NEW DELHI, APR 10 (AGENCIES): With just 24 hours before the phase I of Lok Sabha elections, the Narendra Modi-led NDA government was dealt with two major blows. The first blow came from the Supreme Court after it agreed to hear petitions for a review of its verdict in the Rafale jet deal on the basis of ‘leaked’ secret documents by dismissing its preliminary objections. The second blow came from the Election Commission, which said that it would not allow the release of the PM Narendra Modi biopic. Supreme Court Wednesday allowed the plea relying on leaked doc-

uments for seeking review of its Rafale judgement and dismissed government’s preliminar y objections claiming “privilege” over them. The Centre had submitted that the three privilege documents were unauthorisedly removed from the Defence Ministry and used by petitioners to support their review petitions against the December 14, 2018 judgement of the apex court which dismissed all pleas challenging the procurement of 36 Rafale fighter jets. A three-judge bench headed by Chief justice Ranjan Gogoi delivered two separate but unanimous verdicts rejecting ob-

jections raised by the Centre that those documents were not admissible as evidence under Section 123 of the Indian Evidence Act, and no one can produce them in court without the permission of the department concerned as those documents are also protected under the Official Secrets Act. Delivering a 58-page unanimous verdict, the top court also went on to say that the publication of the said documents in ‘The Hindu’ newspaper reminded it of the consistent views of the court upholding the freedom of the press in a long line of decisions. The court said it will fix a date for hearing the review petitions.

Poll panel bans release of Modi biopic, NaMo TV

Election Commission (EC) on Wednesday stopped the release of Prime Minister Narendra Modi’s biopic and also ordered a ban on NaMo TV till the Lok Sabha elections conclude, saying that any material which disturbs a level playing field should not be displayed. EC has ruled that a film about PM Narendra Modi’s life cannot be released ahead of elections due to begin on April 11. BJP

told the EC that it has no connection with the release of the biopic and a ban on it will only curtail the fundamental right. But the commission said the film, which contains fictional elements, posed a “serious threat” to ensuring a level playing field for all candidates. It said such a film “may create an impression of truthfulness of content” and could therefore not be displayed on any electronic media or at the cinema.

SC order blows the lid off Modi’s ‘lies’: Congress

Congress on Wednesday said the Supreme Court’s interim order has blown the lid off the “lies” of Prime Minister Narendra Modi on the Rafale deal, and termed it as the first step towards justice with the last being a joint Rahul Gandhi parliamentary committee probe. Congress president Rahul Gandhi thanked the Supreme Court for rejecting the Centre’s objections over the admissibility of the “leaked” documents cited by petitions seeking a review of the Rafale verdict. Addressing mediapersons in Amethi, he said, “The Prime minister has been claiming that the Supreme Court had given him a clean chit on the Rafale deal. The Supreme Court has clarified and has begun an investigation into the Rafale deal.” (Cont’d on p-11)

BJP accuses Rahul of gross contempt of court

Accusing Congress president Rahul Gandhi of gross contempt of court, the BJP on Wednesday said he attributed to the Supreme Court what it had never said in its order on the Rafale deal. In a message, Acharya called upon all, especially the first-time-voters, to participate in the biggest festival of democracy in the world and not let their vote go waste. “Vote is right and duty,” he said, adding that every vote counts and could make a difference in taking the country to a road of development. Jailed Manipur scribe released

IMPHAL, Apr 10: Manipur journalist Kishorechandra Wangkhem, who was detained under the National Security Act, walked out of the prison on Wednesday. Authority in Manipur Central Jail released journalist Kishorechand, following an order of the High Court of Manipur. The 39-year-old journalist, former news reader of ISTV network, was detained under NSA on November 27, 2018, for allegedly calling Manipur CM a “puppet” for celebrating the

birth anniversary of Rani Laxmibai of Jhansi and allegedly neglecting the freedom fighters of the state. He was arrested on sedition charges and sent to jail for one year in November last year. After coming out of the jail, Kishorechandra thanked his media friends, human rights activists, rights bodies, CSOs who had supported him in fighting for justice. “I would like to thank my friends from media, rights bodies and CSOs including my wife who supported me morally in fighting for justice,” he said.

KO H I M A , A P R 1 0 (NPN): The stage is set for over 12,13,777 electorates, including over 16,000 first time voters, to exercise their franchise in the first phase of polls for the lone Lok Sabha seat. For the bypoll to the 26-Aonglenden constituency, to be held simultaneously with the Lok Sabha polls on April 11, the constituency has 12,436 electorates including 6,146 male and 6,290 female voters. Voting for both Lok Sabha and by-election will be held from 7 a.m. to 4 p.m. The phase-I Lok Sabha election will also see 91 constituencies across 20 states voting to choose their representatives from about 1,300 candidates. The elections, which will begin on April 11, will continue for over a month till May 19 across seven phases, followed by counting of votes on May 23. Correspondent KOHIMA, APR 10 (NPN): Kohima principal district and sessions judge Khesheli sentenced three persons to life imprisonment on April 2 in connection with the killing of Rahul Dey, son of late Subhas Dey. According to public prosecutor Kathu Rengma, the convicted trio – Lipise Sangtam, Ngamphong Konyak and Hangtong Konyak, all in their early 20s – had beaten Rahul to death on the night of Febru-

ary 21, 2016 and threw his body below the Secretariat Road here. The body was retrieved by police the next morning after being informed by public. UBSI H Inaky of North PS, Kohima investigated the case and submitted charge-sheet against the three accused. Seven persons were examined as witnesses during the course of investigation to prove the case. While convicting the accused, the judge stated that the prosecution had

proved the case beyond reasonable doubt. The court further observed that the accused persons had beaten Rahul and pushed him down the road to mitigate evidence. The court stated that the accused had committed an act that was likely to cause injury sufficient enough to cause the death in the ordinary course of nature. The three persons were convicted under Section 300 IPC and punishable under Section 302 IPC.
