Definitions. a. “Cemetery” – Union Cemetery, Flandreau, Moody County, South Dakota. b. “City” – City of Flandreau, Moody County, South Dakota. c. “City Administrator” – The chief administrative officer for the City of Flandreau as established in Section 1.3.1. of the Flandreau Municipal Ordinance. d. “Finance Officer” – The appointed financial officer for the City of Flandreau. e. “Mayor” – The elected presiding officer of the Flandreau City Council and the executive head of the City of Flandreau. f. “State” – State of South Dakota.

BE IT FURTHER ORDAINED THAT SECTION 10.2.2. RULES AND REGULATIONS BE AMENDED TO READ AS FOLLOWS: That the following rules and regulations shall be with reference to all cemetery property owned, managed, or controlled by the City, and the same may be embodied as conditions in the conveyance of lots in said cemetery, to purchase thereof, to wit: Article 10.2.2.1. All graves shall be held subject to the laws of the State, relating to cemeteries, and shall not be used for any other purposes than as a place for burial of deceased human beings.

Article 10.2.2.2. The general public will be allowed access to the grounds at all times during daylight hours, upon observing the rules that are or may be adopted for the regulation of visitors.

Article 10.2.2.3. The Mayor, attested by the City Administrator, shall sign all lot conveyances.

Article 10.2.2.4. The cemetery is divided into parcels of land measuring sixteen feet wide by fourteen feet long (16’x14’) and henceforth referred to as lots. Each lot consists of four adult graves measuring four feet wide by ten feet long (4’x10’).

On the eastern border of each ten foot long adult grave is an additional space of four feet by four feet that may be used for either a single infant burial or the interment of cremated remains. Unless consented to by the Council, no more than one deceased human being may be buried in an individual adult grave, nor more than one infant or cremated remains be interred in the four feet by four feet space along the eastern border of the adult grave.

Article 10.2.2.5. Owners shall not allow internment to be made in their lots for remuneration, nor shall any transfer or assignment of the use of any lot, or of any interest therein be valid, without the written consent of the Flandreau City Council.

Article 10.2.2.6. No sign indicating that a lot, vault or tomb is for sale will be permitted in or on the grounds.

Article 10.2.2.7. Disinterment shall be allowed, provided all state laws governing disinterment have been complied with.

Article 10.2.2.8. The Council reserves the right to lay out or alter the avenues or walks, or make such rules and regulations for the government of the grounds as they may deem appropriate.

Article 10.2.2.9. The owner of each lot may erect any proper stones, monument or sepulchral structures thereon, except that no vault shall be built entirely or partially above ground without permission of the Council, and that all monuments and all parts of vaults above ground shall be cut stone, granite, marble, cement or bronze.

Article 10.2.2.10. All adult graves in the west addition of the cemetery shall have headstones placed on the west border of the adult grave. Infant burials or interred cremated remains within the four feet by four feet space abutting the adult grave shall have headstones that are flush with the ground.

Article 10.2.2.11. If any monument, effigy or enclosure, or any structure whatever, or any inscription be placed in or upon any lot, which shall be determined by the Council to be offensive or improper or injurious to the appearance of the surrounding lots or grounds, they shall have the right and it shall be their duty to have removed the said offensive or improper object.

Article 10.2.2.12. All corner stones, if installed, must be flush with the ground.

Article 10.2.2.13. Lot enclosures of any kind whatever are prohibited.

Article 10.2.2.14. The owner of each lot may cultivate existing trees, shrubs, and plants in the same, but no trees growing within the lot or border shall be cut down or destroyed without the consent of the Council.

Article 10.2.2.15. If any trees or shrubs situated in any lot, by means of their roots or branches, become detrimental to the adjacent lots or avenues, or unsafe, unsightly or inconvenient for visitors, it shall be the duty of the Council, and they shall have the right, to provide for the removal of said trees and shrubs, or such parts thereof as they shall determine to be detrimental, unsafe, unsightly or inconvenient.

Article 10.2.2.16. Pets, whether or not leashed or otherwise restrained, are not permitted in the cemetery at any time.

Article 10.2.2.17. Responsibility for headstone maintenance and repair shall be borne by the decedent’s family. In the event that a headstone becomes damaged and the decedent’s family cannot be located, the Council shall take such action as it deems necessary to repair the damaged headstone, but each instance of headstone damage that necessitates repair will be reviewed by the Council on a case by case basis.

Article 10.2.2.18. No burying of any kind shall be permitted within the cemetery without being overseen by at least one of the following: the Mayor, the City Administrator, or the Cemetery Advisor.

BE IT FURTHER ORDAINED THAT TITLE 10 BE AMENDED TO ADD A NEW SECTION 10.2.4 THAT READS AS FOLLOWS: Section 10.2.4. Abandonment - Unused Burial Spaces Article 10.2.4.1 In the event a party contacts the City about the purchase of a lot that is identified as being owned, the City may review and cause to be determined whether or not the owner has abandoned the lot.

