DID LOS GATOS’ HOUSING ELEMENT SUDDENLY FALL OUT OF COMPLIANCE? Developer renews claim Town continues to take “illegal actions” to block new housing Drew Penner, Editor
The developer behind the 119unit, 13-story “Capri Fruitstand” proposal for 14288 Capri Dr.—which includes 24 units of affordable housing—has renewed its legal claim that the Town of Los Gatos has been taking illegal steps to block residential development in this corner of Silicon Valley. In Los Gatos LLC’s “second amended petition” filed Dec. 5 in Santa Clara County Superior Court, the Fullerton-based plaintiff says, not only is the Town blatantly disregarding State housing directives to rip development rights from their “Builder’s Remedy” project, but also—following a recent court decision—Los Gatos’ entire Housing Element is likely invalid. “The California Court of Appeals just ruled that another city’s (Redondo Beach) Housing Element is non-compliant because of the use of zoning ‘overlays’ to fulfill its Regional Housing Needs Allocations,” the plaintiff ’s lawyers wrote, referring to New Commune DTLA LLC v. City of Redondo Beach. “The Town of Los Gatos used the same method of zoning ‘overlays’ as Redondo Beach in its Housing Element.” The latest stage in the Los Gatos LLC lawsuit comes as the leadership on Council swings back from former-mayor Matthew Hudes, who fought many of the Housing Element provisions demanded by the ➝ Lawsuit, 6
JOY & OPTIMISM Voices were lifted in hope and unity at Sunday's menorah lighting signifying the start of the eight days of Hanukkah.
COMMUNITY CELEBRATES HANUKKAH ON MAIN A show of local solidarity in the face of antisemitism in Australia Dinah Cotton, Contributor
The “Hanukkah on Main” gathering at sundown on Main Street, Sunday, for the ceremonial lighting of the menorah, was a peaceful event. The first candle was lit, representing divine light and the miracle of Hanukkah. The menorah symbolizes
Jewish identity, history and core beliefs. The news of the unprovoked deadly attack of others celebrating “Hanukkah by the Sea” at Bondi Beach, Australia, was acknowledged and hung in the air. On Sunday, an unprovoked attack killed 15 people in the suburb of Sydney. These individuals were also celebrating the start of Hanukkah. According to Australian authorities, a father, aged 50, and a son, aged 24, fired high-powered firearms into the crowd. Krissy Barrett, the federal police com-
missioner, said on Tuesday it was “a terrorist attack inspired by Islamic State.” The father was shot dead at the scene, and the son was being treated in a hospital at press time. And while it had happened on the opposite side of the globe, the Bondi Beach terrorist attack was noted at the Los Gatos event. “This Hanukkah, we rededicate ourselves to the work of ensuring a safer world for our young people, for our Jewish ➝ Hanukkah, 10

FATAL CRASH ON HIGHWAY 17 UNDER INVESTIGATION Staff Report
BY THE TREE Teri Hope and Dylan Phillips in the reopened section of the cafe.
