President‘s Message David Waller, MRWA Board President Change, no matter how much we dislike or like change, it is inevitable. This year we have seen major changes in the world of politics, with the election of nontraditional candidates to the highest offices at the State and National level. These two offices will more than likely effect and change long standing policies at all levels.

Closer to home, your Association will see a major change of its own with the retirement of Executive Director John Hoagland. John has decided to pursue a more leisurely lifestyle and leave the business of protecting the interests of the Water and Wastewater Industry to others. The Board and Staff wish John well in his retirement and thank his wife Jeanne for allowing John to be our guiding light for these many years. John joined MRWA in 1989 and assumed the position of Executive Director in 2007. John leaves the Association in a strong position within the industry both at a State and National level. John watched over the funds of the Association as if they were his own, leaving us in a strong financial position to meet the goals of the membership and just as passionately, John guarded the reputation of your Association.

Greatness in a person is often perceived as a person that is always in the spotlight with adulations from their peers being rained down upon them. In my opinion, greatness is more often a person that goes quietly about doing their job to the best of their ability without the expectations of reward or public acknowledgement. John brought this kind of greatness to his position as Executive Director. During his time as Executive Director, John quietly orchestrated numerous changes to both regulations and legislation that benefited the industry. And just as quietly, helped sideline or prevented from reaching enactment, rules and laws that would harm the water and wastewater systems of Missouri. We will miss John, but do wish him a very happy retirement.

While it is always difficult to step into a position that the previous person has been so successful, your Association is lucky to have John’s successor already in house and ready to move forward. Our new Executive 4

Director, Randy Norden will bring a different personality to the position, without losing sight of the goals and accomplishments that he inherited. The Board is confident that Randy will continue to grow and strengthen the Association, providing you, the Membership, with an Association that you can continue to be proud of and one that serves the best interest of the industry.

Back to the State and National leaders, while we can’t be sure of what changes will occur as the President and Governor fill their cabinet posts, logic tells us that it will not be business as normal. We await those changes and will be monitoring the selections for posts that affect the industry. If you have a personal relationship with any member that is appointed to a position that has input to proposed rules and laws that would affect the water and wastewater industry, please let Randy know. Those personal relationships are often the crucial contact in the passage or modifying of proposed rules and laws.

From the Executive Director John Hoagland, MRWA Executive Director It’s Been a Hell of a Party In the Summer of 1973, before my Senior year of high school, I was working at the local fescue yard unloading newly harvested seed from trucks via a scoop shovel. It was hot work that lasted until about midnight every day during “fescue season” as it was called back then. I hated the job, but it did keep gasoline in my first vehicle, a 1953 Chevy pickup with four on the floor and a top speed of about 60 miles per hour. Later that summer the old pickup was replaced by a ‘67 Mustang with a Cobra kit that featured significantly more speed, but required even more fuel. But I digress. About two weeks into fescue season, I got a call from the president of the local water board. The company laying water lines all over the county needed a high school kid to chase parts and just be sort of a “gofer” and he thought I might be interested in the job. While I knew absolutely NOTHING about pipes or water or just about anything important in this world, the thought of leaving the seed yard AND the doubling of my wages to a staggering $2.50 per hour was all I needed to hear. Bidding the seed company a quick good-bye, on Monday morning, I eagerly showed up at work for Hevalow & Riddle, the waterline contractors.

Little did I know that 43 years later, I’d be writing this article.

This will be my last article as Executive Director of MRWA as I have chosen to retire and enjoy some new adventures in my life. As I write this, I count myself as one of the luckiest individuals in the world. My job with MRWA has helped provide my family with a great living for nearly 30 years and I’ve been able to see and do things that I’d never dreamed possible. As I reflect on my career, some things stand out in my mind. Working the Flood of 93 and watching a pretty rough looking motorcycle gang work alongside a group of Amish locals throwing sandbags to attempt to protect their town from certain flooding; the unbelievable devastation of the Joplin tornado; traveling to Washington, D.C., and tagging along with Dennis Knipmeyer for VIP treatment at Congressman Ike Skelton’s office, among others.

In an article like this, I’d be remiss if I didn’t acknowledge the great board I’ve worked with here at MRWA over the years. While closely monitoring what goes on with YOUR Association, the board has never been afraid to allow me to try new things and on those occasions something didn’t work out, I was never made to fear failure or hear an “I told you so” …. that’s rare and appreciated.

Then there’s my staff here at MRWA. I’m living proof that as the “boss”, if you surround yourself with smart, hardworking people, even the most average of us can stumble through the job and look reasonably successful.

My thanks to them for their hard work, devotion, and just being who they are every day. They’re exceptional… but you already know that.

On March 1, 2017, Randy Norden will officially move into my chair as Executive Director of MRWA. For the last several months he’s taken on many of my duties so we expect a smooth transition. He’ll bring new ideas and face new challenges as Executive Director. No doubt he’ll do some things differently, but I’m confident one thing will remain the same here at MRWA…a dedication to providing you with the best in training, technical assistance, and representation of the water and wastewater industry here in Missouri.

