundred who resorted to arson on February 2,2017 by torching government buildings and vehicles. By February 2 it was total failure of government law and order machinery as Paramilitary forces were asked to patrol Dimapur and Kohima and Army asked to stand by. Since January 28, no government office was able to function and leaving employees without salary especially at a time when new admissions were on for children education. The central government appears to have taken a totally different view of the situation in Nagaland. According to sources, the centre viewed it as a conflict between those supporting the constitution (74th amendment for 33% women reservation) and those against the constitution (against 33% women reservation vis-a-vis Article 371A). With apex tribe organisations asking their elected members to withdraw support to T.R. Zeliang, it remains to be seen whether the MLAs will pay any heed. The NTAC and JCC have also indicated that they would not mind if the present crisis can be defused if the Governor acts in accordance with the remedy provided in the constitution (Article 356) since there is total breakdown of the law and order machinery. It was learnt that the Governor has already sent his report to the centre but it appears that it contained only about the prevailing situation and might not have contained recommendation for bringing about remedy. Meantime the Governor’s efforts to bring all stakeholders to a dialogue has failed as tribe organisations have stayed away from any meeting with the chief minister.

DIMAPUR, FEB 11 (NPN): In a significant political development, four NPF legislators have urged upon the NPF president, Dr. Shürhozelie Liezietsu to revoke the suspension of membership from the party on former chief minister and current LoK Sabha, MP Neiphiu Rio and former minister, Imkong L. Imchen, MLA. The two had been suspended for alleged antiparty activities by the party president on the recommendation of the NPF Disciplinary Action Committee (DAC). Rio was suspended on May 17, 2016 and Imchen on April 14, 2016. In a letter to the NPF

They acknowledged the fact that Rio had gone to Delhi as an Member of Parliament (Lok Sabha), in the greater interest of the Nagas and to strengthen the peace process in order to facilitate in bringing about solution to the political problem. However, since the situation had gone out of control, the MLAs told the NPF president that they have appealed Rio, as the

National Democratic Alliance (NDA) government in Delhi, for the greater interest of peace and development in Nagaland. The four MLAs said their views, advice and opinion were being put across not just on their individual capacity but as a result of their interactions with elected members, people’s representatives, leaders of masses and cross sections of society. They further reminded the president that the need of the hour was for the government to listen to the voice of the people and to respond in a positive manner so that peace, order and administration could be restored as early as possible.

Zeliang’s attitude shocks JCC, NTAC KOHIMA, FEB 11 (NPN): Nagaland Tribes Action Committee (NTAC) and Joint Coordination Committee (JCC) on Saturday said they were totally appalled by the “apathetic and inhumane attitude” of chief minister T.R. Zeliang. They said, “in his adamant stand”, Zeliang has refused to step down as chief minister even after the expiry of February 10 deadline, based on the numerical support of the legislatures and vehemently ignoring the voices of the people. On CM’s claim that he had met their demands, they questioned how did he “even imagine forgetting the barefaced betrayal to JCC and NBCC and the loss of precious lives of three innocent Naga youths?” The committees also expressed shock at elected members, who they said appeared to have no iota of conscience on the issue. They said the elected members have “surprisingly” also gone against the people and continue to support TR Zeliang “whose act of betrayal has led to the loss of pre-

Patton alleging that the latter’s statement on January 30 agreement was a “blatant lie”. NPF said Supu, spearheading the on-going agitation, should spell out what exactly he meant by that, when Patton had merely quoted the “January 30th Statement”. Instead of resorting to fancy phrases and playing around with words, NPF asked Supu to confine himself to a simple yes or no and point out if the “January 30th Statement” produced verbatim by Patton was the one on which he along with the representatives of the NBCC and the state government had appended their signatures, or otherwise. NPF has asked Supu to either dispute or admit

CHENNAI, FEB 11 (AGENCIES): As the power struggle within AIADMK intensified, party general secretary VK Sasikala on Saturday indirectly accused Governor C Vidyasagar Rao of delaying the proceedings to form the government. “The created time lag looks like it was intended to create a split in the party,” AIADMK tweeted quoting Sasikala. The party general secretary also expressed she was happy after meeting her MLAs and added that all the legislators are with her. “We were waiting patiently till this moment for a reply from the honourable Governor,” AIADMK quoted Sasikala as saying on its official Twitter handle. Sasikala also said

her party would begin a new kind of protest from tomorrow onward. Earlier in the day, Sasikala met her MLAs at the Golden Bay resort in Kuvathur where they have been allegedly corralled into, in order to prevent any horse trading. However, Raj Bhavan continues to delay its decision, plunging the state into uncertainty. Meanwhile, Security has been beefed up in Chennai with intensified patrolling and checking of places of accommodation to prevent anti-social elements from creating any law and order issues, police said on Saturday. “The officers of Chennai Police have been instructed to conduct roundthe-clock checks of lodges, mansions, service apartments and kalyana mandapams (marriage halls) to prevent anti-socials and rowdy elements from taking shelter with the intention to create law and order issues,” a police release said. DIMAPUR, FEB 11 (NPN): About 1.5kg of suspected brown heroin worth Rs.1.5 crore in the national market was reportedly seized by Kohima police Phesama check gate, Kohima on Saturday. According to Kohima police PRO, the seizure was made by police personnel while performing routine frisking duties from the possession of one Kailash Dangi (36), son of Mangilal of Khuri village under Rajgarh district, Madhya Pradesh.

PRO said the contraband was found neatly wrapped and packed in a brown envelope and concealed inside an airbag. The arrested person was travelling from Imphal to Dimapur in a commercial vehicle (Tata Winger). As per the statement of the accused, the consignment was supposed to be delivered to a client at Kanpur bus stand. PRO said a criminal case was registered against the arrested person for conducting further investigation.

