Illinois Law Now!

Question: Do I need a revocable living trust? Answer: A living trust is a legal document you create which bypasses the costly and time-consuming process of probate. It is often used by those with complex financial and personal circumstances. A living trust is not for everyone. The best decision comes from carefully weighing the pros and cons based on your personal situation in consultation with an estate planning attorney. Question: Someone dumped a pile of used car tires and other debris on one of my properties. Is removing it my responsibility? Answer: Under Illinois’ Opening Dumping laws, the landowner is responsible for all open dumping on his or her property, even if the owner didn’t do the dumping or had any knowledge of who dumped the debris on the site. Question: What laws exist to protect kids against Internet predators? Answer: The federal Children’s Online Privacy Protection Act (COPPA), created to help protect kids online, is designed to keep anyone from obtaining a child’s personal information without a parent knowing about it. COPPA requires websites to explain their privacy policies on the site and get parental consent before collecting or using a child’s personal information, such as a name, address, phone number or Social Security number. The law also prohibits a site from requiring a child to provide more personal information than necessary to play a game or participate in a contest.
