Illinois Law Now!
Question: Who is entitled to a survivor’s benefits in a workers’ compensation case? Answer: If the injury or disease results in the death of the employee, full benefits are paid to the spouse and/or children. Benefits are paid to children until age 18, or until age 25 if the child is a full-time student. If the child is physically or mentally incapacitated, benefits are paid for the duration of the incapacity. If there is no eligible spouse or child, the benefits will be paid to a totally dependent parent or parents. Question: How can I be sure that the lawyer I’m about to hire is licensed to practice law? Answer: The Attorney Registration & Disciplinary Commission (ARDC) is the organization which provides a way for consumers to verify whether a lawyer is licensed to practice law. Being included in the ARDC listing ensures that the lawyer has a degree from an accredited law school and that he or she passed a test in order to be admitted to the state bar. Unlike the ARDC site, the Illinois State Bar Association’s (ISBA) illinoislawyerfinder.com website is a referral site. ISBA members must meet certain requirements before they are listed, such as being licensed to practice law, maintaining professional liability insurance, and being in good standing with the ARDC. Question: If I slip on the ice and am injured, what are the chances of my being compensated for my injuries? Answer: Negligence as the result of snow and ice cases may be difficult to prove in court. The law states that property owners have a duty to reasonably maintain their properties, meaning they should remove hazards which could contribute to a fall. In snow and ice cases, a natural accumulation of snow and ice may mean the property owner has no duty at all. However, if a person created a special hazard, or failed to remove a hazard that caused your injury, or if there is a defect underlying the area where you fell, then you may have a case. Veterans Writing Group Governors State University invites veterans to join a new Veterans Writing Group, where they will discover or re-discover the craft of narrative writing in a small, supportive group environment. Veterans will enhance and learn new skills and share camaraderie with other vets in a six-week workshop. Groups are forming now. “Narrative writing helps veterans bridge the cultural divide between their military and civilian life,” explains Robin Thompson, University Lecturer and Coordinator of the program. Their stories are important and may one day become a valuable family heirloom or community resource – everyone benefits.” There is no charge for participation in the Veterans Writing Group. To register, contact Thompson at (708) 534-4581 or rthompson@govst.edu Governors State University is located at 1 University Parkway, University Park, Illinois.
