Visitors to Be Heard: Attorney Patrick Glover, from Meierhenry Sargent, representing Bill and Lori Sutton, spoke to the Council about the Industrial Road Development. Glover expressed 2 concerns with the new development, stating the building in construction could potentially be in the right of way. Glover also expressed concerns about a condition set by the Planning and Zoning Board in June. Glover wanted to bring these issues to the Council’s attention, no action was taken. Mayor Dan Sutton told the Council that the Moody County Museum is in the planning stages of an expansion project, thanks to a generous donation. Sutton stated the planning committee has reached out to South Dakota State University for assistance in planning the space. More information will be coming as this project develops. City Administrator Cohl Turnquist reported there has been substantial progress at the new Fire Station. Turnquist informed Council about some upcoming Change Order Requests, dealing with the flooring in the kitchen and the meeting room. The completion date for the Fire Station is tentatively scheduled for mid-late February. Turnquist stated he had spoke to Todd Kayes from First District about working with the City and the Planning and Zoning Committee to start updating the City’s zoning ordinances. Turnquist was contacted by the Flandreau Public School requesting an unpaid internship opportunity for a high school junior. Sales Tax Revenue is slightly down from 2022, but the City is expected to meet what was projected in the 2023 Appropriation. The Council can expect to see a Resolution in January, which will address the electric rate increase, that is proposed to be a 5% increase in 3-step phases. Turnquist reported the Boys and Girls Club recently learned they were the recipients of a $50,000 Planning Grant, with the opportunity for a $500,000 Implementation Grant. Turnquist said the Boys and Girls Club is looking at addressing the child-care need in Flandreau. The Club is looking at different options in town for a child-care facility. Motion by Fargen and seconded by Tufty to approve the Administrator’s Reports. The following members voted aye: Ahlers, Bjerke, Fargen, Tufty and Yeaton (Via Phone). Nays: None. Absent: Ekern. Motion carried. Old Business: Second Reading of Ordinance No. 616, the 2023 Supplemental Appropriation Ordinance was held. A total of $938,555 will be used to supplement the 2023 Appropriation. The supplemental funds consist of allocated reserve transfers for projects including the Fire Station, Elevator Demolition, Crescent Street Bridge Demolition, Community Center Floor, and retirement of Sales Tax Revenue Bond. Additional funds also needed for professional fees and utilities costs. Motion by Bjerke and seconded by Ahlers to approve Ordinance No. 616. 2023 Supplemental Appropriation Ordinance. The following members voted aye: Ahlers, Bjerke, Fargen, Tufty and Yeaton (Via Phone). Nays: None. Absent: Ekern. Motion carried. New Business: April Buller, from IMEG Engineering, spoke to the Council about the Flandreau Utility Improvement Project. Topics Buller addressed with the Council included construction testing; temporary set-ups for mailboxes, garbage pick up and bus routes; type of asphalt used for the project; impact of the project on trees; and public meetings. Final plans for the water and sewer improvement project will be submitted to DANR at the beginning of 2024. Motion by Tufty and seconded by Ahlers to approve the Inspection Agreement with Dakota Pump and Control to perform annual inspections of the four City lift stations. The following members voted aye: Ahlers, Bjerke, Fargen, Tufty and Yeaton (Via Phone). Nays: None. Absent: Ekern. Motion carried. Motion by Fargen and seconded by Ahlers to approve the Step Increase for Police Officer Trey Andrews, placing him at Step 4 of the Certified Police Office Wage Scale at $24.80/hourly. The First Reading of Ordinance No. 617, Restaurant Liquor Licensing Provisions and Issuance Procedures was held. The second reading of Ordinance No. 617 will be held on January 2nd, 2024 at the next regular Council meeting. Motion by Fargen and seconded by Bjerke to approve Change Order Request No. 1 for Additional Fire Alarm Notification Devices for the Fire Station at the cost of $175.71. Wayne Fanebust, now retired and living in Sioux Falls, has authored eleven non-fiction books about local, state and regional history. He was born in Sioux Falls, graduated from Washington High School, served in the U. S. Marine Corps, attended college in California, has a degree in history, and a law degree. He practiced law in San Diago for thirteen years before moving back to Sioux Falls where he served as corporate counsel until retiring. Fanebust’s most recent book, No Justice for Agnes, published in 2020, examines the tragic and mysterious death of Agnes Polreis in 1906 while serving as an immigrant servant girl in the home of Emma Kaufmann and her husband, a wealthy businessman from Sioux Falls. The venue of Mrs. Kaufmann’s trial was moved to Flandreau. Dr. Spafford of Flandreau was called as an expert witness. Local attorney George Rice was hired as one of the defense attorneys. Eleven members of the jury were Moody County farmers. Hundreds of people flocked to Flandreau filling its hotels, boarding houses, and private rooms in homes willing to host guests. The repulsive manner of death, outrageous attorney antics, and other aspects of the case generated sensational newspaper coverage from coast to coast. THE GENERAL PUBLIC is invited to hear Mr. Fanebust talk about his book on one of the most notorious South Dakota criminal cases of the time. The annual meeting will be held on January 14th at 1pm at Our Savior’s Lutheran Church in Flandreau.

