Asked if he was related to this woman who could not get up, one side of her body stretched stiff confused by the staring and snapping.

How everyone turned away silent when I queried again and again if someone had called an ambulance. And you, the not-related one, letting go of her head and allowing her to slump back down on the concrete ’cause all of a sudden you remembered you had more important business to do and quickly walked away. I saw all of you “Millennial-ing” away and not doing a thing. How you were afraid I was ruining the moment. Ruining your future sharing photo posts. I saw that something is wrong with our people. I called 9-1-1.

Principal Oliverio San Jose Councilman PIERLUIGI OLIVERIO terms out in 2016, which will be the first time in a decade the District 6 council seat will be up for grabs without an incumbent. Already, six months from the deadline to declare candidacy, seven people have announced their intention to run for the Willow Glen seat. But in what some candidates called typical Pierluigi fashion, the lame duck councilman is trying to run the show, positioning himself as a kingmaker on his way out the door.

Leading up to the council meeting this week, Oliverio emailed an assignment to his aspiring successors: send a yes or no vote on two items he picked from the agenda. The idea is that by the time a trio of candidate forums takes place next spring—which he’s also requesting the city fund—he’ll have compiled a monthslong voting record for each candidate. “This will provide residents a definitive way to understand how a candidate would vote given the opportunity to serve,” Oliverio wrote. This wasn’t a voluntary exercise, though; candidates who They refused to participate Did would be noted as such.

City Attorney RICK DOYLE apparently received a complaint from a D6 resident and is reviewing the matter.

STRIDENT yellow-andred banner promises cheap, spacious flats, but Donna Hinck tries to temper her expectations.

“Don’t get your hopes up,” she mutters, shaking her head and smiling against her will at the prospect. “Don’t get too excited.”

Hinck, 54 and homeless, waited nine years for her Housing Choice Voucher, known as Section 8. In March, the Housing Authority of the County of Santa Clara, which administers the federal rent subsidy, called her with the good news. On a waiting list 25,000

names and a decade long, hers was the next in line. On April 2, she began her search. With help from a case manager, she typed a renter’s resume emblazoned in one corner with a professional headshot. In a blue binder, she compiled hundreds of printed-out listings, cards and letters of recommendation.

After six months, hundreds of calls, emails and in-the-flesh visits, Hinck has yet to find a home. Next week, her voucher expires, as does a months-long couch-surfing stay at a friend’s East Side duplex. Unless she finds a place by Oct. 1, she’ll move into a downtown San Jose shelter. For now, there’s still some time, however short. To her visit at the cul-de-sac complex with the bold red sign, she wears a floral shawl, her bottle blonde hair brushed into an up-do, her cheeks pinched pink with blush. She cautiously steps past the red door and

into the front room. The unit is bright, white and clean, and smells of fresh paint. “I wish it was mine,” she says, her face twisting into a sob. “I wish one day I can have a home like this, somewhere my grandkids can visit.”

Property manager Cindy Maschke walks up minutes later to let her down gently. They no longer accept vouchers, she says. Not after two Section 8 tenants burned down a couple units and the housing authority took nearly a month to inspect a third. “That was it for us,” Maschke says, wincing apologetically.

“Money down the drain.”

In Santa Clara County, 1,028 people have a rental subsidy in hand but no place to use it, leaving them in limbo, bunking with friends or family, ducking under tents and overpasses or languishing in shelters. An affordable housing shortage, rising rents, red tape and a lingering stigma about people on public assistance have made it nearly impossible for voucher holders to compete with other prospective renters.

Harasz aims to ramp up marketing and has suggested creating a designation for responsible property owners, something to brand them as good landlords.

In the 2014 survey, 38 percent of former Section 8 landlords said they left the program because of problem tenants. Though unreliable tenants aren’t exclusive to public housing subsidies, agency officials say they need to dispel some of that stigma around the program so landlords understand the housing authority’s role. “Landlords sometimes mistakenly believe that the authority screens tenants,” she says. “That’s not the case.

The onus still falls on the landlord.”

With larger property management companies erring on the side of profit in a white hot market, the authority has tried to market subsidies to mom-andpop landlords. But for many property owners who spoke to the agency, the hang-up was not as much with tenants but the bureaucracy. Inspections can take several weeks, putting landlords out a full month’s rent.

Having spent her share of nights in the open air, Hinck feels a familiar anxiety welling up with each passing day.

The idea of bunking in a shelter by next month quickens her breathing, tightens her chest and kicks off a nicotine craving.

“I’m almost old enough to retire,” she says, clutching her Marlboro lights in one hand and her binder of apartment listings in the other. “I’ve never lived in those places. I’m scared.”

After more than 450 listings, hundreds of bus trips and countless false leads, Hinck can’t help but get choked up. Walking away from another rejection, she begins to plot the multi-bus route to her next apartment viewings. Three buses there, three buses back. “No time to breathe,” she says with a nervous laugh.

Days away from being cast out to the streets, Hinck has to submit her application to the Julian Street shelter.

Just in case. Ten days before her voucher expires, she has to request a final extension. If not approved, she’ll have sailed through the Section 8 program never having found a place to live.

Section 8, created in 1974 after President Nixon called public housing projects “monstrous, depressing places,” meant to allow residents to redeem public subsidies with private landlords. The idea was that low-income families could choose their home, live anonymously in a mixed-income neighborhood and achieve upward mobility. With a voucher, a family pays about a third of their income in rent. Market forces, however, have increasingly rendered that golden ticket a false hope.“In this housing climate, where people are applying for apartments and bringing roses and resumes and great credit scores, our participants are really challenged,” says Katherine Harasz, the housing authority’s interim director.

In the past several months, housing officials have been figuring out ways to entice more landlords to participate and improve the odds for tenants. One obstacle is that the U.S. Department of Housing and Urban Development (HUD), which administers the program, arrives at so-called fair market rents based on few-year-old market data.

“What you get is a valuation that’s not fair, not market and rarely enough to cover the rent,” Harasz says.

To close the gap between federal assistance and increasing rents in Silicon Valley, the authority in August raised the max monthly subsidy to 110 percent of the HUD fair market rent. The move will help about 5,760 families and cost the authority about $20 million more. Even by raising the payments to the maximum allowed by law, a gap persists between subsidies and market rents, according to the authority’s board of commissioners chairwoman Kathy Espinoza-Howard.

The agency’s goal is to attract more landlords who endorse the mission of Section 8 even if they can collect higher rents from market-rate tenants. Last December, the authority surveyed 9,000 current and former Section 8 landlords; about 2,000 responded. While 66 percent said they initially signed on to the program because of the reliable monthly payments, many opted out because of low contract rents and slow response from housing officials.

Over the summer, the agency appointed a landlord ombudsman to parse through queries and resolve problems faster. In July, it sent out the

BLUE MAIL Assistant police chief Eddie Garcia’s emails never should have been blocked by the department.

