San Jose Vice Mayor MAGDALENA CARRASCO has been followed and photographed by political rivals ever since her initial and unsuccessful 2010 run against scandalplagued XAVIER CAMPOS for the District 5 seat.

Over the ensuing years, they’ve hired private investigators to stake out her apartment in attempts to discredit her ties to the East Side. They’ve snapped cellphone photos of her holding court with constituents at Starbucks. She says they’ve even paid one of her neighbors to keep an eye on her comings and goings.

But never, to Carrasco’s knowledge, had they sent mom to do the dirty work.

That changed last week, when strident Carrasco critic and re-election challenger DANNY GARZA upped the ante by deploying his dear mother to stand sentry outside They the councilwoman’s Did house. Armed with a What? black point-and-shoot camera and clad in a SEND TIPS TO “Vote Garza” T-shirt, FLY@ METRONEWS. HELEN GARZA dutifully COM snapped pictures of Carrasco and her children outside their home.

Carrasco was more irritated than intimidated by the elderly woman’s presence, but rebuked it as an extension of Garza’s relentless harassment.

“It does not surprise me, given Garza’s history of intimidation of women, even by his own admission,” Carrasco tells Fly. “He verbally harasses my staff every day and disguises it as so-called transparency. He has repeatedly bullied young female staff members and berated and belittled the most vulnerable residents in our district.”

Garza—who has indeed acknowledged that his ex-wife filed a domestic violence claim against him years ago—didn’t return Fly’s requests for comment Tuesday. But in a May 26 campaign email embellished by bold font and capital letters, Garza accused the vice mayor of slander.

Carrasco calls Garza’s latest antics a distraction. “When we should be advocating for and promoting housing solutions for our most vulnerable residents,” she says, “he has consistently spread false and alternative facts to divide our community.”

Big Oil spends big bucks to attack antifracking Assembly candidate

HE STATE’S petroleum industry is spending a fortune in a South County race for state Assembly to defeat fundraising frontrunner Robert Rivas. The San Benito County supervisor hopes to succeed Anna Caballero, who’s running for state Senate this year and represents a jurisdiction that stretches from Morgan Hill to King City.

The San Rafael law firm Nielsen Merksamer Parrinello Gross & Leoni, which counts BP, Chevron, Exxon Mobil, Phillips and Valero Energy among its clients, created and poured $320,000 into the Coalition to Restore California’s Middle Class, Opposing Robert Rivas for Assembly 2018. It’s the first time the industry has targeted a local official seeking higher office.

Rivas was at the forefront of San Benito’s Measure J, which banned fracking in 2014 despite a $2 million

push funded by large petroleum companies to defeat it.

San Benito was California’s first county to enact a ban on fracking and associated oil extraction technologies, including acid well stimulation treatments and cyclic steam injection; a similar effort failed in Santa Barbara after the San Rafael law firm led a $7.6 million campaign funded by large petroleum producers. Monterey and Santa Clara counties both passed anti-fracking laws in the wake of the San Benito win. This year, there’s a push in San Luis Obispo County to enact a similar ban.

Rivas is a Hollister resident who has been on the Board of Supervisors since 2010. His campaign decries the ads against him as misleading, negative and personal. Among other things, the ads criticize Rivas on public safety. Rivas is running against a fellow Democrat, former prosecutor and lawyer Peter LeroeMuñoz, as well as Bill Lipe, whose

the Sierra Club and civil rights icon Dolores Huerta.

“Robert Rivas took a bold stand against fracking in San Benito County,” said Democratic Assemblyman Marc Levine, who represents the San Rafael area in Sacramento and pushed for a failed statewide fracking moratorium in 2012, “and oil companies want him to pay a price.”

“Fortunately, voters will have the last say.”

Rivas opponent Leroe-Muñoz also addressed the petroleum industry campaign against Rivas in an interview earlier this month.

“Obviously it’s an independent expenditure, so we [candidates] have no coordination with them,” he says. Citing his law enforcement background, he says, “I can’t speak to what their thoughts or motivations are, but I think that what is important is that they are raising an issue around public safety. That’s an issue that many residents have raised with me in the district.”

The petroleum industry committee paid for a recent mailer that “addressed that issue in particular around Robert and public safety and cuts that he made while he was on the Board of Supervisors,” says Leroe-Muñoz.

The Gilroy councilman has raised $80,898 in contributions, according to the contribution database on the California Secretary of State’s website, though Leroe-Muñoz estimated his raise at $140,000 in a Tuesday interview. Supervisor Rivas has brought in $451,432, according to state filings. Lipe has collected $93,537 and contributed $55,000 of his own money to his campaign.

Leroe-Muñoz, who supported a failed 2016 effort to develop 721 acres of North Gilroy farmland into a 4,000-home development, has received contributions from Gilroy development services firm Ruggeri-Jensen-Azar & Associates, Summerhill Homes CEO Joe Head, Gilroy concrete firm owner Don Alvarez, Gilroy residential developer The James Group and Peninsula developer Skip Spiering.

Rivas draws much of his support from public employee unions, including teachers, nurses and municipal employees. Other contributors include state trial lawyers’ groups, Yelp CEO Jeremy Stoppelman and former Palm CEO Donna Dubinsky.

campaign is funded by agricultural interests in the Greenfield, San Ardo and Salinas areas.

The primary is on June 5.

Rivas opponent Leroe-Muñoz, a Gilroy councilman, is on the same page when it comes to the contentious extraction process. “I do not support fracking,” he says.

Nielsen Merksamer attorney Steven S. Lucas is listed as the attorney of record for the political committee. He did not respond to phone calls and an email seeking comment.

The Nielsen Merksamer firm was instrumental in helping defeat Santa Barbara’s Measure P, and the firm opposed the 2006 California Global Warming Solutions Act (AB 32), a state law that aims to reduce the state’s greenhouse-gas emissions.

“We advise our ballot measure clients on all aspects of campaigning,” the firm’s website reads, “from initiative drafting and filing, contesting ballot language and other pre-election litigation, observing and potentially contesting the final vote, and post-election substantive challenges.”

Rivas says he’s not surprised at the petroleum industry’s moves against him.

“That is, unfortunately, politics in 2018,” he says. “Being in this process for the first time, this Assembly seat is a regional office and it’s certainly been a unique experience, and it’s unfortunate that the oil companies have chosen to play dirty politics by attacking me personally with misleading attack ads and attempts to deceive voters. The fact that I took on the oil industry to protect the community against fracking—that’s why I am the subject of these attacks.”

