Meet Your Board Member, Thomas Finlay

Early Life: Iwasborn,raisedandattendedschoolsin SanJoseCalifornia.Withinayearaftergraduatingfromhigh school,Imarriedmyhighschoolsweetheart,Marta.

Married young: ShortlyafterImarried,wehadtwo childrenbyourfourthyearofmarriage.Weraisedourtwo daughterswithinsixblocksofmychildhoodhome.

Work life: Myfirstpayingjobwasassistingmydad duringthesummerwhenIturned14asalandsurveyor. WhenIturnedfifteen,Istartedworkingparttimeafter schoolandweekendsasa“pumpjockey”andautomechanicatthelocalgasstation.I foundabetterpayingservicestationandcontinuedforthenexttwoyearsatthat location.Ithenenteredanautomechanicapprenticeshipatalocalcardealership.After mycompletionoftheapprenticeshipprogram,Ibecameajourneymanautotechnician. Icontinuedasanautotechforapproximatelytwelveyears.Iwasthenofferedthe opportunitytomovefromtheshoptotheofficetoworkwiththecustomersthatwere bringingtheircarsinforrepairs.Icontinuedasanautomotiveserviceadvisor,service managerandpartsandservicedirectoruntilmyretirementinAugust2024.

Advanced Education: IattendedWestValleycommunitycollegeparttimefor aboutnineyearsuntilmyparentspassedaway.Withalittleinheritancemoney,Iwas abletotakeoffacoupleofyearstoattendcollegefulltimetobecomeoneoftheoldest collegestudentstoenteratSanJoseStateUniversity.Iwentontocompletemy undergradworkandreceivedmyBachelorofSciencedegree(BS)inmymajorof businessmanagementinformationsystems(MIS)withaminorinmarketinginMayof 2000.WhenItriedtoreentertheworkforcethelocaleconomywasnotdoingwelland thejobsIcouldlandininformationtechnologypaidlessthanwhatIwasmakingbefore goingbacktocollege!So,Ithoughtthatcompletingamaster’sdegreeinbusiness shouldhelplandajobwithbetterpay.So,Ienteredthebusinessmanagementmaster’s oneyearprogramatSanJoseState.IgraduatedinSeptember2002withamaster’s degreeinbusinessadministration(MBA).

Current Events: MywifeMartaandIbothretiredlastAugustandsoldourSan Josehomeof43yearsandmovedtoSoqueltocontinueouradventures.Weare enjoyingattendinglocalevents,walkingonthebeach,doingsomehandymanjobsand ridingourbicycles.

Answers Your Questions!

Q: Am I grandfathered in if the park makes a rule change? Our park management has issued new rules. One of the rules forbids pets in the park; another says that lattice may not be used on any home. Do I have to get rid of my dog and take down the lattice on my carport?

A: Arulechangecannotoperateretroactively. Anypre-existingpetsorstructuresthat wereallowableundertheoldrulesaredeemedtobe"grandfathered".But,iftherule changeisduetoachangeinthelaw,thentherulemaybeenforceable.Hypothetically, ifanewlawweretooutlawlatticeasafirehazard,thenmanagementwouldbewell withinitsrightstorequirecompliancewiththenewlawviaamendedrulesand regulationswhichreflectthatnewlaw.Butiftheruleschangeisonlybasedupon management'sowndesiretochangeitspolicies,thenexistingconditionsaredeemedto be"grandfathered"in.Youcannotbeinviolationofarulewhichdidnotexistwhenyou purchasedorinstalledsomething,presumablywithmanagementapproval.

Q: If a park rule or rental agreement contradicts the MRL, which one applies?

A: TheMRLisstatelaw,anditcannotbewaivedinarentalagreement(798.19).The MRLalwaysgovernsandanyrentalagreementtermswhichcontradictstheMRLis unenforceable.Statelawsupersedeslocallaw.

Q: Can the park manager enter my home? Can the park manager enter my lot?

A: Yes.Hecanenterthehomebut only intheeventthehomeisabandoned,oritisan emergency.Yes,theparkmanagercanenterthelottoreadutilities,trimtrees,perform maintenancewhereresidentsfailtodoso,ortoprotectthepark(MRL798.26)

Q: What does it mean that a park rule must be reasonable?

