They prowl not for female attention, but dimwits with cash. In a popular bar, pool sharks stand out when you’re sober. They come for business at a place where others seek pleasure. Young Turks Milpitas has a rep for Wild West politics, where political adversaries routinely dog each other at the dais and occasionally away from it (a few San Jose strays have also found their way into the mix).

But after Election Day the city has a rare opportunity to move into a new era without some of its entrenched establishment. The departure of longtime Mayor JOSE ESTEVES and election of RICH TRAN, a county social worker who bested former Councilwomen DEBBIE INDIHAR GIORDANO and CARMEN MONTANO, is expected to provide an injection of young blood, and that’s no cliché. Tran, an Air Force veteran and medical social worker for the county, claims on Twitter to be the youngest mayor in the entire Bay Area. Joining him on the council is incoming Councilman ANTHONY PHAN, who at 23 is believed to be They the youngest elected Did official in all of Santa What?

Of course, none of this addresses the volatile environment that frequently crops up with TOM WILLIAMS, Milpitas’ city manager, still stalking the city hallways.

Sheriff’s Office shows compassion in new approach to evictions

EPUTY ROBERT AVILES, armed with a clipboard and brightly colored paperwork, approaches the porch where a welcome mat bears the black-lettered inscription, “Don’t even think about it.” His partner, Kevlar-clad Deputy Paul Woehl, hangs back several feet as Aviles raps on the white door to deliver the bad news.

“Sheriff ’s Office,” he announces.

A disheveled middle-aged woman answers and, after a brief exchange, beckons the officers inside. They follow

her to the musty hallway, where another tenant appears from the back. The floors are strewn with clutter—hypodermic needles, heaps of junk mail, rumpled-up blankets. Translucent orange pill bottles sit atop end tables and an old player piano. Christian art adorns the walls.

“As of right now, as you know, the eviction is scheduled for the 25th,” Aviles breaks it to them. “That’s probably going to be the for-sure day. So make sure you stay in touch with your social workers. Has anyone moved out?”

Another tenant chimes in, telling deputies that they expect to move into a new place called “the purple house.”

Aviles nods and takes notes. “How about if we don’t have a place to go?” she wonders. “Where will we go?”

“That’s what we’re working on,” Aviles reassures her. “I don’t know all the alternatives, so I have some people looking into that.”

Aviles says he bought as much time as he could for the women left in the singlestory flophouse, which the landlord subdivided to accommodate several mentally ill tenants. Serving the eviction as scheduled a month prior would almost certainly have left the some of the home’s occupants on the streets.

“Last time we were here, a few didn’t even know that the landlord wanted them out,” Aviles tells me as we walk away from the tan stucco home on a quiet street on San Jose’s East Side.

“If we went through with business as usual that day, the landlord would have been there with the locksmith, forced them out and that would be it” Not anymore. Not if he can help it.

Seven years serving eviction notices for the Santa Clara County Sheriff’s Office haven’t made it any easier for Aviles to tell someone they have to leave.

Especially for the single parents, the children, the mentally ill and countless others who could have been helped at some earlier point in the series of events that pushed them to the brink.

Knowing that too many evictions could

suffered from paranoia, apparently forgot to renew an authorization to receive her daughter’s public assistance stipend. That, presumably, is how she fell behind on rent.

“There were so many chances along the way to prevent this,” says Aviles, who went through crisis intervention training in 2010, which opened his eyes to the plight of the mentally ill.

With Sheriff Smith’s blessing, Aviles went around meeting with various nonprofits, social service agencies and county officials to create a network that formed the basis of his displacement mitigation team. He enlisted social workers and attorneys.

He put together a checklist with instructions for deputies to identify people who need the extra help.

“At the county, we really want to support that kind of effort,” says Steve Preminger, a special assistant to County Executive Jeff Smith. “We need to protect people’s dignity, to make sure that they don’t decay.”

Middleton compared the approach to the way police agencies respond to human trafficking cases, where social workers and advocates agree to ride along with officers. In a broader sense, the strategy reflects the changing nature of law enforcement. Decades of dismantling public psychiatric hospitals and other institutions that once cared for people in need has turned modern police officers into one of the few tax-funded agents of public wellness. It’s a reality that all too often plays into disaster.

More than half the people who die at the hands of police had some kind of disability, according to a 2016 report by the Ruderman Family Foundation. The study found that people with psychiatric disabilities are presumed dangerous in police interactions. “Police have become the default responders to mental health calls,” the report states.

Of the 15,400 evictions processed in this county since 2006, only about 5 percent involve the kind of cases the mitigation team is designed to help.

Aviles expects to deploy the aboveand-beyond interventions about twice a week. Since launching the team this past fall, he says he’s helped six people avoid traumatic displacement.

“There’s a whole universe of problems related to the housing crisis,” he says. “But here’s a specific chance, a way to target our efforts to prevent homelessness before it starts.”

have been prevented or at least alleviated inspired him to create what he calls the Displacement Mitigation Team.

“This is a way to catch people who are not able to advocate for themselves,” he says.

Aviles began to assemble the task force earlier this year and formally deployed it for the first time in September. The idea stems from a counterpart in San Francisco, where deputies enforcing evictions link vulnerable tenants to social services instead of casting them out on the streets. He pitched the idea to his boss at the time, Lt. William Middleton, and Sheriff Laurie Smith, who told him to run with it.

“The concept is simple,” says Middleton, who recently stepped down from leading the civil services unit. “But it really does go above and beyond.”

Under state law, only sheriff’s agencies can enforce civil procedures. That includes evictions, which begin in court as lawsuits called unlawful detainers. A judge weighs the evidence to determine whether a tenant has violated a contract with the landlord. If so, they issue a writ that a sheriff’s deputy is mandated to post within three days and enforce less than a week later.

“By the time we get there, the case has been adjudicated,” Aviles says. “What we have is a five-day window between the time we post it and the time we evict.

We usually give them six days.”

That leeway between notice and enforcement could alter the course of a person’s life, he says. That’s when the displacement team gets to work.

By taking advantage of that narrow timeframe, Aviles hopes to prevent situations like so many he encountered in the past. He recalls an assignment in 2010 when he had to evict a mentally ill woman who was the sole caretaker of her brain-damaged daughter.

Evicting them would have rendered the women homeless.

“We told the landlord we just couldn’t’ do it,” he says. “No way we’re putting them on the street.”

Instead, he called the Adult Protective Services, which informed him that it would take weeks to relocate the two women. While scrambling for a way to avoid eviction, he tried to piece together some of their story. It took an hour of coaxing before the mother would admit that it was her name on the paperwork, let alone open up to Aviles. By prying her for information, he found out that the mother, who

San Jose Drops Excessive Fee on Urban Agriculture

BY CHUCK CARROLL Urban agriculture advocates survived a scare and scored an important victory Tuesday, when the San Jose City Council backed off a proposed $1,540 fee that could have left green dreams dying on the vine.

Last month, community groups were elated to learn the council would grant owners of blighted vacant lots a significant property tax break for converting parcels into small-scale farms for five years. But then the city decided to charge owners a $1,540 fee to apply for the tax break.

