Hire Foreign Workers with An LMIA International Mobility Program!

Before recruiting foreign labor, firms must typically get govt approval through Labour Market Impact Assessment (LMIA), formerly earlier known as a Labour Market Opinion (LMO).

When a Canadian business cannot get a desired local Canadian worker for their business, an LMIA is issued. The main mode of establishing this is by publishing job openings in Canada and trying to recruit Canadians, demonstrating that the candidates lack the necessary skills for the position being provided.

After submitting an LMIA application, a company must wait for a letter of approval from Employment and Social Development Canada. A positive LMIA, often known as a "confirmation letter," is a document that attests to the requirement to employ a foreign worker. Possessing a job offer letter, a contract, a copy of the LMIA, and the LMIA number, the prospective employee can apply for a work visa when the business obtains the LMIA.

New Rules for LMIA International Mobility Program Canada A few recent minor adjustments have been made to the LMIA procedure for 2021! Only two categories—high-wage and low-wage—will be used to classify job positions under the new LMIA system. Jobs are categorized as high-wage or low-wage depending on whether the pay is at or above the median wage of the province in which they will be done. The application price for LMIA requests has increased from $275 per worker for LMOs to $1000 per worker.

Essential Requirements for LMIA Program

Hiring Low-Wage Workers For requesting an LMIA, a Transition Plan is not required when hiring low-wage workers. Lowwage workers are subject to a limitation that restricts the number of employees a business can hire, unlike high-wage workers.

Employers in Canada with more than 10 workers will only be allowed 10% of low-wage temporary foreign workers. This cap will be gradually implemented over the next two years to give Canadian employers time to switch to a Canadian workforce.

Hiring High-Wage Workers All Canadian firms wanting to engage a temporary foreign worker(s) at a wage equivalent to or beyond the provincial/territorial median hourly wage must have a transition plan before hiring high-paid foreign employees. A Schedule C form for the LMIA application contains the Transition Plan. The Transition Plan outlines the commitments a business has made concerning the profession and place of employment for which they are looking for TFWs.

After LMIA Approval, What's Next?

You should send a copy of this letter and Annex A to the foreign worker after your LMIA application is granted. The international worker can then apply for a work permit after that!
