I’m hardly the only “Sunday Funday” faithful, but some go a little too hard on the Lord’s Day. This past Sunday, just before midnight, I was ambling back to my car at the corner of Santa Clara and Third streets in San Jose when I saw you, a white sedan at the intersection, waiting to turn right. The traffic light turned green. The car didn’t budge. I thought you might be on the phone, distracted, because the car stayed there—lights on, engine running. I’d already climbed into my car, pulled away from the curb and stopped right next to the white car at the traffic light, which by this time had gone through a few cycles of green to red to green again. I rolled down my window, honked and shouted, “Hey, man! It’s green!” Dude, you were passed the fuck out, your head back and mouth agape. The horn woke you up and you drove off in a hurry.

As I drove away, I regretted waking you up. What if you were drunk? Or so sleepy that you ran into someone else? The next morning in the news, I read about a driver who killed someone after dozing off behind the wheel.

Different car, I noticed. But it scared me. Lesson learned. I should have called the cops on you. I hope our run-in was a wake-up call for both of us.

SPURned TERESA ALVARADO retired from the Santa Clara Valley Water District last month, but not before trying to squeeze every last dollar out of the Golden Spigot.

In February, Alvarado announced she was trading in her flak hat for a director role at San Jose SPUR, the urban nonprofit that cheerleads “good planning and good government” in the Bay Area. That mission doesn’t exactly line up with Alvarado’s recent behavior. In order to have her CalPERS benefits vest, Alvarado needed to work five years at the district.

To reach that mark, she used her vacation hours to take off the month of April. Not a big deal—but that’s where the funny business starts. It turns out Alvarado incorrectly listed her last day as May 2, when her vacation hours only got her to April 26. Once the district caught the error, there was a concern Alvarado may have retired short of her pension. Instead, Alvarado—at a base salary of $161,944 per year; $81 per hour—called and emailed Camacho for the extra hours, noting that her work proposal included “meaningful assignments.” Alvarado even threw the new CEO a little shade wondering why she was putting up “an obstacle for providing these services.”

Camacho said she had other people on it, which led Alvarado to then go over her head and complain to district board members—all so she could get another $2,348 to do nothing.

Claim Jumper CRINGEWORTHY Kathleen King’s claim that she is entitled to a public pension is just unseemly.

CalPERS denies politically connected nonprofit exec’s pension ruse

ATHLEEN KING, CEO of the Healthier Kids Foundation, makes a handsome living on taxpayer-funded grants. She received a 30 percent raise last year to boost her annual salary to almost a quartermillion dollars a year. In a small measure of sanity, King won’t receive a public pension to boot.

In an 9-2 ruling April 20, the board of the state’s public employee retirement system, CalPERS, denied King’s appeal. She and the Santa Clara County Health Authority (SCCHA) argued that the nonprofit exec should be eligible for a state pension—despite not having worked for a public agency.

King’s own arguments were used against her in the decision.

Three years ago, the Healthier Kids Foundation—then known as the Santa Clara Family Health Foundation—sued the SCCHA to prevent the release of emails that San

Jose Inside had requested through the Public Records Act. At the time, King’s organization shared office space with the SCCHA, and its records were maintained on a county-controlled server.

In a sworn affidavit from the 2013 case, King and her attorney argued that the emails should not be released because her foundation and the SCCHA were “entirely separate and independent agencies and the relationship between [them] is purely contractual.”

A judge disagreed, noting that the files were under control of the County of Santa Clara, which could release them, as is required of public records in its possession.

San Jose Inside published a series of articles that showed King and Cindy Chavez, not yet a county supervisor, used the organization’s resources to propel

With a public pension on the line, however, she switched her tune.

The board’s decision upheld a ruling by an administrative law judge, who agreed that King could not be considered a public employee by any reasonable definition. CalPERS staff argued that allowing King to receive a pension “jeopardizes the tax-exempt status of the CalPERS plan.”

Calls to King and the Healthier Kids Foundation were not returned.

Just three years ago, the SCCHA faced off against King in court over the email release. This time, it took King’s side in the pension dispute, which shows just how much the organization’s leadership has changed since former CEO Elizabeth Darrow stepped down at the end of 2015.

King is now a SCCHA board member, and many of the other trustees are political allies of Supervisor Chavez and organizations she ran (Working Partnerships USA; South Bay Labor Council) before becoming a county supervisor.

King first enrolled in the CalPERS system in 2008, when she was hired

to lead the Santa Clara Family Health Foundation. At the time, she reported to the SCCHA. That reporting structure changed in 2009, but King’s CalPERS status continued until her nonprofit renamed itself the Healthier Kids Foundation in 2013, following the San Jose Inside stories and pressure from the similarly named Santa Clara Family Health Plan.

As previously reported, Healthier Kids Foundation appears to have been reimagined to keep King on the taxpayer dole while also helping her remain politically relevant. Other than an annual wine tasting event, the nonprofit raises little in the way of corporate gifts, foundation grants or private donations.

According to its 2012 Form 990, “It does not solicit grant requests, but rather makes grants to organizations that serve the same population as the foundation.” In 2012 it donated $125,000 to the VMC Foundation, whose chief executive officer sits on HKF’s board, to “support Santa Clara Valley health & hospital system.” It followed with $25,000 more to VMCF in 2012 and 2014 for “sponsorship of annual gala.” King’s group also supports Working Partnerships ($20,000 in 2012) and other politically active groups, such as People Acting in Community Together (PACT) and Asian Americans for Community Involvement.

Healthy Kids Foundation spent $1,059,555 on lobbying between 2010 and 2014, according to its disclosure filings, and it contributed $465,000 to fund two tax increase political campaigns, most notably the 2012 Measure A. The organization lacked a clear mission statement in April 2014, when Chavez and the county Board of Supervisors signed off on giving King’s tiny nonprofit $1,168,200 from the Measure A windfall over two years.

The 30 percent salary raise followed.

That money was surplus from Measure A, the county tax initiative that King and Chavez organized in 2012 through the Santa Clara Family Health Foundation.

