Lobby Hobby Santa Clara enacted a new lobbyist ordinance earlier this year, and the first suspected violation has created what appear to be additional conflicts of interest.

PATRICIA MAHAN, a former mayor and councilwoman, violated the city’s ordinance by failing to register as a lobbyist, according to a report by outside investigator JOAN BORGER. But thanks to some vague fine print, Mahan—once again running for a seat on the City Council—isn’t expected to get in any trouble, because she says she didn’t know she was acting like a lobbyist.

Mahan argues that billboard company AllVision hired her to work as an attorney, which would make her exempt from the new rules. However, rather than being a simple paper-pusher, she began scheduling meetings with most of the council members and Mayor LISA GILLMOR to discuss a two-sided digital billboard off of Highway 101. Borger’s report notes that Mahan often “discussed the potential benefits of the proposal for the city,” which sure sounds like lobbying. Councilwoman DEBI DAVIS told Fly that she thought Mahan “absolutely” was a lobbyist. But according to Borger’s report, “enforcement of the ordinance requires a ‘knowing’ violation of the ordinance,” and Mahan They thought she was exempt Did because she was hired as What? an attorney—nevermind SEND TIPS TO the fact that she is an FLY@ estate planning attorney.

After a complaint on Mahan’s lobbyist activity came in Nosky recused himself from the investigation because he had previously given Mahan an unspoken go-ahead to continue her meetings. Nosky then hired Borger, but Davis tells Fly that Nosky admitted Borger “is a friend of mine” from her time working for the city of Sunnyvale, in addition to saying he thought Mahan did nothing wrong. In an email exchange Tuesday, Nosky confirmed that he also had multiple conversations with Mahan about the investigation.

Study from Great Recession shows rebranding artists isn’t the issue

N 2008, the city of San Jose launched a project that sought to alter the very language by which we think of art and creativity. No longer would the city bestow its creatives with that hallowed term of “artists,” used for centuries to describe everyone from sculptors and painters, musicians and writers.

“For us, artists are essentially small business owners,” says Kerry HapnerAdams, director of San Jose’s Office of Cultural Affairs.

The “Creative Entrepreneur Project”

(or CEP) was launched as a joint effort between the Center for Cultural Innovation (CCI) and the Office of Cultural Affairs. It also involved “key individuals from…high tech enterprises” as part of its steering committee. “[The report] is framed in a way that it’s really aimed to empower artists, to be the stewards of their own future,” Hapner-Adams says.

“It’s a way of really looking at them and recognizing that they are an important part of this economy.”

“The term is deliberate,” says CCI’s current CEO, Angie Kim. “That department very deliberately decided that they wanted to respond to the kinds of artists who were already living and working in San Jose, and to say [to the tech industry] that they mattered economically as well as culturally.”

But looking at the figures

presented in the report, the economic hardship local artists—er, creative entrepreneurs—face is striking.

The study found that 85 percent of San Jose artists do not earn a living on their work. It also found “a startling” two-thirds pay “more than 30 percent of their income in total mortgage or rental costs.”

Nearly half of the 642 artists surveyed in 2008 said that housing in San Jose was unaffordable. Average rent has increased by a dizzying 85 percent since then, so it’s almost impossible to say San Jose’s artists are better off today than they were eight years ago.

Part of the 2008 project involved a 10-week seminar on marketing artistic skills in an increasingly competitive market, largely driven by million- and billion-dollar interests. Four artists who attended the city’s Business of Art seminar are profiled in the report: digital artist Howard Partridge, writer Tess Crescini, filmmaker Tricia CreasonValencia and dancer Lidia Doniz.

and the only artist profiled in the report able to support herself on her art—has observed a serious disconnect between the economically dominant tech industry and the area’s artists. “I have zero relations to tech companies,” she says. “Nothing. Absolutely nothing.

You would think that would be a naturally fruitful collaboration.”

Indeed, that was part of the gambit that was made by the city—that changing the language of the city from “artist” to “entrepreneur” would help entice the free-market obsessed, multibillion dollar tech industry to take greater interest in their local artists.

But the results speak for themselves.

“Either as a professional artist, or as a board member of a non-profit that is in the arts community, I really haven’t seen that happening with the tech companies at all,” says CreasonValencia. “I find that very frustrating.

I don’t understand why there’s not more integration and support from multimillion dollar tech companies and the arts community. I don’t get it. I don’t understand the lack of involvement.”

It’s certainly not due to a corresponding lack of funds. As of 2016, Apple, which is preparing to build a new campus in North San Jose, has more than $214 billion stashed away offshore, according to Business Insider. The city may have seen the change in language as a form of empowering artists to compete creatively, but if the businesses the city tries to attract aren’t buying, it leaves San Jose’s artists holding an empty bag.

“There’s this expectation that somehow I’m magically supposed to be able to monetize my work when there’s a fundamental problem, which is that I cannot get people to value the work enough to think that they should pay for it,” says Creason-Valencia. “Always, always, always for me the work is woefully undervalued financially.”

According to Entrepreneur.com, in 2008—the same year that San Jose decided to regard its artists as fledgling businesses—more small businesses closed than were opened: 552,600 new companies opened for business in 2009, while 660,900 businesses closed, the report states.

“There is so much money being made off the new developments,” says Lidia Doniz, before asking the question on the tip of the tongue of every one of San Jose’s artists. “If we’re pushing all the artists out, what kind of city are you going to have?”

