They had never seen a car, nor a lightbulb. Yet our pioneering forefathers drained a swamp and built on it, leaving behind an enduring legacy that subsequent populations have continued to build upon – both literally and figuratively.

And, although the resulting city is one of which we can all be proud, the progressive nature of evolution means few modern cities – Christchurch included – embody the physical characteristics their modern inhabitants would elect, given the choice.

Yes, our CBD was dated, its retail areas not competing well against the rise of suburban malls, its architectural heritage weakened by the ravages of time and its residential spaces simply non-existent.

Yet some one hundred and fifty years later we get a ‘do-over’ and with that comes the opportunity to construct one of the best metropolises in the world.

This year some of the city’s major projects will come to fruition as new office and retail buildings open, significant progress is made on a raft of key developments and new agencies assume responsibility for Christchurch’s regeneration.

However, what is perhaps even more exciting on a local level is the visual form this rebirth is taking. This issue we celebrate that visual form, featuring some of the region’s latest developments.

We look at the much awaited rebuild of chain store Farmers in Rangiora and a two-building development on Manchester Street which now houses a range of popular businesses including Frobishers Espressory and Southern Hospitality.

We’ve checked out the internal fit-out of Life Pharmacy at Northlands Mall and the multipurpose design of Lincoln’s new Event Centre. We’ve headed out to Sumner to view the dynamic and eye catching design of the new Surf Club and we’ve looked into how new technologies and materials are transforming the look and feel of our homes and businesses.

The ability to plan for, absorb, recover from and adapt to events is clearly key to creating a stronger city but, as we’re quickly proving, it’s also key to making a much cooler space.

A

fter finishing 2015 on a high that carried through the summer holidays, there's plenty for Christchurch to be excited about in 2016.

The public response to the opening of the Margaret Mahy Family Playground and reopening of the city's Art Gallery just before Christmas was hugely positive. As well as restoring the city's vital infrastructure we are focused on bringing back the playgrounds and galleries and sports facilities which also make cities great places to live.

The list of projects ticked off or well underway in 2015 is long – the Bus Interchange, Earthquake Memorial, Retail Precinct, Innovation Precinct, Avon River Precinct and Justice and Emergency Services Precinct, and the Margaret Mahy Family Playground – but there is still much more to do.

This year is going to be another very busy one, with new legislation to be passed before April which will allow for the focus of our investment to shift from rebuilding to the regeneration of Christchurch.

One big thing we expect to see completed this year is the programme of repairing quake-damaged roads, bridges and underground pipes. The Stronger Christchurch Infrastructure Rebuild Team's work, funded by the Government and Christchurch City Council to the tune of $2.69 billion, is already 85 per cent complete.

Those who have passed by Residential Red Zones will also have seen the massive clearance that has taken place in these areas, clearing the way for their redevelopment. The people of Christchurch will get to have their say on what they will be used for.

In the central city, we are going to start to see the new Retail Precinct flourish this year, and it will be complemented by the new public areas being created along the Avon River. In particular, we can look forward to the completion of the Terraces section of the Avon River Precinct featuring stone steps leading down to the river and linking to a new promenade in front of the shopping and dining on offer.

It's vitally important that we continue to build a strong economy that attracts new investment and creates more jobs, and this remains front and centre of the Government's agenda. A strong economy supports better healthcare, education and other public services, and it's our strong economy that is helping us rebuild a vibrant Christchurch.

Your city is humming with activity and I look forward to what is to come in 2016.

T

he Catholic Diocese has a 'never before' opportunity to play a significant part in both the spiritual and physical regeneration of not only the city but also the province, because of the scale of work to be undertaken in 2016.

While last year was a year of real change with four churches reopened (Woolston, Dallington, Bryndwr and Hoon Hay), this year will see the start of a number of new builds, the scale of which has never been attempted before by the Diocese.

Spearheading this is the Cathedral, but other significant work will be undertaken. We are especially focussed on the 13 damaged heritage churches throughout the Diocese and while confident that we can repair and rebuild 11, we are growingly optimistic we will save all 13.

The real challenge is to make the most of this unique opportunity, seek out new avenues, think outside the square and do something different. And most importantly, we must be brave.

By concentrating on the Cathedral and the surrounding precinct, it will act as a catalyst for regenerating our focus on the interaction of religion, education, music and youth in this area.

Work on the viability of saving the nave of the Cathedral is picking up pace and as soon as we have removed more of the rubble and are able to carry out further investigations of both the ground and the building itself we will be able to plan with more certainty. We will then need to look at the viablity of the options open to us before settling on an agreed path forward.

This month sees the return of the Christchurch School of Music to its former location beside the Cathedral. Housed in temporary buildings, they provide fantastic opportunities for music students of all ages, not least those attending our two schools already sharing the site (Marian College and Catholic Cathedral Ciollege) and Christchurch Polytechnic on the other side of the street.

Our own CBS choir moves into a new purpose-built space this month beside the Pro Cathedral. When the time is right there is the option to relocate to the Cathedral Precinct.

With this increased buzz comes the opportunity for new and permanent developments, the perfect time to shape and invest in our futures.