A review of financial statements the Healthier Kids Foundation filed with the IRS shows that more than 80 percent of the nonprofit’s money comes from government grants, and nearly half of its expenses are staff salaries including King and her $147,000-a-year finance director and co-CEO, Emily Hennessy.

their political careers, as well as fund a campaign to approve a half-billion county sales tax increase that King has since tapped into to boost her salary to a quarter-million dollars per year.

Just a few weeks after the May 2013 court decision, a random CalPERS audit of SCCHA operations found that four employees of King’s foundation were receiving improper pensions, as they were not employees of the county entity.

BY JENNIFER WADSWORTH The older of two brothers accused of killing their parents told investigators that he shot his father because a stranger forced him to, according to police.

In a brief court appearance last week, Hasib Golamrabbi, 22, and brother Omar Golamrabbi, 17, pleaded not guilty to the double-murder.

Meanwhile, new details emerged about the case, which has become a national news story because of chilling notes left at the crime scene.

“Sorry, my first kill was clumsy,” read one.

Another, per news reports, stated, “I can’t be like you, telling a lie. I can’t love someone without telling them.”

According to arrest reports, Omar told police he was in the family’s

Evergreen hills home on April 23 when his brother shot both parents— Golam and Shamima Rabbi, 59 and 57 years old, respectively—but made no mention of a stranger.

On the day of the shooting, police say, both brothers went to an anime convention, Kraken Con, in Oakland. Omar attended school the next Monday.

Witnesses told police they seemed nonchalant, as if nothing had Omar happened.

Four days later, friends of the Bangladesh-born Rabbis went to the family home to check up on

the couple and stumbled upon the grisly murder scene. Golam was riddled with bullets; his wife Shamima, shot in the head.

San Jose police Hasib immediately questioned Omar but had to track down Golamrabbi, who fled to Tracy.

In a jailhouse interview, he told the San Francisco Chronicle that his little brother—who’s being charged as an adult—is innocent.

On April 23, the brothers were arraigned on homicide charges with enhancements for double-murder in Santa Clara County Superior Court.

Prosecutors on Monday charged former San Francisco 49er player Dana Stubblefield with raping a disabled women he tried to hire as a nanny last year. The 45-year-old retired defensive lineman denies the allegations.

According to the Santa Clara County District Attorney’s Office, Stubblefield in April of last year found the 31-year-old developmentally disabled woman on SitterCity.com.

He then invited her to his Morgan Hill home for a job interview.

After a brief interview, the woman left, authorities said, but Stubblefield—who’s 6-foot-3 and more than 300 pounds—allegedly called her back, offering to pay for her time. When she returned, police said, he carried the 5-foot-tall, 105pound woman to a room, raped her, forced her to perform oral sex and gave her $80.

“The victim immediately reported being assaulted,” McInerny told San Jose Inside. A year later, police booked Stubblefield into San Jose’s Main Jail on five felony counts in connection to the assault.

Stubblefield’s attorney, Ken Rosenfeld, called the charges false, adding that his client “passed a lie detector test with flying colors.” —Jennifer Wadsworth

A

S FAR AS professional musical tours go, it was a quick jaunt. In between main-stage sets at Coachella, M83, the French electronic group responsible for the smash hit “Midnight City,” trucked up to Oakland to play The Fox Theater, headed back down to the Southern California desert for a second Coachella set the following Friday, and returned north once more for a show at The Catalyst in Santa Cruz.

M83’s Oakland gig was part of what SFGate dubbed “San Franchella”—a

slate of Bay Area shows by artists also playing the iconic, two-weekend music festival in Indio, Calif. Readers were provided with a Google map of all the shows, the bulk of which could be seen blooming out of the center of San Francisco, with only a smattering in Oakland and a scant few in San Jose: pop singer Ellie Goulding made a stop at the Shark Tank, hip-hop artist Vince Staples opened up for Logic at the San Jose State Event Center, and DJ SoSuperSam booked a set at The Ritz.

Presented with this collection of concerts, South Bay music fans might wonder why there weren’t more “San Josella” shows. Sure, San Jose doesn’t carry the name recognition of San Francisco. But as the home to Apple, Google,

Facebook, Adobe and the inspiration for a wildly popular HBO comedy, Silicon Valley is known the world over. There are more than a million people living in San Jose alone, and there are certainly plenty of venues.

The SAP Center can handle nearly 20,000 concertgoers, SJSU’s Event Center tops out at 5,000, and the City National Civic can fit a bit over 3,000. We also have smaller clubs, like Studio 8, with a capacity of 1,000; The Ritz holds 540; and BackBar SoFa can accommodate a cozy 120. That’s not even considering Pure Lounge in Sunnyvale, multiple venues on the Stanford campus or the Mountain Winery in Saratoga.

And yet time and again, touring musicians end up playing

San Francisco—or Oakland or Berkeley—before heading south to Santa Cruz, north to Marin and Sonoma counties or leaving the state altogether, without giving San Jose so much as a wave out the window of the tour bus.

Bottom line, San Jose missed out on a ton of great shows this year.

While many theories abound about the city’s underdeveloped music scene, most everyone in the business agrees that a consistent stumbling block comes in the form of a music industry practice few outside live entertainment circles have even heard about—the “radius clause.”

It’s part of a pattern of old fashioned, antitrust-style behavior, used by baseball teams and big oil

The 60-Mile Rule

How music industry insiders keep some of your favorite artists out of the South Bay—and San Jose a backwater companies over the years to restrict the business growth of emerging competitors. Rather than letting the marketplace rule in a laissez faire fashion, one party improves its business position by preventing another entity from selling a product at a lower price or more convenient location. The bigger player, in this case San Francisco, uses its dominant position to lock out a nearby city from professional sports and entertainment options, thereby stunting its development.

