Merger, May I?

Silicon Valley Congresswoman ANNA ESHOO, like many fellow Democrats, has duked it out with telecom giants over privacy and net neutrality. But when the veteran lawmaker had a chance to grill execs over the planned T-Mobile-Sprint merger, she positioned herself firmly in their corner by urging regulators to bless the $26.5 billion tie-up.

Instead of using her allotted five minutes at a Feb. 13 House Energy and Commerce Committee hearing to probe the deal, she echoed some of the same industry talking points that They came up in a letter she Did co-signed a few weeks prior with six Republicans What? and as many centrist SEND TIPS TO Dems. Eshoo argued that FLY@ shrinking the market METRONEWS. from four to three major COM wireless carriers would incentivize 5G rollout and somehow boost competition (a claim belied by a half-century of telecom history, but OK).

Democrats have historically taken a more skeptical view of telecom mergers. In 2011, BARACK OBAMA‘s Justice Department sued to block AT&T’s proposed T-Mobile acquisition. Three years later, a Dem-led FCC blocked T-Mobile’s first attempted union with Sprint.

But Eshoo’s logic seems to be: Why fight it?

Or, rather, to fight duopoly with duopoly.

“Capitalism doesn’t work without competition,” she explained from the dais.

“And when markets don’t work, consumers are the first to lose. Competition is the lifeblood of the economy. It stimulates innovation—something that my district produces a great deal of—and it benefits consumers with more choices, lower prices and better service.”

Funny she’d invoke her home turf’s famed high-tech industry in an argument for mega-mergers, considering Joint Venture Silicon Valley released a report the day before that noted how consolidation has made the region inhospitable for startups.

It’s hard to imagine Eshoo buying her own rationalization. Maybe those $572,000 in career donations from major telecom firms made it easier to suspend scrutiny.

Parks and Wreck Taxpayers say more sunshine is needed in parks district’s governance

HE AGENDA PROMISED talks about hall drapes and management contracts, check signings and wage hikes— the kind of mundane orders of business that grease and grind the gears of local government. Nothing on the docket hinted at the kind of drama in store for the night.

Four elected board members, a bureaucrat under their charge and a lawyer assigned to keep everyone on task sat to one side of a folding-table dais as a small but forceful audience lobbed claims of corruption, secrecy and self-dealing, among other varying degrees of wrongdoing.

“Don’t be a force of evil!” one woman implored the board.

“You’re completely racist,” another hissed. “Rude and racist.”

“You’re a shrew,” a trustee muttered at one point about a colleague.

Nancy Clark, the attorney on loan for $250 an hour from Santa Clara County Counsel James Williams, tried to enforce parliamentary procedure to no avail. Repeatedly drowned out by crosstalk, she finally let out a heavy sigh, rested her chin on her palm and waited until the invectives gave way to bickering, eye-rolling and occasional lulls of civility.

The highs and lows of that the first leg of the first meeting of the year reflect something of a new normal for the Rancho Rinconada Recreation and Park District, a virtually unheard-

of public agency struggling to adapt to a constituency that’s generations removed and a world apart from the one that spawned it.

“A lot of people had no idea this existed,” says Sophia Badillo, who recently became the newest, youngest and, as someone of Filipino-Chinese descent, the only ethnic minority on the board after campaigning as a reformer. “And they had no idea how much they were paying for it.”

Thus, the backlash.

Much of it flared up last summer once Badillo and board ally Sandy Yeaton began publicly lambasting the standalone parks district—a largely seasonal operation that runs a swimming pool and rec hall with a bare-bones staff—which they said too many residents knew little to nothing about. And much of it centers on 34-year-old general manager Kevin Davis and long-serving trustees Miriam Salo and Steve Wesolowski.

Suddenly, everything became suspect: Wesolowski’s solo pool visit on Christmas Eve, Davis’ burgeoning takehome pay, Salo’s and Wesolowski’s residency outside the district, fellow board member Julie Jarvis’ sudden resignation and the pool’s insistence on remaining an all-cash business.

Price and marketed to predominantly white buyers under the brand “Miracle House.”

As Santa Clara Valley became Silicon Valley, the blue-collar neighborhood underwent an attendant transformation. Multi-story McMansions supplanted cheaply built ranch homes. Cupertino annexed the ward in 1999, which helped standardize its loosely zoned hodgepodge aesthetic, and set it on course to becoming one of the priciest locales in the nation. The former white working-class community became a predominantly AsianAmerican enclave with a median home price of $1.1 million—more expensive than 82 percent of neighborhoods in California and 96 percent in the U.S. As a result, Rancho Rinconada’s property tax revenue skyrocketed while many of the homeowners who knew about their stake in the district’s governance had long since moved away. Wesolowski is one of the holdouts. The second-longest-serving Rancho Rinconada board member behind Yeaton, he bought his house for for $100,000 in 1973. “It was one of only a couple places in the valley I could afford to live,” he says.

In 1992, he joined the rec district’s board after he began using the pool for a water aerobics routine choreographed to treat a back injury.

In his view, the board served the neighborhood to the best of its ability and hired a thoroughly competent manager in Davis, a mild-mannered former lifeguard who worked his way up to helm the agency in 2013. “The district’s been running so well for so many years that it seems nobody was interested in challenging us,” Wesolowski says.

Granted, the dearth of contenders might owe to a lack of outreach more than a lack of interest; Wesolowski acknowledges as much. So does Davis.

“Was there outreach? Yes. Was it enough? No,” Davis offers. “But we’re working on that.”

For the few people who work at the district office before it staffs up with dozens of temps during the warmer months, the recent controversy expressed in sometimes personal terms on NextDoor has taken a toll. Davis, for his part, says he’s determined to maintain composure and that he’s committed to working with the board as it tries to regain public trust.

Like many of the 2,000-plus special districts throughout the state and some of the 20 or so in Santa Clara County, Rancho Rinconada faces mounting criticism that it outgrew its usefulness, and that, in the eyes of Badillo and Yeaton, it fails to connect enough with the rapidly changing population that funds it.

A vocal group of homeowners within the 0.4-square-mile district in Cupertino say they realized only recently that they shelled out a combined $2.5 million in property taxes in just the past four years to fund the district or that it went decades without an election because until 2018, nobody challenged incumbents.

