Measure A, approved by Santa Clara County voters in 2000, is a 30-year half cent sales tax generating revenue to enhance the county’s public transit system. Although revenue collection did not begin until 2006, numerous Measure A Program accomplishments have been achieved during the first eight years, all significantly benefitting county residents and commuters.

A few key Fiscal Year 2014 accomplishments are: ‡ VTA’s Extension of BART to Silicon Valley, which will provide more transportation options and reduce congestion, is ahead of schedule and under budget. Service projected to start late 2017. ‡ Santa Clara/Alum Rock BRT will provide faster, more frequent service with increased customer convenience and amenities. Water District CEO signs exclusive deal with tainted contractor

A

S CALIFORNIA prepares, in its fourth dry year, for all manner of apocalyptic scenarios—from rapidly depleted drinking water sources to Dust Bowl-era dirt farms—the thought of Silicon Valley devolving into a waterless sinkhole is “what I lose sleep over at night,” the region’s chief water official says.

As CEO of the Santa Clara Valley Water District, which provides flood protection and water to 1.8 million people in Silicon Valley’s largest county, Beau Goldie is especially concerned with subsidence—the

depletion of groundwater basins that could destabilize the region’s supply and, down the road, puncture the landscape with street-swallowing pits.

These concerns, he says, prompted him to take emergency action this spring and seek approval on an exclusive contract with RMC, a company that is expected to draw up plans for a recycling plant to replenish the valley’s fragile groundwater.

But sources within the water district say Goldie has routinely avoided disclosing potential conflicts of interest regarding RMC, the beneficiary of more than $18 million from the water district in the last decade.

The latest agreement with the company, expected to come in at roughly $4 million, has for the most part escaped public scrutiny. In April, the seven-member elected Board of Directors, on a 5-2 vote, gave Goldie the green light to negotiate a single-source

contract, which means competitive vendors were not even in the running.

Goldie said a surprisingly dry winter gave rise to the fast track contracting process.

“Just about every month counts here,” Goldie told Metro. “We’re in a race.”

What Goldie never disclosed to the board is the cozy relationship the water district has shared with RMC for a number of years.

Melanie Richardson, one of Goldie’s top ranking deputies and the person responsible for overseeing watershed contracts for the district, is married to one of RMC’s principal owners, Tom Richardson. In a statement of economic interest form filed in 2010, Melanie Richardson noted that she held stock options in the company ranging between $100,000 and $1 million.

Goldie also neglected to inform board members that last year Monterey County Water District Board member Steve Collins pleaded no contest to public corruption charges, including felony grand theft, related to payments from RMC and an artichoke grower.

RMCâ&#x20AC;&#x2122;s single-source contract was part of a package of non-competitive deals Goldie submitted at an April 28 board meeting. He received pushback not only from Kremen and fellow director Barbara Keegan, but also Ravi Subramanian, the districtâ&#x20AC;&#x2122;s head of procurement. â&#x20AC;&#x153;I just said the language needs to be stronger to justify why they should be single-source contracts,â&#x20AC;?

Subramanian told Metro in a phone interview monitored by district communications staff.

The RMC deal earmarks several million dollars worth of preliminary planning for an indirect potable recycling plant, but Goldie said that the overall project could end up costing $800 million. Sources say that estimate is optimistic, as the water district has a history of going over budget.

District board member Keegan, a trained engineer who along with Kremen voted against Goldieâ&#x20AC;&#x2122;s singlesource contract proposals, noted that companies doing preliminary planning often receive ensuing contracts.

Engineers rarely trust work they have not veriďŹ ed themselves. â&#x20AC;&#x153;Whoever does the preliminary engineering work obviously is going to have more experience with the project and that would help in the future for a ďŹ nal design contract,â&#x20AC;? Keegan said. â&#x20AC;&#x153;If another ďŹ rm were chosen for the design, they would have to redo signiďŹ cant portions of the preliminary engineering to verify the accuracy of the other ďŹ rmâ&#x20AC;&#x2122;s work product.â&#x20AC;?

Goldie said that RMC has been notiďŹ ed it is unlikely to receive future contracts on the project, making the decision to go with the company from the start all the more perplexing. â&#x20AC;&#x153;That means, potentially, the $5 million being spent on this preliminary contract would be wasted if another ďŹ rm were chosen to ďŹ nish off the project,â&#x20AC;? Keegan said.

Beyond the proposed RMC contract, sources say the ďŹ rm has improperly billed the district in the past. Sources also told Metro that a recent audit found that district staff has routinely moved money between projects, sometimes to the beneďŹ t of RMC, and these transfers of funds are tucked into massive reports that often go undetected by the parttime board members.

Collins worked as a paid consultant for the company and also voted on its contracts as an elected official. Collins also illegally billed clients $160,000 for meetings that he didnâ&#x20AC;&#x2122;t attend, or which were part of his duties as a public official, prosecutors said.

Kremen said. â&#x20AC;&#x153;A couple months arenâ&#x20AC;&#x2122;t going to kill us. Itâ&#x20AC;&#x2122;s going to take up to 10 years to get drops of water from a recycling plant into the groundwater. â&#x20AC;&#x153;Itâ&#x20AC;&#x2122;s starting out on the absolute wrong foot. Weâ&#x20AC;&#x2122;ve known about this puriďŹ ed water project for years. Weâ&#x20AC;&#x2122;ve had way more time to make disclosures about RMCâ&#x20AC;&#x2122;s past behavior, and those disclosures were never made.â&#x20AC;?

Goldie defended RMCâ&#x20AC;&#x2122;s selection, and the decision to exclude details about Collins and the Richardsons when going to the board for approval. He admitted that the SCVWD conducted no additional research into RMCâ&#x20AC;&#x2122;s role in Collinsâ&#x20AC;&#x2122; indictment. â&#x20AC;&#x153;It would just slow down processes tremendously, and we wouldnâ&#x20AC;&#x2122;t be able to provide any more assurances,â&#x20AC;? Goldie said.

In the case of Melanie Richardsonâ&#x20AC;&#x2122;s potential conďŹ&#x201A;ict of interest, Goldie said that a â&#x20AC;&#x153;ďŹ rewallâ&#x20AC;? was put in place years ago to keep her from coming into contact with actions related to her husbandâ&#x20AC;&#x2122;s company. â&#x20AC;&#x153;Melanie is in the ďŹ&#x201A;ood protection side of the house, so she has no involvement in this whatsoever,â&#x20AC;? Goldie said.

But sources at the water district tell Metro that hasnâ&#x20AC;&#x2122;t always been the case.

In fact, internal documents show that Richardson has managed people who handle RMC contracts, including their performance reviews. The â&#x20AC;&#x153;ďŹ rewallâ&#x20AC;? appears to rely on her walking out of the room when RMC is discussed.

Sources conďŹ rmed that the Santa Clara County District Attorneyâ&#x20AC;&#x2122;s office looked into the matter two years ago, but the investigation was called off due to an impending statute of limitations for any potential charges.

RECORD SKIPS Supe Jon Gundry and county education officials ignored

their own staff’s pleas to comply with the Public Records Act.

County Education Officials Play Hide and Seek with Public Records BY JOSH KOEHN New internal emails from the Santa Clara County Office of Education show that the chief of schools and his communications director followed the same playbook when it came to hiding contracts.

After repeatedly flouting the Public Records Act—either by ignoring San Jose Inside’s information requests or by claiming no responsive records existed—the public agency that oversees 31 Silicon Valley school districts now says it “inadvertently” failed to provide previously undisclosed contracts as required by law.

“It was an oversight in not supplying you with this information in a timely manner,” the Santa Clara County Office of Education (SCCOE)

wrote in a June 29 response. “There was never any intention by any staff member to withhold information.”

The record shows otherwise.

Micaela Ochoa, who appears to have been forced out of her role last week as chief business officer, sent numerous emails between June 16 to 18 informing Superintendent Jon Gundry and his spokesman, Ken Blackstone, that the agency was being unresponsive to San Jose Inside’s requests for public records. Public agencies are required to “promptly” respond to request for records within 10 days, regardless of whether they come from media or the general public, and to explain why additional time is needed if the records cannot be provided.

