AssetsandOperationsDirectorShaneWaldensaid sometendersweresignificantlyhigherthanwhatofficers hadbudgetedfor.

"Sometendersarecomingashighas30percentover budget,"hetoldcouncillorslastweek.

"Thisisnotsustainable,andthereisnobudgettocover theseunexpectedincreasedcosts."

MrWaldensaidover-expendingthebudgetwasnot acceptableandchoiceshadtobemade.

Projectswereassessedbasedongrantfundingwith requirements,andimmediatereliabilityandfunctionality concerns.Tenderssignificantlyoverbudgetincluded thoseforBarkleySquareresurfacing($215,000)and RiddellsCreekRecreationRoomworks($120,000).Both wereassociatedwithgrantfundingandthecouncilwas

Bcontractedtodeliverthem.

Sevenprojectswereidentifiedthatcouldcoverthe shortfallinthetwoprojectsincludingcuttingsomeprojects.

Thosetogetaxedforthisfinancialyearincluded: LancefieldandWoodendswimmingpoolchangerooms, KynetonHurryReserveDesignandPlanning,and GisborneShireOfficeroofdesignworks.Theseprojects willbeconsideredfor afuturebudget.

Fundingwasalsorecoveredfromscheduledprojects alreadycompleted,andthosewith abudgetsurplus.

MrWaldensaid acontributingfactortocouncil's positionwassignificantpricerisesacrossbuilding materialsduringthe2021/22financialyear.

TheMasterBuildersAssociationreportedthatbetween March2020andMarch2022,steelproductsincreasedby morethan40percentandtimberproductsbyover20per cent.Laboralsoincreasedsignificantly.

"Anotherimpactistheshortageofcontractors,"Mr

Waldensaid. AreporttocouncilrevealedMRSChas experiencedtenderswheretherewaseitheronlyone responseorzeroresponsesand/ornon-complianttenders.

MrWaldensaidthecouncilbudgetbuildprocess beginsinOctoberofthepreviousyear.Thismeanspricing isalreadyoutdatedbyninemonthsbeforethebudget yearstarts.Hesaidsomeinfrastructureprojectswillnot betendereduntilmorethan12monthsaftertheinitial estimateswereset.

"Officersallow areasonablecostescalationonproject costs,however,thecostincreasesexperiencedwere outsidethisestimate,"hesaid.

Councillorsvoted7-1infavouroftheofficer recommendation.CrGeoffNeilwastheonlychallenger, stating"thisnotgowithoutgriefinthecommunity".

CrNeilsuggestedthecouncilcouldmakeupthe shortfallinthenextbudget,however,councillorsgenerally feltoptionshadbeen"thoroughlyconsidered".

Theprojectswillbedeliveredby ParksVictoriaandtheDepartmentof Environment,LandWaterandPlanning,alongwithpartneragenciessuch asMelbourneWaterandlocalgovernments.

CWAmembershavebeenbusydoingtheir bitfortheenvironmenthelpingtocutdown onclothinggoingtolandfillbyrepairingor recyclingandrepurposingclothingthatwould otherwiseendupatthetip.Around800,000 tonsofclothesandfabricsendupinAustralian landfillseachyear.

From11amonthedaythegroupwillbe sellingcakesandproduce,plants,rugs,handmadetoysandclothingitemswhichhavebeen savedfromlandfill,launderedandrepaired.

Lastweek,MacedonRangesShire CouncilreleasedtheCFA'sdraftproposal torelocatethebrigade'sstationfollowing a lengthysearchfor asite.

TheCrownlandreserve,zonedpublic parkandrecreation,at26-32Sutherlands Roadwastheonlyoptionnotdiscountedof morethan25considered.

"TheCFAidentifiedchallengeswith manyoftheproposedsites,rangingfrom unsuitablesize,potentialoverlays,unsuitableoperationallocationsandowners unwillingtoconsidersale,throughtotraffic impacts,accessandpotentialflooding," a reporttocouncilsaid.

Needsforbothrecreationallandand afirebrigadeoperatingtoitsfullestare imperativetothetownslatedforgrowth.

BrigadecaptainMichaelHemingway saidthecurrentstationat67MainRoad was"wellandtrulyinneedof areplacement".

"Thesitenolongermeetstheneedsof thebrigade,doesn'tfitourcurrentfleetof tankersandispastitsusedbydate,"Mr

Hemingwaysaid.

"UnfortunatelythecostoflandinRiddellsCreekhasbecomeexorbitantand availabilityislimited."

Thebrigadewasscheduledtoreceive areplacement heavytankerin2019but wasforcedtorefuseduetothestation's limitations.

