No News Is...

April has been a black flag month for local media. First there was the bloodbath at KGO radio, where roughly 30 people in the station’s news department were shown the door. Then there was KFOG, where a half-dozen longtime disc jockeys were replaced with machines. South Bay news station KLIV followed a week later, announcing its entire newsroom—about a dozen staffers—would be replaced in a format change to “classic country,” which we guess is more GARTH BROOKS than CHRIS GAINES. But the hits keep coming.

Last Friday, word leaked that the San Jose-less Mercury News would eliminate copy editing for most stories and use software to check grammar. A memo from managing editor BERT ROBINSON landed on JIM ROMENESKO’s media blog, framing the situation in blunt terms. It seems like little coincidence that the news came right after parent company Bay Area News Group named NEIL CHASE its new editor in chief. A journalist turned marketer, Chase will lead the “digital restructuring,” a euphemism for ageism, where experienced professionals are replaced with younger and cheaper content processors—except in one respect: personalities. Merc sports columnist MARK PURDY was reportedly one interested party in taking a buyout but the paper rebuffed him, only allowing reporters—not columnists—over the age of 60 with 20 years experience to accept severance packages. Losing a familiar face like Purdy’s would mostly rile print subscribers, however many there still are, but insiders say the story to watch is how Chase and Robinson get on.

Video game helps illuminate racism felt by African-American men

OU’RE OUT of shampoo. So you grab your coat and keys, and head down the street to the closest grocery store. Whether you end up safely back home, terrified in a jail cell, or zipped up in a body bag has everything to do with your race.

At least, that’s the premise of &maybetheywontkillyou, a game designed

by Akira Thompson to shed light on what it’s like to be black in America.

program alumnus, took the name from over a dozen tweets sent by writer and activist Ijeoma Oluo in December 2014. Oluo’s dispatches came in response to the Department of Justice’s decision not to indict Darren Wilson, the police officer who shot and killed Michael Brown in Ferguson, Missouri.

“Don’t wear a hoodie and maybe they won’t kill you,” one tweet said.

“Don’t ask for help after a car accident and maybe they won’t kill you,” read another.

In Thompson’s game, the player experiences the trip to the store as a young, poor black man. Walking down the street, someone locks their car door as you, the player, walk by.

A cop car slows down and shines

its light on you. In the store, the store owner follows the character down every aisle. In every situation, the player has the option to say something, in which case the scene could dramatically change and end with the police. Or they can choose to “say nothing” and watch their “Frustration Counter” go up and up.

“That frustration—it can only be pushed down so far until it explodes, and the further down it gets pushed, the more crazy and huge the explosion will be,” says Thompson, who is African American.

UCSC literature professor Kimberly Lau says Thompson’s game forces people to understand what it feels like when frustration over racism starts to snowball.

“What is it like, that burden of people constantly being vigilant around you— always being under surveillance, unable to speak against that system?” says Lau, whose recent work includes examining masculinity in the popular “World of Warcraft” game.

Thompson grew up across the river from Matt Hale’s white supremacist World Church of the Creator in Peoria, Illinois, where he and his siblings and a couple of other kids made up the school’s entire black population, he says. Luckily, he managed to avoid blatant or extreme racism outside of microaggressions.

After high school, he enrolled at Columbia College in Chicago and served in Iraq before working with Seamus Blackley, one of the creators of Xbox, at the Creative Artists Agency, and later as a production coordinator at Walt Disney Imagineering. Disney’s resources were ample, Thompson says, but after a while he wanted to create something of his own, and dove into USC’s Cinematic Arts department in Los Angeles before making the move to UCSC. Thompson was drawn to Santa Cruz because of Romero and her husband, John Romero, who were both professors in the digital media department at the time.

Thompson’s newest release, Stop! Thief! was recently made commercially available on iPhone systems and explores how crimes like robbery are perceived when compared with major whitecollar crimes. The larger the scale, Thompson says, the less likely the person is to serve time.

Lau, who was excited to read about &maybetheywontkillyou, but has yet to play the game herself, says that society’s inequalities were carved out of a history of white supremacy, and that’s what his game conveys.

“He’s using the fact that games have a structure to get at the fact that racism also has structure—that there is institutional racism that operates through certain rules, maybe unspoken, maybe unknown or unfair,” Lau says.

Those structures reach deeper than day-to-day encounters, says Thompson. “It goes to believing it,” he says, “having self-worth issues and thinking, ‘Well, society views me this way and everything in society is telling me that this is my value, so this is my value.’”

Thompson formulated the idea for &maybetheywontkillyou the day that his professor, renowned game designer Brenda Romero, showed the class her board game “Train,” which has never been available for sale and explores complicity in horrible crimes. In it, players have to put as many people onto a train as possible. It isn’t revealed until the end that they’re being shuttled to a concentration camp.

That day in class was the same day the court decided not to charge Wilson in the killing of Michael Brown.

“It didn’t feel like justice was being properly served. It didn’t feel like the problem was being addressed in a meaningful way,” says Thompson, who recalls many of his Facebook friends worrying about the rioting and destruction in the aftermath. “When people riot, that is a long-term build-up from some issue that isn’t being addressed, and people feeling so disempowered and disillusioned that they feel like they have no other recourse.”

Thompson channeled his skills into something that could create empathy in people who may have never experienced racism first-hand.

To play the game in person, the player must wear a black hoodie and hold the Frustration Counter.

A moderator holds a large binder, called the Resolution Penal Code, and asks the questions.

A similar online model, available on Thompson’s company website, Rainb.ro, features simple black letters against a white background.

Thompson has presented the inperson version of the game at the Electronic Entertainment Expo (E3), the International Festival of Independent Games (IndieCade), the XOXO Festival and a handful of others.

Reactions to the game, Thompson says, have differed depending on race.

Sometimes he’s met with staunch disbelief, he says, because these people live so far removed from his world that it’s difficult to grasp. He’s got the numbers on hand to back him up.

Police Auditor Wants Data on Use of Force

BY JENNIFER WADSWORTH An avowed atheist has sued the city of Santa Clara for disregarding his demands to remove a Christian cross from a public park.

