No person may operate a snowmobile on a city street: At a rate of speed greater than is reasonable having due regard for conditions and in no event in excess of 20 mph While under the influence of liquor or drugs Except while proceeding to and returning from the city limits by the most direct route from his home or place where said snowmobile is garaged In any cemetery On private property without the consent of the property owner or his agent With more than one (1) passenger on a snowmobile Any person operating a snowmobile on a city street must: Come to a complete stop at all traffic controlled intersections Travel as close to the right edge of the plowed area of the street as practical Obey all traffic signals, signs and devices Yield the right-of-way to all-vehicular traffic and pedestrians No snowmobile shall be operated to cross any street except at a street intersection of a street. No person shall operate a snowmobile in the City of Flandreau in a careless or negligent manner likely to endanger any person or property. No person shall operate a snowmobile upon any public sidewalk. No person operating a snowmobile shall tow any person or object behind except when such person or object is situated upon a conveyance that is attached by means of rigid hitch or tow bar. No snowmobile shall be operated in the City unless it has at least one (1) headlight and one (1) taillight turned on at all times during operation; adequate brakes; and is equipped with a muffler in good working order in constant operation to prevent excessive or unusual noise. The operator of a snowmobile involved in an accident resulting in injuries to or death of any person or property damage in an estimated amount of $100.00 or more must report the accident to Law Enforcement Personnel. It is presumed that any snowmobile operated within the City is operated with the consent of the owner. The owner of the snowmobile will be held jointly and severally liable with the driver thereof for damages arising out of the negligent or improper operation of his snowmobile. The owner of a snowmobile may be held jointly and severally liable to a property owner for three (3) times the amount of damages to trees, shrubs, landscaping, or personal property occurring on private property and caused by said snowmobile where the snowmobile is operated without the consent of the property owner or agent. Law Enforcement Personnel may confiscate any machine, which is operated contrary to or in violation of any provisions of this ordinance. Any person who violates the provisions of this ordinance is guilty of a misdemeanor and is punishable according to the general provision of this ordinance. The above information is a summary of the Title 13, Chapter 13.7 SNOWMOBILE OPERATION. SUMMARY OF FLANDREAU CITY ORDINANCE TITLE 5, ARTICLES 5.3.1.p. AND 5.4.2.2., SNOW AND ICE REMOVAL The City shall notify all owners or persons in possession of property abutting on sidewalks to keep such sidewalks free from snow and ice and to remove the same within 72 hours after every fall or accumulation of snow or ice. The notice
need not be given personally but may be given generally through the official newspaper annually. The owner or person in possession of any property abutting on any sidewalk shall keep such sidewalk free from snow and ice and shall remove any snow and ice from the sidewalks within seventy-two (72) hours after the termination of any snow fall, snow or ice accumulation. The owner or person in possession of any property abutting upon any sidewalk that ends at an intersection or crosswalk shall maintain the sidewalk free from snow and ice to the edge of the street and will also clear any snow and ice deposited on the sidewalk during the street removal process. Those sidewalks not cleared of said snow and ice within seventy-two (72) hours will be considered a public nuisance. The City may cause said snow and ice to be cleared from those sidewalks in violation of said Ordinance and will bill those costs to the property owner. Mayor Bonrud shared that the holiday gathering for Council and employees will be held prior to the next Council meeting on December 16th and will begin at 5:30 p.m.; the regular meeting will follow at 6:30 p.m. The City Administrator informed Council that an Airport Board meeting with Helms & Associates will be held Thursday at 3:30 p.m. regarding runway replacement as well as potential grant funding for the planning process. An analysis of the heating and cooling system at the William J. Janklow Community Center indicated the need to replace a pump at the approximate cost of $2,500.00. City zoning violations are once again an issue at the Roger Hasvold property on E. Broad Avenue. Pederson indicated City Attorney Corey Bruning stated action will need to take place in order to proceed with abatement of the zoning violations; Pederson will proceed with the action. The independent inspection of property maintenance throughout the City using services available through the pilot program of the South Dakota Municipal League will begin within the next week, depending on weather. Warming temperatures this week should resolve the ice accumulation on sidewalks in the city. The Community Safe Room #2 is mostly complete; investigation is taking place regarding three leaks in the roof area. Pederson shared that a meeting with involved parties will take place tomorrow to discuss the breach in the geothermal system at the FSST Clinic. Pederson also attended a meeting this afternoon with involved parties regarding the FEMA process to seek assistance in repairing City property damaged at the park during the recent flooding; City property insurance is not available as the property is in a flood zone. A Request for Proposal (RFP) has been circulated for the playground equipment that will be replaced at the Broad Avenue Mobile Home Park as part of a grant award; bid award will take place in January 2020. Agriculture Risk Coverage (ARC-County and ARC-Individual Program) and Price Loss Coverage (PLC) We will begin accepting ARC-CO, PLC and ARC-IC enrollment for 2019 and 2020 after October 7th and will continue signup until March 15, 2020. This is a highly involved program, so please educate yourself prior to making a signup appointment. Information is available from your local FSA office and at https://www.fsa.usda.gov/ programs-and-services/arcplc_program/index . Our office will be holding general information meeting on the ARCPLC Program. The first one is Dec. 10th @ Trent Baptist Heritage Hall 2 PM. I will be scheduling additional meeting in January so keep looking for additional meeting times and places. I highly recommend coming to a meeting, talking to your crop insurance agent, and/ or comeing and see the CED to get a quick overview of your farm and PLC or ARC Programs.
Farm Operation changes Producers participating in FSA and NRCS programs are required to timely report changes in their farming operation to the County Committee in writing and update their CCC-902 Farm Operating Plan. 2019 ARC/PLC must be completed prior to any farm reconstitution, so it is imperative that you notify the FSA Office as soon as possible when land changes owners, operators, or new land is leased. Designation by Landowner method of division for a reconstitution can be utilized when A. part of a farm is sold or ownership is transferred, B. an entire farm is sold to 2 or more persons, C. farm ownership is transferred to 2 or more persons, D. part of a tract is sold or ownership is transferred, E. a tract is sold to 2 or more persons, F. tract ownership is transferred to 2 or more persons.
Dairy Margin Coverage Program (DMC) Dairy Margin Coverage Program (DMC) signup for 2020 began October 7th, 2019 and ENDS December 13th 2019. This program offers protection when the difference between the all milk price and average feed price falls below the dollar amount selected by the producer. Market Facilitation Program (MFP) Producers may continue to apply for the Market Facilitation Program
(MFP) until December 6th, 2019. This program pays a per acre rate on select certified non-specialty crops based on the lesser of the total 2019 plantings, or the 2018 total planted and prevented planted acres. Market Assistance Loans (MAL): the December commodity loan interest rate for 2019 program crops is 2.625% and could change the first of every month until January 1st. The rate on January 1st is fixed for the rest of the loan period. The length of the loan period is 9 months after the month the loan is made. The Moody County loan rates for 2019 is as follows: Corn $2.07/bu. Soybeans $6.05/bu. Oats $2.01/bu. HRS Wheat $4.15/bu. and HRW $2.89/bu. The Last day to finalize a grain loan to show up in your 2019 records is December 23rd. Otherwise it will show up in your 2020 records.
