Oamaru HISTORY, ADVENTURE AND CULTURE AWAIT IN

Three hours south of Christchurch, Oamaru is North Otago’s largest city with a rich history.

Its origins, dating back to the gold rush era and Victorian days, are still refl ected in a multitude of buildings and ongoing activities within the city and its nearby environs. Explore this heritage in the Victorian Precinct, where you will fi nd, shops, galleries and traditional crafts within some of the Southern Hemisphere’s most complete Victorian streetscapes and 19th century architecture. This heritage and history are proudly celebrated each November during Oamaru’s Victorian Heritage Celebrations. At home in the Precinct, you will fi nd the wonderful world of steampunk. If you are a steampunk fan, save the date next year and plan your trip to coincide with the Steampunk New Zealand Festival at Queen’s Birthday weekend. All manner of mouth-watering food and drink delights may be found, including craft whisky distilleries, award-winning restaurants, and locally crafted artisan foods, which will see foodies in their element. Walking and biking are popular with some great options, and the Oamaru Public Gardens are among the prettiest in New Zealand. Let’s not forget the wildlife options either. From the world’s smallest penguins in their natural environment at the Oamaru Blue Penguin Colony, to the world’s rarest penguin – the yellow-eyed penguin – coming ashore at Bushy Beach, and cute fur seals, there’s plenty to see, do and enjoy. Don’t forget to also check out what’s happening north, south, east and west of this vibrant city.

Ōamaru is the largest town in the Waitaki District and famous for its limestone architecture – but that’s just the beginning of what the town has to offer.

MOERAKI BOULDERS are south of Oamaru, down the stunning Kakanui coastline. Leave your footprints at the famous boulders, explore the Moeraki Lighthouse trail out to the peninsular and spot yellow eyed penguins and New Zealand fur seals. STEAMPUNK HQ is a totally unique museum of art, sound and light, showing an altered universe set within an 1880s Grain Elevator building in Oamaru. Features include The Portal, a retro-futuristic mirror and lighting installation with original glowing light sculptures.

BUSHY BEACH WALKING TRACK is a short distance (340m return) along a cli -top to spot New Zealand fur seals and the rarest penguin in the world, the yellow-eyed penguin. There is a purposebuilt viewing hide, from which to watch the yellow-eyed penguins come ashore. The track begins at the end of Bushy Beach Rd, at the Southern end of Oamaru. The beach closes at 3pm to avoid disrupting the penguins coming ashore. THE CLAY CLIFFS are amazing natural land forms, a geological wonder where sharp pinnacles and ridges are separated by steep and narrow ravines, reminiscent of the badlands. The Cli s were created out of layers of silt and gravel deposited by ancient lakes and rivers around 20 million years ago. They have since been uplifted and tilted by the nearby active Ostler Fault, and eroded. Located on private land, there is a $5 per car fee.

OAMARU BOTANICAL GARDENS are among the oldest in the country, established in 1967. Named a garden of national signifi cance, the 13 hectare public gardens refl ect the unique style and Victprian heritage of Oamaru and the Waitaki through Oamaru stone and other features.

How is the purchase of plant or chattels handled when buying a business?

Plant or chattels of a business are usually termed “Tangible Assets” in the sale/purchase process. Usually a Tangible Assets list is attached to the agreement, or there is a clause in the agreement requiring the Vendor to supply a list to be approved by the Purchaser as part of the process. A Purchaser should check the list to ensure all items expected to be included are there. The Vendor needs to ensure the items on the list are in good working order – a Purchaser may reject any item which doesn’t meet this requirement. A Purchaser may undertake a pre-settlement inspection of a business, and at that time should check that the Tangible Assets are in the condition expected (as previously viewed). The Purchaser should contact their solicitor and the Business Broker involved in the sale to resolve any problem. A Vendor should make it clear if any Tangible Assets seen in the business are not included in the sale (e.g. some motor vehicles). An agreed list of Tangible Assets normally clarifies that. Small Business New Zealand (SBNZ) is a new online platform launched earlier this month to support Kiwi business owners across the country to thrive.

Running a business is hard, and often small business owners feel isolated, left trying to fi gure it all out alone. This is my fi rst column, offering some advice and commentary about employment law, for small to medium-sized Canterbury employers.

The recent Employment Relations Authority decision involving Olivia Farrelly and Advance O ce Products highlights the need for good employment law advice. Olivia was interviewed twice, then o ered a job to provide customer support, mostly by phone. Two weeks later, Advance became concerned with her phone manner, and felt that they might be losing business because of it. They said they had not known, when employing Olivia that she had a noticeable stutter, and believed she should have told them about it because she knew there was a lot of telephone work in the role. Olivia said she’d stuttered all her life but it was only an issue on telephone calls (and not general conversations). Advance dismissed Olivia after meeting with her, relying on the 90 day trial period. Olivia challenged her dismissal, arguing the only reason she was fi red was for a medical condition (her stutter), and that was unlawful discrimination. The Authority agreed, awarding her almost $22,000 in compensation and lost wages. What went wrong? This decision shows there are limited grounds to challenge a dismissal under the 90 day trial period, and there is no way an employer can know them all. A short phone call to a good employment lawyer would have immediately rung alarm bells, and would have been a lot cheaper than $22 grand.