Those who know me know I love the TV mini-series Lonesome Dove that aired a few years ago. In it, near the end of the story, as he is gravely ill and near death, Gus tells his lifelong friend Woodrow…“By God Woodrow, it’s been a hell of a party.”

Yes, it has.

After 28 years total with MRWA and the last 10 as your Executive Director, I thank you all for allowing me to serve you. Good luck and Godspeed to all of you!

Letters Dear Mr. Hoagland, I am writing to let you know how appreciative the City of Mercer is to MRWA and Gary Webber.

Our Wastewater Operator, Tommy West, has called Gary many times to assist us with our smoke testing, sludge judging, sewer system in general, and he has been a huge help to us in identifying our sewer problems. Tommy is now able to work to fix these areas to keep us in compliance with DNR. The City of Mercer would like to thank MRWA and Gary Webber again for their valuable support to our city.

Dear President Waller, I have been meaning to write this letter to you for a long time. I want you to know what a fine job John Hoagland and all the MRWA employees are doing for C-1 Water.

First, let me give you some background of our water district so you know why your organization is so important to us. We are in northern Jefferson County. We serve 13,500 connections in a 60-square mile area with over 200 miles of water main, 8 tanks and 4 pumping stations. We have 8 Distribution III Operators, 4 office employees and I with a Distribution I and Certified Office Professional with MRWA. MRWA has come to our aid on MoDNR compliancy, annual budgets, water loss management, fish kills from leaks, GIS mapping of our valves and training. We have worked with John Hoagland, Liz Grove, Wayne Roderman, Howard Baker, Billy Everett, Tom Hyatt and Brad Rayburn on all of the above. Whether by phone, letter or in person, one or more of your employees has been there for us.

Randy Norden does an excellent job in planning and coordinating the seminar in the spring and the two in the fall. The conferences meet our required hours and actually teach useful knowledge that applies to our field and office jobs. Not to mention the nice accommodations at a good price!

The letter is also a compliment to you and the Board of Directors of what a good job you are doing in overseeing and setting policies that have created and allowed this organization to become so significant and useful to water suppliers.

Letters Dear MRWA Staff, The City of Fisk and Public Water Supply #104 of Butler County want to thank Billy Everett, Tom Hyatt, and Andy Bowman for working on the city water plant. They spent many hours evaluating the plant and working to repair the problems that were found. Their expertise was invaluable to our systems. Without their knowledge and labor it would have been very hard to accomplish the needed repairs.

To Whom It Concerns, The City of Coffey Board of Aldermen have agreed to have a letter written regarding how the Missouri Rural Water Association has helped and improved the City’s water loss situation. The Council appreciates all the help and hard work given by Jim Enterline and Wayne Roderman. Mr. Enterline has come to a meeting in the past regarding water rate increases and then again for helping with the water loss within the city. He provided us with a program to determine water purchased verses water sold and then how to calculate the percentage of the total water loss. We have tried to do a fair comparison by comparing the charge of each town around us. We would receive water rates on these comparisons, but later it would not be what we needed. This is the story of our City raising water rates in the past. The raise wouldn’t help much but the increase would not be that much at a time.

We were told about a rate study done by Jim Enterline. We contacted him and he appeared at a past council meeting and the council couldn’t believe the help that was presented. It is one of the very best things the City has done is having the rate study completed. We are now operating in the black and it makes it a lot easier on the city employees not to have to worry about there the money is coming from to pay the bills. Since we met Jim and Wayne, they both have helped with water leaks and offer their help with whatever needs to be done for the City.

We believe every city should use this service and be a part of MRWA. It has helped us tremendously and we are very thankful to these gentlemen for their patience and assistance. We just wanted to say a bit Thank You and we feel better knowing there is help and support out there.

Dear Mr. Hoagland, I am writing to thank you for Larry VanGilder’s dedicated efforts in creating an Energy Assessment for several of our wells. He recommended a number of hardware upgrades and suggested operational changes that should improve our energy efficiency and lower our costs. Some of these recommendations come at a significant price, but Larry also guided us to low-cost funding sources that should ease the financial burden.

The efforts of Larry and your entire staff are greatly appreciated. I hope that funding will continue for the Energy Efficiency Circuit Rider program.

Dear John, Only July 23, 2016, the Water District started experiencing an unusual increase in water usage. The first thought that came to the District Crew’s head was that there was a water leak. After an exhausting search we were unable to ascertain where the leak could be coming from, that’s when I decided to phone Wayne Roderman. Wayne showed up on July 5, with a clear goal in mind, that was getting to work to find the leak. After determining the usage was south of our elevated tank, Wayne worked day and night when usage was lowest to check every valve and dead end line. After days of searching, it was finally determined that our increase in water usage was due to the drought and extreme heat, which has plagued the area for the last month. In short, I would like to say thank you to Wayne Roderman and Missouri Rural Water Association for all their help. We are truly lucky to have such a great resource as MRWA available in our times of need.