RSZ refutes T.R. Zeliang DIMAPUR, FEB 11 (NPN): Rengma Selo Zi (RSZ) has refuted the statement of chief minister, T.R. Zeliang that the Rengma Hoho (RH) had initially supported 33% women reservation but backtracked on the issue. In a press release, RSZ president, Kenneth Kath, and general secretary, Shatilo Kent, stated that they were surprised as to how the chief minister could make such an allegation. The signatories reminded the chief minister that the RH had at no point in time made any official stand on the reservation issue prior to the January 23, 2017 public declaration, wherein the hoho stood for boycotting Urban Local Body (ULB) elections. NPF said it “prayerfully appeal to all state holders to come to amicable terms for the sake of posterity, peace and tranquillity.” NPF media and press bureau also pointed out that “for over 5 decades since inception that NPF has, with all devotion as a regional political party, been struggling and striv-

ing for the welfare and all round security of the Naga people, striving against all odds, bitter hardship and sacrifices by successive leaders, courting torture and imprisonment during different past periods is no matter of joke.” It said the party has firmly held the responsibility of “protecting and preserving our identity through all weathers”. NPF said “it is tearfully painful that, despite this truism, today’s division amongst our society threatens to topple the Nagas society into the bottomless pit of degradation, shame, despair, helplessness and hopelessness.” “Today, we are faced with so much of unresolved problems, intensified by misunderstandings that imbed any possible solution, or rather; our social problems appear to keep multiplying with every passing day” stated NPF media and press bureau. It said that much has been deliberated and appeals made/disseminated through “all available systems to amicably settle the present imbroglio”.

A press note by NAAME president, Ruokuovikho Chale stated that the trek was undertaken along with NAAME institute as a continuation of Republic Day 2017 official visit.

The trek was to create awareness on the importance of environment. Altogether 34 participants undertook cleaning along the trek route. Importance of adventure and nature were discussed at the programme.

NPUCL on ULB polls & ‘mobocracy in the state’; appeals for peace DIMAPUR: Naga Peoples Union for Civil Liberties (NPUCL) has expressed dismay at the “lopsided reactions” of some Naga organisations and Naga human rights body over the undesirable situation of Nagaland state. Ibobi govt asks Centre to declare UNC as unlawful organization Correspondent

IMPHAL, Feb 11: In the backdrop of Centre’s decision not to hold talks with the agitating United Naga Council (UNC), Ibobi government has recommended the Centre to declare the Naga body as an unlawful organization. UNC has been imposing an indefinite economic blockade on the national highways in Manipur since November 1 last year triggered artificial crisis in the state. NE should reap dividend of Act East Policy

Shillong, Feb 11: North Eastern Council Secretary Ram Muivah said the people of the north-eastern states should reap the dividend out of India’s Act East Policy, which can only happen when the infrastructural issues are in place in the region. Addressing the 3rd Distinguished Lecture of the ASEAN Studies Center (ASC) funded by the Ministry of External Affairs here in Meghalaya, Muivah highlighted the need for more land custom stations in the north-eastern states to facilitate trade with Myanmar, Bangladesh and China. He also stressed upon the 186 kms missing link from the Indian side of the border which would otherwise connect the north east of India to Myanmar, Thailand and the rest of the ASEAN countries. “The public sector should play an important role in the infrastructural development in the region to lay fertile grounds for the private sector to invest in

the region,” he opined. In this regard, Muivah highlighted on the North Eastern Council’s role in facilitating infrastructural development projects in the region. Apart from road and railway connectivity, he touched upon how Gauhati should be the hub of air connectivity with the South-East Asian countries. Muivah also mentioned about how commerce can only thrive in a region where the infrastructure is in place, which unfortunately the northeastern region lags behind the rest of the country because of its geographical location. It is in this area that the North-Eastern Council is focused on working and he briefly mentioned the highway and road development projects of the NEC. Muivah also spoke on the cultural connect that India shares with its SouthEast Asian neighbours stressing on the potential for growth of tourism industry in the region. Citing the example of

an event to promote Indian culture and tourism which took place in Nepal named “Namaste Nepal” which was well received by the people of Nepal, Muivah spoke on the importance of promoting the tourism industry in the region. An important start could be a tour package for the north-eastern region which the NEC is looking to partner with the private sector to promote tourism in the region. Prof. M P Bezbaruah, who delivered the inaugural address pointed out that though India’s North-Eastern has contributed very little in India’s Act East policy despite its potentials, it could not be more apt for India to Act East through the North-East as India’s most important neighbours namely Bangladesh and Myanmar are looking to India for economic integration. The distinguished lecture was preceded by a documentary film titled, “This is Asia’s Time” which explored India’s trading and cultural ties with the SouthEast Asian countries.

The incident took place at around 2.30 am. “It is sad that the vested interest have target the school”, said Anamul Hoque, a resident of Chibinang. According to locals, the building was set ablaze from inside after the miscreants, who seemed to be looking for some documents did not find them. IMPHAL, Feb 11: Two persons sustained injuries and at least five structures including four houses were damaged in a clash between Congress and BJP workers in pre-poll violence in the poll-bound Manipur. Congress worker Kh Amo, who sustained bullet injuries on his left leg, was admitted at a hospital in Imphal while Koijam Thoiba sustained head injuries after he was allegedly hit with an iron bar. The clash erupted at Mayang Imphal in Imphal West district last night, around 9 pm. Generic medicine stores in Tripura hospitals

Agartala, Feb 11 (PTI): In a bid to supply generic medicines to people, Tripura State Co-operative Marketing Federation Limited (Tripura Markfed) and Bureau of Pharma PSUs of India (BPPI) have decided to open counters in all government run hospitals in the state. “The decision to open counters in all government hospitals in the state for supplying generic medicines among common people was taken yesterday in a joint meeting of Tripura Markfed and BPPI. We welcome this decision because common people would be able to buy medicines at much cheaper rates than com-

mercial medicine shops,” State Cooperative Minister, Khagendra Jamatatiya told reporters today. The task to run the stores for selling generic medicine was entrusted to Markfed and BPPI under Jana Aushadhi Sangsthan scheme, he said. Generic medicines are now available in eight hospitals of the state and 16 new shops would be opened in the same number of hospitals by March this year. “Markfed is now selling medicines worth Rs 20 lakh a month from eight counters. The commercial value of these medicines from branded pharmaceuticals cost about Rs 2.5 crore,” he added.