Gmail to the Chief BY JOSH KOEHN EDDIE GARCIA wears his heart on his sleeve, not far from the three stars that line each side of his collar. It’s for this reason San Jose’s assistant chief of police, who’s set to take over as the city’s interim top cop in January, could very well end up becoming a charismatic figurehead for the San Jose Police Department.

But the judgment of SJPD’s secondin-command came into question earlier this year, when Metro published emails by him and other top command staff venting frustration with their civilian bosses at City Hall and scoffing at gift policies. A follow-up request for more emails was initially denied by the city, which said they were personal in nature and their release would cause more harm than good. An appeal was filed, arguments about transparency were made and a committee unanimously agreed the emails should be made public. We reviewed approximately 400 emails, discussed them with Garcia over coffee and came to several conclusions:

1. GARCIA HAD NOTHING TO HIDE The department’s decision to block

the release of the emails was purely reflexive. Garcia admitted in an interview that he was embarrassed by some of the previously reported messages and added that they do not reflect his true character. “I understand I need to be an example for the department and city,” he said.

2. THE NEXT CHIEF LOVES FOOTBALL The vast majority of emails related to a Pop Warner football team Garcia coached in 2014. A devoted father and coach, Garcia often used his city email account to coordinate practices and games. He considers his involvement in youth sports to be an extension of his SJPD duties. “I think it shed a very good light on the department and my work never suffered,” Garcia said.

3. OFFICIAL BUSINESS WAS EXCLUDED Garcia welcomed friends and associates to email him, meshing personal greetings with crime tips. In one message, a parent talks about their kids before alerting Garcia to an embezzlement scam at Samsung. Police say an arrest warrant has been issued

for a former employee, who is suspected of stealing $14,000. There also appears to have been a telecommunications attack in July 2014 near Bellarmine Prep’s campus. Fiber optic lines were cut, causing “one hundred times more damage” than the PG&E Metcalf substation attack. Brian Adams, a spokesman for Bellarmine, said that the sabotage had “no impact at all” on the campus.

4. NO MORE BUSINESS WITH PLEASURE Garcia has created a Gmail account and instructed friends and associates to use that account unless it relates to SJPD business. “It’s something that didn’t register,” Garcia said. “It obviously registers now.”

5. LIKE IT OR NOT, HE’S A BRO Garcia can change stars but not his stripes. He’s the guy who calls people “bro.” He’s the guy who freely tosses around exclamation points and ellipses in emails and texts. He likes the word “Geezus!” Esquivel has steadied the ship in hard times; Garcia will be tasked with boosting morale going forward.

Last week an individual or group claiming to be the hacktivist group Anonymous shut down all websites operated by the Embarcadero Media Group, which runs several community newspapers that span from the Peninsula to the East Bay. The media group’s sites include: Palo Alto Weekly, The Mountain View Voice, danvillesanramon.com and The Almanac, Menlo Park’s community newspaper. Instead of news on the Voice website, there was an image of a person wearing the grinning and mustachioed Guy Fawkes mask which has become synonymous with Anonymous. A message said The Almanac had “failed to remove content that has been harmful to the wellbeing and safety of others.”

The message then exhorted readers to email ANONYMOUS the head of Embarcadero Media, Bill Johnson, with requests to remove offending content. “We do not forgive, we do not forget, we are legion,” the statement concluded.

OVELIST Chang-rae Lee writes about disenfranchisement.

His characters and environments tend to unfold in Hermann Hesse-level proportions of alienation.

Someone, somewhere, always seems to be inner-scrambling to reconnect with a mislaid page of his own composition.

For example, one can imagine Jungian shades of Harry Haller from Hesse’s Steppenwolf and Emil Sinclair from his Demian and transplant them to Lee’s protagonist in A Gesture Life. They may even be distant literary cousins.

In A Gesture Life, Franklin Hata is unable to “let love in.” He’s bereft of whatever possible emotions were even left after serving as a medic in WWII and watching Korean comfort women raped, abused and murdered

by Japanese soldiers. In the book, he appears decades later as an aging physician, famous in his adopted New England town where everyone knows him. Yet he’s emotionally numb and still grappling with those sinister memories, all the while dealing with a promiscuous teenage daughter who hates him. A painful story filled with longing, loss, emotional distance and all the similarly celebrated characteristics of Japanese masters like Yasunari Kawabata or Yukio Mishima, the novel’s isolated, atmospheric style reflects Hata’s condition. Hesse once said that some of his works were processes of self-

individuation for him, in the Jungian sense, and I would go as far to suggest Lee employed similar techniques back when he wrote that one.

A Gesture Life was Lee’s second novel. His debut effort, Native Speaker, launched him to mainstream literary conversation, if there still is such a thing. Native Speaker has been compared to both Ralph Ellison’s Invisible Man and F. Scott Fitzgerald’s The Great Gatsby.

“I don’t think that is an accident,” says Noelle Brada-Williams, who teaches Asian American literature at San Jose State University and will appear in conversation with Lee next week. “[Native Speaker] seems to focus on the search for a canonical identity, even in its form, in a parallel way to its protagonist’s own search for identity. The main character, Henry, seems to be looking to define himself through the various men who have served as father figures to him in one way or another. It seems like Lee was very consciously looking at his own literary mentors as he wrote his first published work.”

Lee’s most recent novel, On Such a Full Sea, a work of dystopian speculative fiction, is a radical departure from the realist material he often employs. Imagine downtown San Jose in the future as a walled-off labor colony built by descendants of a ruined Chinese town 100 years earlier.

The colony produces vegetables and fish for the luxury caste members, the elitist “Charters,” who live across Santa Clara County in a gated community, a place one can easily imagine as a future version of Monte Sereno.

Separating those two enclaves are “the counties”—lawless and deteriorated future versions of the suburban sprawl between downtown San Jose and Monte Sereno.

All jostling aside, On Such a Full Sea is not about San Jose, it’s about Baltimore, but some readers will instantly imagine it here instead.

Even though the book is a work of futuristic speculation, the rigid class boundaries described in its fictional worlds bear eerie resemblances to our own time, especially in San Jose and Silicon Valley, where the differences between the haves and have-nots become horrifically worse as every year goes by.

Lee, who teaches creative writing at Princeton, appears next week thanks to the Center for Literary Arts (CLA) at SJSU, which is part of the College of Humanities and the Arts. CLA stages similar author events every semester, but they’re not just for students. Anyone can attend. Anyone can ask the author about his writing process, his Princeton life, or the alienation and emotional distance so beautifully depicted in his works.

“So many of my students and folks I know around San Jose want to be creative writers,” says Brada-Williams.

“And it is such a gift to be able to meet someone who is successful at it. I also hope that if there are people out there who have not read his work, that his visit will spur them on to read more.”

The District Water World The agency charged with managing the drought—and the water we drink, cook and wash with every day—suffers from an ingrown culture and lax management amidst reports of vendor fraud and multimillion dollar conflicts of interest

BY JOSH KOEHN PURE GOLDIE Water District CEO Beau Goldie says he had no concerns about a conflict of interest scandal involving RMC in Monterey County.

D

EEP INTO the fourth dry year, our behaviors have finally started to change.

