PUBLIC NOTICE SUMMARY OF FLANDREAU, SOUTH DAKOTA CITY ORDINANCE, TITLE 13, TRAFFIC CODE; CHAPTER 13.7 SNOWMOBILE OPERATIONS No snowmobile shall be operated with the City unless it is registered and identification numbers are displayed as required.

No person may operate a snowmobile on a city street: • At a rate of speed greater than is reasonable having due regard for conditions and in no event in excess of 20 mph • While under the influence of liquor or drugs • Except while proceeding to and returning from the city limits by the most direct route from his home or place where said snowmobile is garaged • In any cemetery • On private property without the consent of the property owner or his agent • With more than one (1) passenger on a snowmobile Any person operating a snowmobile on a city street must: • • • •

Come to a complete stop at all traffic controlled intersections Travel as close to the right edge of the plowed area of the street as practical Obey all traffic signals, signs and devices Yield the right-of-way to all-vehicular traffic and pedestrians

No snowmobile shall be operated to cross any street except at a street intersection of a street.

No person shall operate a snowmobile in the City of Flandreau in a careless or negligent manner likely to endanger any person or property.

No person shall operate a snowmobile upon any public sidewalk.

No person operating a snowmobile shall tow any person or object behind except when such person or object is situated upon a conveyance that is attached by means of rigid hitch or tow bar.

No snowmobile shall be operated in the City unless it has at least one (1) headlight and one (1) taillight turned on at all times during operation; adequate brakes; and is equipped with a muffler in good working order in constant operation to prevent excessive or unusual noise.

The operator of a snowmobile involved in an accident resulting in injuries to or death of any person or property damage in an estimated amount of $100.00 or more must report the accident to Law Enforcement Personnel.

It is presumed that any snowmobile operated within the City is operated with the consent of the owner. The owner of the snowmobile will be held jointly and severally liable with the driver thereof for damages arising out of the negligent or improper operation of his snowmobile.

The owner of a snowmobile may be held jointly and severally liable to a property owner for three (3) times the amount of damages to trees, shrubs, landscaping, or personal property occurring on private property and caused by said snowmobile where the snowmobile is operated without the consent of the property owner or agent.

Law Enforcement Personnel may confiscate any machine, which is operated contrary to or in violation of any provisions of this ordinance.

Any person who violates the provisions of this ordinance is guilty of a misdemeanor and is punishable according to the general provision of this ordinance.

PUBLIC NOTICE SUMMARY OF FLANDREAU CITY ORDINANCE TITLE 5, ARTICLES 5.3.1.p. AND 5.4.2.2., SNOW AND ICE REMOVAL The City shall notify all owners or persons in possession of property abutting on sidewalks to keep such sidewalks free from snow and ice and to remove the same within 72 hours after every fall or accumulation of snow or ice. The notice need not be given personally but may be given

generally through the official newspaper annually.

The owner or person in possession of any property abutting on any sidewalk shall keep such sidewalk free from snow and ice and shall remove any snow and ice from the sidewalks within seventy-two (72) hours after the termination of any snow fall, snow or ice accumulation.

The owner or person in possession of any property abutting upon any sidewalk that ends at an intersection or crosswalk shall maintain the sidewalk free from snow and ice to the edge of the street and will also clear any snow and ice deposited on the sidewalk during the street removal process.

Those sidewalks not cleared of said snow and ice within seventy-two (72) hours will be considered a public nuisance. The City may cause said snow and ice to be cleared from those sidewalks in violation of said Ordinance and will bill those costs to the property owner.

Summary: The Chief Financial Officer is responsible for all aspects of accounting and financial investments and management; the annual audit process, cash flow management, budgeting and forecasting, banking and long term debt management and supervision of accounting and finance staff. The organization includes a governmental segment and an enterprise segment.

Additional responsibilities include managing financial requirements of grants and contracts, and annual budgeting for governmental departments, and fiscal responsibilities of enterprise operations, and commercial real estate properties. This position will also provide oversight of financing activities including banking relationships, loan management, future bond financing, budgeting, projections and pension plan management.

Minimum Qualifications: A. The ideal candidate will have a four-year degree in accounting or finance, CPA plus, 5+ years of progressively responsible experience in an accounting environment with direct experience or exposure to governmental (enterprise) accounting and familiarity with Governmental Accounting and Auditing Standards, 3+ years of experience with personnel management, ability to communicate effectively, both written and verbal. Additionally, qualified candidates must have strong computer skills including a preferred accounting software program(s), be a self-starter and work autonomously. A history of working with Tribal governments or non-profit entities in this capacity is a requirement.

B. Additional experience as outlined above may be substituted for the education on a year for year basis to a maximum of three years.

There were no Public Comments Council President Sutton shared a Thanksgiving card from the Boys and Girls Club thanking Council for their continued support of the Moody County Club.

City Administrator Pederson indicated plans for the second Community Storm Shelter are moving forward. Research has begun to replace the phone system at the City Office and Police Department; technology needs to be updated as the existing phone system is twelve years old. Pederson briefly updated Council regarding the recent nuisance letters regarding inoperable vehicles, stating the ordinance may need to be modified to reflect vehicle location on lots.

City Attorney Paul Lewis reported the Circuit Court issued an injunction requiring Roger Hasvold to move items from his property on Broad Avenue that are out of compliance with the City Zoning Ordinance.

Motion by Unger and seconded by Tufty to approve the Administrative Reports. The following members voted aye: Bjerke, Sutton, Tufty, Unger, and Whitman. Nays: None. Absent: Pesall. Motion carried.

Old Business: Shane Waterman, Clark Engineering, provided a status report on the water and wastewater project. Mr. Waterman indicated while most construction is complete, what remains (such as grading, seeding, ADA ramps) will cease due to weather related issues, but will begin again in the spring. Liquidated damages will cease to accrue when construction ceases but will start accruing again when construction starts up again in spring 2019.

Second reading of Ordinance 588, An Ordinance Establishing a Discretionary Formula for the Assessment of Property Taxes on New Structures and Additions, was held. Motion by Whitman and seconded by Bjerke to adopt Ordinance 588. The following members voted aye: Bjerke, Sutton, Tufty, Unger, and Whitman. Nays: None. Absent: Pesall.

Mayor Bonrud entered the meeting at 7:00 p.m. and chaired the rest of the meeting.

Council Comments: Alderman Sutton shared that a Christmas movie will be held at the Crystal Theatre on November 24th after the Christmas Parade. The next Sesquicentennial planning meeting will be held December 5th. City Administrator Pederson shared that he would like to establish an individual City logo as opposed to always using the City seal as we currently do.