LGCRC OWNERS VERY GRATEFUL FOR THE OUTPOURING OF SUPPORT AFTER SHOP PARTIALLY DESTROYED Teri Hope says crash brought back memories of years gone by Faizi Samadani, Contributor
Teri Hope founded Los Gatos Coffee Roasting Co. in 1982. When asked about what the last four decades have meant to her, she replies that it’s been an incredibly rewarding journey. On top of being a business owner in town, she raised a family here. She’s been thinking about those years a lot these past several days, after a car nearly demolished her Main Street coffee shop she co-owns. “I feel like I went through my life flashing in front of me—episodes from childhood, to starting the business, to going through other traumas like the earthquake and our local fires, and the pandemic,” she said. “It’s just kind of all these flashbacks of traumatic episodes that then were resolved, and we lived through.” Karl Klemmer, the driver who was driving the Volvo that slammed into the coffee shop on Thanksgiving, died last week. A fundraiser set up by the Los Gatan and other community members to help
the coffee shop rebound—including supporting the employees—had exceeded its goal of $52,000. A few years ago Hope sold off a majority stake in the coffee shop. Dylan Phillips, a member of the family that now runs it, says it’s been nice to see how people have rallied behind them. “It has truly galvanized the community, and they feel so strongly on how much this business means to them, to their life and their history,” he said. Hope notes their recovery has already involved the participation of many. “I've seen this happen in times before, like the '89 earthquake…the fires we had, and the pandemic,” she said. “It has been overwhelming. I only regret that I haven't been able to make a personal thank you to each and every person that has reached out to me.” Hope says that it does offer a sense of validation to her life, and her entrepreneurial spirit. “It was almost six years ago I sold the company, and I still retain a little stock in it—and I still participate as part of the management team here,” she said. Manager Zoe Phang, who was brought
on six months ago, says the love and the care that Phillips and Hope have put into the business is palpable. “I love what I do,” she said. “It's the family that I get to choose, and I chose the Roasting Company. I hear it from so many people that they've been coming here for the last 30 or 40 years…It's just nice to have people come in and love what we do.” In 2012 Phillips switched from working in consulting in the corporate world, transitioning to building coffee shops and running food businesses in Boston. When relative Gerry Ford purchased the majority stake in the business, Phillips decided to begin working full time at the Los Gatos cafe. “I grew up in Monterey, and I have strange memories (of ) when I was young coming here. My last six years have been getting to know the community the way Hope knows them. This place truly has its own unique vibe, with its regulars that have been coming here the last 40-plus years…My message to the community is that we appreciate—and love—everything they've done for us. The outreach is incredible and humbling.”
A 49-year-old San Jose man was killed Sunday morning in a solo-vehicle crash on State Route 17 south of Vine Hill Road, according to the California Highway Patrol. CHP officers responded to the crash at approximately 10:39am on Dec. 14. Authorities said the man was driving a black 2025 Toyota Tacoma southbound on Highway 17 when, for reasons still under investigation, the vehicle traveled off the roadway. The truck struck a tree west of the southbound lanes before continuing in a southeasterly direction and colliding with the center median barrier, CHP said. The vehicle ultimately came to rest in the left lane of northbound Highway 17, south of Vine Hill Road. The driver sustained major injuries in the crash and was pronounced dead at the scene by medical personnel, despite life-saving efforts. His name was not immediately released, pending notification of next of kin. Investigators have not yet determined the cause of the crash. CHP said it is unknown whether alcohol or drugs were factors. In a statement, Santa Cruz Area CHP Commander Captain Jason Grimm reminded drivers to travel at safe speeds for current road conditions, avoid distractions, wear seatbelts at all times and never drive while impaired.
The driver sustained major injuries in the crash and was pronounced dead at the scene by medical personnel. The heavily-traveled Highway 17 corridor connecting Santa Cruz County and Silicon Valley and is known for its narrow lanes, sharp curves and frequent collisions, particularly during periods of heavy traffic or adverse weather. Anyone who witnessed the crash or has information that could assist investigators is asked to contact CHP dispatch at 831-796-2160. *This article was written with the assistance of AI.

HOUSING FIGHT The Capri Fruitstand affordable housing development is at the center of another legal battle the Town of Los Gatos is fighting.
DEVELOPER BEHIND 13-STORY TOWER SAYS LOS GATOS IS USING ILLEGAL TACTICS Lawsuit, from page 1 Department of Housing and Community Development, to current mayor Rob Moore, a big booster for affordable housing and “missing middle” homes. It was Moore who moved the original approval of the Housing Element (which was soon found lacking by Sacramento due to the Town not going far enough to address a lack of housing diversity and fix built-in problems with segregation), with the support of current Vice Mayor Maria Ristow and Councilmember Rob Rennie. Hudes (who opposed that motion) and then-vice mayor Mary Badame (who abstained in that January 2023 vote) have long contended approving a faulty housing plan was a bad move. Because Los Gatos was late by more than a year in approving a successful Housing Element, it opened the door to several so-called “Builder’s Remedy” projects, which are given special rights to be able to build beyond what would normally be allowed. The Town was able to negotiate a “toll-