The contractual exclusion of business activities over a wide swath of territory affects everything from local self esteem to the long distance branding of a destination, with accompanying economic ripple

effects. “It’s the main hindrance to the South Bay music scene gaining any traction,” Maxwell Borkenhagen, artistic director of Café Stritch, says of the written clauses and gentlemen’s agreements that venue owners and promoters make to protect their financial stakes in the concerts they produce.

It works like this: when a band books a show, the promoter asks the band to commit to not performing another show in close proximity, in both time and space, to the show they are booking with said promoter.

In theory, this gives the promoter some assurance that the band won’t book a second gig nearby and split paying patrons over two shows.

Barbara Wahli, a local promoter of

smaller rock, alternative and metal shows, says she has conflicting feelings when it comes to radius clauses.

“I understand why they exist,” says Wahli, noting that she never makes bands sign anything, but asks them to think strategically about booking other gigs in the runup to the shows she puts on. “I’ve had to enforce them myself on my own shows.

Some bands play, like, twice a week— whenever and wherever they can.”

If a band she books to play at the X-Bar in Cupertino turns around and sets up another show just a few days prior at The Caravan—where there is rarely a cover charge—chances are high that she’ll lose out on paying customers, which will result in a lower profit margin for her. She may

even end up losing money as a result.

Borkenhagen admits there are practical reasons for having radius agreements with acts. Still, he says, in practice it does more harm than good, as it forces bands to choose one venue over another, when in many instances they could play both without cutting into proceeds at either performance.

“It’s a remnant of a time that’s long past,” Borkenhagen says, “and I don’t think it represents the realities of the market in the Bay Area anymore. I think it’s basically unfair. It’s bad for the artists and it’s horrible for the overall Bay Area culture.”

who put on shows—especially in San Francisco—often require bands to sign an agreement pledging not to play within a certain distance of a given club for at least 30 days before and after the date of their show. Sources agree that the industry standard radius in the Bay Area seems to be 60 miles, a fateful number considering that San Jose and San Francisco are just about 49 miles apart. With bigger shows, like Coachella, these radius clauses can cover hundreds of miles and extend months before and after the event.

Chris Ellul, the drummer for English indie rock and soul outfit The Heavy, played Coachella this year. And like M83, Ellul’s band also avoided San Jose—playing both San Francisco and Santa Cruz. It’s unlikely that the guys from M83 were concerned about skipping over the San Jose market. But when it comes to The Heavy passing over San Jose, Ellul says, radius clauses definitely played a role.

The Heavy have history here. The Blank Club, formerly run by Corey O’Brien, who now owns and operates The Ritz, hosted one of their very first headlining shows on the West Coast.

What’s more, Ellul is married to Jen Chambers, a Morgan Hill native and the one-time singer for the nowdisbanded local group Suicidal Barfly.

Ellul and Chambers met at that 2010 Blank Club show, and the band played San Jose twice more in the ensuing years. Eventually, the couple celebrated their wedding with a small reception in the Blank Club’s upstairs green room.

“I’m pissed off that we didn’t come and play in San Jose this time around,” Ellul says, as he waits to play The Catalyst’s atrium stage on a recent Wednesday evening. It’s true that he has a soft-spot for the city where he met his wife and forged other relationships over the years. But there’s more to it than that.

Bands like M83 can reliably pack 800-capacity halls, like the Catalyst’s main room, so playing as many shows as possible isn’t as important as it is when you’re a band like The Heavy, Ellul says. The Heavy draw consistently—but more on the order of 200-300 a night. Because of this, being barred from playing San Jose means missing out on a paycheck and the opportunity to recruit some new fans.

“I personally think—100 percent— that we could play in San Francisco, have a good crowd there, and then come to San Jose and play to the people that wouldn’t travel up to San Francisco,” Ellul says, noting that, by his calculation, somewhere around 150 San Jose residents didn’t come to see his band play in San Francisco.

“That’s just friends and friends of friends. That’s not even including people who just know our music,” he notes. “San Jose is such a big city in itself. These places have got their own populations. There’s enough to go around, if you know what I mean.

There was probably room for us to do San Jose, San Francisco and Santa Cruz. It just doesn’t make any sense.”

Eric Victorino, frontman of Strata and The Limousines, calls the radius clause “a huge problem.”

“It’s kind of brutal,” the singer says, remembering a Strata tour with Trapt, Helmet and Chevelle. Victorino’s band had booked close to three months of dates, with almost no days off. When they did have downtime, Strata often took the initiative to seek out an off-tour show in order to make a little extra gas money—even if they ate up much of that extra cash backtracking or peeling off from the most optimal tour route in order to abide by the radius clause.

Big Business Some sources suggested that Goldenvoice, the promoter behind Coachella, expanded that festival’s 2016 radius clause to reach all the way up to the Bay Area. An examination of local shows in the weeks surrounding Coachella suggest that is not true. But the fact that these rumors were floating around is indicative of the distrust smaller, independent venues and promoters have of the major players in the live music industry.

“It’s not just Coachella—it’s this huge corporate chain that is taking over all aspects of the music industry,” observes The Ritz’s Kyle Gilmore. “They are using the radius clauses to solidify their places in the market.”

Goldenvoice is part of AEG Live, which along with Live Nation, controls around 70 percent of all

Metro reached out to APE in an attempt to ask the giant in Bay Area concert promotions about how it uses radius clauses in its own negotiations. But like the hulking Goldenvoice and Live Nation, Another Planet Entertainment keeps quiet when it comes to the radius clause. All three concert promoters declined comment for this story.

“Nobody wants to say the word ‘monopoly,’ but that’s what’s going on here,” says Jimmy Arceneaux of IFC Productions, an independent talent buying agency based in the South Bay. Arceneaux says he he’s been dealing with radius clauses since the early ’90s, back when the standard radius clause reach was 50 miles.

This would allow bands to play in San Francisco and the South Bay. In fact, Arceneaux says, he worked with a number of clubs around the Bay Area—including The Army in Oakland, The Stone in San Francisco and One Step Beyond in Santa Clara—and he was able to book shows by the same band at all three venues without anyone talking about radius clauses.

