Titus Tollefson presented a check in the amount of $400 to the Mayor and Council to assist with costs associated with the recent purchase of anti-littering signs. The $400 represents funds he earned specifically to purchase signs to deter littering, as well as funds donated from interested parties. The Mayor commended Titus on his involvement and initiative in making Flandreau a more attractive community. Mayor Sutton shared that he and City Administrator Jeff Pederson met with Heidi Marsh, Fresh Produce, regarding branding for the City of Flandreau. A special presentation for Council will take place on Tuesday, October 12th. The Mayor and City Administrator also met with Seth Pearman, Flandreau Santee Sioux Tribal Attorney, regarding funding for the new Fire Station as well as other potential partnerships in the community. Mr. Pearman will discuss with Tribal Council. A community picnic sponsored by Mad Mary’s and the City of Flandreau will take place on October 3rd from 4:00-7:00 p.m. to send off the Flandreau 1742nd National Guard, Detachment 1, as the unit is being deployed for one year. Intentional damage of the roadway by digging up, removing, displacing, breaking or otherwise injuring or destroying a township roadway or ditch can be considered either a Class 2 misdemeanor or a Class 6 felony, depending on the damage incurred. (SDCL 31-32-1 & 31-32-7) . Should the ditches not be restored to original condition, the matter can be turned over to the States Attorney for prosecution or the township attorney as circumstances require. These damages could result in either criminal or civil legal action. These damages may be pursued in court if you are found in violation. In addition, civil penalties of two or three times greater the cost of repairing the damage can be imposed on the landowner for damages. (SDCL 31-32-8). Damages to roads or right-of-ways may increase the liability for both the landowner and the township, reduce the integrity of the roadway increasing the speed of deterioration, as well as being a potential hazard to the public. Landowners are also reminded that nothing should be done to drain water into or alter the township road and/or right of way in any manner without the written authority of the township. Damage by draining water into the ROW may be a violation as described in the first paragraph above.
