Airport neighbors reported sightings of the electric powered aircraft and shared photographs.

Resendiz said his partner and owner of ARTI-Culture, Joel Esqueda, was determined to provide a platform for everyone to access the arts and since December 2016 ARTI-Culture has been collaborating with local businesses to engage people in the community who many have not been exposed to art.

Students leave classes to honor gun victims WALKOUTS AT LOCAL SCHOOLS COMMEMORATE PARKLAND Scott Forstner Reporter

In Hollister, a group of San Benito High School students sat on the steps of the administration building in a silent protest starting at 10:30am, according to school staff. Some held signs and others handed out flyers promoting “dialogue, collective action...and change to a system that won't fix itself.”

Student organizers let San Benito administrators know ahead of time that they planned a peaceful action and planned to stay on campus, according to school staff.

At each of Gilroy Unified School District’s three middle schools and four high schools, students met at pre-determined locations for student-led activities from 10am to 10:17am, according to district staff.​ These activities included: sending off 17 balloons with the names of the victims in the Florida school shooting; writing comments on a large poster with the names of the 17 victims; writing comments on post-its and hanging them on a large glass wall;

As a steady rain came down on the Live Oak High School campus on March 14, hundreds of students gathered in the commons area to honor the 17 victims of the Marjory Stoneman Douglas High School mass shooting.

Live Oak students joined their peers at schools in Morgan Hill, Gilroy and Hollister school districts and across the U.S., finding their own way to remember the students and staff killed one month earlier in Parkland, Fla., one of the nation’s deadliest school shootings.

At Live Oak, located on East Main Avenue, 17 student leaders held up printed images of one of those victims, read their names aloud and told a bit of information about their interests, personalities and life aspirations before asking everyone to join in a moment of silence to recognize that individual.

Each student leader then placed the image on a small

bed of multi-colored roses.

Some students in the crowd who walked out of their classrooms to join the 17-minute ceremony, between 10-10:20am, wore orange as a united front to raise awareness on gun violence. Others held handmade signs with different messages either honoring Parkland, Fla. victims or calling for stricter gun laws. A small group of Live Oak students stood at the entranceway to campus holding signs during the ceremony as well.

Supt. Steve Betando, Live Oak Principal Maria Reitano, School Resource Officer Jeff Brandon and other site faculty and local law enforcement were onlookers as the studentorganized event played out with no shenanigans, just quiet respect amongst the Live Oak student body.

Student leaders encouraged students to register to vote if they were not already registered and supplied registration forms.

Aside from Page, Google roots run deep in Kitty Hawk. CEO Sebastian Thrun founded the research-and-development “moonshot factory” Google X, which operates as a subsidiary of Google parent Alphabet Inc., as

well as Google’s self-driving car team. The selfdriving technology is a vital piece to ensure the project’s safety.

According to a media fact sheet released by the company, Kitty Hawk hopes to make flight accessible

to everyone and a part of our “daily lives.” While the design is meant to be part of our daily lives, the company does not envision Cora being in our garages, but rather to be operated as a flying ride-sharing service.

“Cora will use

self-flying software combined with human oversight to make flying possible for people without training,” a company statement read. “Cora is powered by the same kind of technology that helps electric cars.”

San Benito County Sheriff ’s deputies last week started using bodyworn cameras both out in the field and in the county jail, according to authorities.

The sheriff ’s office is also in the process of installing a “new, comprehensive system for audio and video recording of our interactions with the public and those in our custody,” reads a press release.

That effort includes the recent upgrade of

the jail’s security camera system from analog to digital, and the installation of 22 more cameras in and around the perimeter of the jail. The county jail is located north of downtown Hollister, at 710 Flynn Road.

“These measures will ensure we continue to provide quality service and professionalism to all those we serve,” the sheriff ’s press release states.

Nationwide, body-worn cameras in particular have proven to reduce complaints and provide crucial evidence for prosecutors and case managers.

Though body cameras are increasingly

common for patrol officers on the street, it is “revolutionary” to have them worn by jail and corrections staff, the press release says.

Studies have shown that an inmate is less likely to be violent when a correctional deputy is wearing a body camera.

