Building a house is a lot like having a baby. They devour all your time, energy and focus, they consume your waking thoughts and they keep you up at night. But in the end it is all so worth it.

Yes, Canterbury Build has welcomed its first baby into the team, eight pounds, eight ounces of deliciousness… and a lot of sleepless nights. But nothing working to Canterbury Build deadlines hasn’t already well and truly prepared me for.

Now, back to building… (see, there’s the attention span gone again!). This issue the Registered Master Builders Association tells us about some of the key home design challenges when it comes to rebuilding, the New Zealand Institute of Architects discusses the importance of people connecting with architecture and we profile some new products on the market, including a low emission log burner proving popular for new builds and the first insulated weatherproofing cladding in Australasia, designed to combat cold and leaky homes.

We have checked out some new initiatives to improve our housing performance, such as an innovative study into the effects of water damage on building materials and the technology being used to assess the earthquake tolerance of buildings.

We have also delved into a number of exciting new local projects, including Warren and Mahoney’s new commercial home at 254 Montreal Street, the restoration of ‘The Grand Old Lady of Theatre’ – the Isaac Theatre Royal and the repair of neo-gothic icon, the Arts Centre.

Despite some sleepless nights on my part, Canterbury Build magazine will continue to support our city with information that meets the needs of its residents, celebrating Christchurch as we move forward.

I

n the CBD there is a real sense that the rebuild is in full swing. There is a very strong positive vibe now in the city, with such a large amount of building activity.

The retail precinct has five major builds on the go now.

Nick Hunt's Hereford Street part of BNZ Square is due for completion at the end of 2015. The fence hoarding has been removed and the office fit out work is progressing well. This will have retail and hospitality on the ground floor, car parking for these tenants on level 1 and then office space for government departments above this.

The other half of BNZ Square, which faces Cashel Street and Ballantynes, has reached its full height with the steel frames in place. This is due for completion in late 2016.

Tim Glasson's ANZ Central, formerly the Triangle Centre, is now well out of the ground and flying along. It is due for completion in late 2016 and early 2017. It is a very impressive building that will be a great asset to the city.

Becca will be a major office tenant in this building, bringing significant numbers of technical staff into the CBD from their temporary Sydenham offices.

Phillip Carter's Crossing is now showing its form with the large central 600 bay public car park fully framed up. This car park building will be the tallest building of The Crossing and will provide the first multi-level public car park in the CBD in late 2016.

My Terrace development is back in full flight as I spend more than half a million dollars a week. My two brothers, Harcourt and Tracy Gough, together with their families, have joined The Terrace project with substantial equity injections. The central buildings along Oxford Terrace are now being clad and should be open in May 2016, bustling with their hospitality tenants.

Our Hereford Street building will be fully framed up in October and November and this five storey office building will be finished by July 2016.

Work has begun on the very substantial six storey office building on the corner of Cashel and Oxford Terrace. This building is due for completion in 2017.

The huge NgÄ i development where the old Police Station was has started. Over the road on the corner of Cashel and Cambridge Terrace is well on its way and will house PWC and Chapman Tripp.

Grand Central Office block has quietly gone up on the old Grand Chancellor site and will house many more government departments.

It is well worth a visit to town to see all the changes and to view the building of a new CBD.

hatever your religious persuasion, the Catholic Diocese must be congratulated for the way it's tackled the many heritage buildings in its portfolio, damaged by the earthquakes.

The Diocese hopes that it will save all 13 heritage churches, plus the Cathedral of the Blessed Sacrament.

What's impressive is the process as much as the result.

Rather than bulldoze ahead and make decisions in haste, the Diocese and its advisers played a much more strategic hand.

From the outset, they looked to collaborate and be inclusive. Instead of closing doors, they left them wide open. Rather than forging ahead and making decisions in isolation, they consulted widely‌ Heritage New Zealand, City Council, CERA and the Diocese via the College of Consultors and the Council of Priests. By continually talking with these other organisations, the Catholic Diocese took them along on the journey. Where they saw possible resistance, they worked with these different groups to find a solution.

Among the target audiences consulted was architect Sir Miles Warren. When discussion with him started, the view was that the Cathedral would have to be demolished.

He had a different vision, one that could see parts of the Cathedral deconstructed but the nave, in particular, being saved, engineering solutions allowing.

Had this considered, two-way communication process not occurred, then it is highly likely that the Cathedral site today would be one of demolition rather than hope.