Rivas believes that the attacks on him will only further toxify a Sacramento political climate that’s fraught with divisiveness.

“The civility question—it plays to a larger concern as to why people have very little faith, have very little confidence, in elected officials and government in general,” he says, noting that the energy lobby never met with him during the Measure J push. “They viewed my position against fracking as against their interests.”

Lawmakers Call for Audit of Embattled School District

BY JENNIFER WADSWORTH State lawmakers are now pushing for an audit to investigate claims of fraud and self-dealing at the embattled Alum Rock Union Elementary School District, which serves 11,000 students in East San Jose.

Assemblyman Ash Kalra and state Sen. Jim Beall, both Democrats from San Jose, announced the audit request late last week, saying it would mirror a 2017 review that found credible evidence of conflicts of interest and misappropriation of school construction bonds.

Last year’s probe by the Fiscal Crisis and Management Assistance Team was prompted by an anonymous complaint that Del Terra Real Estate Services—the company hired to manage hundreds of millions of dollars in taxpayerfunded bonds—had fraudulently billed the district for construction and management services.

Despite those findings and resulting public outrage, a defiant majority bloc of the district’s five-member governing board—namely trustees Khanh Tran, Esau Herrera and Dolores Marquez—renewed contracts with Del Terra. They have also refused to implement the vast majority of the 70 recommendations from last year’s audit.

The board’s inaction recently led the state to give the Santa Clara County Office of Education financial control of the K-8 district. If Beall and Kalra get their way, the State Auditor will take a closer look at some of the allegations, which range from civil to criminal violations.

“It is time for a more expansive and exhaustive audit of the district to ensure that things do not get worse,” Kalra said in a news release.

Beall echoed his concern.

“An audit of Alum Rock Unified’s

finances is in the best interests of the children who attend the district’s schools,’’ Beall said in the same release. “Parents of students have real concerns about how the district board functions and how it spends their tax dollars. Is the money being spent on instruction or is it being wasted? The community deserves to know.”

County Superintendent Mary Ann Dewan said she, too, welcomes the additional scrutiny as the board majority continues to threaten the fiscal stability of the district.

Meanwhile, community members have submitted their own requests for investigations by the Santa Clara County District Attorney’s Office and the Fair Political Practices Commission and have rallied support for their cause from other local electeds, including San Jose Mayor Sam Liccardo.

Two bills aimed at clearing the backlog of untested rape kits in California come to a vote this week on their respective chamber floors.

Assembly Bill 3118 by Assemblyman David Chiu (D-San Francisco) would require agencies that process sexual assault evidence to take inventory of untested kits and report those statistics to the U.S. Department of Justice by next summer. Senate Bill 1449 by state Sen. Connie Leyva (D-Chino) slightly revises the language in existing law to make it mandatory—instead of merely recommended—for law enforcement to submit rape kits within 20 days to crime labs and for labs to test the evidence within 120 of receiving it.

Currently, when or whether a rape kit gets tested varies by ZIP code.

Even within Santa Clara County, law enforcement agencies differ on which kits to include in their official backlog. Not all agencies process 100 percent of their kits. Sometimes, that’s because police already know the identity of the alleged perpetrator. Other times, they already have a confession.

But advocates for full and timely testing say each evidence kit has value. The Joyful Heart Foundation, which has been leading a nationwide campaign to clear sexual assault kit backlogs, says testing the genetic evidence can help incriminate or exonerate.

“The rape kit backlog represents a failure of the criminal justice system to take sexual assault seriously as the violent crime that it is,” says Ilse Knecht, a policy director for the nonprofit foundation.

“Making important changes to how California handles its backlog of untested kits sends a message to survivors that they matter. It also sends a message to perpetrators— often violent and serial offenders— that they will be held accountable.”

Tapped Out Corporate Owners Drive Pioneering Downtown Brewpub into Ground

FTER 28 YEARS of operating on San Fernando Street in downtown San Jose, Gordon Biersch (GB) will close its doors for good this weekend. Every bartender and former employee that I can remember, at least those within driving distance, will descend upon the establishment for one last blowout on Saturday.

For anyone to appreciate the

absurdity of this, I must take you back to an early-’90s version of downtown San Jose, before laptops, cellphones and the World Wide Web, and back when real estate syndicates were scrambling to “revitalize” the neighborhood. Much of the area was still abandoned since the ’70s, while other parts of it featured crumbling retail, empty parking lots, stray halfway-house denizens, panhandling transients and fledgling obnoxious jock bars. The light rail had just gone in. Across the street was a not-yetdisastrous attempt to force-cram an upscale open-air shopping mall

into the area, the now infamous Pavilion Shops. Downtown had no restaurant scene of any sort, and the entire concept of “good beer” did not exist anywhere. Although GB wasn’t San Jose’s first microbrewery, it was probably the first one with staying power and a key player in the next phase of downtown’s perpetual state of perpetuating. At SJSU, we’d often show up after night classes in the music and art departments, since there was rarely any restaurant food obtainable past 9pm anywhere. And the beers were $3.

Even though GB came across as a privileged upmarket place—at times it was frat boy central—what made it fun was an attitude of providing the regulars with a totally different dimension of experience.

As the years unfolded, as soon as any regular was deemed worthy, he or she was given a personalized stein, a half-liter German-style chalice with a pewter lid that you flipped open with your thumb. Each Steinholder had his or her name etched into the

lid and also onto the museum-style cabinet in which the steins were kept behind the bar. When the bartender opened the cabinet and pulled my stein from the shelf—a shelf also with my own name—it was like being a member of a secret society.

Special events like the tapping parties were initially just for the Steinholders and not for the general public. And no one else understood how to get one. We intentionally kept it a mystery. For someone that already lived in his own head most of the time, this was fantastic.

Which meant, in my case, as a Steinholder, I could walk into GB, dressed like an absolute slob, unshaven, wearing ripped-up jeans and faded t-shirt, with a mop of hair down to my shoulders, all of which elicited horrific looks from all the upmarket people. I almost could read their thoughts: “Ew, what’s he doing here?” Stuff like that. Then I’d approach the bar and drink from my own personalized stein of beer, shocking the upmarket clowns all over again.

Thanks to the bartenders at GB, I could be a rockstar. I was a man of wealth and taste, like Mick Jagger.

Confusing the crowd was the nature of my game. I confounded the mere mortals, the attorneys, the business majors, the frat boys and the suburban nuclear families, none of whom had steins. I would be around for a long, long year, stealing their souls and faiths. It was a great way to get back at the idiots that picked on me in high school.