2017 Water Taste Test Tom Hyatt, Management Circuit Rider It’s time to consider water sample submission for entry in the MRWA 2017 Water Taste Test.

Submission is easy. Just call the MRWA Office at 573657-5533 by Friday, February 24th, provide your name, telephone number, and the name of your public water system. MRWA circuit riders will collect a water sample in March from the first 24 member systems to call.

If you prefer, collect and deliver your own water sample at the MRWA Office, 901 Richardson Drive, Ashland, MO 65010. Hand-delivered samples should be brought no later than Friday, March 24th to allow time for anonymous labeling of jars prior to the preliminary judging. If delivering your own sample, collect it in a glass jar such as a canning jar, label it with your system’s name, and keep the sample out of sunlight and away from heat sources.

Preliminary judging at the beginning of April will narrow the field to the top five best tasting samples.

MRWA will contact these semi-finalists and request another sample be brought to our April 26th Legislative Open House and fish fry. Final judging that day will determine the 2017 Best Tasting Water for Missouri.

MRWA provides a free stay that evening at the Double Tree Hotel in Jefferson City for one representative from each of these semi-finalist systems.

These individuals also enjoy a complimentary breakfast during the following morning.

The winning system receives a trophy and free luncheon at a later date; and participating representatives will be escorted to the system’s Senate and House chambers at the capitol during the following day’s

Jefferson City Day activities, provided that these legislators can spare a little time for introductions.

Most important of all is the fact that the winning water sample represents Missouri at the National Rural Water Association’s Great American Water Taste Test.

This event occurs during the following February and includes free air fare, hotel accommodation, and meals for a system representative.

MRWA is still looking for a water sample that will awaken the taste buds of judges on that national panel and earn Missouri a place among the best of the best water samples. Missouri has earned the bronze status a couple of times in recent history, but it’s time that this state’s water quality moves up in ranks to capture gold.

Every Little Bit Counts with Pesticides Eric Fuchs, Source Water Technician EPA’s atrazine review should remind us once again that many people doing the same little thing adds up to a lot.

As I write this article, EPA is in the process of an environmental assessment of the herbicide atrazine, and the process reminds me how often we fail in our stewardship duties. EPA is required to do an environmental assessment on herbicides every 15 years, the last done on atrazine was in 2003. Atrazine is the second-most-widely used herbicide in the US. It is primarily used on corn as a broad-spectrum weed killer.

It has been banned in Europe since 2004 and has created much controversy by its use here in the US. The US ecological assessment of atrazine recognized negative consequences of the pesticide on aquatic communities, including their plant, fish, amphibian and invertebrate populations. Additional concerns extend to terrestrial ecological communities.

From a drinking-water perspective, water system operators are very familiar with atrazine, which can be found in both ground and surface water. Those systems in heavy row-cropping areas normally see a spike in Atrazine levels in their source water when corn planting begins.

Atrazine is removed from drinking water using activated carbon, which binds to the particles and then settles out, being removed from the water.

Water systems are required to keep the atrazine levels less than three (3) parts per billion (ppb) maximum contamination level (MCL) in finished drinking water.

This three ppb is based on a running annual average, measured quarterly, so a system can have much higher levels during some periods, yet still be compliant with the MCL. The requirement for this limit was put into place in the year 2000.

In 2012 Syngenta, the manufacturer of atrazine, settled a class action lawsuit by more than 1,000 water systems located throughout the Midwest concerning Atrazine in drinking water. The settlement was for $105 million and was distributed to systems both big and small throughout the states of Iowa, Missouri, Indiana, Kansas, Ohio and Illinois. The company denied any liability or wrong doing linked to the chemical which it has continued to sell.

The agriculture industry argues that if atrazine is banned it will increase production costs because it will be forced to use alternative chemicals. What is not taken into consideration is the cost incurred to the public, passed on by water systems for its removal. The Des Moines lawsuit is an example of a water system trying to recoup costs for removal of chemicals which is beyond the control of itself and its customers.

It seems that the writing is on the wall for Atrazine and its use in the future. It is up to us to step up and be judicious in its use and keeping it out of our water system.

No-till and cover crops are a principle method to keep all chemicals in place and out of our water.

I am not advocating whether atrazine should be banned or stricter limitations placed on its use. Instead, I’m trying to make clear that actions we take in our operations can have far reaching effects of people we have never met, who are consuming water we have never seen!

Water Quality Issue in a Small Town Brad Rayburn, Circuit Rider III A few months ago, I was working with my stepdad at his house and I needed a ladder. The ladder was leaning on a huge tree with a big fork in the center of the tree.

On the other side of that tree, a long 2x6 was leaning against the tree. Both the ladder and board were placed so they would be in the center of the fork. I was rather confused by the situation, so I asked him why the ladder was leaning against the tree. He said, “Brad, one of our cats climbed up there, it will not come down, so I placed the board up there in hopes that it would climb down.

