NEW DELHI, DEC 11 (PTI): Rajya Sabha on Wednesday passed the contentious Citizenship (Amendment) Bill, completing the legislative process for giving Indian citizenship to non-Muslim migrants from Pakistan, Afghanistan and Bangladesh, with Home Minister Amit Shah asserting that Indian Muslims have nothing to fear as they will not be affected by the law. The Opposition termed the bill, which was passed by Lok Sabha on Monday, as “unconstitutional”, “divisive” and “an assault on the democratic and secular fabric of the nation”. As many as 125 MPs voted in favour of the Bill in the Upper House and 99 against it, Parliamentary Affairs Minister Pralhad Joshi said. BJP’s former ally Shiv Sena, which made all the noises of opposing the bill on the grounds that it ignored citizenship for migrants from other neighbouring nations, made a quiet exit from the House just before the voting. Earlier Shah had taken a dig at Sena asking what made it change its stand overnight after supporting the bill in Lok Sabha. Besides NDA constituents such as the JD-U, Shiromani Akali Dal (SAD) and AIADMK, the legislation was supported by the BJD, TDP, YSR-Congress and independents. DIMAPUR, DEC 11 (NPN): The Union agriculture and farmers’ welfare ministry provided Rs 105 crore to Nagaland under Mission for Integrated Development of Horticulture (MIDH) for various horticulture activities, including construction of cold storages. While Rs 31.50 crore was allocated in 2016-17, Rs 41.50 and Rs 32 crore were allocated in 2017-18 and 2018-19 respectively. This was stated by Union agriculture and farmers

welfare minister Narendra Singh Tomar in response to a query by State’s Lok Sabha member Tokheho Yepthomi. To his question on funds provided for construction of cold storage in Nagaland in 2016-17, 2017-17 and 2018-19 and the progress of construction and time of completion, Tomar explained that funds were provided under MIDH for holistic development of horticulture in the country and assistance for development of Post Harvest Man-

agement (PHM), including setting of cold storages. Mentioning that the State government had however reported that no funds had been utilised for construction of cold storages during this period, the Union minister also informed Lok Sabha that the Union food processing industries ministry had approved one cold chain project in Dimapur in 2017-18 with assistance of Rs 8.10 crore, which had been completed and was functional.

Another cold storage was approved in 2018-19 with an assistance of Rs 9.67 crore, which was under implementation, while no cold storage was approved in 2016-17, he added. Meanwhile, Union road transport and highways ministry allocated Rs 726.52 and Rs 462.54 to Nagaland in 2018-19 and 2019-20 respectively for maintenance and development of national highways (NHs) in the State. She observed that the Bill was not only a threat to the plain people, but also to the tribal people. She claimed that ILP can no proper control to illegal immigrants in the

North East, adding that Nagaland was also not safe under CAB. KOHIMA: A co-ordination meeting on monitoring, evaluation study and documentation on the progress of the farmers through Sub-Mission on Agricultural Machanisation (SMAM) was held at the conferences hall of

He said that SMAM is being implemented through the State department of Agriculture of all States, Farm Machinery Training & Testing Institutes and the ICAR. Longkumer said since Northeast region was substantially lower compared to developed countries it was necessary to promote farm machanisation as a special mission and accordingly SMAM has been conceived and implemented during the Xll plan. DIMAPUR: As part of the ongoing crackdown by Assam Rifles to prevent illegal activities, troops of Assam Rifles seized IMFL worth around Rs.12 lakh from Dimapur and Wokha on two occasions. According to PRO defence, troops of AR intercepted a bolero (Pickup) and seized IMFL worth around Rs. 7 lakh in Doyang, Wokha on December 10. In this connection, two persons identified as Ravi Kumar Kachari son of Dilip Kumar Kachari, resident of Church Colony, Wokha and Yanbamo Ngullie son of Thungbenshan Ngullie resident of Forest Colony, Wokha were arrested. The two along with the seized IMLF were handed over to Wokha PS. In another incident, based on specific information troops of AR raided a warehouse and seized IMFL worth around Rs. five lakh from 4th mile area, Dimapur on November 30. In this connection, two persons identified as Suresh Limbu (18) son of Jai Kumar Limbu, resident of 5th Mile, Model village, Dimapur and Kalu Gurung (31) son of late Limba Gurung, resident of Chekiye village Block-6, Dimapur were arrested. DIMAPUR, DEC 11 (NPN): The term of Judicial Inquiry Commission (JIC), which was constituted to inquire into January 31, 2017 incident in Dimapur, has been extended for another two months with effect from December 1, 2019 to January 31, 2020 for submission of the commission report. Panel to address concerns of Assamese people: Shah

New Delhi, Dec 11 (IANS): Amid parts of Assam on the boil over the controversial Citizenship Amendment Bill, 2019, Home Minister Amit Shah on Wednesday said in the Rajya Sabha that a panel under Clause 6 of the Assam Accord would address all the concerns of the local people related to their linguistic, cultural and social identity. “I want to assure all the original residents of Assam through this House that the NDA government will attend to all their concerns. The Committee constituted under Clause 6 will address the concerns,” Shah said while introducing the Citizenship (Amendment) Bill, 2019 in the Upper House. In his introductory statement, Shah said that the committee under Clause 6 could not be constituted until Narendra Modi government came to power. “No one bothered or worried for 35 years,” the Minister said.