Then the corporate pricks ruined it all. In retrospect, 2010 is about when GB began to lose its staying power, culture-wise. Many of the longtime bartenders were leaving and, like everything downtown, the food got progressively worse and more expensive. The owners began to dumb down the work culture and the Secret Holy Order of Steinholders was only a shell of its former self.

Plus, a whole new generation of craft beer places began to emerge in the neighborhood, with GB, the original pioneer, seeming to lose its way. Even as the comfortable classes always filled up the dining area because they hadn’t felt safe anywhere since P.F. Chang’s closed, GB was never able to recapture its original vibe. The vulture capitalist owners destroyed the Mick Jagger in all of us.

Wars From broken bones and 'bird hunting' to e-scooters in public bathrooms, the future of transportation in Silicon Valley takes a bizarre turn

OAPE PELA ISN’T your average, lanky tech bro.

Sure, the 30-year-old East Palo Alto native lives in downtown San Jose and works as a payment analyst at local finance tech startup Finxera.

But the former University of Utah football player’s 6-foot-3, 320-pound stature made him wary of one trend quickly gaining traction with his startup brethren: electric scooters.

“I was surprised. They have some jump,” Pela says of the devices that started to appear on city streets in February. “It felt pretty good, having the wind blow through my hair and all that.”

Pela is one of many San Jose residents, commuters and business owners navigating the sudden emergence of hundreds of scooters available through two deep-pocketed app providers. San Mateo startup Lime has raised $132 million to offer

on-demand shared bikes and scooters in San Jose and more than 50 other cities nationwide. Bird, a startup based in Santa Monica, is backed by $115 million and focused solely on e-scooters.

New riders can set up an account in minutes by downloading the free app, uploading a credit card and agreeing to terms of service that include parking out of the public right of way and wearing a helmet. Bird also requires users to scan a valid driver’s

license. From there, users who pay a flat $1 fee, plus 15 cents per mile, can use the app’s map feature to find an available scooter and take a picture of a QR code to unlock the device.

The scooters, controlled by a simple hand throttle and brake, can reach a speed of 15 mph and hold a charge that lasts up to 18 miles.

In San Jose, a city known for a lack of fast transit options, the scooters alternately attract praise from loyal users, ire for clogging public

sidewalks, skepticism about safety and criticism as a perceived harbinger of gentrification—controversies that also surround sharing economy services such as Uber, Lyft and everevolving local bikeshare programs.

The trick with scooters: They’re just obscure enough to make them harder to regulate.

“There was no coordinated strategy for introducing the scooters to the street,” says Colin Heyne, a spokesman for the San Jose Department of

Transportation. “Not surprisingly, we didn’t have a policy around e-scooters.”

Concerns the city has heard mostly include illegally riding scooters down sidewalks, users discarding scooters on lawns at the end of the ride and riders not wearing helmets. As a result, scooters have emerged as the latest uniquely 21st century question of where a company’s responsibility ends and a city’s or consumer’s begins.

Some see the new e-scooters as gentrifying techie-mobiles, but the on-demand devices could drastically improve transportation options in the South Bay.

“Riders are required to obey the law, but enforcement is difficult for us,” says Sam Dreiman, Lime’s director of strategic development for California. “In some ways, it’s an even bigger question of how much we can enforce or should enforce.”

If companies try to dodge enforcement responsibility, though, it’s not clear whether the city is ready to step in.

HOT WHEELS The ubiquitous scooters have been a boon for Silicon Valley commuters looking for alternatives to the region’s aging mass transit systems, or simply a way to bridge that last mile or so to and from the nearest transit hub.

“San Jose is one of the least-staffed cities in the country,” Heyne says. “We don’t have people waiting around to go enforce rules for errant scooters.”

In the meantime, both the state and the city are hashing out first-ever attempts at regulations designed specifically for e-scooters. In San Jose, they’re due in September, which could make for a long summer in limbo for critics.

Gray Area Take a trip to Diridon Station during rush hour, and it’s clear that commuters in Silicon Valley are already seeking alternatives to the region’s decades-old mass transit systems. From foldable bikes and electric skateboards to the occasional pair of in-line skates or old-fashioned

of the service surfaced almost as fast as the scooters themselves.

In San Jose, Lime scooters were the first to appear, in late winter, Heyne says. The company was already familiar to the city after setting up a short-lived bikeshare system disbanded due to violating a noncompete clause of the city’s contract with Ford’s GoBike program. Scooters were a brief topic of discussion before the company decided to move ahead, in parallel with shared electric bikes that don’t compete with Ford’s conventional bikes, Heyne says.

“We were seeing higher ridership with those electric products in other markets,” Dreiman says.

“That allowed us to accelerate our conversations with the city.”

Soon after came Bird, which opted for same-day deployment instead of advance conversations with the cities.

“That was shorter notice,” Heyne says. “As in, we got a call that they were going to be dropped off on our streets.”

Kenneth Baer, a Washington, D.C.based consultant for Bird, declined to detail the company’s approach to entering San Jose or other new cities.

“Obviously, we have a deliberative process,” Baer says. “I’m not going to get into the details.”

Despite the unconventional rollout, demand has ramped up quickly for the scooters, sometimes making it difficult to find an available device near hubs like Diridon Station.

In the meantime, though, business owners like Maxwell Borkenhagen say the largely unregulated devices can cause problems day to day.

Scooter Cops Spending months crafting detailed policies just for e-scooters might seem a bit excessive. At stake, though, are much bigger questions about who’s responsible for the lessdesirable side effects of the sharing economy. As venture capital-backed startups seeking rapid growth with minimal costs, that tension can come to a head in multiple ways.

First and foremost, Lime contends, e-scooter companies are providing cities with a publicly accessible transportation option at no direct

Razor scooters, long commutes and already-overflowing BART and Caltrain cars have pushed the noncar-dependent to get creative.

In some ways, Silicon Valley is late to the party that planning wonks refer to as “multimodal urban mobility,” where future transportation systems stand to encompass more options than 20th-century cars, trains and buses.

Fast-growing cities in China, for example, have already spent the better part of the last decade trying to figure out how electric scooters of varying sizes can coexist with electric bicycles and other car alternatives.

Automakers like Hyundai and Toyota have unveiled their own high-tech scooter prototypes in recent years, and Lyft in late May signaled an interest in rolling out e-scooters in San Francisco.

“It’s just very costly to use cars to make short trips, especially in cities,” says Ratna Amin, transportation policy director for urban planning think tank SPUR. The rise of scooters and other smaller-scale alternatives, she says, “require us to now think differently about our streets.”