The body cameras on patrol deputies will integrate with the sheriff ’s office’s existing system of in-car cameras, often known as “dash-cams,” the press release continues. The body cameras will not replace the dash cameras, but will “extend (deputies’) recording capacity away from the vehicle.”

Public has right to openness

T

oday begins Sunshine Week, which the American Society of News Editors and the Reporters Committee for Freedom of the Press are celebrating to coincide once again with the March 16 birthday of James Madison, the 4th president of the United States and father of the Constitution and Bill of Rights, and especially the First Amendment.

Sunshine Week is an opportunity for Americans to count their blessings for the brilliance, persistence and virtue of our Founders to establish in brief words the values of freedom, liberty and the power to control, if we work hard enough, the institutions we have created.

Law professors are overly fond of generally describing the law as a “seamless web” in which each of the values that is expressed as a law is supported by and dependent upon every other.

This is certainly true of all the laws that provide for the public’s right to know. These Freedom of Information Laws, created by statute or judicial decision, collectively provide a safety net for those engaged in self-government. Each is built from and supported by the First Amendment.

Of the five First Amendment freedoms— freedom of religion, freedom from governmentimposed religion, freedom of speech, freedom to petition government and the right to a free press— it is the free speech and petition clauses that support many California Sunshine laws. If used by enough of us, these laws create the power to limit and control the institutions we have created.

The California Public Records Act (CPRA) is the law that allows each of us to access the records of government. The law covers all state and local agencies except the Legislature and the courts, which are governed by separate laws. Importantly, and this is a common theme with freedom of information laws, the CPRA presumes that all records held by government

are accessible to the public upon request, unless expressly made exempt from disclosure.

The CPRA gives the public two main rights: the right to inspect records and the right to obtain a copy after paying the direct costs of duplication.

Copies of records held in an electronic format must be made available in any form in which the agency uses the information. While there are hundreds of specific exemptions to disclosure, the law places the burden on the agency to either produce the records or justify its decision to refuse to do so because of an exemption. There are no formalities to making a public records request and agencies are required to assist members of the public to identify records held by the agency.

The California Legislature is governed by its own law, the Legislative Open Records Act (LORA). Many believe LORA needs to be strengthened and legislation has been introduced this year to do so in reaction to the #WeSaidEnough movement and confirmed instances of harassment by elected officials.

The Ralph M. Brown Open Meeting Law and Bagley-Keene Act give all of us the right to attend and participate in meetings of local and state governmental bodies. The Brown Act covers meetings of local legislative bodies like city councils, county boards of supervisors, school boards and special district boards, while the Bagley-Keene act covers bodies of state agencies, like the Air Resources Board.

These laws create five basic rights: 1. The public has a presumptive right to attend meetings of a legislative body (there are narrow exceptions allowing closure of meetings that must be strictly observed); 2. The public has a right to advance notice of the date, time and location of the meeting and a description of each item of business to be discussed at the meeting; 3. The public has the right to obtain copies of memos and background materials in support of a meeting as soon as the

materials are distributed to a majority of the members of the body; 4. The public has the right to speak at a meeting; and, 5. After meeting in a permissible closed session, the body is required to publicly disclose actions taken and any documents approved in the closed session.

California’s courts—the proceedings and records of both criminal and civil courts—are presumed to be open to the public because of myriad court decisions, statutes and regulations.

These general principles apply: 1. Court proceedings are presumed to be open to the public; 2. An attempt to overcome the presumption of openness must be noticed to the public and the burden is on the party seeking closure to establish the existence of a compelling interest to justify closure; 3. Any order to close a proceeding must be narrowly tailored to meet that interest and go no further; 4. The court must make findings justifying closure on the record; and, 5. Findings must be specific and compelling, not speculative. Similarly stiff rules must be met to seal court records.

In 2004 California voters overwhelmingly amended the State Constitution to establish a Constitutional right of access that begins: “The people have the right of access to information concerning the conduct of the people’s business, and, therefore, the meetings of public bodies and the writings of public officials and agencies shall be open to public scrutiny.”

This provides a powerful boost to all the laws that create a presumptive right of public access to the records and meetings of government officials.

These are powerful tools for the public to pry open the doors and files of government, but all their power lies in their continuing use by a diligent and persevering public and the journalists that support the public’s right to know.