A

s we approach the 5th anniversary of the earthquakes, we should begin by pausing and remembering the immense loss our city suffered on February 22nd 2011. One hundred and eighty-five people lost their lives in the earthquakes and the devastation that followed. That's 185 families who are still grieving mothers or fathers, sons or daughters, husbands or wives. For all the progress we've made as a city in the years that have passed, the people we lost will always be with us.

As well a time for remembering, this five year anniversary is also a time to look to the future – to what we want the next five years in Canterbury to look like. We've heard recently that we are likely to be just halfway through the rebuild and the recovery from the earthquakes. In the years to come though we are going to have to tackle big questions about what we want our city to look like in the future, and how we deal with some of the lingering effects of the disaster.

Chief amongst these issues is the over 10,000 Cantabrians still stuck battling EQC or their insurance company. We need urgent action so these people can finally move on with their lives. We also need to be doing more to deal with the coming tidal wave of people with mental health difficulties from years of stress and trauma after the earthquakes. This is going to be especially true for young children who have lived their whole lives in the shadow of the earthquakes.

We also need to be doing more now to return decision making power to local people. One of the defining aspects of the recovery at the moment is the way that the private sector as leaped ahead of the Government – especially in the central city. We are seeing incredible energy and creativity emerge as our city is rebuilt and we should be supporting that by giving locals more power, especially as the CERA powers come to an end.

If we do that we can ensure that something lasting and positive will come out of all this tragedy – a city we will be proud to leave to future generations.

or the next phase of the post-earthquake recovery we need a step change which returns leadership to local organisations and Christchurch citizens. Yet the National Government is once again constraining local democracy, through the Greater Christchurch Regeneration Bill.

The Bill is intended to provide a legal framework for the rebuild until 2021. The Bill also establishes Regenerate Christchurch, a new entity with a seven member board appointed by Government including a NgÄ i Tahu nominee and the City Council. CERA disappears, being being absorbed into the Department of Prime Minister and Cabinet, and a new company CrownCo taking responsibility for the anchor projects.

The Bill is flawed because it leaves far too much power with Ministers in Wellington, especially in preparing the planning documents to guide future development in greater Christchurch.

This is partly because the Bill is based on the CERA legislation.

It carries over many elements of the post-emergency period. It gives several Ministers, not just the Minister for Earthquake Recovery, excessive powers. Ministers can override RMA planning processes. The Bill continues to restrict appeal rights on plans. It allows Ministers to both initiate and approve regeneration plans; and to suspend, amend, or revoke RMA documents, council plans, regional land transport plans; and plans or policies under Local Government Act. If Regenerate Christchurch is to be effective and lead the next phase of earthquake recovery it should have the responsibility for initiating plans, not Ministers. If central government needs to be involved to protect Crown investment in the city, it should only be at the plan approval stage.

The current Bill risks crippling Regenerate Christchurch before it starts. It risks investors and developers bypassing the new entity to lobby Ministers directly for plans which facilitate particular developments and commercial uses.

Five years on from the Christchurch earthquakes, it is disappointing that major decisions about the city's future still won't belong to local organisations and local residents.

The legislation needs changing to respond to submitters who called for the public to have more say and for local organisations to make more decisions and Ministers in Wellington, fewer. It is time for Christchurch people to have our democracy back.

T

here appears to be a new energy starting to emerge in Christchurch. With the establishment of our new architectural office in Christchurch last year, I moved my family from Melbourne so we would become fully integrated in the exciting opportunites that we saw were evolving.

Much to our surprise, the energy, desire and passion which we brought with us just did not seem to be present. Talking with a wide cross section of people, we came to understand that this lack of energy was an indication of the fatigue many were suffering from the ongoing battle against process, red tape and the emotional scars of the earthquakes.

Walking around the city recently I have noticed a dramatic change from 12 months ago in the energy and new additions to the built environment. These can only be a catalyst in the short term and positive in the long term for the city and its inhabitants.

My vision for Christchurch is very similar to that of the vision of the new masterplan for the city, but with a few variations. I would love to see a vibrant city of at least 750,000 people living and working within the current growth boundary with at least 20,000 of these living within the four avenues.

This will require increasing the density of the traditional Christchurch block of land (both CBD and suburban), and contrary to popular opinion, this increase does not mean a lack of amenity or choice.

The opposite is actually true as housing variety increases choice and can increase amenity. There are many studies and world experts in town planning and urban design that support this stance.

Get involved but be specific and positive. Have a look around your local neighbourhood and find out what is happening or what is proposed for the city. Pick one or two things that strike your fancy and don't get hung up on things that you don't want to happen.

If we all focused on what we want, rather than what we don't want the whole city will be a buzz of positive energy focused on moving forward in way that is driven by the people of Christchurch, for the people of Christchurch.

I

t continues to surprise me that various economic commentators, mainly from outside our region, are predicting that the activity related to the rebuild post-earthquake has peaked and we will see significant decline within the next year or two.

The year 2016 will be the year that we reach the halfway point in the rebuild, which obviously means we have still got 50 per cent of the rebuild to go. Any statistics obtainable from the CERA website will confirm that.

