Candy’s Commentary: A Little Legal Jargon

A

s the new year is fresh upon us, I am thankful for all the love 2017 bestowed upon our Las Vegas community as we faced one of the most catastrophic events in modern history this past October. Las Vegas has always been identified as a tourist destination. Make no mistake that after what our city endured, not only did the local community respond, but the world sent heartfelt thoughts for Las Vegas. People came together to support one another in our time of need: from Paris illuminating the Eiffel Tower and the Empire State Building being lit up in red, white and blue, to the countless tourists that came to see the Healing Garden. The iconic Las Vegas sign was given a special new meaning when Illinois resident and retired carpenter Greg Zanis delivered crosses for each of the 58 victims of this tragic and heinous crime that will forever have an impact on our beloved city. On the more positive side of things, in 2017 our city had the chance to witness a super star hockey team that already has broken records in the league led by team owner Bill Foley, our own NFL team, the Raiders making its way to Las Vegas as well as our own pro soccer team, the Las Vegas Lights. Local officials anticipate that these

teams now calling Vegas their home will boost tourism, as well as have a positive impact on our local economy overall.

Having wanted to become an attorney since I was a child, I have always had a passion for the legal community, our judicial system and all the legalities and loopholes that come with practicing law. I’ve had the opportunity to overhear firsthand, read, and study court documents of attorneys’ clients like the “Rat Pack,” former mob bosses, famous entertainers, and many more throughout the history of Las Vegas, and I had always imagined I would be litigating cases in a courtroom in front of a judge and jury. Fast-forward 20 years, I am thankful to be publishing a magazine for locals, by locals and to have the ability and opportunity to work hand-inhand with some of the most incredible attorneys Las Vegas has to offer. These professionals fight tirelessly to protect us locals and Las Vegas’ best interests. These fierce litigators positively impact our community in a multitude of ways — everything from supporting local charities and attending local events, to providing political support and contributions. One of the most

Dan has been called the ‘go to’ guy for big cases, handling appeals concerning large monetary awards and punitive damages as well as those of public importance. A look at his career highlights include the successful argument to allow former Nevada Governor Bob Miller to seek a third term in 1994, securing George Foreman’s right to fight for the heavyweight title against Michael Moorer, representing former UNLV coach Jerry Tarkanian in his battle against the NCAA and serving as lead appellate counsel for pharmaceutical companies and, later, HMOs in cases arising from the Hepatitis C outbreak among Las Vegas endoscopy clinics.

His love for law was forged from an early age through a doting grandmother who envisioned him in a life of public service as a political leader.

He would be a great public servant because he truly cares about people. Once in law school, though, he realized the beauty of and possibilities in the law, itself. And he excelled. Not only is he a scholar of the law, he finds pleasure in what he does. Judges can attest to an oral argument containing poetry peppered with a whimsical twist, but still in a deliberate and convincing manner.

Stories about Dan are replete with praise for both his style and his preparation. Chief Justice Michael Cherry first met Dan around 1983 when Cherry was the Special Master of the Hilton Hotel Fire Litigation. “I knew he was a special type of an attorney,” according to Justice Cherry. “Dan Polsenberg, today, is one of the finest appellate attorneys to appear before the Supreme Court.

He is always prepared and he is entertaining. If he gives up law he would be a great late night host.”

any people see me around Las Vegas or in photos with my signature Bombay Sapphire martini and whole jalapeño in one hand and a showgirl on each arm. “Why is that?” you may ask. You see, I’m living the brand, serving as the Official Ambassador of Las Vegas tourism in my role as Chair of the Las Vegas Host Committee.

Everyone knows that I am devoted to Las Vegas and all that it has to offer. The Las Vegas Convention and Visitors Authority created a permanent Host Committee in 2011 with two main objectives: 1. To welcome the many business and leisure visitors of Las Vegas’ citywide conventions and special events; 2. To educate the local community about the value of tourism to Southern Nevada.

Tourism is the lifeblood of our economy, supporting nearly half the jobs in the area and generating $60 billion in economic activity each year. Attracting more visitors is critical to the continued growth and success of our city. A key to attracting both new and repeat visitors is delivering on the brand promise that Las Vegas is the ultimate travel destination, and providing the best possible experience for tourists.

I have always said that Las Vegas is the greatest city on the planet, and it’s our tourism industry that makes this true. The 42.9 million people who visit us annually support jobs for 44% of the total workforce, generating millions for schools, roads and parks through the hotel room tax. Without tourism, every household in Southern Nevada would pay approximately $2,700 more in taxes.

Tourism is not just a benefit for those who work in the industry, it provides benefits to every one of us who live here.

Las Vegas is known as the Entertainment Capital of the World but it’s important to recognize our city is also a leading destination for business travel. In addition to breaking a record for overall visitation in 2016, Las Vegas also hit an all-time high in business travel after welcoming 6.3 million delegates for the year.

get excited about meeting new people in the interview process and will normally post a picture of them on my Instagram to invite my peers to stay tuned for the upcoming article. I guess it’s my way of sharing with everyone my excitement to step into someone’s life and let their story be told. When I was given the assignment to interview Karen Garrett, I admit, I wasn’t familiar with her and didn’t expect the reaction I got from a good friend of mine and former professional basketball player, Samuel Coleman, Jr. I post a fabulous picture of Karen with a brief introduction of her and his immediate comment, “”Holy Hands is legit!” After talking to Karen, I knew exactly where this sentiment came from.

