Motion by Miles, seconded by Veldkamp to approve the following resolution with all voting “aye”: RESOLUTION 17112101 RESOLUTION TO NAME INTERSTATE HIGHWAY BRIDGE AFTER MOODY COUNTY DEPUTY SHERIFF WILLIAM PAUL DAVIS WHEREAS, on November 3, 2003, Moody County Sheriff’s Department Deputy William Paul Davis was dispatched to an automobile accident on Interstate 29 at the Sioux River Bridge; and WHEREAS, upon arrival at the scene, Deputy Davis rendered assistance to the parties involved in the accident, and would eventually attempt to arrest one of the drivers for refusing to sign a citation; and WHEREAS, while Deputy Davis was outside of his patrol vehicle and attempting to arrest one of the drivers, an approaching vehicle lost control on the ice, slid, and struck Deputy William Paul Davis, tragically ending his twenty-two years of service to the people of Moody County, South Dakota; and WHEREAS, the Moody County Commission, on behalf of the people of Moody County, South Dakota, feels it is right and proper for Deputy William Paul Davis’ noble commitment to be properly memorialized.

THEREFORE, BE IT RESOLVED, by the Moody County Board of Officials that it hereby endorses and unanimously supports the naming of an Interstate 29 bridge here in Moody County, South Dakota, after Deputy William Paul Davis.

Missouri River Energy Services regarding an economic development tool that will soon be available for discount electric rates for newly constructed industrial and retail businesses. He informed Council that he and the Mayor met with a consultant from Barr Engineering Co. regarding the Flandreau Dam Study. The total cost of the study will be $47,500 with Flandreau’s share being $12,500.

Finally, he stated that he received a letter from the state approving Flandreau for a Disaster Mitigation Grant. The next step is approval from FEMA. Motion by Smith and seconded by Tufty to approve the Administrative Reports. The following members voted aye: Sample, Smith, Sutton, and Tufty. Nays: None.

Old Business: Second reading of Ordinance No. 583, An Ordinance That Amends Existing Title 12 Zoning Ordinance, was held. A motion was made by Smith and seconded by Tufty to adopt Ordinance 583. The following members voted aye: Sample, Smith, Sutton, and Tufty.

SUMMARY OF FLANDREAU, SOUTH DAKOTA CITY ORDINANCE, TITLE 13, TRAFFIC CODE; CHAPTER 13.7 SNOWMOBILE OPERATIONS No snowmobile shall be operated with the City unless it is registered and identification numbers are displayed as required.

No person may operate a snowmobile on a city street: • At a rate of speed greater than is reasonable having due regard for conditions and in no event in excess of 20 mph • While under the influence of liquor or drugs • Except while proceeding to and returning from the city limits by the most direct route from his home or place where said snowmobile is garaged • In any cemetery • On private property without the consent of the property owner or his agent • With more than one (1) passenger on a snowmobile Any person operating a snowmobile on a city street must: • Come to a complete stop at all traffic controlled intersections • Travel as close to the right edge of the plowed area of the street as practical • Obey all traffic signals, signs and devices • Yield the right-of-way to all-vehicular traffic and pedestrians No snowmobile shall be operated to cross any street except at a street intersection of a street.

No person shall operate a snowmobile in the City of Flandreau in a careless or negligent manner likely to endanger any person or property.

No person shall operate a snowmobile upon any public sidewalk.

No person operating a snowmobile shall tow any person or object behind except when such person or object is situated upon a conveyance that is attached by means of rigid hitch or tow bar.

No snowmobile shall be operated in the City unless it has at least one (1) headlight and one (1) taillight turned on at all times during operation; adequate brakes; and is equipped with a muffler in good working order in constant operation to prevent excessive or unusual noise.

The operator of a snowmobile involved in an accident resulting in injuries to or death of any person or property damage in an estimated amount of $100.00 or more must report the accident to Law Enforcement Personnel.

It is presumed that any snowmobile operated within the City is operated with the consent of the owner. The owner of the snowmobile will be held jointly and severally liable with the driver thereof for damages arising out of the negligent or improper operation of his snowmobile.

The owner of a snowmobile may be held jointly and severally liable to a property owner for three (3) times the amount of damages to trees, shrubs, landscaping, or personal property occurring on private property and caused by said snowmobile where the snowmobile is operated without the consent of the property owner or agent.

Law Enforcement Personnel may confiscate any machine, which is operated contrary to or in violation of any provisions of this ordinance.

Any person who violates the provisions of this ordinance is guilty of a misdemeanor and is punishable according to the general provision of this ordinance.

The above information is a summary of the Title 13, Chapter 13.7 SNOWMOBILE OPERATION. A copy of the entire Snowmobile Ordinance may be obtained at the Flandreau City Office during normal business hours or by going to www.cityofflandreau.com.

PUBLIC NOTICE EMERGENCY SNOW REMOVAL

There shall be no parking on the streets named below from 2:00 a.m. to 6:00 a.m. on any day of the week where there has been an accumulation of two (2) inches or more of snow within a 24-hour period, to facilitate snow removal operations. Said streets shall be posted accordingly: Center Street - From First Avenue to Pipestone Avenue Prairie Street - From First Avenue to Pipestone Avenue Crescent Street - From First Avenue to Third Avenue Wind Street - From First Avenue to Third Avenue Third Avenue - From Wind Street to Crescent Street Pipestone Avenue - From Industrial Road to Summit Street (Hwy 13) Second Avenue - From Center Street to Prairie Street Wilson Street - From Third Avenue to First Avenue In addition to penalties provided for by the general penalty provisions Title 13 - Traffic Code, violators' vehicles may be towed and the owner thereof shall be required to pay the reasonable charges therefor plus storage at a reasonable daily rate.

SUMMARY OF FLANDREAU CITY ORDINANCE TITLE 5, ARTICLES 5.3.1.p. AND 5.4.2.2., SNOW AND ICE REMOVAL The City shall notify all owners or persons in possession of property abutting on sidewalks to keep such sidewalks free from snow and ice and to remove the same within 72 hours after every fall or accumulation of snow or ice. The notice need not be given personally but may be given generally through the official newspaper annually.

The owner or person in possession of any property abutting on any sidewalk shall keep such sidewalk free from snow and ice and shall remove any snow and ice from the sidewalks within seventy-two (72) hours after the termination of any snow fall, snow or ice accumulation.

The owner or person in possession of any property abutting upon any sidewalk that ends at an intersection or crosswalk shall maintain the sidewalk free from snow and ice to the edge of the street and will also clear any snow and ice deposited on the sidewalk during the street removal process.

Those sidewalks not cleared of said snow and ice within seventy-two (72) hours will be considered a public nuisance. The City may cause said snow and ice to be cleared from those sidewalks in violation of said Ordinance and will bill those costs to the property owner.