ing agreement” with Swenson Builders to reduce the size of its Builder’s Remedy project, and residents of the area are now quite pleased with the townhomes set to go in at 15495 Los Gatos Blvd. On March 28, the Town took offensive action against Arya Properties’ and Los Gatos Boulevard Properties’ Builder’s Remedy applications, in the hopes of succeeding where many other municipalities have failed—opposing the Gavin Newsom Administration’s approach to solving the housing crisis, by aiming at invalidating part of the way the Builder’s Remedy tool functions. The lawsuit Los Gatos’ lawyers filed that day (The Town of Los Gatos v. Arya Properties et al.) takes aim at The Luxe, a 120-unit proposal that would rise more than 148 feet (with 24 affordable units), and The Arya, which would rise more than 116 feet at the Ace Hardware site on Los Gatos Boulevard, creating 175 units (including 35 affordable) in the process. The Town contends that HCD is actu-
ally slowing residential unit production by allowing unlimited 90-day periods for developers to continue to tweak their designs, essentially sitting on valuable vesting rights indefinitely. Richard B. Jacobs, the lawyer for Los Gatos LLC, said in the Dec. 5 filing (in its lawsuit against the Town) that Los Gatos—after having lost its opportunity to adjudicate Builder’s Remedy projects by missing the statutory Housing Element deadline—is trying to regain that power in an illicit manner. “This is another case in the continuing battle between the Town of Los Gatos, the State of California, and low income housing groups acting under State law, where the Town of Los Gatos is attempting to block affordable housing projects in violation of State law,” he wrote. “Local governments that do not prepare a housing element substantially in compliance with state law, thereby failing to plan for an adequate supply of housing, become subject to
various legal consequences.” For example, he hinted that Los Gatos LLC may decide to seek attorney’s fees from the Town for initially deeming the full development application it submitted Aug. 23, 2024 incomplete. He also argued that the Town is making a “bad faith end-run” around the Builder’s Remedy by introducing new, illegal, environmental requirements (like environmental impact reports). “Notably, the Town just finished their EIR for their Housing Element in June 2024 and there should be no additional cumulative impacts from the Builder’s Remedy projects,” he wrote, adding Council even discussed how adding extra environmental red tape “would allow them to suspend the Builder’s Remedy developments by approximately 2-4 years because of the comprehensive EIR policy.” On Dec. 2, Council met in closed session to discuss its approach to the Los Gatos LLC lawsuit. And the item was on last night’s public agenda.

LIVE MUSIC Santa Clara Valley Fiddlers Association members played on while attendees enjoyed the seasonal ambiance.
A FESTIVE NIGHT AT THE (NEW) MUSEUM Fiddling with crafts to a soundtrack of live fiddlers Dinah Cotton, Contributor
One of the Los Gatos Chamber of Commerce’s Holiday Trolley stops along Main Street is in front of New Museum Los Gatos (NUMU), at 106 E. Main St. For the second year, NUMU took this opportunity to hold a “Festive” Evening, last Friday. The event was free, with a five dollar fee for hot toddies, hot tea, hot chocolate or other drinks. And it “sold out” (i.e. reservations were capped at 250, though a few folks who dropped-in were allowed admission). Many who attended got their inner artist on at one of the five craft tables. Attendees created holiday-themed crafts such as ornaments, greeting cards and painted rocks. Others simply enjoyed the current exhibitions and took time to view the local historic collection in the downstairs area. There is also a small gift shop section. Historic and new postcards are available for purchase. You might find a unique present here, one to keep or give. Why not gift a mem-
bership to NUMU? This would be a gift that would be enjoyed all year. Great for that person who has everything. (If so, contact: membership@numulosgatos.org)
CURRENT EXHIBITIONS AT NUMU At Reception “Ebb & Flow” - Three artists explore the cyclical nature of life, nature and energy and how each of these forces contributes to personal healing. Through their work, these three artists delve into the subtleties of natural phenomena that reflect on the constantly changing landscapes of both the external world and inner self.
In the Main Gallery “Stitches & Wiggles: Unraveled and Reimagined Mixed Media Art by Jody Alexander and Thomas Campbell” invites viewers to participate in an object-based dialogue that speaks to the similarities of vision, intention, and ways of creating. Alexander and Campbell gather materials to reuse, repurpose, repair, mend, patch, or stitch together to make compelling artworks that use the language of our time. One exhibit here might amaze you, I know it did me.
In the Spotlight Gallery
“Encounters: The Photography of R.R. Jones” - Photos from travels of this fine arts photographer. Gaze upon portraits from spiritual journeys to Bali, Southeast Asia and Mexico. Jones encountered and connected with spiritual leaders and everyday people in memorable and soulful ways.