Born in Boston, Massachusetts, at a very young age Karen was drawn to understanding how the body worked. What is important to our story of her today was that she was even more intrigued by how the body could be trained to achieve form and how it could heal itself. “I remember wanting to give massages as a kid and just wanting to make my mother feel better,” says Garrett. As a teen, Karen fueled her passion for understanding the body with dance classes and

later fitness classes that taught her what would later be the foundation of her career. As one of the youngest students in these classes, she’d learn nutrition and how that worked hand in hand with achieving her fitness goals. In high school her teachers understood her passion and would allow her quick breaks to eat at her scheduled times. “I would explain to my teachers that if I didn’t fuel my body at that very second my body would miss it’s nutritional window of opportunity.” At the young age of 19, she’d become the General Manager for the gym she took classes at as a kid. If her teachers could see her now I’m certain they’d smile as they look back at such memories and wouldn’t be surprised at all that Karen is one of the world’s most sought after holistic healers today.

I met Karen at City Athletics in South Summerlin,Las Vegas. “I’m a competitive body builder, I have a lot of injuries, I suffer in chronic pain so I just do what I wish somebody would do to me…” the Holistic Health Practitioner from Meuller College of Hollistic Health in San Diego explains is one of the key things that separate her from other therapists out there.

From Navy Recruit To A Successful Boutique Brand – The Pretty Kitty

T

ricia Hetherington- just a small town girl… who went to fashion school, dabbled in acting and modeling, decided to join the Navy to launch and recover F-14 fighter planes, then become an aesthetician, to eventually open up twelve and license an additional thirteen wax boutiques in the United States, “The Pretty Kitty”.

“I have a bit of a unique background. It was after I left the Navy that I decided to use my GI bill and go back to school to become an aesthetician, but it was hard to make a living. After being in the industry for several years I was still struggling.

That’s when I met (my partner) Dane- at a charity event. We started dating, and he kept telling me we should go into business together, but I thought he was absolutely crazy!”

One night in 2006 while living in San Diego, Tricia realized that the main focus in the beauty industry had been day-spas- where you spend an afternoon getting all of your beauty regimens done at once. There were no cute-named boutique specialty spas- especially focusing on waxing. She decided to take a risk with her boyfriend and become business partners, opening up a boutique salon specializing in fast Brazilian waxing services.

“I decided to just say, Okay, what the heck- if we are going to do this, let’s do something completely different, that’s never been done before, and come up with a funny name that get’s people’s attention. That same night, all within a few minutes of conversation, we brainstormed a name- Pretty Kitty came out like- BAM! A light bulb moment went off, and I got the chills. I looked at him and said, Oh My God this is it. This is what we are doing.”

Tricia and Dane opened their first store three months later. It was a very small, run down, 430 square feet building in Pacific Beach, San Diego, but they just knew they were going to make it into something special. They did all of the renovation themselves, and turned their brand new store into a chic, “Breakfast at Tiffany’s” inspired boutique salon.

They worked seven days a week for months- and eventually had their clientele grow enough to hire employees. Just two years after opening their first wax boutique, they opened a second “The Pretty Kitty” in Chula Vista. A year after that, they opened the next one... all without a single penny of debt.

“We moved to Vegas for the first time in 2009, and that was the third store we opened, but the first store in another state. Then a year after that, we opened up the second Las Vegas store- off of Flamingo. After that one opened, we moved back to Orange County. We now have 7 in Orange County, and also license our concept; kind of like franchising… we have about 25 locations now.

Three of which are in Las Vegas. We moved back here a few years ago, built a house, and we love it. It’s been a pretty cool ride- a lot of hard work, but things are much easier now.”

Talking with Tricia, I was impressed by her vivacious personality, her professionalism, and passion for her business. She exudes confidence and pride over her boutiques- qualities that are excitable for the customer to experience firsthand. Tricia also designs all of the “The Pretty Kitty” boutique stores herself, and after hearing her story I was anxious to be invited to come check out the boutiques myself… so I booked an appointment.

All of Tricia’s stores are unique, but with a distinct style and detailed polish that only “The Pretty Kitty” offers. The décor is chic, the atmosphere is mellow, and the salon is pristinely clean. The women running the front desk were bubbling with positive energy, kind, and welcoming. At “The Pretty Kitty” in Summerlin, I was greeted by a super sweet woman named Kirsty, who was going to give me an underarm, Brazilian, and leg wax. Usually, when I get these services done together, it can take about an hour, or sometimes more. Kirsty had me out in 26 minutes, with even more precision and less pain than I had ever experienced before! She was absolutely amazing.

She chatted with me the entire time to keep my mind off of the uncomfortable, sometimes awkward, and painful concept of having your hair ripped out of your skin. Kirsty explained how Tricia trains all of her employees to remove hair the exact same way, and I now understand why. Somehow, the way that she was able to swiftly, efficiently, and (relatively) pain-freely remove my unwanted fuzzies was nothing short of impressive. Even the wax was special! Not only was it a sassy shade of pink, it was applied with high-end equipment that made the removal process so much easier.