He said that when Assam Accord was signed by the then Prime Minister Rajiv Gandhi the movement in the state was stopped and people celebrated and burst crackers but the Committee was never formed. “I want to put forward a bitter fact today. In 1985, the then Prime Minister Shri Rajiv Gandhi signed the Assam Accord. As per the Accord, a committee was to be set up to ensure the social, cultural and linguistic identity would be protected and preserved,” he noted lamenting non-action on the agreement. Tripura Pradesh Youth Congress chief Pujan Biswas said the police resorted to lathicharge on peaceful protesters in the state capital. “To protest the police lathicharge we have given a call for 24-hour strike across Tripura on Thursday,” Biswas said. Tripura Congress adhoc committee chairman Pijush Biswas said seven party workers, including women and few journalists, were injured in the lathicharge. Senior Congress leader Gopal Roy said the police and other security forces at the behest of the government acted against the peaceful Congress agitators. “The BJP government in Tripura, since it assumed office in March 2018, has unleased a reign of terror against the democratic movement and opposition parties,” Roy said.

Manipur now under ILP regime: Biren Correspondent IMPHAL, Dec 11: Inner Line Permit (ILP) regime is back in Manipur with effect from Wednesday with President of India Ram Nath Kovind signing the order in this effect. The regime applicable under the Bengal Eastern Frontier Regulation, 1873 was abolished from Manipur in 1950. The regime is in force in Nagaland, Mizoram and Arunachal Pradesh. ILPS has been enforced in Manipur from today ( Wednesday), chief minister N Biren Singh announced at a press conference held at the chief minister’s secretariat soon after the Union home ministry published the same in its gazette on Wednesday. Singh stated that after the verbal assurance by Union home minister Amit Shah in the Parliament on Monday, the extension of Inner Line Permit System to Manipur was being published in the Gazette of India on Wednesday. Stating that it is a dream come true for the people of Manipur, Singh said the implementation of such law will protect the indigenous people of the state. The committee was apprehensive if the ILP regime been extended in Manipur from today (Wednesday) will able to protect the indigenous people of the region from the impact of Citizenship (Amendment) Bill (CAB). Addressing a press conference in Imphal, chairman of the committee, Ibotombi Khuman said that the committee welcomed the Centre’s move to extend the ILP system in the state. He however doubted if the ILP system will able to protect the indigenous people from the illegal migrants effectively and that it remained a big question.

CAB protests: Assam CM stuck at Ghy airport Guwahati, Dec 11 (IANS): Assam Chief Minister Sarbananda Sonowal was stuck at the airport here for hours as thousands of protesters hit the streets protesting against the Citizenship (Amendment) Bill which was introduced in the Rajya Sabha on Wednesday. Sonowal, who landed in the state capital from Tezpur, was stranded at the VIP lounge of the Lokpriya Gopinath Bordoloi International airport, as his convoy could not roll out due to the massive protest. Raising slogans against the central and state governments, the protesters were demanding unconditional withdrawal of the contentious bill. The protests, which had started days back, intensified during the day after Union Home Minister Amit Shah tabled the legislation in the upper House of parliament. The protesters tried to march towards the state secretariat and burnt tyres on the roads, creating a volatile situation, as the police tried to control the unrest by firing rubber bullets and lobbing tear gas shells. Incidents of violence have also been reported from various parts of the state, with at least 25 protesters - including several students - sustaining injuries in police baton charge.

We don’t want northeastern region to fall in the trap of some mis-campaigning,” the Minister, who hails from Arunachal Pradesh, said. Rijiju explained to the media how the concerns of the northeastern region had been taken into account while drafting the CAB. “The Home Minister has discussed and listened to the voice of the northeastern people. New Delhi, Dec 11 (PTI): The Supreme Court on Wednesday said it is considering appointing a former judge of the apex court for inquiry into the encounter killings of the four accused in the gang rape-and-murder case of a veterinarian in Telangana. “We are conscious of the fact that the Telangana High Court had taken note of it,” a bench headed by Chief Justice of India (CJI) S A Bobde said, adding that the top court only wants that a Delhi-based former apex court judge should hold inquiry into the case. “We propose to appoint a former Supreme Court judge to inquire into it,” said the bench, also comprising Justices S A Nazeer and Sanjeev Khanna. The judge, who would inquire into the incident, would sit in Delhi, it said. The bench said it requested a former apex court judge to inquire into the incident, but he declined it. The bench, which has now posted the two PILs seeking an independent SIT probe into the encounter for hearing on Thurs-

