COUNCIL PROCEEDINGS NOVEMBER 6, 2017

The City Council of the City of Flandreau, South Dakota, met in regular session on Monday, November 6th, 2017 at 6:30 p.m. at the City Council Chambers, 1005 W. Elm Avenue, Flandreau, SD. Present: Mayor Mark Bonrud (7:14 p.m.). Aldermen: Brad Bjerke, Bob Pesall, Ron Smith, Bart Sample, and Karen Tufty. Absent: Alderman Dan Sutton. Also present were Donald Whitman, City of Flandreau; Paul Lewis, City Attorney; Don Ulwelling, Bruce Clark, and Brian Bergjord, Planning & Zoning Commission; Francisco Juarez and Federico Amaya, Kiko’s Mexican Restaurant; Pam and David Lillibridge, Linda Janis, Gordon E. Jones, Jr., Wendy Streitz, Albert Moore, Maridee Toates, Terry Albers and Kelley Ramsdell, Zoning Public Hearings; and Brenda Wade Schmidt, Moody County Enterprise. In the absence of both the Mayor and Council President, the meeting was led by Council Vice-President Brad Bjerke. The proposed agenda was reviewed. Motion by Sample and seconded by Smith to adopt the proposed agenda. The following members voted aye: Bjerke, Pesall, Sample, Smith, and Tufty. Nays: None. Absent: Sutton. Motion carried. The City Administrator introduced the owners of Kiko’s Mexican Restaurant. A joint public hearing was held by City Planning and Zoning Commission and City Council on zoning text amendments and rezoning a vacant lot east of Tractor Supply Company on Pipestone Avenue. A public hearing on zoning text amendments that would allow a parish house along with a church as a conditional use in the HC zoning district and add a definition of parish house to the zoning ordinance was held. There was little public input. Motion by Bergjord and seconded by Clark to recommend approval to Council. The following members voted aye: Bergjord, Clark, and Ulwelling. Nays: None. Absent: Olinger and Rose. Motion carried. A public hearing on rezoning land east of Tractor Supply Company on Pipestone Avenue from R-1 to HC was held. There was a lot of public input. Some spoke in favor and some spoke against the zone change. Motion by Clark and seconded by Bergjord to recommend approval of the zone change to Council with the stipulation that the Flandreau Development Corporation and the business that ends up on this lot work with the neighbors to address their concerns. The following members voted aye: Bergjord, Clark, and Ulwelling. Nays: None. Absent: Olinger and Rose. Motion carried. He also noted that there will be a progress meeting on November 15 with the engineers and contractor on the 1st Avenue water and wastewater line replacement project. Finally, the City Administrator reported that he attended the annual Missouri River Energy Services district meeting in Sioux Falls the previous Friday. Brief Summary: This fulltime position is responsible for providing specialized nursing services in the area that may include school based healthcare, women's health care, family planning, and primary care; does related work as required. Considerable medical judgment is required to determine the appropriate procedure within scope of practice. The Nurse Practitioner requires an advanced level of competency in nursing through additional education or training as well as a Nurse Practitioner's license and prescriptive privileges. Work is performed under the general supervision of the Medical Director (Doctor of Medicine), when available, and the Health Care Administrator who review work routinely. The Nurse Practitioner is responsible for providing guidance to the Director of Nursing, Registered Nurses, Certified Nursing Assistants and Medical Assistants Qualifications & Requirements: Thorough knowledge of nursing techniques and procedures; medical and lab equipment and testing procedures; medication; Considerable knowledge of interviewing and counseling techniques. Ability to work independently; communicate effectively both verbally and in writing; deal tactfully and patiently with clients; establish and maintain records, reports and statistical data; use initiative and judgment; maintain effective working relationships with other related agencies; professionals and citizen groups; perform and record total physical examination; obtain vaginal, cervical, urethral and rectal cultures, papanicolaou smears, and other laboratory specimens appropriate. Skill in diagnostic procedures for diseases and the drug therapy needed for treatment of these medical conditions. Must be proficient in the use of medical and laboratory equipment. SUMMARY OF FLANDREAU, SOUTH DAKOTA CITY ORDINANCE, TITLE 13, TRAFFIC CODE; CHAPTER 13.7 SNOWMOBILE OPERATIONS No snowmobile shall be operated with the City unless it is registered and identification numbers are displayed as required. No person may operate a snowmobile on a city street: • At a rate of speed greater than is reasonable having due regard for conditions and in no event in excess of 20 mph • While under the influence of liquor or drugs • Except while proceeding to and returning from the city limits by the most direct route from his home or place where said snowmobile is garaged • In any cemetery • On private property without the consent of the property owner or his agent • With more than one (1) passenger on a snowmobile Any person operating a snowmobile on a city street must: • Come to a complete stop at all traffic controlled intersections • Travel as close to the right edge of the plowed area of the street as practical • Obey all traffic signals, signs and devices • Yield the right-of-way to all-vehicular traffic and pedestrians No snowmobile shall be operated to cross any street except at a street intersection of a street. No person shall operate a snowmobile in the City of Flandreau in a careless or negligent manner likely to endanger any person or property. No person shall operate a snowmobile upon any public sidewalk. No person operating a snowmobile shall tow any person or object behind except when such person or object is situated upon a conveyance that is attached by means of rigid hitch or tow bar. No snowmobile shall be operated in the City unless it has at least one (1) headlight and one (1) taillight turned on at all times during operation; adequate brakes; and is equipped with a muffler in good working order in constant operation to prevent excessive or unusual noise. The operator of a snowmobile involved in an accident resulting in injuries to or death of any person or property damage in an estimated amount of $100.00 or more must report the accident to Law Enforcement Personnel. It is presumed that any snowmobile operated within the City is operated with the consent of the owner. The owner of the snowmobile will be held jointly and severally liable with the driver thereof for damages arising out of the negligent or improper operation of his snowmobile. The owner of a snowmobile may be held jointly and severally liable to a property owner for three (3) times the amount of damages to trees, shrubs, landscaping, or personal property occurring on private property and caused by said snowmobile where the snowmobile is operated without the consent of the property owner or agent. Law Enforcement Personnel may confiscate any machine, which is operated contrary to or in violation of any provisions of this ordinance. Any person who violates the provisions of this ordinance is guilty of a misdemeanor and is punishable according to the general provision of this ordinance. The above information is a summary of the Title 13, Chapter 13.7 SNOWMOBILE OPERATION. SUMMARY OF FLANDREAU CITY ORDINANCE TITLE 5, ARTICLES 5.3.1.p. AND 5.4.2.2., SNOW AND ICE REMOVAL The City shall notify all owners or persons in possession of property abutting on sidewalks to keep such sidewalks free from snow and ice and to remove the same within 72 hours after every fall or accumulation of snow or ice. The notice need not be given personally but may be given generally through the official newspaper annually. The owner or person in possession of any property abutting on any sidewalk shall keep such sidewalk free from snow and ice and shall remove any snow and ice from the sidewalks within seventy-two (72) hours after the termination of any snow fall, snow or ice accumulation. The owner or person in possession of any property abutting upon any sidewalk that ends at an intersection or crosswalk shall maintain the sidewalk free from snow and ice to the edge of the street and will also clear any snow and ice deposited on the sidewalk during the street removal process. Those sidewalks not cleared of said snow and ice within seventy-two (72) hours will be considered a public nuisance. The City may cause said snow and ice to be cleared from those sidewalks in violation of said Ordinance and will bill those costs to the property owner.