“It was a different scene back then,” he says. Bands like No Doubt, Jane’s Addiction, The Replacements and the Ramones played South Bay clubs and could still play San Francisco’s Warfield.

The music industry has gone through some big changes since then. Streaming music services and mobile devices capable of accessing them have resulted in plummeting record sales. As a result, professional musicians now look to turn a profit while on tour, so they ask for larger guarantees from promoters.

“Bands make their money on the road now,” says The Ritz’s O’Brien.

“Before, bands would go out just to promote the album—and they wanted to make enough money to stay on the road, but now they need to make their money on the road, so guarantees are shooting up. If bands are asking for more money for shows, the promoters are going to have to be a little more strict on a radius clause.”

concert ticket sales in the U.S., according to Billboard. These major promoters tend to be behind some of the biggest summer festivals, which are known to have aggressive and farreaching radius clauses. Coachella’s, for example, covers a sizeable chunk of Southern California and even reaches into Nevada.

According to a Mic.com story from 2014, the massive Chicago music festival Lollapalooza prevented a handful of major Midwestern cities from booking acts for six months before the festival and three months after it. Lollapalooza’s radius clause extended out 300 miles from The Windy City, meaning venues in St. Louis, Milwaukee, Indianapolis, Cleveland, Cincinnati and Detroit were blocked from booking many of the same artists who played the alt music festival.

A flurry of reports surfaced in 2010 that Illinois Attorney General Lisa Madigan was investigating Lollapalooza’s blackout dates and exclusionary activities, but that initiative, if it ever really was more than just poking a stick inside the tiger cage, seemingly died without as much as a whimper.

It’s difficult to confirm whether any Coachella artists were prevented from playing the Bay Area in 2016.

Goldenvoice representatives refused to comment for this story. Plenty of Coachella artists did play Bay Area dates in and around the festival, though sometimes these shows were at Goldenvoice-owned clubs.

However, even if Goldenvoice didn’t institute such a far-reaching radius clause, San Jose venues were blocked anyway. Speaking to SFGate for the “San Franchella” article, Allen Scott, executive VP and head booker for Another Planet Entertainment, a successor to Bill Graham Presents, unwittingly explained why: “There’s only so many markets you can hit and get back to Coachella,” he said. “And since the radius clause prohibits (the bands) from playing a large area of Southern California, the Bay Area and Las Vegas are two markets that have felt the benefit.”

“Nobody will come out and say it, nobody will come out and admit it, but I’ve always had the thought that it was about locking out other promoters,” Arceneaux says. Several years after he got into the business, he started seeing promoters from the San Francisco bumping up their radius clauses to 60 miles—just enough to ensure that all of San Jose was blocked out.

At his last gig before moving to IFC, Arceneaux was a talent buyer for the RockBar Theater in San Jose. He recalls an agent calling him up one day to tell him that his artist wouldn’t be able to play there because it was 59 miles from the venue they’d booked in San Francisco—just within the prohibited radius.

Alex Hodges, CEO of Nederlander Concerts since 2011, oversees the production of concerts in Hollywood as well as San Jose’s City National

Civic Auditorium and the Center for the Performing Arts.

“I get it,” Hodges says of the radius clause. “I think we all get it. But sometimes, I think it’s over utilized as a competitive measure.”

He adds, “Anybody from San Francisco that is trying to extend that radius to cover the City National Civic is doing it from a competitive point of view rather than a realistic point of view.”

As is the case in most fields, those working at the highest level of a profession tend to be competitive.

“I think that you must acknowledge that you’re protecting your market,” Hodges says. “You’re protecting your pocketbook and that can become a personal thing—protecting your reputation as a presenter.”

In his early years working with the legendary Bay Area rock promoter Bill Graham, Hodges recalls working as an agent and manager out of Georgia. He says he frequently spoke with Graham over the phone, negotiating rates and contractual agreements for his clients.

During this time, Hodges would often

Come Together The biggest issue in drawing top touring talent to the South Bay, according to Wahli, is that local booking agents don’t have connections to pull big shows together. “We don’t have a lot of bookers who have relationships with big booking agencies,” she says.

O’Brien and Gilmore of The Ritz agree, but they say building those relationships is difficult because of the narrative that San Jose sits in the shadow of San Francisco.

It’s a narrative that has only been reinforced in recent years by other forms of entertainment, such as professional sports. For years, San Jose has wrangled with Major League Baseball to bring the Oakland A’s to town. That effort was thwarted by the San Francisco Giants, who hold MLB-sanctioned territorial rights to the South Bay. More recently, the National Football League further excluded the South Bay from premier entertainment options by hosting its

“Super Bowl City” in San Francisco, while the game was played at Levi’s Stadium in Santa Clara.

Local bars and restaurants brought on extra bartenders and servers in the week running up to the game only to send staff home when fewer patrons showed. Downtown clubs also promised star-studded ragers, but celebrities didn’t appear.

“San Jose gets hated on,” says indie rock promoter Eric Fanali. “The more apartment complexes we build, the more we become the place where people live and work and then go to San Francisco for fun.”

He is encouraged by what he sees going on at The Ritz and other venues in San Jose’s SoFA District.

None of O’Brien’s efforts will matter though if music fans in San Jose and the South Bay fail to show up. The region’s live music scene inarguably suffers from a lack of grassroots support. Stand outside of Cafe Stritch, The Continental or The Ritz on a given night when the venues charge cover for live acts and observe how many would-be patrons decline to pay $5.

Building a scene takes time, Wahli notes, remembering the challenges that now-defunct Voodoo Lounge encountered in its early days. “It took quite a few years for them to establish themselves, even with bigname acts,” she says.

And good things are definitely happening. Over the last year, Agenda, Aura, BackBar SoFa, The Continental, Cafe Stritch and The Ritz have all booked acts with serious national buzz: Prayers, Dengue! Dengue! Dengue!, Geographer, Deap Vally, Melvins, Dâm-Funk.