Suchanupgradewouldhavedelivered largercapacityforwatercarryand acrew cab(not aluxuryofthecurrentvehicle),as wellasothercomfortssuchasairconditioning.Itwas ahugeblowforoneoftheshire's busiestbrigades.

Thatsameyear,localMPMary-Anne Thomasannouncedthebrigadewould have anew $3millionstationon alarger siteby2021.

Thenewstationwasexpectedtofeature athree-baymotorroom,supportandmeetingareas,offices,turn-outareasfor firefighters,aswellas akitchen,trainingyard, communicationsinfrastructure, fencingand acar park.

Thatpromiseisnowoneyearoverdue andtheselectedsitenowpendingcommunityconsultation.

AreporttocouncilsaidcommunityfeedbackwouldprovidekeyinputinconsiderationoftheCFA'sproposal,oralternatives putforward,and help toidentifysolutions.

Legalaction overcreek

Agroupoflandholdershavethreatenedlegalactionoverthedischargeof Class BrecycledwaterintoDeepCreek inthe Romsey area.

GreaterWesternWaterbegancontrolledreleasesfrom Romsey Recycled WaterPlantlast month attributedto a riseinstoragesfromsustainedheavy rainfall.

Thereleasehas contaminated the creekwhichthosefrontingitusefor bothhouseholdand farming purposes.

Landholders maintain thebanksand creekbedsontheirpropertiesarenot Crownlandwithlandtitlespre-dating the1880s.

"Wherethelandownersalongthe creekownthebedandbanksofthe creek,thendischargingwastewaterinto thecreekconstitutesillegalandactionable common lawnuisance,"Monegeetta farmer RandallGerkenssaid.

In2019WWagreedinwritingitwould notseek alicence(orlicence amendment) fromtheEPAtodischargeinto DeepCreekwithoutgivingus14days writtennotice.

Thisarrangement wastocontinue whenWW merged intoGWW.

"Theundertakinggiventouswasunconditionalandnotsubjecttoanexceptionforan emergency orheavyrainfall," MrGerkenssaid.

MrGerkensispartofthegrouppreparingtotakelegalactionandisalso callingontheMinisterforWatertosack theboardandsenior management of GWW(seetheletteronpage20).

GWWstatedlast month itexpected thereleasesofClass BwatertocontinueintoOctoberuntilstoragesatthe Romsey RecycledWaterPlantreturnto normal.

Malmsbury'sRossRoadresidents havebeendeniedaccessoverthestreet's historicbluestonebridgeuntilsafetyrepairs aremade.

Manyresidentswereleftfrustratedlast weekwithnonoticeorexplanationofthe closure,andforcedtore-routeusingwhat somedescribeas"pot-hole-riddendirtroads thatposemoreriskthanthebridge".

Thebridgehasbeenblockedwithsigned fencingandreducedtowalkingtrafficonly. Initially,residentsweretolditcouldbeup to18monthsbeforeitwouldbeaccessible againbyvehicle.

WhileMacedonRangesShireCouncil admittedfaultwithearlycommunications, AssetsandOperationsDirectorShane Waldensaidanassessmentofthebridgein Mayidentified astructuralrisk.

Hesaidsitevisitsweremadethenext Tuesdaytohand-delivertheoriginalletter and afollow-upletterwithfurtherinformation.

"AllhousesintheRoss,Young,Raleigh andBaldrystreetswerevisited,withallnotifiedregardingthetemporaryclosureofthe bridgetovehicles,"MrWaldensaid.

DaylesfordDistrictCommunityBank's commitmentiscontingentonthestategovernmentfunding a$75millionredevelopmentofthe160-year-oldhospital.

DaylesfordHospitalUpgradeAppeal CommitteeChairLesleyHewittsaidthe bank'spledgesupportsdeliveryofthe precinctmasterplanforthelongerfit-forpurposehospital.

Shesaysthatcommunitycanbedefinedinmanyways, butwhensimplifieddowntoitsmostimportantelement, communityisallaboutconnection.

Ifyou’veeverfeltlikeyoudon’tfitin,youknowitcan be alonelyexperience.Communityprovides asenseof belonging —agroupyouidentifyasbeing apartof.Thisis differentthanconformingtobein agroup. Atruesenseof belongingincludestheabilityforyoutofeelyouare apart ofthecommunityasyourtrueself.Thereisnotanything youhavetochangetobe apartofthecommunity,but instead,youareembracedandappreciatedforyouruniquequalities.

eTheaward-winningLive4Lifeprograminlocalsecondaryschools,withitsYouth MentalHealthFirstAidcourses,isanexampleof akeyinitiativeMacedonRanges ShireCouncilhasimplementedtohelpaddresstherisingconcernssurroundingmental healthissuesamongyoungpeople.