In a lawsuit filed last week in the Ninth U.S. District Court, Andrew DeFaria called the 14-foot granite cross at Memorial Cross Park an affront to the First Amendment.

The Freedom From Religion Foundation (FFRA), a national group that fights for church-state separation, has joined him in the legal challenge.

Reached by phone Friday, DeFaria gruffly demanded to know why anyone would be interested in the lawsuit.

“Why do people care?” he asked. “It’s something that comes up all the time,

all over the U.S. and it’s always resolved in favor of the FFRA. Other than that, nobody needs to know anything.”

Then he hung up.

The cross stands on a half-acre park at Martin Avenue and Del La Cruz Boulevard, the site of Santa Clara’s second Spanish mission. In 1953, a local Lions Club gifted the monument to the “Mission City” to mark the site where the Franciscan outpost stood from 1777 to 1784.

In the complaint, DeFaria said he lives close to the park, where the presence of the “blatant religious symbol” has forced him to reroute on several occasions. He even bypasses streets around it to avoid an “offensive encounter with the

city’s endorsement of the Christian religion through this symbolism.”

Santa Clara Councilwoman Kathy Watanabe, who’s named as a defendant in the suit with all of her council colleagues, said DeFaria may be reading too much into the statue.

“It’s a landmark,” she said. “It could have been any other religion, but it’s just a landmark that symbolizes the city’s history. Nobody’s using it to proselytize or anything.”

The Wisconsin-based Freedom From Religion Foundation said it first asked the city to dismantle the cross in 2012. After subsequent requests went unheeded, according to DeFaria and the group, they decided to take the matter to court.

In his inaugural report as San Jose’s police watchdog, Walter Katz urges the city to take a better accounting of how and when officers resort to physical force in the line of duty.

Nearly a decade has passed since the San Jose Police Department published a review of useof-force cases, according to the Independent Police Auditor’s 2015 report released Monday.

In 2007, the last time SJPD issued a public report Walter Katz to the subject, the agency found that officers used physical force 1,263 times in 2006.

Before her retirement last year, then-police auditor LaDoris Cordell suggested resuming that annual tally.

Katz has taken it a step further, issuing a formal recommendation to shed light on the issue. “It’s important because transparency is one of the cornerstones of accountability and procedural justice,” Katz said.

Citizen complaints about excessive force fell slightly from 139 in 2014 to 121 last year, according to Katz’s report. Without an annual overview of all use-of-force incidents, however, auditors were unable to put that decline in context.

A troubling trend emerged when Katz looked at complaints through the lens of officers’ experience. Rookies accounted for a disproportionate number of excessive force complaints.

Younger cops were also more likely to be subject to multiple allegations.

Of the 27 named in three or more complaints, 16 had fewer than five years under their belt.

“That piqued our interest,” Katz said. “We don’t know exactly the reason behind this, but it’s something we will study in the coming year.” —Jennifer Wadsworth

OT 10 MINUTES into the parley, Queen Ann Cannon storms out of Antioch Baptist Church to the parking lot.

Behind her, the sanctuary erupts in yells over a chorus of tense whispers.

“I’m done,” Cannon says, shaking her head. “I can’t take this anymore.

I really can’t.”

Interim pastor Gregory Lawson appears at the back door with his bodyguard, along with Tony Alexander, who’d been swearing in newly elected trustees at the church business meeting before a 9-1-1 call cut it short.

“I told him, ‘You can’t do that,’” deacon Barbara Boone apprises a latecomer. “I told him this was illegal, this was a bootleg installation, but he went on with it anyway.”

and-white SUV, lights flashing, as two more patrol cars jerk to a stop in the middle of Julian Street. Neighbors in a few next-door cottages step outside to rubberneck.

“Does anybody have a gun?” the first officer asks, taking slow, deliberate steps toward the church’s crowded doorway. Someone mentioned a weapon to dispatchers, police later said.

“No,” pastor Lawson replies calmly.

“Nobody has a gun.”

Inside, about 100 people pack the worship hall, which thrums with commotion. Some pace the aisles; others remain seated in the pews. A group in the back sings, “Hallelujah, hallelujah, he is wonderful.” Calls for order go unheeded. The canticle gives way to shouts about Satan, scripture and a stolen election.

“Revelations 19: God’s wrath goes through this place, goes through this place,” Boone intones. “Revelations 19:

From the back, a young woman in a floral dress shoots up from her seat and tells Boone, her childhood school teacher, that she should be ashamed.

“Jeremiah 23: woe to the pastors that are leading us astray,” the woman shouts. “I grew up in this church, and what I’m seeing now is disgusting and despicable.”

“Oh, you sit down,” Boone replies.

“You sit down. You sit down. We heard you” “You are holding this congregation hostage,” the woman in the dress continues. “This is our church.”

No, no, no, Boone continues, the church is in thrall of the devil, beholden to greed, afoul of both God’s law and man’s.

The volume rises.

Some folks leave.

As the double door swings shut, a man’s voice sounds through the

microphone: “This is still the house of the Lord.”

Take Me to Court

From the dawn of organized faith, infighting has divided flocks and spawned sectarian spinoffs. These bouts generally remained private, resolved by religious mediation or denominational tribunals. But churchgoers frustrated by regulatory leniency over religious institutions have increasingly turned to the enforcement power of the secular justice system. Now more than ever, clerical disputes over fraud, property and misconduct to play out in American courts.

These conflicts have raised recondite questions about churchstate separation. To what extent should the First Amendment’s religious liberty clause exempt faithbased groups from civil law? How, if

at all, are lawsuits involving religious groups constitutionally distinct from their secular counterparts?

At San Jose’s historic Antioch Baptist Church, a bitter feud over financial oversight has already provoked two restraining orders and litigation over alleged defamation.

Now, after the explosive meeting earlier this month, there’s talk of another lawsuit. Unlike past cases, which dealt with clashes between members, this new legal volley will target church leaders and no doubt widen a rift in the South Bay’s oldest African American congregation.

For the past three years, Deaconess Boone has penned fiery, scriptureladen newsletters accusing church leaders of embezzlement and apostasy. “Without a doubt, historic Antioch Baptist Church was built … on solid rock!” she wrote in one such missive. “Unfortunately, that foundation is slipping and sliding

as the church embraces worldly practices and moves further and further away from truly modeling Jesus Christ.”

