Babylon is strong, and there‘s a lot of shit going down in this world. But hey: There‘s a really bright side, as well! It‘s great to see how cannabis becomes more and more decriminalized – Peace, brothers and sisters!

The unwavering persistence of MaryJane’s liberation army is finally dissolving the steely chrysalis of outdated mandates that has encased the beautiful plant for over half-a century. Read on for a recap of global cannabis scene.

A few years into the past, the voices that sang in support of cannabis, blocked out by the mountains of super-harsh legislation never reached the ears of the majority of society. It was marijuana ghost-town, with a few lonely tumbleweeds rolling desolately over the deserted landscape. Of course, that didn’t mean there were no cannabis lovers. When the laws grew tight, cannabis city simply migrated underground. And in that mighty Empire from the curb-corner pushers, to the secret smokers, right

up to the king-pins, laws could come and go to hell, because business in cannabis city was booming as usual.

PRESENT But shoot back to the present, and ba-bang, the tumbleweeds have blossomed into a mighty steam-engine that’s chugging down the track, screaming “Full power!” And the inhabitants of the clandestine society are migrating back to the surface.

Today, the strength of the weed-

wagon has grown so immensely, that even the sharp blade of the red-tape scythe is unable to hack down the grass, (if one is to speak in metaphors).

TODAY These days it’s impossible for ‘4.20’ hours to pass without something weedy cropping up.

Where once it was taboo to even mention marijuana, it’s now common to hear debates spinning around the difference between decriminalization and legalization, or pros and cons of the weed legalization, or even hemp vs weed. People are opening their hearts to the plant, and the convoluted idea that marijuana is a ‘dangerous addiction’ pursued solely by the rebellious sectors of

Vor einigen Jahren erreichten die Stimmen, welche zur Unterstützung des Cannabis sangen, abgeblockt von Bergen überharter Gesetze niemals die Ohren der Mehrheit der Bevölkerung. Es war eine Cannabis Geisterstadt mit ein paar einsamen Steppengraskugeln, die trostlos durch die verlassene Landschaft rollten. Natürlich bedeutete das nicht, dass es keine Cannabisliebhaber gab.

Als die Gesetze eng wurden, wich die Cannabisstadt einfach in den Untergrund aus. Und in diesem Reich der Händler an der Ecke, der verborgenen Raucher und der grossen Gestalten im Hintergrund waren Gesetze einfach schnuppe, weil das Geschäft in Cannabisstadt schlicht seinen Gang ging.

Aber zurück zur Gegenwart, und siehe da, die Steppengraskugeln sind zu mächtigen Dampfmaschinen geworden, die Full Power ihre Kreise ziehen! Und die Einwohner der geheimen Gesellschaft krabbeln zurück an die Oberfläche.

Heute ist die Kraft des Graswagens heftig gewachsen, sogar die scharfe Klinge der Absperrungsmachete kann das Gras nicht wegsensen.

Zurzeit poppt ständig etwas grasiges auf. War es einst tabuisiert, Cannabis auch nur zu erwähnen, ist es nun normal, Debatten etwa zum Unterschied zwischen Dekriminalisierung und Legalisierung, über Pro und Kontra der Graslegalisierung oder zu Hanf oder Gras zu hören. Die Menschen öffnen ihre Herzen für die Pflanze und die verschwurbelte Idee, dass Cannabis eine gefährliche Abhängigkeit ist, in der sich ausnahmslos die rebellierenden Schichten der

Gesellschaft befinden, löst sich auf trotz der Anstrengungen der Hardliner den Status quo zu erhalten.

Den Männern in den weissen Laborkitteln, also den Forschern muss auch ein Teil des Dankes ausgesprochen werden. Von PTSD Behandlung zu therapeutischen Anwendungen für autistische Kinder, über Multiple Sklerose und Krebs, mit jeder Ergänzung der stetig wachsenden Liste an ernsten und potentiell lebensgefährdenden Erkrankungen, die durch Cannabis geheilt oder gemildert werden können wird die Sache der totalen Dekriminalisierung süßer.