Down the History Hall
“Los Gatos History Project: Uncovering Untold Stories” - Dive deeper into the permanent collection of NUMU. Objects that have been stored over the years in boxes are out for you to see. One thing’s for sure, if you have some of these items in your home now, or if you grew up around them, you just might be an antique.
NUMU hours
Thursday-Sunday, 10am-4pm Guided tours 11:30am and 2pm (pre-registration is required) Guided history tours from 2-2:30pm, Sunday, Jan. 4, 2026 There’s no charge for admittance on the first Sunday of each month, 10am-4pm. NUMU admission is free to Los Gatos residents and youth under 18.
Upcoming exhibits
Do you know any talented young Santa Clara County artists? Coming up, NUMU will be holding ArtNow, which is a juried exhibition of high school artists’ work. Students from across the county are asked to submit a work of art in a variety of mediums. The theme for this year is “Before/Between/Beyond.” Submissions are open through Jan 25, 2026. (To learn more visit: numulosgatos.org/artnow)
Textiles in Focus
On Saturday, Jan. 31, from 1-4pm, you can join book and fiber artist Jody Alexander at NUMU for an afternoon of learning all things mending. In this 3-hour workshop, the artist will teach a variety of techniques to repair and strengthen garments and other textiles. (Currently on view: “Stitches & Wiggles: Unraveled and Reimagined Mixed Media Art by Jody Alexander and Thomas Campbell.”) When left visible, the repairs are also decorative, adding texture, lines and daubs of color. The techniques can also be used in paper and textile art pieces. Cost: $95 ($75 for NUMU members.)

A heavy police presence was evident and reassuring to the attendees. ing the sadness of our people in Australia and at the same time, we will celebrate the victory of the Maccabees,” he said. “Tonight, and for the rest of Hanukkah, let us light our Hanukkah candles and place them proudly in our windows.” VIP attendees at the event included State Senator Josh Becker, Santa Clara County Supervisor Susan Ellenberg, Mayor Rob Moore and Vice Mayor Maria Ristow, Councilmember Matthew Hudes and Town Manager Chris Constantin. Mayor Moore gave a speech and was cheered on by former Mayor Hudes. The Los Gatos-Monte Sereno Police estimated the crowd to be around 350. This respectful and joyous crowd also joined in with applause, strongly supporting this optimistic address. Several community members were given honors for being “Lights of the Community” at the event, including: Michal Strutin, Judy Levy, Jen Orrin, Lindsay Roller, Shelley Kunin and Jeff Warwick. Rabbi Hugh-Seid Valencia, chief community officer for Jewish Silicon Valley, lit the first candle. The crowd cheered and sang along with a traditional song, binding Town Plaza Park together in a spirit of solidarity. An outstanding rock band named “Band Aid” (AKA “Plaster Rock”) heated up the cool evening. Candles will be lit in the lobby of the Addison-Penzak Jewish Community Center every weekday, Dec. 15-19, at 4pm.

community, and for all of us,” said Tami Segal, emcee for the Sunday evening event at Park Plaza. “We hold fast to our values, and we stand steadfast in confronting hatred wherever it appears.” It seemed that each and every person who attended this outdoor ceremony echoed these sentiments shared by Segal, who serves as the family engagement manager for Addison-Penzak Jewish Community Center Los Gatos. There was a heavy police presence, as additional precautions were taken in the wake of the Bondi Beach carnage. The Los Gatos-Monte Sereno Police Department received thanks by Segal—and others—for their protective efforts. Los Gatos-Monte Sereno Police Chief Jamie Field and Capt. Rebecca Albin were present. The Los Gatos Hanukkah on Main Street Sunday evening was a safe, festive and family-friendly community event. After the first candle was lit, the menorah was moved to the lobby of the Addison-Penzak Jewish Community Center APJCC Los Gatos. That’s where the additional candles will be lit through nightfall on Dec. 22. Ahead of the Hanukkah on Main celebration, Jewish Silicon Valley Chief Executive Officer Daniel Klein sought to reassure the local Jewish community about the security measures in place in Los Gatos. “I know many of you are thinking about your own security and that of the broader Jewish community,” he stated in an email blast. “We have a comprehensive security plan in place that utilizes both visible measures and less visible measures to ensure everyone’s safety. We are constantly and proactively training our staff, funding communal security initiatives, and working with community partners. In addition, we actively review our security protocols in consultation with security experts and with advice from law enforcement at various levels, and we are always closely in touch with the Los Gatos Monte-Sereno Police Department and other law enforcement agencies and experts about the broader security landscape.” He also wrote that, while there will be time for conversations about “how the normalization of antisemitism in our schools, government, and society can lead to this type of violence against Jews,” the Festival of Lights is not a time to let “those who wish us harm” to silence the Jewish community or force its members into hiding. “Tonight, in the heart of Downtown Los Gatos, we will light the first candle carry-

FRESH FACE Rob Moore became mayor of Los Gatos on Dec. 9.