I was so impressed with my services at “The Pretty Kitty” that I have vowed to transfer my monthly visits to this salon… especially since they can get me in an out that quickly! I always have to convince myself to get up the courage to go to the waxing boutique… and now, I think I’m actually going to look forward to it! Tricia was at the forefront of the boutique beauty salon wave, and has developed a very unique way to make her customers feel special and relaxed, all while receiving high-end salon quality waxing at a remarkably affordable price. Get an annual physical - This should be at the top of everyone’s list. Unless you have a crystal ball, there is no other way of knowing if you have a disease or illness other than getting the proper tests done that are recommended by your doctor.

We shouldn’t wait until we get symptoms, before seeing our doctor.

Pay attention to posture - I know this sounds like something everyone does, but you would be surprised how many don’t . Slouching over time takes a toll on the spine. Get into a routine of stretching every morning right upon waking up. Standing in a doorway, grabbing the top of a door frame is a great way to start our morning.

It also gets the blood flowing and actually feels great.

Reduce alcohol intake to one or two days a week - There is nothing wrong with socializing, but that doesn’t mean alcohol always has to be included..

Put the heavy weights down - This is probably the number #1 way injuries are caused. Especially as we get older. There are so many ways to build muscle, but injuries are not one of them. Besides being painful, they set us farther back than if we had just taken our time in building a more solid foundation. Try using lighter weights, less repetitions.

We are what we eat and what we eat in private shows up in public - This saying couldn’t be more true. Many just can’t cut out the “feel good” food like pizza, fried chicken pasta or dessert. This is what they

were designed to do. They trigger the feel good hormones in our brain but they should come with a warning label. Genetics only go so far and over time they start to give way to our lifestyle choices and is the source of many of our health problems.

Besides the scale going up, you can’t put bad food in your body and expect to feel good, or the scale to go down.

The best and most effective diets aren’t fads - These are the 4 simple rules for successful dieting. 1. Learn portion control 2. Eat every 3-5hrs 3. Eat more protein, less sugar 4.

Hydrate more dehydrate less 5. Calories burned have to exceed calories taken in.

Avoid fad diets. The most common reasons fad diets don’t work long term, is because it is deprived of the foods and nutrients needed to function at its best. Not to mention that once off the diet, the weight comes back with a vengeance. If it doesn’t, play the lotto cause that’s incredible luck.

Take a multi-vitamin - Unless you are eating the daily recommended amount of fresh fruits, vegetables, proteins and fats, which I am guessing many aren’t, get it from another source.

Stress is the silent killer - Avoid it at all cost.

It isn’t so blatant as other symptoms. But the effects can be more serious than any other disease. Breathe, take a yoga class or find a way to release the build-up of what we internalize each day. It is very much there whether we recognize it or not.

Get an annual check up and physical - This includes blood-work. Talk to your doctor and as start as soon as it is recommended.

Early detection is much better than late discovery. Prevention beats a prescription.

Birthdays, Holidays, and other celebrations come every single year. This isn’t a license to eat everything in front of us. Eat like there will be more, not less. This isn’t the last supper. Enjoy in moderation.

What do I do if I am struck by a vehicle that does not have insurance?

There are other potential sources of recovery to consider. For example, the driver of the at-fault vehicle might be insured by an auto policy other than that of the vehicle driven at the time of the crash (consider a borrowed car situation for example). You might also be entitled to uninsured / underinsured motorist (“UM/UIM”) compensation. You should consider the policy of the vehicle you occupied at the time of the crash as well as your own auto policy (if different from the vehicle you occupied).

Due to the limited nature of this article I cannot thoroughly evaluate and answer the question presented. Please give my office a call for a proper consultation.

An Uber driver crashed into my vehicle.

Does the driver’s personal liability policy apply or does Uber’s?

Which liability policy will apply generally depends on the Uber driver’s “status” at the time of the crash. Here is an overview of the different statuses and their respective coverages:

OFFLINE (the vehicle is driven solely for personal use and the app is not active): The driver’s personal liability coverage will apply.

AVAILABLE (the driver has activated the rideshare app and is ready to accept passengers): Uber provides a $50,000 per person injury limit and a $100,000 per incident injury limit (in the event that more than one person is injured).

EN ROUTE (the driver has accepted a passenger request and is en-route for pick-up): Uber provides $1.5 million in liability coverage.

ON TRIP (the driver is transporting a passenger to their destination): Uber provides $1.5 million in liability coverage. Due to the limited nature of this article I cannot thoroughly evaluate and answer the question presented. Please give my office a call for a proper consultation.

My apartment complex was recently taken over by new management. Not long afterwards we started having problems with our water. For about a week and a half we had freezing cold water; then we had lava hot water for another week; and intermittently we had no water at all. Finally fixed the main problem but we still have the occasional days with no hot water or no water at all. They refunded me a $50. What are my rights in this situation?

A

I would need to see your lease to better answer your question. But in general, your landlord is obligated to keep your apartment habitable. Not having hot water...or having no water at all...arguably makes your apartment unfit to live in. If your landlord does not completely fix this problem within a reasonable period of time, you may have a few “self-help” options.

One could be to pay for the repairs out of your own pocket, and then deduct the cost from your next rent check (be sure to submit the rent check with a copy of the repair receipt). A more drastic measure would be to move out and walk away from the lease. However, your landlord could try to sue you for not paying rent or for breaking the lease, so my recommendation would be to consult an attorney skilled in landlord-tenant disputes prior to taking further action. In the meantime, make sure you notify your landlord in writing every time there is a water problem, and

keep copies of your communications. Also, keep detailed records of the dates and times you have no water or no hot water. If possible, take video of turning on the faucet with no water running. All this evidence will help bolster your case should your landlord take legal action against you.