Senior advocate Mukul Rohatgi and advocate Krishna Kumar Singh, appearing for the Telangana government, said it had followed the directions laid down by the apex court for an inquiry into encounters and had already referred the case to the state CID. Two petitions have been filed in the Supreme Court, one by lawyers G S Mani and Pradeep Kumar Yadav, and the other by advocate M L Sharma, seeking independent investigation against the police officials concerned. Telangana police said on Friday that the accused were killed in an exchange of fire with police. The incident took place around 6.30 am when the accused were taken to the site of offence

national Social Security Code Bill introduced in LS New Delhi, Dec 11 (IANS): The government on Wednesday introduced the Code on Social Security, 2019 in the Lok Sabha to reduce the number of legislations on employees’’ welfare and social security from 44 to just four. Introducing the Bill, Union Labour and Employment Minister Santosh Kumar Gangwar said the Code is meant for streamlining a plethora of existing labour laws. Mentioning that elaborate deliberations have been made before drafting the Social Security Code Bill, Santosh Kumar Gangwar said the Code will do away with the complexities involved in social security with the existing regulations. Opposing its introduction, Revolutionary Socialist Party leader N.K. Premachandran said the proposed legislation would curtail the existing privileges of the workers. Trinamool Congress’’ Saugata Roy said the Code has not been demanded by any of the Central Trade Unions and expressed concern that linking social security schemes with the Insolvency and Bankruptcy Code would be detrimental to the interests of workers.

CAB: FIR against AMU students for defying Sec 144 Aligarh (UP), Dec 11 (PTI): An FIR has been registered against 20 students of the Aligarh Muslim University in connection with their protest against Citizenship Amendment Bill, and security has been beefed up in the campus, a senior official said on Wednesday. Rapid Action Force has been deployed at the entry points to the University campus, where an uneasy calm prevailed. The police on Tuesday night filed a report against 20 student leaders and 500 other unnamed persons for defying prohibitory orders under Section 144 and holding a protest near Faiz Gate in the campus. Civil Lines’ Station House Officer Amit Kumar said, “Section 144 has been clamped all over the city and the students had violated this provision by marching up to the University Circle and trying to disturb the peace due to which FIRs have been registered under relevant sections against 20 student leaders.” AMU Proctor Prof Afifullah Khan said that on Tuesday evening, students took out a protest march from the University Library up to the University Circle. India’s latest radar imaging earth observation satellite RISAT-2BR1 now up in the sky will send sharp clarity images for surveillance, agriculture, forestry and disaster management. The satellite camera can look through the clouds and take pictures. The Indian space agency officials said they would supply the required images for various agencies. It is for the user agency to decide on the image use. Gehlot was speaking at a sit-in staged by the Congress against the Bill that seeks to grant Indian citizenship to non-Muslim refugees from Pakistan, Bangladesh and Afghanistan escaping religious persecution there. “It is for the first time that there is an atmosphere of fear in the country. Protests are happening, the North East is burning, but this government is not at all concerned. “What is the intention behind the Citizenship (Amendment) Bill? The opposition is not being heard. We need to think where democracy is,” Gehlot said. The central government is being criticised but it is not bothered and is trying to divert attention from real issues such as economic slowdown and unemployment, Ghelot said at the protest at the Gandhi Circle here. ndia’s GDP growth rate slowed down to 4.5 per cent in the July-September quarter of this fiscal, data by the National Statistical Office released showed. The decline in economic growth came on the back of dwindling consumer demand, slowing private investment and global slowdown. India’s economic growth slowed to a 6-year low of 4.5 per cent in the July-September quarter. With inflation rising, fears of stagflation- a fall in aggregate demand accompanied by rising inflationhave resurfaced. The Reserve Bank of India also reduced its GDP forecast for the financial year 2020 to 5 per cent from 6.1 per cent earlier. The RBI’s highpowered Monetary Policy Committee (MPC) accepted that economic growth had weakened further and output gap remains “negative”. Since February this year, the RBI has revised its GDP growth projections for the financial year 2020 from 7.4 per cent in February to 5 per cent now, which is sharpest such revision in the recent years. However, former finance minister P. Chidambaram maintained that the figure could dip even as little as 4.5% by 2020. Former Reserve Bank of India (RBI) governor Raghuram Rajan said India is in the midst of a “growth recession” with signs of deep malaise in the Indian economy that is being run through extreme centralisation of power in Prime Minister’s Office and powerless ministers. Rajan said that previous governments may have been untidy coalitions but they consistently took path of further economic liberalisation. He identified extreme centralisation, coupled with the absence of empowered ministers and the lack of a coherent guiding vision, as retarding force where reform efforts only pick up steam only when the PMO focuses on them but lose impetus when its attention switches to other pressing issues. The former RBI governor drew attention on Modi’s electoral slogan “minimum government and maximum governance. He said the slogan was often misunderstood as what was meant was that the government would do things more efficiently, not that people and the private sector would be freed to do more. He said construction, real estate and infrastructure sectors are in “deep trouble” and so are lenders to it like the non-bank finance companies. The crisis among shadow lenders and a build-up of bad loans at banks have curbed lending in the economy. Unemployment, especially amongst youth, seems to be growing, as is the accompanying risk of youth unrest. Rajan also maintained that the repeated government allusions to a USD 5-trillion-economy by 2024, which would necessitate steady real growth of at least 8-9 per cent per year starting September-December seems increasingly unrealistic. Notably, India’s $57 billion automotive component industry, which accounts for 2.3 per cent of country’s GDP and employs over 5 million people, has witnessed its worst-ever half-yearly performance with overall revenues registering a de-growth of 10.1 per cent at Rs 1.79 lakh crore in 2019-20. This has resulted in around 100,000 people losing their jobs and an estimated investment loss of about $2 billion that would have happened had the industry continued to grow. The State Bank of India(SBI) has said , the second quarter GDP growth may further lower down to 4.2 per cent on low automobile sales, deceleration in air traffic movements, flattening of core sector growth and declining investment in construction and infrastructure, and put the growth forecast for FY20 down to 5 per cent from 6.1 per cent earlier.