YOUNGEST MAYOR EVER ROB MOORE TAKES CHARGE Ristow back as vice mayor as Rennie opts not to step up Dinah Cotton, Contributor
In a special meeting of the Town Council, Dec. 9, the reins of power were handed over from former mayor Matthew Hudes to Rob Moore, who, at 27, is the youngest Los Gatos mayor ever. (Brent Ventura was also 27 when he assumed the role— but was a few months older). The mayoral position rotates every December, and it’s customary for the vice mayor to be promoted. “The Los Gatos Town Council has focused on local issues and stayed above hyperartisanship,” said now-Councilmember Hudes stated. “I’m grateful to my fellow Council members. You gave me the opportunity to serve and who constantly provide ideas and have helped guide me and give me feedback along the way. I love working with you.” He added, "Finally, I want to thank my family. My wife Qui—who puts up with me jumping up from the table and skipping dinner to get to town meetings and who is a sounding board for me—for my ideas as well as my frustrations—and thank you to Colette and Simon, who are so important.” Hudes added, “It is more than time for a young person to step forward and have a go at it.” His nomination process was interrupted by applause from the overflowing crowd. Hudes formally nominated Moore for mayor. This was then seconded by Council member Ristow—and approved unanimously. Councilmember Rob Rennie was slated to become the vice mayor, but due to personal reasons he declined this position. Councilmember Maria Ristow was nominated and unanimously appointed to serve in the role instead. Ristow’s Council term will expire in December 2028. For the full story visit: LosGatan.com

WILDCAT BOYS FLOURISH WITH A MIX OF YOUTH AND VETERAN TALENT
SPORTS
Los Gatos High School basketball team off to a hot start Emanuel Lee, Sports Editor
On a cold winter night in a packed gym, the scoreboard told only part of the story. Even though the Los Gatos High School boys basketball team couldn’t deliver a victory in front of an electric home crowd in the Lions Club Wildcat Shootout championship game on Dec. 12, what truly energized longtime coach Nick Ward was the way his team competed from the opening tip to the final buzzer. The Wildcats didn’t just play the game— they embraced it. They guarded every possession with purpose, hustled for loose balls and met each challenge without hesitation or fear. Whether diving on the floor, talking on defense, or stepping up in big moments, their effort never wavered. For Ward, that relentless commitment is what defines this team. It’s not only about racking up wins—though that’s a tremendously nice bonus—but about habits: working hard, trusting one another and rising to the moment when the pressure is highest. Those intangibles, he believes, have become the program’s identity—and they are exactly what make this season so exciting to watch for Ward, who is in his eighth season as the Los Gatos coach. Less than 24 hours after suffering a 5749 loss to California High of San Ramon in the Wildcat Shootout title game, Ward certainly didn’t sound defeated. “Last night was fun,” he said. “We understood man for man, they should win that game by 20 (points). To see our guys rise to the challenge was incredible. It was a great confidence booster for us to say, ‘Hey, if we stick together, believe and trust one another we can hang with anybody.’ I’m just really happy how things went and how the guys responded.” Ward had plenty of reasons to be proud of his team’s performance. Cal boasts a roster with two Division I-commits and a third player who is likely to sign with a D1 school. However, Los Gatos held its own, at one point taking the lead in the third quarter before Cal outscored the hosts by five in the final frame to seal the outcome. “Cal High is so talented it’s almost as
LEADERS Senior captains Dionysis Maroudas, Will Campbell and Zach Otoupal pose with the champion’s trophy after the Wildcats’ victory in the Santa Cruz Dad’s Tournament on Dec. 6.