In 2013, reality TV judge Greg Mathis sent a gold-embossed invitation to Cannon asking if she would take a libel claim against the church bookkeeper, Cowander Gage, to the small screen. She declined, but slipped the letter into a bulging dossier on suspected wrongdoing at her church. “They wanted to see what these church ladies were fighting about,” says Cannon, who lost the case in small claims court when a judge wrote it off as congregational matter.

In a separate claim, Gage accused Boone’s husband, retired teacher and fellow deacon William Boone, of shoving her as part of the ongoing disagreement about the church’s financial stewardship. He, in turn, filed an injunction against Gage for

accusing him of slander. The pair failed twice to mediate, which may push the case to trial.

More recently, Rev. Lawson’s role has become a point of contention. Church members canned him by majority vote in January. But the deacons challenge the legality of that election, saying only the diaconate can hire or fire an interim pastor. Lawson—a treasurer for Alameda County—lost his ministerial salary and saw his name plucked from the church marquee and scrubbed from the weekly programs.

The pastor-in-limbo continued leading Sunday services, but with a hired bodyguard in tow.

“There’s a sharp divide,” says David Dill, who was baptized into the church as a child and now drives his mother and elderly, ailing father to Sunday services. “It’s disturbing. I’m not going to take one side, but there are basically two factions pitted against each other.”

Trustees control the money, he

explains, while deacons appoint the clerics. In 2013, the two boards splintered into opposing blocs that threaten to fracture a venerated religious institution.

The deacons demanded an audit, something they said the church constitution requires and, at the time, was 16 years past due. The church ultimately agreed, shelling out $10,000 for an outside auditor to review the books for that calendar year. To the diaconate, however, the report looked superficial. They accused trustees of withholding records and failing to show a lineitem accounting. “We were met with resistance at every step of the way by the trustees, by the bookkeeper, by the secretary,” says Deaconess Boone, a retired principal of Cupertino Middle School. “It makes you wonder what is being hidden from us.”

Alexander, a politically wellconnected union rep by trade and Antioch Baptist Church moderator until his four-year term expired earlier this month, downplayed the imbroglio as a family spat. “The church is over 100 years old, they’ve had squabbles like this before,” says Alexander, whose unflappable composure has helped him as a mediator for the United Food and Commercial Workers, Local 5. “The church is still here. The squabbles do get taken care of.”

Cannon, 75, whose family joined the church when they moved to the South Bay from Richmond in 1955, says she’s less optimistic. She calls the trustees “the Renegades, with a capital ‘R.’” “It’s like a cult,” says Cannon, who retired from IBM to become a courtcertified mediator and volunteer for the NAACP and Peninsula View TV. “You have people who’ve hijacked the church for their own gain.”

‘Beacon of Light’ Antioch Baptist Church, San Jose’s first black congregation, initially convened in 1893 as a home prayer group of former slaves, gold miners and other settlers. They later moved from a living room to a frontier-style, false-front wood building on Julian Street. At the time, locals called the neighborhood “Tar Flats,” a reference to its ambient smell of tar weed and, according to historians, the African American families who lived there.

In the years that followed, Antioch Baptist shepherded its flock through earthquakes, floods, the Great Depression, two world wars and the Civil Rights movement. In 1996, San Jose deemed the church a historic landmark, embedding a memorial plaque into the tan flagstone facade that bears names of the pastor during the church’s founding (Cyclades C. Laws in 1893) and its reconstruction (C.W. Washington in 1960).

Juanita Luster, a retired social worker and four-decade church member, points to the congregation’s 123-year record of service. For generations, she says, the flock has fed the hungry, sheltered the homeless and sent

missionaries abroad. For generations, it has met the needs of its own members, mentored youth and housed the poor. “This church has been a beacon of light, a beacon of Christian love,” says Luster, a former trustee. “I will not speak badly of this church. It’s like a marriage. We don’t need to put all the dirty laundry out there. Doing that is not Christ-like.”

‘You have people who’ve hijacked the church for their own gain’ Members on both sides of the fight made a point of expressing how much they care about the congregation. Antioch Baptist is where people raised their children, met lifelong friends and found healing. For more than a century, academic, political and cultural leaders in the South Bay have called this their spiritual home.

The late civil rights activist and author Henry Gage Sr., who served as president of the East Side Union High School District, spent a lifetime in this congregation. As has Ed Clausell, the first black engineering student at the University of Alabama in Huntsville, who worked on the Apollo moon project and BART in the course of a 40year career in the field. Iola Williams, the first African American to serve on San Jose’s City Council, attended Antioch Baptist before moving back to her home state of Texas.

Parishioners agree on one point, at least: Antioch Baptist Church is a cultural gem. Some believe that its future hinges on becoming more transparent, while others believe a truce is required to save it.

No one denies that the church has struggled to stay solvent. Like many nonprofits, donations have been slow

Lawson preaches the gospel of John, zeroing in on a passage about the woman from Bethany who washes

Christ’s feet with her hair and costly oil. The sermon hook riffs on Willow Smith’s Top 40 single, “Whip My Hair.”

Mentioned only in passing is Judas, everyone’s least favorite disciple.

Christ’s future betrayer groused about the woman using designer oil to “whip her hair” in divine adoration when money for the spikenard could have fed the poor. But Judas couldn’t care less about the needy, Lawson says, because he was a thief who controlled the group’s money bag. The message—set to a triumphant organ and piano accompaniment—rouses the congregation in song and ends in prayer.

Lawson, the seventh of eight children born to a Baptist preacher, followed his father into the ministry. He remembers delivering his first sermon at the age of 5, from the wooden porch of his family home in Bastrop, Louisiana. As an adult, Lawson’s love of theology was matched by his fascination with numbers. In addition to a master’s in divinity, he earned an accounting degree from California State University, East Bay. He worked as a corporate auditor for AT&T before becoming a controller for the city of Oakland, a chief financial officer for the city of Richmond and treasurer for Alameda County, where he still works.