Die Forschung hat den Wert des Grases wieder eingelöst. Auf der Hanfseite, die Anwendung der Faser wächst ebenso mit rasender Geschwindigkeit, manche meinen gar mit ‚Viralgeschwindigkeit‘. Über den Daumen können rund 20,000 Produkte aus Hanf hergestellt werden.

Für alle Hanfunterstützer ist es ein fett verdienter Sieg, nach Jahren unermüdlichen Kampfes. Der Preis in Sachen ‘Am Intelligentesten bislang’ geht ohne Gegenstimme an Uruguay, welches 2013 Geschichte schrieb als es zum ersten Land in der Welt wurde, welches Cannabis legalisierte. Die anderen Medaillen gehen an die Staaten in Nordamerika, Europa und Südamerika, die eine Welle der Cannabisdekriminalisierung eingeleitet haben. Angesichts der raschen Evolution der Szene, ist ein Haufen von verschiedenen Ländern die sich bald Uruguay anschliessen könnten sind überall im Internet. Die Nominierten soweit sind: Jamaika, Spanien, Tschechische Republik, Kolumbien, Costa Rica, Portugal, Peru, Schweiz, Mexiko und Kanada.... und vielleicht sogar die gesamten USA, da dort ein hohes Maß an Befürwortungskultur gibt.

Überdies wurde die italienische Armee befugt Cannabis für medizinische Zwecke anzubauen. Der italienische Gesundheitsminister Beatrice Lorenzin sagte, „Aus pharmazeutischer Sicht gibt es keine Rütteln an der medizinische Verwendung, da die vorteilhaften Wirkungen außer Zweifel stehen.”

Auf der Spassseite hat der Legalisierungsschwall zu einer Flut an Cannabis Partnerseiten geführt.

Diese Webseiten zielen darauf, den peinlichen Moment der Frage, ziehst du auch mal einen durch?, also wenn sie dich anblicken, als ob du ein Tollwütiger bist zu überspringen. Oder, falls du in Colorado bist, auf eine Cannabistour zu gehen. Dies sind nur einige Beispiele der Nebeneffekte, die die Legalisierung schafft. Unternehmer wirbeln umher, sie entwickeln Cannabis verwandte Geschäfte ohne wirklich Gras zu verkaufen, so wie Hydroponics Ausrüstung, spezielle Erde etc. Die Industrie ist ausgewachsen und ökonomisch, daher könnten bald die Kassen richtig klingeln.

Cannabis zieht auch neue, unerwartete Kreise an, nämlich traditionelle Unternehmen, die das Kraut bisher mieden, aber nun ihren Teil am Kuchen haben wollen. Das grosse Geld in der Gestalt des viertreichsten Mannes der Welt, Warren Buffet, der Interesse an der Pflanze geäußert hat. Seine Holding tendiert dazu in Immobilien zu investieren, z.B. in Lagerhallen, um medizinisches Cannabis in Colorado, Washington und Kalifornien anzubauen.

All das sind gute Nachrichten für die Cannabisstadt, da traditionelle Investoren das Potential einbringen die Geschwindigkeit der Legalisierung zu beschleunigen. Es lebe die Cannabisnation!

The men in white labcoats a.k.a the science guys must be given a share in the credit. From PTSD treatment, to therapeutic applications for autistic children, to multiple sclerosis, to cancer, with each addition to the ever augmenting list of serious and potentially life threatening illnesses that can cured or alleviated by marijuana, the case for complete decriminalization grows sweeter.

Science has redeemed the worth of the weed. On the Hemp side, the application of the fibre is also growing at an exponential rate, or some would even say ‚ at viral speeds‘. By a rough approximation, about 20,000 products can be created from Hemp.