Jamie Chen, an organizing manager of Sacred Heart Community Service’s La Mesa Verde program, which promotes organic gardening in low-income areas, has worked for two years to push through the policy. She said she was “flabbergasted at how they came to such a high fee.” On Tuesday, Chen and more than a dozen other speakers begged the council to reduce or drop

the fee altogether. They pointed to San Francisco and Sacramento as places that don’t charge any fees.

“It was a big surprise,” Chen said of the council’s decision to drop the fee. “We didn’t think that they would change.”

Council members were taken aback when speakers accused them of caring more about the city’s minimal costs than helping communities struggling to grow fresh food. Mayor Sam Liccardo and downtown Councilman Raul Peralez, who had worked with Chen on the Urban Agriculture Incentive Zone measure, initially were poised to support the $1,540 fee but quickly changed course. Rather than charge applicants for 10 hours of staff work, the council decided to lower the fee to $308 for two hours of staff time. The city will monitor how much staff time is actually required and, if necessary, bill the applicants for any additional time.

Peralez and Vice Mayor Rose Herrera then went a step further and agreed to pay the initial fees for the first set of applicants out of their own office’s discretionary funds. Peralez has far more eligible vacant lots in his downtown district than other council members.

Under the new program, property owners of an acre or smaller must turn their vacant lots over to nonprofits for five years of farming.

In return, their parcel will be assessed at a reduced rate of $12,700.

Raul Lozano, executive director of Valley Verde, a nonprofit that helps ethnic communities learn to grow their favorite organic crops, said the council’s decision to lower the application fee is a huge victory. The organization intends to build a greenhouse for seedlings.

The group’s West San Carlos Street site will also be used for raised beds and equipment storage.

In a ranking of the most sinful cities in America, it’s no shocker that Sin City tops the list. But where does San Jose fall on a slate of 150 locales? Dead last. Fremont, the sleepy suburban neighbor to the north, ranks next to last. That’s according to an “evil deeds” index released this month by WalletHub. The financial advice site analyzed the most populous U.S. cities based on 27 “key indicators of evil deeds.” The deeds fall under seven categories: anger and hatred, jealousy, vices and excesses, avarice, lust, vanity and laziness. Indicators of said deeds include heavy boozing, infidelity, violent crime, theft, obesity, drug overdoses, plastic surgeries and theft. On WalletHub’s list of hardestworking cities, however, San Jose came in 54th out of 150. Maybe Silicon Valley’s staggering cost of living has something to do with the ranking. San Jose’s too busy working for rent and high-priced homes to afford any vices.

SJSU Investigates 6 Sexual Batteries Investigations into six sexual batteries reported at San Jose State since October led to one arrest last week. The suspect, 19-yearold Huaien “David” Kong, is a student and may have committed multiple assaults, according to SJSU President Mary Papazian.

Campus police believe that Kong may be responsible for at least two incidents, including one of three reported to police last week.

Another case took place in the middle of the day Dec. 7.

OOTBALL IS A game of inches, and right now the San Francisco 49ers are losing by miles. Were it not for the winless Cleveland Browns, the five-time Super Bowl-winning 49ers would have a onewin stranglehold on last place in the NFL. The swift success of the Jim Harbaugh years has been undermined at every turn, much like President Barack Obama’s accomplishments will soon be dismantled under his successor.

The most memorable moment of last season’s brief Jim Tomsula era—a coach plumbed from internal ranks and given the unenviable task of replacing Harbaugh—was either a quadruple-take grimace captured via .gif or a phantom press conference fart. In both instances, and so many others, Tomsula seemed deeply vexed.

This year, thanks to general manager

Trent Baalke, the team’s new coach, Chip Kelly, inherited a cupboard so bare of talent that Kelly didn't even have the option of running the black superstars out of town like he did in Philly. Quarterback Colin Kaepernick’s best play this season was taking a knee just a few feet off the field, and yet the NFL’s most outspoken advocate for civil rights scoffed at the idea of voting

last month—as if the game of inches has taught him nothing about hardfought, incremental victories on the road to justice.

Rumors are swirling that the team’s CEO, Jed York, who was gifted control of the franchise in 2008 by his mother and father, Denise and John York, could be stripped of all authority on football decisions,

which would come as sweet relief to fans who have shelled out thousands on tickets and personal seat licenses.

For the last two seasons an unknown party has paid for a plane to fly over Levi’s Stadium during home games with trailing messages that read: “Hold Jed accountable.”

Or: “Jed & 49ers Should Mutually Part Ways.”

Multiple heads could be on the chopping block this off-season in Santa Clara, but one body in particular could meet its demise before the season’s last whistle—and in no way is the decision dependent on wins and losses, but rather dollars and cents.

On Nov. 23, the city of Santa Clara’s mayor and council, which make up the Stadium Authority board, sent a notice accusing 49ers brass of “potential breaches” of the management agreement for Levi’s Stadium. The letter suggested that

the team’s management company has been less than transparent in how the billion-dollar sports complex reports its numbers. The 49ers were given 30 days to deliver reports and information on 15 issues to City Hall or risk losing control of Levi’s Stadium—outside of the 10 home football games each year.

Such an action would strip the 49ers of millions in revenue, from overseeing Beyoncé concerts and monster truck rallies to hosting events like WrestleMania or the 2019 College Football National Championship game.

Stadium execs fired back, noting

the city had actually not cited any actual breaches and called the question by demanding an estoppel—a statement confirming that the management agreement is in full force and effect. The slick legal maneuver invokes a contract clause that’s traditionally used to satisfy lenders, and the public authority now has until Wednesday, Dec. 21 to comply.

It’s an unprecedented chestbumping match between a major sports franchise and its landlord, and the 49ers have until Thursday, Dec. 22, to produce the requested records or risk losing control of the

Then again, this is Santa Clara—a coming-of-age city often at war with itself, run by part-time politicians and a more than a few full-time imbeciles. The insults added to injuries will likely be substantial.

is anything but refreshing or reassuring.

“So, there’s not going to be a straight answer to a lot of these questions,” he says.

Batra is talking about the city’s dealings with Forty Niners Stadium Management Company (ManCo), the entity the 49ers conceived to handle all non-NFL events at Levi’s Stadium. The team and its two subsidiaries—the other one, StadCo, handles NFL events—lease and operate the 3-year-old stadium, which was approved for construction after Santa Clara voters passed the $937 million Measure J bond in 2010. Since that time, the city has hosted Super Bowl 50, international soccer matches for Copa America, and major acts like Taylor Swift and the Grateful Dead. Under the terms of the agreement, the 49ers pay the city of Santa Clara for police and fire department services for NFL games and split revenue for all non-NFL events equally after expenses are paid. To date, the city has received more than $5.5 million from nonNiner activities at Levi’s.

At issue is whether the 49ers and ManCo have cooked the books and whether the city is entitled to more money.

