Marc Bum and DeAnna Berke Personnel Board joined the meeting. Discussion was held on the 2019 Health Insurance. Motion by Ehrichs, seconded by Veldkamp (based on the recommendation of the County Personnel Committee) to accept the Wellmark Renewal Plan K2A/GPC at a 2.82% increase; and to renew the Wellmark H.S.A Plan at a 1.79% increase; and to accept the Delta Dental Renewal plan at a 1.2% increase, accept the VSP Vision renewal at a 4% increase, and accept all effective January 1, 2019. The motion also includes the approval to contribute $750 to employees who choose to open an H.S.A. The County will no longer reimburse any of the deductibles. All voted “aye”.

Discussion was held on wages. The personnel board made a request to give the County employees a 3% rate increase due to the lower than expected insurance increase. Motion

by Bruning, seconded by Veldkamp to approve the following wage changes effective December 24, 2018 with all voting “aye”: 3% wage increase for all County employees except Commissioners Director of Equalization change to the same wage as Elected Officials Motion by Veldkamp, seconded by Miles to enter into Executive Session pursuant to SDCL 1-25-2, at 10:13 AM. PUBLIC NOTICE SUMMARY OF FLANDREAU, SOUTH DAKOTA CITY ORDINANCE, TITLE 13, TRAFFIC CODE; CHAPTER 13.7 SNOWMOBILE OPERATIONS No snowmobile shall be operated with the City unless it is registered and identification numbers are displayed as required.

No person may operate a snowmobile on a city street: • At a rate of speed greater than is reasonable having due regard for conditions and in no event in excess of 20 mph • While under the influence of liquor or drugs • Except while proceeding to and returning from the city limits by the most direct route from his home or place where said snowmobile is garaged • In any cemetery • On private property without the consent of the property owner or his agent • With more than one (1) passenger on a snowmobile Any person operating a snowmobile on a city street must: • • • •

Come to a complete stop at all traffic controlled intersections Travel as close to the right edge of the plowed area of the street as practical Obey all traffic signals, signs and devices Yield the right-of-way to all-vehicular traffic and pedestrians

No snowmobile shall be operated to cross any street except at a street intersection of a street.

No person shall operate a snowmobile in the City of Flandreau in a careless or negligent manner likely to endanger any person or property.

No person shall operate a snowmobile upon any public sidewalk.

No person operating a snowmobile shall tow any person or object behind except when such person or object is situated upon a conveyance that is attached by means of rigid hitch or tow bar.

No snowmobile shall be operated in the City unless it has at least one (1) headlight and one (1) taillight turned on at all times during operation; adequate brakes; and is equipped with a muffler in good working order in constant operation to prevent excessive or unusual noise.

The operator of a snowmobile involved in an accident resulting in injuries to or death of any person or property damage in an estimated amount of $100.00 or more must report the accident to Law Enforcement Personnel.

It is presumed that any snowmobile operated within the City is operated with the consent of the owner. The owner of the snowmobile will be held jointly and severally liable with the driver thereof for damages arising out of the negligent or improper operation of his snowmobile.

The owner of a snowmobile may be held jointly and severally liable to a property owner for three (3) times the amount of damages to trees, shrubs, landscaping, or personal property occurring on private property and caused by said snowmobile where the snowmobile is operated without the consent of the property owner or agent.

Law Enforcement Personnel may confiscate any machine, which is operated contrary to or in violation of any provisions of this ordinance.

Any person who violates the provisions of this ordinance is guilty of a misdemeanor and is punishable according to the general provision of this ordinance.

AND 5.4.2.2., SNOW AND ICE REMOVAL The City shall notify all owners or persons in possession of property abutting on sidewalks to keep such sidewalks free from snow and ice and to remove the same within 72 hours after every fall or accumulation of snow or ice. The notice need not be given personally but may be given

generally through the official newspaper annually.

The owner or person in possession of any property abutting on any sidewalk shall keep such sidewalk free from snow and ice and shall remove any snow and ice from the sidewalks within seventy-two (72) hours after the termination of any snow fall, snow or ice accumulation.

The owner or person in possession of any property abutting upon any sidewalk that ends at an intersection or crosswalk shall maintain the sidewalk free from snow and ice to the edge of the street and will also clear any snow and ice deposited on the sidewalk during the street removal process.

Those sidewalks not cleared of said snow and ice within seventy-two (72) hours will be considered a public nuisance. The City may cause said snow and ice to be cleared from those sidewalks in violation of said Ordinance and will bill those costs to the property owner.

City Administrator Pederson informed Council the grant application for the Broad Avenue Mobile Home Court playground equipment was submitted by the deadline date and the City has received notification of receipt. A site visit will take place at a later date. A purchase agreement for property for the second community safe room will take place soon; necessary notification to the State regarding the site change will be completed as well. A pre-application for airport runway and land acquisition is forthcoming.

Old Business: Shane Waterman, Clark Engineering, provided a status report on the water and wastewater project. Mr. Waterman indicated utility work and asphalt are complete; concrete work continues. Finish work and seeding are in progress. Discussion was held regarding warranties, substantial completion date and project inspection.

New Business: First reading of Ordinance No. 588, An Ordinance Establishing a Discretionary Formula for the Assessment of Property Taxes on New Structures and Additions, was held.