“never really materialized into a career.”

He chalks this up in part to the timing of the seminar within the global financial crisis, but he also points to a simple dilemma that many artists struggle with: “It was costly to change careers,” says Partridge, whose name shows up another place in the report—as part of a group noted as success stories.

“Empowered by the course teachings, a number of artists from the CEP Business of Art continued to meet and have formed an ongoing coalition of Silicon Valley artists,” the report states. “The group developed a website, www.svartists.org, which features each of their work and posts upcoming events developed by the group.”

Today, the site is no longer operational. Partridge says that the founder moved to New York state to pursue her art in a more affordable climate.

“If you want to start a business, you have to have capital,” says Doniz, a dancer. “I can have a business plan, but if I don’t have capital, if I don’t have the space…”

In an area like San Jose, it can be extremely difficult for artists to generate enough income to ever become a viable business in the first place. Doniz says she works two jobs just to continue dancing.

Her most successful work as a dancer has forced her to leave the state entirely, including one job she had in New York.

Doniz plans to return to that job when her son goes to college, which is actually covered in her living expenses.

“That gig worked,” she says. “But it’s sad, because I love San Jose. I love the Bay Area. But it’s not doable for artists.”

Tess Crescini, the lone writer profiled, has since gone on to make virtually no income from her art, despite an impressive and growing list of publications to her name. “I hate to say it, but not really,” Crescini says, when asked if the seminar was helpful to her career. “I think I got paid $50 when I read my poetry for Filipino Heritage Month in San Francisco.” Half of that went to gas, the other half to parking.

Crescini has done readings with the Vagina Monologues and numerous Filipina cultural groups, and she even had a TV show in San Jose about surviving abuse. Even with all these accomplishments, she no longer believes that she can “make it” as a writer here.

“I pretty much gave up on my writing as a means to make a living,” Crescini says. “It’s sad, but I teach, and I really, really push for them to write.”

Cabela’s Wholesale, Inc., San Francisco County Superior Court Case No. CGC-14-537095. The lawsuit claims that Cabela’s Wholesale, Inc. recorded telephone calls of persons calling its toll free customer-service lines without telling callers that the calls may be recorded, allegedly in violation of California law. VETTE VARGAS, a presenter at C2SV, once worked in the field of digital production, at BAD OMEN Evette Vargas’ Dark Prophet project has one of the many houses creating received praise for its breaking digital effects for blockbusters. of barriers.

After NYU film school, the Bronxborn, LA-based CEO of Digital Reign worked at creating online content to support Lord of the Rings and The Fast and the Furious, before attending grad school at UCLA to get an MFA in television writing. The schematics of TV and movie writing are so different that they’re now taught in different branches of the same grad program.

Her web series Dark Prophet is what used to be called “new media” and is now described as “transmedia.” One has a feeling it’ll be called “post-cinema” someday, since the idea of a story scattered in all directions—between comics, web episodes, music, games and VR—seems likely to become the future of moving images.

It’s becoming harder for a movie audience to relate to a story without hypertext. The audience for games dwarves the audience for cinema—and if gamers are often underwhelmed by the quality of cinematic adaptations of video games, it’s likely because there’s no way for them to interact with the films. No way at present, that is. No wonder Vargas, so deep in the technology that is creating this post-cinematic world, was called “an artist to watch” by the New York Times.

This flowering of cinema into a multi-sided puzzle has been tried before—it may be that Richard Kelly of Southland Tales (2006) got in too early, trying to create a story of a deeply involved apocalyptic future with the help of a few issues of a comic book he wrote. But Vargas’ Dark Prophet is a success in all of its platforms.

Math student, musical genius and unwilling chrononaut Dai Shepard (star and co-producer Chase Fein) has become unstuck in time. He has warning visions of a pre-emptive apocalypse planned by the U.S. government’s ultra-secret Black Box agency. Studying different songs, he retrieves digital codes, hidden messages about the trouble to come.

Dai’s abilities are discovered by one General Luther (Henry Rollins, formerly of Black Flag) who kills Dai’s girlfriend and pins the murder on him. This sends our hero underground—the story is carried out in mini web episodes on YouTube, as well as in the pages of a comic book distributed by Keyframe Entertainment. And there’s room for a spread into other mediums as well.

JESSICA CUSICK Jessica Cusick is president of Cusick Consulting, which was established in 1999 and specializes in cultural policy, planning and community development through the arts. She was the cultural affairs manager for the city of Santa Monica from 2005 to 2015, where she oversaw a significant expansion of support for artists and the creative sector. In 2014, she was awarded L’Ordre des Arts et des Lettres, one of France's most illustrious titles, for her distinguished career in the arts.

TEO CASTELLANOS Teo Castellanos is an actor, writer and director who works in theater, film and television. His award winning one-man show NE 2nd Avenue toured extensively for a decade and won the Fringe First Award at the Edinburgh Fringe Festival in 2003. That same year he founded the dance and theater company Teo Castellanos D-Projects, which toured works nationally and internationally for 12 years. He is the recipient of several awards and grants, including the State of Florida Individual Artist Fellowship in 2005 and 2013.

