RE: “ELECTION GUIDE 2016,” NEWS, NOV. 2 You assert “Citizens United made money equal free speech.” This is quite dishonest, and pretty much the opposite of what happened; CU didn't say money is speech, the law it struck down said that *speech* is *money,* treating speech regarding a political candidate as being in the same general category as a monetary contribution to a political campaign. The Supreme Court merely recognized this as the censorious bullshit it is. Moreover, the Supreme Court ruled long before CU that one cannot do an end run around the First Amendment by prohibiting people from spending more than their allotted quota of money on speech, and then claiming that one is regulating “money” rather than speech. What was at issue with CU was whether the government can dictate to corporations what they can or not cannot say, on the basis that the First Amendment applies only to people, and corporations are not people. The Supreme Court found that for the purpose of asserting First Amendment rights, corporations are legal persons, a finding that the Left has, again dishonestly, characterized as “corporations are people.”

Too Close to Call A week out from Election Day, and the results remain too close to call in a number South Bay races. By press time Tuesday, Santa Clara County election officials had yet to count 15 percent of the ballots, which prevented some people from making their obligatory concession calls. In San Jose’s District 8 City Council race, JIMMY NGUYEN finished election night with strong lead over SYLVIA ARENAS only to fall behind a day later. But the latest count put Nguyen out front again by 84 votes.

Both candidates have been taking turns watching the vote-counters sort through the remaining 4,000 ballots in person.

There’s another nail-biter in Santa Clara, where the challenger, veteran policeman PAT NIKOLAI, has been gaining on the city’s elected police Chief MICHAEL SELLERS. They At last glance, the Did incumbent held a What?

Pot legalization will open flood gates for on-demand cannabis

A

S DAVID HUA built Meadow, a cannabis technology company launched in 2014, he and his co-founders kept asking one question: Do we want to be kings or kingmakers?

Social and political tides were shifting. For the first time, a majority of Americans favored legalizing marijuana. There were whispers and murmurs, then chatter and finally shouts about California being poised for a “green rush,” a rapid and sweeping expansion of the marijuana industry.

For cannabis advocates, the green rush represented a social victory. It

meant easier and safer access to medical cannabis and, as of last week, recreational pot, too. But the green many others see is cash. And the earning potential is colossal: San Jose is on track to bring in $9 million in medical marijuana tax revenue just this year. Hua and his partners created Meadow in this climate, and the answer to their question—kings or kingmakers—came organically.

“We’re better as a team to be kingmakers,” Hua says.

This philosophy shaped Meadow’s focus: creating a software for pot shops that helps manage inventory, sales and deliveries. “We believe there’s plenty of room at the table; we don’t need to be at the head of it,” Hua says. “Why not build the tools and features that can help empower many people to have a better service?”

Questions about motives continue to dog companies entering the cannabis

industry. San Jose recently passed two marijuana ordinances, both at least partially aimed at protecting the industry from predation and profiteering. The most recent, an urgency ordinance rushed through by the council on Nov. 1, bans growing, manufacturing, distributing, testing or selling recreational marijuana. The city designed the rule to give it time to study what legalizing recreational pot means for San Jose in the wake of voters’ approval of Proposition 64.

Another rule approved at the Nov. 1 meeting allows medical marijuana delivery within the city. Once it goes into effect Dec. 2, San Jose’s 16 licensed collectives will be able to deliver medical marijuana to patients 21 and over, between 8am and midnight.

Under the ordinance, third-party companies like Meadow, which works with 60 cannabis collectives across the state, can facilitate deliveries, but the products must come from the 16 approved dispensaries. Drivers must also be employed by the dispensaries and, like all cannabis workers in San

but both charge collectives for their services, rather than patients. Eaze charges a dispensaries software-licensing fee. The company does not publicly share information on those fees, but Sheena Shiravi, a spokesperson for the company, says Eaze treats “each business uniquely.”

Meadow, meanwhile, charges cannabis retailers on a sliding scale based on how many “active users” they have. That’s defined as someone who signed up with the collective or placed an order through Meadow.

“Part of our ethos is that we aren’t successful unless our partners are successful,” Hua says. “We really don’t make money until our partners make money.”

This is a reflection of a philosophical difference between the two companies.

Meadow focuses on serving patients by making the collectives more successful businesses. Eaze, on the other hand, “really [focuses] on the patient experience,” according to McCarty.

“We do that by collecting data around consumption behaviors or interactions with the technology, and constantly improving that through the technology,” McCarty says.

Both Eaze and Meadow support San Jose’s regulatory approach, while also being careful not to step on the toes of collectives, which are naturally protective of their clientele and profits. Kali-Rai says the collectives he works with are excited about, if not a bit daunted by, the prospect of delivery. Many will likely welcome the chance to expand their customer base for a nominal fee. But, Kali-Rai notes, his clients are wary of companies delivering products from outside the city—a practice not allowed in San Jose.

While collectives aren’t eager for outside competition, San Jose officials are open to allowing the delivery to other municipalities. “If a neighboring jurisdiction were to allow delivery, we would allow our folks to deliver there,” McGurk says, adding that Campbell is considering a proposal to ban dispensaries but allow delivery from San Jose’s. By contrast, Los Gatos has banned collectives and delivery.

The rush to profit off of pot delivery is still in its infancy, but since last week the city was flooded with enough questions that it established a website with information about what Prop. 64 allows now and once state licensing begins.

These protections are put in place in part to ensure that outside companies don’t swoop in and profit off of the city’s broadening marijuana regulations.

But they also stemmed from a desire to stamp out the numerous cannabis collectives and delivery services that operate illegally in San Jose.

“My clients were getting very frustrated with illegal operators,” says Sean Kali-Rai, a lobbyist for the local cannabis industry. “We came up with the whole concept with the San Jose Police Department of fighting fire with fire.”