DECRIMINALIZATION For all the MJ supporters, it’s a victory that’s been well earned and well-watered by years of relentless struggle. The award for the ‘Most Intelligent Move So Far’, goes via unanimous decision to Uruguay, for making history in 2013, by becoming the first country in the world to legalize marijuana. The other medals can be handed to the states in North America, Europe and South America that have launched the wave of marijuana decriminalization.

Given the rapid evolution of the scene, compilations of various countries that may soon be joining Uruguay are all over the internet. The nominees so far are: Jamaica, Spain, Czech Republic, Colombia, Costa Rica, Portugal, Peru, Switzerland, Mexico, and Canada....and perhaps even the entire United States, since there is a lot of pro-culture activity in that part of the globe.

THE HEMP ARMY What’s more, the Italian army has been authorized to grow medicinal marijuana to meet the countries needs. Italian Health Minister Beatrice Lorenzin stated, „From a pharmaceutical point of view, there are no issues with medical marijuana use as its beneficial effects are out of doubt.”

Standing ovation. A spade should be the only weapon an army should wield.

MARIJUANA DATING On the fun side, the spate of legalization has lead to a spurt in ‘marijuana dating websites.’

These websites aim to help you skip that ‘awkward moment’ when you ask your date, if they do the deed, and they look at you like you are some sort of rabies covered convict. Or, if you’re in Colorado you can go on a cannabis tour. These are just a few examples of the spin-off avenues of income that the legalization is creating. Entrepreneurs are

scurrying about, developing marijuana related businesses without actually selling weed, such as hydroponics equipment, special soil, etc. The industry has matured and is economical viable, therefore soon enough cash counters could be ringing home the gold.

BIG BUSINESS Cannabis is also attracting new but unlikely ‘suitors’, traditional businesses, that shunned the lady but who now wish to cash-in on the growth spurt. Big Money in the form of the fourth richest man in the world, Warren Buffets, has expressed interest in the plant. His holdings intend to invest in real-estate, i.e. providing warehouse spaces for growing medical marijuana in Colorado, Washington and California.

All in all this is positive news for cannabis city, as traditional investors have the potential to expedite the rate of legalization.

Georg Wurth 1 Million Euro for the Legalisation of Cannabis

Would you report yourself to the police for the possession of 4 grams of marihuana? You think that would be a very stupid thing to do? Well, German Georg Wurth did so, and it was not stupid at all. When he reported himself to the police in 1996 it was part of a campaign for the legalization of cannabis, and of course it stirred a lot of public attention. Ever since Georg has been one of the leading figures of the German legalization movement. He is the CEO of the German Hemp Association, he‘s consulting the senate, and recently he won „The Millionaire Election“, a German TV show.

You gotta fight... for your right... to get high! Georg is a wonderful inspiration, I often party too hard and care too less about a little bit of activism!

So you‘re really a millionaire now – why are you still here and not enjoying your life in some tropical place?

Well, first of all I‘m still very passionate about the whole legalization thing and that‘s why my place is here, in Germany. Also those 1.000.000 Euro are actually not for my private pleasure. The money I won in that TV show shall exclusively support my political project, which is the German Hemp Association.

Alright... so how will you spend the money?

The main objective is to intensify the public discussion about the legalization of marihuana. Of course 1.000.000 Euro is a nice budget to do so! I really like the medium film, and that‘s why we will focus on a series of ads to stir some

attention. There shall be TV ads, maybe even short programmes on TV. Also cinema ads are very interesting, and we plan to create specific spots for specific areas. For instance, we have seen a massive rise of the legalization movement in the South of Germany, where politics are very restrictive. Munich had the 2nd biggest Hemp Parade in Germany, that speaks for itself!

Something is brewing for a long time already, that‘s not a big secret. It might also have to do with the fact that it‘s easier than ever before to establish networks and publicity. The German Hemp Association, which I am leading, has around 100.000 followers on Facebook and is supported by around 1.200 private donators.

The demand for printed pamphlets is huge at the moment. It feels like we are approaching a turning point, so we need more staff, more hardware, more campaigns... and that‘s exactly what we will do with those 1.000.000 Euro.

