Do not wear campaign gear or bring political literature to the polls. Michigan prohibits wearing, or displaying, election-related materials at the polls, including clothes, buttons, pamphlets, fliers, stickers, etc. Such items may not be displayed in the polling place, or within 100 feet of the entrance. If you go to vote with a shirt, button, or sticker that depict images of candidates, or campaign slogans, you will be asked that they either be covered or removed.

By law, every Michigan voter must present a photo ID at the polls, or sign an affidavit attesting that he or she either does not have or is not in possession of proper ID. Convicted Felons Have

Voting Rights There has been much hearsay concerning convicted felons and their right to vote. There has been misinformation or lack of information surrounding this issue. As a result, research was done with the aid of the City of Detroit Law Department.

The purpose is to help readers understand or have firsthand knowledge of how Michigan election law addressed this burning question.

The question is, is there a provision in Michigan Election Law that allows those who have past criminal convictions and served time in prisons, their right to vote in elections?

In Michigan, convicted felons are restricted from “voting only while confined in prison” (Michigan const.

1963. Art. 2 Sec 2” 1954 PA 116, Sec. 758b; MCL 168.758b; MSA 6.1758(2).

Election laws are different in many states. Therefore, it may be true in some states that a criminal conviction of a felonious nature may automatically terminate an individual’s right to vote. In Michigan, the voting right as a citizen is still intact for those who served time in prison after felonious convictions. Even if the convicted person is on probation (meaning that

he or she is not confined in prison) that person can vote in an election.

Those in jail awaiting arraignment or trial also have the right to vote by absentee ballot, in compliance with the Michigan election law: O’Brien v Skinner, 414 US 524;94S Ct 740,38LEd2D702 (1974) and Arlee v Wayne County Sheriff55Mich.App340;222NW2d233 (1974) both to the effect that persons confined in jail awaiting trial cannot be deprived of the right to vote by absentee. See also section 492a and 758 of the Michigan Law supra, respectively MCLA 168, 472a; MSA 6.1492(1) and MCLA 168.758; MSA.1758.

Michigan Chronicle picks for Detroit School Board After careful consideration, the Michigan Chronicle has chosen to endorse the following seven candidates for the Detroit Public School Board. All seven were chosen from the list of those who responded to our candidate questionnaire.

Ryan Mack — Mack’s demonstrated commitment to working with young people, teaching them about the importance of financial literacy, really caught our attention. That plus his financial background and expertise.

This kind of background is obviously needed and would be a strong plus. Also, candidly speaking, it would be good to have another

black male on the board. (Kevin Turman is also one of our choices) Sonya Mays — Although there will no doubt be a loud contingent strongly opposed to Mays because of her affiliation with Emergency Manager Kevyn Orr, her experience with both finance and business, as well as in the non-profit sector, are strong reasons to recommend her.

Plus Mays is the daughter of a DPS teacher and a graduate of DPS, which will provide some necessary cover to defend against detractors. Mays’ record clearly shows her commitment has always been for the betterment of Detroit, even if her choices weren’t in line with others who disagreed with that path. The bottom line is that her depth of relevant experience makes her an obvious contender.

Penny Bailer — Bailer’s breadth of experience with issues related to DPS (she is a former school board member) and commitment to young people in Detroit is hard to match. As she points out in her responses, her entire career of 41 years in Detroit has been focused on young

people, including the Girl Scouts and City Year Detroit, and her record is extremely strong.

Angelique Mayberry – Similar to Sonya Mays, Mayberry’s depth of experience makes her one of the strongest candidates for the job. In a way she is like Mays without the ties to Kevyn Orr and the entire controversial emergency management episode. The following quote is what really got our attention, in addition to her other credentials: “As a community organizer and director of community relations for UAW-Ford, I have been instrumental in implementing capital and programming improvements for over 25 schools in the district. My involvements with DPSCD from this perspective, as well as in my own children’s experience with the district, have uniquely prepared me to understand many of the changes necessary to improve public education in the city of Detroit.”