Santa Clara Mayor Lisa Gillmor has accused the team of refusing to provide itemized expenditures and revenues, while also shifting costs from Niner gamers—such as replacing chewed-up turf—to events that cover the grass when stages are placed for touring acts. The 49ers have dismissed these suggestions and countered that the mayor and some of her colleagues on the council—namely Debi Davis, Teresa O’Neill and Kathy Watanabe—are engaging in political grandstanding and damaging the team and the stadium’s reputation.

Since the sudden and mysterious February resignation of Santa Clara’s former Mayor Jamie Matthews—just a day after the Super Bowl and less than a week after a Metro report detailed widespread dysfunction within City Hall—Gillmor has been on a warpath, often painting the Red & Gold as raiders in the night.

There is a strong suspicion the 49ers funded the dark money organization BluePAC in the recent election, in a

failed attempt to dismantle Gillmor’s council majority.

Batra’s city manager predecessor, Julio Fuentes, was forced out this spring due to his cozy relationship with the team and after a racial discrimination complaint he filed was investigated and dismissed.

A 15-year city employee, Batra has been more cautious than the mayor in calling out the Niners.

He says the city’s finance director,

I’m happy for them, I think it’s fabulous, but they want all the benefits without all the responsibilities of dealing with a public agency’ Gary Ameling, who along with City Attorney Ren Nosky was not made available for an interview for this story despite repeated requests, has had opportunities to review some of ManCo’s financial records.

However, these reports have never been provided in full to City Hall’s doorstep on 1500 Warburton Ave. On Nov. 18, the 49ers hosted Santa Clara’s city manager, city attorney and director of finance— the “three amigos” in the mayor’s words—in an executive floor suite at Levi’s Stadium to look over nonNFL revenues and expenses and provide reassurances. It’s unclear

15 but our staff has. We are fighting on new ground here.”

The stakes of the fight are enormous, as both the city and 49ers have invested considerable resources into building and running the stadium. If the city were to revoke management of non-NFL events, it would be on the hook for operating a 68,500-person venue, an undertaking far outside the scope of services provided by the city’s 927 full- and part-time workforce. (By comparison, Levi’s employs more than 3,000 workers on an average gameday.)

It’s unclear if the 100-plus fulltime ManCo staffers would keep their jobs under a new management company hired by the city. Most of these employees crowded into the council chamber last month for a Stadium Authority meeting, expressing their concerns and slamming the mayor’s criticisms.

“All of that is hogwash,” Gillmor says. “We would hire another management company and we would keep their employees.

Absolutely. When they brought all of their employees saying I would take food out of their babies’ mouths, that was pretty low. It's about [the 49ers] not living up to their end of the contract. That’s what it’s about.”

The city manager seems less sure the 49ers have violated the terms of the agreement, as well as whether Santa Clara is up to the task of taking over Levi’s Stadium “I can't even venture to answer that,” Batra says. “We are hoping to not even get there.”

Team Jersey Al Guido looks the part of a NFL team president. He’s trim and handsome but not particularly tall.

His suit is crisp and he sports his initials, “ACG,” on the left cuff of a pressed white shirt. His hairline runs straight and the cut is precisely cropped. He squints and thinks when he smiles and, like many inside the 49ers organization, is touchy about what he reads in the press.

He grew up in Washington Township in southern New Jersey, where he played football. He wanted to enlist in

what exactly was the point of the meeting. Batra says the team presented several binders full of accounting information, but no real analysis was conducted.

“These were just binders sitting there,” he says. “It's not like I viewed them.”

The city’s independent auditing firm, Harvey Rose, which is currently conducting a review to see if the city violated the terms of Measure J by using general fund money on stadiumrelated events, also visited the stadium last month to review financial records.

49ers officials say the auditors would have been allowed to leave with itemized revenue and expense reports, but only under the condition that they sign a non-disclosure agreement (NDA) that keeps the information from being publicly disseminated.

Auditors apparently demurred on the terms, and team officials say the bean counters have still not made a counter-offer on terms of the NDA. That same day, Nov. 22, the stadium authority board voted unanimously to send a letter demanding that ManCo comply with all requests for information, or risk defaulting on the stadium management agreement.

Niners officials say the auditors were still inside the stadium when the mayor began leaking word of the 30day notice to local media.

On Dec. 6, 49ers general counsel Hannah Gordon sent a terse point-by-point rebuttal, and the team released an accompanying statement that noted it had already fully complied with all terms of the agreements.

“While the Mayor made a big deal of sending a ‘notice’ to our Management Company,” the statement said, “the so-called ‘notice’ did not identify a single breach of the Agreement—because there are none to identify.”

So who is telling the truth? Even the city manager, who signed the 30-day notice sent to the 49ers— which expires Dec. 22, a day after the estoppel certificate is due— doesn’t seem to know if the team and its subsidiary have complied with the agreement or not.

“In the previous years, our director of finance had gone there and reviewed some numbers,” Batra says.

PRESIDENT Al Guido and the 49ers are fighting back against accusations from the mayor and council of Santa Clara. the Army after high school, according to a report, but ended up getting recruited to play ball at The College of New Jersey, a public liberal arts college that strives to keep the Garden State’s best at home. He majored in business administration and quickly rose up the sales department ranks for a number of professional sports franchises. He takes pride in his work and roots.

In an interview late last year, Guido touted his Jersey bona fides by telling SouthJersey.com that he still summers at “the Shore,” referencing the coastline made famous by a caravan of binge-drinking Dragon Ball Z characters who proudly called themselves “guidos.”

Guido’s path to becoming president of the 49ers was straight if not sudden, as he went from selling minor league baseball tickets to managing sales for the NHL’s Phoenix Coyotes to working with the Dallas Cowboys, right when owner Jerry Jones was building a $1.2 billion monument to himself and America’s team. Guido

parlayed this experience into starting his own consulting firm, which brought him into Jed York’s inner circle and landed him a job in 2014 as the 49ers’ chief operating officer. In a fumbled handoff of power that has been indicative of the team’s recent missteps, Guido assumed the role of president as Paraag Marathe was reassigned to the abstract role of chief strategy officer. This spring, Guido appeared on the same “40 under 40” list Marathe had graced in 2015.

In an interview held last week inside a Levi’s Stadium conference room, flanked by the team’s general counsel, Hannah Gordon, whose comments were off the record, Guido admits that the 49ers could have done better in recent years handling community relations. Most notably, he’s referring to a clash over the replacement of fields for a youth soccer league as starting the war with Gillmor, who previously worked with the team on Measure J. “Look, question us for our record

on the field? Sure, we deserve that,” Guido says. “Question us on our decision for coaching or quarterbacks or management or drafts or free agency, fine. What [Gillmor] is doing is she’s bashing our record on management of the building, and that’s very black and white.

“It's completely not true that they’re not getting the full transparency, and I think if you ask Gary (Ameling), and/ or Rajeev (Batra) or anybody else who came over to meet with us, they’ll tell you they got the full access to information. There will be no dispute.”

Besides, Guido asks, who would manage the stadium if the mayor manages to sever the management relationship? The replacement manager would have to timeshare its control, meaning it would have to employ year-round staff while only capturing part of the revenues.