TheprogramwasdevelopedandintroducedintosecondaryschoolsintheMacedon Rangesin2010following acommunity-wideresponsetoanincreaseinyouthmental healthproblemswithintheshire.Itaimstoaddressconcernsaroundyouthmental healthandensureyoungpeople,teachers,parentsandthewidercommunitywere betterinformedandproactiveinidentifyingthesignsandsymptomsofanemerging mentalhealthissuebefore acrisisoccurs.

Sinceitsconception,theLive4Lifeprogramhasexpandedtoincludeninerural communitiesinVictoria,andmorethan20otherruralcommunitiesnationallyhave expressedinterestinimplementingthemodel.Itwasalsoawarded aVicHealthAward as agroundbreakinginitiativein2018.

Theprogramhasbeeninstrumentalinhelpingtosetupanddelivermentalhealth educationforyoungpeopleandadultsacrossthe stateandtoprovidespecialised trainingprogramsinMentalHealthFirstAid.

ThenextYouthMentalHealthFirstAidcoursewillbeheldat6pmonWednesday October26atMannaGumFamilyandChildren’sCentre,Gisborne.Thecoursewill runforfourclassesandcoverhowtohelpyoungpeopleexperiencingmentalhealth problems,andwillincludecasestudies,filmsandgroupdiscussions.Costis$37.50for residentsintheshireand$190forallothers.

Fundsraisedwillassistthesociety withtheongoingmaintenance, preservationandpromotionoftheir localcollection.

Thewalkingtourswilltakeplaceon SundayOctober16at10amand 2pmandwillrunforanhourand ahalf.Visitingthesignalboxwill involvestairs.

Nightdrivingpracticewhenyouareonyour 'Ls'couldjustsaveyourlife. Nighttimeisprimetimeforyoungpeople dyingonourroads. Researchshowsthatintheirfirstyearon

theroads,P-platedriversarearoundseven timesmorelikelytobe killedorinjuredwhile drivingatnight,comparedtofullylicensed drivers.

Onaverage,around31first-yearP-platers

arekilledorseriouslyinjuredwhile drivingatnightinVictoriaeachyear, withapproximately50,000newdrivershittingtheroadannually.

TheTransportAccidentCommission hasre-launcheditscampaignurging parents,guardians,andsupervisors toeducatelearnerdriversaboutthe hazardsthatcomewithnighttime drivingandhelpingthemtogetat least20hoursofsuperviseddriving experienceafterdark.

TheParentalControlcampaign featuresprominentlyacrossdigital, radio,pressandoutdoorplatforms andcomesas adisproportionate numberofyoungdriversarebeing killedonVictorianroads.

Sofarthisyear,youngdriversaged between18and25havemadeup around20percentofalldriverfatalitieswhilethisagegroupaccounts forapproximately10percentofall licenceholders.

Ofthe14driversinthisagegroup killedin2022,sevenofthecrashes haveoccurredbetween6pmand 6am.

ThecampaignsupportstherequirementforVictorianlearnerstoobtainatleast 20night-timedrivinghours,aspartoftheir 120hoursofsupervisedexperience,before receivingtheirprobationarylicence.

RACV’smobilityapp,arevo,hasadded anewFuelFinderfeaturetohelpusers savemoneyatthefuelbowserbyproviding regularlyupdated,specificfuelpricingfrom retailersacrossVictoria.

Previouslypriceswereprovidedinprice ranges,notspecificprices.

TheFuelFinderincludesaninteractivemap thatallowsuserstobrowseandcompare pricesatpetrolstationssotheycanmake economicchoicesonwheretofillup.

Acoupleofyearsago Ireturnedhome tofindtwotreesplantedonthenaturestrip atthefrontofmyproperty.Theywerea redmaplevarietywith amaturingheight ofeightmetresandwereplanteddirectly underpowerlineswhicharesevenmetres fromthegroundattheirlowestpoint.

After athreeweekbattlewiththeMRSC theyfinallyrelentedandreplacedthe mapleswithcrabappletrees.

Butwhathappenednextiswhatclearly demonstratestheilkoftheMRSC.

WithinsixmonthstheMRSCrevised theStreetTreePolicy,renamedittheTree ManagementPolicy,andyep,youguessed it,deletedtherequirementfor athreemetre offsetfrompowerlines.

With astateelectionjusttwomonths away,roadusersintheBendigoregion woulddowelltoreflectonthesteadydeclineofservicetheyreceivefromRegional RoadsVictoria.

First a'roadworks'speedlimitisimposed ontheCalderFreewaybetweenHarcourt andFogarty'sGapRoadwithnoreason given.

Apparentlythedefectiveroadpavementthathasbeenthereforyearsdrew theirattentionbecauseofthesafetyhazard presentedtodriverswhochangelanesin thewet.