MOY ENG Moy Eng brings more three decades of experience in the philanthropic sector as a grantmaker, consultant and senior manager in areas as diverse as arts, education, renewable energy, lesbian and gay rights, immigrant rights and international human rights. Known for her visionary ability to identify and support progressive ideas, she has worked as

a grantmaker in numerous foundations with assets ranging from $100 million to $7 billion. She currently serves on the board of the Stanford Jazz Workshop. She is a singer, lyricist and the mother of two singular young women.

AYODELE NZINGA Ayodele Nzinga is a California artist who, in the tradition of the Black Arts Continuum, uses performance as a method of inter-intra group communication. She is the artistic director of the original Recovery Theater, whose cult classic, Marvin X’s One Day in the Life, is the longest running African American theater production in North America. She is also the producing director of Oakland’s The Lower Bottom Playaz, Inc., which is the only theatrical group to stage a complete production of August Wilson’s magnum opus, American Century Cycle. The project was begun in 2010 and completed in 2015.

STEVEN H. OLIVER Steven H. Oliver is president of the award-winning construction and development firm Oliver & Company, based in Richmond, California, which has built more than 1,000 buildings in the Bay Area, including the California College of the Arts in Oakland, Berkeley Repertory Theatre and the Charles M. Schulz Museum in Santa Rosa. A well known arts philanthropist, advocate, and civic leader in the Bay Area, he is the former chairman of the Board of the San Francisco Museum of Modern Art. He currently serves as chairman of the board for the United States Artists.

THE ELEPHANT IN THE VALLEY: GENDER BIAS IN THE TECHNOLOGY INDUSTRY Gender bias has become one of technology industry’s thorniest and most discussed issues, and the landmark “Elephant in the Valley” report provides data documenting workplace challenges for women in the tech industry.

MICHELE MADANSKY Michele Madansky runs a media and market research consultancy specializing in online media and advertising.

Her current clients include BuzzFeed, Twitter, Adara, Chegg and BabyCenter. She is the co-author of Elephant in the Valley, a study of gender bias in Silicon Valley. In the early 1990s, Michele was the first interactive specialist at BBDO (pre-Netscape). She also authored the first Ph.D. dissertation focused on online advertising. From 2003 to 2007, Michele was vice president of Global Market Research for Yahoo. She has also been a lecturer at Haas Graduate School of Business. In her free time, she enjoys being with her husband and teenage boys, playing tennis and billiards.

FRUIT LOOP Raspberry Pi has connected people across the world with its inexpensive computers.

ONSUMERS ARE generally groomed to think that the latest, greatest gadget comes with the most features and highest price. So it seems odd—improbable, even—that a $35 computer with no case and no software has become a runaway hit.

The Raspberry Pi Foundation, which makes the no-frills device, sold its 10 millionth computer last month. Matt Richardson, a self-described product evangelist for the UK-based nonprofit, will talk about the cheap computer phenomenon Thursday for the C2SV technology conference.

Raspberry Pi founder Eben Upton conceived of the stripped-down computer to get more people to learn to code. As a professor at Cambridge University, he saw a decline in the number of students versed in computer programming. While early generations of gaming consoles forced kids to learn to code, new technologies come ready to use.

Raspberry Pi’s cheap computing gives laypeople a tool to learn how to code. Kids and tinkerers have used the credit card-sized device to create new products, including a supercomputer and a lemur-feeding gizmo for researchers at the Oakland zoo.

“By putting cheap, programmable computers in the hands of the right young people, we hoped that we might revive some of the sense of excitement about computer that we had back in the 1980s with our Sinclair Spectrums, BBC Micros and Commodore 64s,” Upton wrote in a blog celebrating the organization’s unexpected commercial success.

The accessibility of Raspberry Pi’s products has fueled a movement of inventing new devices for less money, many of which end up on crowdfunding platforms like IndieGogo.

“Our mission is to get digital making in the hands of everybody in the world,” Richardson recently told a newspaper in the Midwest. “If you have students interested in making music or digital arts, we want to make sure they know digital making is available for that, too. Whatever our passion is, the computer is a tool.”

Last month, the company launched a $131 Raspberry Pi starter kit, which comes with the newest computer card, an optical mouse and a guidebook. As a nonprofit, the foundation directs all sales proceeds to educational outreach programs and engineering initiatives. — Jennifer Wadsworth

Why else would he use poisonous and even radioactive paints—almost exclusively—for the works in his first solo show? Using antiquated and dangerous paint-making methods, like hand-mixing egg tempera with arsenic and lead, Porwol puts his life on the line for his art. “If Looks Could Kill” is a series of beautiful, seductive, and even deadly female portraits.

There’s no need to fear, however.

The work of David Imlay is ideal for this season, as the days grow shorter and the world is enveloped in fuzzy hues of brown and orange. Most of Imlay’s work is focused on mundane and banal scenes—of Eichler homes in Palo Alto or Volkswagon minibuses parked at the beach—all of them glimpsed through a foggy, yet photorealistic, filter. The resulting images feel as if they were drawn from half-remembered dreams, and as such are imbued with a weight and significance that only dreams can have. A

S A SCULPTOR, Bruce Beasley never fails to surprise. Over the course of his five decade career, he has continually sought out new materials and techniques. An exhibition of new Beasley works, now open at Santa Clara University’s de Saisset Museum, finds the East Bay artist exploring the brave new world of computer-aided design and 3-D printing.

“Bruce Beasley Recent Work:

Coriolis and Torqueri,” presents two series of sculptures—“Coriolis” and “Torqueri”—for the first time in an American museum.