As reservoirs drop to crisis levels and creeks run crisp, Californians have changed their routines. Brown lawns and shorter showers have become part of our lives.

Here in Santa Clara County, conservation efforts have taken hold, as usage in July dropped 35 percent from June, which itself saw a 30

percent decline compared to May. The county still remains short of this year’s 30 percent reduction goal—we stand at 22 percent—but if El Niño makes an appearance, and there’s a 95 percent chance it will, we may just make it out of this yet.

The Santa Clara Valley Water District, water wholesaler to 1.8 million people, has championed local conservation. The public agency runs three treatment plants for drinking water. It also manages 10 dams and reservoirs, 400 ponds that replenish our groundwater and

275 miles of creeks and streams.

This year it’s expected to take in $377 million. It’s an operation with revenues in the same league as Uber.

But unlike the ridesharing behemoth that has a 21st Century business model engineered for financial efficiency, the water district runs like a small, tightlyheld family store, where financial benefits are handed out to people in an inner circle.

CEO Beau Goldie has spent his entire three-decade career at the water district, climbing up the ladder to become its top executive. He

succeeded two interim CEOs who took the reins for a combined 16 months when the board forced out 14-year CEO Stan Williams—after Williams bypassed normal hiring processes to create a $184,000-a-year job for one board member without running it by the others.

Goldie’s contract was confirmed unanimously at a public meeting on May 26, 2009. The board spent less than a minute on the agenda item, and the motion/second/discussion/ vote took less than 10 seconds. His salary and benefits—$417,823 as

15 much-needed water supply infrastructure investments,” Goldie said in a press release.

What’s known as “land subsidence” has been a source of concern for the CEO. The depletion of groundwater resources, drained to compensate for water shortages in other areas, can drop soil levels and create sinkholes. In March, the water district began more aggressive talks about creating an $800 million indirect potable reuse plant, which would

In late April, the seven-person water district board authorized Goldie to bypass competitive bidding and execute $10 million in single-source contracts. Goldie argued that there was no time to undertake a qualification process, and he was granted extraordinary executive powers by a 5-2 vote. After the vote was taken, details emerged about the largest of Goldie’s deals: a proposed $4 million payday for the beleaguered RMC Water and Environment.

The district had awarded RMC $10.6 million in 2009 to design a Morgan Hill flood control project.

As the state’s water crisis deepened, RMC expanded its services to include groundwater replenishment.

In proposing the RMC deal, CEO Goldie neglected to disclose

two material facts: first, one of his top deputies is married to a company principal; and second, just weeks before the water district granted him authority to draw up a deal, ex-Monterey County water board member Steve Collins pled no contest to criminal charges for accepting $160,000 in illegal payments from RMC. Metro reported on the conflicts in July, and since that time has conducted nearly two dozen interviews and reviewed hundreds of emails, budget memos and staff reports. The investigation has identified more evidence that an internal “firewall” agreement— intended to prevent conflicts of interest and safeguard the public’s money—was breached. The district refuses to release a copy of the firewall agreement.

More disconcertingly, Metro’s review uncovered documents which appear to show that top executives ignored concerns that RMC fraudulently billed the district for half a million dollars.

Tom and Melanie Melanie Richardson, a deputy administrator at the water agency, is the wife of RMC co-owner Tom Richardson. A former RMC executive recalls meeting her at RMC company holiday parties. Her husband, meanwhile, is actively involved in managing his firm’s business with his wife’s employer.

Just six months ago, on March 14, he provided a presentation on the South Bay Water Recycling Strategic Master Plan to a joint committee of the district and the cities of San Jose and Santa Clara. His civil engineer’s stamp appears on the cover of the master plan report, which outlined new capital spending projects and financing options.

CEO Goldie has repeatedly argued that RMC is the most qualified company to kickstart the county’s $800 million potable reuse water project. The claim, however, remains untested since no open bidding or qualification process ever occurred.

In a phone interview this summer, Melanie Richardson said a “firewall” was put in place by the district to prevent her from having any

involvement in RMC business. Emails suggest a policy started in December 2009, when she told staff to exclude her from all matters related to the company. But six months before that time, she and the water district signed off on two RMC contracts totaling more than $10.6 million.

Melanie Richardson was a deputy administrative officer of procurement at the time, and the water district was one of RMC’s two biggest clients during the second half of the aughts, according to a source with detailed knowledge of RMC’s financials.

As deputy administrator, Melanie Richardson oversaw multiple stages of the consultant contract review and approval process. But in presentations she delivered to the Board of Directors in February and August of 2009, no mention was ever made of her husband or conflicts of interest with RMC. Complaints suggesting a conflict sent to the District Attorney’s office in 2013, but no charges were ever filed—mainly because the 4-year statute of limitations would have expired before the investigation had a chance of concluding.

In her conversation with Metro, Melanie Richardson admitted that the firewall does not require her to leave the room when staffers discuss RMC work.

“That is not my firewall, that’s just an extra step I take,” she said. “It’s not necessarily required for me to walk out of the room.”

The district and Richardson have refused to release a copy of the firewall agreement, citing attorneyclient privilege. Stan Yamamoto, the district’s lead attorney, also refused multiple interview requests, instead issuing the following statement: “As legal counsel for the District, I’m not at liberty to discuss legal advice provided to District employees.”

He went on to add that he would not “comment on the opinions of unknown sources” despite the fact that requests for comment were related to specific documents.

Dick Santos, who was first elected to serve as the District 3 board director in 2000, said he is “concerned” to learn that Melanie Richardson’s firewall does not prohibit her from sitting in on RMC discussions.

of 2013—are in the same ballpark as the county’s chief executive and San Jose’s city manager, though the district’s budget and employee headcount are much smaller.

Although some small budget cuts were made in 2008 by the district’s interim CEO, little has been done little to shed the nickname one newspaper columnist coined to describe its casual spending of taxpayer money: The Golden Spigot.

A 2009 Santa Clara County Civil Grand Jury report cited lax oversight by the elected board. “Most board members seemed unconcerned with the spending practices of the District,” it concluded. “They do not review proposals in detail and rarely cancel projects to control the budget.”

In 2013, the water district tried to hide a $180,000 court settlement with two of its part-time board members—Tony Estremera and Joe Judge, the latter of whom has since retired—by including a nondisclosure clause in the agreement.

The two elected officials wanted to secure lifetime health insurance as an additional benefit for attending a few meetings each week, and the settlement would have gone unreported had it not been leaked to the press.

A year before that, the water district spent $54,000 to create, promote and distribute a short film about itself, just weeks before voters approved a $500 million water parcel tax. Even with deep flowing revenues of its own, the district taps other tax-funded agencies. In 2011, the water district billed the state $384,395 to cover costs to prepare and post 42 meeting agendas, the Mercury News reported.

All of this would seem noteworthy in normal years, but this is wartime for water. Safeguards and procedures developed to promote better financial decisions can be swept aside under the state of emergency Gov. Jerry Brown declared Jan. 17, 2014.