Thespeedlimitisthereregardlessof whethertheroadiswetornot.Theresultis asituationevenmoredangerousthanthe problemwiththeroadsurface.Thisisnot theonlysectionoftheroadbesetbythis problembutitistheonlysubjectoftheir attention.

Thenwehavethewitcheshatsblocking off alaneaccompaniedby a60km/hspeed limitneartheRavenswoodinterchange becausethepavementhasbeendamaged byrain.ItwouldappearthatRRVisnow allowingthisgoattrackof afreewaytofall apartbeforeoureyes.

In2019,webecameawarethatWestern Water(latermergedintoGWW)wasproposingtodischargewastewaterfromitsRomsey sewageplantintoDeepCreek.Inresponse, wepointedoutitwouldbecommonlaw nuisance.

Atcommonlaw,onepartycannotdischargewaste(nomatterhowallegedlyclean and/orsafe)ontoanother party'sproperty and,ifitdoesso,itwill beliablein damages andtoaninjunction.

WWperhapsthoughtitcoulddischarge intothecreek withoutpenaltybecausethe creekwouldberegardedasCrownland.

However,wepointedoutthat landowners alongthecreekownthebedandbanksofthe creek.This isbecauseoftheageofthetitles –withthe initialCrowngrantsbeingissued beforethethencolonialgovernmentstarted reservingwaterwaysasCrownreservesin the1880s.

Wherethelandownersalongthecreek ownthebedandbanksofthecreek,then dischargingwastewaterintothecreekconstitutesillegalandactionablecommonlaw nuisance.

WWagreedtoprovide awrittenundertakingtousandotherfarmersalongthecreek thatitwouldnotseek alicence(orlicence amendment)fromtheEPAtodischargeinto DeepCreekwithoutgivingus14days'written notice.

WhenWWmergedwithGWW,we requiredthemtoconfirm theywereboundby theundertakinggivenbyWW –which they didconfirmbyletter dated July2021.

OnSeptember20,GWW adviseditwas going aheadwithan"emergency" discharge ofsewagewastewaterbecauseoftheheavy raintheprevious weekend.

Theundertakinggiventouswasunconditionalandnotsubjecttoanexceptionforan emergencyorheavyrainfall.

Thefactisthatrainfallthisyearhasnot beenexcessiveandGWW(andWW)has beenawaresince2018thattheRomsey sewageplantwasinadequatebuthavetaken nosubstantivestepstorectifythesituation.

Theenvironmentalimpactoftheillegal dumpingofsewagewastewaterinDeep Creek,whichishometoendangeredplatypus andnativefishspecies,willbecatastrophic andmakes amockeryoftheVictorianGovernment'scommitmenttoenvironment.

Theunconscionableandunethicalaction ofGWWmakesitimpossibleforthecommunitytohaveanyconfidenceortrustinGWW, itsboardandseniormanagement.Youhave adutytoact.

At arecentmeetingoftheMacedon RangesHeritageCouncil,madeupofthe

Anewpetanqueinter-clubcompetitioncalledThe GoldenBoulehasbeencontestedbyfourclubsfromthe Goldfiedsregion.

TwoteamsoffiveplayersfromMountMacedon,Maldon,SmythesdaleandBallaratpetanqueclubscompeted in aroundrobinhomeandawayeventheldeverythreeto fourweeksduringwinter.

Thecompetitioniscoordinatedbythefoundingclubs, MountMacedon(basedinGisborne)andMaldon.The

purposeofthetournamentistoprovideanopportunityfor clubplayerstoparticipatein afriendlycompetitionintheir ownregionandtopromotethegameofpetanque.

Thetournamentwas agreat successwithmanyplayers nowfeelingconfidenttocompeteinotherevents.

Playerssharedknowledgeofrulesandtacticsand enjoyedthemselvesimmensely.

Petanqueis auniquegameandhasagrowingpopularitybutisoftenconfusedwithitsItaliancousinbocce.

Theboardproposes astrategicvision forthenextfiveyears,andwithBowls VictoriarecentlyreleasingitsStrategicPlan itishopedclubswilldemonstratehowthey intendtobringbowlstoeveryoneintheir communities.

ApresentationdayforTheGoldenBoulewasheld inBallaratonSeptember17.Socialgameswereplayed withmixedteamsdrawnoutofthehatfromallfourclubs, followedby acommunallunchandthepresentationofthe trophy.Heavyraindidn’tdeterplayerswhoshowedgrit anddetermination.ThewinningclubwasMaldon,followedbyMountMacedon,SmythesdaleandBallarat.Best playerofthetournamentwasBarryDroneyfromMaldon. Nextyearthecompetitionisgoingtoexpand.