But the radius clause isn’t going anywhere. As long as there are huge promoters with money, reach and powerful legal teams, bands are going to find themselves pressured into signing on the line and plotting tours that skip the South Bay. Promoters of the local scene— O’Brien and Gilmore, Wahli, Borkenhagen and Fanali—will keep working their connections and bringing great shows to the place they call home.

“This town,” Gilmore says, “if it was able to come together, it would take over.”

book his artists both in San Francisco and at the Concord Pavilion.

“Bill used to tell me that they were too close and it was a conflict,” he says.

“I don’t know that he would put a radius clause in his contracts, but he would just yell through the phone and scream bloody murder that Concord and San Francisco were too close.”

That changed after Graham took over the Pavilion, he says. Suddenly, Graham was sending Hodges requests for his talent, with the intention of booking them both in San Francisco and Concord. Hodges asked him what changed.

Graham responded matter-offactly: “Concord moved.”

Making sure to note his immense respect for Graham, Hodges says: “Bill was very prideful of his home territory and that included the entire Bay Area.”

Hodges acknowledges that egos are very much tied up in the desire to protect a brand. “A promoter is trying to create an identity that he or she is the best,” he says, “for the purpose of buying more shows and for the purpose of credibility with fans and artists.”

Though some of these techniques rely on modern technology, humans have been manipulating photographs from the moment we figured out how to capture the light on chemically treated sheets of silvered copper. “Multiplicity” investigates the ways that artists have molded the superficial appearances of their subjects to evoke the literal and fictional truths they wanted to reveal. Men have had a pretty good run.

Since time immemorial they’ve dominated the cultural, political and economic spheres while simultaneously pushing women into occupations more befitting the “fairer sex.” This new exhibit collects the works of prominent male artists from late 1800s and early 1900s Vienna. Together these images are a comprehensive cross-section of the Viennese intelligentsia’s male gaze. Undergraduate curator Alex Zivkovic collected the prints and photographs, which detail the unseen emotional, intellectual and social lives of women—from the point of view of their husbands and beaus, of course. America is at a crossroads. This country’s lower and middle classes flounder in a sea of debt, whilst Fortune 500 CEOs pilot their luxury yachts into a new gilded age.

Buoyed by obscene paychecks, they sock away grotesque sums in offshore accounts, far away from government agencies seeking tax dollars to fund health programs, build schools and repair crumbling infrastructure. Enter Ryan Carrington.

On May 6, the performance artist will physically transform thousands of pounds of concrete into a huge wall—all while wearing a designer suit. The act is meant to embody the contemporary class war in a moment of spontaneous creation. (MH)

What lies beyond—not beyond death, but simply beyond every choice? What occupies the space on the other side of every decision? We can try to know, but the only way to find out is to decide, to pass through and arrive at the next moment, where we will inevitably face more choices and challenges. These are the themes underlying artist Tim Lierman’s new exhibit, “The Portal Shrinks.” In the pieces that make up this show, Lierman deploys “strange beings, symbols and monuments as stand-ins for ordinary struggles with friends and foes.” (MH)

Before music only reached people through multinational technology companies, musicians used to be cultural ambassadors. Duke Ellington’s Far East Suite is the result of his band’s 1963 world tour, which wound through North Africa, the Mediterranean and the Middle East. It is a document of Ellington and Billy Strayhorn’s cultural melting pot—taking themes and philosophies of the near and middle East and rerouting them through the American jazz tradition. The pieces, which Ellington rarely played live, will be performed by the local group Nineteen Jazz Orchestra. (MH)

Rivaling Beyonce and Adele, Rihanna's astonishing career has spanned a decade without flagging. Since dropping “S.O.S.” at age 18, the international pop sensation has unleashed a steady stream of bangers—“Disturbia,” “Rude Boy,” “Umbrella”—always capturing and advancing the contemporary sound simultaneously. The Barbados native belts out sultry hooks over always-exceptional production and has a knack for the infectious. Her latest entry into the cultural canon is “Work,” a pulsing ode to failed love, powered by dancehall steel drums, a quick-skipping earworm of a hook and two beyond-steamy music videos featuring the omnipresent Drake. This up-and-coming group reflects the diversity of its place of origin.

The San Jose collective features a wide range of cultures and musical stylings that have cohered into a modern vision of classic rock, jazz and soul. During a recent Sharks playoff game, their dread-headed lead singer, Noah Kibreab, sang the national anthem to the turquoiseclad faithful. They’re working on a debut album now. The LP’s lead single, “Love Ain’t Gonna Take It,” features Kibreab warbling about a strained romance as he plucks a few tender licks on his guitar, then bursts into a full-throated refrain. (JF)

The prolific and innovative Russian has crafted a number of striking, distinctive and ambitious symphonies, ballets and operas—like his operatic adaptation of Tolstoy’s War and Peace, which he wrote during the Nazi invasion of his homeland. Now that the Cold War has thawed, he’s finally been elevated to the lofty realm he deserves in Western circles. Two of his finest compositions will be performed by renowned Russian-American pianist, Natasha Paremski. (JF)

Two centuries ago, before bicycle-powered deliveries or the internet, armies of street urchins in eight-paneled caps hawked broadsheets on street corners for pennies. In 1899, they held a strike against Joseph Pulitzer and William Randolph Hearst for abusing child labor laws. They demonstrated on the Brooklyn Bridge, bringing traffic and the consumption of current events to a standstill. ITH ITS LARGE Chicano population and many Latino-oriented community organizations, Silicon Valley always has Cinco de Mayo covered.

The holiday commemorates Mexico’s victory over French forces on May 5, 1862, at the Battle of

Puebla, but the day more often focuses on cruising the city streets, blasting loud music and celebrating in style. Here are a few events.

JUAN FELIPE HERRERA Hammer Theatre, San Jose May 5, 9:30pm, Free U.S. Poet Laureate Juan Felipe Herrera (see page 42) has frequently written about the immigrant experience. He appears as part of the Legacy of Poetry Day.