But our individuality must be yielded to God so that our spiritual life may be brought forth into fellowship with Him. Individuality counterfeits spirituality, just as lust counterfeits love. God designed human nature for Himself, but individuality corrupts that human nature for its own purposes. The characteristics of individuality are independence and self-will. We hinder our spiritual growth more than any other way by continually asserting our individuality. If you say, “I can’t believe,” it is because your individuality is blocking the way; individuality can never believe. But our spirit cannot help believing. Watch yourself closely when the Spirit of God is at work in you. He pushes you to the limits of your individuality where a choice must be made. The choice is either to say, “I will not surrender,” or to surrender, breaking the hard shell of individuality, which allows the spiritual life to emerge. The Holy Spirit narrows it down every time to one thing (see Matthew 5:23-24). It is your individuality that refuses to “be reconciled to your brother” (Matthew 5:24). God wants to bring you into union with Himself, but unless you are willing to give up your right to yourself, He cannot. “…let him deny himself…”— deny his independent right to himself. Then the real life-the spiritual life-is allowed the opportunity to grow.

Manish Tiwari, Hon’ble Member of Parliament, 9th December, 2019, Debate in Loksabhaon Citizenship Amendment Bill, 2019 The citizenship Act 1955 was the first provision of the Indian government that informed about how the citizenship of India can be acquired and what could be the grounds for acquiring citizenship. According to this Act, an individual could gain the Indian citizenship if they were born in India, have resided in India for a long period or have Indian parentage. The main aim of this legislation was to prohibit the illegal migrants from acquiring Indian citizenship. According to this Act, any individual who enters India with forged documents and invalid passport was considered as illegal migrant. In the year 2014, the Citizenship Rule was proposed to be amended by introducing a Legislative Bill, under which religion was to be considered as the explicit ground for awarding citizenship. This step was taken ‘evaluating’ the situation specifically of the Hindus as “vulnerable”especially in Pakistan and therefore, the Citizenship Act of 1955 was proposed to be amended specifically to accommodate Hindu migrants. In the year 2016, Citizenship (Amendment) Bill was presented in the parliament in order to bring some significant changes in the existing legislation. This bill was mainly to consider the problems that the refugee population is facing and that such population is deprived of many facilities and rights in India because of their illegal immigrant status. The existing law did not allow the immigrants to obtain the citizenship of India provided they must have resided in India or have been in the central government service for the last 12 months and at least 11 years of the preceding 14 years, and other qualifications as specified in Section 6 (1) of the Citizen Act,1955. However, the latest amendment “in question”can bring significant changes and can increase the movement of immigrants from Bangladesh to North-East India, which is a major reason of concern for Northeastern states. The Bill provides that, illegal migrants belonging to specified minority communities from Afghanistan, Bangladesh or Paki-

stan will not be treated as illegal migrants under the Act, making them all eligible for Indian citizenship. These minority communities are Hindus, Sikhs, Buddhists, Jains, Parsis and Christians. This implies that illegal migrants from these countries who are Muslims, other minorities who do not belong to the above groups e.g. Jews or Atheists who do not identify with a religious group will not be eligible for citizenship. The question is whether this provision violates the right to equality guaranteed under Article 14 of the Constitution because it provides differential treatment to illegal migrants on the basis of their religion.Article 14 guarantees equality to all persons, citizens and foreigners. It only permits laws to differentiate between groups of people if the rationale for doing so serves a reasonable purpose. The Statement of Objects and Reasons of the Bill does not explain the rationale behind differentiating between illegal migrants on the basis of the religion they belong to. However, according to Government the increasing vulnerability of the population of the Hindus, Sikhs, Jains, Buddhists, Christians and Parsis in the neighbouring countries like Afghanistan, Pakistan and Bangladesh resulted in increasing the illegal migration of these people to India, which led to the development and formulation of Citizenship Amendment Bill 2016. This Bill had resulted in relaxing the eligibility criteria for the selection of the immigrants and included six minority communities or people, who came to India before 2014. The minimum requirement of the residency period was 11 years in the earlier Act, which is now reduced to 5 years (In 2016 Bill, it was 6 years). The proposed amendment in the Bill has also raised some significant concerns and oppositions. The first reason of opposition is that religion has never been used as the ground for making the difference between citizen and non-citizens. Therefore, the Civil Society groups have called this bill as the “communally motivated humanitarianism”. This bill is also considered to be increasing inequality, as it does not include the Shias or Ahmadiyya’s or Mohajirs in Pakistan, who are also the oppressed, discriminated and persecuted minorities. Article 14 of the Indian constitutionprovides equality to everyone, however differentiating on the grounds of religion can be a significant violation of the Indian constitution. Some even believe that this bill will also stamp the countries like Pakistan, Bangladesh and Afghanistan as the institutions that perpetuate religious oppression and will also negatively affect the bilateral relations.