For the past several months, scooters have been a touchy subject in San Francisco, pushing the city late last month to set a June 4 deadline for getting unpermitted devices off city sidewalks. The city says it will begin issuing permits at the end of the month, leaving a gap for users already reliant on the service.

In the meantime, e-scooters’ more recent arrival in San Jose has been marked by a wide range of reactions: “Bros are racing app rental electric scooters outside my apartment,” San Jose Sharks digital media coordinator Ann Frazier wrote on Twitter. “This is now normal everyday life in downtown.”

“Someone brought their Lime scooter into a bathroom stall!?” tweeted San Jose State University student Monica Mallon.

“Fucking scooter idiots almost ran into me twice,” media pundit and City University of New York professor Jeff Jarvis complained on Twitter during a recent trip to San Jose.

cost to the city. All they ask is that the city pay for necessary taxpayer-funded elements, like bike lanes and road maintenance.

“We provide the subsidyfree mobility. Cities provide the infrastructure,” says Lime spokeswoman Emma Green.

But what happens if riders violate either the company’s terms of service, or laws governing riding on sidewalks, parking scooters in the right of way or not wearing a helmet?

California lawmakers are just now writing policies to govern bike lane usage for scooters. In San Jose, using traffic cops to police such low-level nuisances isn’t practical, Heyne says.

“We are woefully understaffed for traffic enforcement,” Heyne says, noting one recent tally counted just a half dozen citywide traffic cops.

Companies, too, are eager to avoid costly, on-the-ground scooter patrols.

“That’s a big one, trying to hold people accountable for how they park,” Dreiman says. He noted that Lime now requires users to submit a photo of how they park their scooter for a trip to officially end and billing to stop. The company is also considering using riders to police each other, submitting photos of

other riders’ parking fails, or offering yet-undefined “incentives” for good behavior, he says.

Bird similarly includes language on its app directing riders how to park. For clear city code violations, like leaving scooters in front of handicap-accessible ramps, Baer says the company is well aware police can issue citations or even tow vehicles.

To counter such concerns, Bird CEO Travis VanderZanden, who previously worked at both Uber and Lyft, earlier this year signed a “Save Our Sidewalks,” or SOS, pledge committing the company to removing scooters from sidewalks overnight, paying cities $1 per scooter per day to offset transportation infrastructure costs and limit the number of scooters to those used at least three times per day.

“Sometimes people lose the big picture when they think about what’s going on here,” Baer says. “There’s people who like it, people who don’t like it. Really, people are thirsting for a new way to get around.”

Still, safety is another moving target. In San Francisco, a Twitter account registered to Facebook product manager Dan Grover in midMay posted a screenshot from the

Wheel World After Pela got into riding scooters, he also saw a business opportunity in the technology. Going from work to his apartment in San Jose, he realized, he could also pick up a few scooters to take home and earn some extra cash.

“The wheels started turning, and I was like ‘Hmmm, how do you become a charger?’” Pela says. “That seems like some easy money.”

Another sharing economy staple evident in the model of shared scooter companies is heavy reliance on nonemployees to charge and move devices to keep up with demand. Pela recently signed up to charge for Bird, which he was told will earn him $5-20 per scooter charged and placed the next day in the appropriate “nest,” or location where it will be made available to users.

The large variation in pay, Pela was told, reflects the difference in the difficulty of “bird hunting.” Users have been known to take scooters inside their homes or offices, and social media posts also show scooters that will later have to be recovered from trash cans or other off-the-beaten-path locations.

GPS-tracked scooters going off the grid is usually an isolated problem, representatives for both Lime and

Bird say. Lime also has an operations team that will knock on doors when needed—and another built-in last resort.

“We have alarms on all scooters and bikes that the team can set off,” Green says. “We’re able to use that as a way to get them back.”

The GPS also provides companies with large amounts of location data, which Lime says is aggregated and anonymized to protect user privacy but provide the company with trend data on how to best meet demand for scooters in different locations.

“We’re tracking the devices and their movement, not our riders,” Dreiman says.

Bird’s privacy policy also says that exact location data and trip routes are stored anonymously. Both Lime and Bird collect personal information like name, contact information and credit card number, upon registration.

Though Heyne says the city isn’t yet receiving any data from scooter providers, such information on ridership or common trip routes could prove useful in transportation planning as well. Key for the city of San Jose, which is also pursuing “smart city” initiatives related to self-driving cars and other nascent technologies, is balancing new forms of transportation with appropriate regulation.

“We’re trying to figure out ways to allow these innovations to happen on the public right of way, just to make sure they’re safe and responsible as they happen,” Heyne says.

The question now is whether the city, the companies or everyday users will be asked to bear the brunt of that responsibility.

“Took a spill as they don’t handle uneven pavement well,” Grover tweeted. “Aside from broken bones, UX was good.”

Though Lime keeps records for injuries reported by users, injuries aren’t always reported. Green says the company carries business insurance mandated by each city it operates in. Lime has also started a helmet distribution center in San Francisco or done occasional helmet giveaways.

Bird has sent some 22,000 helmets to users who request them, Baer says.

In San Jose, Heyne says helmets and other safety rules will likely be included in the city’s September policy recommendations.

“It’s like bring your own seat belts if you’re renting a car,” Heyne says. Still, he added, injuries are also difficult for the city to track: “Nobody calls the DOT if they get into a scooter crash.”

then the blended fungi concoction is poured slowly to fill the bowl with a rich, earthy starter. The baby greens salad ($8) with shaved vegetables and a pistachio vinaigrette is simple and ingredient-driven using fresh, high quality produce in peak season.

The soup and salad options are minimal, with only two of each to allow the pasta dishes the attention they deserve. During the preview opening, chefs were making fresh pasta in the sunroom, which is normally used as additional seating with a street view. These same house-made fresh pastas are on the menu including the signature Pasta Armellino ($19), a tagliatelle with black pepper, parmigiano, crab and uni pieces. The uni is mixed into the light cream sauce and the fresh crab pieces are strewn about the thin ribbons of noodles. It is an immediate hit and must be eaten hot as the dish does start to fade in flavor when it cools down.

Green garlic is in season now, and it’s used in the pappardelle ($17) with Berkshire pork, Italian sausage and tomato sauce. Beware, it packs some

heat and lots of flavor. This is a good option for those who would enjoy a twist on the classic meat sauce and marinara pasta dish. Meanwhile, the spinach bucatini ($15) is a sleeper hit that definitely warrants a return visit. Sliced smoked bacon mixes with springy al dente pasta, topped with shaved cured egg yolk and aged gouda. The flavors and textures are mellow, and it is technique that really shines through in this dish.