I am using the ladder to feed and water the cat.” I was speechless and amused by this situation. I share this story because sometimes in the water industry similar situations occur, water specialists are also in situations that don’t have a clear solution. So, questions arise. How do you get the cat down? Or better yet, how do you come up with a solution to fix the water?

In April, I received a phone call from the Missouri Department of Natural Resources (MODNR) regarding a water specialist that needed assistance with flushing hydrants due to customer complaints of yellow water coming out of the faucets in the customers’ homes. I contacted the water specialist, George Hunt, to set up a time to meet with him. He wanted to begin flushing as soon as possible. When I arrived he had several questions

about flushing hydrants. I spoke to him about a flushing program and where we should begin. Hunt wanted to jump right in and start flushing, but I requested that we go to the water source first. The water source was a well and I wanted to check the water quality from the well before we began flushing.

Hunt turned the well on manually, and I turned the source water tap on. The clear water, or so we thought it was clear, flowed out of the tap into the floor drain. The well house was dimly lit, so I placed a bucket under the source water tap to see what the water looked like in the bucket. Hunt and I both were shocked to see the color of the water in the bucket was brown. It was similar to muddy pond water. We were hopeful that the bucket was dirty, so we rinsed it out multiple times; unfortunately, it was determined that the water was muddy coming from the well. I opened a nearby fire hydrant so that the water could flow directly from the well. It flushed for several minutes without any changes. I was hopeful that maybe the well just had muddy water when it was started. I was

wrong. Now, what? A cat is stuck in a tree, so to speak.

Obviously, this was a bad situation, so I asked, George if he had another well. He replied, “Yes, but it does not work, what are we going to do? How are we going to get water? Why did this happen?” All I heard was the well does not work, so I had him drive me to this nonworking water source. This was also a deep underground well and it was located directly behind the City Hall. I entered the well house and things appeared like it had not operated in several months, or maybe even years. The electrical panel that controlled the well was outdated and opened with wires hanging out of the box. I tested the panel to see if it had power, and to my surprise it did. I located the valves to isolate the well from the distribution system and turned the well on. To everyone’s surprise, the water looked clear, so we let it flush through the hydrant for several minutes. I contacted MODNR to let them know what was going on with the city. They instructed Hunt to initiate a boil water order and to hook up chlorine before the backup well was put online. I assisted Hunt with hooking up a chlorine pump to the well and issuing the boil water order.

The controls for the back-up well had been unhooked from the water tower, so it had to be run on manual. It had a few other problems, such as, the check valves in the well were not working, the water from the well had sand and air in it and the column pipe in the well was in bad condition. I wanted to ensure that the well had enough water over the pump, so a well drawdown test was done.

The drawdown calculation ensured Hunt that there was

enough water over the well pump to keep the pump from burning up, and that the air in the water was due to the failing check valves in the well. Water samples were taken from the backup well, they all came back safe. The boil water order was lifted. This was a relief for the residents and Hunt, but this did not help with rectifying the problem with the primary well.

Hunt contacted local well drillers to see what the best solution was for getting rid of the muddy water in the primary well. According to the well drillers, the best thing to do was to flush the well, until the water cleared up. The water from the primary well was flushed through a nearby fire hydrant. Unfortunately, after two days of nonstop running the water was still muddy and it had flooded a yard. The water was diverted, but this did not work either because the water made a pond next to the railroad tracks.

So, Hunt and I ran 500 foot of fire hose from the fire hydrant. This allowed the water to flow into a ditch. After 12 days of continuous flushing water from the well, it was still muddy. Hunt decided to turn the well off. A couple of days later the well was turned on and it continued to pump muddy water. The backup well was not a reliable source, but was maintaining enough water for the system.

In the meantime, I had talked to several people about the situation. One of those was Ted Forrester, Rural Development Engineer. He told me about an Emergency Community Water Assistant Grant (ECWAG) and that (continued on next page) 19

the city might qualify for that type of grant. Forrester put me in touch with the Rural Development Area Specialist, Mark Dethrow. I explained the situation to Dethrow, and the city qualified for the ECWAG grant. I assisted the city throughout the entire grant application process. In September, the city was notified from Rural Development that they had received 100% grant funding to drill a new well.

The new well was scheduled to begin prior to the end of 2016. If all goes well, the drillers will hit a good water source. Time will tell, but until that happens the backup well is still working. This was a unique situation to say the least, and if the city had not had a backup water source they would have been in trouble. When all this took place, Hunt had only been the water specialist for a week, so it was understandable why he was not sure if the city had a backup source for water. The majority of water

systems have more than one water source, but sometimes they only rely on one source to pump water from. It is a good idea for all systems to make sure that they have at least two sources of water just in case something like this happens to one source. Also, it is important to exercise that emergency backup source monthly to make sure it is in good working order.

Sometimes Water Specialist face obstacles that cannot be solved quickly. Missouri Rural Water Association is here to help with those obstacles. Every time I contact Hunt, we talk about a flushing program, but until the city obtains this new well, flushing hydrants is not an option.