Several of the residents who’ve been speaking out at recent board meetings say they had no idea that a greater share of their property tax bill went to the pool (about 4.6 percent) than their local library (2.4 percent), or that they bankrolled a $20,000 raise for Rancho Rinco’s general manager, who’s slated for another $13,000 bump. (To be fair, Wesolowski notes, Davis has done a fine job building up program revenue and professionalizing the previously part-time position).

Without more robust outreach from the district, critics like Badillo and Yeaton contend, how else would they know about their tax-paid entitlement to what they figured was just another neighborhood pool? The county assessor began bumping the Rancho Rinco allocation from itemized tax bills sometime in the 1980s when it got crowded out by a litany of new bond measures. It’s a debate revived time and again by good-government advocates: Would services offered by these kinds of small, singular agencies, many of which fall under the public radar, be more effectively managed by overlapping counties and cities?

Special districts proliferated in California as public service delivery systems before cities developed the infrastructure to accommodate the post-WWII suburban boom. The state established Rancho Rinconada in 1955 to provide park services for what was then an unincorporated community and one of the most affordable places to live in the valley. For decades before its eventual buildout as a 400-home neighborhood with nearly 4,000 residents, it mostly comprised lowcost modular ranchos designed by architect Cliff May, built by Stern &

Silicon Valley on Verge of a Pot Delivery Boom

BY JULIA BAUM Weed delivery services could be blooming soon in the South Bay since state officials lifted restrictions last month. Now all persons 21 and over can have marijuana delivered right to their doorstep anywhere in the Golden State.

Before the announcement, delivery services had been a patchwork network restricted to operating within certain jurisdictions. Now people in California’s prohibitionist cities like Milpitas, which banned pot clubs and personal outdoor growing last year, can order weed from home.

“This means if a city has current ban, deliveries may legally take place,” Sean Kali-Rai, CEO of the Silicon Valley Cannabis Alliance, said in an email. “However, banned cities will not receive tax revenue.”

Whether Milpitas council members will revisit the issue at a later date is unknown, but they should consider it, given how San Jose racked up $10.5 million in 2017 and another $13 million in tax revenue last year, and that number is expected to get even

higher in 2019. Pot industry experts say the state’s decree will help fight a black market blamed for siphoning off tax revenue (legislators are addressing excessive taxation, which has also spurred illegal weed sales, with AB 286, which would suspend state pot taxes for three years). Meanwhile, critics say it eliminates local control from communities that don’t want any reefer madness.

Allowing delivery services all over the state should make life easier for medical marijuana patients. According to the Sacramento Bee, “residents in about 40 percent of the state have to drive 60 miles or more” to buy legal weed, even after voters approved recreational use. These tragic “pot deserts”—better known to some as the ninth circle of hell—are particularly problematic for those who rely on using cannabis for medicinal purposes.

Lucky local stoners will have a plethora of pot options in the near future. The San Jose City Council approved marijuana manufacturing,

distribution and testing labs in its borders last month and could explore letting current dispensary owners open a second location in town later this year.

City officials said those are potential items for the council’s priority list for the next fiscal year but added there are still “many, many competing priorities.”

The deadline to apply to open a brick and mortar store has come and gone in Mountain View, where 10 applicants signed up for four available permits. Santa Clara, Campbell and Morgan Hill are expected to follow; still, Mountain View’s selection of the final four would make it only the second local city to roll out the welcome mat for ganjapreneurs—that is, if all goes according to plan. At the last council meeting, Margaret AbeKoga suggested revisiting the city’s stance on pot. What that means for legal weed in Mountain View remains to be seen, but this much we know: there’s no stopping the pot delivery boom now that the state deemed it legal despite local laws.

Hanging Kaepernick Doll Spotted in SJ Days before Colin Kaepernick settled his collusion grievance against the most powerful sports league in the nation, a Metro reader spotted a racist effigy of the former San Francisco 49ers quarterback right here in San Jose.

It was close to 11am Feb. 12 when she says she saw it in the parking lot of the Almaden area Costco: a plush Kaepernick doll hung by a chain-link noose on the back of a gunmetal gray 2005 Nissan Titan pickup.

The observer, who asked to remain anonymous to protect her privacy, said the depiction of racial violence shook her to the core.

“Simulating the lynching of a black man who peacefully protested violence against people of color is racist behavior that cannot be tolerated here or anywhere in this country,” she said.

“It’s absolutely shameful that whoever is driving this truck is fine with this public display of racism and hate.”

Many such hateful representations of Kaepernick have ignited headlinegrabbing backlash in communities throughout the country. Last fall, a Placerville barber apologized after a photo of a Kaepernick doll hanging from his shop ceiling went viral. The proprietor said he hung the likeness in 2016 after Kaepernick began kneeling during the national anthem to protest systemic racism and police brutality. “I literally had no idea that I was offending people,” the barber told a Sacramentoarea Fox affiliate at the time.

That’s hard to believe.

It’s unclear who affixed a noosedup Kaepernick to the pickup photographed in south San Jose last week, so one can only wonder whether he or she would make similar claims of ignorance. But while Kaepernick’s biggest detractors try to frame their displeasure as some kind of patriotic defense of the troops and the flag, images like this make it hard to believe that it’s about anything other than race.—Jennifer Wadsworth

Word Play Play on Words lets storytellers see their works’ flexibility

ALL IT MIGRATORY collaboration. This Sunday, thanks to the San Jose Museum of Art and a local literary performance series, Play on Words, an international program of stories will erupt in conjunction with the museum’s current initiative, New Terrains: Mobility & Migration. Whoever registers in advance to attend the literary event won’t have to pay museum admission.

Play on Words began six years ago. To date, the series has migrated through a

variety of venues, from Cafe Stritch to Saint James Park, uniting performance artists, actors, theater enthusiasts, fiction writers and community gadflies. Play on Words operates via a submission process similar to literary journals, in that anyone can submit work for consideration: poetry, fiction, essay, one-act play or caustic screed. What’s different is that after the curators choose certain pieces, they put together a program and find other people to perform the works. It’s a spectacular way to see your own work interpreted by someone else.