GUILLERMO GALINDO San Jose Museum of Art May 5, 12pm “To me everything is a musical instrument,” says Guillermo Galindo, one of two artists featured in the San Jose Museum of Art exhibit “Border Cantos.” The show, which paired photographs taken on the U.S.Mexico border with Galindo’s musical instruments and compositions, serves as an exploration of life at this international crossroads. For his part, Guillermo built instruments out of items he found while exploring the scrubby desert. Using everything from plastic and glass bottles to sand and shoes, he crafts soundscapes inspired by the lonesome landscapes he took in while tromping along the Rio

Starting with 2001’s twin hits “Can’t Deny It” and “Young’n (Holla Back),” on through 2007’s “Make Me Better” and 2010’s “You Be Killin Em,” Fabolous has been a force on the hip-hop and pop charts for more than a decade, frequently providing guest vocals on hits by other artists including Jamie Foxx and Trey Songz.

TARIMBA MACLA, San Jose May 6, 8pm Originating in the Mexican states of Oaxaca, Tabasco and Veracruz, the musical style known as Son Jarocho fuses African and Mexican traditions into a cohesive genre. The best known Son Jarocho song is “La Bamba,” which was first popularized in the States by Ritchie Valens and the film of the same name. Led by Kyla Danysh and Doloris “Lolis” Garcia, Tarimba is a collective of Bay Area musicians dedicated to playing Son Jarocho songs on traditional instruments. They take their name from the wooden dance platform upon which they perform.

The word “Tarimba” is believed to have African roots.

Mapping the Universe THE THOUGHT OF printed maps may bring you back to the tedium of a 5th grade history class, but the new David Rumsey Map Center at Stanford University is like no geography lesson you ever had.

The collection of more than 150,000 rare maps, globes, atlases and other cartographic paraphernalia was donated in 2009 by longtime map collector David Rumsey a San Francisco real estate developer and chairman of Luna Imaging. With artifacts dating back to the 15th century, the Rumsey Collection is a veritable compendium of cartography.

Physically, the Center seems both expansive—almost spare—yet filled to the brim with visual information. While the space is rich with with visual history, context and synthesis comes A Universe alive through the Center’s two wall-sized, digital of Maps interactive maps. Measured at 12 feet by x 7 feet, and 16 feet by 9 feet, the massive touch-screens give a M-F, 1pm-5pm, Free completely new dimension to visualizing maps and David Rumsey Map spaces. With a swipe of a finger, the viewer can navigate Center, Stanford around cities like San Francisco or Paris, zooming in to the smallest details, or interposing old maps on sections of a city, connecting history with the modern day.

The David Rumsey Map Center’s also features the exhibition “A Universe of Maps.” This collection of 150 rare maps and atlases is a fascinating peek into the history of cartography. While it features the first edition of Lewis & Clark’s Account of the Expedition, the emphasis is on the more arcane and obscure artifacts, including a 1933 map of the London Underground, and Abraham Ortelius’s Threatrum orbit terrarium; written in 1570, a leatherbound tome considered to be the world’s first atlas.

Along with “A Universe of Maps” and the rest of the Rumsey Collection, The Rumsey Map Center will hold other Stanford collections, including historical maps from the Branner Earth Sciences Library, and California as an Island, the Glen McLaughlin Collection created by the legendary Silicon Valley VC .

A map-lover's dream, the collection is so vast that it’s easy to get lost in one small section of the exhibition—particularly with the wall-sized interactive screens. And yet it’s neatly organized, accessible, and technologically chic.

Coming across a collection with this level of quality and scope is a rare find for any University Library, and Stanford’s transformation of the collection into an interactive learning tool is an even rarer gift to the Bay Area. —Tad Malone

N SOMETHING LIKE Quentin Tarantino’s version of That Darn Cat, Keegan-Michael Key and Jordan Peele make a sublime comedy team in their new film, Keanu. The poster doesn’t lie: it’s centered around a little mewling kitten, a “gangsta pet” sought by horrible and dangerous men.

The two comedians play cousins.

Key is Clarence, an anxious suburban

family man in a madras shirt. At first glance, he’s like Dwayne Johnson’s frailer little brother. Upon further examination, he’s a beige Chevy Chase. The word protean describes Key; he’s facially bland enough that he can pose as hundreds of characters, as he has over the five seasons of the duo’s hit Comedy Central show, Key and Peele.

When Clarence’s wife and kids go away for the weekend, giving this exec a chance to stretch his legs, he’s called up by his cousin, Rell. Peele is the cuddly fury-brained type, honoring the tradition that a good comedy team is one person trying to keep order, paired with a partner

whose grip has long since gone.

Rell has just been dumped by his girlfriend, who told him he wasn’t going anywhere in life. “I don’t even know what that means!” he whines through a mouthful of bong smoke.

Heaven sends Rell a stray silver tabby, scratching at his door. The cat completes him—they share milk from a saucer. It turns out Keanu the kitten is the lone survivor of a bloodbath. Two monstrous gangsters, The Allentown Brothers (also played by Key and Peele) shot and carved up a lair full of drug-dealing rivals in the best John Woo style. After burglars strike Rell’s house, the kitty vanishes. Clues lead to a gangsta named Cheddar (Method Man). To impress this downtown criminal and his cohorts, the cousins pose as the deadly Allentowners.

The deception is complicated by the way Clarence talks: as Rell says, “like Richard Pryor imitating a white guy.” Key doesn’t really have

the voice of the nervous Caucasian whom Pryor frequently imitated on stage in his long-since-played-out “white guys be like this, black guys be like that” routine. That snippy, quacking white-guy voice of Pryor’s plagues me—I hate when I hear it coming out of my own mouth.

With help from Cheddar’s skeptical moll Hi-C (Tiffany Haddish, a standout) the two run a crew of drug dealers. Their first customer is a drugged out starlet: the one and only Anna Faris, playing herself. Raccoonfaced from too much mascara, waving a samurai sword and eager to play mind games, Faris is delightfully bizarre. It’s poignant to hear her recite her resume: “I was in Scary Movie 1, 2, 3 and 4. Not 5. Too old.”