if you had to play a perfect game—and we were near perfect,” Ward said. “There were a couple of turnovers and missed shots near the rim that we would like to have back, but I said to the guys after the game if you told me a month ago we’d be 5-1 after six games, I’d sign up for that everyday. I’m really happy with the effort and the defensive focus this group has started off with this year.” Get a load of this: the Wildcats have an all-freshmen starting backcourt in point guard Milos Grabovac and shooting guard Oliver Evans, which is a rarity in prep basketball. “Pretty crazy,” Ward said. The two play well beyond their years. Grabovic has 23 assists to just four turnovers through six games, and Evans is shooting 45% from three-point range. Both players were key in Los Gatos being able to break Cal’s full-court pressure. “Milos is really strong with the ball, steady and makes passes before the guys are open,” Ward said. “Oliver is really good defensively and doesn’t back down from bigger guys.” It’s still early in the season, but Ward said he won’t soon forget a sequence involving Evans in the Cal game. “Oliver gets the ball in transition and No. 33 (6-foot-6 Juremi Ejuwa) is at the rim,” Ward said. “Kind of like a 1-on-1. Oliver pulls up from the free throw line and sinks it. That one play will stand out for a
long time. He plays with so much confidence and has great speed and change of pace. He’s not imposing in a game where size often wins, but he’s out there battling with big guys and not backing down. Both of them have been awesome.” Los Gatos has won the SCVAL De Anza Division in two of the last three seasons, and expectations are certainly high once again amid a 5-1 start. Senior 6-3 wing Dionysis Maroudas has been sensational thus far, ranking first on the team in points per game (13.3), steals (2.5) and second in rebounds per contest (6.0). After injury and sickness derailed the final month of his junior season, Maroudas dedicated himself in the weight room last summer and has come back stronger than ever. He scored a team-high 18 points against Cal, including 4-for-8 from 3-point range. “Dionysis has been kind of carrying the load for us at wing forward,” Ward said. “He did a great job defensively and he’s so quick and has got a great first step. He can go right or left and get to the basket, which makes him tough to guard.” Fellow 6-3 senior Will Campbell has also made a huge impact, buoying the team with an infectious get-after-it mentality. “Will is claiming the center position, though I typically don’t call anyone on our team a center because we don’t have anyone 6-6,” Ward said. “But when we’ve gone up against teams like Soquel which
had a 6-8 guy and Cal with a 6-6 guy, Will without hesitation says, ‘I want that guy.’ It’s ‘Alright then, you’re our center.’” In addition to his stellar defense and rebounding, Campbell possesses a nice touch in the lane. “He’s great in that intermediate range, where it’s not quite a jump shot but not close enough to be a layup,” Ward said. “He’s got a great touch in that area, and he’s also able to step back and knock down shots from 3-point range as well.” Zach Otoupal, a 6-4 senior forward who is also a standout in football and lacrosse, leads the team with 6.5 rebounds per game. “Zach comes off the football season and immediately gets in there and takes a charge (against Cal),” Ward said. “He’s mixing it up and the easiest and best way to contribute is to go in there and hustle, work hard, play defense, rebound, dive for loose balls. He’s doing all those things and the young kids are learning that’s how you do it. That is how you contribute—play hard and do all the little things right.” Sophomores Ryan Jamieson and Wyatt Robinson along with junior Jack Siri have made solid contributions in a variety of ways. “Ryan can shoot it and Wyatt is in there defensively putting his nose on the ball,” Ward said. “He’s willing to guard anyone, any size. I think my favorite thing about this group is these young kids are willing to mix it up and not backing down. It’s been a lot of fun so far.”

What an achievement! Just recently the Los Gatos-Saratoga Union High School District received notice that it is the only district (K-12 or high school) in California to have earned a perfect rating across every measure the State uses to evaluate how well districts are meeting the needs of students. This kind of across-the-board recognition reflects the exceptional work happening every day in our schools. It’s a testament to the talent
and dedication of the District’s teachers, staff and students, as well as their families and our community support. Los Gatos and Saratoga high schools have set a remarkable standard. Let's keep that momentum going. Lee Fagot Los Gatos