The exhibition came about thanks to the late Paula Kirkeby, owner of Smith Andersen Graphics in Palo Alto. While visiting Beasley’s studio with Kirkeby, de Saisset director Rebecca Schapp learned of Beasley’s new work, which was then on display at the Museum of Contemporary Art in Beijing. Though Beasley has exhibited at the de Saisset before—on four separate occasions— Schapp says she couldn’t pass up the opportunity to show the Oaklandbased artist’s new work.

The 12 ivory-colored pieces in the Coriolis series were fabricated from resinous material known as

acrylonitrile butadiene styrene, or ABS. Using computer models, these lovely, sensuous sculptures were created using a large-format 3-D printer. According to Schapp, it took four days to print each of the four sections in each sculpture.

A close look at the twisting, curving noodle-like shapes reveals the seams where the individual parts of each sculpture were joined.

In Coriolis XVII (2013), the ribbon of material seems to weave about itself— twisting and turning every which way before reaching an apex. A sense of movement is palpable, and the viewer is left in awe at the thought that a solid material could form such a sinuous shape. But don’t get too caught up in the material or process, Shapp says.

“Bruce really doesn’t want the emphasis to be on the 3-D modeling and printing,” she says. “Those things are just tools to get to a specific form and shape, which are the most important aspects of his work.”

In the exhibition catalog, Beasley

explains that forms in nature are always a source of inspiration, but when it comes to creating a piece, he returns again and again to abstraction.

“Part of what I love about abstraction is that I am free from the constraints imposed by realism and context,” he says. “Abstraction allows me to tap into a much richer vocabulary of shape than realism permits.”

The works in the “Torqueri” series— which takes its name from the Latin word for twisting or bending—are fashioned from bronze and stainless steel. These metallic ribbons twirl, turn, loop and wrap around each other. In Torqueri IV (2015), they actually form a knot. Thanks to dramatic gallery lighting, the pieces exude a warm, golden glow and seem lighter than air. Shapp advises viewers not to take a static approach when examining each of the six sculptures.

“These pieces demand that you walk completely around them, in order to see how they change from various different perspectives,” she says.

In addition to being a tour de force of shape and form, the sculptures in both series play with all the possibilities of texture. Some of the surfaces have been rendered as smooth as glass (Torqueri II); others (Torgueri V) have a variegated finish that captures and reflects light.

While these works would not have been possible using traditional carving or casting techniques, they represent just another step in Beasley’s quest to find new methods of expression. “Remember that being an artist is a journey without a destination,” he says. “It is an exploration of yourself.”

In addition to the exhibition in the museum galleries, Beasley will be represented in the university’s public art program with Rondo I (2013)—a stainless steel sculpture acquired as a partial gift from the artist—that will be installed just outside the museum.

Beasley will discuss his work in conversation with Dr. Hilarie Faberman on Thursday, Oct. 13, from 7pm-8:30pm. The event is free and open to the public.

A Hometown Lost GIVEN ITS IDENTITY as the “Capital of Silicon Valley,” it’s little wonder that San Jose is betting big on the future. The city’s general plan for 20112020 proudly touts the tagline, “Focus on the Future.” But what does this mean for San Jose’s past? If city officials and planners are all focused on the next big thing coming around the bend, is there still room for history?

These are the kinds of questions that loom large in the photography of Josh Marcotte. Many may already be familiar with his work through his Instagram account, “Lost San Jose,” but a new photo show opening at KALEID Gallery on Oct. 7 offers a chance to see his work in a more structured and narrative form.

“‘Love is Transitory’ is an exploration of landscapes and the things that I see every day,” Marcotte says of his new exhibit—“those fleeting moments, these things that I see and photograph and then they’re gone.”

Marcotte has become an expert in capturing fleeting moments. For a previous project he spent two years walking Monterey Highway, photographing that stretch of road that runs from San Jose to Gilroy, capturing the changes that took place over that time. “I’m still continuing to go out there every few months and just revisit,” he says. “There are some things that continue to be a constant as I’m out there, but then there is so much that is just gone … within a day.”

In addition to featuring photos of San Jose, “Love is Transitory” traces a diaspora of former San Jose residents, seeing where people end up after housing becomes too expensive here, and what those places look like. Or, in the photographer’s words: “Exploring what becomes home when you leave San Jose.”

There is a melancholic quality to Marcotte’s photography. Two photos in particular speak to his eye for loss and heartbreak. In one, the papered-over windows of the former Babyland store on Bascom Avenue stand out against a cracked-up stretch of sidewalk. In the other, a scratcher ticket is held by two trembling hands, caked in dirt. Both of these images tell the story of earlier focuses on the future, before they became lost to time.

While we are all hopeful for the future, Marcotte’s work, like Walter Benjamin’s, is an excellent reminder that we never really leave the past behind, but carry it with us wherever we go. —Mike Huguenor

Martyr’s Crown CHARGE! Writer, director and actor Nate Parker dives headlong into his much-hyped new film, ‘The Birth of a Nation.’

Buzzed-about ‘Birth of a Nation’ fights the good fight

F

ILMMAKERS WHO serve as director, writer and actor are usually more talented in one aspect of their hyphenate than the others. The Birth of a Nation, by the much-hyped hyphenate Nate Parker, is best in one aspect: Parker has an actorly presence that makes this film immediate and powerful.