Kevin Turman — Although not as heavy-duty qualified as some of the others, Turman’s experience as the pastor

of Second Baptist Church could prove to be very helpful and provide a missing perspective from the clergy. He’s also known to be progressive and involved in the community. Not a jackleg, hellfire and damnation type of preacher, in other words.

Also, Turman’s views on school safety were refreshing, not looking to rely on still more police presence but working toward other solutions dealing with the attitudes of the children and involving the parents.

Misha Lianne Stallworth — Stallworth’s years of work with youth and youth organizations across the country as well as in Detroit will make her a valuable asset to the board and an effective advocate for the needs of students.

Leslie Andrews — Given the still financially precarious situation of DPSCD, Andrews’ extensive experience working with the United Negro College Fund as well as Rock Ventures in Detroit gives her a unique set of credentials that could help attract much needed funding from foundations and funders that support schools.

The Rights of Voters with Disabilities

The United States Constitution guarantees every U.S. citizen age 18 or older the right to vote. Our state constitution further defines the right to vote by also requiring voters to be residents of Michigan and registered to vote in their city or township of residence.

As long as the voter meets the state and federal requirements, he or she has the right to vote. You cannot be barred from voting due to disabilities.

Things to Know: •Other than city or township residency, identification and age requirements, state and federal laws do not place any other restrictions on the right to vote •Federal and state laws require Michigan’s cities, townships and villages to provide a reasonable number of accessible registration facilities. It is the intent of the law to ensure that voters with disabilities are fully able to exercise their voting rights at the polls. Any action or physical barrier that prevents voters with disabilities from casting a ballot is unacceptable.

•Inside the polling location, at least one voting station should be adapted to allow a person to vote while seated. In addition, all voters, including voters with disabilities, have access to the AutoMARK Voter Assist Terminal in all polling places. The AutoMARK operates like an electronic ink pen. It simply marks the ballot with the

Proposal A vs Proposal B

Major differences between two versions of Community Benefits ordinance proposals The Michigan Chronicle It’s hard to argue with the basic concept of a community benefits agreement which, at its essence, means that you, as a neighborhood resident, should be entitled to some significant say-so over any major developments scheduled to take place in your own back yard. More specifically, you as a low-to moderate income neighborhood resident should be entitled to some say-so, because rich people rarely have to worry about unwelcome developments popping up in their neck of the woods without any community input. It simply isn’t done.

So the question to be considered, when weighing the merits of Proposal A vs. Proposal B, is not whether having a community benefits ordinance is a good idea. It is a very good idea. But the very important question is which community benefits proposal – Proposal A or Proposal B - represents the kind of community benefits ordinance that will help Detroit, and which ordinance will do the opposite.

Proposal A does not permit any participation from any city official - not the mayor, not any member of city council, not any other city official - in the actual negotiation process.

Proposal A also differs greatly from Proposal B in terms of enforcement measures.

The following is the enforcement section of Proposal A: Sec. 14-12-7. Penalties for Noncompliance; Enforcement; (1) The provisions of this Article are prescriptive in nature, and are set forth as required conditions to request, provision, and receipt of Public Support For Investment for Tier 1 Development Projects, Tier 2 Development Projects, and High Impact Development Projects. Material failure to comply with the provisions of this Article may result in denial, suspension, terminate, and revocation, or withdrawal of Public Support For Investment, but shall not be subject to the penalties set forth in Sec 1-1-9 of this code. Except, when obtained through substantial and material misrepresentation or fraud, the resolution of City Council approving the Public Support For Investment shall be evidence of compliance with the provisions of this Article, and thereafter remedies shall be limited to enforcement of the Community Benefits Agreement and/or Development Agreement.

Section 2. This ordinance is hereby declared necessary to preserve the public peace, health, safety, and welfare of the People of the City of Detroit.

Section 3. All ordinances or parts of ordinances that conflict with this ordinance are repealed.

Proposal B’s enforcement section is too lengthy to be included here, but here are some of the abbreviated highlights taken from the proposed ordinance itself: Enforcement.