Fortunately, it seems that I am better at helping water systems than with getting cats out of trees. My solution for the cat was to quit feeding and watering the cat. That never did happen, but the cat did eventually climb out of the tree and is doing well. I hope that the same thing can be said for this water system very soon.

No Product is so Versatile or Affordable as Water Tom Hyatt, Management Circuit Rider People are becoming increasingly conscious of their diets these days. This focus is not exclusively about weight loss; but it means being aware of what they put in their bodies. Whether it is simply a trend or a lasting fixation, more and more people are concerned about healthy living.

When considered in light of what the water industry offers, we have the perfect product. After all, water is calorie-free, carb-free, fat-free, sugar-free, caffeine-free, gluten-free, gmo-free, and completely organic (at least when no chemical has been added to purify it). If not softened through the ion exchange method, water is also low in sodium; and it has no preservatives and no artificial coloring. Although it has none of these typical product labels, water conveniently comes right out of the tap with all of these benefits.

Besides this, water is more versatile than anything else imaginable. What other product that you ingest (food or drink) can you also use for the following applications: • Cleaning toilets, pots and pans, floors, and vehicles; • Flushing waste; • Watering livestock and pets; • Irrigating lawn, garden, and crops; • Extinguishing fires; • Chilling drinks (in the form of ice); • For personal hygiene; • For recreation (boating, skiing, swimming); • And in product manufacturing?

Yes, whether a company builds automobiles or processes food, it needs water - usually large volumes of water – for either commercial or industrial processes.

This underscores another benefit of water. Easy access to water promotes economic growth for a community.

Water is also good for our kidneys, hydrating and flushing toxins from the body, and lubricating muscles to lessen soreness.

Even if you prefer a drink with more distinctive flavor, water is used to make it. Without it, we wouldn’t have coffee, tea, lemonade, soft drinks, beer, wine, and so many

other liquid refreshments, as well as semi-liquid gelatin.

Additionally, water quality in this country contributes to longevity. One study from Personal Finance predicts that millennials will enjoy extended life expectancies, living more than 100 years on average.

Given the source of this information, the gist of the article was that this generation will have to save even more for retirement than baby boomers since they could outlast their financial nest eggs. Okay, back to the original focus!

While breakthroughs in medical science presumably account for longer life expectancies, some of this added life “mileage” is attributable to water quality. With modern disinfection practices and treatment technologies, gone are the days when cholera, hepatitis, dysentery, typhoid, scarlet fever, and diphtheria plagued large population centers as these diseases formerly transmitted themselves through water.

With all of these applications, water is truly lifesustaining and an all-round, versatile product! What is more amazing is how cheap it is. MRWA Resource Conservation Circuit Rider Wayne Roderman calculated average water rates in Missouri on the basis of the biannual MRWA Rate Survey and found little difference between average municipal and water district rates. The average rate for the higher priced of these two groups reflects a value of $8,800 revenue for every million gallons sold. This amounts to a price of nine-tenths (9/10) of one penny per gallon. Although some water systems charge more, it is true that many charge less than a penny per gallon. If these systems simply raised their water rates to one cent per gallon, they would increase their revenue; and customers would still be getting the bargain of a lifetime!

Now, let’s turn our attention from small numbers to big ones… really big ones. The 2013 report completed by the American Society of Civil Engineers gives a D+ grade to this nation as a whole in terms of its drinking water systems, citing that this country will need to (continued on page 24)

invest $3.6 trillion (yes, trillion with a “t”) by 2020 (less than four years) in drinking water infrastructure due to age and neglect of these systems. Missouri scores a C- (nothing you’d rush home from school to brag about) and has an $8.5 billion (now the “b” word) drinking water infrastructure investment need by 2033. These investment needs are astronomical, and these time frames are approaching rapidly.

Perhaps water is too cheap. As an easy comparison, water rates increased within the last six months for the public water supply that serves my home. My first bill went from $30-$35 on average to $46. It didn’t take

long to assess this impact: My family will pay $132 to $192 more for water each year. I then realized something else: We pay $50 each month for our Internet service (less than that new $46 water bill), $90 for our satellite television package, $90 or more for our electricity, and a king’s ransom for our cellular phone package. Even with the increase, water is still my cheapest bill each month… and my most valuable purchase, all at the same time.

Yes, water is used for many things – virtually everything – and it is perhaps the most under-valued resource we have.

Around the State Capitol Harry Hill, MRWA Legislative Liaison During a recent, late-November visit to the state capitol, it occurred to me that there really is a somewhat more subtle “third season” at the old building. The first two are pretty obvious; the chaos of the legislative season followed by the quiet months when legislators, lobbyists and school groups leave for home.

The presence of a third season first struck me as I approached the third-floor office of the Senate Secretary. At times, one of the busiest spots in the building, there was no one in sight. I saw instead a small Christmas tree next to the door which offered, not ornaments, but cards with names and contact information for needy children.