What do you do when your employer falsely accused you of lying about having a disability (when you have doctoral proof) and terminates you because of it?

Nevada is an “at-will” employment state, which means that employers can fire employees for any reason…but there are some exceptions:

One exception is if the firing somehow violates “public policy.” In other words, the firing may be unlawful if it threatens public health, safety, welfare, and morals.

Another exception is if the firing violated the terms of a written, oral or implied contract between the employer and employee.

And under federal law, employers are prohibited from firing employees on the basis of race, age, sex, religion, disability, or pregnancy.

On the basis of what you said, I would argue that your former employer violated public policy by firing you for “lying” about having a disability when you have medical proof that you did not lie. But I would need to know more details about your situation to advise you, so I recommend you consult with an employment attorney as soon as possible to discuss whether your case falls under one of the aforementioned exceptions.

Marsy’s Law: Measure on 2018 Ballot

I

n 1983, the life of Marsalee “Marsy” Nicholas tragically came to an end. Just one week after Marsy’s death, the man accused of the murder ambushed Marsy’s mother, Marcella Leach, and her brother, Dr. Henry Nicholas, at a grocery store.

The family was not aware the man was released on bail.

Understanding the pain victims endure, Dr. Nicholas set out to advocate for a law which would provide rights to victims of violent crimes who had none – whereas the accused have more than 20.

This law is known as “Marsy’s Law.” The official website marsyslaw.us shows a black and white photo of a smiling Marsy with her family.

Covered by a graduation cap is Marsy’s pretty, flowing hair.

The law has passed in California, Illinois, North Dakota, South Dakota and Ohio. Advocates for Marsy’s Law are now hoping to get the law passed in Nevada come 2018. Many have been hard at work spreading the word to educate Nevada residents on the history of the law and why it matters to them. These advocates hope to gain their vote when the time comes for the final approval.

The road to getting the measure on the ballot has been a long one. In press release after press release, Marsy Law advocates proudly announced endorsements from Las Vegas City Council members Michele Fiore and Bob Coffin, and Henderson City Council members John Marz and Dan Shaw.

In a press release issued in October (Domestic Violence Awareness Month), Marsy’s Law advocates gave a well-deserved thank you and public recognition to Nevada organizations working toward ending domestic violence. It makes sense, after all, that advocates for Marsy’s Law would extend a special thank you, as the essence of the law they’re advocating for is to give rights to victims of violent crimes.

Also, in an effort to bring awareness and provide valuable information, Marsy’s Law advocates want people to know that domestic violence affects everyone. They’ve asked Nevada citizens to be aware of the warning signs of domestic abuse.

According to the advocates’ press release, victims of domestic abuse suffer from low self-esteem, eating disorders and many other issues. But abuse survivors are not alone: there are over 20 agencies in counties across the state that provide support to domestic abuse victims.

Now that the law is part of the 2018 ballot, the final approval will rest in Nevada resident voter’s hands.

Marsy’s Law advocates say in the press release, “Just as the accused have important protected rights, the victims deserve a protected voice.”

If approved, the law would grant, “the right to receive information about the services available to crime victims; the right to be treated with fairness and respect throughout the criminal justice process; the right to be protected from the defendant; the right to notice of all public proceedings in the case; the right to be reasonably heard, upon request, at all public proceedings regarding the case; the right to reasonably confer with the prosecuting agency, upon request, regarding the case; the right to full and timely restitution.” MV

Money to invest... It’s most important that you have the money and ready to buy. Whether it’s cash, hard money loan or private loan, you must have ready to show “POF” (proof of funds) for cash deals, or a preapproval letter from a lender for home loans. Cash is easier to negotiate since some of the distressed properties may not qualify for a loan based on excessive repairs. When it comes to negotiating and quicker close, cash is still king. But if you are looking to leverage your money then loan it is.

Finding the deal... There are many places to search and find deals but only if you know where to look for distressed properties and deals.

Steps To Buying A Home In Today’s Market…

It’s A Sellers Market Out There!

S

o you are ready to buy a home here in Vegas? Well before you begin that journey, take my advice to avoid some of these common mistakes and pitfalls…. that often lead to financial unrest and often emotional disheartenment. First be aware that it’s a “SELLER’S MARKET” which has adverse effects on the BUYER. The Seller has certain advantages in a Seller’s Market, that don’t usually occur in a balanced market. Homes that normally take 3-4 months to sell, are selling now in 3-4 days!

And some with 10-20 offers on the same house, in ONE DAY! Buyers have to be READY! When they find that perfect home, they need to have all guns loaded and ready to seal the deal! Here are my personal steps I recommend for all my buyers in this Seller’s Market.

PREQUAL LETTER: Get your prequel letter asap! First things first!

A prequal letter is a Pre-Qualified Letter from a Mortgage Lender, stating that they have prequalified you for a certain amount of money to buy a house. To the Seller, that means you are strong, already qualified, and can close the home and move in quicker. You look like a much stronger buyer than everyone else. Don’t even go looking at homes, till you have that letter in your hand! That’s the Golden Ticket!