At the museum, New Terrains connects multiple partnering organizations via a collaborative

exploration of how bodies move through social and political spaces in Silicon Valley. The theme can be interpreted literally or metaphorically, in any way, shape or form. As a whole, the project addresses topics like healthy transportation issues, urban planning, public protest, immigration, refugees, text mapping or even Situationistinspired psychogeography experiments.

For the event this Sunday, Play on Words curated its most diverse program ever, including fiction, nonfiction and poetry that dovetails with the New Terrains project. The stories, which came in from a wide swath of people, are set in Iran, South Korea, India, Serbia, China, Ireland, Mexico and the US. This is not limited to geographical terrain. Other pieces deal with emotional terrain, touching on issues like sexuality or aging. All in all, it’s a giant step forward for Play on Words.

“I’m really proud of all the shows we’ve done, but I’m especially proud of this one,” said Play on Words cofounder Julia Halprin Jackson. “We’re finally getting to a place where we’re reaching people beyond our

own network of friends, beyond the immediate downtown San Jose area.”

New Terrains began last year and continues through the spring of 2019, with more than 20 partnering organizations participating in the project, from museums and artist residencies to community centers and civic think tanks. Performances, exhibits, lectures and discussions have already unfolded. It’s like French postmodern philosophy meets the UN Refugee Agency, like NASA meets creek cleaning, like political protest meets art history. Organizations from the SETI Institute to the Mexican Consulate are involved, providing an avant-garde collaborative window into the real Silicon Valley.

All of which exemplifies how the San Jose Museum of Art sees itself as borderless, a facility more open to dialog across disciplines, communities and demographics.

Especially with the anti-immigrant political climate continuing to threaten humanity’s rational wellbeing, more people are uniting to address the issues via art practice.

“People are much more willing to reach out now, and wanting to work together, to meet each other, to stand together as various communities, instead of just speaking to themselves,” said Robin Treen, the museum’s special projects coordinator, adding that the New Terrains project has inspired many valley denizens to prioritize their similarities instead of their differences.

In fact, throughout history people from all over the world have settled in San Jose, usually arriving with specific intent, not just showing up because it’s where the train stopped or where their money ran out. “Immigrants built the government structures, the library and everything in San Jose,” Treen said. “And even if those various communities didn’t stick around, they all made big contributions. San Jose was never, ever just a one-culture city.”

Hence, a literary program of new terrains and migration. And perhaps the best example of what Play on Words can accomplish comes in the form of eighth-grader Michelle Qiao’s story, “The City Across the River,” a moving and eloquent tale set in 20th century China that will debut as part of this Sunday’s program. “She mentioned that her English teacher told her to submit,” recalled Halprin Jackson. “I don’t know who her English teacher is, but I thank her.”

M

ARK ZUCKERBERG isn’t a bad person—at least not according to Roger McNamee.

Nowhere in his new book, Zucked: Waking Up to the Facebook Catastrophe, does McNamee make such a claim. The problem is that when a CEO lives in a filter bubble, everything that happens downstream from him will probably reflect the CEO’s own predicament.

McNamee, a decades-long Silicon Valley investor, has held significant positions in many firms over the years, leading growth-stage investments in Electronic Arts, Sybase and Radius before co-founding Integral Capital Partners, a fund created in tandem with Kleiner Perkins, which put him at ground zero for the internet revolution. He was there on the very day Jeff Bezos pitched Amazon and when Larry and Sergey pitched Google. His most recent fund, Elevation Partners, included U2’s Bono as a co-founder.

In 2006, McNamee was among those who mentored the idealistic young Zuckerberg, shortly after he relocated Facebook to Palo Alto. He even introduced the social network’s

founder to Sheryl Sandberg, who would eventually become Facebook’s No. 2.

During those days, McNamee invested in Facebook and still owns a substantive number of shares. He still likes Facebook because it does useful things for more than a billion people.

However, ever since the role the social network played in spreading misinformation and driving division in the runup to the 2016 election, an increasing number of people are finding that the platform has a dark side—one that McNamee insists can’t be fixed unless the company overhauls its entire business model.

As McNamee tells it, it was precisely this model that drove Facebook to become what it is today: a worldwide apparatus of persuasive technology designed to keep users engaged by appealing to lizard brain emotions and modifying their behavior, all while harvesting personal data and metadata to sell to advertisers.

By now, plenty of people understand at least this much. But without taking a deep dive, it is difficult to wrap one’s head around just how serious the Facebook fallout is. Filter bubbles account for

much of the problem. McNamee writes that roughly 40 percent of Americans believe in something that is untrue: Obama was born in Kenya; humanity doesn’t contribute to climate change; Pizzagate.

These are all demonstrably false.

And yet, one man was so convinced of the veracity of Pizzagate—a reference to a conspiracy theory, which claims that high-ranking members of the Democratic Party ran a Satanic pedophile ring out of a Washington, D.C., pizza parlor—that he let loose three rounds inside the pizzeria.

In Zucked, McNamee explains that Facebook creates pockets of “intellectual isolation”—separating individuals from normal group activity and placing them in an echo chamber.

“Filter bubbles exist wherever people are surrounded by people who share the same beliefs, and where there is a way to keep out ideas that are inconsistent with those beliefs,” he writes. “They prey on trust and amplify it.”

Furthermore, these bubbles generate the most activity when their content is ideologically extreme.

Over time, Facebook’s algorithms have learned that anger and fear keep people far more engaged than

shinier, happier emotional states. And so, in the interest of keeping users glued to their Facebook feeds, those algorithms stoked tribalist outrage.

As a result, an illusion of online consensus is created where none exists, all of which enables bad actors to weaponize the platform, amplify hate speech, exacerbate polarizing opinions and spread fake news to scare people and pit them against each other—precisely what Russian intelligence did with their online influence campaigns. It’s not that anyone working for Facebook wanted this to happen—McNamee believes that no one at the company wanted this—it’s just that platforms like Facebook have no incentive to eliminate the chaos because it improves all the right metrics: time on site, engagement, sharing.

And since Facebook’s business plan is to monetize your attention and your time on the platform, a great deal of work went into every little detail—for example, just what shade of red makes the notifications more habit-forming, thus more successful at getting users to repeatedly check their news feed all day long.

