The City Council of the City of Flandreau, South Dakota, met in regular session on Monday, December 18th, 2017 at 6:30 p.m. at the City Council Chambers, 1005 W. Elm Avenue, Flandreau, SD. Present: Mayor Mark Bonrud. Aldermen: Brad Bjerke, Bob Pesall, Ron Smith, Bart Sample, Dan Sutton, and Karen Tufty. Absent: None. Also present were Donald Whitman, City of Flandreau; Chief Zach Weber, Flandreau Police Department (FPD); Paul Lewis, City Attorney; Dave Burwitz, Houston Engineering; Pam and Dave Lillibridge, Cassandra, McKenzie and Reagan Sample, Karla Bjerke and Amy Whitman, interested parties; and Brenda Wade Schmidt, Moody County Enterprise. The proposed agenda was reviewed. Motion by Pesall and seconded by Smith to adopt the proposed agenda. The following members voted aye: Bjerke, Pesall, Sample, Smith, Sutton, and Tufty. Nays: None. Absent: None. Motion carried. Dave Burwitz met with Council to discuss the various services offered by Houston Engineering, Inc. Dave also wanted Council to know that he is Houston’s Office Manager/Project Manager for a new Sioux Falls office of Houston Engineering. This will also be Houston Engineering’s first office in South Dakota. Dave indicated that he would like to continue working with the City as he has since 1992 while he was with other engineering firms. Chief Weber, FPD, informed Council that he has been working on his yearly statistics and it looks like calls for service are up by 400 but that arrests remained the same as the previous year. A full report will be provided to Council at the January 15, 2018 meeting. Chief Weber also announced
that the City Attorney is looking over a proposed agreement between the School District and City for the employment of a School Resource Officer. Chief Weber also noted that following interviews last week, an offer of employment was made to Rob Neuenfeldt who is Acting Chief for the FSST Police Department. Alderman Bjerke, Airport Board Liaison, reported that the City Attorney is reviewing amendments to Title 15 of the City Ordinances as recommended by the Airport Board. An Ordinance with these amendments should be ready for Council action at the January 2, 2018 Council meeting. Alderman Bjerke also discussed flight training at the Flandreau Municipal Airport. The Mayor advised Council that he attended the daycare meeting held at the Community Center last Thursday. There are still a lot of unanswered questions regarding state licensed daycares in Flandreau. The City Administrator reported that he and the City Attorney met with the Planning & Zoning Commission just before the Council meeting to discuss a house that David Ross wants to build in the floodplain. David did everything required by the floodplain ordinance and his plan was approved by Planning & Zoning. City Administrator also reported on the Police interviews held last week and that an offer was extended to one of the candidates. Chief Weber will bring the new hire to the next Council meeting on January 2, 2018 where the wage for the new hire will be on the agenda for Council approval. City Administrator also informed Council that the City has had several inquiries on the loader that has been declared surplus. Bid opening is scheduled for January 8, 2018 with award by Council at the January 15, 2018 Council meeting. Motion by Smith and seconded by Sample to approve the Department, Board, and Administrative Reports. The following members voted aye: Bjerke, Pesall, Sample, Smith, Sutton, and Tufty. Nays: None. Absent: None. Motion carried. Old Business: Second reading of Ordinance No. 585, 2017 Supplemental Appropriation Ordinance, was held. A motion was made by Smith and seconded by Sutton to adopt Ordinance 585. The following members voted aye: Bjerke, Pesall, Sample, Smith, Sutton, and Tufty. Nays: None. Absent: None. Motion carried. Motion by Bjerke and seconded by Smith to approve Pay Request Six (6) from H & W Contracting in the amount of $424,981.35 for the Water and Wastewater Improvements Project. Motion by Sample and seconded by Smith to authorize the Mayor to sign CDBG Payment Request Drawdown Request No. Eleven (11) for $73,571.74. UNAPPROVED MINUTES OF DECEMBER 19, 2017 The Moody County Commissioners met