A: Inorderforaparkownertoenforcearuleitmustbe"reasonable"(798.56(d).This termissubjecttointerpretationbutusuallyitmeansthereisarationalorfactualbasis fortherule,anditappliesequallytoallresidents.Often"reasonableness"ismeasured bywhetherthereisagoodfaithbusinessjustificationfortherule,andwhetheritis costlytoperform.

Medicare Late PENALTIES

Whenyourturnage65,youqualifyforMedicarehealthinsurance. Itisoneof theperksofreachingthatmilestonebirthday! BUT-ifyouarenotyetreceiving yourSocialSecurityretirementbenefits,youarenotyet“inthesystem”soyoumust proactively signupforMedicare.Butnoonetellsyouthat! Andifyoudonotsignup ontime,youincurpenalties!Youhavethethreemonthsbeforethemonthyouturn 65,themonthofyourbirthday,andthethreemonthsafterthattoenroll.Thisis calledyour“initialenrollmentperiod.”Although,ifyouoryourspouseareworking pastage65andhavehealthinsurancethroughanemployer(thathas20ormore employees),thenyoucandelaysigningupforMedicarewithoutapenalty.However, youmustenrollinpartsAandBwithin8monthsoflosingyouremployer-based coverageoryouwillhavetopaythepenalty.ForPartDprescriptiondrugcoverage, youhaveonly2monthstoenrollafteryouloseyouremployercoveragetoavoidthe penalty.Youshouldknowabouttheselatepenalties:

• Part A: MostpeoplegetPartA(hospitalcoverage)fornochargebecausethey (ortheirspouse)hadMedicaretaxesdeductedfromtheirpaychecksforat least40quarters(10years)ofwork. Ifyoudonotqualifyandhavetopayfor

PartAandyouarelateinapplying,themonthlypenaltywouldbean additional10%ofthepremiumwhichispaidfor twice thenumberofyears thatyoudelayyourenrollment. For example, if you were eligible for Part A for 2 years but didn't sign up, you'll have to pay the higher premium for 4 years.

• Part B: PartBcovers‘medical’coverageoutsideofthehospitalsuchas doctors,labtests,emergencycareetc.Thepenaltyforlateenrollmentis10% ofthePartBpremiumforeach full year(12months)enrollmentisdelayed. For example, if you were late by 39 months (which is calculated as three full years) you will have to pay a 30% late enrollment penalty in addition to your Part B monthly premium - forever. The Part B premium in 2025 was $185/month for individuals who made under $106,000 a year. 30% of $185 = $55.50, which added to the premium of $185 means you willpay$240.50.This isapermanentpenaltythatyouwillpayeverymonthandisdeductedfrom yourSocialSecuritycheck.

• Part D (Rx): Thepenaltyforlateenrollmentintoaprescriptiondrugplanis 1%ofthe national base Rx premium ($36.78in2025)foreachfull month you don’thaveRxcoverage. For example, if you are 14 months late, you would pay a penalty of 14% x $36.78 = $5.15 which is rounded up to $5.20. Your monthly penalty will be $5.20 added to your plan’s monthly premium. Thisisa permanentpenaltythatyouwillpayeverymonthandisdeductedfromyour SocialSecuritycheck.

• Supplement plans: Thereisadifferentsortoflatepenaltyrelatingto SupplementorMedigapplans(suchasPlanGorPlanN).Youcanbuyany Supplementplanavailableinyourstate—andinsurerscan’tturnyoudown orchargeyoumoreduetopre-existinghealthconditions duringthesix monthsafteryouinitiallysignupforMedicarePartB.Youhave“Guaranteed Issue”!Thepenaltyyoupayforenrollinglaterthan6monthsisthelossof “GuaranteedIssue”whichmeanstheinsurancecompanycandenyyou coverageorchargeyouhighermonthlypremiumsforyourpre-existing condition.

Late enrollment penalties are added to your monthly premium. They are not a one-time late fee but are a lifetime penalty (except for Part A) and they get bigger the longer you delay.

1. SignupforMedicarePartsA&B on time whenyouturnage65.

2. Ifyouhaveemployer,union,VAorTricarecoverage,youmaybeabletodelay withoutapenalty,butyoumustenrollduringyour“SpecialEnrollment Period”if/whenthatcoverageends.

3. Keep“creditable”prescriptiondrugcoverage(fromanemployer,union,VA, etc.)untilyougetaPartDprescriptionplan.