And this, it seems, is a key part of the problem: Santa Clara is not only at war with the 49ers; the city is also at war with itself.

“Our staff, very candidly, has not followed up or enforced the contracts,” Gillmor says, noting the difficulty in getting information, getting parttime elected officials up to speed and getting city staff to aggressively monitor the inner workings of a multi-billion dollar enterprise. “We’re bringing a little rubber-band gun to a war. And [the 49ers] are taking advantage of that, very much so.”

Councilwoman Debi Davis admits that the council and mayor, which make up the Stadium Authority board, are uneasy about the information they’re receiving, or lack thereof, on all fronts.

“If [the 49ers] have nothing to hide, then why are they making things so difficult?” Davis says. “I would hope that our staff is giving us everything that we need, but I think there is a real trust issue here.

Do I trust the 49ers are giving us everything that we need? I don't.”

In a 90-minute interview, Guido says the team has complied with Santa Clara’s financial information requests on all fronts, but the parsing of language is noteworthy. The team has argued that it is happy to provide all of its non-NFL financial records but simply doesn’t want proprietary information making its way to the public domain. The risk, Guido says, is the team and stadium would lose a competitive edge in bidding contracts that cover everything from concessions and promotions to celebrity entertainer fees. In doing so, both the team, and by extension the city, would lose money, as 49ers CFO Scott Sabatino inartfully expressed to the Stadium Authority board at a recent meeting. “We’re trying to save you from yourselves,” he reportedly told them.

But the nitty gritty details cannot be ascertained in the span of a single afternoon at 4900 Marie P. DeBartolo Way, and it’s not clear if the stadium management agreement requires the 49ers to deliver their financial records directly to City Hall, as requested in the 30-day notice.

Throughout the 49ers fiery response to the city, this phrase is repeated: “The Agreement does not require that these policies and controls be submitted to the Stadium Authority; it only requires that they be developed and put in place.” The endgame of this public spat eludes Guido, who says the mayor—a

It’s an overdue maneuver and absurdly inadequate for addressing the real issue, according to Roger Noll, a professor emeritus of economics at Stanford University.

One of the most outspoken critics of publicly subsidized professional sports venues, Noll has studied stadium deals across the country, and his conclusion on the current

imbroglio between the city of Santa Clara and 49ers is that they’ve both behaved badly, and they’re both right, due to a poorly drafted agreement.

“I think it's probably correct that the 49ers have provided information,” Noll says. “I think it's also correct that the 49ers have not answered all the questions the city has. … I’m not surprised that [the 49ers] have not been transparent. It’s partly because constituents want [the stadium], and partly because the people making the decisions are not particularly skilled or experienced in these kinds of operations.

It's easy for them to get caught up in the enthusiasm of the moment.”

A key complaint among cities that have helped subsidize stadiums—and especially outdoor NFL venues—is that revenue projections don't match reality, Noll says. They’re overly optimistic about the number of events that will occur compared with what would be possible in a convention center or, say, an arena like SAP Center.

“When you have a big business that is very sophisticated, located in this kind of city, exercising this asymmetrical influence, or one-sided influence, it’s amateurs to professionals; it’s like the 49ers playing high schoolers.” Noll says.

“I’ve spoken with some of the current and former City Council people, and they’re well-meaning people. They just don't know anything.”

Ignorance, it seems, is the common thread in this tattered quilt of interests.

City officials claim not to know how the money moves at Levi’s Stadium.

49ers brass claim not to know how they could be any more transparent. And the public is left to wonder who will blink first, unsure when things will get better on the field or in the front office.

As the revolving door at City Hall prepares to spin again, the spat with the football team comes on the heels of a legal battle with neighboring San Jose, which filed suit to stop construction of a $6.5 billion mixed-use retail and office complex next door to Levi’s Stadium, which has been called the largest private development in Silicon Valley history. Santa Clara fired back by suing San Jose over a much smaller expansion of Santana Row. We’ll soon find out whether Gillmor, her allies and constituents have the will to finish a fight with formidable adversaries in a twofront war.

legacy politician whose father, Gary, once served as the city’s mayor and figured heavily in its political life for decades—has made this a personal crusade that offers little benefit to either party. Santa Clara, he says, doesn’t have the capital or expertise to take over the stadium’s operations, and the 49ers’ struggling brand has made it an easy target.

“You’ll notice she never says: ‘Well, they didn’t deliver on the money,” Guido says. Instead, it's more a matter of “they just didn’t make me as much money as I want. She can’t point to one specific thing that we actually haven’t delivered on financially.”

Gillmor, a real estate agent by day who owns at least $6 million in city property and large land holdings in Gilroy (the value is probably much, much more, as statements of economic interest cap holdings at “$1 million or more”), openly gripes about the millions the 49ers have made since coming to Santa Clara, and how this windfall hasn’t trickled down to the city’s coffers in equally impressive fashion. The 49ers, now the fifth-most valuable NFL franchise at $2.7 billion in Forbes’ latest estimate, have seen record profits in their new stadium, selling not only six-figure luxury suites, but also forcing average fans to pay thousands in license fees just for the right to buy season tickets and have first dibs on non-NFL events.

Up-and-coming electronic duo Sick Individuals have been shaking up the dance music scene, remixing tracks by artists as varied as Avicii, Madonna and Rihanna. Known for their hit collaboration with Axwell, “I Am,” Sick Individuals have rocked popular electronic festivals Tomorrowland, Ultra, Sensation, Mysteryland and Creamfields. The Dutch duo of Rinze “Ray” Hofstee and Joep “Jim” Smeele met while studying music composition and bonded over Swedish House Mafia and Daft Punk. Their latest banger, “Alive,” with its earworm melody and energetic beat, shows that these two have no plans to slow down in 2017. (JT)

Presented in partnership with History San Jose, this brand-new adaptation of the holiday classic tells the familiar tale of Clara and her magical nutcracker—only this time, the fantastical story is set in the Valley of the Heart’s Delight and features references to local historical events, which have shaped the region. The production marks many firsts for the recently founded New Ballet School. It’s the company’s first time tackling The Nutcracker and marks the premiere of Alexsandra Meijer in the role of The Sugarplum Fairy.

Latino artists fight back at MACLA’s Chicana/o Biennial exhibit

HE ARTISTS included in the sixth annual Chicana/o Biennial at MACLA are alert and prepared for battle. The culture wars are actively and purposefully raging in San Jose during the few remaining days before the PEOTUS raises his right hand at the 2017 inauguration ceremony.

The exhibit’s statement of purpose begins with a quotation by the journalist Jorge Ramos: “I have a right as a U.S. citizen, immigrant and reporter to ask questions.”

When Ramos was escorted out of a Donald Trump news conference in August 2015 for doing his job, the conflict between the reporter and the real estate magnate resonated symbolically for both pro- and antiTrump constituents. Here was a white man, vying for national influence and power, spouting blatantly racist statements (“They’re bringing drugs.

They’re bringing crime. They’re rapists.”) being questioned by a Latino reporter about Mexican immigrants.