It’s the story of Nat Turner’s slave rebellion in the early 1830s, which

terrified the South. When Turner and his band were broken up, about 60 white civilians were dead. Turner grows from a houseboy on the estate that gave him his name. When there’s a reversal of fortune on the plantation, Nat (played in adulthood

by Parker) is sent into the fields to have his hands torn by the sharp cotton thorns. Parker absorbs all this American nightmare with a grin of disbelief masquerading as a forced harmless smile. Parker’s Turner seems to be discovering the world of slavery as we watch—learning all the pitfalls that keep even a well-meaning, gentle slave from peace or safety.

Turner was taught how to read, and what the masters gave him to

read was key to his revolt. These slaveholders, so enamored of the Bible, never considered how their slaves might have understood the more genocidal passages in 1 Samuel.

Turner’s radicalization is balanced by the story of Turner’s master, Samuel Turner (Armie Hammer), who declines through loss, bad luck and drink. Frederick Douglass wrote that slavery poisoned both the slave and the master, and Birth of a Nation excels, like no movie I’ve seen, at illustrating the poison’s double effect.

In the guarded, eventually shattered friendship between Nat and his master, there’s a pang of loss: hurt for Nat’s betrayal and sorrow, as well as a lesser pang for a spineless, solitary white man who could have had a companion instead of a captive.

That’s not to say that the tragedy of slavery fell equally on the whites, and the atrocities are here to prove it—first, in one real horror-story

sequence in a hot-box shed, and the punishment of Turner in the pillory. The movie has more appeal in the subtle reveal of decadence than—as Parker thinks—in the huge manipulative outrages. Worst is the savaging of Turner’s wife by a small group of white men. People can see this unexploitative filmed attack and its tragic aftermath, and decide for themselves what Parker’s feelings are about rape—it’s now well-known that Parker was accused of that crime in college. In the famous William Styron novel, it was Turner’s mother who was raped. Styron has been praised for rescuing a then-obscure rebel from forgotten history, but in both this 2016 movie and the 1968 Pulitzer Prize-winner, a sexual assault gins the rebel up into revolution.

Parker overestimates the length of time it takes to get an audience ready for vengeance. Most moviegoers are as eager to see slaveholders get what’s coming to them as they are to see Nazis paid back.

Turner may have been a revolutionary who grasped a martyr’s crown, or a religious fanatic who saw signs in the heavens and heard the voice of God. Birth of a Nation is so much of a Christian movie that it’s being advertised as enlightening spiritual entertainment. Parker may have oversimplified this rebel, the way Jesus is always oversimplified in a movie. It may not be clear to the people who are most rapt about Birth of a Nation that you could make a movie about an Islamic suicide bomber just like this, with these many provocations and a finale of slow-mo violence.

For its weaknesses, Birth of a Nation is an important corrective, necessary since such serious nonsense is still talked about slavery more than 150 years since it ended. Take, for example, Bill O’Reilly’s opinion that the slaves who built the White House were “well-fed.” The point isn’t that, at some points in history, certain American slaves ate well. The point is that if you own a man, you can feed him as much or as little as you like.

metroactive FILM MISS PEREGRINE’S HOME FOR PECULIAR CHILDREN

Ever since 1989’s Batman, Tim Burton has been called a director more interested in visuals and ambience than plot. Miss Peregrine’s Home for Peculiar Children doesn’t free him of the charge. The young adult novel plot schematics really show through the tremendous invention, enchantment and incomparably strange humor that only Burton can weave. The sources for some of Burton’s ideas are clear—an homage to Czech puppeteer Jan Svankmajer, an invasion by Ray Harryhausen’s skeleton warriors, the paint-daubed Id monster from Forbidden Planet, the pub-smashing scene in The Invisible Man. Yet there’s material that’s all Burton—a time-shifting finale set against a Ghost Train on a Blackpool wharf; Olive (Lauren McCrostie), a fire-starter, brings a row of dead furnaces blazing to life with the stroke of her hand.

Emma uses her own skills to revive a drowned ocean liner, which sank so quickly that the skeletons of the passengers are still sitting calmly at their dinner tables. As for Green, if she’s physically stiff—perhaps corseted—she wears the role of this sorceress with the authority of a superhero wearing a cape.

The fantasy is delirious, even if the blueprint for it is so worn you can practically see daylight through it.

DEEPWATER HORIZON

Before declining into standard uplifting moments of waving flags, prayer and action movie super-feats, Deepwater Horizon is a thrilling procedural about the worst oil rig disaster in history. Director Peter Berg (Lone Survivor) approaches these roughnecks from the opposite angle that Michael Bay would have taken: they’re more soft spoken and less profane than you’d expect. The exploratory well that the floating Deepwater Horizon was trying to tap was nicknamed “the well from hell”—the drilling project was 43 days and $50 million over budget, and British Petroleum is accused here of cutting corners on safety and maintenance. Berg stresses the human price of the disaster; the ecological disaster to come is signaled only by one startling image of an oil-soaked and screaming pelican flying blind and smashing up a control room. Mark Wahlberg is the lead, but far more interesting is one of those classical-versus-

baroque acting duels that makes movies so much fun. Kurt Russell, with an economical haircut and a white-tipped mustache, is Jimmy, the most revered engineer aboard.

