Illinois Law Now!
Question: I will be moving into an apartment soon and plan to redecorate. Do I need my landlord’s approval about paint colors and installing items such as new light fixtures? Answer: Most leases spell out which cosmetic changes a tenant can make. Painting a unit a bolder color typically requires management approval. It’s best to put any cosmetic changes in writing. Upgrades like cabinet handles or ceiling fans typically must be returned to the original fixtures if you decide to move. Otherwise, the owner can legally withhold the portion of the security deposit which covers the cost of restoring the unit to its original appearance. Question: If I am a salaried employee, am I still entitled to overtime pay? Answer: Possibly. The issue is not whether you are salaried but whether you meet the test for exempt status as defined by federal and state laws. An employee who is exempt from the Fair Labor Standards Act is not entitled to overtime. An attorney with knowledge in employment law can advise you on your specific situation. Question: Is common-law marriage valid in Illinois? Answer: No. Many people wrongly assume that if a couple lives together for a certain length of time, they are commonlaw married. Only a handful of states and the District of Columbia recognize common-law marriage, and each has specific stipulations as to what it means. However, Illinois does recognize common-law marriages that are valid in other states. For more information about Illinois law, visit www. illinoislawyerfinder.com. Check Us Out On
Through the generosity of N.O.B.L.E. Network (National Organization of Black Law Enforcement Executives), Seton Academy students will experience “Arrive Alive”! on Friday, April 19, 2013. This will be a half day presentation cosponsored by State Farm Insurance and N.O.B.L.E. who will provide a driving simulator on the Seton campus. The facilitators for the day will be Officer Kirk Kremski, South Holland Police, Mr. Clarence Moore – NOBLE network, Twin D. Green – IL. African American Family Commission, Lisa Cooper and Marcus Jackson, State Farm Office in South Holland, IL and representatives from the Illinois State Police. Students will actually experience simulated DUI driving, simulated reckless driving, distracted driving from texting and other hazardous conditions. The purpose is to encourage teens to educate their peers in teen safe driving. Students may choose to write an article or create a broadcast piece that focuses on the teen safe driving topic of their choice to enter a contest - the categories are video psa, dramatic interpretation, essays or posters illustrating the public service announcement.