Und es war ganz und gar nicht dämlich, sondern ein durchaus cleverer Schachzug in seinem leidenschaftlichen Einsatz für die Dekriminsalisierung von Cannabisbesitz und -konsum.

Seit vielen Jahren ist Georg eine der Leitfiguren der deutschen Legalisierungsbewegung. Als Vorsitzender des Deutschen Hanf Verbands (DHV) hat er Anfang des Jahres bei der „Millionärswahl“ von Pro7/Sat1 mitgemacht – und tatsächlich eine Million Euro gewonnen.

Natürlich nicht für sein Privatvergnügen, sondern um damit seine Legalisierungs-Bemühungen zu unterstützen. Das Geld will Georg u.a. für die Produktion und Verbreitung verschiedener TV- und Kino-Spots nutzen, welche die öffentliche Debatte anheizen sollen.

Speaking of turning points: Wasn‘t it a huge surprise that of all countries it was a state in the USA that legalized marihuana recently?

Auf die Frage, wann in Deutschland mit einer Legalisierung wie z.B. in Colorado zu rechnen ist, antwortet Georg: „Schwer zu sagen. Aber vor der nächsten Legislaturperiode wird nichts passieren. Der erste Schritt wird wohl die Festsetzung einer geringfügigen Menge sein, die nicht mehr strafrechtlich verfolgt wird. Es macht Sinn, sich die Entwicklung in anderen Ländern anzusehen, wo Cannabis heute einen legalen oder quasi-legalen Status hat. Die Cannabis Clubs in Spanien haben z.B. gut 15 Jahre gebraucht... Ich denke, für Deutschland ist eine Legalisierung in 7 – 13 Jahren denkbar.“

Absolutely, what happened in Colorado and Washington was a landslide for the legalization movement. It created international shockwaves and has been a huge inspiration for countless activists around the world, including me of course. Uruguay is another country that made a great leap forward towards decriminalization, and I hope to see Mexico and Jamaica following their lead soon.

When will Germany follow their lead, any prognosis?

That‘s the obvious question...

That‘s quite right, Germany is very repressive when it comes to drug policy. But you may not forget: It took those Spanish smoker clubs around 15 years of constant legal struggle to reach the point where they are now. I think that‘s an essential message: You have to be active, you really have to do something and create publicity, even if you are just an everyday hemp lover. It‘s tricky, of course:

As long as marihuana is still illegal it is kind of delicate to show your face, to take a stand in public. But in the end that‘s the only way, if we want a change! Okay, you might think it is a little too much to engage actively in a society like the German Hemp Association – but there‘s a huge bandwidth of activism. You can use all those internet forums and social media, of course you should go voting and inform yourself about the program of the different parties in your country. You can write letters and comments to politicians. All too often we forget that these little actions can really cause a change. So if you really mean it with the legalization of cannabis, you should become active.

Paradise Seeds rules the roost when it comes to offering premium cannabis seeds. The breeder has created the ultimate method to guarantee healthy plants.

Ingredients

Procure some clean water that is free of chlorine, chloramines, and high levels of sodium.

Sediment-free bottled water, or reverse osmosis filtered water will work fine. Fill a mason jar, or any other glass vessel half-way up with water and add fulvic acid & B-complex vits. Although a seed is a self-sufficient system, the addition of fulvic acid, such as Diamond Nectar/Liquid Gold and a vitamin B complex or Supervit, boosts growth. The pH of the solution should be at 6.0.

Remove the lid of the jar, and place a piece of white cheesecloth, or any clean fabric that can retain moisture but drains easily,

over the rim of the glass. With the seeds in the solution, and the tissue in place, store the jar in the dark at room temperature for 18 to 24 hours. After 12 hours, give it a gentle swirl. By the 18th hour most of the seeds should’ve settled at the bottom.

Main Medium

Whilst selecting the medium, do your homework and research thoroughly. In order to give the seeds get a good head start, Paradise Seeds charges the medium with a complete solution of EC 0.5 to 0.7 and a pH of 6.0.