He’s the traditional disaster movie archetype—the guy who smells trouble before anyone else. Smiling like a treacherous lion, John Malkovich is Vidrine, the company man, togged out in a sweaty blue Oxford shirt with the BP medallion on it. The Great Malkovich has a bogus but endearing Cajun accent, and the two just play off each other, the stalwart versus the slippery. The home front stuff (groan, Kate Hudson as a self-declared “simple country girl”) adds Hamburger Helper to the dish. Once the disaster starts, it has its share of awe: exploding valves, rupturing pipes, rivets firing like .45 slugs, and computer screens reading “ANNULAR FAILURE” (which sounds like something you wouldn’t want your doctor to diagnose).

Finding the happy human side of this mess, Deepwater Horizon ends with an album of pictures of the real victims and survivors of the doomed platform. You never saw a group of people who looked less like movie stars. To quote a line in the movie, that tactic may not be stupid, but it sure ain’t smart. (Valleywide) (RvB)

DETOUR/THE STRANGE WOMAN

(1945/1946) Sweaty, calf-faced sap Al Roberts (Tom Neal) hitchhikes across the USA to join his beloved in Hollywood, but he gets and gives two fateful rides. First, he’s picked up by a worthless, rich bookie. Second, he gives a ride to a harpy on her last legs: Vera (Ann Savage), a lady who looks like she was “thrown off the crummiest freight train in the world.” She’s a schemer who enjoys cornering people, and in the last half of this impossibly spare drama, she keeps Al a prisoner as she cooks up a big swindle. Director Edgar Ulmer, the prince among

Poverty Row directors, declares war on happy endings: “People knock themselves out trying to buck fate.”

That’s the point of this partnership, in a film that seems to take place completely in the front seat of a convertible. Ulmer’s oft-repeated boast that this film was made in six days isn’t true (it was actually 28); even though this dark miniature masterpiece is public domain, it was released with as much fanfare as the cheap PRC studio could afford.

The heavy, rapid narration is the exception that proves the rule that narration in a movie is a bad idea: all the words spilled here just add more

pressure to the mania, the foretold doom. BILLED WITH The Strange Woman. What can you say about a movie in which George Sanders isn’t the most evil person in the show?

Based on a novel by the author of Leave Her To Heaven, this tells of the exploits of a vicious woman (Hedy Lamarr) in pre-Civil War Maine. The director is again Ulmer, a director of many contrasts—at one point an associate of the same Max Reinhardt who gave Ann Savage her stage name, at others the maker of small budgeted ethnic films for the lowest studios in Hollywood. Revivals DER KONGRESS TANZ/LIEBELEI

(1931/1933) At the 1815 Congress of Vienna, where the great powers gathered to clean up the mess Napoleon made, a glove saleswoman (Lilian Harvey) starts up a little romance with the Czar of All the Russias (Willy Fritsch). We associate UFA, the biggest studio in Germany, with the expressionism that cast shadows of the horror and crime films in America. But in this Weimar Republic comedy, we see them capable of some fluff for a change. BILLED WITH Liebelei.

The title means “affair” or “fling;” it’s by an uncredited Max Ophuls, whose smooth camerawork, sense of beauty in decaying codes, and fascination with romantic games that turn frightfully earnest, makes him a director in need of much more revival. Fortunately, the Stanford Theatre is playing several of this master’s movies this fall, including La Ronde (Oct 29-30) and Lola Montez (Nov 5-6) about the renowned courtesan—and sometime San Franciscan—who literally toppled thrones before ending up as an attraction in a shabby circus. Jethro Tull frontman balances the past, future on new tour

E

NTERING THE FINAL stretch of one of the most divisive presidential election cycles in American history, it can be difficult to conceive of a political point of view beyond the polemic that mainstream cable news has been feeding us for the past year.

But for Ian Anderson, it’s hard to understand exactly how the United States has come to find itself facing the possibility of a Trump White House.

It’s not that Anderson, the founder of progressive rock pioneers Jethro Tull, is a bleeding-heart liberal. He

is a proponent of responsible gun ownership and a fan of some of fairly hawkish figures—like Condoleezza Rice and his friend Tony Snow, former press secretary under George W. Bush.

Then again, it helps to remember that Anderson hails from the U.K.—from the proud and fiercely independent country of Scotland, to be precise. And while he is a longtime student of American culture and politics, he has the ability to view our country from the outside, like a rock & roll Alexis de Tocqueville.

“In all of sane Europe, we are pretty liberal and sensitive about the rights that people have, as long as they don’t force them unpleasantly on others.”

He shares this perspective voluntarily, without prompting, briefly steering a recent conversation away from music and into politics and religion.

All of this makes sense, of course, when you consider Anderson’s background and take a listen to his discography. On the title track of Jethro Tull’s fourth LP, 1971’s Aqualung, Anderson seems to toggle between self-righteous derision and true empathy as he narrates a day in the life of a tramp. At first, this disheveled character is “eyeing little girls with bad intent”; later he is nursing a bum leg, wheezing and dying alone on a cold park bench.

Fast forward to “Farm on the Freeway,” from 1987’s Crest of a Knave, and we find Anderson pining for a pastoral past that is disappearing. It’s classic “Morning in America” romanticism, until he gets to the cause: a new airport is being built, freeways are slicing through the heartland and a “silicon chip factory” is pushing out a family farm.

Even if Anderson weren’t so forthcoming about his views, fans of Jethro Tull would find plenty of clues to his personal philosophy by looking up the historical figure that shares his band’s name.

