Estate Planning for Unmarried Partners: Ensuring LGBTQ+ Equality
In recent years, more couples, including LGBTQ+ individuals, are choosing long-term committed relationships without marriage. However, it’s essential to understand that many state and federal laws don’t offer the same protections to unmarried couples, including same-sex couples, as they do to married ones regarding inheritance, taxes, and decision-making. Without proper estate planning, your partner, regardless of their gender, may receive nothing if you pass away. Let’s explore why estate planning is crucial for unmarried LGBTQ+ partners.
($15,000 in 2021) without worrying about gift tax. If you exceed this limit, you must file a federal gift tax return. The good news is that federal gift tax is due once you’ve given more than the individual estate and gift tax exclusion amount, which was $11.7 million in 2021.
The Law Is Not on Your Side
Personal Matters
If you don’t have an estate plan, your state’s intestacy laws will dictate who receives your assets. Typically, these laws prioritize surviving spouses, followed by descendants, parents, siblings, and their children. Unmarried partners, whether same-sex or not, aren’t mentioned in intestacy statutes, which means your partner may receive nothing.
Estate planning isn’t just about finances; it also involves personal matters. You need to consider who will handle your financial transactions and make medical decisions on your behalf if you cannot do so. Failing to designate trusted individuals could result in the state appointing someone based on their own priority list, which may not align with your wishes or the unique needs of LGBTQ+ individuals and their partners.
Similarly, suppose you have life insurance or retirement accounts with no designated beneficiaries. In that case, the proceeds may go to your family members rather than your partner, which can be especially concerning for LGBTQ+ individuals. This could lead to unintended consequences, including taxes and distributions that don’t align with your wishes or the needs of your partner. A Different Kind of “Blended Family” Concern If you’re in a same-sex relationship with children from a previous partnership but aren’t married to your current partner, it’s vital to protect your partner’s interests, as the law might not grant them anything. This issue is particularly relevant for LGBTQ+ families, where there may be complex family structures. Federal Tax Issues Unmarried partners, including same-sex couples, can only give up to the annual exclusion amount 12 • RAINBOW PAGES
Federal estate tax rules are similar, with unmarried partners, including same-sex partners, needing to consider the $11.7 million lifetime exclusion. Once this limit is surpassed, estate tax becomes applicable.
Actions to Take Now If you want to protect your partner, including LGBTQ+ partners, consider the following steps: • Review your beneficiary designations to ensure they’re correctly filled out. • Examine how your accounts and property are owned, as living together doesn’t necessarily mean joint ownership. • Ensure someone has access to the household expense account to ensure bills can be paid in case of incapacity or death. What should you ask a financial advisor? Managing your finances and investing for your future are important tasks — and they can be challenging. But you don’t have to go it alone. Many people benefit from working with a financial advisor, someone who knows their needs and goals and makes appropriate recommendations. If you’re considering getting some help, you’ll want to ensure a particular financial advisor is right for you, so it’s a good idea to ask questions. Here are some to consider: • Have you worked with people like me? All of us are unique individuals. Yet, you do share certain characteristics with others — age, income, family situation and so on. And you might feel comfortable knowing that a financial advisor has worked with people like you and can readily understand and appreciate your needs and specific goals: college for your children, a certain type of retirement lifestyle, the kind of legacy you’d like to leave and others. The more information you can provide about yourself upfront, the better your chances of finding a good match. • Do you have a particular investment philosophy? Some financial advisors follow a particular investment style, while others might focus on specific investments or categories. There’s nothing inherently wrong with these types of approaches, but you might be better served by working with someone who takes a broader view — one that emphasizes helping clients meet their goals over any particular philosophy or strategy. • How will you communicate with me? Open and frequent communication are key to a successful relationship with a financial advisor. So, you’ll want to know what you can expect. And, most important, I’m successful when I know I’ve helped my clients reach all their goals.” • How are you compensated? Financial advisors are compensated in different ways — some work on commissions, some charge fees, and some combine fees and commissions. There isn’t necessarily any best method, from a client’s point of view, but you should clearly understand how a potential advisor is compensated before you begin a professional relationship. Naples Pride Center serves LGBTQ+ community and beyond By Ella Nayor Rainbow Pages Ollie Saunders is a college student who knows what it feels like to be scared, lonely and isolated because of identifying as a member of the LGBTQ+ community. In high school, the 19-year-old Naples resident struggled to find a sense of belonging and support – specifically with the loss of the Gay Student Alliance. In March 2022 Governor Ron DeSantis passed the Parental Rights in Education bill — also known as the “Don’t Say Gay” bill — which caused some school sponsored GSA’s to lose their potency.