Die Hinzugabe von Fulvinsäuren wie Diamond Nektar/Liquid Gold und Vitamin B oder Supervit stärkt das Wachstum. Der pH-Wert sollte bei 6 liegen. Nehmt den Deckel des Glases ab und legt ein weisses Käsetuch über den Rand. Mit den Samen in der Lösung stellt ihr es bei Raumtemperatur 18 bis 24 Stunden ins Dunkle. Nach 12 Stunden etwas schütteln.

Um die 18.Stunde sollten die Samen nach unten gesunken sein.

Vorbereitungsphase

Dieser Schritt benötigt eine präzise Kombination aus Wasser und Sauerstoff. Leert das Wasser aus und dreht das Glas, sodass die Samen auf einer weissen Lage von oxidiertem Wasser ruhen. Die resultierende Feuchtigkeit innerhalb des Glases ist ausreichend für die Samen.

Nochmal 24 bis 48 Stunden ins Dunkle. Die Wurzeln sollten spriessen und deren Wachsen begonnen haben. Öffnet das Glas, so dass die Samen auf dem Stoff liegen. Nun kommt die Wahl des Wachstumsmaterial ins Spiel, da der Grad des Mittels das Ergebnis bestimmt.

Hauptmittel

Um den Samen einen guten Start zu geben, reichert Paradise Seeds das Mittel mit einer kompletten Lösung EC 0.5 bis 0.7 an. Legt die Samen, mit dem nach oben gerichteten Samenkappen in die Erde/das Mittel eurer Wahl. Der Widerstand der dünnen Schicht Erde wird die Samen stärken.

Die Töpfe mit einem Wurzelmittel müssen von einem Feuchtigkeitsdom, als Ersatz halbierte Plastikflaschen umschlossen sein. Wenn die Samen rauskommen, könnten einige noch Samenkappen haben. Falls die schwächeren nach ein paar Tagen immer noch Kappen vorweisen, trennt die Kappen ab.

Lasst das Licht herein

Künstliches Licht muss nahe den Samen scheinen, ihr wollt doch nicht, dass die Babies ihre Hälse strecken müssen (draussen sucht einen leicht beschatteten Bereich). In den ersten oder zweiten Woche keine Überdosis Licht. Sobald das erste Blatt erscheint, entfernt den Feuchtigkeitsdom für eine halbe Stunde am Tag. Fertig! Was beim Anbau

alles blühen kann Frage: Jemand hat Cannabis im eigenen Haus angebaut und wurde entdeckt. Droht bei der Verurteilung auch der Verlust von Haus und Grundstücks?

Antwort: Ja, das kann passieren! Die Regelungen über die Einziehung von Tatwerkzeugen erlauben unter bestimmten Umständen auch den Zugriff auf das Grundeigentum, wie nachfolgender Fall zeigt.

Der Fall

Ein Niederländer hatte sich im Jahre 2007 für 143.000 Euro ein Grundstück mit Einfamilienhaus in Kleve gekauft, wohnte aber weiterhin in den Niederlanden.

Spätestens im Sommer 2011 hatte er begonnen, im Keller und im Obergeschoss des Hauses Cannabis unter Kunstlicht anzubauen. Regelmäßige Besuche verschiedener Personen, geschlossene Rollläden und die Tatsache, dass in dem Haus niemand wohnte, waren den Nachbarn bereits aufgefallen.

Bei einem Hubschrauberflug im August 2011 wurde zudem eine erhöhte, überdurchschnittliche Wärmestrahlung des Hauses festgestellt. Bei der Durchsuchung im Dezember 2011 wurden knapp 200 fast ausgewachsene Pflanzen sichergestellt, die mit 32 Lampen mit je 600 Watt beleuchtet wurden. Zudem fanden die Ermittler 1,1 kg getrocknetes Cannabis und eine aus dem Jahre

2010 stammende Rechnung, aus der hervorging, dass der Niederländer bereits damals Lampen und Spezialerde bestellt hatte, die für ca. 200 Pflanzenkübel gereicht hätte.