ADDICTIVE ALGORITHM Facebook's business model, in concert with its algorithms, have worked to push people into addictive and polarizing echo chambers.

on each user’s activity, tracking everything they like, click or watch online, as well as the behavior of their friends and groups—all of which feeds an enormous artificial intelligence engine that constructs with ghoulish accuracy a massive data model of each user. Since the algorithms operate with an intrinsic bias by recommending sensationalistic, radicalizing or conspiratorial stories, the users become much more vulnerable to emotional manipulation and they remain engaged much longer. To this day, similar scenarios continue to unfold, not just on Facebook but on Twitter, Instagram and YouTube as well.

But Zucked is about Facebook above all else, so McNamee, fearing that the company he financially supported might now be a serious

catastrophe for privacy, innovation, democracy and the psychological health of humanity, is sounding the alarm and calling for a nationwide conversation. Zucked is an elaborate and triumphant manifesto-like screed that details the history of how it all went wrong—from baby photos, puppies and long-lost uncles to a global platform of mass surveillance designed to manipulate user attention and monitor everyone’s behavior.

In particular, one chapter titled, “Silicon Valley Before Facebook,” provides a compelling and concise history of how we got to where we are. In it, McNamee illuminates the last 70 years, drawing a line from the Apollo space program straight up to the current day, in terms of technology philosophy, business ethics, infrastructure and startup economics. Previous geniuses from

Doug Engelbart on through Steve Jobs all believed that technology should function as a bicycle for the mind, augmenting human intelligence rather than replacing it.

For a half-century before 2000, engineers and scientists were limited by processing power, memory, storage or bandwidth and thus couldn’t create what they truly envisioned, so they had to function as artists while trying to make something usable for the public. In the short few years from the original dotcom boom to the social media era, several dynamics all fell into place that few people outside of the technology industry understood.

Both Moore’s Law and Metcalf ’s Law evolved to a point where the aforementioned constraints disappeared and any aspiring CEO could build a business for far less than they could in the days before

cheap cloud storage, ultra-fast processing power and high-speed internet. They could focus much more on the application layer rather than infrastructure.

Before the social media era, there was no such thing as a globally successful startup comprised of college nerds without skills, pulling together a product just to see what would happen. Zuckerberg came along at the perfect time. Facebook exploded relatively quickly compared to the longer arcs of Apple and Microsoft. This new era also emerged hand-in-hand with an extreme libertarian ideology, characterized by a total disregard for the role of government in business and a total absence of empathy for anyone else’s problems, even if Facebook’s business plan aided and abetted those problems.

Facebook uses psychological tricks that lead to behavioral addiction— that’s a conversation we need to have Governments seem to agree. As of presstime, Facebook was wrapping up negotiations with the Federal Trade Commission that could result in a multibillion-dollar fine, thanks to the company’s privacy violations stemming from the Cambridge Analytica scandal. Similarly, the UK Parliament released a damning 100-page report calling Facebook and its execs “digital gangsters,” and concluding that the company intentionally and knowingly violated both data privacy and anticompetition laws, and should not be allowed to govern itself from now on.

Thankfully, in the midst of the catastrophe, McNamee says there is light at the end of the tunnel.

In Zucked, he provides a wealth of solutions. If society can summon its

collective will and come together to tackle these issues, we can move democracy forward, encourage nonmonopolistic innovation, repair the psychological problems caused by platforms such as Facebook, and ultimately, make the world a better place.

The following interview has been edited for length and clarity.

METRO: In retrospect, could you have predicted the way in which Facebook’s platform began to facilitate bad actors weaponizing Facebook’s business plan?

McNAMEE: The key thing, and to me this is the important point, is imagine that there are three phases to my relationship with Facebook.

There is phase one where I am one of Mark’s advisers. I’m also separately a friend and adviser to Sheryl Sandberg, and then I had the opportunity to bring them together.

Then comes what I would call the quiet period, which is sometime in 2009 through the end of 2015. And there I’m just a cheerleader. I no longer have an insider relationship.

But it was a period where I couldn’t have been prouder. By all the public metrics, the company was exceeding my wildest dreams. And then comes the third period, what I will characterize as the activist period, where, beginning in January or early February of 2016, I start to see things that literally did not compute for me. The notion that bad actors would do harm to innocent people over Facebook literally never occurred to me until I saw it.

METRO: Since many people still find Facebook extremely useful, how can the public be made to understand the negative aspects of the platform?

McNAMEE: What I have learned is that the business model and the architecture of the product in combination with the culture of the company—those three things have combined to enable a lot of bad outcomes for innocent people.

And the impact can be seen in at least four areas. First, public health, which is really the mental health of the users of all ages, from little

McNamee writes that he never knew Facebook would begin evolving its business model toward the dark arts of persuasive technology, which quickly became the equivalent of AI-controlled crystal meth for the masses. As Facebook grew in scale, its techniques enabled emotional contagion to overwhelm reason and spread like wildfire. Left unchecked, bad actors will continue to take advantage of the tools Facebook uses to manipulate people. Hate speech and confusion will continue to spawn violence. Disinformation will continue to damage democracy, says McNamee.

Second, democracy, with obvious impact in the United Kingdom and the United States. Third, privacy. And, fourth, innovation. And so what you have here is a wonderful technology operating in an environment with no constraints and no accountability.

I constantly repeat this point: I do not think that any of these people are bad people. I believe that they have been encouraged from the earliest years of their companies to pursue growth and stock price appreciation without concern for any other consequence. And the investors, the boards of directors, the friends, the spouses—all have played a role in making the behaviors of these companies seem reasonable. I get that. I’m actually sympathetic. It’s not like these products do nothing good. In fact, quite the opposite. The reason they’re so successful is because they provide services people want in a very convenient form. Now, the fact that they use psychological

tricks that create behaviors that lead to behavioral addiction, that’s a conversation we need to have.

METRO: Most of the tech industry believes that AI is the future, but you don’t think so. If AI must exist, what can be done to prevent future damage?

McNAMEE: The transition from the fallibility of humans to AI should be done in a manner that eliminates implicit bias. But there’s nobody to make that happen. So when I look forward—and I think this is a very core point—I have great optimism, because I not only can see the path we should be on, I believe we have the ability to get there. When I look at, say, Facebook or Google, those businesses depend on the attention of human beings. They depend on the hands-off behavior of policy makers.