And rate hikes—generally phased in over years to cushion the blow to everyday consumers—are being fast-tracked. This spring, the water district proposed a 13.8 percent increase for South County residents.

“A smooth series of water rate increases had been a part of our long-range planning to address

identify irregularities in hundreds of pages of staff reports and contracts that are filled with engineering jargon, near daily amendments and abbreviated accounting figures.

District staffers say it wouldn’t be difficult for Melanie Richardson to reduce funds from one of the 20 watershed projects she controls, leaving leftover funds for someone else to channel into other existing contracts, including those controlled

by RMC. “Is it possible? I don’t think it happened,” Goldie said. “I don’t mean to be flippant here. Anything is possible, but I don’t think it happened in this case.”

What is possible—and almost certain—is that Goldie and his top administrators have ignored warnings that RMC has manipulated contracts to overbill the district by as much as $512,000.

Zero Work

There should be no hidden agendas, whether it be the with press or anybody else.”

While the agreement remains hidden, one thing is certain: the firewall has been anything but comprehensive. In addition to Melanie Richardson’s ability to attend progress reports, staffers have at times provided her with reports on RMC’s work.

“As you can imagine, sometimes staff forget and then I have to remind them,” she said. “They might ask me to sign off on a document, and I’ll say, ‘No, I don’t sign off on that document.’ You can’t expect every other person in the organization to remember this. Over time it’s gotten better.”

The firewall also failed to prevent Melanie Richardson from conducting performance evaluations of unit managers who performed oversight of RMC contracts. While her subordinates initially sent their own assessments on RMC to a different deputy for review, she was eventually given summaries of how her team members performed, including portions that related to RMC business. This changed in July, shortly after Metro’s initial report on conflicts of interest involving RMC. She does, however, author most of the five-year capital budget plan for flood control, and she manages up to 20 watershed projects, which are designed to protect people and properties from flood damage. Any budget changes above $100,000 must be signed off by the board of directors, but the complexity of the accounting makes it near impossible for part-time board members to

But internal emails acquired through Public Records Act requests suggest exactly the opposite, that Goldie and Camacho have actively turned a blind eye to fraudulent billing.

Roger Narsim, an engineer unit manager for the district who oversees RMC contracts, first sounded alarms about the fraud nearly 18 months ago. His warnings fell on deaf ears. In a message sent April 21, 2014, Narsim noted that RMC had billed the district an estimated $512,000 for work that was never done. He added that it would be difficult to recoup the money and that the district’s lone option might be withholding $46,000 in retention funds. To date that money has not been released, yet Goldie and Camacho both maintain that RMC has never had a district contract cancelled or suspended due to improprieties.

In particular, RMC appears to have received $350,000 in payments for zero hours of work related to the Lower Silver Creek “Reach 6B”

project. The project’s goal was to construct flood protection on the creek so water get could safely flow from Lake Cunningham in East San Jose down to Highway 680. This would protect the communities from a catastrophic flood, the type that occurs once every 100 years.

“In essence, we paid to RMC about $350K for Reach 6B program management work which they did not work for an hour,” Narsim wrote in an email this spring to Camacho.

Narsim has continued to inform his colleagues that RMC violated the terms of its contract by billing the district for non-existent work.

As a result, district staff has been forced to fill in the gap. In an email to a colleague, Narsim noted that the district has expended more than 2,400 hours of staff time to perform work that RMC was paid for.

“As you know, District cannot spend money to work on the tasks that were assigned to a private entity which was already paid out,” Narsim wrote. “This is gifting of public money to private entity.”

Despite these emails stating that RMC had improperly billed the water district for unperformed work, Camacho said in a follow-up

interview last week that Narsim “never brought up any issues in regards to that.”

When Metro read her the emails she received directly from Narsim, noting the misuse of district funds, Camacho changed her story, saying that she did recall such an issue and that the matter was forwarded to district counsel Stan Yamamoto.

Camacho added, “I assume that there was a resolution, because I have not heard of any issues in regards to that, until you brought it up today.”

In a July interview, Goldie suggested he had no knowledge of RMC violating the terms of its contract or improperly billing the district. “I’m not aware of anything where RMC has billed incorrectly,” he said.

Metro requested another interview with the CEO to discuss Narsim’s emails, which suggest the CEO was alerted to the overpayments, but Goldie did not make himself available for comment.

Media attention to RMC’s new deal with the district has already led to a change in how contracts are being negotiated. In August, Goldie signed the single-source agreement with RMC but the deal was capped at $1.28 million, rather than the originally contemplated $4 million. Katherine Oven, a district deputy operating officer, said that the agreement was reduced by $2.7 million because of previous reports

by Metro and NBC Bay Area.

“The main reason is because there’s been so much scrutiny about this contract, we decided to narrow the scope to things that are critical to inform the work of the other singlesource consultants,” Oven said.

RMC senior civil engineer Steve Bui, who handled all of RMC’s watershed contracts with the district, quickly cut short a phone interview after he was asked about the billing irregularities.

Alyson Watson, RMC’s president, said she had no information about improper billings to the water district. “I am not aware of that,” she said. “That’s news to me.”

RMC is no stranger to controversy.

In 2008, it was sued by an Oakland contractor over a botched dig under

the Guadalupe River north of Julian Street, in which a tunnel flooded and trapped an 11-ton microtunneling machine so deep in river mud it took two years to excavate. The city had paid RMC $683,016 for its engineering and design services. San Jose then had to write a $3 million check to settle the case and never got its new sewer line.

In reference to the Monterey County public official who was caught accepting illegal consulting payments, RMC president Watson defended the company, stating

‘We were asked to destroy documents, and we refused,’ says a former member of RMC’s financial team. that its client, the Marina Coast Water District, asked the company to issue a consulting contract to commissioner Collins.

When the Monterey bribery scandal began to come to light, “We were asked to destroy documents, and we refused,” said a former member of RMC’s financial team.

One of RMC’s name partners “asked the staff to delete a lot of documents.

They refused. We refused. The documents were never deleted. We just looked at each other and said, ‘This is just weird.’ I’m not going to go to jail for anybody.”

In a 2011 wrongful termination lawsuit filed in San Diego County by former RMC accountant Karen Aquila, Aquila’s attorneys argue that “RMC did not want to jeopardize $28 million [in public contracts with the Monterey water district] by admitting to its participation in the

after winning the most expensive water district race in history last November. Now chairman of the board, Kremen remains unconvinced by the urgency argument that granted Goldie executive powers in the spring to sidestep the normal consultant qualification process.

“If you had three months to negotiate the contract, didn’t we have three months to get a bidding process started?” Kremen said. “I think it was a sham that it was supposedly so urgent. We clearly had three more months on the bidding process.”

Kremen is troubled by the reports of fraudulent billing. “I call on the District Attorney to reopen the investigation that was closed because of statute issues,” the chair said Tuesday. When informed of the refusal by the district’s CEO and legal counsel to answer questions, Kremen called for full disclosure of all RMC-related matters. “An agency in lockdown mode is not serving the public. Openness and transparency are paramount.”