This never happened after San Jose Inside made two requests for consulting contracts on June 3 and 4.

“It appears that the information you provided to Josh yesterday evening is inconsistent with the facts,” Ochoa wrote on June 16 to Gundry, Blackstone, several staffers and Maribel Medina, an attorney who also no longer works for the SCCOE. “The attached response you sent to Josh today at around 2 PM is also inconsistent with the facts. I am very concerned that SCCOE's response to the PRA Request is not accurate. I'm not sure from where you are getting the information you are providing to Josh, but it's not accurate.”

Thirteen days would pass before the SCCOE would cough up copies of the contracts.

Several of these agreements again prove that Gundry has doled out $100k deals but set amounts just below the six-figure threshold, which would require approval from the elected Board of Education and scrutiny from SCCOE accountants.

As previously reported, Sue Daniels received a consulting contract for $99,999. SOA Project had its contract increased by the superintendent Ken Blackstone to $99,950.

The law firm McArthur & Levin, LLP received a contract in February for $90,000.

Multiple other law firms were given contracts for tens of thousands of dollars.

Several of these contracts related to payroll mishaps from 2013, which resulted in the IRS fining the SCCOE $200,000 last year. Gundry has insisted in public that he simply wants to find out what happened

and fix the system, but in a rare email he admitted he has always planned to contract out unionized positions and eliminate jobs.

On Oct. 20, 2014, Medina sent an email with the subject line “RE: serious concern.” She wrote: “It sounds like there are two primary concerns: (1) contracting out bargaining unit work, and (2) automating payroll to replace employees. Neither of which is accurate.”

Gundry replied: “We are definitely planning to automate payroll. It would be irresponsible not to do so.

The fact is that when we automate, we will need fewer employees, so concern #2 is largely true. Are they really suggesting that we maintain antiquated, manual practices just to save positions? I would make a similar argument for concern #1, but we will discuss it at cabinet on Monday.”

Gundry’s plans to clean house are now coming to fruition with the departure of Medina and Ochoa, the latter of whom is being replaced by Mark Skvarna, a consultant Gundry secretly hired last November and paid $92,250. In six months of work, Skvarna never submitted a single written report and invoiced the county for nearly $20,000 in travel expenses.

In a phone call Monday, Blackstone reiterated the company line—that the SCCOE is committed to transparency and never intended to conceal contracts.

“I want to be clear that we respect and follow the law,” he said.

Blackstone then called past articles on SCCOE business “libelous.”

“One can be at any venue and get a quality musical experience.”

Historian Robert Fitts examines the life of the first Japanese player to play in Major League Baseball

N 1964, A JAPANESE southpaw named Masanori Murakami, a.k.a. Mashi, came across the Pacific to pitch for the Class-A Fresno Giants. Later that year, when the San Francisco Giants called him up in the heat of a pennant race, Murakami became the first Japanese player in the major leagues.

Unfortunately, confusion surrounding a contract with his club back home, the Nankai Hawks, prevented his U.S. career from taking off.

Now, baseball historian Rob Fitts has written Murakami’s definitive story: Mashi: The Unfulfilled Baseball Dreams of Masanori Murakami, the First Japanese Major Leaguer; and both he and Mashi will make two appearances this Saturday in San Jose.

Near the beginning of the book, Fitts tells how baseball was introduced to Japan by American teachers in the early 1870s, soon after Japan had opened up to the western world. We get a glimpse into just how different the sport became for the Japanese. Taking inspiration from martial arts, especially judo, the Japanese brought a “mind and spirit” type of aesthetic to the game that did not exist here.

As Japan was just beginning to embrace foreign trade and western ideas, a term emerged: wakon yosai, which means “Japanese spirit, Western technology.” Teams modeled their practices after how they believed samurai warriors would prepare for battle. Players respected the field and the uniforms in the same way a samurai respected an heirloom sword. Techniques of extreme mental endurance and harsh discipline emerged, like practicing a fastball against a brick wall until a hole was bored into it.

Teams would field ground balls for hours on end, until they vomited from dehydration. Complete subordination to the team mentality was required, sort of like the groupthink that would later occur in Japanese businesses.

Much of this aesthetic still lingered by the time Mashi came along in the mid-twentieth century.

After the Nankai Hawks sent him to Fresno, the differences between

the Japanese game and its American counterpart blew him away. In Japan, players never expressed their frustrations or inappropriately lost their tempers on the field. That was considered a loss of face. Players never questioned their superiors or argued with the umpires. In the US, when Mashi saw players throwing bats, kicking chairs and insulting the umpires over bad calls, such behavior seemed totally bizarre.

Mashi also became schooled in the aesthetics of bench brawls, which didn’t really exist in Japan, since Japanese players weren’t allowed to express their emotions. In the US, even if a player wasn’t prone to fighting, he was required to take the field whenever a fight emerged.

One couldn’t remain stoic and sit on the sideline—you had to charge the field and join the brawl even if just pretending. It was an unwritten rule.

Again, Mashi had never seen such a phenomenon, but it taught him that he was now allowed to open up emotionally.

“These were not violent men, nor were they showing disrespect for the game,” recalls Mashi in the book.

“Instead their acts exhibited how seriously they played baseball. After watching the fight, I began to show my emotions when I was frustrated.”

And what better place to finally lose his temper than San Jose? On June 21, 1964, Mashi entered the field at Municipal Stadium to close out the second game of a doubleheader against the San Jose Bees. Thanks to a lousy call, he couldn’t get the job done. Afterward, Mashi broke a chair in frustration, the first time he ever did such a thing.

The book is chock-full of similarly intriguing anecdotes and I won’t spoil the details. Fitts does a great job illuminating specific characters in the backstory. Some examples: Cappy Harada was the shady wheeler-and-dealer who orchestrated Mashi’s confusing loan to the Giants. In Fresno, Manager Bill Werle was the man responsible for converting Mashi from a starter to a reliever, precisely what led him to the majors.

Fitts, along with Mashi himself, will make two appearances in San Jose this Saturday. At 1pm, a presentation and signing takes place at the Main Library. At 5pm, they appear at Nikkei Traditions in Japantown.

N 15 VIOLENT SECONDS, the 1989 Loma Prieta earthquake rendered Lupin Lodge a wreck of toppled cabins and cracked foundations that took years to rebuild. Four years prior, a rare summer rain and mercurial wind-shift spared the nudist resort from a 15,000-acre arsonsparked blaze that destroyed the community water system.

But neither seismic spasms nor wildfire prepared Lupin proprietor Glyn Stout for the devastating force of Ed Dennis.

Ed moved into the clothingoptional Los Gatos enclave in 2002,

a year after Glyn and his new wife, Lori Kay, had given birth to twin girls.

First-time fatherhood and a secondtime marriage got Glyn thinking about how to secure his family’s future by investing in the 110-acre property—California’s oldest nudist colony.

Glyn confided these hopes to Ed, a retired entrepreneur with a purported $17 million net worth and a passion for naturism. Ed— corpulent, blustery and later tabbed Terrible Ed—“portrayed himself as an unselfish paladin,” the Stouts would tell a judge some years later.

Somehow, the Stouts recounted in a lawsuit they filed against him in 2007, Ed persuaded them of his accolades as: “an intellectual

genius, a think tank consultant on retainer with multiple Fortune 500 companies, an entrepreneur with a natural talent for creating wealth, as well as an expert in … publishing, printing, engraving, photography, computers, web design, marketing, accounting, information systems, French cuisine and fine wine, management communications, preschool education, luxury apartment development, renaissance fairs, business law, mortgage finance, mental health, psychology, team building and organizational behavior.”