Article 10.2.4.2. In making a determination of abandonment, the City will first send a letter to the last known address if available and if no address is available and/or no response to the City’s letter is received, the City shall publish public notice in its official newspaper as follows: a. The notice shall describe the coordinates of the unused lot and/or grave; b. Set forth the name of the owner(s) listed in the cemetery records, or if the owner is known to be deceased, then the names of such claimants as are heirs at law, next of kin, or specific beneficiary under the will of the owner if known; c. Detail the facts with respect to the failure of the owner or survivors to keep the City informed of the owner’s address for a period of Sixty (60) consecutive years or more; and d. The notice shall run two times in a consecutive two-week period. After 120 days from the final notice and publication, the City shall have the right to sell such lot and/or grave.

regular session on Monday, August 7th, 2017 at 6:30 p.m. at the City Council Chambers, 1005 W. Elm Avenue, Flandreau, SD. Present: Mayor Mark Bonrud. Aldermen: Brad Bjerke, Bob Pesall, Bart Sample, Ron Smith, Dan Sutton, and Karen Tufty. Absent: None. The CDBG Progress Public Hearing was held. Randy Wilts questioned whether 1st Avenue between Wind and Lindsay Streets will be paved yet this year. Dave Burwitz, engineer with Clark Engineering, responded that it would. Randy Wilts also indicated that the contractor has been leaving heavy equipment in the street by the Methodist Church making parking difficult on Sunday mornings. Dave Burwitz indicated he will ask the contractor to discontinue parking in front of the church over the weekends. There being no further comments, the Mayor closed the Public Hearing.

Dave Burwitz gave Council an update on the water and sewer line replacement project as a whole. In the section from Wind to Lindsay Streets, the sewer work is complete. Only two blocks of water connections are left to be done. This section of the project and the first section from Industrial to Veterans Streets will then be paved. The contractor will then move to Veterans Street and work on 1st Avenue to Wilson Street. The final phase is Wilson to Wind Streets.

The section that includes 3rd, Pipestone and 13th will be done in 2018. The contractor is running approximately one week behind schedule and may bring in another crew to help get caught up.

School Superintendent Rick Weber said that he has been talking to Chief Weber regarding the hiring of a School Resource Officer (SRO) position. Superintendent Weber indicated that the School Board might be willing to pay the City $25,000 per year to go toward the salary and benefits for the SRO. Chief Weber said he would like to hire a replacement for Officer Pelton who would potentially become the SRO. It was determined that we need to wait and see what the proposed 2018 budget looks like before a decision is made about hiring another officer. Superintendent Weber said he was going to take the matter to the full School Board at their next meeting.

Mayor Bonrud reported on Riverside Park Days and how successful the event was. The Mayor also discussed the Special FDC meeting scheduled for Tuesday at 4:00 p.m. regarding the Flandreau Locker. City Attorney Paul Lewis discussed the rezone process and what a TIF can be used for.

The City Administrator reported that the last day for the Aquatic Center will be August 20th. The City received a grant again this year for mosquito spraying from the State Department of Health for just under $2,000. Land surveyors were here last week surveying for the two new businesses looking to get established in the Industrial Park.

City Administrator asked Council about having a budget work session meeting on Tuesday, August 22nd at 5:15 p.m. (Later in the meeting, Council members indicated there was a conflict on the 22nd and the meeting was scheduled for Monday, August 28th at 5:15 p.m.)

Motion carried. Second reading of Ordinance 579, Amending Title 10 Cemetery, was conducted. City Attorney Paul Lewis presented two versions of Ordinance 579 for Council’s consideration. Version “A” changed the timeframe that a gravesite would be considered abandoned from twenty (20) to eighty (80) years. In Version “B”, should a party inquire about a vacant site’s availability, it would need to be determined whether to consider it abandoned before it could then be purchased; there would have to have been no contact with the owner in at least sixty (60) years. Council opted to adopt Version “B”. Motion by Pesall and seconded by Smith to approve Ordinance 579, Amending Title 10 Cemetery (Version B). Summary: This fulltime position is located at The Flandreau Santee Sioux Tribal Health Clinic in Flandreau, SD. The purpose of this position is to work in a hybrid (paper/electronic) medical record environment, alternating between abstracting and coding pertinent outpatient medical data from the Electronic Health Record (EHR/EMR) into the Resource Patient Management billing system and analyzing medical data entered by the clinician in the Electronic Health Record (EHR). Duties include: Performs comprehensive review of the record to assure the presence of all component parts, such as: correct name, health record number, signatures and dates where required, and all reports which appear to be indicated by the treatment rendered; Evaluates the record for documentation, consistency, accuracy and correlation of recorded data, such as medical necessity and modifier usage; Ensures the final diagnosis as stated by the physician is valid, complete and accurately reflects the care and treatment rendered; Analyzes provider documentation to assure the appropriate Evaluation and Management (E&M) levels are assigned using the correct CPT codes and applicable modifiers; Assures diagnostic and procedural terminology used is consistent with currently acceptable medical nomenclature. Facility Worker

Dakota State University is seeking applications for a full-time Facility Worker.

This position will work the 4am – 12:30 pm shift, Monday through Friday.

Primary responsibilities include custodial care for general cleaning and minor maintenance for buildings on the DSU campus. Duties will include floor care consisting of vacuuming, shampooing carpets, scrubbing, mopping, waxing and polishing floors. This position will also clean and sanitize restrooms, dust and wash walls, woodwork and windows, collect and remove trash from buildings, remove snow from steps and sidewalks during winter and perform minor maintenance functions as needed. Additional responsibilities will include some painting, moving furniture and checking equipment as necessary.

The successful applicant must be able to follow written and oral instructions, operate required equipment, work with students, staff, and the public courteously, work independently, lift up to 50 pounds regularly and maintain a valid driver’s license.