(1) An Enforcement Committee shall be established to monitor Tier 1 Projects. a. The Enforcement Committee shall be comprised of, at minimum, the following four individuals: i. Corporation Counsel for the City of Detroit; or their designee. ii. a representative from the Planning and Development Department; iii. a representative from the Law Department; iv. a representative from the Human Rights Department. b. In addition to the members of the Enforcement Committee as identified in Subsection (1)a of this section, the Planning Director may require that other departments participate in the Enforcement Committee as needed.

(4) The NAC (Neighborhood Advisory Council) shall review any allegations of violations of the Community Benefits Provision provided to it by the community, and may report violations to the Enforcement Committee in writing.

(5) Upon receipt of written notification of allegations of violation from the NAC, the Enforcement Committee shall investigate such allegations and shall present their written findings to the NAC based upon the following: a. Whether the Developer is in compliance with the Community Benefits Provision; and b. How the Community Benefits Provision will be enforced or how violations will be mitigated.

(7) If the NAC disagrees with the findings of the Enforcement Committee or determines that the Enforcement Committee is not diligently pursuing the enforcement or mitigation steps outlined in its findings, the NAC may send notice to the Enforcement Committee, and the Enforcement Committee shall have 14 days from receipt of notice to respond to the concerns outlined.

(8) If the NAC is not satisfied with the Enforcement Committee’s response, the NAC may petition the City Clerk and request that City Council schedule a hearing with opportunity for both the Enforcement Committee and the NAC to present information related to the alleged violations of the Community Benefits Provision and any enforcement or mitigation efforts that have occurred.

(9) If City Council elects to hold a hearing, or based upon the written information 22 submitted, City Council shall determine whether the Enforcement Committee has made reasonable efforts to ensure that the Developer has complied with the Community Benefits Provision. a. If City Council determines that the Enforcement Committee has made reasonable efforts, City Council shall notify the NAC and the Enforcement Committee of their findings. b. If City Council finds that the Enforcement Committee has not made reasonable efforts, City Council shall make specific finding to the Enforcement Committee on the steps that need to be taken to comply with the Community Benefits Provision.

REGIONAL ENHANCEMENT MILLAGE PROPOSAL

The proposal would authorize the Regional Transit Authority of Southeast Michigan (RTA) to levy within Macomb, Oakland, Washtenaw, and Wayne counties a property tax assessment: • at a rate of 1.2 mills ($1.20 per $1,000 of taxable value); • for 20 years beginning in 2016 and ending in 2035; • that may not be increased, renewed, or used for other purposes without direct voter approval; and • to be used upon the affirmative vote of an RTA board member from each RTA member jurisdiction for the purpose of construction and operation of a public transportation system connecting Macomb, Oakland, Washtenaw, and Wayne counties, including rapid transit bus routes across county lines, specialized service for senior citizens and people with disabilities, commuter rail, airport express service, and other public transportation purposes permitted by law, consistent with RTA bylaws and subject to the limitations of the Regional Transit Authority Act. If this new additional assessment is approved and levied, revenue will be disbursed to the RTA. It is estimated that $160,907,285 will be collected in the first year.

PROPOSAL B: CITY COUNCIL INITIATIVE ORDINANCE FOR COMMUNITY BENEFITS AGREEMENTS An initiative to enact the “Detroit Community Benefits Ordinance” proposed by the Detroit City Council to amend Chapter 14 of the City Code to add Division XII, Community Benefits, to require the city to establish and consult with Neighborhood Advisory Councils in conjunction with certain large-scale projects involving city property or tax subsidies, to require development agreements between the city and the developers of such projects to incorporate the concerns of the Neighborhood Advisory Councils to the extent feasible, to include certain other related provisions, and to establish that the ordinance is the comprehensive local law on the subject matter.

Pursuant to state law, the revenue raised by the proposed enhancement millage will be collected by the Wayne County Regional Educational Service Agency and distributed to local public school districts within the boundaries of the Wayne County Regional Educational Service Agency based on pupil membership count.

