Additionally this farm has revenue generated from a wind tower and wind easement contract currently with Moraine Wind LLC, that originally commenced in March of 2007 with the contract term running until March of 2044, with an option to extend to 2049, which annually pays $2,750.00 per tower, plus wind royalties, which according to the personal representative of the estate was paid a combined total of $8,466.24 for 2025 which was paid in Jan. 2026 and $6,406.82 for 2024 which was paid in Jan. 2025, with payments varying based on the amount of the wind royalties calculated annually; the wind contract easement will continue and be assumed by the purchaser(s) based on the renewal provisions and other terms of the contract; with the sellers to retain all wind tower revenue & easement payments for 2026 payable in early 2027, with all future payments attributable to 2027 and thereafter to be paid to the new buyer/owner(s). NOTICE — VISITATION RECORD
On June 3, 2026, Steven Lesnikowski (also known as Steve Lynch) publicly stated that he had moved to Flandreau to be near his children and wished to see them every day. Visitation has in fact been offered to him continuously since 2019, with sobriety as the only requirement — a verified 0.0 BAC at the time of the visit. As of July 29, 2026, the standing offer was expanded to three mornings every week — Wednesday, Saturday, and Sunday, 90 minutes each at 9 am. Each visit requires only written confirmation at least 24 hours in advance and a verified 0.0 BAC at the time of the visit. The children choose whether to participate. Every offer has been documented. The record since June 3, 2026: 41 offered 4 attended 1 arrived / did not pass sobriety check 36 no-shows Last visit: July 25, 2026. Repeated written offers — to discuss visitation, and to work out any reasonable path forward — have all gone unanswered. The offer has never been withdrawn and does not expire. A complete dated log of every offered, confirmed, and missed visit is maintained. Sole legal and physical custody is held by the undersigned pursuant to California court order. Visitation is offered above the court-required minimum, and remains available at any time he chooses to accept it. Child support arrears as of September 2026: $61,065.73

Staff are taking measures to address the plumbing and other utilities that may be shared with the adjacent building, the Crystal Theatre. Based on the condition of the structure, it appears the building may not be salvageable. New Business: Shane Waterman of IMEG Engineering provided an update on the utility improvement project. Progress has been delayed due to recent rainfall and wet conditions. H&W Contracting has completed the utility work, and subcontractors are currently working on curb and gutter installation and roadway restoration. Asphalt work is anticipated to be delayed until midOctober due to the wet conditions. The next public meeting regarding project updates is scheduled for Wednesday, September 30, at 12:00 p.m. at the City Office. Discussion was held regarding the 2027 Dispatch Agreement with Moody County. The County recently presented an amended agreement to the City of Flandreau, reducing the proposed cost for fiscal year 2027 from $66,797.66 to $52,483.88. Aldermen Ahlers, Bjerke, and Fargen spoke in favor of transitioning dispatch services to the City of Watertown, citing financial considerations and the potential for improved service. Aldermen Yeaton and Ekern stated that transitioning the City’s dispatch services to Watertown may ultimately be necessary; however, they expressed concerns regarding the proposed timeline and spoke in favor of continuing dispatch services through Moody County for fiscal year 2027. Motion by Yeaton and seconded by Ekern to accept Moody County’s proposed 2027 Dispatch Agreement at a cost of $52,483.88. A roll call vote was taken, with three members voting aye: Ekern, Nibbelink (via telephone), and Yeaton; and three members voting nay: Ahlers, Bjerke, and Fargen. The vote resulted in a 3-3 tie. Pursuant to SDCL 9-8-10, the Mayor may not cast the deciding vote on an ordinance or proposal to expend or appropriate money. Therefore, the motion failed. Motion by Nibbelink and seconded by Fargen to table the 2027 Dispatch Agreement with Moody County until a special meeting is called by the Mayor.