Cannabis advocates and SJPD tout delivery as a safer way to help increase patient access.

“At a high level, [delivery] couples accessibility with safety,” says Keith McCarty, CEO of Eaze, another ondemand cannabis delivery company looking to break into the South Bay market. “When you don’t give patients accessibility, they don’t get what they need… or worse yet, they resort to getting it from illicit drug dealers.”

Safety comes down to three things: the purity of the products, the security of patients and drivers, and respect for the law. Both Meadow and Eaze offer realtime tracking of drivers, like a DoorDash or Uber, so both the collectives and the patients know where the delivery is at all times. Legalizing delivery also addresses the biggest problem for San Jose medical marijuana patients: location. Currently, San Jose only allows medical cannabis collectives in industrial zones, far from public transit and the city’s center.

“The city, with its aggressive zoning regulations, pushed us, pushed the legal collectives, into very difficultto-reach areas for most patients,” says Neil Ruditsky, director of business for Elemental Wellness. “We’re just excited to relieve the burden for some of our most seriously ill patients.”

Any of San Jose’s 16 collectives interested in on-demand delivery service will have to submit a plan to SJPD for approval, according to Michelle McGurk, assistant to the city manager. Collectives will have to choose between managing deliveries on their own or using a third-party, like Meadow or Eaze.

Eaze launched in 2014, the same year as Meadow, and McCarty says cannabis delivery helps overcome any stigmas by operating in a more discreet, professional manner. Meadow and Eaze provide similar services with subtle differences,

President-elect Trump spent the bulk of his campaign pledging to make America great again by winning back jobs while also encouraging violence at his campaign rallies, spewing racist, xenophobic and misogynistic rhetoric in search of applause, and floating plans to crack down on a free press.

(The list is so much longer than this, but let’s assume everyone has been paying attention.)

The election result has sparked protests across the country as well as led to numerous reports of hate crimes, including one in San Jose.

A San Jose State University student says a man grabbed her by the hijab and threw her to the ground in a parking garage near the school’s

campus. A protest in downtown San Jose the next day resulted in hundreds of people taking to the streets and some even shutting down traffic on Highway 87.

Anxiety is naturally running high, as many people are worried Trump intends to follow through on pledges he made during his campaign. These promises include: • Arresting all undocumented immigrants with a door-to-door deportation force.

• Carrying out “extreme vetting” of any suspected terrorists, which could be anyone. (But probably not you, old blue eyes.)

• Creating a registry of Muslim citizens.

One elected official who has been especially critical of Trump is San Jose Mayor Sam Liccardo, who criticized the president-elect after a

summertime campaign rally in San Jose turned violent. On Monday, Liccardo issued a highly unusual statement to reassure residents that local officials and law enforcement will protect constitutional rights and not comply with Trump’s administration on federal immigration enforcement.

“We’ve got your back,” Liccardo said.

Liccardo also encouraged residents to report any incidents of hate crimes and directed residents to a number of resources the city has created for immigrant affairs.

The mayor finished his statement by quoting deceased French resistance leader Andre Malraux: “Instead of lamenting the absurdity of the world, let us try to transform the corner of it into which we were born.”

Our long national embarrassment has only just begun.

DA to Host Sexual Assault Symposium Incidents of sexual assault on college campuses are nothing new, but technology and social media have played a key role in elevating the issue to national prominence.

This summer, the Stanford rape case blew up on Facebook and Twitter, as people fumed over Judge Aaron Persky imposing only a six-month sentence on Brock Turner.

With these and other incidents in mind, Santa Clara County District Attorney Jeff Rosen will host a campus DA Jeff Rosen sexual assault symposium, which starts at 9am Friday at Santa Clara University.

Rosen said he hopes the event will help “make campuses even safer and sex assaults even fewer.”

According to RAINN, the nation’s largest anti-sexual violence organization, 23.1 percent of undergraduate women experience rape or sexual assault, either through physical force or violence. The organization also found that “college women are twice as likely to be sexually assaulted than robbed.”

College is a time for self-exploration, for young adults to go out into the world and figure out who they are and what they can do with their lives.

That freedom can also result in terrible decisions that leave lifelong scars.

The 2015 documentary The Hunting Ground depicted how this type of “freedom” and how it negatively affects others. The film details stories of sexual assault survivors from colleges across the nation. In the cases presented, many of the schools did little to nothing to help the victims.

In light of these events, Rosen wants to make it easier for victims to get the justice they deserve. —Taylor Jones

GETTING BLAZED Changing forests in the Santa Cruz Mountains are worsening local wildfires BY KARA GUZMAN

N A LATE September afternoon, residents as far flung as San Jose, Morgan Hill and Santa Cruz watched in collective horror as a thin smoke plume at the summit of the Santa Cruz Mountains became an ominous mushroom cloud that was visible for miles.

For two weeks, the mountain peak looked like an erupting volcano as the Loma fire burned 4,474 acres and destroyed 12 homes and 16 other buildings. Hundreds were evacuated.

At its height, more than 2,000 personnel battled

the fire day and night, from the air and on land. The Loma fire was contained on Oct. 10, but firefighters remained at the scene for another several days, finishing repairs. Not including damages to property and infrastructure, more than $17.8 million was spent to control it, according to Cal Fire staff.

In fact, much of California was ablaze this summer. In August, the Blue Cut fire near Los Angeles burned more than 36,000 acres. The Soberanes fire in Big Sur, which began July 22, burned for nearly three months, consuming 132,127 acres. Last month, the state had 43 wildfires. And yet, fire season is just beginning— in the Santa Cruz Mountains, fall brings prime conditions for wildfires—parched vegetation, less fog and dry north winds.

SMOKE EATER The Sand fire this July engulfed thousands of acres near Santa Clarita.

It’s not just the number of wildfires that’s startling, but also their intensity.