Shall the limitation on the amount of ad valorem taxes which may be imposed on taxable property in the Wayne County Regional Educational Service Agency, Michigan, be increased by 2.00 mills ($2.00 per thousand dollars of taxable value) for a period of six (6) years, 2016 to 2021, inclusive, as new additional millage to provide operating funds to enhance other state and local funding for local school district operating purposes?

It is estimated that 2 mills would raise approximately $80,000,000 when first levied in 2016.

WAYNE COUNTY ZOOLOGICAL ZOOLOG AUTHORITY RENEWAL MILLAGE REN The Wayne County Zoological Authority was established pursuant to Public Act 49 of 2008 and formed to allow for continuing zoological services for the students, residents and visitors of Wayne County. The law allows the Authority to seek authorization from the electors to levy a tax on real and personal property to provide revenue to an accredited zoological institution for this purpose. Accordingly, as a renewal of the previously approved millage authorization which expires with the 2017 tax levy, to continue providing zoological services to benefit the residents of the County, shall the 0.1 mill (10 cents per $1,000 of taxable value) on all of the taxable property located within the County continue to be imposed for a period of ten (10) years, being years 2018 through 2027? It is estimated that if approved and levied, this millage would generate approximately $3,940,066.55 in 2018.

Vote ‘YES” on the RTA millage proposal The Michigan Chronicle The Michigan Chronicle supports the $2.9 billion Regional Transportation millage because there is really no other choice.

Southeastern Michigan desperately needs a radical upgrade to its public transportation system if we are to have any hope of sustaining Detroit’s comeback beyond this initial hopeful burst and into the foreseeable future. This isn’t just about transporting white suburbanites to the game and back; this is about transporting Detroiters to where the jobs are, both inside the city as well as beyond 8 Mile Road. This is about making good on the promise to make Detroit a modern city that works for all of its residents. Not just the newly arrived with well-paying jobs already in hand, or the young, single artistic urbanites for whom Detroit serves as inspiration, but for those of us who have been here through the worst of times as well as what appears to be a comeback, even if an uneven one.

It is not an exaggeration to say that the difference between the development of a functional regional transportation system and allowing this opportunity to fade away is the difference between survival and counting down the days until we slip right backwards into the economic desperation we thought we had left behind.

Having said all of that, this is not to say that we don’t have concerns about the millage proposal, because we certainly do. The

primary concern is that the desperate need for a regional transportation system should not be used as an excuse to strong-arm the Detroit vote into supporting a measure that does not sufficiently address all of Detroit’s pressing transportation needs, especially in the city’s isolated neighborhoods, while focusing more early attention on cross-border transportation issues.

More specifically, upgrading the quality of public transportation for Detroit’s neighborhoods must be an equal priority with providing transportation to and from the suburbs. According to Detroit’s Amalgamated Transit Union Local 26, far too many of Detroit’s neighborhood bus routes operating within the city limits still suffer from hour-long waits while those routes headed out of town, such as the Gratiot and the Woodward line, have apparently been prioritized for shortened wait times. This is unacceptable and needs to be addressed right away.

Another concern raised by the ATU that we share is that Detroit (DDOT) drivers are currently paid $10,000 a year less than SMART drivers. Should the RTA proposal pass, placing the RTA as the top decision-making body for transit in the region, then there is no way Detroit drivers should settle for making less than their suburban counterparts once they become part of the same system.

But at the end of the day, despite these troubling issues, we simply can’t justify a

‘no’ vote against the RTA millage proposal after all the time and effort it has taken to get our region to this point where we finally have a realistic chance of coming together to create the sort of public transportation system we should have had years ago, and that is already present in every other major city in the country.

this time around, meaning that we should be willing to wait four years to get it right, is simply not an acceptable option. The momentum is here now, and anyone who knows anything about political momentum knows that what’s here today can so easily be gone tomorrow.

The possibility that the issue can be revisited again in four years should it fail

So what does that tell you about the chances for four years from now?