The Antioch Baptist deacons who hired him as interim pastor chose him largely because of his accounting expertise. “We need both a spiritual leader and a financial leader,” Cannon says. “We found someone with both. He’s young, but he has what we were looking for.”

When he came to the church in 2014, Lawson began hosting midweek Bible studies and ramping up outreach to lure back younger members to the mostly elderly congregation. Though people would attend the Sunday services regardless of the conflict over church governance, people began to view the Wednesday night prayer group as a meeting for one faction of the church.

“Maybe they started to see it as something for ‘that group,’” says Lawson, who’s dressed down in athletic pants, sneakers and a leather jacket after a recent midweek prayer service. “I don’t know. I tried to convey to them that I’m not on this side or that side—I’m on the Lord’s side.”

to pick up since the economic collapse of the previous decade. IRS records show losses and depreciation going back to at least the mid-aughts. The church, which manages a neighboring six-unit low-income apartment complex, paid off since 1999, has routinely spent about twice as much on upkeep than it collects in rent.

For some members, the 2012 audit raised as many questions as it answered. In 2007, the church loaned $25,000 to a related nonprofit—the Antioch Housing and Economic Development Corporation, whose tax-exempt status has since been revoked—to expand a nearby African American community center. San Jose promised another $75,000, but withdrew once the state shuttered its redevelopment arm in 2011. The project has since stalled and questions lingered about the loan’s repayment.

Even if no misconduct comes to light in a forensic audit, some members suggested that an independent review would give a fractious flock some peace of mind.

For years now, the infighting has discouraged people from tithing, according to the Boones and other church officials. Expenses are up and revenues down, a trend that predates this festering dispute.

“Religious organizations, by their very nature, don’t have a lot of controls in place” says Chris Marquet, founder of security consulting firm Marquet International. “The people drawn to these groups tend to come for the greater mission, not because they necessarily have the financial expertise.”

About a month earlier, Lawson recalls driving up to the church to find one of its members removing his name from the signboard. He sat in his car, unsure of whether to say something or deal with it later.

His name is also conspicuously absent from the church’s website.

For the past couple of weeks, a guest preacher has delivered the sermon while Lawson reflects on how to move forward after the business meeting that ended with police presence. Antioch Baptist has gone without a permanent senior pastor since Dr. J. Alfred Smith Jr. ended a six-year tenure to succeed his father at the historic Allen Temple Baptist Church in Oakland.

Since then, it’s been a revolving door of guest preachers and pastorsin-the-interim, like Lawson. The church constitution sets a high threshold for installing a permanent pastor: 70 percent approval from sworn members. “Now how’re we going to do that?” Cannon says.

“We can barely sit in the same room together, except to worship.”

Rev Run As with any religious organization— most of them tax-exempt, governed by laissez faire corporate codes and internal bylaws—the Antioch Baptist plaintiffs will have to cast their battle as secular. Otherwise, a judge could dismiss the case on a core constitutional tenet: the separation of church and state.

Toward the end of the 19th century, courts deferred to clerics or the congregational majority to settle disagreements over church property.

In 1979, the U.S. Supreme Court determined that legal principles applied in secular property disputes could extend to religious institutions. The rules get a bit murkier when it comes to personnel and membership. Civil rights laws generally prevent employers from hiring based on race and gender, but exempt religious entities. This “ministerial exception” means the government cannot force the Catholic Church, for example, to open its priesthood to gay or female clergy.

When it comes to internal disputes, the courts can review whether a congregation followed its own

rules, as long as the judge sidesteps matters of religious doctrine. If a person affiliated with a religious group commits an offense, the courts generally apply the same standards of civil and criminal law that they would to a secular organization.

Still, even deeply ideological battles have a way of morphing into civil and criminal matters. When the Episcopal Church USA ordained a gay bishop in 2003, some congregations tried to secede, leading to legal wrangling over property. An exact count is hard to come by, but in the cottage industry of religious reconciliation, experts cite a statistic that brings the annual number of church conflicts in the U.S. to 19,000. A fraction of those go to court, but even that’s hard to tally because the cases come in the guise of property or personnel issues.

Dianne Mason, an attorney who founded OneAccord Reconciliation Services to coach congregations through their differences, says church litigation is on the rise. “Historically, lawsuits against churches have been viewed by Christians as tantamount to challenging God—dangerous, shameful and not an option,” she wrote in a newsletter to clients.

“But times have changed. In today’s litigious society, many churches are not only being sued, but they are being sued by their own employees.”

Last year, the Fremont-based Islamic Society of the East Bay turned to a court-appointed arbitrator to wrest control from its president.

The ouster capped off two years of turmoil, accusations of corruption and physical confrontations.

Hundreds of civil lawsuits filed in Santa Clara County Superior Court by religious groups this past decade touch on similar issues—property, personnel and broken contracts.

In the event that ecclesiastical disputes rise to the level of a criminal case, they tend to involve allegations of theft or abuse. Church on a Hill, San Jose’s second-oldest Baptist church, was found financially liable for hiring a child molester, Keith Woodhouse, who was convicted in 2014 of abusing nine girls. Earlier this year, a federal grand jury accused couple Jonathan and Grace Chang of swindling $7.4 million from a fellow member of Saratoga’s Home of Christ Church. In 2015, the

‘I want people to be aware of what is happening here and concerned enough to change it’ That last call came from Rev. Lawson, who also alerted Steve Bills, head of the church’s parent denomination, the Oregon-based American Baptist Church of the West.

In a conversation with Metro, Bills said he doesn’t believe there’s any fraud, just concerns with transparency and who has the authority to appoint interim ministers in a church that has languished for years without a permanent pastor.

The letter he addressed to the church in January, however, he took a more urgent tone. Antioch Baptist, he wrote, must conduct a forensic audit to shed light on “apparent financial discrepancies.” Bills advised church officials responsible for the money to step away until the

insurance company completes an investigation. The church, it continues, should hire independent financial managers and cooperate with auditors and the police.

“Anyone hindering this will be dealt with severely,” the letter cautioned. In light of Lawson’s financial qualification, Bills concluded in a scriptural kicker, “Who knows whether you have come to Antioch for such a time as this.”