That little tree reminded me of times past when I had observed a simple pine wreath hanging on a legislator’s door or a simple message of “Peace.” On another occasion I recall seeing capitol maintenance workers wrapping garland on nearby street lamps, a task far removed from their regular jobs.

How could a tour of the capitol - in any season - be complete without a mention of food? I was informed that the house and senate staffs each have their holiday meal. The senate, I was told, leaves the building to eat out. But the house staffers, on the other hand, organize a “carry-in” meal.

Asked how they avoid the (more than 120) participants from overwhelming food tables with lime jello salads and Christmas candy, the answer was simple and practical. The first floor staffers are instructed to bring salads (for instance), the second floor is to furnish side dishes. The third floor is to bring desserts, etc. Reports from the past would indicate that tasty Christmas cookies and candy were not slighted in the least.

There is something uniquely special which emerges in conversations that far exceeds a subtle reference to the season.

The actual performance is on a December Tuesday night. A rehearsal is held at the capitol on the preceding Monday.“It’s (that Monday) my favorite day of the year to be working at the capitol,” said a woman who has been employed many years in the building.

“It’s such an unusual place,” she said.“The acoustics are just about perfect.”

The choir, composed of dozens of Jefferson City public school students, first assembles at each of the far ends of the second floor capitol corridors. Singing “Adeste Fideles” (in Latin) they move slowly toward their positions on the staircase in the center of the building.“The sound is faint at first,” she said.“It is so beautiful. It’s really moving”.

I once heard someone say they thought “they were hearing the sweet voice of angels” as they entered the building unaware the choir was rehearsing.

Missouri Rural Water Association Supports Higher Education Tom Hyatt, Management Circuit Rider Education for young women not only improves their economic outlook for life, but the United Nations Population Fund cites that it “… increases a nation’s productivity and economic growth …” (State of the world population report, 2016, p. 65). That report (available at https://www.unfpa.org/swop) focuses upon the world’s 60 million girls who are 10 years old and predominantly come from developing nations. However, the report indicates that global stability and prosperity is dependent upon young women developing their full potential.

Missouri Rural Water Association plays a role in this U.N. priority. Its slate of 2016-2017 college scholarship recipients consists of four women: Sadie Watson, Bailey Griffith, Makayla Koenigsfeld, and Delayne Patton.

Two scholarships are awarded to enrolled college students and two to graduating high school seniors.

Children, stepchildren, and dependents of full-time employees of active member systems and of MRWA are eligible. Each student receives $1,000 to lessen the financial burden of higher education.

Daughter of Caldwell County PWSD 3 Clerk Sammy Watson, Sadie Watson is a transfer student to North Central Missouri College in Trenton after completing her freshman year at Culver-Stockton College.

This Braymer native started her sophomore year with 38 Sadie Watson credit hours due to dual credit coursework during high school. Her chosen field of study is health care as she plans to earn her Registered Nursing degree. Watson blends personal ideals with practical considerations when choosing this career: “love and compassion for people” and “abundance and availability of nursing jobs.”

Watson also navigates academics and athletics with equal grace, if her high school experience is any indication. She earned placement on the Honor Roll and was a member of the KMZU Dream Team and KMRN All Star Team all four years. This ambitious student was also awarded Marine Corps. Distinguished

Athlete; participated in Sam Graves Leader Academy and Future Leaders Academy; and volunteered for Student Council, Student Cadet Teacher, and Special Olympics.

Bailey Griffith is the daughter of City of Slater Assistant City Administrator Russell Griffith.

Attending the University of Missouri at Columbia, Griffith earned 77 credit hours by the time she returned to school this past fall. She is pursuing a Bachelor of Science Degree in Bailey Griffith Business Administration with an emphasis in Marketing. Although beginning a career path in medicine, this young woman acquired a growing interest for marketing as a way of promoting businesses in their pursuits of serving customers and achieving success.

Griffith summarizes her current and former achievements well:

Member of Alpha Kappa Psi Business Fraternity, Two consecutive semesters on the University of Missouri-Nursing Dean’s List, Residence Hall Government, Graduated Slater High School in the top 10%, Member of the National Honor Society, Member of Future Business Leaders of America, Honor Roll for eight consecutive semesters, Student Council Representative, Class of 2014 Vice President.

Osage County PWSD 3 Office Manager and Clerk Virginia Koenigsfeld’s daughter, Makayla, was graduated from Linn High School May 2016.

Young Koenigsfeld hits the ground running for her college studies, having ranked first place out of her graduating class of Makayla Koenigsfeld 52. A glance at her high school transcripts reveals just how well this scholar performed: all A’s all four years, even with extremely challenging classes such as trigonometry, calculus, and chemistry!

Selecting an undergraduate major of biology and health sciences will prove a stepping stone to her career choice of physician. This aspiring medical doctor has experienced tragedies with people close to her and wants to no longer feel helpless as people suffer.

Other achievements for Koenigsfeld include president of Student Council and senior vice president; member of 1st Team All-District and 1st Team All-Conference in volleyball, Athletic Club, and CYO; participant at the Washington Leadership Conference; inductee into the National Honor Society in 2014; volunteer with Osage Caring Projects, Capital Region, and church events; and math and science tutor.