Since the introduction of the Citizenship Amendment Bill in the Lower House of Parliament in 2016, there has been a significant unrest among the people from the North-East states of India. People from North-East and mainly from Assam have significantly protested against the Citizenship (Amendment) Bill. There are various social political and economic implications of the Bill that could affect the Northeast Indian states. The people from Northeast states are significantly concerned about their status in their states. They fear that this bill will increase the number of immigrants in their states that would affect the social and economic benefits that they receive. For example, the indigenous people living in Mizoram fear that the entry of the Buddhists Chakmas from Bangladesh will take the advantage of the bill and will migrate in significant number. The tribal communities from Meghalaya and Nagaland are worried about the Bengali migrants. The tribal people living in the Northeast state have developed their own social, political and economic environment. They have their own traditional and cultural system of living that could be significantly affected by the entry of migrants from Bangladesh or other countries. The government of Manipur want to implement the Inner Line Permit System in order to stop the immigrants from entering into the state. The Indigenous National party and the Indigenous People’s Front of Tripura are also against the bill as they fear that their tribal status will be affected by this bill. However, as per the latest version of Citizenship Amendment Bill, 2019 which has been introduced and passed in LokSabha on 9th of December, 2019 have made certain changes in the original draft of 2016 Bill. As per 2019 CAB Bill, Arunachal Pradesh, Nagaland and Mizoram, where Inner Line Permit (ILP) regime is applicable, will be kept out of the purview of the proposed Citizenship Amendment Bill (CAB). The ILP regime is under Bengal Eastern Frontier Regulation, 1873. In terms of Section 2 of the Bengal Eastern Frontier Regulations, 1873, the Inner Line Permit system is prevalent in Arunachal Pradesh, Mizoram and Nagaland. Moreover, Under the Sixth Schedule of the Constitution, autonomous councils and districts were created in tribal areas in Assam, Meghalaya and Tripura. The autonomous councils and districts enjoy certain executive and legislative powers. They will also be exempted from the purview of Citizenship Amendment Bill 2019. However, the question arises as to whether these so called ‘protected’ regions would also be able to escape by taking a shelter of ‘Inner Line Permit System’ from

the ‘indirect’ impact of the influx of large number population in the neighbouring regions? Demographic change is the first social, political and an economic issue that have raised the concern of the Northeast people. The decades of illegal migration have been ongoing in Tripura and Assam, but through this bill such immigration would become legal and the already existing communities will likely to lose their demographic status. People from Assam fear that their language will become secondary, their culture would be distorted and their political rights would be lost. Another reason of the significant opposition of the Bill in Assam is that this Bill is against the Assam Accordwhich was signed on 15th of August 1985 between representatives of Government of India and the leaders of Assam Movement in New Delhi declared “March 24, 1971” as the cut-off date for illegal immigrants; however, the proposed Bill moves the cut-off date for illegal immigrants – for only six religions - by more than 43 years to December 31, 2014. A six years long agitation followed against illegal migrants from the then East Pakistan (now Bangladesh), which then culminated with the signing of an agreement called the Assam Accord. The citizenship Amendment Bill also contradicts with the National Register of Citizens (NRC) which is a roster of all those who settled in Assam up to the midnight of March 24, 1971. It may be noted that, Bengali Hindus (from Bangladesh) who were declared illegal immigrants by the NRC are now legal by the current clauses of the bill. This nullifies the process of NRC and seriously affects the demographic character of the region. The Assam Accord and the NRC set the cut off of the citizen irrespective of their religious status. For becoming the citizen of Assam, the tribal people and other population of the state have to prove that their ancestors were the residents of the state before March 25, 1971. However, due to the Bill, the illegal immigrants from Bangladesh, who came before 1971 would become the citizen of the state affecting the existing population and their social status. States like Manipur and Tripura have a significant number of the Hindu population, but the Bill may result in implementing the communally driven agenda, which can result in creating a political void. The economy of the states includes the employment and job opportunities for the resident population and the existing laws provide priority to them to participate in the economic system. However, the Bill would result in making the immigrants and refugees the citizen of the

states and the opportunities for employment and job would be divided between the existing citizens and new immigrant citizens. However, on the other hand, a fact needs to be taken into consideration that, India is located in a rough neighbourhood surrounded by strategically hostile nations and fragile democraciesfrom where influx of people due to persecution is always a possibility. Given our ethos, traditions, and practices it is surprising that India have not yet evolved a refugee policy. India do not have a national refugee law and is not a signatory to the 1951 UN Convention on the Status of Refugees and its related 1967 Protocol - which set the basic standards of treatment to be meted out to refugees of which the most fundamental is non-refoulment. However, our not signing the aforesaid Convention and Protocol does not absolve us from observing the basic humanitarian law relating to refugees including the principle of nonrefoulment as we are signatories to the Universal Declaration of Human Rights (UDHR), 1948, the International Convention on Civil and Political Rights (ICCPR-1966) and the Convention against Torture and Other Cruel, Inhuman and Degrading Treatment or Punishment (Torture Convention-1984). Also, Article 14 of the UDHR, Article 13 of the ICCPR-1966, and Article 3 of the Torture Convention-1984, each expresses a commitment to protect refugees. Additionally, the right to refoulment is internationally recognized today as a part of customary international law. Article 51(c) of the Indian Constitution directs the State to respect international law and treaty obligations. Customary international law has been held by the Supreme Court to be part of international law. Moreover, it needs to be reiterated that the intention and motivation regarding the Bill which the central government have been reflecting can best be resolved by India ratifying the UNHCR Refugee Convention. Surprisingly India is one of the only democracies in the world not to have signed the Convention. This has led to inconsistent approaches in dealing with refugees and economic migrants. The Refugee Convention provides clear guidance on all refugees, including repatriating them voluntarily to home countries once conditions for such repatriation become feasible. Second Partition: breakdown of secular India