Wildfires now burn twice as many acres as they did 30 years ago, and scientists expect that figure to double again in the next 30 years. Fire seasons are also three months longer than they were in the 1970s, according to a 2015 U.S. Forest Service report. As California’s wildfires grow bigger and hotter, this summer’s explosive blazes may be a sign of what’s to come.

The New Normal The two largest fires ever recorded on the Central Coast both happened

in the last decade. One of them, the Zaca fire near Santa Barbara in 2007, was particularly intense, burning all vegetation to the ground and leaving nothing over roughly 170,000 acres, says Chris Potter, a research scientist at NASA who studies wildfires and the Santa Cruz Mountain forests.

“So if that’s an indicator or representative of what’s to come for the kind of fires we’re going to have in the future, they’re going to be difficult to control, burning larger areas, in really remote kinds of terrain that makes it very difficult for firefighters,” Potter says.

And only a few hot, dry days are needed to prime an ignition.

“It’s just perfect for spreading fire.

Hot, and then a little bit of wind, and you’ve got yourself a huge problem,” Potter says.

Climate change from fossil fuels and the buildup of greenhouse gases is making wildfires more dangerous, he says. The warming trend has already increased the frequency of

fires on the Central Coast. Huge wildfires like the Soberanes fire used to occur every 25 to 30 years. Now they come once a decade.

“Because we’ve changed the climate here, that’s our new normal.

That’s what you have to expect, and what you have to prepare for,” Potter says. “Not only will they be bigger than ever, but they’ll burn hotter, with more severity. So it will be hard to save structures that are within their pathway. We’re already spending $1 billion per year to control fire in the state. So the

Mountains, which pass through Santa Clara and San Mateo counties, have seen drastic change.

If left unchecked, Santa Cruz Mountains grassland turns to shrubland, then to increasingly thick forest. Wildfires and grazing animals, and later, people, have kept the balance for most of the mountains’ history. First came the mastodons and mammoths—giant tusked beasts— which ate grass and leaves. Then for thousands of years, Native Americans managed the land with prescribed burns. In the 1800s, the timber and farming industries began thinning the forests, also with prescribed burns.

15 So historically, when wildfires started, as is natural for this region, they mostly burned a small area and died on their own, since they had relatively little fuel.

But since the 1900s, the Santa Cruz Mountains have been mostly unmanaged for the first time in history, creating a different, thicker forest, says David Van Lennep, a local forester for the Redwood Empire lumber company. Not only have prescribed burns become rare, but any wildfire that pops up is immediately suppressed.

“There’s more flammable material in the mountains now than there has been in past years.

The fires that we’ve seen starting in 2008 in the Santa Cruz Mountains are kind of a new phenomenon,” Van Lennep says.

The Summit fire near Corralitos in 2008 was the last significant wildfire in the region, scorching 4,270 acres. It burned some dense areas that hadn’t seen fire in almost a century. Roughly 40 percent of the Santa Cruz Mountains is public land that is mostly unmanaged, said Van Lennep.

Tim Hyland, senior environmental scientist for the Santa Cruz district of California State Parks, says prescribed burns occur in less than 1 percent of the 65,000 acres of state land in San Mateo and Santa Cruz counties.

Prescribed burns are difficult in the Santa Cruz Mountains. For one, the Clean Air Act limits the amount of smoke that can be produced.

Also, as more people move into the mountains, there’s a smaller area that can be burned safely, Hyland says.

A Disrupted Cycle Natural wildfires and prescribed burns used to reset the landscape, creating patches where plants would clear then return, says Ed Orre, forester and division chief of Cal Fire’s Santa Clara unit.

That’s no longer the case. Fires are now extinguished as fast as possible.

“Because we’ve suppressed fire for so long, everything’s built up across the landscape, and now we have large expanses of heavy fuels and

CALIFORNIA BURNIN’ dry vegetation,” Orre says. “And so we’re not getting those smaller patch burns and maintaining that mosaic on the landscape. We’re getting bigger, larger fires. And when the weather is really hot and dry and the fire starts, it’s really difficult to catch.”

Orre started with Cal Fire in 2000, in the San Mateo-Santa Cruz unit. Within his first few years, he had already participated in eight of California’s top 20 most expensive and largest fires in history at the time, he says.

Orre said the Loma fire luckily had no significant wind, otherwise it would have grown much larger.

“It was a fuel-driven fire,” says Orre. “It was a very hot, dry day [when it started] and the fire was burning daytime and nighttime, very aggressively. We were very successful at keeping it from getting any bigger than it was, but it was a tough fire to put out, until the weather changed.”

The peak of the Santa Cruz Mountains fire season is only beginning, Orre says. Recent rains wet the grass, but were not enough to rehydrate the larger, thicker plants, which can still fuel fire, he says.

A New Forest Change how fires spread, and you change the plant community, says Hyland.

For example, the Santa Cruz Mountains are being swallowed by invasive plants, many of which are flammable. After the 2008 Summit fire, stinkwort and French broom took over places where they didn’t grow before. These invasive weeds specialize in spreading to newly burned places, and beat out the native species, says Hyland.

“They’re not good habitat for all the animal species. I like to refer to them as ‘empty calories’ in the ecosystem,” Hyland says. “They take up space, but they don’t contribute to the food pyramid.”

“So that’s really an issue. If we start seeing increased fires, which seems almost certain that we will and already are, then that puts us at risk for all these weeds to win out after the fires.”

The Santa Cruz Mountains are also overwhelmed by Douglas

16 firs, says Hyland. These trees are flammable and historically have been controlled by wildfires. But because of fire suppression, Douglas firs are spreading at incredible rates, swamping out rare plant communities.

Forest managers are now removing Douglas firs and trying to preserve oaks, which are more fire resistant. The hope is that when fires become more frequent and intense, the forest will be more resilient, says Hyland.