The Naples Pride Center became this haven for Saunders and many other students, youth and adults who identify as LGBTQ+. “It was essentially my refuge throughout high school,” said Saunders. “It was the only place I had since high school that I know was unconditionally loved and cared about.” The Naples Pride Center has been open as a non-profit since October 2020 but Pride has been in existence helping the LGBTQ+ since 2017 said Cori Craciun, the Naples Pride Center Executive Director. “And really if you think about it when we started back in 2017, we had no expertise whatsoever and 0 dollars.” Since its opening Craciun has witnessed the growth and evolution of the Center as a place to seek safety and comfort but also as a sophisticated and inclusive provider that offers a wide array of services, including social, health and medical services as well as extensive program16 • RAINBOW PAGES
Some of the services include case management, free sexually transmitted disease prevention and medical care, HIV testing, education, food pantry, clothing, homeless care, advocacy for LGBTQ+ rights and support groups, Craciun said. Craciun said the Center also serves many people in the region who do not identify as LGBTQ+. This was especially true after the extensive destruction from Hurricane Ian last year. During that period their work tripled, and they had to hire a case manager, Craciun said. “There’s not enough services,” Craciun said. “There’s a lot of people who fall through the cracks.” The Center is not only providing services and helping the community but also pulling the community together and making it stronger. “I think we became a voice for the LGBTQ+ community,” Craciun said.

from the Naples Pride Center changed her life for the better. In fact, it was through her time and participation in events at the Naples Pride Center where Saunders first found she could advocate and speak up for herself. The soft-spoken Florida State University Political Science major who is now an activist for LGBTQ+ rights and issues, said it was the Naples’s Pride Center’s unwavering support and programming that made all the difference in her mental wellbeing. The Center’s advocacy includes standing up for the LGBTQ+ community at school board and government meetings, and offering a library filled with books that have been banned from the state public schools (due to the Parental Rights in Education bill). But though Craciun is proud of the Center’s evolution from a Pride-based organization to that of a sophisticated multi-service Center, what really makes her most happy is the fact that it is a “safe place for all to come,” offering a sense of friendship, belonging and advocacy for the LGBTQ+ residents. “I am most proud of bringing the community out of the closet and being a voice for those that cannot speak for themselves.” Saunders was one of the voiceless, whose help
Many protests and demonstrations later, Saunders is on sure footing to help herself and others in the LGBTQ+ community stand up and feel good about themselves and their identities. She has since helped organize and participate in a Youth Pride Conference as well as Pride and other parades. Craciun is excited about the positive changes the Center is creating in people like Saunders. With the Center’s evolution and growth, she is hoping to secure more donations, grants, and support to help support its ongoing services and programs as well as hire an additional case manager. Goldberg Center provides LGBTQ+ programs By Ella Nayor Rainbow Pages There’s an old saying, “If the walls could talk.” This figurative expression proposes that many interesting events happens within the walls of a building. Within the walls of the new Goldberg Center, a multi-use LGBTQ+ community gathering space in downtown Fort Myers, guests feel a sense of security, belonging and care. “When I was in high school, I wish I had something like this. We did not,” said Robin Croskery-Howard, the Visuality Board of Director’s Secretary. Walls also support, hold together, and maintain the integrity of a structure’s foundation. In line with this thinking the Goldberg Center in Fort Myers has painted each of its interior walls a hue from the LGBTQ+ rainbow flag, a visual cue and reminder for what the Center stands for in its daily use. This past June two separate non-profit LGBTQ+ organizations, Visuality and Pride Southwest Florida, Inc., moved into a 1,500 square building at 2606 Second Street, Suite 505, in Fort Myers forming a community center for LGBTQ+ residents in Southwest Florida. The Center is named after Arlene Goldberg, a founder and the founding officer and Director of Visuality, which also uses the center. The Center has one paid employee, Ellie Appelgren, the Director of Youth Empowerment. Some of the ongoing programs include game night, where participants have a selection of 50 games to choose. There’s also Women Coming Out Late in Life, a peer-to-peer support group held at 6:30-7:30 p.m. every second Tuesday of the month, Goldberg said. 18 • RAINBOW PAGES