The band is named after an English agriculturalist and inventor who lived from 1647 to 1741. A student of European farming practices, Tull sought to improve efficiency in the field with his patented “seed drill,” which could mechanically and simultaneously drill holes and sow seed.

Anderson comes to San Jose later this month with his new touring production, Jethro Tull—a rock opera of sorts, which reimagines the life of the historical Tull through a story set in the near future. The performance features hits from the Jethro Tull catalog, as well as new material, and confronts issues such as climate change, big agriculture and population growth.

Here, again, we see the continued exploration of a theme that has interested Anderson for the majority of his career—balancing a yearning to return to simpler times, while keeping an eye on the horizon and the promises of modernity.

“There is an element of Scottishness and the folk traditions that have always stayed with me to some degree,” he says. The same goes for religion. “I’m not a Christian,” he continues— the Bible in the same way he appreciates Shakespeare, opera and the blues. “It’s a good story.

It has an enormous worth for society.”

It would seem that Anderson is adept at balancing disparate views— just as he is known for balancing on one foot while taking flute solos.

And it is clear that he is adept at telling stories.

Stories are important. They can remind us of where we’ve been and give us a sense of where we want to go. They serve to both inform the rational mind and also temper it against cold, unethical and purely utilitarian decision-making.

In one month’s time the American people will weigh the stories they’ve been told over the past many months and compare them with what they believe to be true in their hearts.

One hopes that on that day both rationality and empathy will be in proper balance.

Getting back to Bumble, where the app goes wrong is in removing the filtering that comes from a man needing to lay his ego on the line and expend effort to pursue a woman. The notion that it’s “empowering” for women to do the chasing ignores that it’s in men’s genetic interest to not turn down a mating opportunity—even with a woman they aren’t that interested in. Also, because men evolved to expect choosier women, even subtle forms of chasing like your contacting a man first may send a message that you’re not all that. UE TO MAJOR changes in the law, everyone in the cannabis industry will soon have to make a choice: get licensed, go (or stay) black market or quit.

As an attorney, I cannot, and will not, recommend anything other than full compliance with state and local law for those who want to be involved. Unfortunately, it is my opinion that many of those who opt to get licensed will still get squeezed out of the industry. There are two main ways that I see this happening.

First, I don’t think the average person realizes the storm of bureaucracy that is approaching. The industry is about to go from basically unregulated to highly regulated. Costs are about to go up. Way up. Margins will drop considerably. This is inevitable.

While there are many factors that will influence how long this storm lasts, I see a giant reshuffling of the deck. Many of those in the industry who want to remain will simply not be able to. Many new people will come in. This is because there will soon be many hands in the pockets of growers. Growers will either have to accept dramatically reduced margins or increase prices. The age-old tension then comes into play: How much can you raise prices without customers turning to the black market?

The second way people may be squeezed out is if local land-use ordinances become too restrictive. I worry that local government will greatly narrow where commercial cannabis activity (and especially cultivation) is allowed. It’s important to remember that government will have many voices in its ear, including those opposed to the industry.

The wine industry is a powerful one in the Bay Area—what position will it take? Local governments may simply legislate many farmers out of existence; they simply won’t be able to use their land for cultivation.

This is a one-two punch because of the insane land prices. Most farmers simply won’t be able to afford to sell land zoned “agriculture-residential” and buy land zoned “diverse agriculture.”

What will happen to all those independent small farmers who produce just enough to support their families? Will they be driven out entirely?

SoFA District’s future the focus of creative convergence events

OR ONCE, artists and real estate developers just might come to a meeting of the minds.

As grotesquely expensive housing begins to leach onto the SoFA District in downtown San Jose, where many have labored for a quarter-century to make the neighborhood artsy and interesting, here comes a slew of events to see how stakeholders might possibly find common ground.

As part of C2SV, San Jose’s three-day music and tech-industry powwow, MACLA will host a rocking Cultural District Forum at 10am Thursday, Oct. 6. Later that evening, the second annual SoFA Design Crawl will unfold, with more than a dozen designers, architects and other creative agencies opening up their offices to showcase current projects. Both events are free of charge.

When it comes to real estate, everyone knows the usual sequence of events. Artists and other interesting people transform an underutilized neighborhood into a destination, or at least a place where other interesting people can find each other. Next, real estate bullshitters monitor what

the artists are doing and swoop in to erect lifelessly uniform residential and retail, often gentrifying the neighborhood so artists and interesting people can no longer afford to live there—despite the fact that it was the artists and interesting people who made the neighborhood interesting in the first place.

Real estate bullshitters wait until the artists make a neighborhood viable before willfully destroying the artists’ livelihoods, just so developers can make a fortune dumbing down the whole neighborhood all over again. This is not illegal by any stretch.

It’s just how the real estate business often works. And since downtown San Jose is apparently prime territory for transient tech workers who don’t care about the neighborhood anyway, a much-touted “housing boom” is currently unfolding to giddy euphoria.

Program into something interesting for a change, organized both the Cultural Forum at MACLA and the SoFA Design Crawl.

“All these developers are developing here because the neighborhood has an interesting vibe,” she said. “So, how do we begin thinking about the fact that it’s an ecosystem, and arts and culture are a critical part of it? At the same time a lot of development is coming in, so how do we get everybody to work together, to make sure that we retain what’s here and build on it, rather than forcing it out?”