Another problem facing forest managers is sudden oak death, which is widespread in the Santa Cruz Mountains. It’s a disease caused by a water mold, and has flared up in the last five years, says Shannon Lynch, a UC Santa Cruz doctoral student studying tree disease. She says it’s unclear how many oak trees are affected, but sudden oak death is the primary disease affecting local forests.

Contrary to the name, “it’s not a sudden death,” says Lynch. “It takes an estimated five years for a tree to actually die. When it’s attacked, it’s just those last several months that the tree appears healthy, apart from some bleeding symptoms on the trunk. But within a couple of weeks, all of a sudden the canopy changes, but it’s been running its course for a number of years on the tree,” Lynch says.

As sudden oak death kills more trees, it creates more possible fuel for fires, says Orre.

He urges mountain residents to “harden their homes” to fire. Homes are usually damaged by falling embers, not racing flames, he says.

Orre recommends that they also install fireproof roofs and siding, keep gutters clean, cover chimneys and vents with metal mesh, replace single-paned and large windows with stronger ones, equip garages with fire extinguishers, and post address signs so they’re clearly visible from the road. Residents should clear a perimeter around their houses, he says.

“If people are going to be living in the wildland or on the edge of the wildland, they need to be as prepared as they can for the eventuality of a fire coming through,” Orre says.

Since breaking out as a solo artist with 2004’s The College Dropout, Ye has demonstrated a knack for innovation—pioneering the use of sped-up soul-vocal samples, paving the way for Drake and The Weeknd with his indie-rap crossover 808s & Heartbreak, and making his own rules on My Beautiful Dark Twisted Fantasy and Yeezus. For the San Jose Museum of Art’s current exhibition, Indestructible Wonder, Holm’s contribution Watertable took up the entire length of one gallery. The hollowed out table contained a pool of black water with music machinery that, despite being entirely wet, could still emit sound. For “Artrage,” Holm will play records underwater in a performance piece called Submerged Turntables. Can we anticipate an urban dance party set against a fairytale idyll? As the DJ himself puts it, don’t be expecting a rave: “The pool, black and depthless, represents loss. I am enacting a small moment of remorse towards this loss.” (JE)

Making centuries-old books come to life is Sandow Birk’s forte. Hammer Time TOTALLY CRACKED ‘Nutz Re-Mixed,’ billed as a 21st century spin on the classic ‘Nutcracker,’ opens at Hammer Theatre this week.

WO MILLION dollars isn’t a lot of money in Silicon Valley terms, so the restoration and reopening of the 20-yearold Hammer Theatre in downtown San Jose came at a bargain price. The 5,400-square-foot building was closed after San Jose Rep folded about two years ago. Now, after a renovation and a re-do of the sound and lighting system, it’s both a public and a private space.

The downtown theater is ready for black box performances, for students, for corporate presentations.

The Hammer has a rooftop terrace, facilities for receptions and sit-down dinners. SJSU put in $1.5 million and the city added another halfmillion. SJSU’s Humanities Dean Lisa Vollendorf describes the Hammer as a place where the city and the university can meet, much like the town-andgown partnership that resulted in the Martin Luther King Jr. Library.

Vollendorf recalls that the library, now one of the landmarks of downtown, was controversial at first.

There was a similar back-and-forth after the San Jose Rep went out of business. The city issued an RFI—“a request for interest,” Vollendorf explains, “which at the end of the day the university decided to make an offer on, and rightfully so.”

There’s a question of “what kind of art millennials will support,” as Vollendorf puts it. Giving the campus of 30,000-plus students exposure to the

arts is one selling point for the space.

“The Hammer Theatre doesn’t replace existing spaces, it augments them,” she says. “Our facilities are aging. This is our chance to put our best foot forward, and to give the students access to a beautiful performing art center, just two blocks away.”

The campus is making a three year initial commitment to the Hammer Theatre, with personnel and faculty investments, to see if it’s a financially stable model. If so, that will encourage a longer lease. But there’s more, Vollendorf says: “This is made for the broader community, too. It tries to answer the question of how can Silicon Valley be on the cutting edge.”

Upcoming events include, maybe, Cinequest in February—this is still in the unconfirmed stage, though San Jose’s film festival opened the then-dark Hammer for screenings last year. SJSU’s production of Luis Valdez’s Corridos just finished its run at the Hammer.

“If you’re there in the early afternoon or evening, it’s very exciting,” Vollendorf says. “Sitting in the audience is a beautiful experience

for the students who never went to a professional theater. And we can tell them, ‘Welcome to your Hammer Theatre; this belongs to all of us.’”

Renowned Santa Cruz-based choreographer Tandy Beal is generally an ebullient person, but she’s especially enthusiastic about the Hammer, which will be hosting her production Nutz: Remixed (Nov. 18-Dec. 4), the new version of her biennial deconstruction of the Nutcracker Suite.

“It’s gorgeous, it’s fantastic, it’s a jewel for San Jose,” Beal says. “We’re honored that we get to be their first professional show.”

Beal’s career—which, as she says on her site, has lasted “40 ODD years”—includes collaborations with Bobby McFerrin, Frank Zappa, and the Pickle Family Circus. She had a stint leading the Moscow Circus and she was a crew member of the movie Nightmare Before Christmas.

The beloved Nutcracker gave Beal grounds for renovation. Beal is the first, she believes, to create an alternative version of the traditional Christmas production. Lord knows it comes in various flavors these days— everything from straightforward kid fodder to the Freudian version, filmed

by Carroll Ballard in Seattle, with its Maurice Sendak-designed set.

“How do we make joy—something irresistible—during the dark time of the year,” Beal asks. “The time when we need places where we go ‘Yes!’” Her answer is to have six singers take a different slant on all the world-music dances in Nutcracker, which Beal and her company flavor with hip-hop, Spanish folkloric music and a little punk rock. “The babies get out of the nursery, and there’s some antic table sliding, while the characters wisecrack.

“The company is close to readiness.