“…At the stroke of midnight, when the world sleeps, India will awake to life and freedom. A moment comes, which comes, when we step out from the old to the new, when an age ends, and when the soul of nation a nation, long suppressed, finds utterance…” an excerpt from ‘Tryst with Destiny’, the maiden speech of independent India’s first Prime Minister Jawaharlal Nehru on the eve of India’s first independence day. A day earlier, Pakistan also celebrated its first independence day. The partition of the two dominions (dominion of India and dominion of Pakistan) was necessitated following the Lahore resolution and the two nation theory of Muhammad Ali Jinnah, the ‘father of the nation’ of Pakistan. India went ahead to declare itself as the ‘Republic of India’ on 26th January, 1950 while Pakistan declared itself as the ‘Islamic Republic of Pakistan’. A good number of the BJP MPs with Mr. Amit Shah leading the charge have put the onus

on the Congress for the partition of India and Pakistan echoing the voice of its predecessors who have all tread on the same path for electoral gains. But history bears witness to these fallacious claims of the BJP who fail to comprehend that while pointing one finger to the Congress, they are pointing the other three fingers to themselves. It was VD Savarkar who was bestowed with the title ‘Veer’ by the BJP for writing mercy petitions to the British while still in the goals in the Andamans who first propounded the ‘two-nation’ theory in 1935 in Ahmedabad in a Hindu Mahasabha session. The BJP in all fairness has lost all moral right to claim that its party does not discriminate the Muslims of India especially after recklessly splitting Jammu & Kashmir into two UTs, hounding its political leaders as prisoners and literally shutting down the entire state for over 3 months. To add salt to the injury, the Citizenship Amendment Bill, 2016 was once again introduced in

the Lok Sabha after it was previously thwarted in the Rajya Sabha. Like before, it saw an easy passage of the bill in the Lower House with 311 voting for it and 80 against it. Enough has been discussed about the bill and we need not delve into the nitty-gritty of the CAB. What we need to understand is this bill is against the very nature of the Indian Constitution. 72 years after we got independence we have gone back from new to the old. On the 9th of December, at midnight, the BJP Government passed the contentious Citizenship Amendment Bill amid huge protests across the country. Already, violent protests have erupted, there is complete breakdown of law and order in many areas in the Northeast but the BJP does not seem to have any regard for the sentiments of the people. The very soul of this nation- the constitution has been gagged by the BJP. The National Register for Citizens which is in the pipeline is designed to further denigrate the

Muslims of India. Without CAB, there can be no NRC and this is exactly the reason why the BJP is hell-bent on passing CAB in the Upper House. The NRC exercise in the state of Assam which was supposed to target the Muslim populace proved to be disastrous. With a spending of over 1300 crore not only it did it cause a huge drain on the exchequer but it also involved the state machinery with over 55,000 state government officials working round the clock which proved to be a futile exercise. Surprisingly, out of the 41 lakh people who were left out, most of them are Bengali Hindus who are now kept in six detention Centres across Assam. The BJP is adamant on carrying out the Pan-India NRC exercise which has been widely criticised by eminent people from all over India. With an already frail economy, such an exercise will only lead to economic disaster. The BJP should realize that they are treading on a very dangerous path.

The 1971 Bangladesh liberation war which put a dent on the West Pakistan’s hegemony over East Pakistan is an epitome of a failed state established on religious lines. Any attempt to divide India on religious lines is against the tenets and the ethos of this country. What the BJP is doing today will only weaken a strong secular and resilient India which took years and years to built. Instead of indulging

in appeasement politics, it should focus on taking this country to much greater heights with the huge mandate which the people of India have bestowed upon them. Why are our MPs supporting CAB?

The Nagas have been betrayed but their leaders who have voted in favour of CAB and claim to represent the voice of the state when it is clearly not the case. In their bid to appease their “bosses” and for short term gains, they have conveniently overlooked the implications of the contentious bill. Nagaland may be excluded but with our neighbouring state Assam still under CAB, there is the real and imminent danger of Dimapur first and then even the other districts getting swamped by illegal immigrants. We as a people also seem to have lost our voice when people in other states are questioning their leaders. Our leaders as shown in the parliament clearly do not respect the sentiments of the people. Chidambaram on Wednesday appreciated the party’s alliance partner in Maharashtra, Shiv Sena, for not participating in the voting on the controversial Citizenship Amendment Bill, 2019 in the Rajya Sabha. Speaking to media outside Parliament, Chidambaram said, “We got 105 votes and it is wonderful, 105 is a good number.” The contentious Citizenship Amendment Bill was passed by the Rajya Sabha on Wednesday, two days after it got the nod from the Lok Sabha. As many as 125 members voted in favour of the Bill and 105 voted against it. Earlier in the day, Home Minister Amit Shah had tabled the Bill in the House. The Bill seeks to give citizenship to refugees from Hindu, Christian, Sikh, Buddhist and Parsi communities fleeing religious persecution from Pakistan, Afghanistan and Bangladesh. 182 drones observed along borders New Delhi, Dec 11 (PTI): As many as 182 incidents of flying of drones have been observed along the country’s border, Union Minister G Kishan Reddy said in Rajya Sabha on Wednesday. The minister also said a standard operating procedure (SOP) to deal with the threat from drones has been issued in April 2019 to all states and union territories for implementation. “As per information received, 182 incidents of flying of drones have been observed on the borders,” he said in response to a written question. Further, Reddy said, the Indian Air Force is the main airspace control agency and continues to train all security agencies and all state and union territory police forces on anti-drone measures.