The same scenario has played out with the other 12 heritage churches. Even as little as two months ago, it was thought that the only remaining option for two of the churches would have to be demolition. Again, in consultation with American architect James McCrery, solutions may have been found to hopefully save parts of both of these churches.

In public relations speak, this has been a textbook community engagement process. Key target audiences were identified early, kept informed, and became part of the journey with an extremely successful longterm outcome. A less rigorous and hastier approach could have meant more heritage buildings could have been lost.

I

have recently returned from attending a conference in Rotterdam which was a very enlightening experience. Rotterdam was completely decimated in 1940 and has been recreating itself ever since.

Rotterdam has the eighth largest port in the world and is the main port for product distribution into and out of Europe. The port is spectacular but so is the city.

I had the good fortune to meet with city officials during my visit and witnessed first-hand some of the spectacular buildings and infrastructure that have been put in place in Rotterdam.

The city has unashamedly adopted a radical approach when it comes to buildings, with office blocks positioned at unusual angles and stacked on top of each other in a way that is architecturally quite stunning. The downtown shopping precinct has a mix of modern retail offerings, including a stunning food hall which is encased in high quality apartment buildings. Right next door to the food hall there is a cluster of cube houses at crazy angles offering a spectacular example of high quality urban design.

From an infrastructural perspective everything from the Erasmus Bridge (Swan Bridge) through to the Central Station involves extraordinary architectural design which gives the city a unique footprint.

Rotterdam has sorted how to cope with cyclists (and there are thousands of them), pedestrians, trams and motor vehicles in the same access corridors through the city. It all works efficiently and provides a good balance in terms of transport modes throughout the city.

The few buildings that were left standing after the unprecedented bombing of the city on May 14, 1940 have been carefully protected. The central city was obliterated and more than 800 people were killed. That gave Rotterdam an opportunity to re-invent itself and it has done that with pizazz. We have much to learn from cities like Rotterdam as we regenerate Christchurch.

There are many good lessons off-shore that can be applied to our city and we ignore them at our peril.

he finalised Transition Recovery Plan and the new legislation to make it happen – the Greater Christchurch Regeneration Bill – have now been revealed. This is a significant moment for us in Canterbury.

Over the course of the past five years, we have seen some remarkable feats. Our people have poured their ideas and energy into the fabric of our recovery and reconstruction, and have shaped the future for us in Christchurch and Canterbury. I want to see this local innovation, creativity and energy poured into our regeneration.

The Regeneration legislation is important for many reasons, not least of all because it should mark the shift of power away from central government and back to locally-led decision making. Balanced against this of course is the need to ensure that there is an enduring commitment from central government to its share in the next phase of recovery.

Labour supported the Government at the first reading of this legislation. We think it is vital that the select committee comes to Christchurch and carefully considers the evidence.

We do, however, have questions that we need answered. We need to know exactly what the Bill means by regeneration and just how far the new structure will allow public engagement. We are also wary of the degree of control by the Minister that remains, and why Christchurch will need this overview for the next five years. We will be asking if this is necessary.

We also want to see what the checks and balances will be on these extraordinary powers. The biggest question though is whether the Christchurch Regeneration Bill will lead to the genuine local-led recovery that the people of Canterbury asked for.

I strongly encourage you to put forward submissions on the Regeneration legislation and to have your say in the future of Canterbury as we look towards the next five years.

Don't forget when this legislation is once again revisited, it will be 10 years since the quakes.

C

hristchurch is lucky enough to get a fair few sunshine hours – second only to Blenheim and Nelson in the South Island. Wouldn't it be great if it was easier for households and businesses to use this free energy source to generate their own solar power?

Recently, Parliament started debating changes to the Electricity Industry Act. The changes come in the form of a Member's Bill from Green MP Gareth Hughes. The Bill will cut the red tape around solar connections. It will establish a fair system for setting the rate at which residential and small businesses can sell any surplus electricity they generate back into the national grid.

I have visited Christchurch homes that have installed solar panels and heard first-hand about the great benefits of solar panels and extremely low energy bills. I've also heard that going solar could be a lot easier with a couple of minor changes to our law.

People go solar for a range of reasons, but they also face a variety of challenges. We have almost 30 different lines companies in New Zealand. The connection fees vary for each, as does the paperwork, which means it is harder and more expensive to go solar in some regions than others.

Even once people go solar, there are problems with buy-back rates. Currently power companies can change the buy-back rate with very short notice – which means families cannot always plan how much of a saving they will make by going solar. If we had an independent body that decided the buy-back rate, one that is fair to the consumers and the industry, there would be more security for those wanting to go solar. In the United Kingdom, Germany, and many Australian states, this is how it works.

