Summary: The Chief Financial Officer is responsible for all aspects of accounting and financial investments and management; the annual audit process, cash flow management, budgeting and forecasting, banking and long term debt management and supervision of accounting and finance staff. City Administrator Pederson shared progress to date on the second community safe room; the property is being surveyed as a portion is within the 500 year floodplain. Pederson indicated the recent power outage was due to issues with powerlines that are not maintained by the City and had to be repaired by WAPA. He also thanked everyone for their patience and cooperation during the outage.

Mayor Bonrud entered the meeting at this time (6:39 a.m.).

City Attorney Paul Lewis provided an update on the zoning violation hearing held today at 1:15 p.m. regarding the Roger Hasvold proper-

ty. He indicated the presiding judge ruled that Mr. Hasvold will be found in contempt if he does not remove the trailer he has been inhabiting on the property by Wednesday, December 5th. The judge also indicated the City is allowed to abate the rest of the zoning violations on the property. City Attorney Lewis shared a conversation he had with Mr. Hasvold regarding off-street parking and Mr. Hasvold’s understanding that he is not in compliance with City zoning ordinances.

Mayor Bonrud chaired the remainder of the meeting and provided his report. The next Council meeting on December 17th will begin at 5:30 p.m. with a pot luck gathering for Council and employees; the regular meeting will begin at 6:30 p.m. The Mayor also discussed the upcoming Christmas and New Year’s Day holidays and the fact that they occur on Tuesday for both holidays; he welcomed Council opinion regarding whether to close City Offices on Monday, December 24th and/or Monday, December 31st. The decision whether to close for the holiday(s) will be an agenda item on the December 17th Council agenda.

Motion by Pesall and seconded by Sutton to approve the Administrative Reports. The following members voted aye: Bjerke, Pesall, Sutton, Tufty, Unger, and Whitman. Nays: None. Absent: None.

Old Business: Shane Waterman, Clark Engineering, provided a status report on the water and wastewater project. Mr. Waterman indicated while most construction is complete, what remains (such as grading, seeding, ADA ramps) has been suspended effective November 21st, 2018 due to weather related issues, but will begin again in the spring. Liquidated damages will cease to accrue with the effective date of November 21st, 2018, but will start accruing again when construction starts up again in spring 2019. The contractor will receive a notice to proceed when it is determined that construction may resume.

New Business: First reading of Ordinance No. 589, 2018 Supplemental Appropriation Ordinance, was held.

Motion by Unger and seconded by Sutton to approve Pay Request Fourteen (14) from H & W Contracting in the amount of $189,440.10 for the Water and Wastewater Improvements Project. Liquidated Damages in the amount of $160,050.00 will be withheld and retained by the City leaving a payment to H & W Contracting in the amount of $29,390.10. The following members voted aye: Bjerke, Pesall, Sutton, Tufty, Unger, and Whitman. Nays: None. Absent: None. Motion carried.

Motion by Whitman and seconded by Pesall to authorize CDBG Drawdown Request No. Twelve (12) in the amount of $4,187.82 and to authorize the Mayor to sign the drawdown request. City Administrator Pederson made a presentation to Council regarding the Phase 4 Electric Distribution Improvements Project. He shared the project timeline indicating material and construction bids will be sent out December 5th and will be accepted/opened on January 10th, 2019 with Council approval on January 21st, 2019. The budget for the original project and amendment items was also discussed. He is optimistic that bids will be low enough that the remaining Phase 3 & 4 construction funds will be sufficient. If not, it may be necessary to use the amount remaining in the Phase 1 & 2 construction funds, and a portion of restricted savings.

Council Comments: Alderman Unger requested clarification regarding the recent meeting attended by the Mayor, City Administrator, and representatives from Moody County concerning the County request to discuss the idea of the City contracting with Moody County for law enforcement in the City. Mayor Bonrud stated that in the meeting he shared his belief that the Flandreau Police is strong and that it is effective in the minds of the community. Unger stated that contrary opinions were expressed at a forum held at the Bean & Vine several months ago.

The Mayor declared the meeting adjourned at 8:04 p.m.

Troy Wellman, Sheriff met with the Board. Motion by Miles, seconded by Ehrichs to hire Kimberly Laframboise, Dispatcher at Grade 12/Step C at 15.48/hr, effective December 17, 2018. All voted “aye”.

Wellman informed the Board that the SD Department of Transportation has granted the request to name the Interstate 29 Big Sioux River Bridge, south of mile marker 125, Deputy Bill Davis Memorial Bridge. Former Commissioner Tony Firman was commemorated for all of his work in getting the State to grant this request.

Discussion was held on adding a fifth deputy to the Sheriff’s Department. Miles and Skroch informed the Board they met with 2 City of Flandreau representatives on November 28, 2018 and were informed at this time the City is not interested in exploring the idea of combining forces. The commission was made aware that at least one City Council member wants further discussion and that the Flandreau City Council did discuss it at their meeting December 3, 2018. No action was taken.