Pasta Armellino may be a new eatery, yet for those who remember, it is in many ways a reinvention and subsequent reintroduction of some familiar elements. First, Chef Armellino is already a fixture on the Saratoga culinary scene thanks to his achievements at Plumed Horse.

Also, pasta is not a new cuisine to the location, as this used to be home to East Coast Alice, a quaint pasta and pizza restaurant. The building’s renovation gives it a new exterior and interior aesthetic, but the recognizable arrangement of the sunroom immediately to the right of the entrance brings back memories of East Coast Alice’s choppy layout.

Pasta Armellino brightened up the space with white tiles and a fresh coat of blue paint where the previous restaurant had been kept purposely dim with a darker color palette. Each previous occupant has taken care to preserve a wooden beam from the original back barn of the space where the kitchen is now located. Armellino has put this beam in the ceiling of the kitchen. The main dining room features an entire wall of graffiti art from San Francisco-based artist Chris Kondo. It is in stark contrast to the rest of the space, which is decorated in a mix of contemporary-meets-Art Deco era colors, sconces, and lettering.

This isn’t the kind of place for the diner who wants to be fussed over.

The service style lends itself well to the independent diner who doesn’t mind settling the bill up front, carrying their own beverage tray and promptly exiting after dinner. It is definitely the place for anyone who wants good pasta.

FIRE + FLESH Sophie’s Mediterranean Grill nails the basics with its beef kofta kabob plate.

HE ORIGINS OF man cooking meat over an open flame can be traced back to our caveman ancestors hundreds of thousands of years ago. A cursory search of the internet shows that “kebobs” originated in Turkey over 600 years ago, with Turkish soldiers cooking hunks of freshly hunted meat on their swords over open-field fires.

There’s something very primal about the cooking and consuming of foods in this manner that men and women alike are drawn to. So, when my boss turned me on to Sophie's Mediterranean Grill, I couldn’t resist the urge to go there post haste, as I can’t resist a good kabob.

Located in the pristine Evergreen Village Square, Sophie’s is owned by the proprietors of another Evergreen favorite, Caspian Village. The interior is modern and clean with extremely high ceilings that give it a cathedral-like atmosphere, and would be a fine spot for a group lunch.

They serve up all the usual complement of Middle Eastern fare, and among a growing number of restaurants that now exclusively serve Halal meat. They are a fast-casual spot, so ordering at the counter is a must. I ordered my two test dishes that any legit Mediterranean spot should be able to pull off—the beef kofta kabob plate ($11.99) and a baba ganoush ($4.99) app.

First up was the baba ganoush, and it was spot-on. The eggplant was creamy, smoky and seasoned perfectly. Every dip of the accompanying pita bread was a delight.

The kabob platter is served with the full accompaniment of sides— including rice, hummus and a green salad—to make this one of the more complete kabob platters out there. The rice was bland and forgettable, but the hummus was tasty, albeit a bit heavy on the tahini for my liking.

As for the kabobs themselves, the meat was juicy, well-seasoned and had a nice char on the exterior. Not the best I’ve had, but a delightful carnivorous treat worthy of its ancestry.

While not all primal urges should be followed, occasionally getting in touch with one’s caveman roots is a meating worth pursuing. —John Dyke

A collection of photographs captures the faded glory of neglected classics

Photographer Josh Marcotte has cropped the right side of the car out of the frame. His talent for composition and his muted palettes are the painterly details that grab your attention in his solo show, Cul-

de-Sac Cruisers (a Phantom Galleries exhibit at the Pierce Apartments).

Marcotte is a fourth generation San Jose native and the last member of his family who still lives in Silicon Valley.

On his website lostsanjose.com, he declares the modus operandi of the artist behind the lens: “Lost San Jose is a collective series of ongoing photo projects documenting my day to day life in the neighborhoods where I live and work, as well as the overlooked and shifting landscapes of Silicon Valley.” Those qualities, of things and places being overlooked, permeate the images in Cul-de-Sac Cruisers.

But he and curator Vivian Giourousis narrowed the focus of the show after she told him that it was going to be located at 2 Pierce Ave. in San Jose. In a phone interview,

Marcotte says that he remembers the old Firestone building that once occupied the space now taken up by the luxury apartment complex.

“In my head, I was picturing images of automobiles and the environment that they create,” he says, “just due to the fact that that was one of the big buildings that had been torn down to create the new space there.”

His photographs of vintage cars, in various states of decay, came out of his Lost San Jose project. As curated for this exhibit, they're also temporarily reclaiming the pavedover space on Pierce Avenue that was once an automotive hub.

“I've always been drawn to the automobile, to cars in general,” Marcotte explains. “Walking through any neighborhood, anywhere in California, you're going to find automobiles that people have held onto for various reasons. We have a very strong car and commuter culture here.” On his excursions around the city, he looked for cars that reminded him of “the landscapes that made up my time here in Silicon Valley and what my life is like.” Sometimes the owners talk to him about the car’s history. But even when his audience doesn’t know that history,

the photographs are evocative enough to tell stories sans commentaire.

A bowling ball-size dent sits in the middle of a sea blue Plymouth Valiant’s trunk in “Smaller and Smaller. Portland, OR (2015).” Marcotte frames the car in an empty parking lot, below three painted lines—red, yellow, black—on a white brick wall. The date in the picture’s title is the only clue that suggests he didn’t travel back in time to the 1960s to take it. He approaches his subjects—or, more accurately, objects— the way that Robert Bechtle did when he photographed his grasshopper green and wood-paneled Alameda Gran Torino in 1974. Both images reveal something about the owners despite their absence from the frame.

The pristine Gran Torino rests in the driveway of a clean suburban home. This is a well-cared-for family car. The Valiant, and Marcotte’s other cars, like the rusted one from In Bloom, answer the question Bechtle’s work suggests: “What will become of this vehicle in time?” It won’t remain immaculate. Instead, it will age and succumb to weather or neglect.

Marcotte cites a Raymond Carver poem, “The Car,” which accounts for our attachment to automobiles even when they no longer gleam.

“There was this wonderful Raymond Carver poem that I liked, talking about the relationship that he had with his car,” Marcotte says. “He had this negative relationship with this car, but it was also something that he could rely on, even in that negative relationship.”