Christchurch already has a higher rate of solar panels per person than the national average, but I'd like to see solar energy playing a key role powering the future of our city.

The Green Party's “fair go for solar” proposals will make it easier for Cantabrians to be more energy independent and environmentally friendly. Now we just need the Government's support!

L

ast month negotiations for the Trans-Pacific Partnership (TPP) Agreement were successfully concluded.

That's great news for New Zealand – and for Canterbury exporters – as it's our biggest ever free trade deal.

It involves 12 Asia-Pacific countries, which together account for 36 per cent of the world economy, and will open New Zealand up to huge international markets. It will give our exporters access to 800 million potential customers for our goods and services.

Under the agreement, 93 per cent of New Zealand's exports to the United States, Japan, Canada, Mexico and Peru will be tariff free, saving key New Zealand industries such as meat, wine, horticulture, dairy and forestry millions in tariffs each year. It's also expected to benefit our economy by at least $2.7 billion a year by 2030.

Last month, the Government also announced we had achieved surplus for the 2014/15 year, a target we set in 2011.

That's a significant milestone – we are now one of the first developed countries to get our books back into surplus following the Global Financial Crisis.

What's more our economy is continuing to grow. We recently recorded our 18th consecutive quarter of expansion to deliver annual growth of 2.4 per cent in June 2015.

The Christchurch rebuild is also continuing to progress well.

Nearly $12 billion worth of building consents have been issued in greater Christchurch since 2010. Among the Anchor Projects, the Hagley Oval and Bus Interchange are complete, and there is good progress with others such as the Justice & Emergency Services Precinct and the Avon River Precinct.

Construction of the $800 million East and North Frame Residential Precinct will also begin soon and the Margaret Mahy Family Playground will be open in time for Christmas this year.

These are all part of the National-led Government's clear economic plan to support more jobs, higher incomes, and provide more opportunities for New Zealanders and their families to get ahead.

Protecting vulnerable workers from financial exploitation

I

ntroducing Ruth Burgess, Lexington Legal’ ‘pro bono’ and newest solicitor

Every issue Canterbury Build magazine will bring you up to date legal advice, with some of the city's leading specialist law firms providing information on a wide variety of issues of importance to both business owners and consumers.

I met Paul Brown of Lexington Legal in Hanmer at the Hope Conference – advertised as “the best place to learn about human trafficking, exploitation and slavery from leading NZ experts”. I put my hand up and offered to help and now I find myself heading the firm’s pro-bono work… and I am busy.

For example take the recent issue of some Filipino farm workers getting work visas using false documentation.

Currently this is being investigated by Immigration New Zealand (INZ), who have placed some workers reapplying for visas on interim visitor visas. This is particularly harsh on those workers who have finished one contract and were about to start work for a new employer. Those workers cannot [legally] start work until their status is decided; they are not eligible for WINZ benefits, and they are reliant on their friends’ goodwill for support. Both guilty and innocent are punished. An arrest has been made and I look forward to all the details coming out.

In the Philippines workers go to a recruitment agency to get a job overseas. Some – but not all – recruitment agencies charge a fee of around one months’ [NZ] salary. Many workers can’t pay this so they borrow the money, often at huge interest rates, in the belief all will be well once they are earning ‘the big money’ overseas. Once in NZ some workers find the cost of living far higher than expected, their income lower and a huge debt back in the Philippines. This isn’t slavery, but it is financial exploitation of vulnerable workers.

I am happy to do this work on a voluntary basis, but Lexington Legal has set up a Givealittle page to try and cover – or recover – some of the costs of doing this work. Getting settlement agreements right

S

erious employment disputes are often settled by written agreement which is stated to be in full and final settlement of all matters arising out of the employment relationship. Such agreements are also commonly executed pursuant to s149 of the Employment Relations Act 2000 meaning they are only enforceable by the Employment Relations Authority (the Authority) and the Employment Court (EC) and that the validity of the agreement is more difficult to challenge.

Despite these benefits, it remains important for the parties to a dispute to consider at an early stage in the settlement process both the form and content of any proposed agreement.

This has been highlighted by the Court of Appeal in the recent case of JP Morgan Chase Bank NZ v Robert Lewis [2015] NZCA 255 which found that: ! Neither the Authority nor the EC have the jurisdiction to enforce a settlement agreement that terminates an employment relationship if it hasn’t been executed pursuant to s149. ! Such an agreement is a new stand-alone agreement, intended to replace the employment agreement and to govern the parties’ obligations to each other after the employment relationship has ended. ! Neither the Authority nor the EC have the power to award a party damages for breach of a settlement agreement.