This ostensibly charitable newcomer promised to help Glyn and his wife achieve financial stability, double the club’s

membership and spark a naturist revival. To Glyn, saddled with debt and litigation, the man sounded like a godsend. He signed over the company—but not the property—to Ed and his wife Kassandra. On a handshake, they agreed to a 99-year lease. Trusting Ed, Glyn said, became the worst mistake of his life.

Under Ed’s brief reign, membership fell to a 25-year low. Staffers also left in droves. The already-foundering club nearly collapsed under the weight of lawsuits, liens, collections cases, sexual harassment claims and overdue taxes. The Lupin Loop newsletter, once a bulletin for community announcements, became a platform to berate members who voiced their concern.

Jean Farmer, a Louisiana transplant dogged by a federal fraud charge, followed her husband Robert Cowan on a job lead to Lupin in late 2008. For the equivalent of $8 an hour, Cowan would take care of landscaping in exchange for a place to park his RV. The couple fell in love with Lupin, named for the California flower that blossoms into a spear of purple petals. Founded as Elysium by Europhile naturist George Marcellus Spray in 1935, the resort offers a panoramic view of mountains and redwoods. It feels remote—with wandering deer and the occasional mountain lion. Still, it’s a quick drive from both Silicon Valley and the coast, suspended in what Glyn calls “a creative vortex” between valley industry and Santa Cruz earthiness.

Maura Byrne moved into the Baytree cabin in 2010 and got kicked out three years later. Like many of Lupin’s jilted tenants, she claimed in court that the Stouts retaliated against her for summoning a county building inspector after repeated requests to eradicate rats and replace a wall heater. Adding insult to Byrne’s legal injury: her car got towed at Lori Kay’s behest and she was too broke to pay the $800 to get it back. In an email dated April 18, 2013, Lori Kay told Byrne to move her car to “Back 40,” a former storage area and now a plot of derelict trailers hidden from view to most visitors. “[W]hat you did was illegal and immoral,” Byrne wrote back. “It surprises me, given my knowledge of all your shady business practices, that you would go the route of retaliation.”

Over the years, Lupin shunted more and more staffers to the Back 40, recently renamed The Terraces, which lies off the margins of a map given to visitors and beyond a sign marked “Maintenance Area.” Rows of dilapidated trailers abandoned over the decades sit next to plastic chairs and propane tanks, tilted awnings and leak-shielding tarps. There is no plumbing or septic, only makeshift electrical wiring. “It’s shocking to think that a place that looks like the Back 40 is so close to Los Gatos,” a Lupin tenant said. “Most people there are recovering from some setback in life. They don’t know any better.”

Largely through word of mouth or “help wanted” Craigslist ads beckoning people to “come live in paradise,” residents claim, Lupin has hired people “in transition”—transitions from prison, probation, broken relationships or drug and alcohol addictions.

According to both court records and internal company documents supplied by former employees, many worked for the equivalent of minimum wage in “Lupin Bucks,” basically a credit on their account to pay for lodging, meal tickets and membership fees.

“Many times we work more on a barter system rather than traditional models,” Lori Kay explained. “Over the last 80 years this has served Lupin and many of its members very well.

After learning that Ed was nothing more than “a well-experienced conman, sociopath and misanthropist,” as the Stouts characterized him in the inevitable breach-of-contract lawsuit, it took three more years of bitter court fights before the final showdown.

Meanwhile, Ed and Kassandra holed themselves up in their cabin or the main office for days at a time. Finally, after months of sabotage, sieges and physical bouts, sheriff ’s deputies enforced the eviction and ended a bitter saga that pushed Lupin to the brink of insolvency.

Glyn seemed to never quite recover from the episode. A spinal fusion to relieve a pinched nerve, compounded by cancer and other ailments, left the longtime owner frail and spent. His wife Lori Kay, an acclaimed sculptor, assumed control in 2006. Almost a decade later, as Lupin approaches its 80th anniversary in August, the resort remains shrouded in allegations of wage theft, substandard living conditions, questionable hiring practices and retaliatory evictions.

Last month, the Santa Clara County District Attorney’s Office accused Lori Kay, 53, Glyn, 77, and two resident-staffers of surreptitiously sucking water from a nearby creek. Now with a felony case on the books, longtime members wonder whether Lupin can weather its latest legal storm.

The property subsequently fell into disrepair and ran into trouble with regulators over labor and safety violations, as well as illegal grading and construction. One such violation, in 2010, involved a propane tank explosion that sent a burn-blistered tenant to the hospital for five days. The U.S. Department of Labor, Occupational Safety and Health Administration fined the management company, Lupin Heights Inc., $12,000. “If it ain’t broke, wait a week,” Lupin dwellers often quip.

Though not certified as a sober-living environment, Lupin has also presented itself as a place to get back on one’s feet.

“They deliberately look for people who are in a desperate situation,” said Klein, who almost moved out several times because of what he calls rampant and passively accepted methamphetamine use on the grounds. “They have a twisted notion that they’re some kind of a rehab.”

Lupin’s membership materials appear to support that claim. “Over the years, Lupin has been a haven of sobriety for many who have learned that their lives depend upon avoiding alcoholic consumption,” a handout states. Felony drug use, it continues, results in automatic dismissal. In practice, however, that wasn’t the case.

A couple years ago, the county’s Department of Family and Children Services took custody of newborn twins from their meth-addicted mom, a chef at Lupin’s restaurant. The mother, identified in court papers only as J.A., told the judge that she lived in a “zero-tolerance” community at Lupin. In its response, the county discredited that notion, pointing out that Lupin holds a liquor license and only bans alcohol from the skinnydipping pool and spa.

Still, many former and current residents told Metro that they came to Lupin looking for some measure of healing, only to get swept up in a cycle of codependency by relying on the Stouts for housing, food and work. One couple said they had to sign up for public welfare because the Lupin credits they earned didn’t cover for enough meal vouchers.

Former Cabrillo College instructor Robert Eckert, who moved into the Tiger Lily yurt in 2009 as a paying

tenant before getting evicted a year later, said he would sometimes give staffers rides to the food bank so they could eat.

There’s another adage in the camp that Lupin employees are more likely to have an outstanding warrant than a valid driver’s license.

The Stouts dispute the assertion, saying the club performs background checks and sometimes drug tests to screen employees, though a criminal conviction won’t necessarily disqualify a person from moving in. In fact, a considerable number

Mendoza began wasting away from drugs—in virtually every arrest report, police said he was coming down from some kind of high. During his stay at Lupin, police say they caught him with drugs, blank checks and stolen cars.

The week between Christmas 2008 and the New Year, Mendoza, high on meth and heroin, stole a 2002 Mitsubishi Gallant and high-tailed it past the Great Mall in Milpitas, according to court records. Police described him as thin and rank, with a shaved head and a goatee. Panting and drooling, he curled up on the ground in a fetal position and said he felt like his heart would explode. “My stomach’s hurting,” he told the officer, admitting he’d been using drugs all day and, in a panic, had just swallowed a gram of meth. “I’m going to die.”

Mendoza’s sister, Lupin owner Lori Kay, formally evicted him from his trailer in 2014. By then an exodus was occurring for many longtime members. Some defected to other clubs, fed up not just with the drugs but also the all-night raves and fetish parties that they felt flouted the wholesome ideals of naturism.

HHHHHHHH of resident-workers came to Lupin with checkered pasts—commonly with domestic violence, drug and theft convictions—and often brought their troubles with them.

Santa Clara County Sheriff ’s Office spokesman Sgt. James Jensen said that in the past two years deputies were called out to Lupin once every eight days on average.

Thirty-eight-year-old Mike Buckland, one of the two resident workers caught up with the Stouts on water theft charges last month, came to Lupin with a mile-long rap sheet and nowhere else to go. The Stouts gave him work, a trailer to live in and food from the kitchen— which got temporarily shut down for vermin by county health inspectors last month.

Eviction records state that Lori Kay’s half-brother, Ricky Mendoza, began working at Lupin in 2008.