K and P’s long-time collaborator, director Peter Atencio, wreaks this film out of a Los Angeles flavored with bits of New Orleans. A thug team-building session is staged in a graffiti-covered park, where someone has spray-painted the phrase “Hollywood Fuck Off.” If this was the comment of a neighborhood local disgusted by camera crews, Atencio is careful to leave in the shot.

Keanu is just that generous.

Like the baby in Raising Arizona, Keanu the kitten stirs up everyone’s emotions without having any of its own. Wearing a bitty do-rag, and tiny bling around its neck, the little mite is a symbol of fragile, finer feelings threatened by the heavy boots of the urban world. Another instance of tenderness: the prelude to a thwarted kiss on a rooftop between Rell and Hi-C, during a fireworks party. The explosions give the would-be gangbanga PTSD after the gunfights he’s been witnessing.

And Haddish, like Faris, gives this endearing trifle everything she’s got.

But is it that trifling? The subject gives these two prime comedians something to sink their teeth into.

Both biracial, Key once observed he and his partner are “code-shifters” with the color line. Keanu teases the idea of how the movie-fed characteristics of race are just one more role for actors.

Similarly, race is just one more thing everyone believes in, even though there’s no science to prove it.

HAPPY BIRTHDAY The Olivia de Havilland Festival celebrates the works of the soon-to-be 100-year-old actress.

Silver Screen Centennial OLIVIA DE HAVILLAND, who will be 100 years old July 1, is being honored at the Stanford Theatre with a 15-film retrospective, celebrating her long acting career. Raised in Saratoga, she showed an unstoppable streak at an early age, moving out of her home even before she graduated from Los Gatos High. Her stepfather—the manager of a sincedefunct San Jose department store—had threatened to kick her out if she didn’t stop performing. De Havilland was discovered by an agent of the impresario Max Reinhardt while she was playing Shakespeare in a local theater. She was signed to a Warner Brothers contract, and starred as Hermia in the 1935 film of A Midsummer Night’s Dream. At 5-foot-3, she embodied the Shakespeare-ism: “Though she be but little, she is fierce.”

On the Havilland’s centennial birthday, the theater will screen one of her best-known performances: Melanie Hamilton Wilkes in Gone With The Wind.

Frail Melanie is a vision of then-popular dreams of the old south: “endangered” was De Havilland’s word for Melanie, the reverse image of the conniving Scarlett.

De Havilland says Melanie was “the woman I wish I could be.”

Good thing for film fans that De

Havilland wasn’t that woman. She sued the factory-like Warner Brothers over the inferior roles she was offered. It became a two-year fight, but there’s still a socalled De Havilland law on the books to keep contracts from indenturing artists.

Few would argue De Havilland did her Olivia de best work at Warner Havilland Festival Brothers, even with a dynamic co-star. That May 6-July 3 was Errol Flynn, whom Stanford Theatre, Palo Alto she loved, and whom she played against in seven ages, from Elizabethan England, to old west Santa Fe, to the Little Bighorn, to the Charge of the Light Brigade.

The fest focuses on key years in this powerful, subtle and delightful actor’s career—from 1935’s Captain Blood to the 1949 My Cousin Rachel. She took a turn into film noir (The Dark Mirror, where she plays twins). She’s a woman gone mad in The Snake Pit. Her two Oscar-winning parts are revived in The Heiress and the unwed mother drama, To Each His Own. One scarce movie, unmissable for cultists of James (Bride of Frankenstein) Whale: The Great Garrick, about the great Shakespearean of the 1700s. Aesop Rock confronts turning 40, regrets, neuroses on new album

LENTY OF PEOPLE dread their 40th birthday, but according to Ian Bavitz—better known by his stage name, Aesop Rock—the idea of being “over the hill” was particularly distressing.

“Being an older dude in a younger dude’s game, it just loomed,” the indie

emcee and producer says. “I think it caused a lot of reflection, and had me thinking of things I hadn’t thought about it forever. I’m still working on everything—I’m a mess in many ways. Things don’t really ever magically smooth out and become easy. It just seems like everyone loses their minds forever and then we die.”

To anyone familiar with the New York-born musician, this train of thought will come as no surprise.

Aesop Rock is known for pingponging from absurdist pop-culture

references, to philosophically astute observations and then wrapping things up with a punchy, existential lamentation.

He’s also earned a reputation for having a voluminous vocabulary.

In 2014, a data scientist even determined that Aesop used more words over the course of his first five studio albums than Shakespeare did over the course of seven plays.

Aesop recently dropped his seventh studio album, The Impossible Kid, and is slated to play The Catalyst in Santa Cruz on May 10.

He wrote the lyrics and produced the beats all while living in a cabin in Washington, where he says he moved in order to get away from it all. Previously, he’s lived in New York and San Francisco—or, as he

puts it in a promotional video for the new record, “I moved from the most expensive city in the U.S. to the other most expensive city in the U.S. and something had to give, honestly.”

The rapper says that he immediately recognized the offer to live and work in the barn—which came to him by way of a friend—as a unique opportunity.

“I recognized it was a romantic concept on it’s own,” he says. “Go to the woods and make music—cool. I might not get that chance again. It was about seeing what I could do in a space like that.”

Aesop ended up looking back—on episodes from his childhood, for example, as well as lamenting the fact that he didn’t pursue a career as a visual artist. Both of those themes are covered on The Impossible Kid’s lead single and second track, “Rings.”

“I used to draw—hard to admit that I used to draw,” he spits on “Rings,” before coming to rest on the biting chorus, where he repeats: “They will cut you down just to count your rings.”

It’s a song about regrets and the perspective age affords, Aesop explains. “I was talking about how, in relation to my artwork, I had heart and loved it all, but maybe never had the confidence and skill to really be a leader in that arena,” he says. “It takes more than heart to be a leader, because there’s always someone out there ready to be the man. I think people are inherently pretty cruel.