The data from 2016 to 2018 was given by Rai, in a written reply to a question regarding citizenship to refugees from Afghanistan and Pakistan. Rai noted that provision for capturing online citizenship data of migrants from minority communities hailing from Afghanistan, Pakistan and Bangladesh was introduced in 2018 and as per available data, 927 Sikhs and Hindus from Afghanistan and Pakistan have been granted Indian Citizenship since then.

NEW DELHI, DEC 11 (PTI): Gold prices fell Rs 73 to Rs 38,486 per 10 gram in the national capital on Wednesday on account of a stronger rupee, according to HDFC Securities. The yellow metal had closed at Rs 38,559 per 10 gram on Tuesday. “Spot gold for 24 karat was trading down by Rs 73 in Delhi on a stronger rupee against dollar,” HDFC Securities Senior Analyst (Commodities) Tapan Patel said. In the early trade on Wednesday, the rupee appreciated 12 paise to 70.80 against the US dollar. Silver prices also fell by Rs 89 to Rs 44,640 per kg from its close of Rs 44,729 per kg on Tuesday. In the international market, gold was trading at USD 1,464.8 per ounce, while silver was quoting at USD 16.62 per ounce.

NEW DELHI, DEC 11 (IANS): The Centre has changed the composition of the group of ministers (GoM) on integrated goods and service tax (IGST) after finance minister decided to opt out of the ministerial panel headed by her. Deputy Chief Minister of Bihar, Sushil Modi has now been made chairperson of the GoM that is expected to deliberate and suggest measures for increasing the GST revenue. Sources in GST Council said that the said changes has been made as finance minister Nirmala Sitharaman is also chairperson of the Council, which is expected to receive report from GoM and take further action. So, this would have created a situation where the person finalising the recommendation is also to take further action on it. “Inadvertently, Union Finance Minister was mentioned as Chairman of the GoM. Since Union Finance Minister who is also the Chairperson of the GST Council could not have headed the GoM as its report is required to be submitted to the Chairperson of the Council. In view of the above, a modification was made to the constitution of the GoM...,” Council sources said. The GoM on IGST constitutes ministers and officers from states as well

MUMBAI, DEC 11 (PTI): The rupee appreciated by 7 paise to settle at a fresh one-month high of 70.85 against the US dollar on Wednesday on the back of firm domestic equities and easing crude oil prices, extending its winning run for the sixth straight session. Forex traders said the domestic unit gained ground ahead of the release of key macro-economic numbers on Thursday. At the interbank foreign exchange market, the rupee opened at 70.87 against the US dollar. During the day, the domestic unit fluctuated between a high of 70.74 and a low of 70.94. The local unit finally settled the day at 70.85, up 7 paise over its last close. The rupee had settled at 70.92 against the US dollar on Tuesday. “Rupee continued to trade higher against the US dollar ahead of the important inflation and industrial production number that will be released tomorrow. Expectation is that the number could disappoint and could keep gains capped for the currency,” Gaurang Somaiyaa, Forex & Bullion Analyst, Motilal Oswal Financial Services Private Ltd. Brent crude, the global oil benchmark, eased 0.65 per cent to USD 63.92 per barrel in futures trade.

NEW DELHI, DEC 11 (PTI): Asian Development Bank (ADB) on Wednesday lowered India’s economic growth forecast for FY2019 to 5.1 per cent on slowing job prospects, rural distress exacerbated by poor harvest and credit crunch. The multilateral bank, however, expects the growth to pick up to 6.5 per cent next year on supportive government policies. “In South Asia, India’s growth is now seen at a slower 5.1 per cent in fiscal year 2019 as the foundering of a major non-banking financial company in 2018 led to a rise in risk aversion in the financial sector and a credit crunch. “Also, consumption was affected by slow job growth and rural distress aggravated by a poor harvest. Growth should pick up to 6.5 per cent in fiscal year 2020 with supportive policies,” the ADB said in a supplement to the Asian Development Outlook 2019 Update. Earlier in September, it had trimmed India’s gross domestic product (GDP) growth to 6.5 per cent from the earlier estimate of 7 per cent. For FY2020, it had projected a GDP growth of 7.2 per cent, which now has been cut to 6.5 per cent. We expect to see carbon neutrality strategies for 2050, and the decarbonisation of key sectors, such as energy, industry, construction and transport, added the UN Secretary General. “In support of these efforts, I am calling on you, leaders from the private sector, to challenge your governments to use this opportunity to make clear their economic development policies that will enable your companies to invest decisively in a net-zero future,” Guterres said. “We are still seeing too many bureaucratic and regulatory obstacles, in-