While attending UC Santa Cruz as a art history major, she spent time studying abroad in Switzerland, where her host family introduced her to naturism and the body acceptance movement. Upon her return, she discovered Lupin, where she would meet Glyn and raise their two daughters. “It’s an incredibly beautiful place,” she said proudly, gesturing to a sweeping view of redwood forest beyond the floor-to-ceiling windows of the Lupin restaurant.

A celebrated mixed media artist and metal sculptor, Lori Kay has exhibited and lectured both locally and abroad. Her work has been commissioned for public art projects in nearly a dozen cities. Through her art, she has explored themes of

identity and a childhood marked by prejudice against her interracial parents and their mixed-race offspring. “I needed to stop and do this,” she says in a 1995 Mercury News article about an exhibit inspired by her biracial heritage.

“I couldn’t just keep going casting bronzes and doing public sculptures without questioning … who am I, and how do I bring both my backgrounds to who I am and what I create.”

There’s a stark contrast between Lori Kay’s ruminative artistic self depicted in old news clippings and the portrait painted by court records and accounts from dozens of embittered Lupinites. Tenants and members describe Glyn and Lori Kay, who live apart on the grounds, as a “good cop, bad cop” duo. Glyn is quick to commend his semiestranged wife—the pair filed for divorce but never finalized papers— for her ability to take charge.

High school-aged Simone and Samara are identical but with opposite asymmetric features—one is right handed and the other left, one’s hair whorls clockwise and the other counter. Secondly, Lori Kay said, she’s a female sculptor. And, of course, she manages the longestrunning naturist club west of the Mississippi. “The oldest business in the Los Gatos chamber of commerce,” she said, adding that she intends to keep it that way.

Lori Kay dismisses allegations from former tenants as sour grapes from people who dropped their end of the contract. Lupin won those cases, she pointed out, and the people evicted have questionable reputations and legal troubles in their own right.

“We evicted them as any landlord would,” she said. “We are much more careful in the way we investigate potential tenants in an attempt to minimize the number of evictions.”

Most of Lupin’s visitors have been loyal members for more than 10 years, she said. “Our membership has supported Lupin through some

Robert Bergman, a photographer who flies in from Canada every year to organize a body acceptance festival at Lupin said any facility that size will have issues, but that his experience has been positive on the whole. Delman Smith, a Los Gatosbased attorney and Lupin member for decades, agreed, calling the place “Eden-like.”

Citations from various regulatory agencies, Lori Kay said, are simply one of the challenges of running an unconventional business—one that’s part water district, wildlife refuge, mobile home park, tourist attraction and bastion of a widely misunderstood subculture. “We try our hardest to continue in our 80year tradition in having a safe, family friendly and mutually respectful place,” she said. “We’re a community.

But even within the tight-knit naturist community, Lupin has alienated some members by blurring the line between sex and social nudity. “Being a nudist is supposed to be a non-sexual, family friendly environment,” explains Ken Hooper, who canceled his membership in the mid-aughts over what he saw as the club’s decline. “That’s so important.

Social nudity is about trust.”

HHHHHHHH After a breathless chase through the steep, forested hillsides, a shiny fox with a bouncy inflatable tail succumbed to his captor. Smash—a 39-year-old man in a latex fox suit with zippered crotch—gleefully whimpered and caressed his potbelly as the hunter rubbed his nipples.

“He’s in fox heaven,” an onlooker said with a laugh.

Journalist Tracy Clark-Fory documented the bizarre ritual of the “Human Fox Hunt” at Lupin for Salon in 2011. She described men and women dressed up in

leather and harnesses and erotic, anthropomorphic animal costumes stalking each other in the woods.

“There is a jarring dissonance between the back-to-basics naturist routine and the sinister ornamentation inside the hut,” Clark-Fory observed.

Punishment for the foxes apparently involved some sort of agreed-upon BDSM play in the privacy of a rented yurt. Even if the sex happened out of public view, the sexualized role-play at a resort marketing itself as familyfriendly sent shockwaves in naturist circles. Not long after the hunt, the American Association of Nude Recreation (AANR) withdrew its accreditation from Lupin Lodge. Cindy Gregory, a resident member and Lupin’s special events coordinator, wrote an open letter to AANR defending the decision to rent space to the fetish party. After all, she said, at least some of the kinky cosplayers shed their “furversions” to a polite nakedness after the hunt.

Being outnumbered by “textiles,” as

nudists call the clothed, can stir up insecurities for naturists.

“After the hunts, many of the participants took off their costumes and enjoyed the hot tub and pool in the nude,” she assured AANR leaders, adding that there was no public sex on the grounds. “I am gratified that they feel accepted here and comfortable enough to express themselves.”

Other non-naturist groups would rent out spaces for parties, all-night raves that drew the ire of neighbors and the attention of sheriff ’s deputies. Months before the human fox hunt, a 21-year-old raver rolling on molly and four tabs of acid collapsed in the main bathroom— called the Taj Mahal by Lupin residents. Another partygoer found him around 6am, slumped over and vacant, and called 9-1-1. Paramedics recounted in incident reports that his blood pressure shot up and his brain swelled before he died.

“That should have woke us up,” a resident lamented. “By the time the next guy died, a lot of us had enough morally, ethically. We had to say something.”

HHHHHHHH Michael Schaupp left Santa Cruz around midday Dec. 10, 2013, for a 2pm class at Ex’pression College in Emeryville. The 36-year-old father and design student had driven the same northward Highway 17 route countless times on his 1996 Honda VLX motorcycle. Drivers who shared the winding mountain road with him that day said he looked at ease, like an experienced rider. And he was.

But about a half-hour into his commute, a 1994 Ford Explorer shot out onto Highway 17 from Idylwild Drive in a southbound arc that cut off Schaupp and sent him hurtling to the shoulder, according to detailed reports

by California Highway Patrol officers. A trail of blood plotted his trajectory. The Explorer’s 47-year-old driver, Joline Fay Cohen, scrambled out of the SUV just as another car pulled up to the scene.

“Oh my God, I just killed that guy,” she told the witness, per the CHP. “Did you see him hit my car? What should I do?” Without

Schaupp died two days later at Stanford Hospital. Yet three full months passed before Cohen surrendered herself to authorities on hit-and-run charges that landed her in a Central Valley womenâ&#x20AC;&#x2122;s prison.

Lupin residents claim Lori Kay harbored a fugitive during that time, leaving them no choice, they said, but to tip off CHP investigators to Cohenâ&#x20AC;&#x2122;s whereabouts. As a live-in assistant for several years to Lori Kay, Cohen ran errands, oversaw the main office and, according to CHP tipsters, had a reputation for smoking meth and driving erratically. stay because there are such thing as tenancy laws,â&#x20AC;? Lori Kay explained.

But the tragedy raised more questions about Lupinâ&#x20AC;&#x2122;s hiring practices. In an ongoing wrongful death lawsuit against Cohen, Schauppâ&#x20AC;&#x2122;s mother, Denise, and 19-year-old son, Caleb, also name Lupin as a defendant. The Schaupp family attorneys claim that Cohen was acting â&#x20AC;&#x153;within the scope of her employmentâ&#x20AC;? while driving the SUV and that Lupin is vicariously liable because it employed her â&#x20AC;&#x153;with knowledge of her history of reckless driving, erratic behavior and substance use.â&#x20AC;? â&#x20AC;&#x153;That was the beginning of the end for me,â&#x20AC;? says a member who has called several government agencies to investigate Lupin. â&#x20AC;&#x153;You just canâ&#x20AC;&#x2122;t run from one crisis to another and blame the rest of the world.â&#x20AC;?

Because itâ&#x20AC;&#x2122;s a pending case, the Stouts declined to talk about the wrongful death lawsuit, except to insist that they ďŹ red Cohen before the fatal accident. Attorneys also advised them against talking about the alleged charges of stealing water from a creek managed by their neighbor, the Midpeninsula Regional Open Space District.