These flights would be operated from a separate terminal for civilians, which is almost ready, at the Advanced Landing Ground (ALG). Initially, the existing civil supply office building, adjacent to the ALG, would be used as an interim civilian terminal before a separate terminal within the ALG is set up, the officials said. Private airlines have also evinced keen interest to start operation from this month, they said. Local MLA Kaling Moyong along with East Siang DC Tamiyo Tatak, officers and engineers today visited the airport and inspected the temporary civil terminal which is nearing completion. Moyong said that the state government has resolved all pending issues and moving ahead on the work for it.

Phungzathang joins NNP

Imphal, Feb 11 (PTI): Phungzathang Tonsing, the veteran Congress leader who had resigned from the party, on Saturday joined the National People’s Party (NPP). In a reception function organised by NPP here, the National President of NPP Conrad K Sangma welcomed Phungzathang Tonsing. Earlier yesterday, Tonsing had resigned from the party without showing any reason. Tonsong was the president of MPCC and had been a minister in the Congress regime in Manipur for about 20 years but dropped from the present congress ministry in the recent past. Guwahati, Feb 11 (Agencies): The 43rd edition of Karbi Youth Festival will be held at Taralangso in Karbi Anglong district of Assam from February 15 next. “Our endeavour is to bring the diverse cultures and tribes of Karbi Anglong and its neighbouring places in one platform and showcase the unity in diversity,” Sum Ronghang, president of the reception committee said here today.

DGCA suspends GoAir engineer NEW DELHI, Feb 11 (Agencies): The aviation regulator has suspended the licence of a GoAir aircraft maintenance engineer (AME) for alleged lapses which led to the engine fire seen by eyewitnesses on ground and some passengers on a Bangalore-bound flight at Delhi on Wednesday night. A preliminary probe by the Directorate General of Civil Aviation (DGCA) has revealed that two AMEs’ negligence caused the engine trouble soon after the GoAir plane took off from Delhi to Bangalore with 193 people on board. GoAir, on its part, denied any negligence and said it followed the drill as prescribed by the engine manufacturer. “The Airbus A-320 new engine option (Neo) with Pratt & Whitney (P&W) engines was doing its first flight of the day on Wednesday morning from

Mumbai to Delhi. An hour into the flight, the cockpit got warning of low oil pressure in one engine. This was followed by a second alert for the same engine in the form of a ‘chip warning’,” said a senior DGCA official. The plane landed in Delhi safely. “After an engine gets a chip warning, the AME should have examined the same in the engine once it had landed. The condition of the part for which the second warning had come was such that the plane needed to be grounded. But the GoAir allowed the aircraft to operate under ‘minimum equipment list’ (MEL) for 10 hours,” said the official. Aircraft engineers routinely release planes for flight under MEL which means that the fault is such that aircraft can be operated for some more time before rectifying the same. This air-

craft then flew from Delhi to Leh where it could not land due to bad weather. It returned to Delhi and then flew to Guwahati; returned to Delhi and was scheduled to operate Delhi-Bangalore and Bangalore-Mumbai that evening. “The AME who released this aircraft for DelhiBangalore flight on Wednesday evening did not realise that the 10 hours the plane was supposed to fly under MEL would get over soon after take off. This plane had already done nine hours of flying after landing in Delhi that morning,” the official added. The plane would have done close to 14 hours by the time it was supposed to reach Bangalore. Soon after taking off for Bangalore, the engine had a fire scare and the plane had to return to Delhi to make an emergency landing after remaining airborne for 15 minutes.

No restriction on migration to Gulf countries: Government

NEW DELHI, Feb 11 (Agencies): The government has not imposed any restriction on migration to Gulf countries, but it has advised Indians not to travel to Yemen, the Rajya Sabha was today informed. It was done “in view of the security situation” in Yemen, said Gen (retd) V K Singh, Minister of State for External Affairs, in a written reply. As the situation grew out of control following a civil war in Yemen, India evacuated 6700 people, including nationals of 41 countries, in April 2015 under ‘Operation Raahat’. India also closed its embassy in Yemen after the operation. In response to a subquestion, Singh said, the government is monitoring the situation arising from ongoing economic downturn in the Gulf countries and is working in close coordination with the governments in these states towards extending all possible assistance to Indian nationals abroad. He said, a section of Indian workers presently facing difficulties in two major Saudi companies namely, Saudi Oger and the Saad Group are returning back to India. “The process is nearing completion and 4,830 Indian workers have returned so far. The Saudi authorities are extending necessary support to the affected Indian workers of these companies including in waiver of fines on ‘Iqama’ (resident permit) related violations, provid-