Around the same time, Lawson got a notice under the official church letterhead: “I’m writing to inform you that Gregory O. Lawson’s contract as senior pastor in the interim has been terminated effective immediately.” A second note arrived from the deacons on the same stationary stating that, for the record, Rev. Lawson “has not been terminated.” But three more followed insisting that the members have spoken, and Lawson is out.

Carry On? Last week, Cannon says, the church changed the locks to the pastor’s study. It’s still unclear whether Lawson plans to come back. The deacons have hired an attorney to sue the church to get access to the bank accounts. “It’s come to this,” Cannon says.

Deaconess Boone says she hopes a lawsuit will serve as a wake-up call.

“Remember, this is about stolen money,” she says. “I want people to be aware of what is happening here and concerned enough to change it.”

Dill, who says he’s not trying to play the devil’s advocate, called any suggestion that embezzlement occurred an alarmist take, as insurance auditors already resolved the matter of the missing cash. “There isn’t any,” he says. “They checked.

Everything’s fine. You can’t make a wild, general accusation without something to substantiate it.”

Alexander says the church will carry on, as it has in the face of every other challenge. Consider, he says, that the members have spoken, the pastor’s been fired and the claims of wrongdoing settled and cleared.

“If they want to litigate, that’s up to them,” he says. “But whatever the result, some people will like it and some people won’t.”

District Attorney’s Office charged three people in an embezzlement scheme involving San Jose’s Tofatolu Congregational Church.

Members of Antioch Baptist Church have tried to summon law enforcement, but, according to police records, lacked evidence to merit an investigation. In January 2014, a trustee called San Jose police to report grand theft, naming seven fellow trustees as suspects. In October, a church member reported a burglary, saying that someone pried open the door to an upstairs archive room and stole several files and Bibles. A month later, police took another report of embezzlement of at least $30,000 by six suspects.

After penning two For Dummies books about leadership and communication, he shifted his attention to the historical realm where he found the story of a Christian couple, Frans and Mien Wijnakker, who saved two dozen Jewish people from the Holocaust. Written in 2011, Marty dug into his roots as a history teacher and has shared this tale at more than 400 events ranging from people’s homes to this year’s Holocaust Remembrance Day in New York. Choirs harmonize in swelling, sweeping progression over twangy tabla taps and haunting whines coaxed out of the sitar as dances, narrations and multimedia projections provide visual accompaniment to the audio. In 2005, after the deaths of several family members, Michael Deni left his home in New Jersey and came to San Francisco.

Combining synthesizer and guitar, he funneled the emotions unearthed by that tragedy into songs that he shared at local open mics. After finding cellist Nathan Blaz and drummer Brian Ostreicher at one of the gigs, the trio formed Geographer and rapidly became an alt-electro sensation. They blend analog and electronic influences in their live performances—looping lyrics and modulating the cello with effects pedals into an amorphously excellent sound of subdued dance beats, astral synths and soulscraping lyrics. No American child has entered their teens without first mimicking the guttural hum of a lightsaber. In an effort to raise $20,000 for the Make-A-Wish Foundation, the Toronto-based Newmindspace will be bringing their nationally touring lightsaber mega-battle to San Jose. Dubbed the “Cats in Space Tour” because Disney doesn’t play games with its intellectual property, the organizers have been massively successful—drawing over 10,000 people to their battle in San Francisco on a chilly day dampened by pouring rain. By donating $10 for a plastic, um, light sword, participants will be able to recreate a youthful fantasy on a grand scale. (JF)

Parents and those who pay attention to education news will be well acquainted with the acronym “STEM.” Shorthand for “science, technology, engineering and math,” it’s been a buzzword for the past five years. “STEAM” is an expansion of the same concept—with an A added for “art.” This weekend, through the end of May, students from Menlo Park’s Synapse School and Redwood City’s Connect Charter School will be demonstrating the power of STEAM—showing off the work they did for the Data Art Project, which combines art, design and music, with engineering, science and math.

Channeling the aesthetic of turnof-the-century goth rockers, RVLS exist as time-travelers from an angstier time. Fronted by the ankh pendant-wearing Kalie Wolfe, this quintet of punk rockers lays down hard-driving buzzy riffs and crunchy percussion to propel Wolfe’s piercing, anguished lyrics. Hailing from SoCal, they’ve climbed their way from tiny backyard parties to the national “Emo is Back” tour. Silicon Valley Open Studios marks its 30th year with three weeks of art

OR 30 YEARS, Silicon Valley Open Studios has connected South Bay and Peninsula artists with members of the communities where they create.

Next month’s three-weekend event features more than 350 artists working in just about every medium imaginable: watercolor and oil paint; mixed-media, jewelry and assemblage; mosaic and glass; sculpture and woodworking; and photography.

Launched in 1986, the event coordinates with artists who voluntarily open their studios to art patrons, collectors and anyone who is interested. It gives art lovers the chance to meet with artists working in their own backyards and gain an understanding of the artistic process.

Many of the exhibitors show their work in the very studios where they create, and sometimes those studios are located at the artist’s home, which makes for an even more intimate experience.

SVOS has continued to grow over the years, as veteran artists continue to participate and new artists join

the ranks. This year it will stretch from Gilroy to Burlingame, with more than 150 studio spaces and galleries open to the public.

“The fact that this event has lasted for 30 years is a testament to its popularity,” says Mel Thomsen, executive director of SVOS. “In fact, SVOS grows bigger every year because visitors enjoy interacting with the artists and seeing a lot of their work at one time. The event also provides an easy, cost-effective way for art enthusiasts to start an art collection.”

One of the goals of SVOS, a nonprofit organization, is to help budding artists attain exposure—both from the public and from art professionals.

“Owners and curators of many of Silicon Valley’s finest galleries and museums attend SVOS, looking for new talent,” Thomsen says.

James Arakaki is one of the artists participating in SVOS for the first

time. The Campbell artist is an industrial designer and photographer by trade. He’s created everything from company logos to bank card readers. Even his art has a utilitarian streak, which makes sense considering his father taught him the basics of drafting. He also fashions guitars and other stringed folk instruments out of wooden cigar boxes. As one would expect from a draftsman, all his work features smooth, precise lines.