Prosecutors say the Stouts and two resident employees siphoned thousands of gallons from Hendryâ&#x20AC;&#x2122;s Creek last year without permission to offset a drought-induced water shortage. Wildlife cameras allegedly caught the foursome in the act, trespassing to route a plastic pipe from Hendryâ&#x20AC;&#x2122;s waterfall. The Stouts claim their rights to the water were grandfathered inâ&#x20AC;&#x201D;the former landowner allowed them to tap the stream before selling the property to the open space district in 2012. â&#x20AC;&#x153;This is the latest setback,â&#x20AC;? Lori Kay acknowledged last week. She added that Lupin has survived worseâ&#x20AC;&#x201D;the Great Depression, World War II rationing, ďŹ res, droughts and earthquakesâ&#x20AC;&#x201D;and the legacy of the lodge is bigger than any one person.

Yet many members, some of whom spent the better part of their lives at Lupin, fear that the eight-decade legacy has been corrupted by deepseated dysfunction, and the water has run dry in more ways than one.

They spurn catchy one-off jams for atmospheric compositions that immerse you in a galactic, indie-electronic psychedelia. Detached vocals float and intersect with round keyboard melodies, all laid over infectious swaying bass progressions, and crashing drums. They take their time getting places, meditating on particularly potent combinations, but none of their meanderings seem lost, as they dwell in littletrod ground of the sonic spectrum.

On “Bombshell,” a steady looping keyboard and asymmetrical drums gallop while wailing, ambient vocals and curious, burbling guitar riffs bounce off the track, swirl in anti-gravity circles, and return in soothing waves. (JF)

‘Book of Mormon’ asks audience to laugh at and love religion

T

HE BOOK OF MORMON is a juggernaut among modern Broadway musicals. With nine Tony Awards, including Best Musical, the production is responsible for shattering 81 house records in 44 venues across the country.

And so it should come as little surprise that the musical broke records for ticket sales at San Jose’s Center for the Performing Arts last week— grossing $1.85 million for the week ending in July 5, during Mormon’s South Bay debut.

Mormon is the story of two young missionaries sent to Uganda by the Church of Jesus Christ of Latter Day Saints. Their charge: spread the good news of their faith. However, upon arrival they discover the local villagers—suffering under the rule of a cruel warlord—are more concerned with issues of poverty, disease, famine and violence than matters of religion.

Further complicating matters, our two would-be prosthelytizers are hopelessly mismatched—with one suffering from an inflated ego, the result of growing up a big fish in a small pond, and the other a pathological liar. Sounds like a barrel of laughs, right?

In the vulgar hands of writers Matt Stone and Trey Parker (they of South Park fame) and Robert Lopez (who co-

wrote the songs of Frozen and Avenue Q) it certainly is.

Book of Mormon, the nine-time Tony Award-winning musical comedy, is making its South Bay debut, with 16 shows running from June 30 to July 12 at the Center for the Performing Arts.

After seeing Mormon for the first time, it is clear why this production was dubbed “the best musical of this century,” by Ben Brantley of The New York Times. It’s a laugh riot—which tumbles forward with infectious energy, as it bounds from one uproarious number to the next.

From show opener, “Hello!,” it is at once clear that Parker, Stone and Lopez, are masters of the showtune craft. Rich harmonies, familiar song structures and catchy arrangements, nod to classic musical tropes with both reverence as well as plenty a self-aware wink.

“Hasa Diga Eebowai” (translation: “Fuck You, God”), owes plenty to Elton John’s “The Circle of Life,” from

The Lion King—so much so, that the sacrilegious tune seems like something you’d sing with your kindergartner on the way to school.

Of course, the songs, music and book can only go so far in carrying a musical. That’s where the cast comes in.

The Book of Mormon’s touring ensemble is excellent. The musical’s core trio of actors and singers—Billy Harrigan Tighe, as Elder Kevin Price; A.J. Holmes, as Elder Arnold Cunningham; and Alexandria Ncube, as Nabulungi—impress in nearly every scene.

Tighe, as Elder Price, skillfully moves from exuding naïve confidence in “You and Me (But Mostly Me),” to deep self-doubt and dejection as he quaffs cup after cup of coffee at a café.

Similarly, Holmes’ Elder Cunningham, deftly captures the neurosis of his character—drawing laughter with his wild-eyed grins and explosive Tourette’s-like spasms and cackles.

Ncube, however, is the clear scenestealer here. She radiates innocence, uncomplicated beauty and kindness at every turn of the first act, and finds a place somewhere between righteous indignation and disillusionment in the second, after learning that the missionaries she believed would spirit her away to “Sal Tlay Ka Siti” plan to leave her village just as destitute as they found it.

The Center for the Performing Arts certainly plays a role in Mormon’s first run of shows in San Jose. The massive and round 2,677seat auditorium is a venue South Bay residents can take pride in.

Book of Mormon certainly doesn’t pull any punches, but it is not overly cruel, either. And therein lies the secret to the musical’s power and popularity. The production finds a sweet spot between lampooning organized religion—all organized religion—and recognizing faith’s ability to unite people for the common good.

High Art EMPIRE SEVEN STUDIOS’ new show, “The Things We Forget,” features two well-known artists with strong ties to the Bay Area exploring how light and color affect perception.

Artist and illustrator Jason Arnold lives and works in Santa Cruz, and Beau Roulette, artist and photographer, grew up in Los Gatos. The show presents the newest work from each artist in the shape of vibrant paintings that sometimes trick the eye, and bleak, but beautiful, photographs.

The Things We Forget “I started taking pictures in high school,” says Roulette, a photographer and artist. Under the Jul 10-31, various times tutelage of his brother’s band’s manager, Roulette Empire Seven Studios was able to shoot major musical acts, such as Korn and Marilyn Manson while still a teenager. His brother, Drew Roulette, is bassist for the popular Los Gatos band, Dredg.

When his father died, Roulette took over the family car business in San Jose. And after nine years stewing in the corporate life, Roulette found a creative outlet taking photographs and creating designs for numerous music, skateboarding and snowboarding companies—including Nike, Adidas and RedBull.

Jason Arnold is an artist and illustrator whose work is characterized by a brilliant polish, but also an unnerving aesthetic, absurdity and crassness—full of exaggerated color and gesticulation. This is a true homecoming, as Arnold is not only a Bay Area native, but a graduate of San Jose City College. He also is a lead designer at The San Francisco Bay Guardian Newspaper.

Arnold’s art is most recognizable on the many skateboards it adorns. He has contributed numerous and notable designs to Real Skateboards, Thrasher Magazine, Enjoi Skateboards and Spitfire Wheels. He was formerly a designer at NHS Skateboards in Santa Cruz.

“The Things We Forget” is a study of the way subtle shifts in the gradient of a color can create optical illusion and evoke emotion. With clean lines and bright colors, Arnold presents witty and edgy portraits of young women striking sardonic poses. Beau Roulette’s contribution to the exhibit is a mixture of soft but striking studies in hue and contrast, which employ visual illusions—along with his bare, but hauntingly elegant photography.

“The colors will vibrate, especially if your eyes have a lack of cones or you're color blind,” Roulette says regarding his diaphanous, optically-warped pieces.

Subjects vary in the artists work, but a vibe both resplendent and somewhat dissociative is shared between Roulette and Arnold. Overall, “The Things We Forget” is a fascinating exploration of the relationship between light, color and the fusion of two very different aesthetics.—Tad Malone

Not Himself IMMORALITY HAS A PRICE In ‘Self/Less,’ Damian, played first by Ben Kingsley, trades his old body for a new, younger one, played by Ryan Reynolds. But at what cost?

‘Self/Less’ doesn’t live up to Director Tarsem Singh’s potential

Y ANY NAME and any copyright, Self/Less is John Frankenheimer’s 1966 film, Seconds, a second time around. It’s another disappointment from Tarsem Singh that is, once again, likely not his fault. At a comic convention a few years back Singh told the audience that his Immortals was a case of creative differences: his producers wanted Zack Snyder and Singh had wanted Caravaggio. Has something like this happened again? Did Singh want Kubrick, and did the producers want an action movie?

