COUNCIL PROCEEDINGS August 1, 2022 The City Council of the City of Flandreau, South Dakota, met in regular session on Monday, August 1st at 6:30 p.m. at the City Council Chambers, 1005 W. None Mayor Sutton informed Council of Riverside Park Days, which will be held at the City Park on Aug 6-7. Sutton encourages residents to attend this event and support the vendors. The Mayor reported that there is some progress in the City with property owners with Code Enforcement violations, but fines could be assessed to property owners who aren’t following the Code enforcement. City Administrator Cohl Turnquist informed Council of an upcoming new event at the Flandreau Aquatic Center called “Dog Swim Day.” Turnquist and pool manager Blake Savey have been working together to plan this fundraising event. Residents can bring their dogs to the Aquatic Center on August 19th from 4-6 to swim in the pool. Cost is $5 per dog, with proceeds benefiting the Sioux Falls Humane Society. Turnquist also reported that he has been working with the City’s architect on changing some of the language on the RDA contract for the Fire Station loan. Logan Gran, with DOT Transportation Alternative, met with Turnquist and FDC members on the bike path project and was pleased with the proposed improvement plan. Administrator Turnquist reported to Council that he has been working with the City’s insurance company on securing funding to replace the Fire Hall roof, which was damaged in the May 12th storm. Turnquist also reported that Shane Waterman, with IMEG, stated that Lagoon Cell #1 has no damage to the line and that the city should be able to reshape and reseed the lagoon to make the necessary improvements. Motion by Ahlers and seconded by Fargen to approve the Administrative Reports. The following members voted aye: Ahlers, Bjerke, Ekern, Fargen, Tufty and Yeaton. Nays: None. Absent: None. Motion carried. Old Business: None New Business: Motion by Fargen and seconded by Ekern to approve the 2023 Pictometry Agreement with Moody County, which has a term of 6 years at $4,000 annually to be budgeted out of the General Fund. The following members voted aye: Ahlers, Bjerke, Ekern, Fargen, Tufty and Yeaton. Nays: None. Absent: None. Motion carried. The City is entering a codification agreement with American Legal Publishing Corporation for a formal recodification process of the current Code of Ordinances. This has not been done in decades. $7,750.00 is the fee, with 40% to be paid in the current fiscal year, 40% paid when legal review and drafts are received, and the remaining balance will be paid after the books are delivered and an online code link is provided. Motion by Yeaton and seconded by Bjerke to approve the Codification agreement with American Legal Publishing Corporation for $7,750.00. The following members voted aye: Ahlers, Bjerke, Ekern, Fargen, Tufty and Yeaton. Nays: None. Absent: None. Motion carried. As part of the process for securing funding for the fire station construction project, the Rural Development Administration requires the City to adopt a loan resolution. The amount of financing for the fire station provided by Rural Development Administration is $775,000. A similar amount will be borrowed from First Savings Bank, which will also be secured by the issuance of sales tax bonds. Motion by Bjerke and seconded by Ekern to adopt Resolution 2022-09, which is the Fire Station Loan Resolution. The following members voted aye: Ahlers, Bjerke, Ekern, Fargen, Tufty and Yeaton. Nays: None. Absent: None. Motion carried. Motion by Yeaton and seconded by Ahlers to go into executive session for a legal matter at 6:49 p.m. The following members voted aye: Ahlers, Bjerke, Ekern, Fargen, Tufty and Yeaton. Nays: None. Nays: None. Absent: None. Motion carried. After exiting executive session, there was a motion by Ahlers and seconded by Fargen to take the Moody County Dispatching agreement off the table. Motion by Ahlers and seconded by Ekern to accept the 2023 Moody County Dispatch agreement for $64,012. The Water Quality Specialist will monitor surface and ground water for biological, physical and chemical parameters to determine water quality.