Everything is in place, everyone’s grinning in rehearsal—we’ll do final run-throughs this weekend,” she continues. “We’ve got Natasha Kaluza with a hoop act that kills—she gets 50 hoops going at once. We’ve got jugglers and a really good cyr-wheel rider. Lots of daredevil tricks…everybody just walks out uplifted, and they’ll have a good time this year.”

The production opens to a public square where a servant, The Barber Fiorello (played with perfect nuance by Babatunde of Seville Akinboboye) corrals local musicians to help accompany his master in courting a woman. The master, Count Almaviva, Nov. 12-27th seeks the romantic favor of Rosina, already betrothed to California Theatre, San Jose the elderly doctor, Bartolo. Enter Figaro, an enterprising conman who has talked his way into a job as a hairdresser.

After meeting Almaviva, he decides to help him win Rosina’s favor. What follows is the quirky quest of a rag-tag duo hell-bent on capturing Rosina’s heart in an increasingly hilarious and perplexing romp.

Kirk Dougherty shines as Count Almaviva. He is both genteel and ludicrous.

Vocally, Dougherty’s mid-range tenor reaches and holds very high notes with crystal clarity. Rosina, played by Renee Rapier, is equally brash and silly, giving her character a refreshing self-awareness not seen in the others, save Figaro, to whom she most closely relates. She displays a wide tonal dexterity with her deep and smoky mezzo-soprano. Bartolo is played by Valerian Ruminski, who convincingly portrays an older, paranoid male suitor; his mutterings and patronizing comments are complemented by his deep baritone.

The standout performance belongs to Kirk Hanscombe as Figaro.

Demonstrating easy command over his powerful, flexible voice, he channels the comedy through his face. His expressions—hilarious and cartoonish— are incredibly emotive and clearly capture Figaro’s personality.

A razor-sharp sense of comedy is imperative in producing The Barber of Seville, and Opera San Jose sees it through with tremendous success. Using everything from sight gags and running jokes, to emphatic repetition, The Barber of Seville’s inherent silliness and levity is solidified. Given a little room, everyone in the opera—rightfully—gets a little goofy. But simultaneously, everyone in The Barber of Seville, from lead to bit player—when given the chance—shines to great effect. —Tad Malone

If the aliens came, how could we talk to them? Amy Adams plays linguist Dr. Louise Banks. She’s sought out by the U.S. government when a dozen spacecraft show up around our planet.

The few admitted inside the craft see aliens through a glass, darkly: tentacled “heptapods” gesticulating in a murky gray gas. They’re faceless squid-like creatures communicate with inky circular clouds, which resemble the spattery drawings of a sumi brush. Director Denis Villeneuve keeps brandishing the ticking clock by having representatives of the Army (Forrest Whitaker) and the CIA (Michael Stuhlbarg) insist that the solution must be found quickly. Physicist Jeremy Renner is the male version of the female love interest, there to pick Louise up when she collapses. Arrival is a cold movie, with wintry landscapes and plenty of loss. Louise seems to be more of a Nicole Kidman role, but Adams impresses. The final punchline explains why the film is suffused with mist and sorrow. Smart as it is, Arrival is not a movie you’d want to see after a bad night or a heavy meal—as closing your eyes to consider its depth might send you to sleep. (Valleywide) (RvB)

A sometimes bizarre, sometimes winning film about multi-hyphenate billionaire Howard Hughes (Warren Beatty). It’s set in 1959 and 1964— during his last days of lucidity, before his eccentricities were turning to mania, and before his mania turned to out and out senility. The film sets the L.A. basin, a bastion for old-time religion, against the amorality and temptations of the movie business. Frank (Alden Ehrenreich), a good, church-going Methodist driver in Hughes’ employ has, as his new passenger, a beauty queen from Virginia named Marla Mabrey (Lily Collins, the film’s standout). While Marla is a self-respecting Baptist, she harbors a hidden desire to go a little wild. The aged, reclusive Hughes acts as a kind of bad fairy to complicate things between the religious couple. When a person makes a movie about the early 1960s, it’s an advantage if he was really there, and Beatty was: the scenery and the dialogue are almost anachronism free.

SPELLBINDING J.K. Rowling’s pre-Hogwarts adventure is positively enchanting.

Wizardly World J.K. ROWLING’s ingenuity, now free of old Hogwarts, gets a real workout in Fantastic Beasts and Where to Find Them. Credited as scriptwriter and co-producer, Rowling has a fresh backdrop, the New York of 1926. She and director Peter Yates, a longtime vet of the Harry Potter film series, charm us with the critters, but really hook us with the characters. This warmly cast comedy has a switched-suitcase plot, mixing a British amateur crypto-zoologist, a busted-down former police officer for the world of magic, the portly baker Kowalski (Dan Fogler, excellent in a dapper stout-man part, neither slobby nor mawkish), and a ravishing if ditzy mind-reader.

The battered leather suitcase belongs to Hogwarts dropout Newt Scamander (Eddie Redmayne) and is far bigger on the inside, which makes it ideal for stuffing full of mythological beasts. On a visit to the city, one of Newt’s menagerie escapes—an endearingly mischievous flying echidna that loves to stuff treasure into its pouch.

When trying to retrieve the thieving monotreme from a bank’s vault, Newt’s case gets accidentally picked up by the baker Kowalski.

Aggravated mystical copper Porpentina Goldstein (the pretty, sad-faced Katherine Waterston) hauls Newt into custody, delaying the rescue. Even with the New York wizards trying their best to keep

secrecy, some civilians suspect witchcraft.

Samantha Morton is an Aimee Semple McPherson-type street preacher who carries a banner emblazoned with a pair of large hands snapping a magic wand. Enter Fantastic Beasts Miss Goldstein’s and Where to glamorous telepathic Find Them sister Queenie (Alison “Fine Frenzy” Sudol); PG-13; 133 Min. she thinks Kowalski is on Valleywide the cute side, even if his mind is going to need to be “obliviated” once their adventure is over. Is it a coincidence that “Queenie” was the name of a middle-aged witch in everyone’s favorite muggle/magus romance Bell Book and Candle?