And the people that use these products have a lot of leverage against both of these things; they have the ability to withdraw their attention to make a point, same way the teachers in L.A. went on strike, or the way the

METRO: Plenty of people can use Facebook in a positive way without feeling manipulated, or they simply just don’t care if their behavior is being monitored 24/7.

So what do we do?

I do not pretend that I know the right answer. What I know is that I care deeply about Silicon Valley, I care deeply about technology.

Facebook continues to be the largest investment that I hold. And I hold it because I don’t want anybody to be confused about why I’m doing this.

I’m doing this because I’m terrified about the future of our country and

about the future of civilization. I believe that what [Shoshana] Zuboff calls “surveillance capitalism” may be as great a threat as climate change because the underlying technology strips us of our humanity, and the people who operate these technologies are not accountable to the people affected.

So it’s not a choice. People can say, “Oh, but you pick your friends, and you pick what you click on.” But that isn’t actually true, because all of these things operate with this notion that Tristan Harris calls brain hacking, which is very clever psychological tricks to play on the weakest elements of human psychology. And there is something deeply dystopian about what’s going on. And my point here is, we need to engage in this conversation. Let’s not pretend that this is in any way good for humanity or good for society. Because the evidence right now is demonstrably that it’s not.

METRO: How difficult will it be to move the needle and bring the bulk of society on board with this?

McNAMEE: I am really sympathetic.

I think this problem is really hard.

I spent 34 years doing nothing but investing in tech. I’ve spent the last three years trying to figure out what the hell is going on, and I did it as a full-time job. IT is really confusing.

I wrote the book because it was so damn confusing I realized, “Wow, if I describe my journey to everybody, that will help them get a jump start.” I am playing Jimmy Stewart in Rear Window. I see something that looks like a crime, and I pull on the thread until I understand it. And in sharing that journey with the reader, I allow the reader to skip the three years I spent figuring that part out.

Now that everybody’s focused on it, we’re learning really quickly. And my point here is, your kids’ health depends on it. Your health depends on it. The country’s health depends on it. The world’s health depends on it. And we shouldn’t feel sorry for the billionaires that own these companies. They’re incredibly rich, they’re going to be happy and fine no matter what. Now it’s time to focus on everybody else.

You withdraw your attention and you really profoundly impact the outcome. And by the way, you see this with Facebook now. People have really changed their usage patterns in the United States, and I don’t think they’re done. Policy makers recognize that [Facebook’s] behavior is inappropriate and all they’re asking is to get enough pressure from voters to justify taking action.

And if you ask yourself what’s the policy, let’s just look at a new category like AI. You go, “I think all artificial intelligence products should have to prove safety and efficacy.”

Now, do we have a model for that?

Interestingly, we do. When the Food and Drug Administration in 1938 was given its current powers to find safety and efficacy for any new drug, it had all these inspection things from the earlier Food and Drug Act relative to the food supply. Why? Because everybody recognized that food and medicine were so important; you couldn’t afford to have bad actors hurting people. And I believe with AI it’s the same thing. We need to get back to having technology being something that empowers people, not takes away their humanity.

So my basic point is, I want Silicon Valley to return to the culture and philosophy of “bicycles for the mind.” And I believe as a solution to a man-made problem, it’s directly analogous to wind power and solar in that there’s a gigantic business opportunity for fixing this mess. I’m not saying we have to blow up Silicon Valley and go home. I’m saying just the opposite. I want us to stop hurting people.

hen a company grows from nothing to 2.2 billion active users and forty billion dollars in revenues in only fourteen years, you can be sure of three things: First, the original idea was brilliant. Second, execution of the business plan had to be nearly flawless. And third, at some point along the way, the people who manage the company will lose perspective.

If everything your company touches turns into gold for years on end, your executives will start to believe the good things people say about them. They will view their mission as exalted. They will reject criticism. They will ask, “If the critics are so smart, why aren’t they so successful and rich as we are?”

Companies far less successful than Facebook have fallen victim to such

overconfidence. The culture of Silicon Valley, which celebrates the brash and the bold, breeds overconfidence and then lets nature take its course. The corpses of overconfident companies litter the landscape of the tech industry.

Companies like Digital Equipment, Compaq, Netscape, Sun Microsystems and MySpace were hot growth stories in their prime. Then there are the survivors who had lost prestige as their growth slowed down, companies like Intel, EMC, Dell, and Yahoo.

The executives of these companies confidently predicted strong growth right up to the moment when there was none and the stock—and their dreams of endless growth—came tumbling down. Then there are companies like Microsoft, Oracle, and IBM, at one time undisputed leaders but whose giant market capitalization masks a dramatic loss in influence.

It took me a very long time to accept that Zuck and Sheryl had fallen victim

to overconfidence. I did not pick up the signal when I first reached out to them in October 2016. It was not even clear to me in February 2017, when I gave up on trying to convince Dan Rose to investigate my concerns. The evidence started to pile up in the month prior to the hearings on Oct. 31 and Nov. 1, 2017, but I still wanted to believe that Zuck and Sheryl would eventually change their approach…

Instead, Facebook finished 2017 as it had begun it, by not giving an inch, thus violating a central precept of crisis management: embracing criticism.

Instead, Facebook defied its critics without even acknowledging their existence. The company’s message to the world—“nothing to see here, move along”—was so completely out of step with what we already knew that I was taken aback. What were they thinking?

The idealist in me still hoped there would be a way to persuade Zuck and Sheryl to look at the situation differently, to recognize that the 2018 U.S. midterm elections were fast approaching and only Facebook had the ability to protect that election from mischief similar to 2016…

Back in early October 2017, Barry Lynn of the Open Markets Institute had convinced me to write a long‐form essay describing the dark side of social media, our journey to date, and our best policy ideas. He then persuaded the editors of Washington Monthly, a venerable magazine for progressive policy advocates, to commission a 6,000-word essay. My goal was to crystallize the issues and our policy recommendations for policy makers inside the Beltway, an intellectual one‐ stop‐shop that would frame the debate and create a platform for the next phase of our work. I submitted the first draft in late October.