OFFER OVER LIST: Be prepared to offer “Over List”, which means offering MORE than the Seller has the home listed (priced at). If it’s the “Perfect Home” for you, it’s probably the perfect home for someone else too. And it’s perfectly legal to pay a man more than he’s asking for his house. The reason today’s buyers are offering over list relates to a few points. They really love the home, and really want to get it before anyone else does. Other buyers are out there looking at the same time, and the Seller will most likely accept the Highest and Best offer. Not that you have to, but know that it’s very common to see offers Over List in this Seller’s Market.

KNOW YOUR FINANCES: After meeting with the Mortgage Lender, you will have a clear picture of what your financial strength is… what you can buy, how much of home you can buy, what size of down payment

you will need, and what your monthly payments will be. You might be pleasantly surprised how strong you are! Meeting with a lender costs absolutely nothing, and only takes 30-45 minutes. Time well spent to prepare you for this exciting chapter of your amazing life!!

CHOOSE A GOOD REAL ESTATE AGENT: In my opinion, the most important decision you can make. Google and real estate websites are not up to the minute accurate, however your agent has instant and accurate access to the current status of any home. The home you see on your computer could already be sold.

Outdated and old information. Your agent is also looking out for your best interest. Most people wouldn’t go to court without a lawyer, and I wouldn’t go looking at homes without a Professional Real Estate Agent. They know the questions to ask, how to negotiate a better deal, and they have the resources to protect you along the way.

MAKE A LIST: Sit down and put some thought into your search. What area of town do you like? Do schools matter? Shopping? Parks? How many bedrooms? Baths? Pool? Fireplace? Garage?

I recommend taking a sheet of paper, and drawing a line down the middle, and on the left side, put your “Must Have” features… and on the right side put your “Would Be Nice” features. HE MARKET IS HOT: The local Las Vegas real estate market is on fire! And it’s set to be cooking for the next few years! With the onset of our national sports teams, The Las Vegas Knights Hockey team, and the Las Vegas Raiders, this town is set to explode with real estate values. The under $300,000 home market is selling super-fast. 83% of homes in this rage are selling in 60 days. Some homes, if set to sell right, and move in ready, are selling as quick as same day. And in this market, some properties for sale are receiving multiple offers, as much as 20-25 offers on the same house, all at once. The median price in Vegas is now at $260,000, which is up 10% from last year, and these homes are flying off the shelf. In some cases, homes in this price range are selling “over appraisal” because of the shortage of homes for sale in today’s Las Vegas market. (Recent MLS count was only

5157 homes on the market). And 2017 Sales are outpacing last year 2016.

Luxury homes, ($750,000 and higher), are also moving at a fast pace than usual. Average days on luxury market are around 120, and the selling prices are very close to the listing price, if not the same.

For those in a pinch for the down payment, you might want to consider the HIP program! Home is Possible. Many lenders are offering this “Grant” program, to assist you in coming up with your entire down payment. Very attractive for those who thought they could not buy a home. There are 8 tours to choose from with groups as small as 2 and sometimes as large as 150.

Each tour is assigned a meeting point at which you meet your tour guide who leads you into the restaurants where you’re immediately greeted and seated by the host or hostess who give you the VIP welcome. That’s What She Said MB Steak Restaurant Review

here has been chatter about this hot new spot and one of us did a little research prior to dinner so we could not wait for our weeknight adventure into MB steak. We were delighted to find out that MB Steak offered a “secret valet”, perfect for locals and easy access directly into the restaurant.

The hostess escorted us to our table and the first thing that stood out in this remarkable two-story restaurant was the main dining room. Imagine entering a room that feels like a spectacular mash up of an elegant supper club, the interior of a whiskey barrel, and Game of Thrones. The ambient lighting and comfortable atmosphere both lent to the perfect setting for dinner. Hidden behind the main bar is a private dining room with slats that can stay closed for privacy but can open, if the inhabitants of the evening would like the energy from the casino floor to filter through.

Next up, was Tuna Poke served with wasabi soy, pickled cucumber, and avocado puree. This truly unique dish had a zing from the pickled cucumber, complemented by the avocado puree and lotus chips that added a bright crunch.

Once we sat, Chef Billy greeted us warmly and as we whet our appetite on the amazing herb and cheddar bread, presented with butter kissed with olive oil and black lava salt. He took us through the story of the newest restaurant at the legendary Hard Rock Hotel. It is apropos that the restaurant, founded by brothers Michael and David Morton (hence, the moniker “MB Steak”) chose to build the restaurant from the ground up at the hotel their older brother, Peter, originally opened over twenty-two years ago. While Peter has left the building, MB Steak is definitely a spot worth checking out.

We got our greens in with a steakhouse staple, the Chopped Salad, which was as colorful as it was tasty. This salad incorporated a quite a few things that one of us absolutely loves; grilled tiger shrimp, artichokes, hearts of palms, white beans, pepperoncini, and green beans. The other has not met an olive she did not like and the Castelvetrano olives did not disappoint. We were both delighted to find sweety drop peppers, adorable miniature red peppers that hit the palette with just the right amount of heat. One of decided that this was her new favorite salad ingredient.

As we chatted with Chef Billy, we ordered cocktails. The Beet Writer was the choice for one of us, the more adventurous of the two. Ketel One Citroen Vodka, Strawberry infused bitters, homemade grenadine, fresh lemon, and sage are shaken together to create a brilliant cocktail with and earthy touch and the gorgeous hue of, well, beets.

