PUBLIC NOTICE GARBAGE COLLECTION Garbage collection within the City of Flandreau is contracted to Eng Services. Under the terms of the contract, Eng Services collects all garbage and household refuse from all single-family and multiple-family residences, including mobile homes, within the corporate limits of the City of Flandreau. The monthly charge will provide for the collection and disposal of contents of not more than three containers (not less than ten gallons and not more than 30 gallons) for each domestic unit. Garbage shall mean and include every accumulation of animal, vegetable or other matter that attends the preparation, consumption, display, use or storage of organic matter, including the can, container or wrapper wasted along with such matter. Household refuse shall mean and include such items as garbage, sweeping, cleanings, trash, litter and domestic solid waste. Household refuse shall not include any household hazardous waste, as defined by any state or federal regulation. Eng Services and other businesses will also collect yard debris for an additional charge to be negotiated between the contractor and the party involved. This additional service is at the option of the user of those services. Yard debris shall include such items as grass lawn clippings and leaves. Other refuse and debris, such as appliances, tires, furniture, etc. may be disposed of for a fee. Please contract Eng Services or other contractors providing such service to make individual arrangements. The City of Flandreau Restricted Use Landfill Site is also open. PUBLIC NOTICE

In accordance with Title 5 – Public and Private Nuisances:

Property owners must remove noxious weeds and unhealthful vegetation from the property within a reasonable time after the growth of the vegetation on any property within the City of Flandreau. (Chapter 5.3) Notice is hereby given to property owners whose property within said City on which the height of the grass and/or weeds has exceeded the height of six (6) inches and that any grass or weeds that exceed said height shall be removed within forty-eight hours. The notice need not be given personally but may be given generally through the official newspaper annually. The published notice shall constitute notice as required by this Section. (Chapter 5.4) If the owner or person in possession of property fails to abate the nuisance within the time specified, the City may take remedial action to abate the nuisance and to charge the cost thereof against the abated property. A separate charge will be incurred each time this action is initiated. (Chapter 5.4) Exception. Property owners with parcels of land that exceed one (1) acre in size may petition the City Council for relief from the requirements of this Chapter. The Council may approve or disapprove the petition and establish other criteria that must be complied with. If the exception is approved, minimum upkeep standards shall require 1) the property, including boulevards, must be mowed at least twice a year, and 2) the control of noxious weeds. The City Administrator stated that the bid specs for the water and sewer improvements will be in tomorrow’s newspaper. Planning and Zoning met last week and approved a conditional use permit for Dave Feske. Airport engineers are waiting for approval from the FAA regarding plans to build a new hangar at the Flandreau Airport. One of the lots at Southview Heights has been sold. Mid-American Energy will soon be installing the gas main in Southview Heights. The Boys and Girls Club gymnasium is finished and they will be holding an open house April 27th. Also, the City Administrator briefly discussed the 2016 Summer Recreation Schedule that was distributed in the council packet. Motion by Sutton and seconded by Smith to approve the Administrative Reports. The following members voted aye: Bjerke, Pesall, Sample, Smith, Sutton, and Tufty. Nays: None. Absent: None. Motion carried. Old Business: None. New Business: At the request of Alderman Pesall, making council packets available to the public was discussed. All agreed to have the council packet placed on the City’s website before each council meeting for public inspection. Motion by Pesall and seconded by Sample to adopt an employee recognition policy to acknowledge employees who go above and beyond their normal job duties. ATTENTION COLMAN TOWNSHIP RESIDENTS The Colman Township Board of Supervisors want you to know it is against the law SDCL 31-32-7 to farm the right of way on township roads. Doing so creates a liability for the township, the landowner & the person doing the farming if it is someone other than the landowner. Therefore if anyone in Colman Township does farm the right of way, the board of supervisors have the right to destroy the crop and restore the road to it’s original condition and send you the bill. There have already been court cases on this issue and the court has ruled in favor of the township. Along that same line, South Dakota Codified Law says it is the landowner’s responsibility to remove weeds, trees, and brush, 31-31-2 or the township can have this done and assess it to your property taxes. SDCL 31-32-3.1 states that it is against the law to dump any material or cargo in the right of way and that includes rocks and other debris. Please help us to keep our township roads in good shape and make them safe for the motoring public. Doing so will mean we will have to spend less tax dollars dealing with violations of these sections of code.

Motion by Miles, seconded by Ehrichs to remove the April 5, 2016 minutes from the consent agenda with all voting “aye”. Bart Bauske, Booster Ad Agency, met with the Board to discuss Moody County Advertising with the Booster. Motion by Jones, seconded by Veldkamp to accept the Booster rate of $2.22 per column inch through the budget year. All voted “aye”. Motion by Veldkamp, seconded by Ehrichs to conduct business as Board of Equalization at 1:01 PM. All voted “aye”. The Commissioners signed oaths as Equalization members. Motion by Jones, seconded by Miles to approve the DOE to make any changes due to discretionary reduction, veteran exemption, renewable resource credit, local industrial development per SDCL 10-4-8.1, and Local Board changes. Motion by Jones, seconded by Miles to approve the property tax exempt status application including parcel 21.50.27.36. All voted “aye”. Skroch presented the General Fund Cash Surplus Analysis as of March 31, 2016 as required by the Department of Legislative Audit. Skroch reported the total unreserved, undesignated fund balance of the General Fund as of March 31, 2016 was 2,005,203.86. This represents 47.66% of the total appropriations for ¼ of the current year’s annual budget plus the subsequent year’s annual budget.