I would get a master class in the Socratic method from the piece’s editors, Paul Glastris and Gilad Edelman, who provided a series of brilliant questions, the answers to which filled in many holes. We showed the policy prescriptions to a number of others on Capitol Hill to get their feedback. The editing and reviewing went on through the month of November until one day Gilad told me we were done. The essay would be the cover story of the January 2018 issue, slated for publication

on January 8. It went beyond election interference to talk about the threats from internet platforms to public health, privacy, and the economy…

On Jan. 1, 2018, Zuck published a post announcing his goal for the year ahead—to fix Facebook. He offered a nine-point plan. Wait. What? Fix Facebook? Where did that come from? No one at the company had previously admitted to problems that might require fixing. Suddenly Zuck acknowledged concerns about fake news and the possibility that too much Facebook (or other social media) might lead to unhappiness. He offered a classic Zuck fix: more Facebook! Zuck’s plan for addressing the problems created by Facebook was for users to do more of the things that created the problems in the first place.

In response to Zuck’s post, Washington Monthly published my cover story online a few days early, on Jan. 5. Even though I had completed the essay more than a month earlier, it read like a rebuttal to Zuck’s New Year’s resolution. Where Zuck’s post had framed Facebook’s flaws obliquely, my essay was direct and specific. Where his remedy was more Facebook, my essay recommended ten remedies, aimed at user privacy, ownership of data, terms of service, and election interference. The press picked up on it, and the next thing I knew, an essay designed for a handful of policy makers in Washington began spreading outside the Beltway. We had managed to find a pretty good audience for our message in 2017, but we had made no progress with the only audience that mattered: the top people at Facebook. The company’s PR people had begun to say unflattering things in private but were ignoring us in public. And it was working for them.

Then came Washington Monthly. The lucky timing of the essay would lead Facebook to engage directly.

HERE IS LITTLE doubt that the South Bay has come into its own as a beer snob’s paradise.

Downtown San Jose boasts at least 10 taprooms focused on high-end hoppiness, and even craft cocktail bars can’t ignore the craze: Over the weekend, Haberdasher drew a line stretching around the corner after scoring a keg of Russian River Brewing Company’s much coveted limited release, Pliny the Younger.

Some craft brew establishments serve their own beer on site and

partner with food trucks. Others have had success cooking their own food alongside beers from a variety of labels. It is rarer to find a brewery that produces beer and food on site. That’s where Off the Rails, the newest entrant to the Silicon Valley gastropub game, is hoping to separate itself from the pack.

Located in downtown Sunnyvale, it occupies the former location of both Firehouse Grill & Brewery and Stoddard’s Brewhouse & Eatery—111 Murphy Ave. Off the Rails is no mere rebrand, however. The fastcasual brewpub comes with a totally revamped menu, and an impressive and diverse in-house beer selection.

They’ve also separated the food

ordering area from the bar; this, along with the open, well-lit floor plan, gives Off the Rails an inviting, familyfriendly feel.

The menu was developed by Off the Rails’ chef, Israel Zinanda, who comes to Murphy Avenue after a twoyear stint at The Basin in Saratoga.

It features a curated collection of standard diner fare like burgers, salads, flatbreads and “social plates” for sharing.

The seven on-tap brews are mostly holdovers from the Firehouse’s brewmaster, but their Murphy Wheat Bavarian Hefeweizen and Commuter IPA are the creations of the new Off the Rails brew chief, Michael R. Barker, who served as brewmaster for Firehouse from 2014-15 and then as a consulting brewmaster for Sactown Union Brewery in Sacramento from 2015-18.

Aesthetically, their lineup captures most of the colors of the beer rainbow, from pale gold to dark amber. As a fan of stouts and porters, I was disappointed that their taplist didn’t reach all the way down into the creamy, black depths. However, I was reassured by the friendly barkeep

that Off the Rails plans to embrace the dark side this spring.

I was having a hard time deciding which beer I wanted to sample, so I ordered a flight—four beers served in 4-oz. glasses ($13). To soak up the suds, I ordered a beet and goat cheese salad ($12) and a spicy vegetarian flatbread ($10).

I began my flight with the crisp South City Cider. It was sweet and bubbly with subtle apple notes. Next up was the hefeweizen, which was refreshingly smooth and light on the palate—the perfect beer for sipping while watching a ball game.

From there, I worked my way to the IPA, which draws its bold flavor from three different types of hops. It was surprisingly easy to drink given its high alcohol content (7.3 percent).

It even impressed my companion— not an IPA fan by any means—who commented on the the beer’s pleasant floral aroma.

My favorite beer by far was the Dub Nation—a dubbel with a striking, dark brown color. Traditionally, Belgian dubbels are heavy and bitter, but I found the Dub Nation to be sweet and almost nutty; it’s the kind of beer that could easily tag along with a steak or decked-out burger.

Speaking of the food, the veggie flatbread and goat cheese salad paired excellently with our flights.

The flatbread was crisp and brought plenty of heat with a generous helping of jalapeños. Its spiciness was counterbalanced with a sweetness from the caramelized onions and mango salsa. The gamey and creamy goat cheese struck a pleasant harmony with the sweet and earthy roasted beets for a flavor combo that could only be classified as “adult.”

With an already impressive— and growing—beer selection and a rock-solid food menu, I foresee Off the Rails being one of the top gastropubs in the South Bay for a long time to come.

Local indie rockers Bylines officially release their debut album this Friday. Summit Road is a seven-song set of laid-back grooves, echoing open chords and intertwining guitar leads. The record’s lead single, “Easy To Do,” vaults over the kind of self-absorption posturing as sassy self-awareness in the standard down-and-out rock & roll ballad—as the track’s narrator owns up to his apathy: “It’s easy to do,” he sings, before shrugging in resignation. “It’s easier not to do.” One imagines he could be talking about apologizing, putting down the bottle or just being more present. The lyric’s opacity will likely mean different things to different listeners, a hallmark of any great pop song. (MS)

LunaFest is a package of short films, all created by women filmmakers from all around the world. This year’s mini-fest includes a documentary by Japanese-American filmmaker Yuriko Gamo Romer on her journey to American citizenship; the story of a black girl in Los Angeles grappling with her first encounter with racism and sexism; Australian Sophie Hexter’s story of a young woman whose life was changed when she took up the drums; and several other shorts all focused on life, love, struggle, hope and letting go. The Sunnyvale Community Players have been sticking to the classics this year, and their forthcoming show is no exception. The local theater company’s annual junior production is Bye Bye Birdie. But she also likes to re-imagine the context of such things in her installations. In STUFF(ed), she creates walk-in art spaces in which bold colors bleed and bounce all over the place, and violate the natural boundaries between wall, floor and ceiling. She calls her work in this installation “living paintings,” and they’ve come about thanks to the SJICA’s Sandbox Projects, which allow artists to stretch their muscles with site-specific work.