You’ll want to see Philippe Rousselot’s photography on an IMAX screen if possible, to take in the terrifically detailed NYC landscapes, with their pomp and squalor.

Colin Farrell is magically evil as a snappily dressed enforcer who is secretly preying on a poor half-wit (Ezra Miller); Ron Perlman is a speakeasy proprietor who looks like a demon version of H. L. Mencken. The effects are dazzling, but you may need an obliviation spell to forget having seen similar ones in Doctor Strange—the buildings that repair themselves, or the apple that eats itself while floating in the air.—Richard von Busack

Dreaming Big CONCEPTUAL ART Dream Theater’s ‘The Astonishing’ is a 34-track, two-act concept album about a dystopian feudal future.

Dream Theater take their heavy prog to next level on ‘The Astonishing’

OR MORE THAN three decades now, Dream Theater has been exploring and charting new territory in the realms of progressive rock and metal, continually redefining both themselves and the musical genres they have long championed.

With the release of their latest record, The Astonishing, earlier this

year, the band has further cemented their reputation for breaking new ground and pushing the boundaries of rock, incorporating a vast array of elements into the 34-track concept album.

According to a press release for the album, The Astonishing “paints a tale of a retro-futurist post-apocalyptic dystopia, ruled by medieval style feudalism. It’s a place aching for a Chosen One to rise above the noise and defeat an empire defined by the endless drone of noise machines and the illusion of safety in bland musical conformity.”

Sound familiar?

The group will be performing The Astonishing, live and in its entirety, when they play at the City National Civic on Nov. 20. The show—by all accounts a massive undertaking—will incorporate an immersive visual show to complement the music and narrative arc of the album, which is set in a post-apocalyptic world.

The brainchild of founding member and guitarist John Petrucci, the themes underpinning Dream Theater’s 13th studio effort did not come in an instant of inspired reverie.

In fact, Petrucci had been working on The Astonishing for a couple of years before he brought it to his band.

“When he came to us at the end of the last world tour with the story, I read it and was immediately inspired and felt a rush of musical ideas to contribute,” says Jordan Rudess, DT’s keyboardist since 1999. “It was the

most intense writing project that we've done together yet. At times it was almost more like writing music for a film score or a musical— supporting the story and developing themes for the different characters, there's a lot of recurring motifs.”

Once the writing process was complete, the band enlisted the skills of David Campbell, an arranger, composer and conductor, who has worked with the likes of Aerosmith, Michael Jackson, Adele, Beck and many more.

“David did a beautiful job of taking what John and I put together in the studio and bringing it to a real orchestra and real choir and getting these great soloists to come in and add a magic touch to it,” Rudess says.

“It was a lot of work on every level, it was the biggest Dream Theater project I've ever been involved in, and it continues on the road.”

In bringing the album to the stage, Dream Theater wanted to make it a larger-than-life experience for fans—hiring a specialized production company to add visual components to the mix. As Rudess explains, the type of venues that were booked for this tour were also chosen specifically for their acoustic properties and intimate settings.

“We wanted people to be seated,” Rudess explains. “There’s a lot to watch on the screen, so we thought this would be the best way to enjoy this record, which is more dynamic. It has more soft points on it than most Dream Theater albums—but that's not to say it isn't heavy as well.”

The veteran musician promises that the concert experience, which will be performed in two acts, is one that fans new and old will come away from thoroughly satisfied. “It’s an emotional, dynamic musical ride.”

The Astonishing follows Dream Theater’s 2013 self-titled LP, which garnered them a second Grammy nomination and landed at the top of Billboard’s “Hard Rock Albums” chart, and even peaked at No. 7 on the “Billboard 200” rankings.

The Ugly Truth AN OPENLY misogynistic, KKK-endorsed serial abuser and circulator of anti-Semitic imagery is now president-elect. Peter Thiel, a Lex Luthoresque Bay Area billionaire who waged a unilateral war on the First Amendment, tried to dissuade youth from attending college, and is planning on infusing himself with the blood of adolescents so that he can live forever—for real, look it up—has been tapped as part of the transition team.

Welcome to dystopia.

If this has you angry, you can at least take some solace in the fact that Fea is coming to The Ritz. If you don’t recognize that name, you should. The fiercely feminist, queer Latina punk band from San Antonio, Texas, is about as much the antithesis of Donald Trump as possible.

As with every person I’ve spoken to since election night, I offered my condolences to Phanie Diaz, the band’s drummer, when I reached out to her recently.

“It’s gonna be a fight,” says Diaz, who formed Fea with her Girl in a Coma bandmate, Jenn Alva.

Donald Trump, that Lovecraftian fever dream of a presidential candidate, has bolstered his political career by making people like the members of Fea invisible, villainizing them, or promising to simply kick them out of the country.

As the saying goes, history repeats itself. Many of the injustices Fea sing about in 2016, have been covered before—by The Bags, a late-’70s Los Angeles chicana punk band, for instance. It’s fitting, then, that Alice Bag (the singer of The Bags) produced Fea’s self-titled record.

Many are predicting that a lot of great music is coming in the wake of this election. On the one hand, that is probably true, and Fea are living, breathing examples. But on the other, that logic is a way of quietly telling musicians that they don’t matter until a moment of utter cultural vulnerability. But that doesn’t seem to bother Diaz.

“Keep spreading the word of love and understanding and stick together,” she says, before uttering an alarmingly concise summation of both the history of fascism, as well as our country’s current moment: “One man cannot define us.” —Mike Huguenor

This will sound crazy, but…should I tell my girlfriend, the love of my life, that I was abducted by aliens? It happened a long time ago, and I have no proof—just my own recollection. Yes, it could’ve been a dream, but even so, it changed how I see things and opened me up to new possibilities. My girlfriend is a schoolteacher and probably wouldn't believe me. Whether she'd still stay with me, I don't know.