Lucknow/Khushinagar, Feb 11 (PTI): An estimated 64 per cent voter turnout was witnessed today in the first of the seven-phased Uttar Pradesh polls which passed off peacefully in 73 Assembly constituencies, barring some stray incidents of violence. Chief Electoral Officer T Venkatesh said at some places, there were reports of election slips being snatched, leading to pelting of stones and clashes. The turn out was estimated at around 64 per cent till the close of polling, he told a news conference here at the end of polling. The first phase witnessed a three per cent rise in voter turnout as in the same phase in 2012, covering these assembly constituencies, it was 61 per cent. Collective wisdom needed

A

t a time when people needed a resolution to the current impasse between the DAN government headed by chief minister T.R.Zeliang and the various apex Naga tribe organisations, the Nagaland Baptist Church Council (NBCC), perhaps after much thought, got into the act and managed to have both conflicting parties to sign a gentleman’s agreement on January 30,2017 in Chumukedima. Leaving aside who should be blamed for reneging on the agreement or who has been misinterpreting certain lines in print; the situation in Nagaland today is indeed more than volatile. After the agreement misfired, there were many who felt that the Church (NBCC) should have been very cautious in getting itself involved in the conflict. This was so because, there was no meeting point unless either of the two sides, agreed to give up their stand. However, instead, the church should have done more and perhaps in the coming days, go further to stamp its impact in the affairs of men. The role of the church in the affairs of men is of paramount importance since the biblical tenets amplify the purpose of the government. Both John the Baptist and Jesus refer to the political concerns of their day. In both the Old and New Testament God’s representatives spoke out against abuse of political power and sought just use of power. On the ongoing issue, the apex Naga tribes have made it clear that they will settle for nothing less than the resignation of T.R.Zeliang as the chief minister of Nagaland on moral ground whose handling of the ULB election issue had purportedly precipitated it into a series of incidents including loss of two lives in police firing on January 31. On the other hand, chief minister T.R.Zeliang remains defiant by maintaining that since he enjoys majority support of the DAN legislators in an opposition-less house therefore, there was absolutely no reason even to consider such a demand. Even here there is clear conflict of perceptions between morality versus constitutionality. The chief minister alone cannot be faulted for countering the issue of “high moral ground” with numbers that matter, at least in politics. The hardening of stand between the two opposing sides do not augur well for Nagaland as it could only further complicate matters and invite unwanted situations. There are many people who continue to pray everyday, some constantly for all sides so that each of them will humble down and agree to disagree but do the best for the rest. It is easy to expect easy and early solution as it appears that the present situation does not offer that opportunity after the failed January 30 agreement. Resolution is not simple and neither easy but it can still be achieved if a conducive environment can be created. One of the need is for restraint on the part of some people, who express their freedom too freely without a thought to the damage done to Nagaland, its traditional institutions and its people. Due to the inclination and also influence of such write ups, the Indian mainstream media projected the entire issue as denial of rights to Naga women by the “traditionalist Naga males” who have been accused of even going to the extent of using violence. This is indeed a gross misrepresentation and a disservice to the Nagas, that include both men and women. Every citizen of the state is obligated to give positive inputs to encourage collective wisdom to resolve the matter.

You will begin to see that your thoughts are from God as well, and your mind will no longer be at the mercy of your impulsive thinking, but will always be used in service to God. “We have sinned with our fathers…[and]…did not remember…” (Psalm 106:6-7). Then prod your memory and wake up immediately. Don’t say to yourself, “But God is not talking to me right now.” He ought to be. Remember whose you are and whom you serve. Encourage yourself to remember, and your affection for God will increase tenfold. Your mind will no longer be starved, but will be quick and enthusiastic, and your hope will be inexpressibly bright.

The actions of the government T to save Article 371-A

1. Article 243-T & Part IX-A of the Indian Constitution by 74th amendment inserted in the Constitution of India from the year 1992 providing 33% reservation for a period of 10 years and extended in 2012 for another 10 years. Nagaland was not exempted from the enforcement of this Act. 2. Central Govt. has directed the State Govt. to implement the Act and accordingly the State Govt passed the Nagaland Municipal Act (NMA) in 2001, however, the 33% women reservation was left out from the Act. 3. In 2004 election under Nagaland Municipal Act 2001 was conducted throughout the State except Mokokchung district and without 33% women reservation since 33% women reservation was not there under NMA 2001. 4. In 2005 Miss Khetoli filed a PIL in the Gauhati High Court Kohima Bench and the Single Bench of the Gauhati High Court directed the State Government to insert 33% reservation in the NMA 2001. 5. The State Government complied the Single Bench Gauhati High Court judgement by amending the NMA (Principal Act) in 2006 and 33% women reservation was inserted in the Act. 6. The 33% women reservation was not implemented because the ULB members who were elected in 2004 was for a period of 5 years and therefore their tenure came to an end only in 2009. 7. The Tribal Hohos and other civil societies opposed 33% women reservation and therefore the Government could not hold the election in 2009. 8. The State Cabinet decided to have a consultative meet with all the tribal Hohos and civil societies on 8.10.2010 at Kisama and divided into 2 groups. Group-A dealt on ownership of land and its resources vis-a-visright of the Government for public properties. Group-B dealt on reservation to ULB and election thereof. 9. In pursuance to the consultative meeting at Kisama on 8-102010, the State Cabinet directed the Urban Development Department to tour all part of the State for necessary consultations and soliciting the views of people. 10. Accordingly, the Urban Development Department conducted tour to the entire state in April 2011 and compiled the findings and submitted to the Govt. The Department recommended that since people are not in favour of holding elections with 33% women reservation, recommended for women nominees with voting rights in ULBs. 11. The Naga Mothers Association (NMA), Eastern Naga Women Organisation (ENWO)&