Carver lists 50 things that have gone wrong with his car before he ends the poem, “The car with payments that couldn’t be met. / The repossessed car. / The car whose clutch-pin broke. / The car waiting on the back lot. / Car of my dreams. / My car.”

He and Marcotte both convey that American ideal of ownership and what that implies—a burden, often mechanical and always financial, but one that can also set you free, barring Bay Area traffic, to explore the open road.

CROWDED FIELD ‘Who Am We?’ by Do Ho Suh features myriad faces on seven sets of four-color offset wallpaper.

Piling On IF YOU WEREN’T careful, you could walk right into Do Ho Suh’s multicolored acrylic chandelier Cause and Effect (2007). It’s the first piece you see in the Korean artist’s exhibit The Spaces in Between. Suspended from the ceiling, the sculpture hangs low enough for visitors to examine the translucent details at eye level. Up close, you can distinguish hundreds of doll-size men linked together by their arms and legs, one man straddling the back of the man below him so that a chain of bodies forms all the way to the top of the gallery.

Suh has manufactured each one in a delicate palette that conjures up a spring garden made of glass. There are rose-colored men on top of lilac ones.

Others are the color of bluebells, buttercups or the scintillating green of a dragonfly’s back. The artist appears to have settled on three different kinetic poses: standing, striding and kneeling. Arms fold around chests and ankles, each pair of hands enfolding the body above and below. It’s hard to imagine the room it would decorate—a surrealist’s palace, perhaps—with its strange arrangement of human Do Ho Suh: The Spaces forms, a rainbow made of limbs, heads and torsos. in Between Screen (2005) stands behind it and corresponds with the massive chandelier. It, too, is made of Thru Feb 25, Free colorful doll-like people, but there are men and Cantor Arts Center, women both, and they’re clothed. You can even Stanford make out a tiny pattern etched into some of the museum.stanford.edu posterior pants pockets. Instead of linking them, Suh’s lined them up in jumping jack poses, their hands held high above their heads. He stacks them lengthwise in rows forming a pattern, a net of X’s and O’s. There is a variety of faces, but their expressions all share a pitilessness. These stocky bodies of an unnamed nation are united and ready to triumph for some common cause. They could be ready to start a war or about to protest one.

Both of these installations are so eye-catching, impressive in color and scale, that visitors might fail to notice Who Am We? (2000). From a distance, the beige screens suggest they're merely decor to offset the chandelier’s brilliance. But as you move in close enough to worry your nose, the panels are filled with hundreds of faces like miniature cameos or the opened windows of an Advent calendar. These are portraits of Do Ho Suh’s high school classmates. He can’t have had thousands and thousands of fellow students, but he’s printed them out in multitudes to foster that illusion. He either assembled them en masse because he cherishes his adolescent memories, or he’s re-created the nightmare of still being taunted by their million smiling faces. —Jeffrey Edalatpour

DEATH TRIP ‘The Wages Of Fear’ chronicles truck drivers transporting nitroglycerin over bumpy mountain roads.

Dead Men Tell Tales DEATH THROUGH SPURNED love, death through the livelong-day at work. Such is the great double bill The Wages of Fear (1955) and Les Diaboliques (1955), a brace of brilliant thrillers by France’s H.G. Clouzot. As in all efficient death traps, the action is easy to describe.

The Wages of Fear, a masterpiece of cruel suspense, involves some stranded Europeans (Yves Montand, Charles Vanel and Folco Lulli) stuck in an oil patch company town in South America.

The men want to go home but lack the plane fare. Then an opportunity—of sorts—turns up. An oil well is on fire, and the oil company needs some expendable drivers to make the 300-mile journey to the oil fields with the explosives to blow it out. Unfortunately, no one remembered to tend the nitroglycerine, which is rotting and oozing in a shed in the tropical heat. One sudden bump and the stuff explodes.

Over swamps, crumbling bridges and cliffside roads, the drivers haul their nightmare cargo to their destination. This business was fresh enough to be filched for Solo: A Star Wars Story, but the essential pessimism of this tale is even fresher.

Wages of Fear/Les Clouzot’s follow-up to his hit Les Diaboliques is Diaboliques straight-up terrifying melodrama. At a horrid French boarding school, a headmaster is carrying on with Jun 6-7 both wife (Vera Clouzot, the director’s wife, dead Stanford Theatre before 45 from a bad heart) and his fleshy mistress (Simone Signoret). Together the diabolical women hatch a plan to get the man out of their life. Even after being sunk in the school’s repulsively mossy swimming pool, he refuses to stay dead.

Both films have been remade—William Friedkin’s harrowing Sorcerer (1977), his version of Wages, is his best film. There was more to Clouzot, not well-known enough here; the nigh-psychedelic unfinished film about mind-melting jealousy, preserved in the documentary H.G. Clouzot’s Inferno; the classic 1940s crime drama Quai des Orfevres, and Le Corbeau, all about the trolls of yesterday, writing denunciatory anonymous letters to the occupying Nazis.

Clouzot’s expert winching of nerves influenced Hitchcock himself—the famous joke Hitch made was that he’d heard from an anxious parent whose daughter didn’t feel safe in the bathroom after the bathtub scene in Diaboliques, and then the subsequent shower scene in Psycho. Hitchcock drawled, “I told him to send her out to be dry-cleaned.”

In ‘First Reformed,’ Paul Schrader takes viewers to the Garden of Gethsemane

HE IMPASSIONED qualities Paul Schrader brings to First Reformed are exactly what one hopes for in a religion—it’s compelling even when you don’t believe it. No one gets a MacArthur Grant for figuring the film’s roots: Ingmar Bergman’s Winter Light (1962), Robert Bresson’s Diary of a Country Priest (1951) and, to a lesser extent, Bresson’s 1977’s The Devil, Probably.

Bergman noted that one of his wives had described Winter Light as “a dreary masterpiece.” Though

this harmoniously composed First Reformed may not be a masterpiece, it’s definitely not dreary. The anger in it—the American quality, that refuses to swallow wrath instead of expressing it as violence—gives it a simmer.

Ernst Toller (Ethan Hawke) is a solitary pastor, a devotee of Kierkegaard and Thomas Merton in a working class upstate New York wowed by charismatic churches.

Toller leads the white-painted and steepled 250-year-old First Reformed church in Albany. It’s a bone thrown at him by Jeffers, the well-fed pastor of the Abundant Life megachurch (Cedric Kyles aka Cedric the Entertainer). Plans are underway

with an anniversary reconsecration, but the place is attended by few, except for bored tourists exiting through the gift shop.