Delayne Patton, daughter of MRWA Small System Circuit Rider Jim Patton, commenced from Crocker High School May 2016 with 12 college credit hours earned from Ozarks Technical Community College in Springfield. Her major studies will be Criminal Justice with Delayne Patton a minor in Social Work as she continues her higher education at Lincoln University in Jefferson City. As a juvenile officer, Patton hopes to “… make a difference and have a positive influence in young people’s lives.”

Her passion for youth work is rivaled by her interest in softball, which she has pursued throughout her years in high school. She was 2014 and 2015 player on 1st Team All-Conference, All-District, and All-Region; and she was All-State pitcher. Like her athletic abilities, she is no 30

light-weight when it comes to coursework. Her grades during her entire secondary education are A’s and B’s; nothing less. Additionally, she earned A’s exclusively at Ozarks Technical Community College.

Patton has other noteworthy accomplishments: National Honor Society member and treasurer; Sophomore Class treasurer; Senior Student Council member and treasurer; A+ Scholarship Program recipient; Homecoming Princess; 1st Place Science Fair winner; Student of the Quarter; Senior Yearbook staff member; and volunteer for multiple causes, including Special Olympics, underclassman tutoring, and coaching and umpiring little leaguers.

Employers & Conceal and Carry in Missouri MRWA indicated that they get questions from time to time on issues involved for an employer dealing with conceal carry gun laws. The following is a summary of the current law on the issue in Missouri, including the recent change to Missouri conceal carry permit requirements effective January 1, 2017.

Missouri state law authorizes a municipality to “by rule, administrative regulation, or ordinance to prohibit or limit the carrying of concealed firearms by permit or endorsement holders in that portion of a building owned, leased or controlled by that unit of government.”1 This would also appear to apply to a resolution by a Public Water Supply District or a Sewer District. The statute does not allow the municipality policy to explicitly make a violation of such ordinance or regulation a criminal offense; however it does allow for the removal of a person violating the rule from the facility.

“Parking Lot Laws” Missouri does not allow the concealment of weapons in a private vehicle to be a criminal offense, and allows for employees to take their concealed weapons to work in their car, so long as they are not brandished while the vehicle is on the premises of the company that has an employer policy on weapons.2 The statute does allow employers to ban concealed firearms from any vehicles owned by the employer.

Constitutional Challenges While these laws have not yet been challenged in Missouri, an identical law has survived a challenge in Oklahoma, which was appealed to the Tenth Circuit Court of Appeals in Ramsey Winch, Inc., v. Henry. Oklahoma introduced parking lot laws in 2004 similar to Missouri parking lot laws. Oklahoma’s legislation holds employers criminally liable for prohibiting employees from storing firearms in locked vehicles on company property.3 In rejecting the challenge to Oklahoma’s law, the Tenth Circuit Court of Appeals noted that the Occupational Safety and Health Administration has “not indicated in any way that employers should prohibit firearms from company parking lots,” and actually, OSHA has “declined a request to promulgate a standard banning firearms from the workplace, preferring instead to allow states to police themselves.

The debate over the potential safety benefits or detriments of concealed carry was touched upon but not resolved by the Tenth Circuit. Instead, they used the simple existence of such a debate as evidence that there could be benefits to concealed weapons in private vehicles on employer premises, and therefore a rational basis exists for the law. Because there was a rational basis, the court declined to reject the Oklahoma law as unconstitutional and allowed it to stand.

Since Oklahoma’s law closely mirrors similar provisions in Missouri’s parking lot law, it is reasonable to believe that it too may be upheld if challenged – although such a challenge would be to a different Federal Appeals Court. Under current Missouri law employers are allowed to have employees keep their concealed weapons in their car, so long as the weapon is not brandished on the employer’s property.

Liability Finally, looking at liability, employers are advised to review their general liability insurance policies to review when coverage is provided; typically, coverage is provided when the injury was proximately caused by events that were foreseeable by the employer. The Missouri Supreme Court in Taylor v. Bar Plan Mut. Ins. Co. noted that usually, general liability insurance will exclude “injuries arising from use or ownership of a vehicle or gun,” so those harmed on company property by either of those may be unable to recover under an employer’s insurance policy.4 However, beyond insurance policies, employers should be aware of potential negligence claims, such as negligent hiring, negligent supervision, and negligent retention. Employers are advised to thoroughly conduct background checks before hiring employees with have a reported propensity for violence, because any violent acts committed by the employee with such a history has the potential to expose an employer to liability just for keeping such an employee on their payroll. Therefore, while employers are allowed to either allow or prohibit concealed weapons, there are other liabilities to keep in mind. § 571.107 R.S.Mo § 571.107.15 R.S.Mo. 3 Ramsey Winch, Inc., v. Henry, 555 F.3d 1199 (10th Cir. 2009).

