The Board of Trustees of the City of Egan, South Dakota met in a special meeting on July 28, 2026, at Egan City Hall, 101 N Irvin St, Egan, SD. Present: Board of Trustees – Michelle Ten Eyck, Cody Chamblin, Karlie Ten Eyck, Allen Loehr, and Finance Officer Maeghen Putnam. Mike Hein absent. Citizens Attending: Jason Gierke. The 6:00 pm meeting was called to order by Chairman M. Ten Eyck. Motion by Loehr, second by K. Ten Eyck to approve the agenda. All Present voted “aye.” Motion by K. Ten Eyck, seconded by Chamblin to approve July 15, 2026, Regular Meeting Minutes. All present voted “aye.”

Public Comment: M. Ten Eyck spoke about the decision to limit public comment at Board of Trustee meetings. She cited SDCL 1-25-1, the SDML Open Meeting Brochure, SDML training, and Robert’s Rules of Order. Donna Koehn inquired about the progress on getting a local tree dump for Egan residents. M. Ten Eyck stated that the city is still working on the tree dump issue and the contract is good with Flandreau through October.

Old Business: Loehr made a motion to approve the $71,776.68 Seal Pros Quote with the new addition of two patches on First Street and overlay to a portion of First Street. Seconded by Chamblin. All present voted “aye.” This quote includes the Prospect Street overlay previously approved at the July 15, 2026, meeting. Jason Gierke came in to talk to the board about installing a meter pit on his land. Currently, water is leaking under his trailer house, and the meter is inaccessible to the City/Big Sioux for repair. Meter pits are required per Ordinance 141a5. K. Ten Eyck moved to defer action on Jason’s meter pit until the end of the meeting. Seconded by Loehr. All present voted “aye.” New Business: The Board of Trustees is the first reading of Ordinance 141 – 1.03 C 2026 – Meter Pit Requirements. Revisions were made during the meeting a finalized version of the Ordinance was agreed upon. ORDINANCE 141 – 1.03 C 2026 – METER PIT REQUIREMENTS AN ORDINANCE TO REPEAL ORDINANCE 141A5 AND REPLACE ORDINANCE 141 SECTION 1.03 C and 1.03 D WITH: ORDINANCE 141 – 1.03 C 2026 - METER PIT REQUIREMENTS BE IT ORDAINED TO REPLACE SECTION 1.03 C WITH SECTION 1.03 C 2026 METER PIT REQUIRMENTS TO ORDINANCE 141. (1) All dwellings or places supplied with water from the town water system shall be metered. (2) Meters shall be installed only in a basement that is protected from frost and other damage and that remains accessible for examination and maintenance. Crawl spaces, slab-on-grade construction, and any other location outside a basement of the building are not permissible for meter installation. When a basement meeting these requirements does not exist or cannot be used, a manufactured meter pit shall be installed. A suitable place for the meter and meter pit, safe from frost or other damage and accessible for examination, will be provided by and at the expense of the City of Egan. All plumbing and expenses from the meter pit to the residence will be at the owner’s expense. If a meter is injured by freezing within the basement or is otherwise damaged by the act or neglect of the owner or occupant, it shall be repaired or replaced at the expense of the owner or occupant. If a meter is injured by freezing within the meter pit, it shall be repaired or replaced at the expense of the City of Egan. If the owner or occupant neglects or refuses to repair or replace the meter, or refuses to pay the related expenses, the water supply may be turned off and shall not be restored until all costs and the applicable reconnect fee have been paid. Unpaid costs may be collected in the same manner as other utility charges and may become a lien or collection against the property/owner. (3) The town will supply meters to all accounts where applicable, so meters are compatible with the town’s computer read system. The meters are the property of the City of Egan/Big Sioux Water. (4) Manufactured meter pits shall be required for all new construction that does not have a basement or a modular/mobile home that uses residential sized meters and shall be located within 1 foot of the users lot line where possible or in a place designated by the Public Works supervisor where lot line placement is not feasible. The pit shall be of a type approved by the Public Works supervisor, installed according to manufacturer specifications, and shall remain fully accessible at all times (no permanent landscaping, structures, or coverings that obstruct access will be allowed.) (5) The Egan City Board of Trustees may hear and decide appeals where it is alleged there is an error in any order, requirement, decision or determination made by an administrative official in the enforcement of this chapter or of any ordinance adopted pursuant thereto. (6) Except as otherwise provided herein, any person violating any provision of this chapter shall be subjected to 30 days imprisonment in a county jail or $500 fine, or both. In addition to the sentence that is imposed herein, the defendant shall make restitution to the to the City of Egan. First Reading: 