Ben Kingsley is Damian, a dying real-estate tycoon informed of the existence of the Phoenix Corporation.

For a mere $250 million, it saves the personalities of great men whose minds outwear their bodies—“Einstein, Edison, Steve Jobs” (Apple has product placement galore in this film). Phoenix has secretly pioneered the new tech of “Shedding”—taking personalities and inserting them into new bodies.

Damian dies, and in his new form (as Ryan Reynolds) he carries out a life of pleasurable dissipation.

Damian must turn up regularly to have a prescription refilled by the silky physician (Matthew Goode) who oversaw the personality transplant in his New Orleans clinic.

If Damian doesn’t take the pills, he has flashbacks and disturbing dreams. These convince Damian that this body came with a ghost in the

machine. Phoenix’s gun-wielding employees do their mortal best to ensure the newly-transplanted tycoon doesn’t find out about his host-body’s past.

Self/Less is the most straightforward, present-day set movie Singh has made, with no touch of fantasy other than the sci-fi “shedding” machinery (even this looks plausible: it’s not much bigger than an MRI). Singh has a Nicholas Roeg-worthy taste for contemplating the various angles of a scene, for zeroing in on steel and chrome and glass. The gilded Manhattan penthouse the old Damian inhabits looks appropriately decadent—halfway to Sadaam’s golden fortress in The Devil’s Double. Panning the camera aboard a truck from on top of a Louisiana levee, he establishes the isolation of a lone rural house that comes under siege from ruthless men. (It’s the preamble to an authentically tough shootout.)

While it’s not an insanely expensive movie, Self/Less changes its scenery

often—you feel like you’ve seen two sides of the world.

It’s also blessed with authentic work by Natalie Martinez as Madeleine, the woman once married to the original owner of Damian’s new body. Martinez’s reaction to the first sight of her presumed dead husband exemplifies what’s meant by the expression “the actor nailing that take.” Her reaction is as rapid as a gunshot.

Reynolds’ blank Canadian likability is best in the early scenes— he’s like a film noir sap and he begins to be treated like one. Self/ Less’ best line is from a Phoenix company enforcer: “I know you’re disappointed. You thought you bought a new car and it turns out to have a few miles on it.” But the script by Alex and David Pastor (the 2009 Carriers) peters out after the second act—when it frames the problem and identifies the villains, all that’s left is to carry out the too easy solutions.

Many critics have a hobby of making excuses for M. Night Shymalan—this space prefers to save its chips for Singh. Singh’s work in Immortals (2011) and Mirror, Mirror (2012) have been real retina candy, with costumes by the late Japanese designer Eiko Ishioka.

It’s been almost ten years since Singh’s The Fall (2006), the film that suggests this director may someday flabbergast the world. The Fall was about a crippled and suicidal inmate (Lee Pace)—a stuntman at the dawn of Hollywood cinema in 1916— recuperating at a hospital as he spins a story for an injured child (Cantinca Utaru). It was like a Terry Gilliam film, concerned with the primacy of fantasy over reality—it’s as if Joan Didion’s “We tell each other stories in order to live,” were paraphrased to “We tell each other stories to keep from going mad.” Singh’s baroque impulses may quarrel with the ability to do all the things a commercial movie is supposed to do. But in Self/Less, this movie with no good reason to be made, you certainly don’t see a dead talent, or one that’s giving up.

STRONGER THAN ME New documentary ‘Amy,’ follows the life and untimely death of vocalist Amy Winehouse, who ultimately could not beat her addictions.

Revivals:

Body and Soul ALREADY A HIT, the documentary Amy is of the deepest sadness, like a Japanese tragedy. It isn’t purely an investigation into the end of Amy Winehouse, dead at 27, or of those addictions that turned her into one of the people you step over at the bus stop. With aptness that justifies the cruelty, a British comedian describes Winehouse in her last days as looking like an ad campaign to rescue neglected horses: all bones and big teeth and dull eyes. At a recent screening, director Asif Kapadia (of the best auto racing documentary I’ve ever seen, Senna) describes the aftermath of Winehouse’s brief life as a “crime scene”—there are plenty of suspects.

Amy’s father Mitchell and her ex-husband Blake Fielder-Civil were perhaps riders on the fabled gravy train, but the British press did their part. The saddest image in the film is Winehouse standing in a circle of yowlers with atomic flashbulbs sizzling.

She gives up, trying to retrieve her dignity by lighting a cigarette. I realize a hack has to make a living. But what happened to Amy Winehouse is like the old-time London sport where you throw a terrier into a pit of rats.

(R, 78 min.) New to L.A., Alex and Emily (Adam Scott and Taylor Schilling) are going through all the sexual dysfunction and adultconversation deprivation that often comes along with raising a toddler.

In the park, they meet the cool Kurt and Charlotte (Jason Schwartzman and Judith Godreche) who invite the newcomers over for a playdate with their own kid…but it’s actually Kurt and Charlotte who are in need playtime. Director Patrick Brice (whose previous film was Creep) makes this a wise, pleasant farce with sharp compositions and a nice balance of naughtiness to skeeviness.

Schwartzman and Godreche excel as the kind of cool California couple who are so evolved you can literally drink from their swimming pool. Fans of Schilling on Orange is the New Black will note she has the perfect sitcom face—her slow reactions of dismay and reproach always seem fresh. As is typical with a Duplass Brothersproduced film, it sort of runs out of gas at the end, but it’s a humane and sexy comedy. (Opens Friday at Santana Row.) (RvB)

She bit back. The documentary reveals the causticness she turned on herself and others, as well as the drive that got her a recording contract before her teenage acne had cleared up. We see how Amy she resists being shaped into a hit-maker—in favor of the R; 128 Min. jazz revivalism of the albums CineArts Frank and Back in Black. It Santana Row takes a significant talent to make this film look natural, as if the story were telling itself.

It took restraint not to make oversized claims for Winehouse’ voice, and to just let the music and the scathing lyrics speak for themselves. And it took discernment to find the musicians who can explain how well she knew her craft.

Flogged half to death at outdoor festivals, this fragile talent was her most authentic self in a club. “No jazz artist wants to perform in front of 50,000 people,” Tony Bennett notes. Seen during a duet with Winehouse on “Body and Soul,” Bennett comes out like a gent in this story of wastrels, parasites and helpless friends. He’s one of the few people who could put some real light and clarity into Winehouse’s magnificent eyes.

LADY HAMILTON AKA THAT HAMILTON WOMAN/GREEN FOR DANGER (1941/1946) How a married woman became the true love of England's most heroic sailor, Viscount Horatio Nelson (Laurence Olivier). The highlight is an 1800 New Year's Eve embrace in which Nelson can tell his lady (Vivian Leigh): "Now we have kissed for two centuries."

The direction by Alexander Korda means to needle the patriotic impulses of Britons facing down Hitler. It’s lavish for the time and place; it got deserved praise the glittering cyclorama of the Bay of Naples includes a smoking Vesuvius.

But the bathtubbish re-creation of Trafalgar isn't half as wet as Miklos Rozsa's throbbing score. It survives on the strength of Leigh, whose Emma has the best elements of both Miss O'Hara and Miss DuBois.

BILLED WITH Green for Danger Inspector Cockrill of Scotland Yard—the scintillatingly dry Alistair Sim—investigates murder at a wartime hospital. The deft director

SABRINA/BEAT THE DEVIL (1954/1953) Elegant social comedy that tends to end-run people’s mal de mer caused by the co-starring of old actors with young girls.

Audrey Hepburn plays the daughter of a chauffeur on a Long Island estate who for years has nursed a crush on the family's younger playboy son (William Holden), but the responsible elder brother (Humphrey Bogart) eventually turns her head. BILLED WITH Beat the Devil. It suggests a remake of its director John Huston's own The Maltese Falcon written by Joe Orton, and it characterizes the white man's burden as a bag of loot. The lounging adventurer Billy Dannreuther (Bogart), stuck in a podunk Italian beach town, has a tip on some uranium fields in Africa; he's waiting with several fellow adventurers for transport there.