“I’m more convinced now than ever that there are real internal control issues at the top,” Kremen said.

District board members have already met in closed session to discuss the CEO’s performance, and those meetings will continue this month. Four votes could force Goldie into early retirement. Just this spring he received a 7-percent raise, but sources say discussions now center on whether Goldie should be allowed to stay through the end of this year.

Steve Bui also worked on spinning the Monterey revelations, advising RMC employees “not to believe everything you read in the paper” and blaming desalinization foes “who will do anything they can to try and stop it.”

RMC had been amassing a big book of business with public agencies. “They just got money hungry, power hungry. They wanted more business. They wanted to be bigger,” the ex-employee recalled.

After the problems in Monterey, “they lost a lot of business” and about 20 percent of the staff was laid off.

“We are not responsible for any of the circumstances that led to the contract being canceled, and we’ve been drawn into a dispute outside of our control,” Watson said.

After the Monterey desalinization initiative imploded, RMC had one ace in the hole—Santa Clara Valley Water District—and a new product to sell: groundwater replenishment.

he summer of 2015 hasn’t been solely a dry spell—a wave of ramen joints has risen up throughout the Bay Area. Notably, Myzen Ramen holds its own against the latest batch of slurp-happy noodle havens.

The Japanese diner opened shop in July, and it earnestly tries to evoke its roots, from the row of wooden planks inked with black kanji script to the waiters bellowing “Irasshaimase!” (Welcome!) to each new customer.

Inside, a subdued, jazzy playlist rolls through the speakers in English and Asian languages. Flag banners hang the Myzen logo above the bar, framing a collection of potted (and probably fake) orchid plants. You almost forget you’re actually inside a strip mall in Sunnyvale.

There is also no ridiculous line camped out before the doors open — possibly the first time we didn’t sign up on the waitlist at a ramen restaurant. Though many rationalize that the longer the wait, the better the recipe, I found myself in a better mood after immediate seating.

We started with Chicken Karaage ($5.99), and Myzen wasn’t afraid to take some risk with its version. The breading was on the light side—not particularly crispy or oily, which may disappoint some deep-fried devotees. However, the unique dip, dubbed “bulldog sauce” by our waiter, blanketed the chicken in a sweet and salty zest. Its laundry list of ingredients included apple, vinegar and even caramel. Perhaps not for everyone, but still worth a taste.

The Myzen Ramen ($10.95) came out before we even cleaned off the appetizer. Made with the beloved Tonkotsu base broth, the meal didn’t arrive in the biggest of bowls for its price. Thankfully, the first mouthful didn’t disappoint. The broth—the backbone of any ramen bowl—had a creamy, pure body. Verging away from standard tonkotsu soups, the formula went easy on the salt and instead trusted the robust pork flavor to deliver.

The chashu pork cutlets were a delight. The meat easily gave way and melted as I chewed through each slice, exceeding my expectations of a standard ramen topping. The egg was light on the soy sauce, though the yolk was pleasantly half runny, half gelled. The rest of the toppings were typical, but overall, the bowl roped in the right components where it mattered.

Myzen also offers rice bowls and salads. The Katsu-Rice ($7.99) followed the trend of cooking light, with each sliver of meat cloaked in a thin, lightly fried batter. The dish carried a fresh pork taste decently, though the portion size didn’t add up to a full meal.

ILK TEA, aka bubble tea or boba, was once a fad; now it’s a staple of dessert drinks, a place to duck from the heat, meet up with friends and catch a little free Wi-Fi.

The milk tea genre has been in the Bay Area long enough to develop aficionados like Candy Gomez and Caleb Bui, who became such avid fans they created their own shop selling organic fusion teas. The husband and wife team opened Tea Lyfe in January in San Jose’s Little Saigon district, an area not known for appreciating organic products or paying the markup for it. A milk tea shop may not sound groundbreaking to some, but serving organic products in this area of San Jose with dense Vietnamese and Latino populations is risk taking.

Candy and Caleb grew up in San Jose, so they’re passionate about their product as well as their store location. They took on the extra challenge of growing the market for authentic and healthy milk tea, while most shops in this area make drinks from powdered flavor additives.

The owners personally curate the gourmet teas, which are brewed fresh each day and mixed with organic milk. The couple believes that “a good product is a good product, even if people don’t understand organics [they] do come and ask for healthier products.” Candy’s Latino background and Caleb’s Vietnamese heritage blend together for one-of-a-kind creations like horchata milk tea or the Vietnamese coffee version, VietChata, and Vietnamese coffee-flavored waffles that taste surprisingly like churros.

Tea Lyfe’s ambitions don’t stop at sourcing organically, though. They also strive to source locally by choosing delicious macarons made by San Jose-based Macahhrun (fun bonus: they come in shapes of animals and superheroes), organic milk from Straus Family Creamery and Made in America reusable glass milk bottles.

Tea Lyfe gets a mixed crowd of San Jose State students, people who work at the shop using the free Wi-Fi and a young adult crowd just a bit older than the teens who often frequent milk tea shops. Gomez and Bui are trying to expand their reach by giving out samples at Veggielution and selling on weekends at River of Life Church. They want to convey the message that people should care about what they put into their bodies, as well as what a business gives back to its community.

They play a rollicking combination of spot-on renditions of country classics and outlaw originals, complete with twangy melodies, road-weary lyrics and mournful slide guitar. But you’d be able to guess his hometown even if he hadn’t spelled it out so explicitly. Signed to E-40’s Sic-Wid-It label, Nef is featured on 40 Water’s ode to the North Bay, “707.” And he’s clearly influenced by the man who put the Valley-Joe on the map—Mac Dre. You can definitely hear the late Boss Tycoon in the young Nef’s delivery, which is languid, laced with absurdist similes and over-annunciated. (NV)

SALSA FESTIVAL Courthouse Square, Redwood City Sat, 12pm, Free Things will be heating up in Redwood City this weekend, as the city’s eighth annual Salsa Festival takes over Courthouse Square downtown.

The festival will feature live entertainment on multiple stages, a salsa competition—which will pit both professional and amateur salsa chefs against each other—plus, salsa and tequila tastings. In addition to spicy salsas, a number of local restaurants will be serving food and drinks throughout the day. While the grown-ups enjoy the blazing flavors and adult beverages, attendees of all ages will have the opportunity to engage in a variety of activities, including dancing, art projects and games. The Pear Theatre opens its new season in its new location with ‘The Walls of Jericho’

OUNTAIN VIEW’S Pear Theatre (formerly the Pear Avenue Theatre), which recently moved to a brand-new performance space, kicks off its first season in its new home with The Walls of Jericho, a worldpremiere adaptation of a classic romantic comedy.

The Pear’s artistic director, Diane Tasca, adapted the 1933 short story Night Bus (by Samuel Hopkins Adams, also the basis for the Oscarwinning film It Happened One

Night) into a sweet and charming production for the stage.

