2018 Good Neighbor Awards Realtors® and affiliates are well known for their generosity and giving spirit. In past years, only one person was recognized for the Good Neighbor award. This year, the Salt Lake Board of Realtors® honored four members for their extraordinary service and dedication to three different causes that benefit the community. The 2018 Good Neighbor recipients included: Chris MacPherson and Heather Nelson (Children’s Christmas Carnival at The Road Home Shelter) Lisa Jungemann (Suicide Prevention Awareness) and Rachel Green (Love Lake City).

Americans who are moving out of state tend to be heading south, according to a new analysis by LendingTree, a loan information source. Researchers analyzed more than 2 million new purchase mortgage loans to see where people are moving to and from. Florida was the winning destination, according to the analysis. It was the top destination for movers who were relocating out of state in 15 out of the 50 states. Texas was also one of the top destinations for people relocating from other states. Alaska was the state that had the most residents looking to move away. The study found the top destination for those leaving Alaska was Washington state. Roughly 12 percent of Utah residents were looking to move out of state. For Utahns moving out-of-state the top new destination state was Idaho. Many Americans who do move out of state don’t tend to go that far. More than half of the most popular relocation states border the person’s current state.

Shelly Tripp, Coldwell Banker Residential Brokerage (South Valley) Shelly Tripp understands people and the struggles they face in life. Shelly grew up in less than ideal circumstances. Her father was a drug dealer, and her mom battled alcoholism. For a short period of time, Shelly was homeless. Yet, she was determined to create a better life. She moved to Utah and at the age of 27 earned a real estate license. In her first 18 months as a Realtor®, she sold 47 homes. Since that day Shelly has built an unmatched real estate career and consistently been a top producer. Her success in real estate is complemented by a lifetime of service. She helped organize and implement the Board’s Kids Fest Carnival and has served on numerous committees. She serves on the board of directors for Christmas Box International, an organization dedicated to improving the quality of life for children, teens, and young adults who have been abused, neglected, or are facing homelessness. Since February 2017, Shelly has volunteered dozens of hours every week to help inmates at the Salt Lake County Jail and Utah State Prison by facilitating and conducting an addiction recovery program, as well as conducting Sunday worship services for the inmates. Each inmate in this program goes through a 12-step process to learn how to overcome and heal from their addictions. “Shelly is a survivor in the true sense,” said Linda Geer, managing broker of Coldwell Banker Residential Brokerage (South Valley). “She’s definitely committed to making a difference in people’s lives. “She’s unselfish, humble, and kind. If you’re doing a deal with her, it’s a win-win situation. I’ve worked with her my whole career and been her manager for the last six years. I’ve never had a complaint about her. She tries to make the world a better place around her. She’s amazing.”

Julie Krushensky, First American Title Insurance Julie has been in the real estate world for 13 years. She has been a sales representative for First American Title for eight years. She was previously a Realtor®. Julie currently holds two leadership roles. She is the president of the National Association of Hispanic Real Estate Professionals (NAHREP) Utah Chapter and is the chairwoman for the Affiliates Advisory Board.

Love Lake City helps as many people in the community as possible through monthly service and volunteer projects. The group served breakfast to those at the Ronald McDonald House in September. The August project was an individual project to recognize kindness. In July, we served sandwiches, water, and pizza to hungry folks downtown. Lisa Jungemann, Windermere Real Estate Utah (Ft. Union) Suicide Prevention Awareness In March 2013, Lisa Jungemann’s life changed forever after she lost her 18-year-old son Matt to suicide. Since then, Lisa has shown incredible strength by raising awareness and money for suicide prevention. In Utah, suicide rates are skyrocketing and are now the leading cause of death for Utah youth. Through her work, Lisa helps save lives and brings hope to those affected by suicide. Chris MacPherson, Academy Mortgage & Heather Nelson, Utah Key Real Estate Founders, Children’s Christmas Carnival at The Road Home Shelter Chris and Heather organized and hosted the Children’s Christmas Carnival in June at The Road Home shelter in Midvale. More than 70 volunteers took part in the day’s event, helping 300 people at the shelter. Volunteers and local businesses raised $20,000 to make the activity possible. Backpacks filled with toys, clothing, and everyday supplies were given out to each person at the shelter.

