PUBLIC NOTICE GARBAGE COLLECTION Garbage collection within the City of Flandreau is contracted to Eng Services. Under the terms of the contract, Eng Services collects all garbage and household refuse from all single-family and multiple-family residences, including mobile homes, within the corporate limits of the City of Flandreau. The monthly charge will provide for the collection and disposal of contents of not more than three containers (not less than ten gallons and not more than 30 gallons) for each domestic unit. Garbage shall mean and include every accumulation of animal, vegetable or other matter that attends the preparation, consumption, display, use or storage of organic matter, including the can, container or wrapper wasted along with such matter. Household refuse shall mean and include such items as garbage, sweeping, cleanings, trash, litter and domestic solid waste. Household refuse shall not include any household hazardous waste, as defined by any state or federal regulation. Eng Services and other businesses will also collect yard debris for an additional charge to be negotiated between the contractor and the party involved. This additional service is at the option of the user of those services. Yard debris shall include such items as grass lawn clippings and leaves. Other refuse and debris, such as appliances, tires, furniture, etc. may be disposed of for a fee. Please contract Eng Services or other contractors providing such service to make individual arrangements. The City of Flandreau Restricted Use Landfill Site is also open. Hours of operation are Wednesday – 3:00 p.m. to 7:00 p.m. and Saturday – 9:00 a.m. to 5:00 p.m. Questions concerning routes, schedules and disposal of material not covered in the contract, should be directed to Eng Services at 997-5551.

14.3.7.1 The City will herein be responsible for the maintenance, trimming, and care of all park and street trees. 14.3.7.2 The landowner will be responsible for the maintenance, trimming, and care of all private trees situated upon their property, but said maintenance, trimming,and care shall be subject to City requirements regarding pest control or trimming when such actions are necessary to prevent hazards to life and property. 14.3.7.3 Overhanging Branches Every owner of a tree which overhangs any sidewalk within the City shall trim such tree to a minimum of ten feet (10’) above the surface of the sidewalk. Every owner of a tree which overhangs any municipal arterial street or right-of-way within the City shall trim such tree to a minimum of twelve feet (12’) above the surface of the street or right-of way. Every owner of a tree which overhangs any county road or portion of the state trunk highway within the City shall trim such tree to a minimum of sixteen feet (16’) above the surface of the county road or state highway. FLANDREAU CITY ORDINANCES REQUIRE THAT ALL DOGS OR ANIMALS OF THE DOG KIND, AND CATS ARE: To be licensed (Chapter 6.3). Licenses may be purchased at the City Office located at 1005 W. Elm Avenue. Not allowed to run at large (Chapter 6.2) Not allowed to disturb the peace and quiet of the neighborhood or to become a Public Nuisance by destroying or defacing property or causing injury to persons or domestic animals (Chapter 5.3) Not allowed to defecate on public or private property other than on the property of their owners. In accordance with Title 5 – Public and Private Nuisances: Property owners must remove noxious weeds and unhealthful vegetation from the property within a reasonable time after the growth of the vegetation on any property within the City of Flandreau. (Chapter 5.3) Notice is hereby given to property owners whose property within said City on which the height of the grass and/or weeds has exceeded the height of six (6) inches and that any grass or weeds that exceed said height shall be removed within forty-eight hours. The notice need not be given personally but may be given generally through the official newspaper annually. The published notice shall constitute notice as required by this Section. (Chapter 5.4) If the owner or person in possession of property fails to abate the nuisance within the time specified, the City may take remedial action to abate the nuisance and to charge the cost thereof against the abated property. A separate charge will be incurred each time this action is initiated. (Chapter 5.4) Exception. Property owners with parcels of land that exceed one (1) acre in size may petition the City Council for relief from the requirements of this Chapter. The Council may approve or disapprove the petition and establish other criteria that must be complied with. If the exception is approved, minimum upkeep standards shall require 1) the property, including boulevards, must be mowed at least twice a year, and 2) the control of noxious weeds. CITY OF EGAN AND CITY OF FLANDREAU CHLORAMINES AND FISH