7/28/2026 The Board reverted to the Jason Gierke hearing. A motion was made by M. Ten Eyck that the city will cover the meter pit expense and the meter. Jason is responsible for everything from the meter pit to the house expense. K. Ten Eyck seconded the motion. All present voted “aye.” Committee Reports: Compliance/Code Enforcement: nothing Maintenance/ Streets: The lawn mower is getting taken to Titan Machinery. It has been overheating and has a leak in the radiator. Parks: There is a leak at the ballpark. Loehr is going to get the necessary parts and fix it. It is going to be converted to Pex A and a ball valve installed. Budget: Putnam presented the Board with a worksheet that showed the last three years’ actual expenditures and revenue. Along with estimated expenditures and revenue for the remainder of 2026. Notable decisions were to appropriate $75,000 to Streets, $10,000 to Parks, and $8,000 to Lawyer expenses. Old Business: K. Ten Eyck reached out to Dakota Surveillance. She is waiting for the estimate. The plan is for a four-camera setup, one pointed towards Gazebo Park, another pointed towards the city office, another at the ballpark, and the last camera at the river city park camping area. Chamblin contacted Patriot Electric about Gazebo Park electric. Patriot will come quote the project when they get time. The Board reviewed Ordinance 174 and 174.1 relating to dog tag licensing. M. Ten Eyck stated the enforcement piece is a little difficult. She contacted American Legal Publishing to specifically look at the dog tag ordinance to help with wording that will help with enforcement of the ordinance. After taking the lawn mower to Titan Machinery, Loehr inquired if the city could purchase a trailer. One was borrowed and one was rented to get the mower fixed. Chamblin mentioned that we have not had a trailer for the twelve years he has been on the board and with tight budget discussions he does not believe the trailer is necessary. The board will investigate this next year. K. Ten Eyck made a motion that the Board of Trustees moves the regular scheduled meeting to the 2nd Wednesday of month at 6:00 pm. K. All present voted “aye.” Committee Reports: Compliance/Code Enforcement: Chamblin has noticed some vehicles that need enforcement and has to get the addresses to Putnam. There was a lawn that needed mowing but that was taken care of. Maintenance/Streets: M. Ten Eyck and family rebuilt one of the bleachers at the Ball Diamond with new wood and two picnic tables are fixed. Loehr replaced all the plumbing in the Ball Diamond bathrooms spending $662. The tractor had a flat tire. It was repaired. The snowplow batteries are charged and are working. Loehr has also been in contact with Boyer’s about trading in the big snowplow for a smaller one. Loehr will continue to follow up. Parks: Three quotes for electrical work will be acquired from Patriot, AMP, and Dell’s Electric as suggestions for electricity to the Gazebo Park, light switch in the Ball Diamond bathrooms, and to replace/fix the electrical main panel for the Ball Diamond. Personnel/Compliance: Three counsel members and the Finance officer will go to the SDML conference in October. K. Ten Eyck is working on an employee manual. Putnam will send K. Ten Eyck a copy of the Egan Personnel Manuel. Utilities: The city is overtaking the sewer line soon to be installed in the ally between Irvin and Fred. The city will pay half for the six-inch sewer pipe at a cost of $850. The city is paying for all the plumbing supplies and being reimbursed by Ted Thull since Jeff from Big Sioux is overseeing the project. On June 3, 2026, Mr. Lesnikowski publicly stated he moved to Flandreau to be near his children and wished to see them every day. Visitation Record since June 3, 2026: 18 offered 4 attended 1 arrived / failed breathalyzer 13 no-show At the request of the minor children, and to spare them the disappointment of preparing for visits that do not occur, the following terms take effect immediately. The standing visitation times remain fixed, and are expanded to three mornings weekly: Wednesday, Saturday, and Sunday — 9:00 AM, 90 minutes each. Each visit must now be confirmed in advance. Mr. Lesnikowski must confirm his attendance in writing no less than 24 hours before the 9am scheduled visitation, so that the children are only asked to prepare for a visit that is actually going to happen. Confirmed visits remain subject to a verified 0.0 BAC and to the children’s own choice to participate. This is not a reduction in access — it is an increase, now three mornings per week. What changes is that a visit begins with his confirmation, so that no child is left waiting on a door that does not open. This offer does not expire. A complete dated log of each offered, confirmed, and missed visit and its outcome is maintained and will continue to be published intermittently. Custody status: Sole legal and physical custody held by the undersigned pursuant to California court order. Visitation is offered above the court-required minimum on a permanent basis.