His partners include Robert Morley, subbing for Sydney Greenstreet, and Peter Lorre (as a German-accented "Mr. O'Hara") who has a mouthful of lectures on the importance of trustworthiness. During the forced wait, Dannreuther's wife, Maria (Gina Lollobrigida), takes a liking to an upper-class Englishman named Harry Chelm (Edward Underdown).

Fortunately for Dannreuther, Chelm has a neglected wife: Jennifer Jones, looking better in cat's-eye sunglasses than anyone has ever looked since. The adventure of a few shady men trying to rip off Kenya holds up a cracked mirror to imperial pretensions, specifically British imperial pretensions.

(There's a joke here about the care and feeding of the British manor lawn that'll never let you see Masterpiece Theatre the same way again.) Supposedly, Bogart loathed the picture ("Only phonies like it").

Too bad he was blind to its merits; his is a warm but acrid sunset performance, and it inspired a well-deserved cult. If Beat the Devil doesn't make a lot of logical sense, forgive it: as Jones sighs, "Charm and dependability so seldom go in the same package.” (Plays July 11-14 in Palo Alto at the Stanford Theatre.) Building a Scene THE BELIEVER Cliff Rawson wants to see San Jose’s scene grow. ‘Any city of our size should have a bigger scene,’ he says.

Local musician and promoter Cliff Rawson is working to make San Jose relevant

ALKING AROUND the recent SubZERO Festival at the beginning of last month, Cliff Rawson was suddenly struck with a sensation he doesn’t often feel in San Jose.

“I felt like I was walking around San Francisco or Brooklyn,” he says.

“There were a lot of people there. It felt really good.”

The reason it felt so good is that Rawson wants San Jose to have a scene on par with its neighbors to the north and other comparably

sized metropolitan areas around the country. He really wants it.

Unfortunately, Rawson says, many of the best musicians and artists in the South Bay are “looking to leave at their first opportunity” for places like L.A., San Francisco or New York.

“There’s no reason that should have to happen,” he says. “San Jose is a big town. We have great bands here. And now, with San Francisco being so expensive and Oakland getting that way too … there’s starting to be a good core scene in San Jose—people who are not leaving.”

He names local indie rock acts, such as Rex Goliath, Dinners, Joan & The Rivers and more, as examples of highly talented, home-brewed

acts, who should be drawing larger crowds in San Jose, but aren’t.

“People are discouraged,” Rawson says. “Even the really good bands. They tell me, ‘I can get my people to come to Stritch for free, but I can’t get them to pay $10 at The Ritz.’”

Rawson, who has lived in some of New York’s toughest neighborhoods in order to avoid high rent while still remaining close to high culture, isn’t afraid of a challenge. This character trait, combined with his love of rock & roll music and experience with promoting makes him an ideal foot soldier in the fight to make San Jose relevant.

And he is responding to that very call. Working with his promotional partner, Laura Patterson, Rawson aims to unify what he sees as a fragmented community with carefully curated shows designed to bring together a wide swath of San Jose’s music and art-loving denizens. If he is successful, he says the result will be a stronger San Jose scene that provides proper support to local musicians and artists.

He has already organized one

well-attended local showcase at SLG Art Boutiki—which he simply called “Show!”—and is hosting a second this Friday at The Ritz, which he will call “Scene!”

His plan is that both “Show!” and “Scene!” will be ongoing events held on a regular basis at both venues. Rawson says that “Show!” drew about 150 people to the Art Boutiki and he is hopeful that “Scene!” will bring even more, with it’s lineup of local acts, including his band, Cola, Joan & The Rivers, Them Slack Jawed Sons of Bitches, as well as local rapper, Anthony Mastrocola (who also goes by the name Cola on stage).

After many years on the East Coast, Rawson moved to San Jose in 2012 to take his current position with Ballet San Jose, where he now serves as director of educational outreach and is a full-time pianist.

Though he has a formal musical education, outside of work Rawson uses his talents to play alternative, indie and punk music. His recently formed band, Cola, sounds very much like New York in the ’70s. Lou Reed and The Velvet Underground are the most readily discernable influences, but he says The Stones, The Clash and Tom Petty are also key inspirations.

Rawson recalls first moving to San Jose and hanging out at Willow Den. It was there that he realized how important these groups were to him, as they were the majority of what he chose to play on the dive bar’s jukebox.

“I’m kind of going for something that’s between The Velvets and Stones,” Rawson says—“something that’s right on the edge of punk rock.”

He wrote many of the Cola songs on his own before putting together the band, which includes Evan Bautista, a drummer who has worked with Dr. Dre; Matt Davis on bass; and Peter Colclasure on keyboards.

Between his day job, his band, and his passion project—promoting local shows—Rawson keeps a schedule that doesn’t leave him much down time, but he’s fine with that.

“I do this thing because I love it,” he says. “I’m very positive and excited about doing all this kind of work in San Jose. Any city of our size should have a bigger scene.”

â&#x20AC;&#x2DC;Thinkâ&#x20AC;&#x2122; Different CELEBRATING DIVERSITY through indie music and underground art, the annual Think and Die Thinking festival will be held this week at Cafe Stritch and the Billy DeFrank LGBT Community Center.

Expanded from its punk-rock roots, the festival aims to promote the work of those traditionally marginalized by mainstream society, especially the LGBTQ community, women and people of color, according to local musician and festival cofounder Christine Tupou.

"We strive to prioritize raising the voices of folks who have historically been disenfranchised and silenced throughout, not just punk history but, history in general," Tupou says. The 2015 lineup is special partly because the event organizers invited mostly artists who've never before performed in the festival.

"I'm excited about literally all of the bands but, off the top of my head, I am very excited about Downtown Boys from Providence, R.I., playing the fest,â&#x20AC;? Tupou says.

They are my favorite band to watch live. Victoria, who fronts the band, grew up here in San Jose and always has the most amazing things to say in between songs."

Downtown Boys, who describe themselves as a "Bi bilingual political dance sax punk party," perform Saturday at 11:30pm. Tupou, who used to play in the nowdefunct lo-ďŹ pop band, Sourpatch, will perform with Try the Pie, at 10:30pm on the festival's opening night.

The festival is a multimedia affair. This year, in addition to performances by dozens of bands from both near and far, visual art and literature will also be showcased.

"There will be writing workshops, a workshop on guitar set-ups and zine readings," Tupou says. There will also be a panel presentation entitled "Marginalized Identities and the Current Climate of Punk: A Multi-Perspective Discussion," which Tupou describes as a way to come together and share community-organizing experiences.

State Law vs. Federal Law The first thing that everyone MUST know and fully understand is the federal “Supremacy Clause.” The Supremacy Clause is the provision in Article Six, Clause 2 of the United States Constitution. This establishes the Constitution, federal statutes, and treaties as the “supreme law of the land.” It provides that these are the highest form of law in the United States legal system, and mandates that all the state judges MUST follow federal law when a conflict arises between federal law and either a state Constitution or state law of any state.

Question: How can any state (Colorado, Washington, Oregon & Alaska) or California in this matter establish any state law or amend the state Constitution without violating the “supreme law of the land” known as the federal Controlled Substance Act?

Conclusion: We already have Prop. 215 known as the "Compassionate Use Act" here in California which does NOT fly in the face of the CSA for a reason. Remove (amend) the "grey" area from SB 420 to STOP the unlawful vendor model dispensaries from illegally "selling" and "profiteering" from a controlled substance and the transactions. Make a few changes (amend) to the "draft" closed-loop version of the AG Guidelines that have been sitting on The Attorney General’s desk for almost four years now. It's just as simple as that and then California will have the laws that already exist written properly and in accordance with federal law as much as possible instead of what other states are doing and then NO individual or organization will have to live with the threat of potential federal prosecution.

There are times you may want to tell a woman to calm down, like when you lack live electrical wire to chew on or are curious as to how the nurses would react if you walked into the ER with your head under your arm.