in regular session on Tuesday, December 19, 2017 in the County Commissioners' Room of the Courthouse at 9:00 AM, with the following members present: Chairman Jerry Doyle, Rick Veldkamp, Tom Ehrichs, Dan Miles, and Carla Bruning, with Kristina Krull, Auditor as Clerk of the Board. Also present: Marty Skroch, Commission Assistant, Paul Lewis, States Attorney, and Brenda Wade Schmidt, Moody County Enterprise. Chairman Doyle called the meeting to order. Motion by Ehrichs, seconded by Miles to approve the agenda. All voted “aye”. Motion by Veldkamp, seconded by Bruning to approve the minutes of December 5, 2017 with the following addition with all voting “aye”: Marty Skroch met with the Board. Discussion was held on the Ambulance Department. Also present Mark Bonrud, Scott Ganschow, and Taylor White. Motion by Miles, seconded by Bruning to enter into executive session at 9:02 AM pursuant to SDCL 1-25-2. Reason: legal, personnel. All voted “aye”. Motion by Bruning, seconded by Ehrichs to resume regular session at 10:10 AM. All voted “aye”. Lewis left the meeting. Discussion was held on Road Haul Agreements. Troy Wellman, Sheriff presented a purchase request to the Board. Motion by Veldkamp, seconded by Miles to approve the purchase of 2018 Dodge Charger in the amount of $23,122, with addition of full wheel cover costing $290, and 3 additional keys costing $585 for a total of $23997. All voted “aye”. Kristina Krull, Auditor met with the Board. Motion by Ehrichs, seconded Bruning to approve the following resolution with all voting “aye”: RESOLUTION 17121901 WHEREAS, Moody County funds the Highway budget through tax dollars and revenue from car licenses, and WHEREAS, the board of commissioners designated operating transfers out of the General Fund to the Highway Fund for 2017. NOW, THEREFORE, BE IT RESOLVED that the Operating Transfer Out of the General Fund to the Highway Fund in the amount of $600,000 be approved as outlined in the 2017 Annual Budget. RESOLUTION NO. 2017-08 A RESOLUTION REGARDING THE ADOPTION OF THE DISTRIBUTED GENERATION WORKBOOK WHEREAS, the Public Utilities Regulatory Policy Act of 1978 (PURPA), as amended, requires a utility to buy power and sell power to Qualifying Facilities; and WHEREAS, the City of Flandreau and MRES filed a Petition of Waiver, which specifies the obligations of the City of Flandreau and MRES to a QF, with the Federal Energy Regulatory Commission (FERC) on Section 2010 of PURPA, and have been granted such waiver by the FERC; and WHEREAS, the City of Flandreau and MRES agreed to comply with “Rules of Compliance” as part of the Waiver; and WHEREAS, the City of Flandreau has drafted guidelines and documents to implement the Rules of Compliance known as the “Distributed Generation Workbook” to accommodate QFs in interconnection and power purchase arrangements, which are subject to be updated periodically. NOW, THEREFORE, BE IT RESOLVED that in recognition of the above statements, the City of Flandreau hereby adopts the Distributed Generation Workbook as the “Small Power Production and Co-Generation Policy.” Dated at Flandreau, South Dakota, this 18th day of December, 2017. RESOLUTION 2017-09 TRANSFER FROM CONTINGENCY FUND WHEREAS, the City of Flandreau, South Dakota, has included in the 2017 Appropriation Ordinance No. 576 a contingency item which may be appropriated by Resolution of the Governing Body to any other appropriation amount that is deemed insufficient during the year, and WHEREAS, the budget items for General Government Legal, $4,400; Insurance & Bonds, $406; General Financial Administration, $15,157; Cemeteries, $1,361; Aquatic Center, $28,472; Parks, $29,973; Community Center, $9,400; and Debt Service, $525 are insufficient and it was deemed necessary that $89,694 of the Contingency Appropriation be transferred accordingly, NOW THEREFORE, BE IT RESOLVED THAT the City Council of the City of Flandreau, South Dakota, does hereby declare that authorization to transfer $89,694 from the Contingency Appropriation to the insufficient budget items stated above be hereby granted. BE IT FURTHER RESOLVED THAT the means for financing the insufficient budget items is from the use of designated and undesignated cash on hand.