Naga Women HohoDimapur (NWHD) gave a representation to the then Chief Minister to implement 33% women reservation in ULBs by holding election. However, the women group are said to have asked by the then Chief Minister to bring court’sorder if they desired to have 33% women reservation. 12. The NMA filed a writ petition in the Gauhati High Court Kohima bench for implementation of the Nagaland Municipal Council Act 2001 with 33% women reservation in the ULBs as passed by the Nagaland Legislative Assembly in 2006. 13. The Single Bench of the Gauhati High Court WP (C) No. 147(K) 2011 judgement delivered on 21-10-2011 directed the State Govt. to hold election to the Municipal & Town Councils and to complete the entire process on or before 20-01-2012. The relevant portion of the judgement is reproduced below -para 36 of the judgement: “Considering the matter in its entirety, the Respondents (i.e.State Government) are directed to hold the elections to the municipal councils and Town Councils and to complete the entire process on or before 20.01.2012”. 14. The State Government appealed to the Gauhati High Court Division Bench and the Division Bench of Gauhati High Court stayed the order of the Single Bench by judgement order dated 31-07-2012. 15. The women group appealed to the Supreme Court through a Special Leave Petition in 2014 challenging the order of the Division Bench Gauhati High Court and also moved in the form of Additional petition against the Assembly resolution dated 22-092012. 16. The Government on its part constituted a Select Committee on 22-03-2012 headed by the then Parliamentary Affairs and Planning & Coordination Minister and submitted its report on 21-092012. The said select Committee was entrusted to scrutinize parliamentary laws for application to Nagaland also submitted its report on 21-09-2012 as directed by the then Chief Minister and legal Advisor that Article 243-T infringe Article 371-A. Accordingly, on 22-09-2012 the Nagaland Legislative Assembly passed a resolution moved by the then Urban Development Minister on the ground that Article 243-T of Part IX-A is not applicable to the State of Nagaland as it infringes Article 371-A. 17. The Supreme Court admitted the SLP of the women group on 5-4-2016 and stayed the decision of the Division Bench pronounced on 31-7-2012. In the SLP petition that has raised ap-

The setting aside of the Division Bench order by the Supreme Court means the order of the Single Benchof the Gauhati High Court stands and the State Government is bound to call election with 33% women reservation. 18. The Government while fighting the case in the Supreme Court did not seat back but conducted series of consultations with various Tribal Hohos and women organizations. In 2016 alone as many as 14 times consultative meetings with the various tribal Hohos and other civil societies including women group were held by the govt. 19. The Senior Advocate in the Supreme Court appearing for the Government opined that the best option is to arrive an amicable agreement with the women group and withdraw the petition by the women group since the State had enacted Nagaland Municipal Act 2001 and implemented by calling the ULB election in 2004. The Assembly resolution was merely an expression of intention to do something and cannot override the principal Act. The Govt. negotiated with the women group to go ahead with the election with 33% women reservation and on the part of the women group to withdraw the case to which they have already submitted withdrawal petition in the Supreme Court. 20. The tribal Hohos and civil societies opposing/agitating the ULB election with 33% women reservation has compelled the Government to declare the 21st December 2016 election notification to ULBs as null and void. 21. The issue before the Naga people to decide now is that the court direction to hold election with 33% women reservation still stands and if the Supreme Court pass any judgement interpreting Article 371-A from their own perspective it may endanger the sanctity of the Special provision given to the Nagas. 22. The Government effort is to save and protect Article 371-A from the court’s encroachment, however, by declaring the election null and void has given space for the court to take up the issue and pass any order from their own understanding. In the event of the Supreme Court passing any judgment diluting the provision of Article 371-A, in the near future, the tribal Hohos and other civil societies who are pioneering the present agitation should be held responsible by the Naga people. he unfortunate events currently taking shape in Nagaland calls for calm and cool contemplation with matured wisdom, if we are to avert further disaster from happening all over again. By now it ought to be sufficiently clear to the State Government that the people have determinedly crossed the river of no return. The situation has become extremely volatile because the subject, rightly or wrongly, revolves around a sensitively guarded Traditional Customary Laws and Practices that is protected under Article 371 A. Enough has been debated on it with varied legal interpretations and does not require repetition. Instead let us take a dispassionate look at our ground realities: 1. The agreement signed between JCC and the Government of Nagaland represented by the Chief Minister and his Home Minister in the presence of NBCC as a responsible third party witness, on 30th January 2017, was a very serious undertaking for all concerned not to childishly be trifled with. It should have honourably been upheld. Without doubt reneging on this agreement was the spark that set Nagaland ablaze. The beleaguered Home Minister trying to find that proverbial straw to save his drowning Government and his bearded face by saying: (Quote): “On the hindsight, the lapse on the part of all participants was that it was not discussed as to whether the postponement shall cover the entire State or only those towns/municipalities where the people were protesting against ULB election” (Unquote)[Nagaland Post February 10, 2017] is nothing short of a poor pathetic explanation that does not convince anyone. The need for the above hair splitting exercise was absolutely unnecessary for those with gray matter because the very basis for this coordinated meeting centred on temporarily suspending the ULB election process for two months. The fact that it was ‘not discussed’ was for the obvious reason that the subject covered not part but the entire State as a matter of a principle problem across the board. If Chief Minister and Home Minister were really confused as to whether the agreement covered partial or whole State, the responsible thing to do was to have it clarified from the JCC first before arbitrarily taking such a hasty action without honour and vitiate the atmosphere by tactlessly failing to perceive the foreboding current sweeping the shores even at that time. In this, NBCC as the third party witness ought to also explain their understanding of this agreement for public clarity. 2. Chief Minister was a party to this agreement. It was obligatory on the part of his Cabinet to abide by his decision and