While the horizontal infrastructural spend relating to underground services is expected to be complete by December this year, commercial rebuilds, key projects and housing stock will continue through the process of regeneration. We have estimated that we are spending $100 million a week, every week, rebuilding our city. It is also anticipated that it will continue to be the case for the next three to four years.

Once again I make a plea to economists who wish to advise us that it is nearly all over, that they look at the facts. My understanding is that the Government's end date for the rebuild is 2026, so we can expect activity related to the rebuild to extend out over the next ten years. Of course it will reduce in intensity but it is not going to fall off a cliff and there are still billions of dollars to be invested into our economy.

These are exciting times for Christchurch because we are now starting to see real evidence of regeneration. Those exciting times can be undermined by false assumptions with regard to assertions that the largest economic development programme to have occurred in New Zealand is coming to an end. It is not coming to an end; it is coming to a halfway point.

Unresolved Insurance Claims – Last Call.

The damage and disruption caused by the Canterbury earthquakes has resulted in an unprecedented number of insurance claims. Many insureds will be surprised to learn that an insurer may decline an unresolved claim in its entirety if proceedings have not been filed in Court within a specified limitation period.

nsurance claims for damage or disruption which occurred up to 31 December 2010 will be governed by the Limitation Act 1950. Under the 1950 Act insurance claims must be filed within 6 years of the event that caused the loss. Any insurance claim for damage caused by the 4 September 2010 earthquake must therefore be filed in court by 3 September 2016 at the latest.

Insurance claims for damage or disruption which occurred from 1 January 2011 onwards will be governed by the Limitation Act 2010 which came into force on that date.

Different wording used in the 2010 Act has created uncertainty around when the 6 year period starts to run. There is debate as to whether the limitation period under the 2010 Act starts to run from the event or at a later time such as when the insurer declines a claim. There are also some rare exceptions which may enlarge the limitation period.

The safest course for an insured who has an unresolved claim is to file proceedings in Court by 3 September 2016 at the latest. Insureds should not leave the filing of such claims to the last minute. Legal advisors will need sufficient time to consider the claim and prepare the Court documents.

As an alternative an insured could negotiate to contract out of limitation defences with their insurer. For instance, EQC has publically announced that there is no 3 September 2016 deadline to bring Court proceedings for an EQC claim. EQC has announced that the 6 year period will generally run from

the date of settlement or when the claim is declined.

Some insurers have also recently announced that they will not raise a limitation defence until 4 September 2017 for any residential claim.

It would be unwise for an insured to rely on these announcements.

In each case, an insured should obtain the written agreement of EQC or their insurer to an extension of the limitation period.

It should also be borne in mind that the announcements by EQC and some insurers do not apply to non-residential insurance claims.

In all cases insureds should take timely legal advice.

ased in Ashburton, Bradford Building demonstrates construction capability across a range of civil works, through to commercial and community buildings, architecturally-designed private houses, and specialist restoration work on historic sites.

Operating for more than 60 years, the diverse company constructed almost all of the major buildings in Ashburton, and has also been involved in building, altering, restoring and fitting-out many large commercial and industrial structures across Canterbury.

One of their latest projects, a two-storey building on 96-100 Riccarton Road, demonstrates the company's high quality workmanship and innovation.

Designed by Skews Architects, the ground floor of the development was created to provide split retail tenancies and leading up to the first floor via two separate stairwells is an open plan office, which can also be subdivided.

“The modern design is complementary to the surrounding area, and creates a very pleasing outlook for office workers overlooking the bustling Riccarton Road traffic,” Mark says. “Also, the abundant glass on the street frontage of the building creates a lovely contemporary look from the inside and outside. And, as the building is facing south west, it also provides a lot more natural light for the tenants, particularly on the first floor.”

Project manager of the development was Bradford Building's Kieran Doran, originally from Ireland, who has been with the company for three years. “Keiran came through to help us with this project, along with a number of other projects in Christchurch – he is very capable and a fantastic asset to our team.”

With 75 staff across both Ashburton and Christchurch, Bradford Building has recently expanded quite rapidly. “Within the last 18 months, we've grown from a staff of 35 to a large team of 75.

There has been a lot of demand for work in both Ashburton and Christchurch, in direct relation to the rebuild.”

Metalwork specialist develops its own product range After over 60 years as a leading metalwork solutions company, Carlton Taylor Industries Limited (CTI) has diversified by introducing its own range of products into the market.

F

ollowing the decision to add another dimension to the well-established business, a line of high quality Carlton branded products was developed and entered into the market in mid-2015.

CTI construction sales manager Gary McCann says the company wanted to capitalise on its strong brand. “It was about utilising our first-class engineering capabilities in design, development and manufacturing. And it also meant reducing dependence on our contract manufacturing.

We received an order from them two days later – our ability to move fast and thorough was accepted straight away.

The customer was very pleased with all the work that was involved and the fact that we went the extra mile to meet their opening date.”

CTI, incorporating Aluminium Die Casting Ltd, employs over 65 staff in two Christchurch locations, across the sheet metal fabrication, aluminium diecasting and CNC machining industries. It is a major supplier of metalwork solutions to Australasia and beyond.