Last month, about half the country embraced Trump’s indefensible assertions. The Biennial is poised to serve as a rebuttal to a poisonous era of such damaging political rhetoric.

Like most of the work featured here, Zeke Peña’s painting, Sandra de

la Frontera, embraces and transcends its category. As part of his Bravo/ Grande Series, it is one of several twofaced portraits, like Siamese twins attached at the cheek. A ghostly white bird of prey straddles and connects the two faces as the three-eyed woman gazes at something outside of the frame, a desert in the distance.

On Peña’s own website, there’s a second version of the painting in which he’s placed “Sandra” on a background with vintage movie posters. The bold and oversized movie titles make for a livelier, if more obvious, statement ("Rio Grande Wetbacks" hovers in the background).

But they complement each other and it would have created a jarring effect if both had been chosen to hang side by side: twins reflecting twins on a changing American landscape.

As the total population of Latinos has grown within that landscape, Linda Vallejo has transformed sets of data and statistics to create “The

Brown Dot Project.” In a series of paintings that were inspired in part by modernists like Chuck Close and Charles Gaines, Vallejo combines brown dots (“I am literally counting one Latino at a time!”) and squares to reflect a number or a percentage.

From this group of paintings, the one representative here is National Latino Artists 9.12%, 2016. A painter’s easel made of dots rests on a pale blue canvas lined with grids. The easel and the figure illustrate the population of Latino artists in America. Vallejo has worked out a highly detailed system that takes ownership of an abstraction by transforming a number into something concrete.

One of the paintings that directly responds to Trump’s call for a wall along the Mexican border is We Dream of Ways to Break These Iron Bars, 2016 by Eric Almanza. Three people stand on the other side of an impassable fence. Their hands extend through the spaces between planks.

There’s a biblical quality to two of the figures. One woman genuflects with her palms opened up to the sky. A second woman in robes looks down in silent prayer or meditation.

The painting suggests a photograph

by Richard Misrach from his “Border Cantos” series that was on display earlier this year at the San Jose Museum of Art. The view, from the other side of the fence, is the same but Almanza fills in the space with people, whereas Misrach captures a bleak sense of emptiness. Both works remind the viewer how inhumane it is to separate people, regardless of their ethnicity or nationality, by a man-made and artificial border.

The overall effect of the exhibition is literally written on the wall. There’s a Call to Action: “How will you step up in 2017? Share how you will create change in your community this coming year.” You can pick up a colored piece of paper, write down your action plan and pin it up in the gallery. It’s one piece of weaponry these artists are advocating for in the fight against racism, and the first step toward winning the long battle ahead.

A SAFE SPACE Led by the Exhibition District, local creatives are taking over the former Ross store in downtown San Jose.

Support Your LoCo UNDER THE BANNER of “Local Color,” artists Erin Salazar and Drew Clark, locals themselves, enlisted a posse of young creative people to temporarily transform an abandoned downtown San Jose building into a gathering place for artists. The enormous venue in question sits at 27 S. First St., formerly Ross Dress for Less, which closed last summer. The building was previously Black Sea Gallery, a failed furniture store, and also famously the site of a botched plan to open a House of Blues. Before that, it was downtown’s legendary Woolworths store for over half a century.

For the last few years, Salazar and Clark have cemented themselves as part of a new generation of multidisciplinary artists trying to improve the dreary urban fabric of downtown San Jose in a multitude of ways. Salazar organizes mural painting escapades with her non-profit, The Exhibition District, while Clark pools his resources with numerous musicians, ballet dancers, event designers and visual artists under the banner of The Commons.

With the 30,000-square-foot Ross Dress for Less sitting empty and the parcel of land hypothetically slotted for another high-rise apartment tower, Salazar and Clark talked the landlord into giving them the keys to create a transitory safe space. As a result, there’s a Marley floor for modern dancers to do their thing. Sound systems appear in various corners. All the Ross branding is gone.

Along the northern wall, right where the Woolworths lunch counter used to be, there is a giant collaborative mural. In another area, a handful of comfy couches are arranged around a performance space. In the rear half of the store, many of the white merchandise racks still exist, but Salazar and Clark plan on using them to cordon off spaces for artists to hang their work and hawk their goods. The spaces will be rented out starting at $50 a month. Up front, the old Ross cashier counter remains—only now the spot where people used to purchase $5 fake plants, knockoff watches and post-expiration-date Swiss chocolate is a pop-up retail space.

All in all, Local Color—or “LoCo”—functions on multiple levels. It’s a safe place for local people of any color. Or it’s a place to paint in many colors. Or it adds color to a terminally beige neighborhood.

Of course, the new high-rise could be looming in a few months, or it could be much longer for the building to get demolished. No one yet knows.

Impermanence is the perspective to be celebrated here. “We’re trying to put the ‘temporary’ back in contemporary,” Salazar says. —Gary Singh

Big booms, high-flying fun in the action-packed ‘Rogue One’

HE STAND-ALONE Rogue One: A Star Wars Story is a battle movie, heavy on the war, light on the stars. Many have heard that George Lucas once cut footage from WWII dogfights into the work-print of the first Star Wars film, to give previewers an idea of what the film would look like once the effects were done. Rogue One, then, comes full circle. It’s a World War II movie in space.

The finale is on the planet Scarif, a world of surf and tropical reefs; the attack wings shooting, bombing and

crashing are like a futuristic version of the Pacific theater.

It’s set during the rise of Lord Vader and Grand Moff Tarkin. More about Vader momentarily, but the latter is yet Governor Tarkin, and played by Peter Cushing’s digitized ghost. It’s hard not to stare at the apparition of an actor dead for 22 years—the movements are a little artificial, but it’s him, all right. No one had seriously thought the grave could hold Peter Cushing, anyway.

Rogue One answers a question that’s been plaguing geeks for decades: why did the Death Star have such a glaring design flaw, so similar to the ever-convenient Self-Destruct Button in spy movies? Having answered this, director Gareth Edwards races along to the climax of a dangerous mission, carried out with a mixed cast of funny-

name bearers. Central to this tale is Jyn Erso (Felicity Jones, as determined and rabbitty as ever). She has grounds for wrath; her mother was killed by stormtroopers back on their rainy black-earthed home planet—a vision that blends Kauai and Donegal. Her father Galen (Mads Mikkelsen), who had been hiding from the Empire, is your classic kidnapped scientist, brought back to labor on the planet-busting weapon with an old acquaintance (Ben Mendelsohn.)

On a nearby planet, the dead Jedi’s towering main temple is abandoned, but it’s being salvaged for a mineral or something called kyber, which fuels both the light sabers and the death star alike. The Central Asian-like city around the temple teams with rebellious life—a town about to blow into insurrection against the Empire’s occupiers.

There, rebels join Jyn to eventually become the crew of a battered Imperial freighter stolen and renamed “Rogue One.” The crew roster includes a brain-damaged pilot,

as well as Chirrut, a blind semi-Jedi with zen archer skills (Donnie Yen, whose tremendous martial artistry is the single most rapture-inducing part of the show).

