A Public Hearing was held for a transfer of retail (on-sale) liquor license from DCC, Inc. dba Mad Mary’s Steakhouse located at 306 N Veterans Street, Flandreau SD to C2W, LLC. dba Sioux River Spirits located at 111 E 2nd Ave, Flandreau SD. No public input was heard.

Motion by Yeaton and seconded by Ahlers to approve the transfer of retail (on-sale) liquor license from Mad Mary’s Steakhouse to Sioux River Spirits.

A Public Hearing was held for a new retail (on-sale) liquor restaurant license to DCC, Inc. dba Mad Mary’s Steakhouse located at 306 N Veterans Street, Flandreau, SD. No public input was heard.

Visitors to Be Heard: None.

On behalf of the City and City Council, Mayor Dan Sutton expressed condolences and sympathies to the family, friends and co-workers of Deputy Sheriff Ken Prorok. Sutton also reported he was pleased with the collaborative work being done between the City of Flandreau and the Flandreau Santee Sioux Tribe on some important projects within the Community.

City Administrator Cohl Turnquist also expressed condolences and sympathies to the Prorok Family. Turnquist reported he has attended several meetings regarding the Child Care Grant that the Boys and Girls Club is applying for. The Fire Station Project is still progressing and the Council should expect to see some small Change Order Requests in upcoming meetings. Turnquist was approached by a representative from Banner Engineering on a new program for a multi-city chip seal project. Public Works Superintendent Tanner Harris and Turnquist will attend an upcoming meeting to learn more information about the program. Administrator Turnquist also informed the Council of an upcoming Zoom meeting with FEMA to go over changes to the flood maps. The meeting will be held February 21st at 2:00 and anyone interested in attending should contact Turnquist for the meeting link.

Motion by Yeaton and seconded by Tufty to approve the Administrator’s Reports. The following members voted aye: Ahlers, Bjerke, Ekern, Fargen, Tufty and Yeaton. Nays: None. Absent: None. Motion carried.

New Business: Jody Hernandez, from Boys and Girls Club, gave a presentation to the Council on the Child Care Grant that they are working on obtaining. The Boys and Girls Club, who is partnering with the Flandreau Santee Sioux Tribe, the City of Flandreau, Flandreau Public School District and Dakota Layers, is working to secure funding to construct a child care center in Flandreau. Hernandez stated the lack of choices for child-care and increased costs involved with child care as some of the issues residents of Moody County are facing. If grant funding is awarded for the child care center, future discussions will take place among the placeholders of this project.

The First Reading of Ordinance No. 619 for Ordinance Codification was held. The City contracted with American Legal Publishing in 2023 to complete a review and recodification of the existing City Code of Ordinances. The Second Reading of Ordinance No. 619 will be held at the next Council Meeting on February 20th, 2024.

Motion by Fargen and seconded by Ekern to approve pay request No. Eight (8) to WS Construction for the new Fire Station for $89,252.18. The following members voted aye: Ahlers, Bjerke, Ekern, Fargen, Tufty and Yeaton. Nays: None. Absent: None. Motion carried.

Motion by Bjerke and seconded by Yeaton to approve pay request No. Eight (8) to IMEG Engineering for professional services of $89,500 for Series 2023 Water Improvement Project. The following members voted aye: Ahlers, Bjerke, Ekern, Fargen, Tufty and Yeaton. Nays: None. Absent: None.

Motion by Tufty and seconded by Ekern to approve the Fire Protection and Utility Agreement between the Flandreau Santee Sioux Tribe and the City of Flandreau. Ryan Kills-A-Hundred, representing the Flandreau Santee Sioux Tribe, also expressed condolences to Officer Prorok’s family, on behalf of the Tribal President. Kills-A-Hundred stated the Tribe is excited about the collaborative efforts from both governments on important projects, including the Child Care Grant, Solar Agreement, and Updated Fire Protection and Utility Agreement between the City and the Tribe.

VALENTINE’S DAY SPECIAL WEDNESDAY, FEBRUARY 14

Wayne Fanebust, now retired and living in Sioux Falls, has authored eleven non-fiction books about local, state and regional history. He was born in Sioux Falls, graduated from Washington High School, served in the U. S. Marine Corps, attended college in California, has a degree in history, and a law degree. He practiced law in San Diago for thirteen years before moving back to Sioux Falls where he served as corporate counsel until retiring.

Fanebust’s most recent book, No Justice for Agnes, published in 2020, examines the tragic and mysterious death of Agnes Polreis in 1906 while serving as an immigrant servant girl in the home of Emma Kaufmann and her husband, a wealthy businessman from Sioux Falls. The venue of Mrs. Kaufmann’s trial was moved to Flandreau. Dr. Spafford of Flandreau was called as an expert witness. Local attorney George Rice was hired as one of the defense attorneys. Eleven members of the jury were Moody County farmers. Hundreds of people flocked to Flandreau filling its hotels, boarding houses, and private rooms in homes willing to host guests. The repulsive manner of death, outrageous attorney antics, and other aspects of the case generated sensational newspaper coverage from coast to coast.