EGAN CITY MINUTES December 20, 2023 The Board of Trustees of the City of Egan, South Dakota met in regular session on December 20, 2023 at Egan City Hall, 110 W 3rd Street, Egan, SD. Present: Board of Trustee members Cody Chamblin, Dana Walters, and Jerome Olson. Board member Nancy Hansen absent. Also present: John Steinhauer, Amanda Walters, Barb Warborg, Dan Warborg, LeAnne Larson, Michelle TenEyck, Lori Voneye and Harvey Donley. Meeting was called to order by Chairman Chamblin. Motion by Olson, second by Chamblin to approve the agenda. All present voted “aye.” Motion by Olson, second by Chamblin to approve the minutes of November 15, 2023. All present voted “aye.” Public Comment: • John Steinhauer - concerns about the new softball fence. Access is insufficient for players, also concerned about fence being tall enough to stop foul balls. He provided access measurements of Flandreau’s field. Chairman Chamblin will take pictures and contact RW Fencing to go over concerns. Final payment will not be issued until concerns have been resolved. Michelle TenEyck asked if it is required to be ADA compliant. The Finance Office will connect with the state about requirements. The city will also have to ensure that teams playing either carry insurance or have a signed waiver on file with the city office. Zoning: Jason Gierke is asking if his home can become a multi-family dwelling. The board prefers Jason come to a city meeting (was previously asked to attend) to outline his plan for the dwelling. The board is concerned with water/sewer impact. It has been recognized there is potentially an un-permitted building on the property. Normal session resumed. Old Business: • Purchasing update – Board reviewed the initial change to the purchasing policy. The board will continue working on the policy with the expectation to finalize at January meeting. • Website update – Content from old website now migrated to new website. Not all content was not transferred due to cost. All Agendas, Meeting Minutes, Ordinances, Resolutions and Budgets not migrated will be available to all residents. Copies will not be made of said information. New Business: • Lori VonEye discussed the current living status of Hermine Keith. VonEye explained that it is a temporary situation. Keith does not want to change zoning to Residential because it is a temporary situation. Motion was made by Walters, second by Chamblin to allow for a variance. All present voted “aye”. Keith will work with the city office on completing it. • Resolution 2023-04 Contingency transfer. Motion by Olson, second by Chamblin to approve. All present voted “aye” • 1st reading of Ordinance 227 Noise and Braking read. Motion by Chamblin, second by Walters to approve. We are looking for a Surveillance Officer to undertake the surveillance of our premises and protection of our staff and visitors. This position will be responsible for detecting any suspicious behavior and preventing vandalism, thefts or other criminal behavior, maintaining strict surveillance and access controls, and ensures regulatory compliance. The surveillance officer must be well trained in surveillance and dealing with perpetrators. The goal is to help the Cannabis Control Commissioners in maintaining excellent working conditions by keeping our facilities safe and problem free. Must be 21 to Apply. Must past background check.