Kerith Lisi is also a first-year exhibitor. She uses collage as a way of paying attention to the little things. Pasting together scraps of print media—snippets of text and photographs from magazines, title pages of novels, and even yellowing, age-worn blank pages from the back of books—the Redwood City artist turns ephemera into something more permanent. “I layer old with new,” she writes on her website, “imbuing each piece with a sense of time and history to tell a new story.”

Photographer Stephen Toll captures arresting images of the natural world. He spends much of his time traveling and documenting his trips with snapshots of wildlife, landscapes and close-up abstractions. His goal, he says, is to enable others to see and enjoy the world as he does. “I seek to capture images that speak to the viewer— that evoke the feeling of a scene the way it spoke to me.”

Veteran exhibitors also continue to participate in SVOS. Palo Alto artist Martha Castillo has been a part of Silicon Valley Open Studios for 18 years. She makes clay monotypes, which evoke the rustic charm of architectural decay.

Using layers of texture and color, she creates non-representational abstractions—allowing the viewer to create meaning, or simply appreciate their rugged beauty.

Punk band battles Patrick Stewart in hillbilly hostage flick ‘Green Room’

RITER-DIRECTOR Jeremy Saulnier’s indie thriller Green Room is about one of those scenes that never changes even as the years go by, like prison, the military or academia. Still, the new film by the director of the expert noir Blue Ruin seems as if it should have been set 1987 or so.

There is still enough of a punk music scene in 2016 to permit a trad punk rock band to drive an Econoline van from gig to gig. And likely, there’s still a quantum of racist skinheads still fouling what’s left

of that scene. There are excuses in Green Room’s script made for why the musician protagonists don’t have an online social media presence. There is also a lot of extraneous business about cell phones that get broken or don’t work and don’t figure into the plot. The movie would have worked better in the lonelier days before constant electronic communication, but it also would have cost more to make as a period piece. Finally, Green Room gets into its groove as a punk rock hostage situation, a crisis facing a quintet of people who only dress as if they’re tough and feral.

The Ain’t Rights are a four-piece punk band from D.C. (“Actually Arlington” they explain in an interview with a music journalist).

They’re touring the Pacific Northwest, running on siphoned gasoline and surviving the kind of

shows where the payoff is a free lunch and $6.78 each. In Astoria, Oregon (called “Seaside” in the film) a fan and show promoter tips them off about a forest roadhouse where they can play. “It’s a boots and braces crowd,” he warns. Sure enough, the blockhouse-like club is full of white supremacists with Bic’d skulls.

After provoking the racist audience with a cover of Dead Kennedys’ “Nazi Punks Fuck Off,” the band returns to the green room to find a freshly dead girl with a knife sticking out of her temple. Nearby are a pair of louts: Big Justin (Eric Edelstein) and the dead-faced and enormous murderer Werm (Brent Werzner). Also on hand is Amber (Imogen Poots), an undersized girl with a patchy Chelsea haircut. She saw the killing, and thus she knows she’s done for.

As witnesses to the crime, the band can’t be allowed to leave. That’s when the club’s owner—the ringleader of a secret backwoods drug operation— arrives. Darcy (Patrick Stewart) has to reluctantly fix the mess; his plan is to kill the band, tear up the bodies with

pit bulls, and tell the cops the strangers were intruders looking to steal gasoline.

Nazis make peerless villains—one of the white supremacists has a tiny swastika tattooed on his cheek, like a beauty mark. The problem is to not let them speechify too much.

Stewart’s air of regret and lack of dogma marks him as the fiercest man around. An exchange between Stewart’s Darcy and a survivor of the rampage: “It’s been like a nightmare.”

“For all of us,” he answers.

Not every actor could make that regret seem plausible. Bearded with Lenin-like spectacles, Stewart brings depth to this commercial kind of movie. He’s quiet, but he’s quite formidable—you have no doubt he could keep his warriors in check, even the personal guard of killers to whom he awards red bootlaces as a badge of authority. When Darcy makes an aside about “that boot party last year” it’s a little scarier imagining it than actually seeing the stomping in question.

Amber and the band of four turn out to be harder to kill than they looked.

Drummer Reese (Joe Cole) knows some martial arts; Pat (Anthon Yelchin) gets his arm chopped up but duct tapes it back together. The intrepid female guitarist, Sam (Alia Shawkat), makes an improvised spear from a fluorescent light bulb. We can expect Shawkat to survive—and not just because she’s a girl and girls always make it to the end of horror flicks. Here, the actress who starred as George Michael’s cousin in Arrested Development and once played Ilana’s lookalike hookup on Broad City, seems as tough and lowdown as Michelle Rodriguez.

This is lesser Saulnier, for all the slow aerial shots that make this lonely forest look like a green hell. He doesn’t set up the surprise motive for the murder coherently—we have to put it together ourselves. (It’s a movie that’ll make more sense on repeat viewings.) Nor does he come up with a twist finale.

Still, Green Room is a strangely involving as any movie contained by the bloody hillbilly-attack genre. Mostly, it’s a credible daydream of a tour gone wrong: a movie about the punk rock life, rather than a thriller with punk rock sauce dumped over it.

L

IKE SO MANY musicians, Emily Kinney began her singing career with an act of rebellion.

“We lived in Wayne, Nebraska, at the time, and I think I was 7,” she says.

“I saw an ad for a talent show and I told my mom I wanted to sing in it.

She didn’t want me to. But then I filled out the form and sent it in anyway.”

Now 30, Kinney has come a long way from singing in talent shows.

An actress as well as a musician, her first big role was playing Mo Rocca’s

younger sister on an episode of “Law & Order: Criminal Intent.” But the role she is most widely known for is the optimistic, peaceful (and now deceased) character of Beth Greene from AMC’s “The Walking Dead.”

By the time she was cast for the show, she had already been performing as a musician around New York. Knowing this, the showrunners gave Kinney’s character multiple singing parts as diegetic music on the show, covering three Tom Waits songs, as well as the song “Be Good” by Waxahatchee.

“The lucky thing is I love Tom Waits, and we kind of established that Beth was a fan as well,” Kinney

says, fondly recalling her involvement in the show’s musical selections.