With the rebels is a reprogrammed droid. K2SO (voiced by Serenity crewman Alan Tudyk). He’s longlegged, 8 feet tall, snippy, and only intermittently obedient. “I thought I told you to wait in the ship!”

K2SO is scolded by his companion, Cassien (Diego Luna). As per the nerve-wracked Dr. Smith in TV’s Lost in Space, this android gives the defeatists in the audience someone to cheer on: he likes to recite the exact percentages of how fail prone a given mission might be.

Darth Vader turns up twice, once to show off his air-strangling trick—bemusing that such a gasper would want to make other people suffocate. The dark lord in his home inside a volcano citadel with a lava moat. Seemingly still recovering from his injuries from Revenge of the Sith, he stews in an aquarium full of chemicals. Nice to have him back, but Vader is not scheming up anything magically treacherous.

The movie is crowded and way too busy. The characters make stylish entrances—for example, Forest Whitaker as a blasted-up fanatic, stumping in on mismatched prosthetic feet—but they make even swifter departures. The Empire Shoots Back, for once, and with accuracy. Those who prefer the series’ explosions to the double-moonrises should be slaked by what happens. It’s all action, hopping from planet to planet and blasting all the way. That makes it faster and more serious than anything in the series.

The seriousness also makes it less exhilarating than last year’s relaunch.

One really wants to leave the recent election out of this experience, to go, watch and forget about the desperate times. This is difficult, given the huge emphasis on revolutionary self-sacrifice and battle lines being drawn; it’s an unpleasant kind of zeitgeist offered here—premonitions of possible struggle to come.

Revival THE WIZARD OF OZ

The Wizard of Oz (1939) is as famous for the unquenchable yearning in Judy Garland's voice, as it is for the witty Tin Pan Alley songs that never could have been written with such spirit and word play if the composers had known what the film was going to mean to the world 75 years later. It’s salted with pure horror, in the flocks of winged monkeys and the disappearance of the Wicked Witch, achieved with a hydraulic elevator

and a cloak full of dry-ice smoke.

The movie exists beyond the usual standards of criticism, which is why critics tend not to write too much about it. Still, The Wizard of Oz is one of those special films where what's onscreen is immaterial to the reactions it rouses in those watching it: the dreams of escape, the misfit's aching memories of persecution and solitude. IN SOME 2050s university class on “The Celebrity Interview as Literature,” the film Jackie might get taught as an example of the push and pull between lofty subject and noodging journalist. Nothing as vulgar as spin goes on—just gentle, forceful pressure from above.

The freshly widowed Jacqueline Kennedy (Natalie Portman) is hiding out in Hyannis Port, Mass., during the cold November of 1963. A fictional reporter (Billy Crudup) who seems to be a lot of T. H. White and a little bit of William Manchester, is inquiring after her, teasing her out to talk. Ms. Kennedy tries to keep her privacy while being available to the public, as she has during the short course of her term as First Lady. She checks the protocol for the state funeral to come. By herself, she drinks, chain-smokes and listens to the soundtrack of the musical Camelot. (It was a kitschy received idea of the early 1960s that the Kennedys regime was like King Arthur’s court.) Regal pride, deep shock and resentment are here, as well as private crumbling and steely poise in public.

It’s hard to get into a mood of mourning and have a good wallow. What’s most striking in Pablo Larrain’s chilly film is how much smaller the U.S. was a half

century ago, and what a different country the past was. The enclosed spaces, often in cars or planes, are broadened by Mica Levi’s distinctive, not to say thunderous, soundtrack. The issues facing Jacqueline are surprising—so much depends on how Charles de Gaulle will be treated Jackie at the funeral, and it’s not as if a French president R; 100 Min. would draw that much Camera Cinemas water today. The script by Noah Oppenheim is full of bad-movie prescience: “I wonder if Mrs. Lincoln knew they’d build a monument to her husband,” Jackie wonders. And Peter Sarsgaard’s Robert Kennedy muses whether a legacy of the Cuban Missile Crisis would be the idea that John F. Kennedy precipitated it.

A movie like this stands or falls by its lead performance. Fall it does. Portman is drastically wrong for the part. Her Jackie Kennedy recalls the old putdown, “Halloween came early this year.” It’s a breathy-voiced impression—something like what a very good female impersonator would do, and one look at a photo of the real woman dispels what little illusion there is. —Richard von Busack

San Jose scene veterans band together to form KOOK

UCKED BEHIND the burned out husk of an old tattoo shop, there is a little room decked out with posters of countless metal bands. Above them all hangs a huge banner emblazoned with the letters K-O-O-K—with the second “K” flipped horizontally.

“Personally, I wanted something that was symmetrical, word-wise.

Something you could spin different ways and always have it be more of a symbol than a word,” says Karl Larson, the band’s guitarist and

primary songwriter. More than just symmetry, the logo creates a sort of mathematically impossible logic.

“One is less than zero, and zero is greater than one,” Larson says, looking up at the banner, which could be read thusly: 1<00>1.

“That’s just how Karl’s brain works,” Jeff Wilson, the band’s bass player, says from the other side of the room.

There is obvious camaraderie between the band members as we talk. Besides Eric, the band’s drummer (a recent transplant from L.A.), all the members of KOOK have been a part of the San Jose scene for years.

“I was in kinda like an AC/DC band, called Sin City. Then that changed into a band called Motorfly.

And then I was in Imperial Space

Pod,” Larson says, name-checking the groups on his resume. Notably, Larson also played in the earliest incarnation of Oakland-based metal band High on Fire—itself a spinoff of San Jose doom legends Sleep.

“Very, very beginning,” he says, of his time with the group. “Me and Matt (Pike) just started writing songs and then that just kinda morphed into what became High on Fire.”

Pike is a legend in metal circles for his continued output with bands like High on Fire and his role in Sleep.

Back in the ’90s, Wilson’s old band used to rehearse in a practice space next to theirs.

“They were so fucking loud that we had to clear out and wait for them to be done,” he says. “It was just like, ‘Seriously guys, does it really need to be that loud?’”

“It does, though,” says Troy Aschenbrenner, KOOK’s singer, interjecting with conviction. While KOOK’s music is certainly sludgy and

indebted to stoner metal (Baroness, Ghost, Kylesa, and the Melvins are all listed as influences), Aschenbrenner’s vocals distinguish the group from their peers. Like Ozzy, Aschenbrenner is a metal singer, landing his delivery somewhere between Mercyful Fate and the dark theatrics of Nick Cave.

“It sounded a bit like a heavy version of The Cramps to us—the first songs that we were throwing out,” Larson says, sitting on an overturned road case in one corner of the room.

“I think it’s Troy’s element, the style of singing mixed with the heavy thing, it just creates a different sound.”

Aschenbrenner nods, before saying something that sounds decidedly un-metal.

“Growing up, my parents were just Elvis, Elvis, Elvis,” he says. “I love Elvis.

I saw Elvis.”

The sense you get talking to the band is that they love playing music, and they love meeting other people who love playing music. Wilson even runs a metal production group, Heavy San Jose, which is working on booking a dedicated metal night in the South Bay one Saturday a month. “It’s like with anything,” he says. “If you want something to happen, just make it.”