I want to be completely honest with her. Is that crazy?—UFO-napped Strange how nobody ever manages to shoot video when there’s an alien spaceship in the vicinity—perhaps because they’re too busy recording that guy, two traffic lanes over, who’s picking his nose.

Like you, science historian and Skeptic magazine founder Michael Shermer felt like he had a little meet-’n’-greet with some outer space dudes. However, he realized that his supposed abduction was just the effects of “sleep deprivation and physical exhaustion” because he had just cycled 83 straight hours in a bikeathlon. This—mixed with a “distant memory” of a TV episode about aliens taking over Earth—made for what Shermer calls “nothing more than a bizarre hallucination.”

Shermer notes that UFOs and alien abductions are: “1. unaccepted by most people in astronomy, exobiology” and SETI (the search for extraterrestrial intelligence); 2. extremely unlikely (although not logically impossible); and 3. … largely based on anecdotal and uncorroborated evidence.”

However, Shermer explains, “the human capacity for self-delusion is boundless, and the effects of belief are overpowering,” leading many people to swear that they actually did go on a ride with the little green men. As “evidence,” they’ll tell you they have really vivid “memories” of, say, the aliens bickering: “Just put him in the trunk of your flying saucer. Nah, got all my intergalactic soccer gear in there.

You take him!”

But such “memories” are probably due to what memory researcher Elizabeth Loftus and her colleagues call “imagination inflation.” This describes how repeatedly imagining an experience can, over time, lead us to forget that the particular event came out of our imagination or a dream.

For example, Loftus and her colleagues told research participants that a dream they’d revealed to the researchers probably meant that they’d had an upsetting experience before the age of 3, “like being bullied by an older child.” The participants insisted that

they didn’t recall anything like that. Yet, about two weeks later, many reported experiencing the bullying they were simply told about—even offering details on how they were supposedly oppressed by some other 3-year-old.

This makes sense, considering cognitive psychologist Robert Bjork’s finding that “using one’s memory shapes memory,” meaning that the more we recall something the bigger and stronger it grows in our memory. Also, in recalling some event—for ourselves or others—we have a tendency to “decorate,” adding details that can easily get merged into the particular “memory.”

Also consider “cognitive dissonance,” the discomfort from simultaneously holding two opposing beliefs, like thinking that your worldview was transformed by UFOs while also thinking that it’s stupid to believe in UFOs. We tend to smooth out the clash by going with whichever belief works best for our ego. So, in your case, to continue believing that you’re intelligent and also not cockadoody in the head, you tell yourself that your memory of your special vacay with the 00100010111 family has to be real.

As for what to tell your girlfriend, what counts is that you had these insights—not the sense that a space alien opened your skull up with some high-tech can opener and dumped them in. If you mention the alien thing at all, explain it in light of the science on how our memory likes to dabble in fiction writing.

While you’re at it, give yourself credit for your insights. It may help to understand our brain’s “default mode” processing. Our mind doesn’t just turn off when we take a break from directed, focused thinking (like reading, studying, or pondering something).

Wider neural networks take over and do subconscious background processing—gnawing on ideas and problems we’ve been working on. This can make insights seem like they came out of nowhere. But chances are, yours are a product of your mind and your real-life experience.

Artist-partners document road trip that actually qualifies as epic

WO ARTISTS AND partners just spent the last seven months traveling around the country to collect material for a documentary about artists engaging themselves in sociopolitical-communal action.

They’ve already operated in a nomadic fashion for years, but this time around, Thollem McDonas and Angela Villa traveled to all 48 contiguous states, performing along the way, and gathering source footage for a related live show debuting at WORKS/San Jose this Saturday.

Waldorf Blofeld synthesizer and Villa’s digital video talents, Silver Ochre takes its name from a harmonization of opposites. The ochre pigment used in paleolithic cave paintings meets the silver screen. Old meets new.

Intimacy meets distance. Combining the present-time awareness of zen perspectives with the technology of digital synthesis and video, the performance will likewise reconcile the polarities of the human condition.

As the the two artists explain, Silver Ochre trains the eye on small moments of time and the ear to the moment of the times.

Together, both Villa and Thollem are peripatetic artists, with Villa working as an artist manager, promoter and photo-videographer to Thollem’s keyboard exploits. What’s more, they bring a bloodline of social,

ethnic and arts advocacy, as well as avant-garde San Jose shenanigans.

Angela’s father, Jose Villa, was a legendary Chicano activist decades ago in San Jose. He chaired the Mexican American Studies Department at San Jose State University, was director of urban education at San Jose Unified School District, and he even headed up MACSA (The Mexican American Community Services Agency) for six years. Jose also claimed as his mentor the late Ernesto Galarza, a pioneer of bilingual education and the individual for whom the “Man of Fire” table sculpture on Paseo de San Antonio was created.

McDonas was born and raised in San Jose, rigorously studying the standard classical piano repertoire, composing and improvising from a young age before graduating from music school at SJSU. Now, as leader or co-conspirator, he has released more than 50 albums on 20 different vanguard labels just in the last 10 years, playing every possible sub-genre of post-classical, free jazz, noise, punk, world music, dance, film

and more. A brief cross section of his many collaborators include William Parker, Pauline Oliveros, Stefano Scodanibbio, Nels Cline, Mike Watt, Martha Colburn and Matthew Barney.

He is equally at home on concert hall stages or in underground Italian WWII bunkers. He first performed at WORKS over 25 years ago.