The Walls of Jericho, directed by Pear veteran Caroline Clark, stars Sarah Cook as Elspeth Andrews, a spoiled and stuck-up heiress—on the run from her controlling family in Florida and hoping to meet up with her hotshot aviator paramour in New York City.

Though she’s wealthy, she attempts to go incognito by opting to travel by bus. She soon meets happy-go-lucky, street-smart Peter Warne (Drew Reitz), headed to the Big Apple for a business opportunity. He takes a fancy to her, despite her snobby demeanor and complete cluelessness.

When her suitcase (along with most of her cash) is stolen and her desire for a fancy bath at a hotel leads to a missed bus connection, he takes her under his

wing. Thus the two begrudgingly strike out on a long adventure, involving cheap tourist cabins, hitchhiking, car thieves, potatoes, pecans, telegrams and other hijinks. If you've seen any rom-com—ever—you know what comes next. Through a series of misunderstandings and increasingly flirtatious banter, Elspeth comes to see Peter, whom she initially could not stand, in a new light. Sparks fly and soon enough: a happy ending.

Set during the peak of the Great Depression, the upper-crust Elspeth also gets a bit of a lesson in keeping it real, as she sees how hard most of the country is struggling just to get by during hard times. For the most part, however, the story is fun and frivolous.

It's difficult for a while to see what knight-in-shining armor Peter sees in bratty, out-of-touch Elspeth. Still, the two have enough chemistry to be convincing, and Elspeth reveals a bit more heart as time goes on. Cook and Reitz, both funny and appealing, have the most stage time and lines, but a small group of supporting cast members

(Keith Larson, Stephanie Whigham, Leslie Newport and the always-great Todd Wright) play a multitude of colorful characters Peter and Elspeth meet along the way. Dave Sikula has a brief but memorable turn as Elspeth's shrewd Scottish father.

The Walls of Jericho is an old story, but Tasca’s new adaptation is very well done. I enjoyed the way she took many of Adams’ descriptions directly from his story, and placed them into the mouths of her characters. It sounds as if it might come off as artificial and stiff, but Adams’ humorous lines and the characters’ delivery make it work.

I also liked how the show was full of period-appropriate jazz and pop music.

There are no backdrops and set design is minimal, just a few key props. It's a testament to the whole Pear crew that the audience can successfully fill in the blanks using their imaginations.

Just like their previous location, the new theater is tucked away behind the Computer History Museum— hidden amongst the many nondescript buildings near the Googleplex and Shoreline Ampitheatre. Only a small folding sign gave a clue to the theater's whereabouts; you’d never find it if you didn't already have directions. Such a high-quality theater could do with a big marquee or something to improve visibility.

The new space, at 1110 La Avenida St., has twice the seating of the old one and allows for greater flexibility in staging, although it’s still intimate, with a 75- to 99-person capacity. It's nice to see the Pear expand, but the presence of only two single-occupancy restrooms is puzzling—and led to long lines of patrons waiting to use the facilities. One more small complaint: the configuration of the seating for this production includes only one aisle, so getting to and from seats in all but the front row and along the aisle proves a bit of an inconvenience.

Kinks in the physical setup will no doubt be worked out in future productions, as the company settles into its new residence. Judging by the seemingly full opening-night house, the new Pear is off to a promising start.

RIDING THE RAILS ‘Homeward Bound’ tells of the ‘orphan trains,’ which shipped parentless children from New York to live in the Midwest.

Runaway Train ‘Homeward Bound’ is cluttered but caring

RITTEN AND DIRECTED by the Tabard Theatre’s founder and producing artistic director, Cathy Spielberger Cassetta, Homeward Bound: An Orphan Train Journey makes its world premiere at the Tabard’s San Pedro Square stage this Friday.

The plot of Homeward Bound is rooted in the journey of thousands of orphan children sent by the trainload across America in the first decades of the 20th century in search of better Homeward Bound: circumstances. The aim was to place these children with An Orphan Train farming families so that they might live a life on “farmJourney lease,” as opposed to the chaotic and squalid streets of turn-of-the-century New York City.

Sep 25-Oct 11, Homeward Bound focuses on six orphan girls and their $15-$40 attendant who have been placed upon one of those fateful The Tabard trains. On the trip, the orphans learn more about each Theatre, other and connect until they resemble a family, only to face San Jose the uncertainty of finding homes—and more importantly families—out West.

Besides the orphan’s gracious attendant, played by Joyce Taylor, the cast is composed entirely of children and teenagers. Angelina, played by Chloe Allen, is the boisterous New Yorker—fiercely independent but also deathly afraid of rejection; Mabel, quiet and theater-obsessed, is played by Sarah Dorsey; Hazel, played by Ashley Wilson, is a girl still in denial of the extravagant life and family she lost; Brigid, played by Ginger Hurley, gives the standout performance as the exuberant but cynical Irish girl; Elizabeth (Emily Anne Goes) is the quiet, considerate older sister to Rosie (played by her real life sister, Samantha Goes), who is as innocent as she is poetic.

The show is an eclectic mix of media. The set is minimal, save a few chairs for the train ride. Historical, sometimes tragic images slide across three projection screens, Ken Burns style. Narration, video and live music are occasionally deployed, but in no discernible order. At times it’s hard for the audience to stay on top of the overall focus. Is it a musical? A play? A history lesson?

Homeward Bound: An Orphan Train Journey is still a work in progress— but a compelling work nonetheless, and worth a visit. —Tad Malone

First-ever Diamond in the Rough Film Festival comes to Cupertino

HE REINCARNATION of Joan of Arc once walked the streets of San Jose, and even had a regular radio show on KKUP. Premiering at the first Diamond in the Rough Film Festival at BlueLight Cinemas in Cupertino, The Ambassador of God is a documentary concerning the radio psychic and lecturer, Brother Anthony Penera. The co-director (with Francesca Stonum) is Diamond in the Rough festival founder, Mark Schwab.

The Ambassador of God is a very closeup profile of Brother Anthony, seen before he left this spiritual plane in 2013. Brother Anthony seems a blend of Stuart Smalley and Paul Lynde— sarcastically free from organized religion and insistent on the power of love. He preached to his pupils (of whom Schwab was one) against “hate and fear and all the crap that comes with it.” Penera was initiated into psychic mysteries by an Italian lady in Willow Glen named Norma Jean Baker, just like Marilyn Monroe.

He soon claimed to be able to recall previous lives, including one as the Maid of Orleans. In Schwab, Brother Anthony saw not only a student but a chance for exposure. “When I first approached him about making a documentary, he was over the moon,” Schwab tells the camera. “For two

to three years, I was his main public relations guy.”

The danger of this situation—of being a publicity man for a serious eccentric—is spelled out in a film from a few years back, Joe Gould’s Secret; it tells of how New Yorker writer Joseph Mitchell (Stanley Tucci) accidentally killed his own career by shadowing a noted Greenwich Village character.

Devoted as he was, Schwab learned of the “spiritual bully” side of Penera.