Toller’s pregnant parishioner Mary (Amanda Seyfried) approaches the pastor about her troubled husband Michael (Philip Ettinger), tormented about bringing a baby into a world doomed by climate change. Mary finds evidence that Michael plans a terrorist act. His likely target: a billionaire climate-change denier (Michael Gaston) modeled on one of the Koch brothers, who is a major donor to Abundant Life and First Reformed.

Torn by his own uncertainty, and convinced by Michael’s ecological activism, Toller wonders if he should make a martyr of himself.

Seyfried is the sun in this wintery movie, warming it up; her long blonde hair falls like a curtain in front of the camera in her close up during a trust-game with the pastor. Similarly, Cedric Kyles gives the movie a foot in the material world. Jeffers snaps impatiently at Toller, “You’re always in the Garden” (of Gethsemane).

leather chair, dealing with this prickly colleague who believes Christianity is all Good Friday and no Easter, who fails to realize that shepherding men requires a compromise here and there.

Hawke is very convincing as this wifeless, childless divine whose devotion to duty has almost destroyed him.

Toller is a hard drinker in solitude—he mirrors Bresson’s disliked country priest, eating himself alive not just with doubt, but with stomach cancer.

If Toller is the type of Protestant scold who advertises his next sermon as “Will God Forgive Us?” he shows compassion when a class of visiting kids tour the holiest place in the church. It’s the trap door concealed under a pew, a leftover from when First Reformed was a stop on the Underground Railroad. Toller’s anxiety to make the kids understand is very touching.

The bleakness is nothing but honest in Alexander Tynan’s photography, with its pristine Academy ratio, its visions of cold humble streets, bare lightbulbs and silent rooms. But another word for austere is “bald faced.” Every now and again, one glimpses Hawke measuring the effect of his own acting. And sometimes Schrader seems to turn Toller into his most famous character: Travis Bickle in Taxi Driver. Toller is part of a career long-obsession with fanatics, and Schrader’s continuing question of how deeply into the woods one can follow a madman.

It’s an admirable comeback, an immersive portrait of obsession.

Schrader was raised in his own tradition of devotion. He minored in theology at Calvin College, and for religious reasons never saw a movie until he was 17. He went from film critic to screenwriter to director.

With his reverence and solitary note-taking, Toller resembles a movie fanatic. A variation of the theme in First Reformed could have been the contrast between an under-attended, old-time jewel box theater and a crass multiplex. Theaters turn to churches; both often turn into museums; and too often, as Milton wrote, the hungry sheep look up and are not fed.

HE ORIGINAL LINEUP of pop sensation The Monkees lasted for a brief period: The quartet that scored No. 1 hits with “Last Train to Clarksville,” “I’m a Believer” and “Daydream Believer” was together from fall 1965 to very early 1969.

In the nearly 50 years since then, group members Micky Dolenz, the late Davy Jones, Michael Nesmith and Peter Tork have reunited in combinations of two, three and (occasionally) four. But there has been one constant among all of those

reunion projects, live shows and recordings: Dolenz.

All four Monkees sang, and Dolenz played the part of The Monkees’ drummer onscreen (and occasionally on recordings and in concert). While he had some professional musical experience prior to being cast on the weekly television comedy, Dolenz’s primary occupation had been as an actor, starring in the late 1950s series Circus Boy. So, while some of The Monkees (Nesmith and Tork in particular) had trouble reconciling their musical careers with their onscreen roles, Dolenz never seemed to experience much internal turmoil.

“What would I regret?” he asks rhetorically. “It was really successful.”

It’s safe to say Dolenz is a fan of his group. “I’m very, very proud of the work I did—the singing, the acting and the playing—everything,” he says. But The Monkees came in for some critical bashing in the 1960s, with naysayers pointing out that the group was assembled by outsiders (as was Moby Grape) and didn't play on all of its records (a charge that's equally true of The Byrds, The Mamas and the Papas and The Beach Boys). Still, time has been kind to The Monkees, and while the group has seemingly been locked out of consideration for induction to the Rock & Roll Hall of Fame, the Monkees’ singles and many albums have undergone a reassessment. Some are now viewed as pop classics of their era.

“The Monkees was not a band,” Dolenz emphasizes. “It was a TV show about an imaginary band.

The television show took place on this set, which was a beach house in Malibu.” With a chuckle, Dolenz

points out that the premise “does raise the question how we could afford a place in Malibu and we’d never done any work.” He likens The Monkees to a Marx Brothers musical, such as 1931’s Monkey Business.

But he emphasizes that from the beginning the foursome worked hard to improve their musical skills. “‘Johnny B. Goode’ by Chuck Berry was my audition piece for The Monkees,” Dolenz says. “That’s the song that got me the gig.” In addition to playing all of the drum parts on the group’s hit 1967 LP, Headquarters, Dolenz sang lead on seven A-sides of the dozen Monkees singles released during the group’s original run.

Davy Jones died in 2012, and these days Tork remains busy with his own group, Shoe Suede Blues. But for a select string of dates—less than 20—Dolenz and Mike Nesmith have joined forces once again, this time for a tour billed as The Monkees Present: The Mike & Micky Show.

It’s the first time the two have appeared as a duo, and it represents an opportunity to dig a bit deeper into The Monkees’ catalog. “We do ‘Porpoise Song,’” Dolenz says, referring to a relatively obscure fan favorite written by Carole King and Gerry Goffin for the Monkees’ 1968 psychedelic movie, Head.

“And it’s gonna be great having [Nesmith] singing a lot of his original stuff,” says Dolenz. Of all the former Monkees, Nesmith has been the most reluctant to record or tour with his former comrades.

But by all accounts, both men are looking forward to the tour. “We’re just ready to launch out and do this,” Dolenz says.

Asked what he believes lies at the heart of The Monkees’ enduring appeal, Dolenz says that the group “caught lightning in a bottle. I look at it in a kind of scientific sense: The whole becomes greater than the sum of its parts.

“It’s like the story about taking the watch apart to see how it works,” says Dolenz. “And of course, then it doesn’t.”

SMOKY VOCALS The fire still burns for The Animals frontman Eric Burdon.

Rock & Roll Animal MANY OF THE bands considered part of the “British Invasion” of the mid-’60s drew from American soul and R&B. Some, like the Beatles, filtered those influences through their own musical sensibilities, creating something completely new in the process. Others—The Rolling Stones, for example—built upon an R&B foundation, getting their start playing their own arrangements of others’ material. Initially, however, The Animals were the most faithfully blues-based of all British acts to score on the American charts.