Thanks to Goldstein, along with C2SV, the Cultural District Forum at MACLA should be a prime moment for San Jose to bring developers and interesting people into the same conversation for once. An awesome selection of panelists will make the conversation a rocking one.

Moderating the panel will be Jessica Cusick, who is currently devising a plan to implement legislation for a new type of “Certified Cultural District” in California—a fantastic idea. Additional speakers include actor/writer/director Teo Castellanos of Miami’s Wynwood Arts District; Moy Eng, executive director of the Community Arts Stabilization Fund in San Francisco; Ayodele Nzinga, organizer of Oakland’s Black Arts Cultural District; and Steven Oliver, a philanthropist, arts enthusiast, advocate and civic leader. In Oliver’s case, he is both a real estate developer and a person literate in contemporary art, proving those personas aren’t mutually exclusive.

The Design Crawl will feature numerous creative people who work in the SoFA district—graphic and industrial designers, architects, animation interns, ad agencies—but aren’t normally visible to the average person frequenting the scene.

“One of the most interesting things about this region is that everyone knows what Silicon Valley is, but nobody knows where Silicon Valley is,” Goldstein said. “And I thought it would be a really interesting idea to turn it inside out by getting the designers to open up their offices once a year and allow people to come in and see what they’re doing.”

Last year, the SoFA Design Crawl attracted roughly 200 people, but now that it’s coupled with C2SV, more designers are involved and more attendees are expected.

The Wise Ways of Wenzhou

PENING A NEW restaurant and preserving a historical building are two tough tasks on their own. Carol Chen and husband Max Soloviev decided to do both at once with the opening of Wenzhou Fish, Noodles & More in San Jose’s Japantown. To say Chen and Soloviev were dedicated to the building—once a boarding house and then a chop suey restaurant—would be quite the understatement.

They spent 40 months renovating the inside, which had bad fire damage, while maintaining the original façade and balcony to preserve the historic landmark. Their efforts have not gone unnoticed, as patrons are pleasantly reminded that such interesting architecture exists in our city.

The restaurant has more substance than a rebooted exterior and modern interior, though. During the long renovation, the owners had a chance to fine-tune a menu that features Chen’s native Wenzhou cuisine and some of their chef ’s ideas as well. The result is a broth base for their soups that is delicate and light. The Wenzhou Fish Ball Noodle Soup ($12.99) and the Wenzhou Silky Knocked Fish Soup ($14.99) are their two most popular dishes. The silky knocked fish noodle is available until it sells out for the day, which has already happened several times since the restaurant opened last month. Wenzhou cuisine is defined by its signature use of seafood, which the owners felt would fit in well with Japantown’s sushi offerings. The fish noodles here are made by pounding market caught grouper filet, mixing it with potato starch, then rolling and cutting the mixture into thin ribbons. The fish noodles are thin and silky, pairing well with the broth and house made noodles.

Wenzhou cuisine is also known for an impressive list of appetizers.

Here, the most popular items are the house made pork dumplings with chives—also known to sell out quickly. The pan-fried pork dumplings with daikon ($6.99 for 6 pieces) and the Salt and Pepper Tofu ($8.99) are good alternatives. Both are fried until flawlessly crispy.

By giving a fresh coat of paint and more to an old building, the owners have joined in the revitalization of Japantown and introduced a new cuisine to San Jose. Now, keep in mind, this is no ordinary ice cream shop, but one that serves up an exotic rolled ice cream treat that gets its origins from street vendors in Thailand. The first step to ice cream bliss is waiting in a line that can take up to one to two hours. I lucked out, as I had to wait “only” 40 minutes before ordering. Once inside, there is the difficult decision of picking from one of 11 customizable flavors. Delicious choices include Nutella & Chill (Nutella, banana and Graham crackers), Mai Thai (Thai Tea), PB&J (peanut butter, jelly and graham crackers) and Oreo Blast. This was not an easy decision. Fortunately, I brought the whole family so we were able to order a bevy of flavors to sample. With only one size and one price ($6.50), these choices were easy.

Every order gets one-on-one time with Icicles’ friendly ice cream makers. The whole process is like a bizarre Vegas sideshow, as the raw materials are presented on a frozen plate while customers inspect through the glass. The ice cream makers proceed to chop, smooth and mix the concoction until all the ingredients are perfectly blended. The mix is then flattened onto a cold, flat sheet and then peeled up into small rolls of ice cream nirvana. Before handing over the goods there is an encore performance of adding toppings (e.g. fresh fruit, nuts, Nutella, condensed milk, Oreos, whipped cream) to the masterpiece. I highly recommend the toasted marshmallow, if only for the pyrotechnics.

Every flavor combination is distinct and delicious, so it really just comes down to one’s mood. Got a craving for smooth and refreshing? Get the Mai Thai. Feeling nostalgic? Then the Cereal Killer—vanilla custard with Cap’n Crunch, Fruity Pebbles or Cinnamon Toast Crunch—is the way to go.

Craving chocolate heaven? Nutella & Chill was my hands-down favorite, as I ordered it topped with—what else?—more Nutella, condensed milk and marshmallow.

PUB DATE: This heavenly blend left me in an ice cream coma for hours.

Food00/00/15 crazes come and go, but this one seems to have real legs. What’s not to love about outstanding customer service, excellent price points and a delicious product? Now, if only we can do something about those lines. —John Dyke