The 14 oz. Strauss veal chop served with the bone in is topped with a crust composed of ingredients both of us love, garlic and parmesan. It was out of this world.

One of us would have been content making a meal out of the aforementioned herb and cheddar bread and had to stop herself. We moved onto the Charred Spanish Octopus with broccolini, stewed tomatoes, and port wine. The heavy char on the octopus was nicely balanced with the crunch of the broccolini and the sweetness of the port wine.

Dry Aged Tomahawk Seared Sonoma Foie Gras

It is unusual but one of us judges a good steakhouse not only by how well they cook steak, but also by how well it cooks salmon. Fennel crusted salmon with marble potatoes and lobster butter was pleasantly cooked to perfection. The fennel provided a nice balance to the rich lobster butter.

Another steakhouse classic, creamed spinach, reached a new level thanks to the Morton Brothers. Topped with a poached egg and truffled Gouda, one of us thinks she had a life

altering experience. As if the creamed spinach wasn’t enough, her next bite was the Maitake mushrooms, topped with aged goat cheese. The edges of the mushrooms were perfectly crisp and unlike fresh goat cheese, its aged counterpart has sweet and nutty flavor notes.

For the other, one of us discovered one of our top bites of 2017 in the cream corn with king crab and roasted poblanos. The texture was amazing with corn was that was smooth and crunchy at the same time, the crab was sweet and there was just enough heat from the poblano pepper.

We couldn’t believe we even considered dessert at this point but we are so glad we went all in.

We opted for the 8-layer carrot cake, perfect for sharing. Alternating between thin layers of candied pineapple, ginger, candied walnut, and nice big pieces of carrot, this was simple and traditional but still all Hard Rock in its sexy presentation.

After dinner, we were treated to a peek of the second level. The first thing one of us noticed wasn’t the beautiful island bar in the center room or the windows that framed the entire room, rather a skylight with moss and a stunning mix of succulents cascading in from about 30 feet above.

The other noted that the windows open so she foresees beautiful spring evenings being spent coming back to this spot.

The evening was pure perfection and that’s was she said. MV

Cory Harwell of Simon Hospitality Group In 2009, Harwell created Uber Hospitality Group and owned three Round Table pizza franchises as well as Caña Tapas Kitchen & Bar. It was at Caña that Harwell met Chef Kerry Simon and the beginnings of a new friendship began. In 2012, the two finally had an opportunity to work together and the pair decided they would form their own company together and pursue their mutual interests. Simon Hospitality Group was born.

Harwell partnered with Kerry Simon to create Simon Hospitality Group in late 2012 and they worked together to build the firm into an internationally recognized hospitality development and operations company. Since the firms’ creation, Harwell has spearheaded their very high profile projects; Chuck’s a Kerry Simon Kitchen at the Hard Rock Hotel in Chicago Illinois, Simon Mansion at the Hard Rock Hotel & Casino in Punta Cana Dominican Republic, and Le Pink Flamingo in Montreal Canada, to name a few.

as Vegas’ epicurean scene is ever evolving, and Restaurateur Cory Harwell has quickly become a front-runner within the industry.

Never far removed from his roots, starting in the dish room of a mom and pop restaurant in Woodstock Georgia, Harwell now uses his 20-plus years of experience at Simon Hospitality Group, and continues to pay homage to his origin by celebrating comfortable and recognizable food while using familiar vehicles to introduce guests to new and exciting ingredients.

In 1993, Harwell was afforded the opportunity to work closely with Marc Packer to open HarleyDavidson Cafe, Rue 57 and Angelo & Maxie’s in New York City, and to relocate to Las Vegas in 1997 to build and operate Harley-Davidson Café. In 2003, Harwell was recruited by Tom McCartney at New York-New York Hotel & Casino to help develop, build and operate Nine Fine Irishmen. After opening this highly successful restaurant and pub, Harwell was promoted within the organization and ultimately became the Vice President of Food & Beverage prior to his departure in December of 2008.

In 2014, Harwell and Simon opened Carson Kitchen in Downtown Las Vegas. A true labor of love, the duo created an intimate experience that made guests feel like they were in Simon’s loft for dinner – and the restaurant quickly became a game changer in Downtown Las Vegas and now allows guests who dine there to carry on Simon’s legacy.

Harwell is the epitome of the self-taught Chef who just loves great ingredients, bold flavors, and phenomenal food. He learned from his mother and grandmother that food must have an opinion. His simple philosophy of food is two-fold; re-introduce your guests to foods and flavors they already know but are reimagined or modernized, or introduce your guests to new ingredients or flavors, that they would normally be reticent to try, by using them in familiar vehicles.