Teenage activist Greta Thunberg has called upon world leaders to stop using “clever accounting and creative PR” to avoid real action on climate change. Lahore, Dec 11 (PTI): Hafiz Saeed, the Mumbai terror attack mastermind and chief of the banned JuD, was indicted on Wednesday by a Pakistani anti-terrorism court here on terror financing charges, amidst intense international pressure on Islamabad to bring him to justice. The anti-ter rorism court (ATC) Lahore indicted Saeed and three of his top aides Hafiz Abdul Salam bin Muhammad, Muhammad Ashraf and Zafar Iqbal on terror financing charges. ATC Judge Arshad Hussain Bhutta directed the prosecution to produce the witnesses and adjourned the hearing till Thursday. Saeed, 69, along with the other accused, were presented before the court today under tight security. “Saeed and his aides’ lawyers made their arguments requesting the court not to indict their clients,” a court official told PTI after the hearing. “Deputy Prosecutor General Punjab Abdur Rauf, pleading for framing the charges against the accused said Saeed and others are involved in terror financing case and the Counter Terrorism Department of Punjab police has presented evidence for it,” the official said.

The Gambia’s petition alleges that the clearances were “intended to destroy the Rohingya as a group, in whole or in part”, via mass murder, rape and setting fire to their buildings “often with inhabitants locked inside”. A UN fact-finding mission which investigated the allegations found such compelling evidence that it said the Burmese army must be investigated for genocide against Rohingya Muslims in Rakhine.

Salman to quit ‘Bigg Boss 13’; Farah Khan to take over

ilmmaker-show host Farah Khan might take over hosting duties of “Bigg Boss 13” once Bollywood superstar Salman Khan quits the controversial reality. “Salman is quitting the show and Farah Khan will be taking over from January. He’s expected to celebrate his birthday on the sets,” a TV industry source told IANS.

A report suggested that the “Dabangg” star, who turns 54 on December 27, is quitting the show owing to health conditions. According to reports, Salman has recovered from Trigeminal Neuralgia, and his near and dear ones have advised him to leave the show because they don’t want him to get angry again. “Salman has recov-

ered from a health issue called Trigeminal Neuralgia, which doesn’t allow him to get very angry as it will disturb his nerves. But every week, one or the other participant is getting on to his nerves, which is not good for Salman’s health. Hence, this is certainly the last season of the show that he will be hosting,” an industry source told Deccan Chronicle. “He has been wanting to quit for a few seasons now, but somehow the channel and the production house keep getting him back. But now, he has clearly been told by close ones as well that the show should not hurt him in any manner, as his family and friends are concerned for him,” the source added. The users on Windows Phones will be locked out forever after December 31, said Facebook. “WhatsApp will stop working on millions of phones in the next couple of months as the company withdraws support for some older mobile platforms. “From February 1, 2020, any iPhone running iOS 8 or older will no longer be supported, along with any Android device running version 2.3.7 or

NEW DELHI, DEC 11 (PTI): World Cup medalwinning rifle shooter Ravi Kumar, who has failed a dope test, says his is a case of inadvertent intake, an explanation he hopes would fetch him a lighterthan-expected punishment from the National AntiDoping Agency (NADA). The 29-year-old Kumar, who has not been with the national team since the World Cup in Munich last May, is a bronze-winner from the Gold Coast Commonwealth Games and the 2014 Asian Games in the 10m air rifle competitions. He tested positive for propranolol during a domestic competition here. The substance is used to treat high blood pressure

Rijiju expects best-ever haul in Tokyo Olympics 2028

Kiren Rijiju NEW DELHI, DEC 11 (PTI): Sports Minister Kiren Rijiju is hoping for a best-ever medal haul from the country’s athletes in the Tokyo Olympics, but warned that the blame would lie with all the stakeholders if India fails to put up a good show in the 2028 Games. Rijiju said eight years should be enough for India to prepare its best for the Los Angeles Olympics. “If we can’t prepare ourselves for something that far (2028 Los Angeles Olympics) then we have to blame ourselves in terms of policymaking, setting a direction and channelising the resources,” Rijiju said at FICCI’s “Turf 2019” Global Sports Summit.

“With the time which is in our hand we must ensure that India is no more a country which is not taken seriously in the Olympics. I will definitely not be satisfied as a sports minister of the country if we don’t win medals,” he said. The minister said nest year’s Tokyo Olympics is the immediate target but infrastructure needs to be put in place for future events for athletes to perform well. “Tokyo is an immediate target with the existing talent. We cannot create champions overnight. It’s not possible to create world champions in a year or two. We have to ensure that the entire infrastructure is in place,” Rijiju said. “Having said that, we have certain existing talents at our disposal and we have to make the best of it. I hope Tokyo 2020 will be a good platform for India to have a best-ever Olympic performance but we have limitations. However, there is nothing stopping us from 2024 Paris and specially the 2028 Los Angeles Olympics which is more than 8 years away” he added.