Die Entscheidung des Gerichts

Das Landgericht verurteilte den Mann für zwei Taten zu einer Gesamtstrafe in Höhe von 5 Jahren und 6 Monaten Freiheitsstrafe (LG Kleve, Urteil vom 30.05.2012, Az. 120 KLs 11/12). Der Anbau im Sommer und der Anbau im Winter stellten dabei jeweils eine eigene Tat dar. Da das Gericht ferner davon ausging, dass die erste Ernte im Sommer 2011 eine Menge von mindestens 11,7 kg

GERMANY eingebracht hatte, die für über 30.000 Euro verkauft wurde, ordnete es daher Wertersatzverfall in Höhe von 30.000 Euro an. Zudem wurde das Hausgrundstück als Tatwerkzeug eingezogen. Zur Begründung führte das Gericht aus, dass der Angeklagte alleiniger Eigentümer des Grundstücks war und das Grundstück mit dem Haus einzig zum Anbau von Cannabis genutzt wurde. Eine andere, darüber hinausgehende Nutzung habe nicht vorgelegen.

Weder wurde das Grundstück vermietet, noch zu eigenen Wohnzwecken genutzt. Das Gericht führte weiter aus, dass die Einziehung des Grundstücks auch nicht unverhältnismäßig sei, da es als Tatwerkzeug für eine ganz erhebliche Straftat genutzt wurde. Auch unter Berücksichtigung der finanziellen Verhältnisse des Angeklagten, der lediglich eine geringe Erwerbsunfähigkeitsrente bezog, sei die Einziehung des Grundstücks trotz seines ganz erheblichen Wertes nicht unverhältnismäßig.

Hinweise aus der Praxis

Mit dem Instrument des Verfalls können die Gerichte alles

abschöpfen, was jemand durch eine rechtswidrige Tat erlangt hat. Ist das Erlangte nicht mehr vorhanden, da z.B. Einnahmen aus einem Drogenverkauf bereits ausgegeben wurden, kann in der Höhe des geschätzten (!)

Umsatzes sogenannter Wertersatzverfall angeordnet werden.

Dabei haftet der Adressat mit seinem gesamten Vermögen, auch wenn die vorhandenen Werte nachweislich legal erworben wurden.

Tatwerkzeuge können eingezogen werden. Der Staat wird damit neuer Eigentümer der Sache, der Verurteilte verliert seine Eigentumsposition ersatzlos. Eine Einziehung ist bei allen Gegenständen möglich, die zur Begehung einer Straftat oder deren Vorbereitung gebraucht wurden oder bestimmt gewesen sind. Ein Tatwerkzeug kann auch ein Grundstück, Haus oder eine Eigentumswohnung sein. Nicht ausreichend ist aber, wenn ein Gegenstand nur bei Gelegenheit der Tat benutzt wurde. Voraussetzung ist vielmehr, dass der Gegenstand nach der Absicht des Täters gezielt die Verwirklichung der Straftat fördern soll. Für eine

Immobilie gilt dies insbesondere, wenn keine andere Nutzung vorliegt, dort also ausschließlich Cannabis angebaut wird. Steht hingegen das eigene Wohnen – z.B. in einer Eigentumswohnung – im Vordergrund und hat jemand nebenbei ein paar Cannabis-Pflanzen, liegt eher eine nebensächliche Nutzung der Wohnung zum Anbau vor.

Zwingend ist diese Ansicht aber nicht. Voraussetzung für eine Einziehung ist ferner, dass der Gegenstand dem Täter gehört hat. Hätte in vorliegendem Fall der Verurteilte das Haus lediglich gemietet, wäre eine Einziehung nicht möglich gewesen. Gleiches gilt auch z.B. für Drogenkuriere, die für ihre Kuriertätigkeit einen PKW nutzen: Während ein fremder PKW nicht eingezogen werden kann, wird ein dem Kurier selber gehörendes Auto schnell der Einziehung unterliegen.