“That Waxahatchee song is actually one I sent to them. I was like, ‘Hey, have you heard this girl?’ I’m a music fan, and she was someone I had seen and thought this song could be cool.

And they liked it.”

It’s clear that Kinney loves music.

Her enthusiasm is audible as she speaks about the musicians she enjoys. “It’s funny how, as I’ve been writing, I feel like the music my parents listen to has stuck with me.

As I’ve gotten older and made music myself, that stuff has stuck with me.”

Kinney’s own sound is clearly influenced by American singersongwriters. She counts both Joni Mitchell and James Taylor as lifelong favorites, two musicians that she always returns to.

In this sense, there is some overlap between the character she played on

TV—the gentle, guitar- and pianoplaying Beth—and the real person behind the role. The difference between the two calls to mind the proclamation of contemporary philosopher Slavoj Žižek: “Beyond the fiction of reality, there is the reality of the fiction.” There are shades of similarity between Emily and Beth, overlapping traits mapped onto two different people.

“One difference is our age, so the kinds of experiences we’ve had are very different and so the things that I write about might not be what a 17-year-old would be writing about,” she says. “However, musically, they do have commonalities, since it really was the musician Emily Kinney performing those songs, albeit in the voice of a character.

“Even though my songs have a different sound recorded, I do feel they come from a folky, Americana place when I’m writing. In some ways it kind of works. If people were a fan of those songs, when people check it out there ends up being quite a bit of crossover.”

Kinney will be playing solo this month at San Jose’s Streetlight Records. She’s touring in support of her recent full length, This is War, a 10-song collection about fighting for yourself, for your art, and for your space in a relationship. Toward the end of the record, there is a confrontation with the semi-real, semi-spectral character named Molly, a sort of pan-seductive figure who could either be real, be a drug, or be both simultaneously.

“I was trying to describe a situation where it wasn’t just the person that was pulling someone I was dating away from me, but it was also, you know, their needs or addictions as well.”

Kinney and her band recently shot a video for “Molly” that will be released soon, but she’s already looking forward to the next project, with the next album set to begin recording in May. And with a recent pilot shot for ABC, the show at Streetlight is a great chance to see an intimate performance by an artist on the rise.

THE JAZZ SINGER Nicole Henry is just one of many performers taking the stage locally on International Jazz Day.

Celebrating America’s Music EVEN THOUGH IT has been celebrated officially for more than five years, 2016 marks the first time San Jose will participate in International Jazz Day. The UNESCO-Thelonious Monk Institute of Jazz-sponsored event is observed all over the International Jazz Day world, but now, thanks to a collaboration between the city, San Jose State University and San Jose Jazz, Apr 30, America’s oldest and original art form will get its 1pm-8pm, Free moment in the Silicon Valley sun.

Downtown With The Smithsonian Institute’s April Jazz Heritage San Jose Month, as well as upcoming jazz celebrations at the White House, the timing was ideal, according to Brendan Rawson, executive director of San Jose Jazz. “A lot of stars aligned,” he says. “And it felt right for us to do something free for the local community that ties into this whole international initiative.”

The event will be held at Hammer Theater—with the main acts taking the stage inside, and other performers spilling out into the plaza. Formerly home to the San Jose Repertory Theatre, the Hammer Theater is now in the hands of SJSU, which allows for a multi-dimensional use of the space.

With the help of the SJZ Boom Box, a retrofitted mobile outdoor stage, at least four local bands are scheduled to perform on the plaza. Inside, the lineup includes a performance by SJSU’s Afro-Latin Jazz Ensemble and a set by renowned vocalists Nicole Henry and Nicolas Bearde, in collaboration with the San José State University Jazz Orchestra, and directed by Grammy-award winner Dr. Aaron Lington.

But San Jose Jazz is offering more than just the diverse flavors of music and food (provided by a fleet of food trucks). On one side of the building, in the cafe, Arturo Viera, the curator of Latin music for San Jose Jazz, will be giving a lecture on the current world of Latin Jazz and its history, from Puerto Rico and Cuba to New York and beyond. In the main auditorium, there will be a screening of Songs of Lahore, a 2015 documentary about a group of Pakistani Jazz musicians traveling to play with Wynton Marsalis in New York’s Lincoln Center.

While this may be the first time San Jose has come together to celebrate Jazz under an international collaboration, Rawson is confident for the future of International Jazz Day in San Jose. “Hopefully we get a big enough response that we can build a tradition around it,” he says.—Tad Malone

Cultures, anniversaries converge to make Sister City trip a smash

RELAND IS A mystical country, so it seemed apropos to experience last weekend’s USA-Ireland Sister Cities Summit as a mystical convergence on multiple levels.

Thanks to the San Jose-Dublin Sister City Committee, and especially Tim Quigley, a grand-scale embroidering of trajectories all came together in a tapestry of citizen diplomacy, person-to-person and community-tocommunity connections in business, arts, economics and more.

To begin with, the event celebrated numerous historic milestones all at the same time.

Locally, Dublin and San Jose are celebrating the 30th anniversary of their sister city relationship, founded in 1986. Globally, Sister Cities International, the worldwide citizen diplomacy movement President Eisenhower launched in 1956, is celebrating its 60th anniversary.

Ireland was also celebrating the centenary of the Easter Rising that took place in 1916 in Dublin, which precipitated Irish independence. There’s also the centenary of the WWI Battle of the Somme and the 20th anniversary of the Good Friday Accords. Quigley, along with Peter Finnegan, the Dublin

City Council’s director of international relations, spent the last 18 months organizing the event. Nothing of the sort had ever occurred.