Harwell lives in Las Vegas with his daughter Kayla James and his wife Lauren. He dedicates much of his spare time to charities that raise money and awareness for childhood cancers; including St. Baldrick’s and Tommy’s Gifts for Kids. MV

1 oz Butter chilled 2 oz Onions white diced 1 oz Jalopeno, diced 2 oz Tomato diced 1 T Garlic minced 2 oz Beer 4 oz Heavy cream 1 oz Mayo 1 T Dijon Mustard 1 t Worcestershire 4 oz Cream Cheese 4 oz Aged, sharp white cheddar shredded 3 oz Lump crabmeat A dash Tobasco A pinch Salt and pepper A pinch Parsley chopped

In a sauté pan heat the butter and the onions & jalopeno and sweat, add tomatoes & garlic and season with salt and pepper Deglaze with beer and allow to reduce by half Add in the cream, mustard, mayo, worcestershire and bring to a boil reduce to desired thickness Add in the cheeses and melt through while stirring Add in the crab meat and fold together Season with salt and pepper to your liking Spoon into oven safe serving dish, top with cheddar and brown in oven Serve with assorted warm breads, crostinnis or grilled baguettes

My open-minded diner? My daughter, younger than 2 years old, with a palate more mature than some adults I know. Before she turned 1, her bibs would be smeared with canary-hued dribbles, after her Jamaican-Puerto Rican-American father spooned pureed curried chicken into her mainly toothless mouth. Her October birthday meant a slight change in weather so there were bowls of arroz caldo, reflecting my Spanish and Filipino roots. The gently simmered rice porridge was infused with ginger, garlic and lemon to ward off the seasonal sniffles. If I was concerned the ginger would be too spicy, she proved me wrong.

The empty bowl was followed by “more?” Yes, babe, yes. Always more, in our hyphenated home.

The Mortera Chicken Adobo • 4 pounds bone-in chicken breast, butchered in two pieces, and thighs • ¼ cup soy sauce • 3/4-to 1 cup rice vinegar or lemon juice • 4 peeled, whole garlic cloves • 1 yellow onion • 2 bay leaves • 2 teaspoons whole black peppercorns In a large stock pot, sear chicken until browned on all sides. Throw in onion and garlic and saute until almost translucent. Add the spices. Combine the liquids in a separate container. Add a dash of salt, ground pepper and more vinegar or lemon juice until the sauce hits the right balance of savory and sour. Pour the marinade in the pot, cover and simmer until the chicken falls off the bone. Serve over steamed, white rice. MV

Common Mistakes Even Successful People Made in Their First Jobs

I

f I look back on my first job, I find that there were many things that I could have done better as a professional, but that I decided not to do. Reflecting on career mistakes, however, is a practice that successful leaders use to grow.

This is not to say that you should make mistakes, however, so below, I have cited some common missteps that I, and indeed most, people have made in the beginning of their careers.

Failing to Ask Questions What you don’t know can hurt overall performance, and if you don’t ask, employers may feel that you don’t want to be bothered with the tough task of learning. Maybe you are too embarrassed to speak up or don’t want to annoy co-workers or supervisors. The next time you have a question, though, ask it; asking questions amongst your peers and supervisors will put you ahead of the pack in getting noticed.

Sending One-word Replies Regardless of how busy you are, always devote some time to responding effectively to your coworkers and clients. Few people care how many emails you have responded on a daily basis, but they do care about you taking the time to listen and then respond substantively.

Do I know you?

Forgetting names demonstrates a lack of consideration for others. As a new employee, you must always get to know everyone while at your office or on your team. Even if you do not know their names, at the very least start conversing with them occasionally is helpful. Besides, everyone likes to be greeted and new employees should make an effort to fit into the culture of the organization.

Know-it-all!

Behaving as if you know everything—even if you have prior experience or education—is one of the quickest ways to annoy others. Although you want to appear confident in your skills and abilities, you should also rely on your team when faced with challenges and duties that are unfamiliar. You will appreciate the input given by colleagues and in return they will feel like they have contributed to your overall performance.

Not My Job Just because a task may be outside the scope of your job responsibilities does not mean that it is not your job. Getting involved with your staff builds teamwork and it shows that you are willing to help out when in need. Even the most menial task like taking the out the trash earns respect from your coworkers and supervisors.

World’s First CBD Oil Retail Chain has Chosen to Open Inaugural Store in Las Vegas

n January 1st 2017, the legalization of recreational (adult) use, possession, cultivation, and sale of cannabis went into effect in Nevada and the newfound industry was met with considerable success. As the fifth state to legalize recreational usage, the passing of Ballet Question 2 in Nevada resulted in a flurry of retail stores, with legal sales commencing just six months later on July 1st 2017. According to the State of Nevada Department of Taxation, marijuana dispensaries sold $27.1 million in its first month of legal sales alone.

Fast forward only one year, where January 2018 represents yet another landmark event in Las Vegas history. At the end of the month, successful “cannapreneur” and Las Vegas native, Joe Vargas, will open the world’s first CBD oil retail store.

For those who are unfamiliar, cannabidiol, or CBD, is a compound found in cannabis and industrial hemp, but unlike it’s famous cousin tetrahydrocannabinol (a.k.a. THC), is nonpsychoactive. CBD has many health benefits and provides relief for a vast array of ailments and medical conditions, including chronic pain, fibromyalgia, Parkinson’s disease, arthritis, nausea, diabetes, inflammation, stress, anxiety, insomnia, seizures, psychosis, and depression.

An OG Pioneer in the Local Cannabis Industry Ruckus wants people to understand that the cannabis industry is still a relatively young industry: things are still being ironed out, and there’s a long road ahead. Laboratories aren’t always regulated, and results can always vary.

Therefore, Ruckus advises to take precautions when it comes to THC levels. Since each strain has a different effect, people should be careful.

If they decide to use cannabis, they should always do it safely and responsibly. Armed with information, Ruckus jumped at the opportunity when the local medical dispensaries opened.

