Full-Time-Assistant Attorney General

The Flandreau Santee Sioux Tribe (the “Tribe”), located in Flandreau, South Dakota, is seeking applicants for one full -time position of Assistant Attorney General. The attorney, under the direction of the General Attorney, will be tasked with the responsib ility of prosecuting the Tribe’s Law and Order Code, and will work closely with Tribal Police and other local state and federal agencies to fulfill the position’s obligations. The attorney will also assist the Attorney General with assigned matters regard ing the representation of the Tribe, its Housing Authority, its Health Clinic, its tribally owned businesses, and the Royal River Casino and Hotel. The attorney will handle all adult criminal and juvenile delinquency matters for the Tribe. Licensed attorne y in good standing with the State Bar of South Dakota, or any other state bar, and is able to be admitted in South Dakota within 10 months of employment. Must have between one and five years of experience as a practicing attorney, with experience in Indian Law and Criminal Law preferred. Must have a juris doctorate from an American Bar Association accredited law school. No felony or misdemeanor convictions involving a crime of moral turpitude. Must be able to efficiently utilize Microsoft Office and Westlaw . Must have a valid driver’s license.

The proposed resolution would vacate the north 25’ of the 80’ road dedication of Community Drive commencing at the southwest corner of Lot 1 Booster Club Addition and extending east through the west 10’ of the South Four Hundred and Forty-Three Feet (S-443’) and West Twenty-Eight (28’) of Outlot 7 of the Southwest Quarter (SW ¼) of the Southwest Quarter (SW ¼) of Section Twenty-One (21), Township One Hundred Seven North (107 N), Range Forty-Eight (48) West of the Fifth P.M., Moody County, SD. No public input was heard. Public Hearing was closed. Motion by Fargen and seconded by Tufty to approve Resolution 2024-09; Vacating a Portion of Community Drive. Mayor Dan Sutton reported he has been working with Administrator Turnquist and the City’s Code Enforcement Officer on cleaning up some nuisance properties in town. Sutton has attended several meetings regarding the Boys and Girls Club’s Early Childhood Learning Center. Sutton told Council there are many positive things happening in Flandreau.

City Administrator Cohl Turnquist informed Council members that a crew from The Road Guy Construction Company would be in town in September to do warranty work on the chip seal project to First Avenue that was completed last summer, which was unsatisfactory to City officials. The Zoning Ordinance Review Committee has met several times. Todd Kayes, from First District, will be at the August 19th meeting to report to Council members on proposed updates to the zoning ordinances. There will be a budget workshop held during a special council meeting on Wednesday, August 14th, at 5:30 p.m. The City has been unsuccessful in finding a new audit firm and has informed the state legislative audit office of the situation. Funds of $7,722.50 will be received from the surplus auction sale which was held July 30th, 2024. The city’s water towers will be having routine cleaning and maintenance done between August 12th and August 20th and residents could experience low water pressure during that time. The Housing Authority Committee has met with Todd Meierhenry, from Sioux Falls, on a possible multi-family unit development on Broad Avenue. The Flandreau Dam Revitalization Committee met and developed a mission statement and discussed ideas to improve safety and clean-up and maintenance. The next meeting for this group will be August 15th, at 10:00 a.m. at the Flandreau Dam. The City is looking for volunteers who would like to be on the Cemetery Committee. If interested, please contact the City Office.

New Business: Nancy Carlsrud, representing the Flandreau City Band, informed City Council that the band is asking for $4,000 for their 2025 community subsidy request. Carlsrud also stated repair work and painting needs to be done at the band shell.

Carlsrud spoke on behalf of the Crystal Theatre, stating the 2025 subsidy request would be $8,000, which helps provide quality family-friendly entertainment. Museum director, Caitlyn Drietz, reported on the happenings going on at the Moody County Museum, and requested a $10,000 community subsidy for 2025. Tammie Hammer, Sharon Dailey and Kim Hansen were present on behalf of the Flandreau Parade Committee who is responsible for organizing the Christmas Parade and decorating the park next to the bank. They are requesting $3,000 for their 2025 subsidy request.

Caitlyn Christy, with the Boys and Girls Club, presented a flyer to Council Members with information on the Club and their activities. Boys and Girls Club is requesting $10,000 for their 2025 community subsidy request.

Further discussion on community subsidy requests, along with other 2025 Budget requests, will happen at the Budget Workshop meeting on August 14th, at 5:30 p.m. The first reading of the 2025 Appropriation Ordinance will take place at the first council meeting in September. Terry Wolf and Jeff Becthold, with Missouri River Energy Services, presented information to the City Council on the distribution maintenance program, which assists cities with filling electric line worker positions.

Phillip Allen, with the Flandreau Santee Sioux Tribe, provided information to the City Council about possible grant fundings available to the tribe for a bridge/pathway that could potentially tie in with the Recreation Trail being planned by the Flandreau Development Corporation and the tribe’s plans to replace the Crescent Street Bridge.

Motion by Yeaton and seconded by Tufty to allow Administrator Turnquist to write a letter of support to the Flandreau Santee Sioux Tribe for pursual of grant funds for the new pathway. The following members voted aye: Ahlers, Ekern, Fargen, Tufty and Yeaton. Nays: None. Absent: Bjerke. Motion carried.

Motion by Tufty and seconded by Ahlers to approve the Step Increase for Jaymes Zollner, placing him on Step 4 of the Apprentice Lineman Wage Scale at $24.32/hourly. The following members voted aye: Ahlers, Ekern, Fargen, Tufty and Yeaton. Nays: None. Absent: Bjerke. Motion carried.

Motion by Ahlers and seconded by Fargen to approve the Step Increase for Tyler Wallert, placing him on Step 2 of the Certified Police Officer Wage Scale at $24.82/hourly. The following members voted aye: Ahlers, Ekern, Fargen, Tufty and Yeaton. Nays: None. Absent: Bjerke. Motion carried.

Administrator Turnquist presented information to the Council about Resolution 2024-10; Opposition to Initiated Measure 28. If passed, IM 28 would cause revenue loss for cities in South Dakota due to losses in sales tax revenue. The initiated measure would remove state, municipal and tribal taxes on all items sold for human consumption except alcohol and prepared food.

Motion by Fargen and seconded by Yeaton to table Resolution 2024-10, as council members would like to gather more information on Initiated Measure 28. The following members voted aye: Ahlers, Ekern, Fargen, Tufty and Yeaton. Nays: None. Absent: Bjerke. Motion carried.

Motion by Fargen and seconded by Ahlers to allocate $29,116.52 from General Fund Reserves for repair costs to Flandreau Fire Department brush truck and ladder truck. The following members voted aye: Ahlers, Ekern, Fargen, Tufty and Yeaton. Nays: None. Absent: Bjerke. Motion carried.

Motion by Yeaton and seconded by Ahlers to approve Pay Request Fifteen (15) from WS Construction for final retainage for the Flandreau Fire Station in the amount of $30,789.06. The following members voted aye: Ahlers, Ekern, Fargen, Tufty and Yeaton. Nays: None. Absent: Bjerke. Motion carried.

Motion by Fargen and seconded by Ahlers to approve the transfer of $212,163 from 2021 Water Bond Reserve account to Series 2023 Water Improvement Project account, which would allow for enough funds to complete Schedule Three (3) of the Series 2023 Water Improvement Project. SB 201 is a bill passed by the South Dakota legislature in March titled ‘An Act to provide new statutory requirements for regulating linear transmission facilities, to allow counties to impose a surcharge on certain pipeline companies, and to establish a landowner bill of rights.’