Four Things Every Realtor® Needs to Know By Curtis Bullock CEO, Salt Lake Board of Realtors®
Properly accepting or countering an offer Scenario: Suppose the Buyer makes an offer using the REPC. The Seller is happy with most of the terms of the offer except she would like the Settlement deadline moved up a week. The Seller signs page 6 of the REPC and checks the “Acceptance” box and then sends it back to the Buyer with a Counteroffer attached that includes the new Settlement deadline. Are you under contract? Or, is this a counter offer? Answer: It’s a counter offer. You are most likely not under contract yet. The thing to remember is that if you are changing even one thing on an offer, it cannot be an acceptance. So it was incorrect for the Seller to check the “Acceptance” box on page 6 of the REPC. Instead, the Seller should have checked the “counter offer” box on page 6 of the REPC and then sent the counter offer sheet along with the REPC back over to the Buyer. At that point the Buyer could accept, counter or reject the Seller’s counter (i.e., the changed Settlement deadline). All the other stuff

in the offer not changed by the counter remains the same and is accepted. Remember this in multiple offer situations Scenario: How should you withdraw an offer or counter offer? Let’s suppose your Seller has countered an offer from Buyer No. 1. Soon after, Buyer No. 2 makes a better offer. The Seller would like to consider Buyer No. 2’s offer but realizes there is an outstanding counter that Buyer No. 1 is considering. How should the listing agent withdraw the counter? Answer: The first thing you should do is pick up the phone and call Buyer No. 1’s agent and verbally withdraw the offer. As soon as that conversation happens, the offer is legally off the table. If you don’t get the agent live on the phone, leave a message and try sending a text. You might also try calling the broker. But to make sure you have a paper trail, after you verbally communicate the withdrawal, have your Seller sign the “Seller’s Notice of Withdrawal of Counter Offer” form and
send a copy to the agent. If the situation were reversed and the Buyer was withdrawing their offer, the Buyer’s Agent would do the same thing and call the listing agent and verbally withdraw the offer or counter offer and then use the “Buyer Notice of Withdrawal of Offer / Counter offer” form. New UAR forms give notice According to Kreg Wagner, legal counsel for the Utah Association of Realtors®, the UAR Forms Committee recently approved four (4) new forms for our membership. These forms are simply “Notice” forms. In some of the UAR addenda, there is a requirement for the Seller or the Buyer to give written notice the other party. The committee has gone through the entire forms library and identified when notice is required. The new forms include: 1) Seller’s Notice to Buyer of Accepted Offer (Time Clause Addendum). 2) Seller’s Notice to Buyer of Substantial Completion (New Construction). 3) Seller’s Notice to Buyer of Accepted Offer (Multiple Offers Addendum). 4) Buyer’s Notice to Seller of Termination of
Buyer’s 3rd Party Contract (Subject to Sale of Buyer’s Property Addendum). Updates to the UAR agency agreements The UAR Forms Committee has approved updates to the Exclusive Buyer Broker Agreement and the Exclusive Right to Sell Listing Agreement. These updates incorporate the new Wire Fraud Alert Disclosure Form as part of these agency agreements. This means that going forward, you need to have your clients sign the Wire Fraud Alert Disclosure Form. By having the Wire Fraud Alert Disclosure Form signed, you are providing another reason for why people should always use a Realtor®. It absolutely is an added service that you are providing to your clients and, in turn, will help you protect your clients, your brokerages, and you personally from real estate wire fraud issues and liability. ver the past four articles, we have done our best to explain to newcomers and experienced Realtors® alike what the Realtors® Political Action Committee is and what the Government Affairs Department of the Salt Lake Board of Realtors® does every day to support our Realtor® members. We have addressed the basics of RPAC, how we choose what candidates to support in local elections, how political advocacy works, and why fundraising matters. For the conclusion of our five-part series into “What is RPAC,” we take a step into the future. Particularly, we will be looking at what is to come in 2019 for RPAC and the Government Affairs Department at the Salt lake Board of Realtors®. 