Understanding the platform he has, Ruckus feels he’d be missing an opportunity by not sharing what he’s seen work more often than not. “I have a voice now because of that TV show,” he said. “Who the hell would I be if I didn’t give this information to people? ...Now that I’ve got the platform, I do it every chance I get.”

“Going there and giving this information to people has been one of the greatest achievements of my life,” he said. “Being able to explain to people how they can take their own health back into their own hands and heal themselves is an amazing experience, and I sleep with a full heart every night because of it.”

Once asthmatic as a child, Ruckus isn’t afraid to share that he’s been a user of marijuana most of his life and has always known cannabis wasn’t just for recreational use. He credits cannabis with helping him with his asthma. When Ruckus started the TV show, a few of his friends were diagnosed and tragically passed away from cancer – one being his band mate. Ruckus felt a strong pull to begin doing research and make an oil that could potentially prevent others from the same fate. Ruckus was able to apply his research and help one of his friend’s daughters, who was diagnosed with cancer. “She’s 11 years old now,” Ruckus said, “…and she’s 100 percent cancer-free now.” After seeing the effects cannabis had on this little girl, Ruckus began to truly understand the healing components of cannabis.

Ruckus’ passion for his activism was evident in his voice as he shared touching stories of how cannabis oil has helped heal different forms of ailments: from his own pain caused by a series of accidents, to his mother’s thyroid condition. In addition to making oil and working at Inyo Fine Dispensary, Ruckus recently taught a class on how the oil works. Ruckus is trying to start his own business in the cannabis industry across different states so that his oil is accessible to more people.

Others swear by the clicker. Some would never train without a pinch or choke collar. Some folks use treats. Other people do not.

When working to rectify a dog’s “bad” behavior it’s important the correction be proportionate.

Think of it this way: If you bump into me in a crowded bar it would be inappropriate to punch you in the face. An appropriate response would be to put my arm out so you’re kept at arm’s length and let you know, in a civil tone, you’re in my space. Chances are you bumped into me by accident … at least one would hope.

Here are a few steps to help insure you are choosing a dog training tool wisely:

1.

Obedience isn’t a Behavioral Band-Aid – If a dog has ‘bad’ behavior and you think a “sit/stay” is going to fix it. You’re wrong.

Stopping behavior without determining its cause or context means any fix is temporary – no matter what tool you use.

2.

Hammer for a Nail – Use the proper tool for the correction. Behaviors that can be solved with mild correction and redirection should be addressed with something like a Gentle Leader™ or “head collar” and not a pinch or remote collar.

Don’t Try This at Home – If you’re going to use a training tool, find a trainer skilled in its use and learn how to use it properly.

We have made and broken more resolutions than we can count to the point where many of us have lost our childlike passion and feel that we are simply too old to bother. Maybe this year it’s time to release the child within us and celebrate with renewed passion by attempting something we never tried and always wanted to do, or reliving something we loved doing as a child. What’s your New Year Resolution?

My name is Demi Hou, owner of Demi’s Gift Baskets. After losing everything during the 2008 recession, I decided to move to Vegas and have lived here four years now. I am proud to be part of the Vegas community, participating in charitable outreaches, business expos and supporting local businesses such as MYVEGAS! My passion is designing gift baskets and fulfilling the needs of our local hotels, businesses and residence. It is my 2018 New Year resolution to grow to be Las Vegas’s #1 provider for gourmet gift baskets while continuing to connect with and support local businesses.

My goal for 2018 is to help as many women as I can to feel empowered and beautiful! I feel so blessed to be able to share this mission through my business and serve as an example to my kids as well. To me, feeling beautiful it is a state of mind. Beauty is what we believe in, what we tell ourselves, and the good actions we take every day! Every women deserves to feel beautiful, loved, and respected,... but that all starts within! All too often, self defeating doubts are planted deeply into our minds, and reaffirmed daily, through seemingly everything!

Once we learn to see ourselves in a different light, our confidence, self esteem, and our beliefs all combine to remove any doubts about our beauty.

When we achieve this together, we can come to the realization that we are capable of amazing things and we’re absolutely unstoppable!”

I’ve come to the conclusion that resolutions are to resolve something, there is nothing for me to resolve.

“Resolutions” had me in a lack and scarcity mindset, by putting too much pressure on myself to not do that or to do this, it wasn’t joyful for me at all. I now celebrate the new year by celebrating my wins and evaluating what joy I had from the past year and do more of that. I practice everyday on being intentional, taking one step further everyday and stretching my comfort zone. It’s having faith and exercising stepping forward even when I don’t see the path.

I don’t usually make resolutions; I make goals and lots of them! It could be as small as an item I’d like to purchase for home, health and fitness desires, educational, a trip I’d like to take, something to help set up for my future and more. Some goals take me hours to achieve, some take months and others take years. I have several things on this year’s list I didn’t get done, but I achieved many things! If I had a resolution, it would be to complete those goals missed on this past year’s list and to help others achieve their goals.’

When Mark first asked, my resolution for 2018 was just to be featured in MyVegas Magazine! That alone would be amazing! But in all seriousness, I hope to continue the path God has laid out for me. To provide for my wife, be a good witness, and help feed thousands. Everything is by His Grace, and for His glory.’

My new years resolution is to keep myself consistent, to continue past resolutions made to thyself and...TO KEEP my word to myself ...bring patience deeper into my practice’