Overflowing Frame Two solo art shows ruminate on crowded scenes of everyday life in San Francisco

T

HE FRENCH photographer JR crowds every corner of his black and white images with people in “The Chronicles of San Francisco—Sketches” (through March 24 at Pace Gallery). During a 2018 visit, he and his roving team of assistants and co-conspirators photographed hundreds of San Franciscans. They captured individuals participating in group activities, attending a concert or a protest.

They also took snapshots of individuals performing the same task,

such as taking a selfie or working on a laptop. And, in the final, lengthy, horizontal compositions (most of which include the caveat “Work in Progress”), they cut each person out and arranged them next to one another. The singular task multiplies while the individuals overlap and merge into something monolithic. They are, perhaps unconsciously, homages to homemade high school collages.

Every photograph looks like it’s taking place in a stadium-sized event with people sitting or standing in different tiers, in row upon row. But the backgrounds are distorted and abruptly shift. In one corner of Balloon, you can see the downward curve of a typical hilly street. But the Castro Theatre marquee

sign shows up in the foreground just to the right of it. When you’re standing in front of the theater, you’d have to turn your head in either direction to see a street that rises out of the Castro and up to Noe Valley or to Divisadero.

And, as if they’re defying gravity, a dozen protestors float upward, blocking out the “R” and the “O” in the Castro sign.

JR isn’t afraid to enliven a busy scene like this with even more randomness.

You can find someone riding a bicycle, doing push-ups or sitting glumly selling newspapers.

Unlike JR’s “Sketches,” “Going Places: Drawings by Ric Ambrose” (at Triton Museum of Art through April 14) gathers urbanites together in a more orderly approach. Ric Ambrose also

takes photographs, but that’s just the point of departure. Whether vertical or horizontal, his graphite drawings resemble straightforward renderings of photography rendered in scroll form. But Beach Bum, a panoramic view of a sand and seascape, is actually a composite of two different beaches, one in Northern California and the other in Santa Monica. Ambrose says there’s a tell in that some people are dressed in sweats because it’s cold. “I'm fascinated by how people at the beach are uninhibited, even their gestures,” he says. “They're in their own space, not aware how people are looking at them.”

A delighted child is buried in the sand up to his neck. Two surfers carry their striped boards. Three swimmers with wet hair dry off on their towels.

And a man with sunglasses on at the center of the canvas stares directly at the artist. Invariably in “Going Places,” Ambrose is alert to the consciousness of the individuals he’s looking at and then interpreting on paper. He’s not consuming them so much as recording human interactions, his included. In contrast, the posing in “Sketches” feels mechanical and artificial. JR enlarges

the idea of a selfie so that it becomes an orgiastic ritual. As you enter Pace, the greeting desk in the front gallery has been displaced by 6- to 7-foot tall diorama stands. Visually, they read better when you’re standing outside and across the street. One of them is a collage of people, all smiling, as they hold their cell phones up in the air and back at themselves.

Ambrose doesn’t exclude technology from his work, but it serves his art and not his vanity. In 54 Giant Boulevard, you can see the faceless outline of the artist taking a photograph with his phone as reflected in the shiny hood of a car. The city street looks like it’s enjoying a temporary hush, but there are signs of life behind every carefully drawn skyscraper window. “You see, on the hood of the car, all those buildings are surrounding a void of the sky itself,” he explains. “There was a term that art historians would use, the pregnant void, meaning empty space is activated.” There is no such empty space in “Sketches.” When everyone is activated, as in JR’s San Francisco photographs, the individual is lost, which may be the point.

The JR we meet in the documentary Faces Places, which CLA_Ads_Nayomi.indd Agnès Varda co-directed, doesn’t square with the artist behind the Pace exhibit or his 2017 installation of a child at the Mexican-American border. In both cases, his photographs purposefully bring something humane from his subjects. Ambrose looks at the same group of San Franciscans and makes connections with and between them, whether in cafes or in crosswalks. In “Sketches,” everyone in the Bay Area is just a face in the crowd.

A Tall Tale ‘The Light Between Two Towers’ details connection between San Jose, Paris

NCE, SAN JOSE could have been known as the city that kept the light on for you. At the corner of Market and Santa Clara streets stood a light tower, 237 feet tall with flagpole. It was the size of a 24-story building.

Suspended at its top were a clutch of six arc lights, blazing at 24,000 candlepower. Visible for miles, it was bright as the moon—thus the nickname, “the Moonlight Tower.”

Tom Wohlmut’s documentary, The Light Between Two Towers, uncovers new

evidence that the Eiffel Tower—built eight years after San Jose’s Moonlight Tower—might have been based on ours. Gustave Eiffel’s engineers were certainly familiar with models in “certain American cities” of iron towers bearing lights, “Eclairage électrique à grande hauteur.” Like the San Jose tower, the Eiffel has a series of arches at its base, instead of the original stone pedestal that had been proposed.

Moreover, Wohlmut traces the strong connections between local landowners the De Sassets, the banking Rothschilds (at last, featured in a benign conspiracy theory) and some of the highest members of the French government. Not only was the San Jose

tower potentially a model for the Tour d’Eiffel, its iron structure may also have solved the problem of building the core structure of the Statue of Liberty.

The invention of the arc light, and the electric generators to power them, led to experiments of suspended lights from high structures; towns even as nearby as Nevada City tried it.

But the San Jose tower was heralded right away. Harper’s Weekly, one of the most important magazines of the day, described the San Jose tower as “the first of its kind.” The Los Angeles Times swore, “Los Angeles wants one, and must have it.”