Many people believe the myth that the typical man is about as emotionally sensitive as the typical hammer. However, neuroscientist Tor Wager looked at the findings from 65 brain imaging studies and found that—overall—men’s brains weren’t any less responsive to emotional stimuli than women’s. However, Wager’s study and others did find sex differences, like that women seem more likely to experience negative emotions—fear, anxiety, and depression. Women also seem to be more emotionally expressive—verbally and in writing—and better at processing emotions, so they’re less likely to end up feeling dragged out back and beaten up by them.

But for men, when women get emotional, and especially when they veer off into rantville, emotion processing can play out something like this. Woman: “Knock-knock.” Man: “Who’s there?”

Woman (upset): “Feelings!” (Silence. More silence.) Woman: “Hello? Hello?! I know you’re in there! I can hear the TV!” To a man, an irate woman’s sharing of her emotional drama can be a bit like her sharing her Drano-tini. Relationships researcher John Gottman explains that men can become physiologically overwhelmed from stressful conversation alone, getting “flooded” with stress hormones and feeling physically ill and desperate to withdraw.

This happens through a “misattribution of arousal,” which means that your brain subconsciously (and instantaneously) puts mere talk that has a stressful vibe into the wrong bin—the “fight or flight” bin that alerts you, “Run from that tiger!” In response, adrenaline surges, your heart races, sweat beads, and parts of your brain and body that aren’t vital for bolting the hell out of there shut down. Yes, that’s a “Sorry, we’re closed!” sign on your digestive tract, and—oopsy!—there’s another on your brain’s higher reasoning center (which makes sense, considering you’re

supposed to be dashing away from the tiger, not parsing whether you have ill-will toward its mother-in-law).

The thing is, running away—as your body has primed you to do—would metabolize the stress hormones. But when you just sit there, the stress hormones just sit there, pooling, poisoning you, leading to sickening feelings. The natural impulse is to take shelter from the adrenaline storm—to escape and go off and recover— but this is hard to explain in any articulate and emotionally sensitive way in the moment, as your ability to reason is on sabbatical. So, in lieu of ducking under the nearest couch like the cat, you do it verbally, telling her, “Calm down!”

Of course, the problem here wasn’t that she needed to calm down, but that you did.

So when you laid that on her, she probably heard, “I’m not just going to ignore your feelings; I’m going to dismiss them.” (This always goes over so well with women.)

Explaining the sex differences in emotion processing might help you both keep in mind that a man isn’t just a woman with a different set of funparts.

For example, for her, venting her feelings may simply be a way of managing them.

However, in the spirit of better male/ female communication, you need to tell your girlfriend your plan. No, you can’t just flash her a look of panic and bolt out the door—though being chased down the street by an enraged woman clutching your renaissance faire crossbow should do wonders in diminishing that nasty adrenaline buildup.

Betelgeuse, considered the star likeliest to go, is 197 parsecs distant. Arcturus, since you asked, is 11 parsecs away. Seeming implication: donâ&#x20AC;&#x2122;t worry about it. â&#x20AC;˘ Not so fast. No supernova candidates are within striking distance of us now.

However, as the stars wheel through the cosmos over astronomical time, some may come within range. â&#x20AC;˘ Another cosmic peril is gamma-ray bursts (GRBs), focused beams of highenergy radiation thought to be thrown off by, among other things, massive supernovas. GRBs have a lethal range of 1,000 parsecs. The GRBs we detect (theyâ&#x20AC;&#x2122;re quite common) come from galaxies much further away. However, if (a) a massive star within 1,000 parsecs of us were to go nova, and (b) said nova produced a GRB, and (c) said GRB were pointed in our direction, Earth would be smoked. â&#x20AC;˘ What are the chances? Professor Beech calculates that, â&#x20AC;&#x153;over the remaining life of the biosphereâ&#x20AC;?â&#x20AC;&#x201D;the roughly two billion years he thinks weâ&#x20AC;&#x2122;ve got left before our dying sun snuffs itâ&#x20AC;&#x201D;we may get belted by one GRB and 20 supernovas, or roughly one every 100 million years. Indeed, Earth may have already gotten smacked a few times. â&#x20AC;˘ Butâ&#x20AC;&#x201D;a very big but, speaking franklyâ&#x20AC;&#x201D;we donâ&#x20AC;&#x2122;t know this for a fact.

Although scientists have conjectured that turning points in Earthâ&#x20AC;&#x2122;s history stemmed from close encounters with a supernova, evidence is lacking. (A few supernovas have been spotted in historical times, but all were at harmless distances.) In other words, the risk posed by supernovas and GRBs is entirely theoretical.

Granted, theorize is what scientists do. Professor Beech concedes the threat is â&#x20AC;&#x153;not one of immediate concern,â&#x20AC;? immediate being deďŹ ned as within the next several million years. However, in his view thatâ&#x20AC;&#x2122;s no reason to put the matter out of our minds. He thinks itâ&#x20AC;&#x2122;s worth looking near other pre-nova or just-past-nova stars for signs of large-scale astroengineering projects constructed by advanced civilizations attempting to shield themselves from incineration.

Weâ&#x20AC;&#x2122;ll let the professor brood about that. As for you, Travis: If you want to have the occasional palpitation about giant asteroids, go for it. But cross supernovas off your list.

We know some far-off stars like Betelgeuse look highly unstable and could go supernova at any time (this being a relative term). But what about closer to homeâ&#x20AC;&#x201D; say, within 50 light-years? What if Arcturus burned through all its hydrogen and went supernova? What effect would that have here on Earth?â&#x20AC;&#x201D;Travis van Dreven Weâ&#x20AC;&#x2122;ve got drought in California, economic crisis in Europe, random mayhem all over, and youâ&#x20AC;&#x2122;re fretting about supernovas? Well, somebody has to. Luckily, Martin Beech, astronomer and author of a 2011 paper, â&#x20AC;&#x153;The Past, Present, and Future Supernova Threat to Earthâ&#x20AC;&#x2122;s Biosphere,â&#x20AC;? has already done the spadework. Short version: you can renew your magazine subscriptions for another year.

To set the table for the long version, letâ&#x20AC;&#x2122;s categorize existential threats: First order. We may think of these as hundred-year perils, indicating the timeframe within which the cloacal discharge has a decent chance of encountering the rotary distributor.

Examples abound: nuclear war, global warming, resource exhaustion. If the most alarming predictions have yet to become reality, thatâ&#x20AC;&#x2122;s partly because some of our speciesâ&#x20AC;&#x2122; biggest brains have teamed up to head them off.

Second order. These are the thousand- to hundred-thousand-year threats. The classic example, brought to mind by my recent column on the subject, is the next ice age, once thought to loom. Modern humansâ&#x20AC;&#x201D; people you could invite over for an evening of spare ribs and pinochleâ&#x20AC;&#x201D;have endured at least one such trial already. For now, global warming has pushed the return of the glaciers to the back of the freezer. But thereâ&#x20AC;&#x2122;s much we donâ&#x20AC;&#x2122;t understand. Who the hell knows?

Third order. These are perils range from the millions to tens of millions of years.

Here weâ&#x20AC;&#x2122;re talking about giant asteroid strikes, great extinctions and other cataclysms that permanently affect life on Earth. So far as we know, no such event has occurred within human experience. That said, thereâ&#x20AC;&#x2122;s good evidence these things have happened, and they might again.

Fourth order. These are disasters that may strike within the hundreds of millions to billions of yearsâ&#x20AC;&#x201D;â&#x20AC;&#x153;very low probability, high-consequence problem[s],â&#x20AC;? as Professor Beech puts it. This is the territory heâ&#x20AC;&#x2122;s staked out. In the densely argued paper, he notes the following: â&#x20AC;˘ A typical supernova must occur within 10 parsecs (about 33 light-years, or 192 trillion miles) of Earth to have any noticeable effect. The closest star thatâ&#x20AC;&#x2122;s on track for supernovadom, IK Pegasi (a binary pair, actually), is 46 parsecs away;