not vote against this agreement under the principle of “Collective responsibility”. Technically speaking therefore this was as good as a “no confidence” vote against him. If for nothing else CM should have honourably and gracefully resigned on this one count alone. Reclaiming the endorsement of his Legislators for his continued leadership is of no real consequence when the talk is about “Moral responsibility” for all the unfortunate incidents that had been perpetuated under his watch leading to the death of our three sons. Remember what Mr. David Cameron, the Prime Minister of England, did after losing the Brexit plebiscite that he was campaigning against? He (not being a power/money hungry Naga), accepted the moral responsibility as an honourable man with principles and gracefully resigned on his own volition despite the full support of his majority Party MPs in the House of Commons and had every right to legally continue. That is what decent people term as a respectable sense of ‘honour’. If there is any “Honour” left in Nagaland we the people must stand together for a change and do the best we can to salvage it from the cesspool where it presently resides...before it finally dissolves. 3. The most glaring aspect in the present trying situation is the non-functional status of the Government machinery which has practically come to a grinding halt for the past 10 days signifying a clear breakdown of law and order situation that has spun out of Government’s control with no immediate end in sight. Coordinating interactive consultations and discussions with the traditional infrastructure including the Tribal Apex Hohos is the urgent need of the hour. However, judging from the determined stand taken by NTAC/JCC with the full backing of all the Tribal Apex Hohos, this is not about to happen as long as MR. T.R clings on to his rickety chair. Ignoring the traditional time bomb with a short ULB fuse that he has arbitrarily lit is going to make normal governance impossible from this point onwards with potential chaos in the making that could very well cause additional loss of lives in the event of his effort to make the Government machinery function. We are witnessing a fullblown Constitutional breakdown. This is perhaps more than sufficient a reason for the Governor to consider his prerogative and independently recommend PR based on the dangerous ground reality that is waiting to spiral out of control further if nothing tangible is done. The games people play through the prism of the 33% reservation for women

(From previous issue) These are some of the searching questions the public wanted the state government to clarify before proceeding with the election. The argument about getting generous fund for development of urban areas from the central funding once the reservation process is completed could not convince the people without further scrutiny, if it compromises on their rights affecting every Naga of both the gender. The cabinet had on 4th Feb.2017, curiously, decided to send a Memorandum urging the central government to initiate a constitutional amendment to this provision contained in Part IX-A, Art.243 (T) cl3. This is a meaningless exercise to buy time, as the process for any constitutional amendment is a very long drawn process and not likely to be considered for the state of Nagaland alone. In any case everyone knows that sending a Memorandum is not a solution to the current crisis between the people and the state government. Such an irrelevant action will only create further suspicion and mistrust. The Naga civil societies are genuinely worried and concerned how such an Act would be a compromise to their rights and interests of the future of the Nagas. But the adamant refusal to have the dialogue with the people compounded by the subsequent

u-turn on the tripartite agreement was not expected form a person of authority of the government. It was the last straw to end the TRUST of the people on the present elected government which is supposed to take care of the welfare and protect the interest of the people. The public anger was spontaneous and uncontrollable leading into avoidable bloodshed and the tragic loss of innocent lives. The mandator y constitutional provision, under the Art243 (T)cl3(74th Amendment 1992)say that;- not less than one-third (including the seats reserved for SC&ST women) of the total seats shall be reserved for woman. The main purpose of this general directive is to ensure adequate representation for the weaker sections like, the SC, ST and woman uniformly in all the ULBs in the country. How compatible is the reservation provision with the Naga tradition and customary practices. On critical examination, a question may be asked whether an exception can be possible exempting the applicability of this provision in Nagaland state be justifiable in view of the overriding constitutional guaranteed to the Nagas under Art.371 (A) on any matter relating to the Traditional and customary practices, religious practices, administration of civil and criminal justice and the ownership of land, transfer and its resources.

This is a comprehensive right given to the Nagas to protect preserve and regulate their lives in accordance with their traditions and customs. Though the municipality or Town Council is of modern Institution, it is established within the Naga territory and for the regulation of the lives of the Nagas, so it automatically attracts the right guaranteed. However, strict observance by the state government on the provisions relating to the Woman Reservation in Art.243 (T) clause(3), at the time of the last Amendment to the Municipal Act 2001, may have given an impression that the traditional and customary procedure is inadequate to take

care of Legislative requirement in today’s situation. Nevertheless, the procedure adopted in moving the bill for 33 % reservation for women, and subsequent passing as an amendment to the municipal act was inconsistent with the spirit of the rights guaranteed to the Nagas. Because it is considered as interference to the rights provided. Sadly, the adoption of the amendment by a unanimous resolution in the assembly in November 2016 legitimized its applicability in the State of Nagaland unless a corrective measure is taken in reversing the Act. Goa opposition raises doubts over en masse Army voting

Panaji, Feb 11 (IANS): Opposition political parties here have claimed that the BJP in Goa had forced the Indian Army jawans to cast votes in favour of the saffron party in the February 4 state polls. Leaders of the Congress and Goa Forward claimed that jawans from the 3 MTR camps located in Navelim in South Goa and the 6 TTR in Ponda voted in unprecedented numbers. They also said their party’s respective candidates were not allowed to canvas in the military cantonment areas. “Over 700 army jawans were suddenly registered as voters from the three MTR military cantonment area. This kind of voter registration and voting is unprecedented... This is nothing but a surgical strike on fair election processes in the state,” Congress state president Luizinho Faleiro and the party’s candidate from Navelim told IANS on Saturday.