Formed in 1962 in Newcastle upon Tyne, The Animals lit up the American hit singles chart 19 times between 1964 and ’68, including the No. 1 smash, “The House of the Rising Sun.” Eric Burdon & Along with the stirring, soulful organ of Alan Price, a key to the group’s appeal was Eric The Animals Burdon’s deeply expressive, sonorous and gravelly voice. Hits like “It’s My Life,” “Don't Let Me Be Misunderstood” and “We Gotta Get out of this Place” would go on to earn classic status.

They developed a more psychedelic sound, one exemplified by songs such as “San Saratoga Franciscan Nights” and “Sky Pilot.” The band members went their separate ways by 1969, with mountainwinery.org Burdon going on to a solo career.

In 1970, Eric Burdon took part in a brief but very successful collaboration with Long Beach funk band War, scoring the hit single, “Spill the Wine.” In 1994, The Animals were inducted into the Rock & Roll Hall of Fame, and in 2008, Rolling Stone ranked Burdon 57th on its list of “100 Greatest Singers.” Today, Burdon leads his own group using The Animals name.

In 2017, Burdon recorded his own version of the 1966 Buffalo Springfield classic “For What it's Worth.” The recording—posted on Burdon's website ericburdon.com—shows that the years have done little to diminish his vocal presence.

Burdon’s adventures have become the stuff of legend: John Lennon’s lyric “I am the eggman” in the Beatles song “I am the Walrus” is a veiled reference to Burdon's sexual exploits. In May 2018, he made the news once again: Poet and songwriter Patti Smith personally delivered a cake to Burdon onstage in celebration of his 77th birthday, accidentally setting her hair on fire in the process. The Animals vocalist quickly extinguished the flames with his bare hands, but the fire in his voice still burns brightly. —Bill Kopp

Dogs have proved useful for sniffing out drug stashes, dead bodies and IEDs. How great would it be if you could dispatch your German shepherd Tinker Bell into a bar or party to sniff out the human minefields? “Naw…skip this dude. Serious intimacy issues.”

People will swear that their dog is a great judge of character—focusing on the, oh, two times he growled at someone they despise but conveniently forgetting all the times he snuggled up to their sociopathic ex. The reality is, research does not support dogs (or even chimps) having what they’d need to assess a person’s character—a sophisticated cognitive ability humans have called “theory of mind.”

Theory of mind describes being able to guess the mental states of others—to infer what they’re thinking or intending. For example, when you see a man across the street get down on one knee in front of a woman, theory of mind leads you to figure he’s about to ask her something—and it probably isn’t, “Could I borrow a pen?”

That said, the ballsy little purse Cujo that growls at some Mr. Skeevy probably isn’t doing it out of the blue.

Dogs do seem able to read even subtle aspects of human body language—like our tensing up upon approaching somebody we dread talking to—and they may respond in kind.

However, dogs’ perception of people and the world is dominated by their exceptionally powerful sense of smell— estimated to be between 10,000 and

100,000 times more powerful than ours, according to anthrozoologist and “Dog Sense” author John W.S. Bradshaw.

In other words, though dogs can’t read a person’s mind, they may be able to smell what’s on it—or rather, the chemical messengers released by what’s on it. For example, doggy cognition researcher Alexandra Horowitz explains in “Inside of a Dog“ that adrenaline (triggered when a person’s afraid or angry) “is unscented to us, but not to the sensitive sniffer of the dog.”

Additionally, Bradshaw points out that the types of people dogs are socialized with—women, men, men with beards, people wearing different kinds of clothes—make a difference in whom dogs snuggle up to and whom they snarl at.

So, no, your dog is not a leg-humping background-checker. But she can help you see something important about men—if you look at how a potential boyfriend treats her: with patience or annoyance. And as I often advise, it’s also important to put some time (and a lot of observation) between thinking a guy is really awesome and seeing whether he actually is. It’s tempting to believe you’ve found everlasting love, just as it’s tempting to believe that your dog is some sort of crystal ball for reading character—and not responding to how some guy just kneaded all the stuff together for homemade liverwurst and then wiped his hands on his pants.

Beyond your boyfriend not being tuned in to the genetics, there’s a littleknown feature of our immune system— basically the psychological version of that plexiglass partition in liquor stores in bad

neighborhoods—that may be causing him to worry about your sleepathons. In addition to warrior cells being sent out by our immune system to attack bodily invaders, such as viruses, psychologist Mark Schaller’s research suggests we have a psychological warning system—the “behavioral immune system”—to help us avoid being exposed to disease in the first place.

story popped up in the New York Times recently about a San Francisco company that has developed an algorithm to assist local district attorneys in their efforts to expunge cannabis convictions as part of the Proposition 64 cannabis-legalization reform.

Code for America, a national nonprofit with a chapter in the South Bay, is now working with San Francisco District Attorney George Gascón as his office sifts through thousands of felony and misdemeanor pot convictions with an eye toward clearing residents’ criminal records when they can. Under Proposition 64, people convicted on pot charges can apply to have their cases expunged.

On May 15, the district attorney and Code for America announced they’d help to ease they way for applicants, as they announced a “cuttingedge partnership to use technology to clear eligible convictions.”

“California has decriminalized recreational cannabis use,” Gascón says in a statement, “but a marijuana conviction continues to serve as a barrier to employment, housing, student loans and more. … Until we clear these records, it’s government that is effectively holding these people back and impeding public safety. I’m hopeful that this partnership will inspire many prosecutors who have cited resource constraints to join this common-sense effort and provide this relief.”

Gascón’s move did eventually inspire Santa Clara County District Attorney Jeff Rosen to reverse course on his initial opposition to the proactive expungement process initiated by his big-city peer.

And in the North Bay, all three candidates running to replace outgoing Marin County District Attorney Edward Berberian this year support the proactive expungement move undertaken by Gascón and have pledged to undertake a similar process.

Now they’ve got a method to ease the way, thanks to Code for America, whose various corporate funders include Google, the Knight Foundation, and the Silicon Valley Community Foundation. Elizabeth Smith, head of marketing at Code for America, says that the hope is to “get it to the point where we are working with enough counties this year that we could clear up to 250,000 convictions.”

So how does the algorithm work? Code for America has agreed to let the nonprofit “pilot a product that allows a government agency … to determine eligibility for record clearance under state law, automatically fill out the required forms and generate a completed motion in PDF format. SFDA will then proceed to file the completed motion with the court. The process will be applied to all 4,940 felony marijuana convictions dating back to 1975.”—Tom Gogola