2019 will be a very busy year for campaigns. It is the year where the majority of city council positions in the county will be up for election. There are also some very contentious mayoral races that will be occurring within the valley; Salt Lake City and West Jordan are two of the biggest that come to mind. Some of our very own Realtors® will either be defending council seats they hold or challenging incumbents to fill their seat. We at the Salt Lake Board of Realtors® will be monitoring these elections closely and working with our RPAC Trustees to make smart, educated decisions as to who we will be supporting in each of these races. We will interview these candidates extensively and assist in any way we can to ensure that those elected to office value the real estate profession, and support our profession not only in words, but through the actions they take. The Government Affairs department of the Salt Lake Board of Realtors® is in good hands under the direction of Marcus Jessop (our Government Affairs Director) and ready for this campaign season. In 2019, the SLBR will also be opening a new chapter in our Government Affairs mission: placing a larger emphasis on proactive public policy work. I will be taking the reins and putting together a new strategy as to how we can help many cities and towns become friendlier to private property rights issues that help not only Realtors® but also homeowner. This will include analyzing hundreds of pages of city ordinances to find burdensome regulations that negatively affect growth and development. These regulations involve impact fees, sign ordnances, and door-to-door solicitation. I will be using a variety of tools including research studies, public polling data, and focus groups to help demonstrate to these council members and mayors why making changes will be beneficial to not only Realtors®, but to the entire city/county as a whole. All in all, I
am very optimistic that we will be able to assist in making meaning additions and amendments to the cities we choose to target. In order to support these missions, we need your help. Luckily there are a number of ways for you to get involved. The first would be to show up to our Government Affairs Committee meetings which take place on the first Wednesday of every month at 9 a.m. in the Salt Lake Board of Realtors® auditorium. At these meetings we bring in speakers who represent key stakeholders in municipalities
around the valley, go over any major policy issues affecting our industry, and break into our sub-committees that include events, elections, and community outreach. This is a great way to show your support for your industry and get involved in key issues around the valley. We also need your help in interviewing candidates who are running for office. Like I mentioned above, this will be a busy time for elections and we anticipate that there will be a sizeable number of interviews occurring. This would be a great opportunity if you would like a chance to personally vet the candidates who are running for office before we allocate any funds. Lastly, we need you to invest in RPAC. Without your support, nothing we have talked about during this entire series would be possible. Your RPAC contributions play the largest role in ensuring Realtor® friendly candidates are elected to office. A: Staying focused on doing the tasks consistently that need to be done. I have been reminded by a great leader, the little things matter. Keep doing the little things. Q: What advice would you give to someone who is a new agent? A: Soak up all the education and training you can. The more you learn, the more confident you will be and that will radiate outward and your network will want to do business with you. Create value for people. Q: How many homes did you sell in the first year after getting your real estate license? What made you successful? A: It took me years to grow my network and now 16 years later, 98 percent of my business is referrals from past clients and friends. Working with someone that has been referred to me, makes it really fun and rewarding. Q: What do today’s home buyers and sellers look for when choosing a Realtor®? A: Today’s home buyers and sellers look for a Realtor® they can trust to guide them through the technical process. Someone who adds value through great advice, negotiation skills, beautiful photography, marketing, and online presence. Home prices increased across all Wasatch Front counties in the third quarter year-over-year. Davis County was up 10.9 percent; Salt Lake up 9.2 percent; Tooele up 14.6 percent; Utah up 11.3 percent, and Weber up 9.6 percent. Mark Shepherd of Layton-based Shepherd Real Estate Group received the 2018 CRS of the Year award from the Residential Real Estate Council Utah Chapter. “I’m honored to receive the CRS of the Year award,” Shepherd said. “It means a great deal to me.” In 2014 and 2017, Shepherd was awarded the national CRS President’s Award. The Residential Real Estate Council Utah Chapter had the highest membership growth of all 50 states in 2018. The national RRC recognized Dawn Stevens, 2018 RRC Utah Chapter president, for the tremendous growth over the past year. “I would like to give a huge congratulations to the entire team: Ian Wood, 2019 president, Matt Dulle, CRS ambassador, Heather Nelson, Terry Simmons, Nancy Blum, Bob Goodson, Cory Sue Cutler and Klair Gunn,” Stevens said. “Way to go!”
Merilee Rowley, principal broker of Selling Salt Lake, recently donated a kidney to her little brother Zack Jacobson, 24. Zack’s kidneys were permanently damaged when he was 11 years old from a surgical complication. “I’ve been telling Zack he needed to be nice to me because I would be his match,” Merilee said. Merilee’s recovery took six weeks. The transplant surgery was a success.