Not everyone, but I guess from my experiences, you can never really count on others out there to do the ‘good’ thing.”

On the whole, the album feels a lot like one giant therapy session, in which Aesop is acting as both the patient and the shrink—identifying problematic behaviors, looking back on past mistakes, sussing out his neuroses and then working to move beyond them.

“I’m just trying to find some stability, and a solid support system that understands me,” he says. “It’s an endless quest to feel accepted.”

U.S. Poet Laureate Juan Felipe Herrera returns to San Jose for ‘Legacy Day’

HE STATE’S LARGEST group poetry event will unfold Thursday, May 5, both inside and outside of the Hammer Theater Center. U.S. Poet Laureate and San Jose legend Juan Felipe Herrera will preside over the entire gala hoedown spectacular.

Even though Legacy of Poetry Day features a few dozen poets unleashing their stuff—students, faculty, staff, plus former and current

civic laureates—the party won’t be limited to just poetry.

To begin with, short readings from San Jose State University (SJSU) peeps and community poets will unfold outside the theater from 5 to 7pm.

The next hour will feature a glorious theatrical march of the highest order: Pachanga on the Paseo: A Roving Spectacle of Public Art. It probably won’t fit into any singular category— Chicano, Cuban, Aztec, or Latino—so don’t even try. But it promises to be a cosmic conglomeration of music and dance written by both Luis and Kinan Valdez and directed by the latter.

Presented by SJSU, the Pachanga will blossom into a full-blown procession of performers, poets and audience

members entering Hammer Theater Center—formerly The Rep—all while leading up to an official blessing of the venue by Herrera himself. Another series of readings by several poet laureates from various local cities, including alumni and current scribes, will then take place, after which Herrera will sign any number of his many books.

Bring ‘em if you got ‘em. Once all of that is done, the party then spills right back out onto the concrete, taking full advantage of the normally underutilized and squandered Paseo de San Antonio.

There is no admission fee for any of this. Everything is free of charge, and if you’re anywhere near downtown San Jose on Thursday, you should at least hover on the periphery, because Juan Felipe Herrera, who taught at De Anza College in the ’80s and lived in Japantown, is a legend. Thirty years ago he helped crystallize what’s blossomed into an era of Latino artsand-culture-jamming provocateurism,

and in the process he made San Jose a much better city. Now he’s the first-ever Latino to become U.S. Poet Laureate, although the designation, “Latino,” tends to simplify the dude too much, in my opinion.

It might be more accurate to say Juan Felipe Herrera is an American poet in the Chicano-Zen-hipster tradition, personifying a transnational border-shattering performance-life-art bouillabaisse of Surrealist theater, Dada and Maya cosmologies. He can wax poetic about the intersection of Story and King or the struggle in Chiapas.

He’s conquered academic departments at more than one university. His oeuvre includes standard poetry and prose to the most obscure scholarly publications. He can rant, he can rave, and now he can even bless buildings.

For example, one of the best things ever written about San Jose was a 30-page book of “scenarios” titled ZENJOSE, back in the ’80s. Just as the city was digging up downtown streets in order to install the light rail system and convert the neighborhood from a vast desert of empty parking lots into something urban, Herrera created this little masterpiece of a book. He wrote haiku-like poems and Roberto Segura drew the calligraphy. A copy still exists in the main library but the book is sadly out of print. Herrera used the book to poke fun at City Hall, commuter traffic, million-dollar light rail trains going 1 mph, and even runaway downtown shopping carts looking for their parking lots.

In another book, Mayan Drifter, Herrera journeys to his ancestral homeland of Chiapas and formulates a serious compendium of prose, poetry, travelogue and political ruminations on the systematic demise of indigenous people in Mexico. Written in the first half of the ’90s, the book contemplates the inevitable collapse of nation states, borders and associated identities.

In addition to numerous poetry volumes, Herrera also writes children’s books. He is an uncategorizable force to be reckoned with, still, and therefore perfect for the christening of the new Hammer Theater Center.

Under the auspices of SJSU, the theater now enters a new poetic era.

NE OF THE BIGGEST problems with owning a private dirigible is that they tend to be quite large. Even the compact version Mr. Harada and I operate is just shy of 250 feet. So, while I steered the Von Barfly above the squat skyline of the South Bay, Mr. Harada scanned the ground below with his standard-issue monocular. We identified an appropriate spot on highway 9, brought the Von Barfly down to landing height, unfurled the rope ladder, and staked in our safety lines between a group of Italian sports cars.

Jack Rose Libation House is located at the Highway 9 turnoff, where everyone passes by wondering what exactly is behind the sign that reads “La Hacienda.” Things have certainly changed. Jack Rose is a world-class cocktail bar: reclaimed wood, a casual ambience, excellent food, a decapitated Zebra, what looks like half the personal library of an English Lord, etc.

Mr. Harada and I weren’t sure how to proceed, so we took a seat on the deck and ordered crispy cauliflower, pretzels, house-made sausage, house-made meatballs, butterscotch something or other for desert and enough drinks to water the lawn.

Several thousand calories later, out of the back of the bar, we felt a force much greater than us approach. I heard the tell-tale click of cowboy boots as he turned the corner, wearing black jeans, a black cowboy shirt, and a devilish grin topped by a finely manicured, silver pompadour.

“Gentlemen,” he said, “how’s the evening treating you? Joey Myers.”

Our hands trembled as we reached to greet the legendary rockabilly/ swing drummer/bartender. We shook “hello” and I pondered who else has had the pleasure of meeting Joey Myers: David Bowie, Jimmy Page, Iggy Pop, Lemmy, Eddie Nichols, The Legendary Stardust Cowboy, Pejack, and probably more women than an average human sees in their lifetime.

He’s one of those individuals who lives a dozen lifetimes at once. We share some sordid friends, and with the summer nigh Joey treated us to some seasonal drinks.

As I struggled up the rope ladder into the Von Barfly, Joey winked at us from the redwood deck and disappeared. Was he ever there? He must have, but maybe...