Accordingly, there could be significant ramifications for parties to an agreement if sufficient care is not taken when negotiating and recording terms. In particular, both parties should consider: ! What terms are to be included in a settlement agreement.

Any term not documented in a settlement agreement, whether executed under s149 or not, is likely to be unenforceable even if it were intended to survive the end of the employment relationship (i.e. restraint of trade / confidentiality). ! What remedies would be sought if the settlement agreement is breached. While the Authority and EC have exclusive jurisdiction to enforce s149 agreements, they cannot award damages for any loss suffered as a result of a breach.

Conversely, while damages are available for claims brought in the District or High Court, there is more scope for a party to challenge the validity of the settlement agreement.

Visitor Centre delivers iconic The Botanic Gardens in Christchurch have long been a site of aesthetic glory in their own right.

But they’ve taken on an even greater incandescent glow thanks to Patterson Associates, the architects who have created a transfixing space – the new Visitor Centre – within the gardens.

H

ighly respected and reputable architectural firm Pattersons won the contract to design the centre in 2009 through a Christchurch City Council led architectural competition.

Patterson’s winning scheme proposed the new building be located in a very different position in the gardens to the site specified by the competition and explained the logic for this suggestion to the council.

It was a bold move grounded in common sense that won the judges over. “We were delighted when the judges agreed with this and selected us to lead the project,” director Andrew Patterson says of his firm’s success.

Named by World Architectural News as one of 21 global architects “whose directional ideas are helping to shape the future of world architecture”, Patterson is, by any measure, a bona fide innovator making him and his team the perfect fit for delivering such iconic infrastructure.

Established in 1968, Pattersons has clients and projects all over the world including in India, Singapore, Australia, Germany and China and specialises in architectural areas inclusive of sustainable, urban and heritage builds.

Award winning architecture A light, airy space, the Botanic Garden Visitors Centre seems to effortlessly embody the spirit of classic garden architecture, positioned in such a way that it complements existing pathways within the gardens while opening up to a grand new event lawn and Avon River banks.

Designed to be experienced as a series of airy, leafy thresholds including public spaces – the shop and a café, Ilex Café – which offer a look into the semi-public areas including the library, function room, meeting room, an exhibition area and a large green house and shed, the centre has a perfect synergy of flair and practicality.

The function room, which can accommodate up to 120 people for meetings and dinners, or 150 for cocktails, provides a dramatic backdrop for entertaining, and Ilex Café generously supplements the social spaces on site, as it is also hireable for events in the evenings.

The public spaces in the Visitors Centre are enhanced by sculptured panels on the walls and ceiling – the effect is to create filter light like the dappled shade of woodland, which in tandem with the building’s greenhouse-esque styling, pays suitable homage to the environment in which these features reside. The saw tooth roof further fulfils the traditional industrial greenhouse look.

The building is designed to communicate and educate the visitor in the beauty, variety and complexity of the plant world.

Officially opened by the Duke and Duchess of Cambridge, the centre may be a site of tremendous beauty, but it is also all about brains too, providing an all-important base for botanic science and research. “The building is designed to communicate and educate the visitor in the beauty, variety and complexity of the plant world.”

Discussing some of the challenges involved with delivering the multi-faceted project, Patterson says, “The brief was complex with the entire long-term wish list for the gardens gathered together into one project.

“The Gardens wanted to incorporate a lot of diverse and often conflicting functions in the one structure – things like a café and the maintenance sheds, shade houses and public exhibition spaces were to be all mixed up with the research functions, so this required careful planning.”

Additionally, the Christchurch Botanic Gardens is unusual because it isn’t a walled garden – in fact it is permeable all the way around, pierced by bridges. The design included new access ways to complete the pathway system and open up a large section of the adjacent riverbank for public access.

While the ultimate milestone is realised in the tangible manifestation of an ambitious vision, Patterson talks about another recent and compelling win for the team. “We are thrilled that the complex has just been awarded the New Zealand Institute of Architects highest National award for a public building in a ceremony this week. We are over the moon with this result and having had the opportunity to be involved with such an important part of the Christchurch cityscape.”

With circa a million visitors each year – locals and tourists – the Botanic Gardens have always retained a special place in Cantabrians’ hearts and have done since 1863, when the planning of an English Oak tree marked their beginnings. Having celebrated its 150th anniversary in 2013, the gardens, spanning 30 beautiful hectares.