“The reason for our doubt is that there was no verification about whether the army jawans were registered in their home states. They were just given voter cards,” Faleiro said, adding that a similar surge in voting was also noticed in Ponda constituency, where the 6 TTR regiment is based. “I was not even allowed to campaign or meet the registered voters in the army cantonment area,” Faleiro said, adding that a complaint had been made to the Election Commission. Goa Forward, a regional political party, has also

claimed that increased army voting in Navelim, should be probed by the EC. “How is it possible that over 600 army jawans are registered as voters on the last day of filing nominations? The booth level officers were not even allowed in the army cantonment areas to verify the identity of the voters,” Goa Forward spokesperson Prashant Naik told a press conference on Saturday. The BJP has, however, dismissed the allegations as baseless and complaints from political parties who were unnecessarily trying to politicise the issue. “Cong ress tries to politicise every issue. They should not do it. Army personnel have voting rights and if they exercise their right, then no one should object,” state General Secretary Narendra Savoikar told IANS. “In fact, they should be proud that army personnel exercised their rights,” he added.

Under the initiative, the Department of Archives, Archaeology and Museums, has started putting for public display a special museum object for each month. In the maiden series under the ‘Object of the Month’ initiative for February, Minister for Culture and Finance Haseeb Drabu unveiled the rare manuscript ‘Shahnama’ at Dogra Art Museum, Mubarak Mandi Heritage Complex. ‘Shahnama’ (the Book of Kings) is a long epic poem written by renowned Persian poet Ferdowsi. He started writing it in 977 AD and completed it on 8 March 1010. Consisting of some 50,000 “distichs” or

couplets (2-line verses), the ‘Shahnama’ is the world’s longest epic poem written by a single poet. It is the national epic of Iran and tells mainly the mythical and to some extent the historical past of the Persian Empire from the creation of the world until the Islamic conquest of Persia in the 7th century. Iran, Azerbaijan, Afghanistan and the greater region influenced by the Persian culture including Georgia, Armenia, Turkey and Dagestan celebrate this national epic. The work is of central importance in Persian culture, regarded as a literary masterpiece, and definitive of the ethno-national cultural identity of modernday Iran, Afghanistan and Tajikistan. “The initiative will facilitate display of rare and unique objects from the reserve collection of the museums in the state which could not be earlier displayed due to paucity of space in the museums,” Drabu said.

Reply to I-T queries on post IAF to launch AEW&C to pry on Pak, China note ban deposits extended NEW DELHI: The government on Saturday extended the deadline for reply to SMS or e-mail queries from the income tax department on cash deposits made post demonetisation by 5 days to February 15. “Time limit for filing of online response to cash deposit data extended! Now you can file your details by February 15, 2017, #Operation Clean Money,” the I-T department said in a tweet.

On January 31, the tax department had launched ‘Operation Clean Money’ under which it had sent SMS and e-mails to 18 lakh assessees in the initial phase for suspicious cash deposits of Rs 5 lakh and above made during November 9-December 30, 2016. These people had to reply to these queries by logging onto the e-filing portal of the I-T department within 10 days of receipt of communication.

BENGALURU: The Indian Air Force (IAF) will finally induct the first indigenously developed all-weather airborne early warning and control (AEW&C) system— ‘Eye in the Sky’— at the Aero India 2017, in Bengaluru, augmenting its ability to detect incoming cruise missiles, fighter jets or even drones from both Pakistan and China. The Rs 2,400 crore project will see the first aircraft inducted on February 14, while the second one will be delivered in a

TOI had first reported in January that the AeW&CS is ready for induction, and Defence Research and Development Organisation chairman S Christopher, on Saturday told reporters that the induction will happen at Aero India. Experts have pointed out that India is lagging behind in this aspect of defence capability in comparison with both China and Pakistan. Presently India has only three Phalcon airborne warning and control system (AWACS),

which uses the Israeli earlywarning radars mounted in domes on top of IL-76 aircraft. The indigenous AEW&C system, developed by the Centre for Airborne Systems (CABS) in Bengaluru and integrated on Brazilian-made Embraer145 aircraft, will add to the capabilities along with the three Phalcon systems. The system is equipped with a 240-degree coverage radars in contrast to the existing Phalcons, which provide a 360-degree coverage over a 400-km range.

The Serious Fraud Investigation Office has filed charges for cheating the exchequer after investigation of operators running a group of 49 shell companies and their proprietorship concerns. A charge is that 559 beneficiaries had laundered money to the extent of Rs 3,900 crore, with the help of 54 professionals. The information has been shared with the Special Investigative Team on undisclosed money, the income tax (I-T) department, enforcement directorate (ED), Securities and Exchange Board of India, and The Institute of Chartered Accountants of India (ICAI). The I-T department has reopened assessments in these cases and the ED has initiated action under the Prevention of Money Laundering Act. ICAI has also initiated disciplinary proceedings against its members involved.