And since KOOK started out, that’s what they’ve been doing: making connections with likeminded bands, and trying to get them to San Jose to play.

“We put that on,” Wilson says, pointing toward a banner for a fest called Beers in Hell, which was held at the late, great Johnny V’s dive bar and music venue. “That was 11 bands.

I’d never seen Johnny’s like that. We went from 6 until 2 in the morning.

That was the first time I really thought San Jose might be able to support a scene.”

Nice guys or not, KOOK make sure their music is loud, visceral, something you can feel. “A friend said to me one time he saw us he felt like his guts got rearranged,” Wilson says.

Aschenbrenner nods in agreement. “My brother said the whole floor was shaking.”

Marsalis’ Musical Mallets YEARS AGO, vibraphonist Jason Marsalis flew up to Seattle to play a studio session with Christian Fabian and Ed Littlefield. Months later, while on an Alaskan radio show, he learned from Littlefield’s answer to the host that they had recorded modernized versions of folk songs by the Tlingit Native American tribe.

“And I'm sitting there like, I didn't know that's what that was,” he says, laughing. “I just came in and played.

Those kind of sessions can be a blur. Jazz is based on folk music and blues. However, jazz is a music that is also open to other cultures. That just was an organic moment. A lot of these things just happen.”

Marsalis hails from one of New Orleans’ royal jazz families. His grandfather, father and three older brothers are all accomplished musicians. In high school, his father encouraged Marsalis to shift from the drums to the vibraphone, a pleasing, but oft-overlooked instrument.

“It's melodic and it's rhythmic,” he says. “It's in between a horn and piano. After a while, I started to get ideas of what I wanted my music to sound like. And so then I started to follow that.”

Marsalis has been performing live with his father since he was 7 years old.

He’s collaborated with bluegrass artists, played world music and jammed with popular fusion group Snarky Puppy.

Today, he leads the Jason Marsalis Vibes Quartet. The group’s most recent album, 21st Century Trad Band, showcases Marsalis’ dazzling vibes skills, and seeks to bring “the 20th century into the 21st.” He hits whimsy on “The Man with Two Left Feet” and noir-ish intrigue on “Nights in Brooklyn.” On “BP Shakedown,” he flits between darkness and hope in an instrumental protest against the Deepwater Horizon spill that spewed 210 million gallons of oil into the Gulf of Mexico. He outros with Texas Rep. Joe Barton apologizing to British Petroleum.

“I was living in New Orleans when that oil spill took place,” he says.

“And, it's funny, honestly, my thought was, 'Oh, this again?' There's been all kinds of oil spills that happen. And they just keep happening, because these companies want to skirt regulations. They obviously don't really care.”—John Flynn

Despite this discouraging evidence, I guarantee that you will have the potential to meet with Future Versions of You on a regular basis during the next nine months. According to music critic David Nolan, these future pioneers came away from the June 4 show with the conclusion, "You don't have to be a virtuoso or a musical genius to be in a band; anyone can do it." I see parallels between this seminal event and your life in the coming weeks.

Women are really cuckoo when it comes to gifts. If my lady didn’t get me a present on my birthday, I wouldn’t really care. But if I didn’t buy her something for hers or if I chose badly, brace yourself! Don’t get me wrong; I love my girlfriend. I just wish I understood how to avoid the minefield here.—Lost In Santa’s Wonderland Unfortunately, you can’t just tell her that your relationship was “a gift from God.” So was the plague of locusts.

Gift-getting generally is a bigger deal to women than it is to men (like, if you miss the mark on her birthday, you might have to call in the U.N. peace negotiators).

To understand why, consider that our emotions aren’t just feelings; they’re motivational mechanisms that evolved to guard our survival and help us pass on our genes. For example, you feel jealousy when you sense a threat to your relationship -- like that your girlfriend’s compleeeetely platonic male BFF really has her back…because that’s the best position for a reach-around to her front.

Of course, both men and women feel jealous and are deeply hurt by both sexual infidelity (“Did you have sex with him/ her?!”) and emotional infidelity (“Do you love him/her?!”). However, evolutionary psychologist David Buss finds that men and women differ in which type they find more distressing. Because men experience “paternity uncertainty” (“Mama’s baby, Papa’s maybe”), they’re more distressed by sexual infidelity, which could chump them into raising a kid who’ll pass on some other dude’s genes.

There’s no such thing as “maternity uncertainty” because babies are delivered not by storks but by obstetricians—who coach screaming, profanity-spewing mothers-to-be to push a bowling ball-sized human out a

very small opening. Accordingly, Buss finds that women are more distressed by the prospect that a man might be emotionally elsewhere, leading him to divert his investment in their children into diamond-encrusted loot for that hussy he’s been stepping out with.

In light of this, it makes sense that a woman puts more weight on a male partner’s displays of love and commitment -- which is ultimately what gifts to your girlfriend are. Maybe understanding that can help you convert gift-giving from a perilous chore to a way to tell your girlfriend that you love her, that you don’t take her for granted, and that it means something to give her a little burst of happy.

Unfortunately, this may not make your shopping any easier on Official Girlfriend Holidays (Christmas, Valentine’s Day, your anniversary, and her birthday). What might is asking for advice from women close to her—her mom, her sister, her BFF. As a bonus, they’re likely to gab about what a loving, thoughtful boo you are. As a secondary bonus, if some gift is a bust, they’re also handy targets for blame.

However, there’s a way to minimize the effects of any big-gift fails, and it’s with semi-frequent little gifts—like picking up her favorite overpriced smoothie or that special cheese she raves about. Doing this tells her something very important: that you love her enough to pay attention.

RECENTLY REVISITED one of my favorite books, City of Djinns by William Dalrymple, a travel book about Delhi history. In Delhi, no matter how many new businesses seem to emerge, the old legends—just like spirits or djinns—often come out of nowhere, sometimes decades after they were aced out.

Dalrymple portrays a city

“disjointed in time, a city whose different ages lay suspended side by side as in aspic, a city of djinns.”

This is also my view of downtown San Jose, where, in the SoFA District, decades of creation and destruction reverberate to the current day.

Businesses or buildings die right alongside others just beginning, seemingly merging the district’s physical and temporal aspects. Djinns are a city’s ghosts and when I see the brick building at 399 S. First St. gearing up to serve fish taco plates, I cannot help but recall when that building was Marsugi’s, the best corner rock & roll dive San Jose ever had. At Marsugi’s, one watched bands

like Nirvana or Faith no More in front of 30 people, back when those bands were relatively unknown.

However, on one particular night at Marsugi’s, things got a little fishy.

At the time, we were a group of four SJSU music students gigging as an improvised noise-art fraternity of the absurd. In February of 1993, two weeks before Marsugi’s was slotted to close, we played a show to maybe 12 people and I became the first one to play an amplified lawnmower in downtown San Jose. Since the club was closing in favor of mainstream upmarket riffraff, we wanted to leave our mark. The lawnmower came from my mom’s house and after we loaded everything into the truck, we stopped for beer at the dumpy Lucky Supermarket downtown.