Hausdurchsuchungen Nach den Durchsuchungen von Growshops in Bremen und Hannover im Juni diesen Jahres war schnell klar, dass es der Polizei insbesondere auch darum ging, die Kundendaten der Internetshops zu bekommen. Nur so jedenfalls lässt sich die Pressemitteilung der Staatsanwaltschaft Hannover interpretieren. Mit polizeilichen Ermittlungen und weiteren Durchsuchungen bei Kunden der betroffenen Shops ist daher recht sicher zu rechnen. Doch wie verhält man sich bei Durchsuchungen? Rechtsanwalt und Strafverteidiger Ulrich Kerner aus Berlin hat für uns die häufigsten Fragen zum Thema Hausdurchsuchungen beantwortet.

Kann auch ohne Durchsuchungsbefehl durchsucht werden?

Ja, bei Gefahr in Verzug – aber das sind die absoluten Ausnahmefälle. Wurde schon vorher ermittelt, liegen in der Regel die Voraussetzungen dafür nicht vor, da dann genug Zeit war, den Ermittlungsrichter zu erreichen.

Daher immer einen Durchsuchungsbefehl zeigen lassen. Der Durchsuchungsbefehl muss den Durchsuchungszweck und -ort genau beschreiben.

Darf ich telefonieren?

Ja, sofern der Anruf nicht dazu dienen soll, andere Tatverdächtige zu warnen oder Beweismittel beseitigen zu lassen. Der Anruf beim Anwalt darf nie verweigert werden.

Soll ich versuchen, die Durchsuchung zu verhindern?

Nein, auf keinen Fall! Denn das wäre als Widerstand gegen Vollstreckungsbeamte strafbar

und wird auch in der Sache keinen Erfolg haben. Der Durchsuchung sollte widersprochen werden, dann ist es aber ratsam, sie zu dulden.

Muss ich bei der Durchsuchung mithelfen?

Nein, man muss nicht aktiv mithelfen, denn niemand muss zu seiner Überführung beitragen. Mitunter kann es aber trotzdem ratsam sein, gesuchte Gegenstände freiwillig herauszugeben oder Schränke und Türen aufzuschließen, damit sie nicht gewaltsam geöffnet werden und nachher alles verwüstet ist.

Dürfen auch Schriftstücke beschlagnahmt werden?

Ja, sofern Sie als Beweismittel in Betracht kommen. Dann sollte darauf bestanden werden, dass sie sofort versiegelt werden und dies protokolliert wird. Datenträger und Festplatten dürfen beschlagnahmt oder – als milderes Mittel – auch kopiert werden.

Muss mir ein Protokoll über die Durchsuchung ausgehändigt werden?

Ja, und es muss alles genau protokolliert werden. Man sollte energisch darauf bestehen, dass das auch sorgfältig gemacht wird und einen Durchschlag des Protokolls verlangen.

Was ist, wenn bei der Durchsuchung Waffen, z.B. Schreckschusspistole, Messer oder Schlagstock, gefunden werden?

Waffenfunde sind im Bereich von BtMG-Straftaten immer ein ernsthaftes Problem: Das Strafmaß liegt bei 5 Jahren Haftstrafte im Mindestmaß (!), wenn der Täter bei Handel, Einfuhr, Ausfuhr oder dem Sich-Verschaffen von nicht geringen Mengen BtM eine Waffe bei sich führt. Dazu reicht es häufig schon aus, wenn sie griffbereit zu Hause liegt. Also: Waffen weg!

Irgendwo auf der Welt fliegt bestimmt noch Nazimüll rum. Warum nicht im Meer?

Selbst im interstellaren Raum trägt schließlich die Voyager Begrüssungsworte eines Ex-Nazis (Kurt Waldheim) zu den Aliens, glaubt ihr nicht?