Students attending Gavilan College have a new course of study that can help pave the way into the California State University system with an Associate in Arts in Social Justice Studies.

The Transfer degree “is designed to prepare students for a seamless transfer into the CSU system to complete a bachelor’s

degree in Social Justice Studies and related majors,” according to Gavilan staff.

Career pathways include social work, education, government services, human rights, immigration, child advocacy, environmental justice, criminal justice, disability rights and health care.

Sociology instructor Leah Halper was the driving force in creating the program. She noted that in recent years “many students were paying attention to national and international politics, asking for ways they could do more

to participate in building a positive future.”

According to the program description, “Social Justice Studies explores the important terrain between ideals of justice and everyday local, national and global realities of injustice.”

To complete the major, students will take required courses (including three of the following: Sociology of Race, Ethnicity, and Cultural Identity; Introduction to Women's Studies; Intercultural Communication; and Introduction to Sociology: Social Problems) and choose among

a variety of related courses such as Mexican American Cultural History, Women's Lives in United States History, Introduction to Conflict Resolution, and Global Social Change.

Students in this program must complete 60 semester units that are eligible for transfer to California State University, including general education requirements and the courses required for the major, according to Gavilan staff.

“Learning about social justice can help students see themselves in society,”

said Angela Castillo, a sociology instructor.

Upon successful completion of the Social Justice Studies program, students are expected to be able to recognize and analyse the gap between local, national and global realities, and the ideals of democracy and justice.

In doing so, students will apply history and theory to understand past and present movements for social change. They will also be expected to experiment with a variety of social justice methods in their own communities,

evaluating the impacts not only upon the community but upon themselves.

The major is designed to help students envision and assess national and global social justice approaches to contemporary challenges, according to Gavilan staff.

The Social Justice joins 22 other options at Gavilan College, including mathematics, physics, psychology, business, administration of justice and computer science.

Ordinance No.: 968 AN ORDINANCE OF THE BOARD OF SUPERVISORS OF THE COUNTY OF SAN BENITO, READOPTING ARTICLES I AND II OF CHAPTER 7.05 OF THE SAN BENITO COUNTY CODE ENTITLED “STATE VIDEO SERVICE FRANCHISES” RELATING TO STATE FRANCHISES FOR CABLE COMMUNICATIONS; AND REAUTHORIZING A FEE TO SUPPORT PUBLIC, EDUCATION, AND GOVERNMENTAL (“PEG”) CHANNEL FACILITIES WITHIN THE UNINCORPORATED AREA OF SAN BENITO COUNTY WHEREAS, Section 5870, subdivision (n) of the Public Utilities Code, which was enacted as part of the Digital Infrastructure and Video Competition Act of 2006 (“DIVCA”), authorized the County of San Benito (“County”) to adopt an ordinance establishing a fee on state-franchised video service providers to support public, educational, and governmental access channel facilities; and WHEREAS, Section 5870, subdivision (n) of the Public Utilities Code provides that local ordinance establishing the Public, Education, and Governmental (“PEG”) fee shall expire expiration of an applicable State franchise, however, such an ordinance may be reauthorized; and WHEREAS, the County of San Benito (“County”) adopted Ordinance No. 849 on January 12, 2010, wherein the County created Article II of Chapter 7.05 of the San Benito County Code entitled “State Video Service Franchises” (sections 7.05.027 – 7.05.034) in which Section 7.05.033, subdivision (B) (entitled “PEG Support”) imposed PEG fees on cable providers within the County’s jurisdiction; and WHEREAS, California Video Franchise Certificate Franchise No. 0007 granted to Charter Communications, which includes the County of San Benito would have expired on January 2, 2018. In addition, any other state-issued Video Franchise Certificate Franchises within the County which expire in coming years will each trigger the need for renewal of Ordinance No. 849.

This Ordinance is intended to establish an evergreen renewal of Ordinance No. 849 until such time that the Board of Supervisors takes action to cease such reauthorizations; and WHEREAS, Charter Communications state franchise renewal with the County became effective on or about January 2, 2018; and WHEREAS, the County intends to readopt Articles I and II of Chapter 7.05 of the San Benito County Code (sections 7.05.001 – 7.05.034) of the San Benito County Code to reauthorize the collection of PEG fees; and WHEREAS, this ordinance will authorize/reauthorize the County’s ability to charge a fee to cable providers within the County’s jurisdiction to support public, educational and government channel facilities; and, WHEREAS, the County reserves the argument of whether or not Ordinance 849 has in fact expired, or whether it was automatically renewed by the extension of the cable franchise.

