The City Council of the City of Flandreau, South Dakota, met in regular session on Monday, November 2nd, 2020 at 6:30 p.m. at the William J. Janklow Community Center. Present: Mayor Dan Sutton. Visitors to be Heard: John Schiefelbein shared historical information and a vintage photo of the Flandreau Dam with Council. He also indicated he has recommendations regarding safety at the dam, such as fencing at the abutments to prevent access and additional rip rap along the bank. He feels both would be less expensive than the dam alternatives presented for consideration at the October 19th Council meeting. Presentation: Terry Wolf, Director of Transmission and Distribution Services for Missouri River Energy Services, presented information regarding the MRES Distribution Maintenance Program for Council consideration. He shared the history of the program, working arrangements, duties of the electric crews, and the different types of maintenance options available to the City of Flandreau. Mr. Wolf discussed the advantages of shared crews for special projects, on call and standby, as well as the mutual aid and management support services available through the program. Should Council decide to participate in the program, it could be readily implemented, and would be for a fiveyear term. Mayor Sutton encouraged everyone to vote in the election tomorrow, November 3rd, if they have not already done so, stating that it is an opportunity to be heard. The Mayor is working with City Administrator Pederson and City Attorney Bruning regarding a noise ordinance that will be presented soon. City Administrator Pederson commented on the MRES presentation held earlier, indicating that participation in the program would be beneficial for electric employee retention and succession and the City could achieve a higher degree of continuity in the department. A donor sponsored a “Free Little Library” that has been added to the park west of the First National Bank that serves as a depository for donated books that can be shared. There will be a Public Hearing on the November 16th agenda for renewal of the Vast franchise. Pederson recommends a five-year renewal with an increase from 3% to 5%. There will be an Airport Board meeting on Thursday to review the airport runway design layout; information will be presented to Council at a later date. Workplace rules are now in place at City buildings regarding the wearing of masks and sanitization due to the recent spike in COVID-19 cases in the last several weeks. Discussion was to be held tonight regarding the Dam Analysis Study but has been postponed as there has been a modification to Alternative 1 which lowers upstream levels while still maintaining a desirable fish habitat. Information will be presented soon so Council can select one option and then proceed to the 30% design level. Motion by Unger and seconded by Ekern to approve the Administrative Reports. Following discussion, Unger made a motion, seconded by Pesall, to close discussion and vote on the motion on the floor. PUBLIC NOTICE SUMMARY OF FLANDREAU CITY ORDINANCE TITLE 5, ARTICLES 5.3.1.p. AND 5.4.2.2., SNOW AND ICE REMOVAL The City shall notify all owners or persons in possession of property abutting on sidewalks to keep such sidewalks free from snow and ice and to remove the same within 72 hours after every fall or accumulation of snow or ice. The notice need not be given
personally but may be given generally through the official newspaper annually. The owner or person in possession of any property abutting on any sidewalk shall keep such sidewalk free from snow and ice and shall remove any snow and ice from the sidewalks within seventy-two (72) hours after the termination of any snow fall, snow or ice accumulation. The owner or person in possession of any property abutting upon any sidewalk that ends at an intersection or crosswalk shall maintain the sidewalk free from snow and ice to the edge of the street and will also clear any snow and ice deposited on the sidewalk during the street removal process.

PUBLIC NOTICE SUMMARY OF FLANDREAU, SOUTH DAKOTA CITY ORDINANCE, TITLE 13, TRAFFIC CODE; CHAPTER 13.7 SNOWMOBILE OPERATIONS No snowmobile shall be operated with the City unless it is registered and identification numbers are displayed as required. No person may operate a snowmobile on a city street: • • • • • •
At a rate of speed greater than is reasonable having due regard for conditions and in no event in excess of 20 mph While under the influence of liquor or drugs Except while proceeding to and returning from the city limits by the most direct route from his home or place where said snowmobile is garaged In any cemetery On private property without the consent of the property owner or his agent With more than one (1) passenger on a snowmobile
Any person operating a snowmobile on a city street must: • • • •
Come to a complete stop at all traffic controlled intersections Travel as close to the right edge of the plowed area of the street as practical Obey all traffic signals, signs and devices Yield the right-of-way to all-vehicular traffic and pedestrians
No snowmobile shall be operated to cross any street except at a street intersection of a street. No person shall operate a snowmobile in the City of Flandreau in a careless or negligent manner likely to endanger any person or property. No person shall operate a snowmobile upon any public sidewalk. No person operating a snowmobile shall tow any person or object behind except when such person or object is situated upon a conveyance that is attached by means of rigid hitch or tow bar. No snowmobile shall be operated in the City unless it has at least one (1) headlight and one (1) taillight turned on at all times during operation; adequate brakes; and is equipped with a muffler in good working order in constant operation to prevent excessive or unusual noise. The operator of a snowmobile involved in an accident resulting in injuries to or death of any person or property damage in an estimated amount of $100.00 or more must report the accident to Law Enforcement Personnel. It is presumed that any snowmobile operated within the City is operated with the consent of the owner. The owner of the snowmobile will be held jointly and severally liable with the driver thereof for damages arising out of the negligent or improper operation of his snowmobile. The owner of a snowmobile may be held jointly and severally liable to a property owner for three (3) times the amount of damages to trees, shrubs, landscaping, or personal property occurring on private property and caused by said snowmobile where the snowmobile is operated without the consent of the property owner or agent. Law Enforcement Personnel may confiscate any machine, which is operated contrary to or in violation of any provisions of this ordinance. Any person who violates the provisions of this ordinance is guilty of a misdemeanor and is punishable according to the general provision of this ordinance. The above information is a summary of the Title 13, Chapter 13.7 SNOWMOBILE OPERATION.