Brother Anthony told unverifiable stories; he said he’d taught 40,000 students, including singer/psychic friend Dionne Warwick. Yet to keep a roof over his head, the psychic worked for almost 30 years at the Beech-Nut baby food factory on Senter Road.

Heavy on the talking-heads shots as it is, this tale of a small-time divine has the color of a Flannery O’Connor story.

Schwab’s other offerings at the fest include the not-bad short The Davenport Vampire, shot by himself and several of his students. As a stoner is cornered in a stalled car by a vampire,

there’s both impressive creature reveal and intimidating makeup.

The fest’s name, “Diamond in the Rough,” encourages trepidation—can we see them when they’re polished?

Still, the offering that seemed most like a gem was the Jason Salazar directed/ Schwab-written and photographed short Before You Leap. In it, a couple of young marijuana seekers meet with a new dealer and discover a big bureaucratic hassle. Desperately seeking weed are Ty, a doofus in clashing plaids (Robert Sean Campbell), and his ornery female pal Floyd (Casey Semple). The two have such an unforced rapport that it makes you wish this were a calling card for a feature film.

Max by Rajesh Naroth gives a vision of the intensity with which solitary people love pets, and tells it all through acting. Bettina Devin finesses it with grace as a woman sharing a last day with her companion.

From Australia, Gone Lesbo Gone traces the history of a would-be scandalous film, Lesbo-A-Go-Go (2003),

by Arnold Leavold of Brisbane, Queensland. Leavold was the thenowner of a video store called Trash Cinema. Apparently seeking obscurity and misunderstanding, Leavold decided to emulate one of the proto-porn “roughy” films of ’60s NYC weirdette Doris Wishman—complete with her wandering shots of people’s shoes, the skeevy, guttery cast, and the sudden hair-pulling violence. This red-letter day for the Brisbane underground cost $700 Australian, plus some amount of beer, and almost got one of its stars fired from her day job when word got out in the papers about a shocking scene shot in a graveyard.

If anything, Gone Lesbo Gone is more talking-headsy than Ambassador of God. And it’s no rival to Not Quite Hollywood, the documentary about Australia’s contribution to the realm of cine mauvaise. (The Mad Max movies didn’t come out of nowhere.)

Like many of the offerings at this fest, Gone Lesbo Gone seems of most interest to the budding filmmaker seeking collaborators in the realm of outrageous, small-time, always personal cinema.

LIKE THE JOHNNY Depp-starring Black Mass, Pawn Sacrifice is a monomaniacal character study, which is supposed to leave one in awe of the lead actor's focus. Similar to Depp’s portrayal of Whitey Bulger’s ghoulish solitude, Tobey Maguire plays Bobby Fischer, a 1970s chess champion, buckling under the weight of his burgeoning celebrity and teetering on the verge of madness.

Both Pawn and Mass expect that a blunt competitiveness will make us identify with a climber; movies can make us identify with anyone, as long as they’re playing offense. But Fischer is a genuinely offensive guy: paranoid, mercenary, Jewhating, insufferably arrogant and not very interested in women. One woman is shoehorned into the script, a prostitute (Evelyne Brochu). Asked what she does, she says “I screw people.”

Director Edward Zwick takes it on faith that Fisher must win for the good of the USA, and to take the Soviet Union down a peg: “We’ve lost China, we’re losing Vietnam,” points out Fischer’s government handler (Michael Stuhlbarg).

Even hippies get their patriotism on when they see Fischer’s game: “Maybe the USA isn’t so bad after all!” exclaims an extra. It’s tough to judge what’s more

clumsy, the five ton needle drops—really, The Doobie Brothers? “White Rabbit” again?—or the appeals to the flag, via newsreel Pawn Sacrifice montages of the USSR at its most blustering.

Zwick (Glory, The Valleywide Last Samurai) goes flat and front-and-center, except for some Icelandic landscapes that no doubt paid for themselves in tax credits. Maguire, in endless closeup, seethes as his Russian nemesis, Boris Spassky (Liev Schreiber) flashes a wafer-thin, sardonic smile and walks away with the movie.

Schreiber eroded my patriotism.

He keeps taking the movie into an interesting new direction that Zwick won’t follow. Fisher’s nerves snap audibly, and Spassky murmurs “You don’t look well, Robert James.” The easy way to make Pawn Sacrifice function would be to give us more Spassky—to show Spassky’s own share of hard times; something that would have built to a moment of communion between the battlers. As it stands, Pawn Sacrifice encourages us to see Fisher as a Cold War casualty who cracked up to keep us free.

REUNITED AND IT FEELS SO GOOD After a six-year hiatus, Strata frontman Eric Victorino says the band, pictured outside of their 2014 Blank Club show, are getting used to the idea of playing together again.

Strata is playing the Ritz for the first time, feeling like a band again

RIC VICTORINO is in high spirits when he answers the phone.

Why shouldn’t he be. It’s Friday evening, the laughter and his initial distraction indicates he is amongst friends. Plus, he notes, “I’ve been drinking some wine.”

But Victorino has plenty more to be cheerful about. Not long ago, he surpassed the crowdfunding goal for his planned solo album as E. James. Plus, he has recently resumed rehearsals with Strata—the San

Jose-bred alternative rock band that nearly attained mainstream success back in the mid-2000s, only to see its ascent cut short by a less-thanamicable breakup—and according to the singer, things are going swimmingly these days.

Strata is currently preparing for their first show in about a year.

Their last performance was at The Independent in San Francisco. Back then, they played a set composed almost entirely of deep cuts—the tracks they wanted to play after their six-year hiatus. In retrospect, that might have been a bit ambitious, Victorino notes.

“We played obscure stuff that only the most hardcore fans would know about,” he recalls. “You felt the drag about halfway through the set. It was

like a Foo Fighters set, except without all the hits. It was just way too long.”

That’s not the plan this time around. “I think the novelty for us has worn off a bit,” Victorino says.

“We crafted the setlist for this show the same way we would if it was 2007 and we were on tour. We’re not going for nostalgia. We’re going for the hardest-hitting songs and the ones people want to hear.”

Strata are slated to play The Ritz this Friday, along with Citabria, Cemetery Sun and Louis Wain & The Cats, and Victorino says they aim to make their first appearance at the SoFA club a memorable one. “I’m super excited to be playing there and bring back those old memories.”

The “old memories” to which Victorino is referring were formed in Strata’s early days—back when The Cactus Club was still running—just across the street from where The Ritz is now.

“There’s so much history there,” he says, referring to the Cactus—which

hosted some of the biggest alternative acts of the ’90s, before they were huge, including Green Day and Deftones.

Recalling those days, Victorino says that local bands used to have a place to ramp up—to play a super small stage at first, then getting the chance to open for a larger touring band, which would draw a larger crowd and give a young and aspiring band exposure to a wider audience. “That’s what’s missing [in San Jose] right now.”

When asked whether Strata might be coming out with a new album anytime soon, Victorino says that new music is likely inevitable—it’s only a matter of whether they’ll actually be able to get into a proper studio and press up a proper single, EP or full length.