It was all the dream of Mercury publisher J.J. Owen, who becomes quite a character in Wohlmut’s crowdfunded documentary. This booster and journalist urged the building of the tower, proposing it to be made of ordinary iron piping. At an initial budget forecast of $400, it ended up costing more than 10 times that). It was ultimately built by day laborers, and powered by the steam generator at a nearby lumber mill.

The Light Between Two Towers allows

you to sample Owen’s fragrant rhetoric about the tower’s light: “effulgent glory...like the smile of a loving god.” He was quite the futurist, forecasting the telecommunications revolution in his editorials. At the end of his life, Owen soliloquized the struggle to build the tower: “the long delay, the discouraging word, the cold refusal of aid…”

The tower lasted from 1881 to 1915.

Restrung with incandescent lights, it withstood the ’06 quake. The end eventually came when the decaying structure was slammed by a freak winter storm.

Gone as it is, the tower isn’t forgotten. The landmark is replicated at 50 percent scale at San Jose History Park. Not mentioned in the documentary is the matter of a 1989 mock lawsuit held at SCU. (Wikipedia, and all the sources that rely upon it, claims the trial actually occurred.)

The city of San Jose sued Paris for copyright infringement. There were unforgivable words on both sides of the line. A French partisan of the Eiffel Tower described our tower as “a clown’s hat.” Indeed. Well, such a clown would be the size of Godzilla.

Judge Marcel Poche found for Paris by claiming that there were parallels through the world of iron towers at the time. Bygones must be bygones, since dignitaries from the French consulate have been asked to attend the invitational screening on Feb. 20, preceding an upcoming run at 3Below.

Born in Australia, Wohlmut worked on 1970s TV programs like All in the Family before coming to the Bay Area to make corporate films. He told me he considers this documentary his way of thanking San Jose. A Francophone, Wohlmut dug into archives in Paris and at ETH Zurich to discover the clues of this mystery.

The Zurich technical school recently designed models for a new light tower to potentially be built here, a project that’s been sent over to SJSU for more research. If they get it off the ground, perhaps there’ll be a plaque honoring the vision of J.J. Owen—literally an enlightening man.

ORE THAN A dozen musicians have been members of jazz fusion band the Yellowjackets since the group launched in 1977. But keyboardist and founding member Russell Ferrante says there are common threads woven throughout the band’s ouvre.

“A strong sense of pulse and groove, a balance of structure and spontaneity, a sense of evolution and development, and an optimistic outlook” are all distinctive characteristics of The Yellowjackets’ music, he says. With some pride, he mentions that there is a class at the prestigious Berklee College

of Music dedicated to the study of the band’s compositions.

Last September saw the release of Raising Our Voice, The Yellowjackets’ 24th album. And although the players may have changed over the decades, those common threads bind the group’s entire body of work.

Ferrante says that the new album represents “who we are, and it reflects our aesthetic sense.” But at the same time, he acknowledges that the band’s character is constantly being refined.

Raising Our Voice revisits some older Yellowjackets tunes. The original version of the opening track, “Man Facing North” appeared on the group’s 1993 album, Like a River.

While the ’93 recording focuses on

electric bass, this new version places emphasis on impressive interplay between Bob Mintzer’s sax and the wordless vocals of Brazilian jazz singer Luciana Souza.

Souza, who co-wrote two of the album’s tracks with Ferrante, is an integral part of Raising Our Voice.

“Luciana’s input was crucial in creating the new versions of previously recorded songs,” Ferrante says.

But most of the music on Raising Our Voice is completely new. “All the [new] music was written prior to going into the recording studio,” Ferrante says, “but we refined and shaped it during the recording process.” Many of the tunes weren’t originally slated to include vocals at all, but once the group entered the studio with Souza, Ferrante says they “excitedly integrated her” into the arrangements.

“She added another melodic voice to the band,” he explains, “allowing us to expand our orchestrational possibilities.”

Each of the four members of The Yellowjackets—Ferrante, saxophonist Bob Mintzer, William Kennedy on drums and bassist Dane Alderson—are involved in projects outside the group.

“Bob writes and records his own quartet and big band music,” Ferrante says. “I compose for and play trio gigs that are entirely acoustic in nature; Will has been playing some more rhythm and blues-oriented gigs on his own; and Dane has a weekly gig in Charlottesville playing a wide variety of music from rock to jazz.”

The group members bring those diverse backgrounds together to create The Yellowjackets’ sound, one that is firmly rooted in the tuneful and accessible end of the jazz spectrum. Raising our Voice explores a number of different textures, from Mintzer’s old-school “Swing With It” to the bop-flavored “Strange Time” to the impressionistic “In Search Of.” The latter makes subtle use of synthesizer, though one has to listen closely to hear it.

“Acoustic piano was my primary voice on this recording,” Ferrante says.

“I feel most expressive at the piano, but I still love the way synths can be used to help shape the arrangements.”

The album ventures outside the jazz idiom completely on a pair of brief, minimalist instrumentals— “Emerge” and “Divert”—that are nearly ambient in nature. “Those pieces were primarily Dane’s creations,” Ferrante says. “We hope to continue to explore [that style] and further incorporate the entire band in a more substantive way.”

Over the years, The Yellowjackets have sometimes been pigeonholed as “smooth jazz,” a style that holds little credibility with critics or serious jazz aficionados. Ferrante takes it all in stride. “I acknowledge that some may label our music as ‘smooth jazz,’” he says, “but I think if you really open the hood, there’s a lot more going on than one might initially perceive.”

Part of the issue some take with smooth jazz is its formulaic nature. “I think some of that criticism [of the style] may be justified,” Ferrante concedes.

But part of why he doesn’t believe The Yellowjackets fit into the category has to do with the intention behind the music.

“We want to make music that will inspire, challenge and last.”

On the other hand, it's not useful in the same way that food and water and sleep are. Most people don't get sick if they are deprived of poetry. But I want to bring your attention to a poem that is serving a very practical purpose in addition to its inspirational function. Simon Armitage's poem "In Praise of Air" is on display in an outdoor plaza at Sheffield University. The material it's printed on is designed to literally remove a potent pollutant from the atmosphere. And what does this have to do with you? I suspect that in the coming weeks you will have an extra capacity to generate blessings that are like Armitage's poem: useful in both practical and inspirational ways.