Communicating with the Decision Makers Elizabeth Grove, Management Circuit Rider

A common complaint I hear from operators is the struggle to get board members to understand the issues facing the utility and getting them to make the decisions that need to be made in order to maintain/upgrade facilities. All too frequently, we hear about a city or district that has found itself in a dire situation, out of compliance, and everyone is standing around scratching their head wondering “How did we get into this situation?” Ask the operator and he/she will tell you that something to the effect: “I have been telling them this is a problem for a long time!”

As an operator, maybe we need to look at a more pro-active method of getting our message across to those who hold the purse strings and make the decisions. A common scenario I run across when I attend board meetings goes something like this: The Mayor/Board President calls the meeting to order. The minutes, bills and financial reports are approved. Then an hour or more is devoted to planning the next community festival, potholes in the streets, stray animals getting into the trash, not to mention the citizens who come before the board to voice concerns and complaints. Around 9:00 p.m., the mayor/board president turns to the operator and asks how things are going at the water/wastewater plant. Everyone is tired, worn out and ready to go home.

They really don’t want to hear about the compliance concerns, money that needs to be spent, etc. So, the operator says everything is fine. The meeting is adjourned and everyone goes home. Two weeks later, the mayor/ board president gets the letter from DNR regarding the results of the latest sanitary survey. It lists 102 items of concern with the water system. At the next meeting, the mayor/board president is mad (after all the letter is addressed to him/her directly)! The result is the operator looks incompetent for not being on top of things and the city/district (in the opinion of the mayor/board president) has a black eye as a result!

There are several things that work against an operator when dealing with an elected board. First, board members can change every two to four years, depending on the type of seat/organization. Second, chances are the people who are elected to fill these seats are very limited 34

in their knowledge about utilities and what it takes to operate and maintain them.

So what is an operator to do? How can we be more visible and get our message across more effectively so that decision makers understand how important it is to operate and maintain a safe, healthy utility? Here are some suggestions: 1. Be the first on the meeting agenda! I would bet the water/wastewater infrastructure in most communities is the most expensive asset in town. The problem is most of it is underground (out of sight-out of mind).

Wouldn’t it make sense to discuss the most expensive asset first? After the meeting is called to order and the “housekeeping” items are taken care of (approval of minutes, bills) the utility report should be next - before the festival planning, potholes and trash issues.

2. Present a WRITTEN report to the board members. This doesn’t have to be fancy. It could even be hand written. But a written report is important! It should list items that were completed since the last meeting, items to be completed over the next month, and items of particular concern. It should be one page in length (no one has time to read a novel, so make it brief and to the point). This makes sure the board members get an idea of how much work is being done and what is needed in the future. Show them you do more than just ride around in the company truck all day!

3. Make sure your written report is included as part of the meeting minutes. It then becomes part of the permanent record of the city and is available for review should you need to go back to it sometime in the future.

4. Look and sound professional when presenting to the board. This doesn’t mean you show up in a suit, but come groomed and prepared. Review what you are going to report to the board and be prepared to answer questions. Studies have shown that people form their opinions in the first few minutes of meeting/seeing someone before any words are spoken. Make sure your first impression is a good one! It sounds easier than it is. Honing your communication skills take time and practice. Many operators complain that they tell their board the same thing over and over again and nothing happens. It may take more than once to get your message across. Studies have shown that on average, you have to tell someone seven times before it finally clicks! So, keep telling them,

both verbally and in writing. Eventually, things should get better and you will have more understanding and respect from your elected officials.

A sample of a water operations report is shown. The format can be changed and information adjusted to suit your particular utility. This sample shows quite clearly the work that has been performed and some of the major issues facing the utility.

With hundreds of Office Professionals, Vendors, and Water & Wastewater Operators in attendance, the week was a successful combination of events; all things water and wastewater. The conference week began on Tuesday, October 25 with the Office Professionals Seminar and ran through noon Friday, October 28 with the conclusion of the Fall Operations & Maintenance Symposium.

Attendees had opportunities to gain valuable information from training sessions, from vendors of state-of-the-art water & wastewater technologies, and from colleagues.

MRWA member and non-member system operators alike were in attendance at this event. Let’s take a closer look at what MRWA offers water & wastewater systems.

Conferences: Every year, MRWA hosts four conferences. An Annual Conference in February/March, the Bootheel Expo in August, and Fall Conferences (a 2-conference event for Office Professionals and Water/Wastewater Operators) in October. At present, these conferences are designed to give water and wastewater operators ten renewal hours per conference. In theory, if an operator attends one conference per year, he/she would receive all required recertification hours needed for license renewal within the three-year life of the certification. MRWA member and non-member system operators alike were in attendance at this event. The cost benefit to a member system operator at this particular event (Office Professional’s Seminar/ Fall Operations & Maintenance Symposium) would be

a savings of $55.00 on registration price and a cost savings of $65.00 on registration price to an office professional. To a smaller system with a smaller budget, this could be the deciding factor whether a system’s board or council approves their personnel’s attendance.