Once inside the store, I decided to buy a stack of whole fish from the seafood section. I don’t remember

why I did this. It was a snap decision.

Nothing was premeditated.

During the show, none of my equipment was working, an occasional downside to shows with homemade electronics, so as the rest of the group proceeded to make sounds, I grew frustrated. Plus, we were angry that Marsugi’s was closing, so the emotion came to a boil 10 minutes into the gig.

Enter a Briggs & Stratton lawnmower rigged with a homemade contact microphone assemblage to amplify its sounds, sitting on the beer-stained Marsugi’s carpet, with gas in the tank, just waiting for me to turn it on. As the rest of the band continued to make excruciating noise for noise’s sake on keyboards, bass, amplified trombone and electric guitar, I couldn’t get any of my equipment to work, so I stepped onto the floor, placed my right foot on the lawnmower, and yanked the cord a few times until the machine came roaring to life. Fully amplified, the motor raged through the PA system. The sound man, already drunk and on LSD, started tweaking knobs in response. Then, I flipped the mower over so its blades violently spun in full view of the audience members and I started laughing. I just remember laughing.

Only the fish remained, so I rescued them from the Lucky’s bag, theatrically taking each fish out of its plastic wrap, slow enough so the intimate crowd could realize what was about to happen. As the band played on, I threw dead fish, one by one, into the running lawnmower blades. As a result, fish guts sprayed every which direction, splattering throughout the entire club. The bar, the walls, the tables, and yours truly were covered with fish guts afterward. Some of the audience got splattered, while others tipped up tables to shield themselves from the flying fish guts. The manager immediately shut down our show, but the club smelled like fish throughout the last two weeks it remained open. The staff was never able to get rid of the smell and I had to shower several times before I stopped smelling like fish.

Skip to 2016 and the djinns of 399 S. First will resurface yet again, when a new restaurant opens next month, right where this juvenile temper tantrum went down. Space and time will merge and I can’t wait for the fish tacos.

the same thing. A large portion is enough for two, as the garlic linguine was topped with dark colored chasiu pork and roasted broccoli. The savory chasiu had enough flavor to coat the noodles, bringing a balance to the Eastmeets-West dish. The minimal seasoning on the broccoli had the same purpose, balancing out the salty and savory pork in an effective combination.

UNCH BREAKS are more than just time to satiate one’s appetite— they’re also a breather from work stress, a time to socialize with coworkers, an opportunity to people watch.

Whether the chefs intended it or not, Kumino Restaurant offers an excellent setting for all of the above.

We all have a lot to fit into our lunch hour, including commute and waiting in line. Kumino’s quick and

cheap lunch options, with a touch of elevated sophistication, help alleviate the stress of where to go and what to eat. The chef and sous chef worked as cooks at Manresa and Momofuku Noodle Bar, respectively, and together they aim to combine fine dining elements with speed and efficiency.

The menu is simple with five categories and a few desserts. It starts with buns, which are an ideal on-the-go lunch food. A few of these as a meal can be filling and Kumino offers a variety of flavors. Options include the standard pork belly bun ($3.75) for those jonesing for a thick slab of fatty pork cut by pickled cucumbers and hoisin sauce. There are also unique combinations like smoked salmon,

eggplant and even the crawfish bun ($4.25) with masago mayo, celery, and carrots. The last of these was a little disappointing, as it was more bland than its appealing description.

The disappointment, however, was quickly forgotten thanks to the smooth service we had from the single woman working the entire front of the house.

It was a small dining room but bustling with activity from diners and take-out orders. The promise of tastier fare was literally on the horizon as we could see the chef cooking the garlic noodles from across the open counter. But first, the chicken karaage appetizer ($7.50) with mayo came out. The fried chicken pieces were a crispy golden brown color and were tender after the crunchy bite.

It was a redeeming appetizer.

At this point, we were served the noodles we had been eyeing as the chef worked. The garlic noodles ($11) come highly recommended here, and I witnessed several other diners ordering

Had I realized the noodle portion would be so large, there would have been no need for my poached salmon rice bowl ($14.50). My entrée came in a good portion size covered with salmon cubes topped with a chunk of miso butter. The accoutrements included pickled ginger, tobiko (fish eggs), nori squares and circular slivers of danmuji (Korean yellowed pickled daikon). The chefs preference for butter sometimes does not translate well, but the rice bowl was set up for delicious success with the right textures and flavors—a dab of miso butter does little to help plain poached salmon.

The concept of a worker’s lunch means something quick and filling, but sometimes sacrifirces are made regarding taste. With a location down the street from the Googleplex and many apartment complexes, lunch or dinner at Kumino makes perfect sense for neighborhood inhabitants and those just passing through. The restaurant aims to make any work lunch or other meal a pleasant experience, and they definitely provide exceptional value for the cost, speed and quality of service.

A Comeback Pho the Win

HE FOOD GODS rarely give second chances. But to many pho devotees, their prayers have been answered with the re-opening of Pho Ha Noi in Little Saigon’s brand-new, upscale Vietnam Town plaza.

Pho Ha Noi was a beloved pho shop on Capitol Expressway that inexplicably closed in late 2013, despite a steady following and a solid four star Yelp cred. I spoke with owner and head chef Charlie Nguyen, and he said the restaurant closed because of family issues and nothing business related. One of my good friends, who actually first introduced me to pho, used to wax poetic about Pho Ha Noi and how no other pho could compare. When I heard about their soft opening in early December, I grabbed him and told him it was time to put up or shut up.

Unlike most pho shops, which are sparsely decorated, Pho Ha Noi’s new location and décor are upscale; fancy chandeliers, quartz countertops and a stunning mural of Hanoi’s Hoan Kiem Lake adorning the rear wall.

The service was also friendly and terrific.

At the behest of my cohort, we ordered their special combo pho dac biet ($11.25)—and to prove our credentials, we ordered the tái riêng (rare beef on side) to accompany our pho. Every other place I’ve been serves the rare beef in thin slices, but Pho Ha Noi dices, or tenderizes, the beef and tops it with a little cilantro, green onions and fresh garlic.

Pho Ha Noi is known for their Northern-style broth, so it’s a little different than what most people are used to; it has a strong beefy taste with hints of green onion and ginger, unlike the southern broth which is more star jasmine and white onion. The depth and breadth was phenomenal, and I slurped up every last drop.

Another house specialty are the handmade fresh, wide noodles.

Pho Ha Noi’s seem to be thicker and tastier, which helps capture the nuances of the broth. The tripe, tendon and brisket that all come standard with the special combo were delicious, but the absolute highlight was the tenderized rare beef that was so supple and cooked in their piping hot broth.

I worried a little about coming to Pho Ha Noi on opening night, because they may not have had all the kinks worked out. Other than a little payment snafu, they were up and running like a place that had been doing it for years. Second chances are rare in the restaurant world, but Pho Ha Noi is making the most of it. Rejoice, South Bay pho lovers.