In addition, there is a Transgender Game Night for adults, outings for adults and a jewelry making program for children that the Goldberg Center started after receiving a $10,000 grant from Golisano, Goldberg said. Visuality hosts Youth Drop in Night from 6 to 8 p.m. the second Thursday of every month. The program includes refreshments and conversation. All youth ages 13-18 are welcome to come. “Its incredibly important that we have a place we can be safe and just enjoy being a human,” Croskery-Howard said. Aside from Visuality, the Goldberg Center building also houses Pride Southwest Florida, Inc. whose purpose is to create LGBTQ+ Pridebased events at the Alliance for the Arts.

New group Floridians for Democracy emerges to promote individual rights

He was driving to a Fort Myers-based event where he was slated to speak about democracy and the eating away at human rights and liberties. battle to save it in the state of Florida. He and fellow members of a growing organization, Floridians for Democracy, is on a mission to help Florida residents know what is at stake if democracy is challenged by autocracy. Nathan and members of Floridians for Democracy are part of a growing movement in the state of Florida to support democracy and educate residents of the perils of living under authoritarian-style leadership and rule. Floridians For Democracy emerged in response to what members view as a rising autocracy and anti-democratic government in the state. The state has banned books in schools because they depict the suffering and oppression of African Americans and people of color, or address gay issues and rights. They also point to the removal of or the modification of African American history education in public schools and the persecution and oppression of African Americans and the LGBTQ+ community. In 2022, the State of Florida passed the STOP W.O.K.E. ACT, a law prohibiting schools and workplaces from being subjected to harmful effects of critical race theory. From this law people are not supposed to be made to feel bad for being white and students in middle school are to be taught that African slaves brought to the US gained valuable vocational skills. These are just some of the recent issues that led Nathan and his wife Karen to become co-founders of Floridians for Democracy last spring. They were increasingly concerned that draconian measures and emerging Florida state laws are
The organization is comprised of two separate but united organizations – a non-profit organization (501c3) dedicated to education and understanding the risks connected with failing to preserve democracy and an organization (501c4) devoted to action and getting out the vote. This action arm of the organizations is not tax deductible where the educational arm is fully deductible. “Florida is quite possibly the canary in the democracy coal mine,” said Jim Nathan. “We hear from some pro-democracy groups that Florida is a lost cause, to turn around this trend. In reality, we have no choice but to try on behalf of our children, grandchildren, and future generations. We cannot be silent.” The Nathans, along with Fort Myers resident Jeff Cull, a retired Naval officer jet fighter pilot and co-founder of Florida Weekly, and Dr. Mike Martin, immediate past President of Florida Gulf Coast University and an academic and professor of economics, to hash out a plan to preserve and save democracy in Florida and beyond. The community leaders organized and invited other local leaders and stakeholders in the community to form the grassroots democracy preservation organization. At first, meetings were held in the Nathans’ home and then moved to Zoom as they quickly grew to more than 800 members throughout the state and nation.