A Change in Big Sioux’s water treatment will affect your aquarium treatment procedures. Since the City of Egan and City of Flandreau purchases its water from Big Sioux, this change affects Egan and Flandreau residents. In the past the drinking water produced by Big Sioux Community Water was disinfected by using free chlorine. In the very near future the disinfectant will be changed to chloramines. Although chloramines help to make your water safe to drink, they are toxic to fish, reptiles and amphibians. Chloramines must be removed from the water these animals live in. Unlike free chlorine, chloramines do not dissipate rapidly from water, so you will need to take extra steps to remove them. Here are some facts you should know: What are chloramines? Chloramines are another form of disinfectant which is used to kill potentially harmful bacteria in water. Chloramines are a combination of chlorine and ammonia and both can be toxic to fish and amphibians. Why are chloramines toxic to fish? Chloramines are a combination of chlorine and ammonia, both of which are toxic to fish. When people, animals or birds swallow water that contains chloramines, the chlorine and ammonia is neutralized by the digestive system before it reaches the blood stream. Fish and other marine life, however, don’t just swallow water – they breathe it. When the water contains chloramines, these substances enter directly into the blood stream and chemically bind to iron in the red blood cells, which makes it difficult for those cells to carry oxygen. Eventually, fish may “suffocate” from lack of oxygen. Are chloramines toxic to both saltwater and freshwater fish? Yes. Chloramines affect saltwater fish in the same way that they affect freshwater fish. How can I remove chloramines from the water? As chloramines break down, either naturally or through the use of dechlorination chemicals, ammonia is released. This ammonia must be removed from the water in the fish tanks or ponds prior to coming into contact with the fish or amphibians. Ammonia may be removed by specific agents to remove chloramines and ammonia, natural zeolites or a high grade granular activated carbon filter. Contact your local pet store to determine the best method for removing chloramines in your situation. Will letting water sit for a few days cause chloramines to disappear? No. Unlike free chlorine, which dissipates when water sits for a day or two, chloramines may take weeks to disappear. Do chloramines have to be removed if only a small amount of water is added to an aquarium or pond to make up for evaporation loss? To know for sure, you will have to monitor for total chlorine residual. Chloramine residuals in water used to keep fish should be kept below 0.1 mg/L. Total chlorine test kits are available from pet stores, pool supply stores and chemical supply houses. Make sure, however, that the kit is for “total chlorine” or “combined chlorine” not “free chlorine”. A free chlorine test of chloraminated water would read zero but still be toxic to fish. Will a carbon filter remove chloramines? Yes. To be effective, however, it must contain high quality granular activated carbon and you must permit sufficient contact time between the water and the carbon. Will reverse osmosis remove chloramines? No. Salts can be caught by the permeable membrane but chloramines pass through easily. Will boiling remove chloramines from water? No. Boiling is not an effective way to remove chloramines from water. The only practical methods of removing chloramines from water are using a water conditioner which contains a dechloraminator or by using granular activated carbon. Ask your pet supplier for instructions on how to use these products.

WHEREAS, pursuant to SDCL 32-25-9.1, the Board of County Commissioners may determine and establish speed zones upon all or any part of the highways under its jurisdiction; and
THEREFORE, BE IT ORDAINED BY MOODY COUNTY, SOUTH DAKOTA, that a speed limit of 25 miles per hour be and the same is hereby established on that portion of 470th Avenue extending southward from South Dakota Highway 34 and continuing to the municipal corporate limits of the City of Colman, Moody County, South Dakota. Scott Lewis, Custodian met with the Board. Lewis informed the Board new LED Lighting has been donated for the Moody County Veterans Memorial in front of the Courthouse. RAB Lighting Co./J.H Larson Co. will be donating $1045.50 in LED lights and Bob’s Electric is donating $676.96 in labor. The Commissioner expressed their gratitude for this generous donation. Lewis presented an estimate for LED lights for the Court House pillar lights on the north side. Motion by Miles, seconded by Bruning to approve the Bob’s Electric estimate for LED lights for $1525.00. All voted “aye”. Discussion was held on the bid for the Sheriff’s Office sidewalk. Also present Al Deelstra, Big Al’s Contracting, and Brad Ciavarella, Ciavarella Design. ORDINANCE NO. 2017-01 AN ORDINANCE AMENDING EXISTING ORDINANCE 2012-01 AUTHORIZING THE MOODY COUNTY BOARD OF COMMISSIONERS TO DECLARE A FIRE DANGER EMERGENCY AND TO PROHIBIT OPEN BURNING WITHIN MOODY COUNTY. BE IT ORDAINED BY MOODY COUNTY, SOUTH DAKOTA, THAT ORDINANCE 2012-01 BE AMENDED TO READ AS FOLLOWS: Section 1. That when weather or other conditions exist which make open burning of any substance unduly hazardous and a danger to public safety, the Moody County Board of Commissioners may enact a resolution declaring a “Fire Danger Emergency”. Section 2. That if a “Fire Danger Emergency” is declared, all open burning of any substance shall be prohibited within any or all of the unincorporated areas of Moody County until such time as the resolution declaring the “Fire Danger Emergency” shall have been rescinded by appropriate action of the Moody County Board of Commissioners.