For one whole day, panel sessions took place in the meetings facility of Croke Park Stadium, itself an important historical landmark in regards to Irish independence. Any U.S. city twinned with an Irish counterpart was invited to send a delegation, and since San Jose was the organizer, a few dozen local folks made the journey to attend or participate in the panel sessions. Vice Mayor Rose Herrera appeared on a panel with the mayors of Dublin, Liverpool and Guadalajara, Mexico, on the value of city-to-city linkages in today’s world. (Side note: Dublin and San Jose are both twinned with Guadalajara, so word has it a special trilateral union of sorts might already be in the works.)

education and youth, moderated by U.S. Ambassador to Ireland Kevin O’Malley. In O’Malley’s case, he showed a photograph from 25 years ago in his native St. Louis, when he was president of the St. Louis-Galway Sister City Committee and Michael D. Higgins was his equivalent on the Galway side. Now Higgins is the President of Ireland, O’Malley is the ambassador, and there they were, speaking at this summit, one in the morning and another in the afternoon. On O’Malley’s panel we also saw Orla Feely, University College Dublin’s veep of Research, Innovation & Impact, who just happened to be the daughter of Frank Feely, who was instrumental at the very beginning of the San Jose-Dublin relationship 30 years ago. She fondly recalled the initial stages of the alliance and how it forged every level of Dublin’s growth in the technology sector.

Such was the vibe of the entire event. Everyone seemed to be establishing or renewing partnerships or forging new dimensions of citizen exchanges in the areas of education, business, art, athletics or culture, all strengthened by sistercity relationships. To see so many individuals from so many different professions, all championing the role of citizen diplomacy, studying abroad and global fellowship—it was inspiring, to say the least.

With that, the final panel session evolved into the most entertaining spectacle of the whole day. Kathleen Powell of Cinequest could get barely get in a word edgewise with Academy Award-winning director Jim Sheridan, an inimitable Irish legend. Sheridan stole the show and told stories of his humble beginnings, as well as lambasted the church and lamented the government’s decreasing support for the arts. On that same panel, we saw Irish musician Roisin O, who actually came to San Jose State as a foreign exchange student not too long ago. She told great stories about living at the school’s International Center and learning about women’s rights activism in the context of Islam from her Pakistani roommate.

The San Jose-Dublin partnership has now become a model for other cities. Even better, the conference ended with a Henry Miller quote projected on the screen: “One’s destination is never a place, but a new way of seeing things.”

T’S A BUSTLING TIME for new restaurant chains in Silicon Valley, as retail developments grow rapidly and diners begin to embrace mixed models of dining. Lyfe Kitchen is not a newcomer—a highly regarded flagship restaurant opened in 2011 in Palo Alto.

But while the brand has already spread to places like Denver and Chicago, it had yet to open a second location in the Bay Area until now.

The self-proclaimed “fine fast casual” establishment has a fitting location in Cupertino’s Main Street complex, which will be rife with activity now that many of its restaurants have opened and a bullseye-branded department store is soon to join.

This month’s grand opening event treated guests to a Brussels sprouts ribbon cutting ceremony serenaded with an original Lyfe Kitchen song by Stanford’s longest running a capella group, Mixed Company. The new location retains a live herb garden wall, just like the Palo Alto location, symbolizing the “Feed Your Self ” healthy living concept.

The chef-inspired menu showcases tasty ways to enjoy healthy eating. The

piping hot flatbreads were satisfying, especially the fresh mozzarella and tomatoes in the Margherita and the sweet and smoky BBQ Chicken Flatbreads. Lyfe fans like myself have been loyal to the Art’s Unfried Chicken, a baked approach to fried chicken, and the Ancient Grain Stir-Fry, which is a filling dish with alternative carbs. The roasted Brussels sprouts and squash side with cranberries and Dijon vinaigrette are a sleeper hit that has grown into a crowd favorite. It is a must have with any meal and is under $5.

The self-service water bar is a great idea for our drought prone state, but it is a better idea not to miss out on any of the Lyfe Waters. From cucumber mint, Hibiscus beet and ginger mint chia, the infused waters are unsweetened options that are healthy and anything but boring. I had a chance to try the Kale Banana smoothie and Classic lemonades, both of which are refreshing

In an interview with Lyfe’s CEO, Chance Carlisle, he cited several ways in which the brand has maintained its food and service quality at its price point. One way is limiting protein options on the menu to only chicken, salmon, and Mahi Mahi. There is a higher operating cost associated with stocking various types of meat. Second, the mostly vegetarian ingredients are prepared with simple cooking techniques and fewer seasonings, making it quick and easy to get on the plate. And last, the ingredients procured at the restaurants are fresh rather than processed to avoid any extra costs.

While many of these aspects of the business model provide cost savings, it also benefits the consumer who is ensured fresh produce with few preservatives and additives.

Customers order and pay at the counter, then bring a number back to their table where waiters will bring the food as it is ready. This set up, along with the self-service water station that provides chilled, ambient and sparkling options, is another interpretation of the fresh and fast service Silicon Valley has come to expect.

N ACTUAL BELL TOWER on top of the Bell Tower Café gives this downtown Saratoga eatery a bit of a European flair. An espresso machine straight from Rome graces the countertop and goes oh so well with the hammered tin ceiling.

The minimalist glass displays show off just-made Parisianinspired pastries, and outdoor tables and chairs invite lingering over a freshly pulled cappuccino. Even dogs are invited to hang out, with water dishes and free treats at the ready.

This place may sound familiar to Saratoga regulars, but it feels brand new after a significant overhaul by the new owner. Previously known as the Bell Tower Bistro and Patisserie, the reimagined Café has lower prices, a revamped menu, bright decor, two outdoor seating areas with heaters and a big flat screen TV tucked away in the corner. A peek inside the kitchen reveals organized boxes of local organic produce, backing up their farm to table claims.

While the vibe might feel a bit foreign, the food is accessible and fresh ADVERTISER: SANTO MARKET PUB DATE: California fare. Next time I might be brave enough to go for the deep-fried Metro Silicon Valley 1604 version, which our waiter strongly encouraged.

While it was a simple dish, it was well executed—both the pancakes and eggs were fluffy alongside crispy bacon.

While we slowly sipped on coffee ($3), we checked out the menu to ponder our next visit. The breakfast croissant ($8.95) and Persian Omelet ($10.50) with egg whites, basil, tomato and feta were both at the top of the list until we saw the weekly specials, which include Chicken and Waffles ($11.95).

Overall, this updated version of Bell Tower is a welcome addition to the downtown Saratoga scene: unpretentious breakfast and lunch options at affordable prices. Homey American touches like Mason jars for water glasses and free coffee refills complement the streamlined interior, creating a relaxed scene for savoring the morning over pastries and eggs.