The possibility has been expressed by Deloitte India in its report titled ‘Technology, Media and Telecommunications (TMT) Predictions 2017’. “Demonetisation has forced a behavioural change in the Indian consumer. While FinTechs used the ‘carrot’ approach to entice customers to switch behaviour and adopt digital payments, demonetisation employs a more draconian ‘stick’ approach, which may prove to be more effective,” the report, which was made available to ET, said. “Demonetisation may well be the catalyst that sees semi-urban and rural markets in India skip the ‘card’ era and leapfrog directly to ‘mobile payments’ era,” the report added. New Delhi, Feb 11 (PTI): RBI Governor Urjit Patel today exhorted banks to reduce their lending rates to push credit demand in laggard segments, saying banks have benefited from influx of low-cost deposits and its previous repo rate cuts. “One the amount of reduction in the repo rate that we have undertaken combined with the fact that banks have benefited immensely from the influx of deposits which are CASA deposits, that has come into the system. “And the weighted average lending rate reduction has been considerably less, given that we feel that there is some scope for further reduction in lending rates and if you see that for sectors like housing, personal etc the reduction has been much more than for other sectors by the same bank,” he said. WASHINGTON, FEB 11 (PTI): President Donald Trump has said he is considering signing a “brand new” executive order by next week to temporarily bar citizens of seven Muslim-majority nations from entering America, a day after a US court refused to reinstate his controversial travel ban. “We will win that battle. The unfortunate part is that it takes time statutorily, but we will win that battle. We also have a lot of other options, including just filing a brand new order,” Trump told reporters travelling with him on Air Force One from Andrews Air Force Base to Florida. Asked if his plan might be to issue a new executive order, Trump said: “It very well could be. We need speed for reasons of security, so it very well could be.” Trump said that “in honour of the (9th US Circuit court) decision” he will likely wait until next week to respond with any action. “Perhaps Monday or Tuesday,” he said. The Minsk II accord saw Kremlin-backed rebels agree with Kiev and Moscow on a halt to the fighting and outlined a complex roadmap for securing peace. It was hammered out by the presidents of Ukraine and Russia with the help of their French and German counterparts and signed on February 11 two years ago. And Drake isn’t going to make it to LA, because he’s playing a show in Manchester... But that might not be such a bad decision. The show’s ratings dropped to a seven-year low in 2016, meaning the star will make more money from a single concert than he would from three minutes’ TV exposure Will there be a trump protest? Fifty Shades Darker gets critical spanking

W

hile not everyone hated the sequel to 2015’s Fifty Shades of Grey, the vast majority of critics were not impressed. The New York Times said the film was “Fifty Shades Darker and only half as watchable” as its predecessor. “What an incredibly, indelibly idiotic movie,” is how Rolling Stone’s Peter Travers summed it up in his 0.5-star review. “Fifty Shades Darker is an ordeal to watch not because of its gothic eroticism but because of its utter blandness,” wrote The Independent’s Geoffrey Macnab. “When the inevitable spanking scene takes place, it is tongue in cheek (although not quite literally so).” “Buff, bland, bonking machines are possessed of prodigious libido but bereft of personality,” The Daily Mirror’s Chris Hunneysett wrote. “If you want to watch a movie about a billionaire playboy with a penchant for darkness, inflicting violence and dressing up in masks, you’re far better off seeing The Lego Batman Movie.” But Variety liked it a

little more, writing: “For all its structural and psychological deficiencies, it’s hard not to enjoy Fifty Shades Darker on its own lusciously limited terms.” “It sure ain’t boring,” observed Deadline’s Pete Hammond, who also gave the film a more positive review. “Best of all, like the first film, this one has a killer soundtrack that makes Fifty Shades Darker sound just as good as it looks.” “There’s one significant problem with both Fifty Shades movies that’s impossible to ignore: [Jamie] Dornan is just a dud,” said Time’s Stephanie Zacharek. But, she adds: “It’s all fantasy, so what’s the harm? There isn’t any. And if millions of girls or guys go out to see Fifty Shades Darker with their friends for a giggle or two, then the world is a happier place.” Other publications who didn’t quite consider the film a masterpiece included The Guardian, The Telegraph and The New Yorker. To be fair - we’re fairly confident everyone involved in making the film wasn’t pinning their hopes on critical praise.

The Hague, Feb 11 (IANS): Former Dutch football star Piet Keizer died on Friday at the age of 73 following the effects of lung cancer, his family made it known on Saturday. From 1961 until 1974, Keizer played a total of 490 matches for Ajax during which he scored 189 goals. With the Amsterdambased giants, he won the European Champions Cup

in 1971, 1972 and 1973, the club World Cup in 1972 and a total of six national titles, reports Efe. The skillful and stylish left winger never played for another club. With Sjaak Swar t and the late Johan Cruyff, Keizer formed a legendary Ajax frontline. Keizer’s former friend Cruyff died on March 24 last year at the age of 68, after he was diagnosed with lung cancer as well. Keizer played a total of 34 matches for the Dutch national team. He was active in one match at the 1974 World Cup, in which the Netherlands finished second. After his career Keizer said farewell to football and lived a quiet life, only to return as advisor and scout of Ajax in 2001.

24 Indians picked for NBA Academy New Delhi, Feb 11 (PTI): Twenty four players were selected for the National Basketball Association (NBA) and the ACG Worldwide Group (ACG) Jump National Finals. The selected 24 will become the first class to receive scholarships and training at NBA Academy India. The selection of the players at the National Final, held from February 9 to 11, marked the culmination of the three-month nationwide program that conducted tr youts in six regions including Mumbai, Delhi, Ludhiana, Kochi, Chennai a n d Ko l k a t a . T h e 2 4 players will get scholarships and training at the NBA Academy India. 17 killed in Angola’s football match stampede L ua n da , F e b 1 1 (IANS): At least 17 people died and dozens of others injured in a stampede at a stadium at a soccer stadium in the northern Uige city of Angola. The tragedy occurred on Friday evening seven minutes into a first division match between Santa Rita de Cassia and Libolo when hundreds of local fans stormed one of the gates of the stadium to watch the match, Xinhua reported. Sources with a local hospital said there were at least 76 casualties, of whom 17 dead, mostly teenagers who tried to sneak into the stadium to watch the game. Five people were also reported to be in serious condition after the stampede. Witnesses said the crowd trying to gain access would have taken the stadium past its 8,000 capacity, and some people began to fall and some people had walk on others, triggering the worst stadium tragedy in recent memory. The gate was already over crowded when hundreds of more fans stormed the gate to gain entry while there were only police men were present to safeguard the order, one witness said. Angolan President Jose Eduardo dos Santos has ordered an investigation into the incident, local media reported.