RESOLUTION NO. 17041801 A RESOLUTION AUTHORIZING THE PURCHASE OF BRIDGE CONSTRUCTION LABOR BASED UPON THE PRICE ESTABLISHED THROUGH THE COUNTY OF SPINK, SOUTH DAKOTA BID PROCESS WHEREAS, the Moody County Highway Department will need one BRIDGE CONTRACTOR; and WHEREAS, the COUNTY OF SPINK, has recently gone through a competitive bidding process for bridge contractor, such bidding process culminating in the bids being opened March 7, 2017.
Article 2.1 Irrespective of the enactment of a resolution from the Moody County Board of Commissioners declaring a “Fire Danger Emergency”, open burning of any substance is expressly prohibited when the National Weather Service has declared a Red Flag Warning in Moody County, or when the Grassland Fire Danger Rating in Moody County reaches Very High or Extreme.
WHEREAS, HOLLAWAY BRIDGE AND CULVERT, INC, was the lowest responsible bidder and such COUNTY OF SPINK, SOUTH DAKOTA, bid process and, HOLLAWAY BRIDGE AND CULVERT, INC is willing to sell to MOODY COUNTY under the same terms and options available to the COUNTY OF SPINK, a copy of such bid specifications and bid having been filed at the Moody County Auditor’s Office; and
Section 3. That any person who shall create, commit, maintain, or permit to be created, committed or maintained an open burning in violation of a resolution declaring a “Fire Danger Emergency”, or when the National Weather Service has declared a Red Flag Warning in Moody County, or when the Grassland Fire Danger Rating in Moody County reaches Very High or Extreme, shall be deemed to have committed a public nuisance in violation of and subject to all criminal and civil penalties provided for therein. Any person who maintains, commits, or fails to abate a public nuisance as required under the provisions of this ordinance shall be subject to a maximum penalty of thirty (30) days in jail, a $500 fine, or both. Each and every day that the violation continues may constitute a separate offense. Article 3.1 In addition to the fines and penalties indicated in Section 3 above, any person who violates this ordinance may be subject to the suppression costs of extinguishing the fire. Additionally, nothing within this Ordinance shall be construed to prohibit or supersede any civil remedy otherwise available to any person or entity.
WHEREAS, pursuant to SDCL 5-18a-22, MOODY COUNTY is authorized to purchase supplies and services from any active contract that has been awarded by any governmental entity by competitive sealed bids or competitive sealed proposals or from any contract that was competitively solicited and awarded within the previous twelve months;
Section 4. “Open burning” is defined as the intentional burning of any substance whether natural or manmade, or the intentional casting off of any burning substance, whether natural or manmade, except the burning of such substance in a container sufficient so as to prohibit the escape of any of the burning substance, or any sparks, flames or hot ashes from the container. The escape of any such burning substance, or the escape of any sparks, flames or hot ashes from any such container shall be deemed prima facie evidence that the container was insufficient so as to meet the exception from the definition of an open burning set forth herein. The maintaining of a fire in any interior fireplace, stove or furnace is specifically excluded from the definition of an open burning as contemplated by this ordinance.

Section 5. Campgrounds. Unless specifically banned by resolution of the Moody County Board of Commissioners, open burning within those designated areas falling within the boundaries of any permitted private, state or federal campground shall be legally permissible. Section 6. Reporting of controlled burns. Anyone who intends to conduct any “open burning” at any time, regardless of the enactment of a “Fire Danger Emergency” resolution by the Moody County Board of Commissioner, or a ban imposed as a result of a Red Flag Warning from the National Weather Service or when the Grassland Fire Danger Rating in Moody County reaches Very High or Extreme, shall, before such burn, notify the Moody County Dispatch Center and provide the following information: location of the burn, time of burn, substance to be burned, approximate completion time of the burn and a contact phone number for the responsible person. Any person who violates this Section shall be subject to a maximum penalty of thirty (30) days in jail, a $500 fine, or both. Section 7. This ordinance is declared to be necessary for the immediate preservation of the public safety in accordance with the provisions of SDCL 7-18A-8.