For Silver Ochre, expect a collaboration combining the talents of both artists, each one being naturally interested in fusing polarities. For most of his life, Thollem was an acoustic pianist, but a few years ago he pulled a Dylan and went electric. After pushing the boundaries of multiple electronic keyboards in various composer/ performer schisms, this time around, for Silver Ochre, he’s turned his sights on the Blofeld, a piece of machinery normally dominated by German ambient and techno musicians. Instead, Thollem is more interested in using machines in ways they were not intended to be used.

“Every time I have a new instrument, I develop ideas based on its potentiality, as opposed to me buying an instrument based on a vision that I have,” Thollem says. “I see it as a real collaboration with the technology. I’m not approaching an instrument with a specific goal in mind.

I’m approaching it with the idea of creating something that I would never have conceived otherwise, if I didn’t have this instrument.”

For the video component, Villa will transform her present-time awareness, zen-like in its simplicity, to suggest beauty beneath the mundane. Her photographic eye—in which the native and exotic, the distant and the intimate are fused—will unfold in the videographic accompaniment to Thollem’s real-time manipulations of the Blofeld.

“Her work is really based on being in the moment,” Thollem says of Villa’s visual art. “Being really aware of beautiful, amazing things happening in totally mundane situations.”

Together, the masculine and feminine polarities of life will fuse.

Yin shall weave with yang and the natural opposing forces of the human condition will integrate. And that is beautiful. And amazing.

OS GATOS HAS a new brewpub that aims to satiate the South Bay’s appetite for booze and bites. While there is no shortage of establishments offering craft beers and food, few are actual breweries. Loma Brewing Company is one of these few, with silos on-site at their expansive downtown location.

One section of the brewpub is, of course, a brewery, while another is a bar with two televisions playing sports. The third section is a quieter dining area with booths. The place is owned by the Youkilis brothers—Scott is a former chef and Kevin is a former Major League Baseball player best known from his time with the Boston Red Sox. With this combination, it’s safe to expect lots of good food and sports at Loma Brewing.

The daily happy hour runs from 3-6pm, with $5 Loma beers and $8 cocktails and snacks. Serving standard yet elevated bar food like nachos and chicken wings, dishes mostly come in small plates meant for sharing. Many items are house-made like the chips and dip ($8), featuring a gooey French onion dip. The flatbreads are decently sized and the smoked trout version with arugula, apple, radish, and crème fraiche ($15) are worth a try.

For seafood options, we went with the Ceviche Tostada ($13) with shrimp and salsa rojo. While the flavors were not as bold as expected of a ceviche, the shrimp was still satisfying with the avocado puree. The Mussels and Clams ($14) were the highlight of the meal. The flavorful spicy tomato broth paired well with crusty and buttery garlic bread.

For newcomers, the beer flight ($21) is a good way to try all seven of Loma’s original beers: Kolsch German ale, Berliner Weisse wheat beer, Oktoberfest German lager, Pale Ale American style, IPA American style, Irish Dry Stout and Oatmeal Stout. A variety of guest beers are also available on tap as well as wines, cocktails and ciders. A refreshing glass of Finnriver Pear Cider ($8) has fruity and acidic notes reminiscent of a Wyder's.

The open space and plentiful seating makes Loma Brewing a great place to socialize. The atmosphere is casual and inviting, which is fitting as beer should not be bourgeois. As expected for the Los Gatos area, the prices are on the higher side for both food and drinks. Loma offers brunch and afternoon meal times in addition to the standard lunch, dinner and happy hour. There are also late-night specials on Friday and Saturday until midnight. —Ngoc Ngo

AST CASUAL GASTROPUBS” will not yield much in the way of search results. Even Google hasn’t caught-up with the ingenious mind of Louis Silva, of Naglee Park Garage fame. Silva and his partner, Long Nguyen, envisioned their newest restaurant endeavor, Park Station Hashery, as “a different kind of eatery for everyday life.”

The menu runs the gamut from traditional American fare (e.g. burgers and ribs) to colorful foreign cuisine (e.g. Piri Piri and Portuguese salt cod). Not only can they take care of one’s nutritional needs, but libations are also a specialty. With craft beers on tap, wine and a full coffee bar, this place definitely keeps people hydrated.

The first thing to catch the eye is the magnificent Rose Garden-inspired mural on the east side of the building, created by local artists Ben Henderson and Lacey Bryant. It really helps Park Station stand out, which is tough considering that they’re kitty-corner from the Rosicrucian Museum. The interior is simple but elegant, with long wooden tables that can be used for communal dining. There’s also an open patio to dine alfresco. Individual tables are available for a more private rendezvous.

We gave the weekend brunch menu a sample. Park Station qualifies as fast casual, as orders are made at the counter. We ordered the Corned Beef & Hash ($13.95), Our French Toast ($11.95) and—to quench our thirst— the Rose Park Mimosa ($8) and El Chapo ($5.50) a spicy cayenne mocha.

The counter and ensuing table service was efficient and very friendly.

The corned beef & hash comes with two poached eggs with hollandaise sauce. The eggs provided plenty of delicious, rich yolk to smother the almost excellent house-made corned beef. The dish was beefy, bold and had a nice combination of spices that didn’t give me tongue fatigue as corned beef can.

Their french toast is made with vanilla bread pudding and topped with whipped cream, maple syrup and toasted pecans. The bread pudding itself was soft and tender, but the flavor was one note. The crunchy pecans helped to liven things up, but it needs maybe a whiskey sauce or some cinnamon to flesh it out. On the positive side, I appreciated that it wasn’t ridiculously sweet.

As for the drinks, I thought the mimosa had a good balance, but my wife felt like it could’ve been a little boozier. The El Chapo had a nice mix of spice and a deep chocolate flavor, but maybe could’ve used a bit more of coffee to give it more kick. With an inventive menu, bold ownership and a hungry clientele, Park Station Hashery is an exciting new addition to the Rose Garden dining scene. —John Dyke PARK STATION HASHERY 1701 Park Ave, San Jose. 408.320.1711