“I don’t think we’ve ever been able to practice without writing stuff,” he says, explaining that the band usually comes up with new riffs at every practice. “It’s the way we start a jam session—we build on each other’s ideas and song ideas come out and we record all of them. The potential for a new Strata record is always there.”

He also feels that the band is more focused than they’ve been in quite some time—and are definitely the most focused since reuniting back in 2014. “Last time it was like, ‘Holy shit, we’re actually doing this.’ and this time it’s like, ‘Let’s do this the best we can.’”

Victorino isn’t the only one who is pumped about playing. According to the singer, a number of Strata super fans have already purchased VIP tickets for this week’s show—some of them are coming from as far away as Baltimore.

The limited edition tickets give fans the opportunity to hang out with the band during sound check, before the show. Last year, he says, they did the same thing, and a fan of theirs came out from Texas. “To me, that’s the kind of stuff that helps me feel like what we’re doing is important. When somebody loves us that much that they’re going to buy a ticket and come across the country and hang out.”

OPEN HOUSE The state-of-the-art Bing Concert Hall at Stanford will be open to the public this Saturday.

Bing Thing STANFORD UNIVERSITY is inviting the public to tour its relatively new, state-of-the art performance space, Bing Concert Hall, this Saturday.

Opened in 2013, Bing is equipped with a cutting edge sound system and designed to stage works by today’s most forward thinking composers.

For example, an upcoming performance by progressive jazz pioneer, Darcy James Argue, “Real Enemies,” will tell the story of some of the most pervasive conspiracy theories in American history in sound and light. And in early 2016, the space will host Montreal DJ and producer Kid Koala’s imaginative puppet show, Nufonia Must Fall.

On Saturday, Bing will open its doors to a series of free live performances in order to give visitors a taste of the hall and its open-air lobby, the Gunn Atrium.

Bing Outside/In

Bing Concert Hall, Stanford Kicking things off in the concert hall is Lila Blue, a Sep 26, 1pm-5pm, remarkably mature-sounding 15-year-old singer and Free songwriter. Blue cites Regina Spektor and Joni Mitchell as early influences, but on her debut album, Lucille, her tone conjures up a quirkier Norah Jones. Precocious isn’t the right word to describe someone who composed music for an experimental theater collective from the ages of 10 to 14. Let’s check back in with her in a couple of years to see if Lorde and Taylor have become her new BFFs. Speaking of theater collectives: Octopretzel’s sweet-tempered folk music and puppets will wow visiting children and discourage them from sitting still. The group has a theme song that attempts to explain its name. “An octopus has tentacles, that stretch out and wiggle and swim,” the members of Octopretzel sing. “A pretzel is so yummy!” Magician Dante Mancini will also be performing for Bing’s younger visitors all afternoon.

Headlining the open house is the San Francisco-based orchestral indie rock outfit The Family Crest. The band’s style, which stretches folk music to its anthemic limits, is reminiscent of The Lumineers. After The Family Crest, Nonstop Bhangra will preside over an interactive DJ set, featuring live dancers and drumming.

Also on hand, Circus Bella will defy gravity and impress with juggling and other circus acts, while Stanford Taiko will drum away the 3 o’clock hour.

We will be filing a lawsuit against the state for attempting to unlawfully modify a voter initiative (Prop 215) which is forbidden according to the California Constitution.

The first thing that everyone MUST know and fully understand is the federal “Supremacy Clause.”

The Supremacy Clause is the provision in Article Six, Clause 2 of the United States Constitution.

This establishes the Constitution, federal statutes, and treaties as the “supreme law of the land.” It provides that these are the highest form of law in the United States legal system, and mandates that all the state judges MUST follow federal law when a conflict arises between federal law and either a state Constitution or state law of any state.

Question: How can any state (Colorado, Washington, Oregon & Alaska) or California in this matter establish any state law or amend the state Constitution without violating the “supreme law of the land” known as the federal Controlled Substance Act? Answer: In our opinion...they can’t! As long as federal laws like the CSA, IRS Rule 280E and federal banking laws exist NO state can lawfully legalize something that is federally illegal! The federal governmental entities may NOT prosecute or pursue the states themselves but they’ve recently made it clear that they will go after organizations and individuals.

Conclusion: We already have Prop. 215 known as the “Compassionate Use Act” here in California which does NOT fly in the face of the CSA for a reason. Remove (amend) the “grey” area from SB 420 to STOP the unlawful vendor model dispensaries from illegally “selling” and “profiteering” from a controlled substance and the transactions. Make a few changes (amend) to the “draft” closed-loop version of the AG Guidelines that have been sitting on The Attorney General’s desk for almost four years now. It’s just as simple as that and then California will have the laws that already exist written properly and in accordance with federal law as much as possible instead of what other states are doing and then NO individual or organization will have to live with the threat of potential federal prosecution.

Ah, yes, your love is like a summer’s day—if a summer’s day chased its lemonade with two Red Bulls and a fiveshot latte.

It’s easy for you to assume you’re in your right mind, just because you haven’t started throwing peanuts at people in the park while debating abortion with a squirrel. But there are three stages of love: the “falling in it” stage, the “figuring out how it’ll work” stage, and finally, the “you’re the one!” commitment stage.

You’re in the starting days of the “falling in it” stage—getting hit by rushing hormones and neurotransmitters— which is to say that you’re chemically dazed. Which is to say that making any sort of decision about what you two have is like getting really high and going off to sign papers for a bank loan.

In fact, according to research by psychiatry professor Donatella Marazziti, it’s likely that right now, you and this guy are each chemically different people— and thus behaviorally different people— than you will be once the chemical storm dies down. Marazziti found significant shifts in testosterone levels in both men and women who’d recently fallen in love. Compared with single people and

people who’d been in relationships for a while, women newly in love had elevated testosterone, likely making them more sexually tigress-y, while the T levels of men newly in love dropped, likely making them more gooey and emotional—to the point where even a Navy SEAL might start sounding like a Valentine’s Day card.

How long the biochemical inebriation lasts varies, but Marazziti’s research suggests that couples are pretty much out of the falling in love daze a year to two years later. It’s only then—once you sober up—that you find out what you actually have together.

The kind of love that sticks around is not just a feeling but a feeling that inspires loving action. As novelist Marlon James, quoting a former lover, put it: “Love isn’t saying ‘I love you’ but calling to say, ‘Did you eat?’” Love that lasts should also inspire a sort of loving inaction—loving the person enough that you don’t hate them for all the ways they turn out to be a total idiot: how they can’t seem to understand that pee goes in the big white porcelain thing, not on the floor; and that socks left on the bedroom rug will not grow tiny legs, crawl up the hamper, and fling themselves in.

I prefer to meticulously build and thoroughly test my wings before trying a quantum leap. But I have observed that Aquarius is one of the three signs of the zodiac most likely to succeed with this approach. And according to my astrological calculations, the coming weeks will be a time when your talent for building robust wings in mid-air will be even more effective than usual.

PISCES (Feb. 19-March 20): You are being tempted to make deeper commitments and to give more of yourself. Should you?