NOW, THEREFORE, THE BOARD OF SUPERVISORS OF THE COUNTY OF SAN BENITO ORDAINS AS FOLLOWS: SECTION 1. The foregoing recitals are true and correct and incorporated herein as though set forth in full.

SECTION 2. FINDINGS. The Board of Supervisors makes the findings set forth in Exhibit “A”“Findings” which is attached hereto and incorporated herein by this reference.

SECTION 3. READOPTION. Articles I and II of Chapter 7.05 of the San Benito County Code (sections 7.05.001 – 7.05.034 are hereby readopted in their entirety without any changes.

SECTION 4. REAUTHORIZATION. (A) In readopting Articles I and II of Chapter 7.05 of the San Benito County Code (sections 7.05.001 – 7.05.034), the County intends to, to the extent required by California Public Utilities Code section 5870, subdivision (n), and hereby does reauthorize the fee on state-franchised video service providers to support public, educational, and governmental (“PEG”) channel facilities adopted by the Board of Supervisors on January 12, 2010 in Ordinance No. 849. The fee shall remain unchanged and in full effect as to all state-franchised video service providers.

(B) Commencing from, and after, the effective date of this Ordinance, the County’s PEG fee in Ordinance No. 849 shall automatically be reauthorized upon the expiration of any existing or future Video Franchise Certificate Franchise(s) held by any state-franchised video service provider operating within the County. The Ordinance shall so renew upon the future expiration of Video Franchise Certificate Franchise(s) until such time that the Board of Supervisors takes formal affirmative action to cease the renewals (which action may be taken at any time and without notice, except as required by the Ralph M. Brown Act, California Government Code Section 54950 et seq.).

SECTION 5. SEVERABILITY. If any section, subsection, sentence, clause, portion, or phrase of this Ordinance is for any reason held illegal, invalid, or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions hereof.

The board hereby declares that it would have passed this chapter and each section, subsection, sentence, clause, portion, or phrase hereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses, or phrases be declared illegal, invalid or unconstitutional.

SECTION 6. The Board of Supervisorshereby finds that this Ordinance is not subject to review under the California Environmental Quality Act (CEQA) because it can be seen with certainty that there is no possibility the Ordinance may have a significant effect of the environment pursuant to CEQA Guidelines section 15061, subdivision (b)(3) and is therefore exempt. The County Administrative Officer, or his designee, is hereby directed to prepare and file a Notice of Exemption. (See, CEQA Guidelines sections 15061, subd. (d) and 15062.)

SECTION 7. EFFECTIVE DATE AND CODIFICATION. San Benito County Code sections 7.05.001 – 7.05.034 shall remain codified without changes. This ordinance shall be in effect 30 days after adoption. Within ten (10) days after its adoption, this ordinance shall be published pursuant to California Government Code 6061 in its entirety in a newspaper of general circulation which is printed, published and circulated within San Benito County, or a summary may be published as allowed by law.

Voters will decide fate of cannabis taxes JUNE VOTE APPLIES TO AREAS OUTSIDE HOLLISTER AND SAN JUAN BAUTISTA

Statewide, the business of cannabis is moving forward, but if residents of San Benito County want to see the industry operate in the unincorporated areas of the county, it will be up to them. After the San Benito County Board of Supervisors voted 5-0 on March 5 to pass a cannabis tax resolution for the June 2018 ballot, it now is officially on the ballot.

Approval of the cannabis tax by county voters will be a necessary first step for San Benito County to go forward with the legalization of recreational cannabis cultivation county-wide.

At the moment, commercial cannabis operations are not legal in unincorporated San Benito County. However, if voters approve the tax resolution in June, the path towards legalized cannabis would be just one step away.

“About 55 to 56 percent of our voters passed Proposition 64, and if we put this on the June ballot we will have buy-in from our residents, should they say yes or no — not just the five people on the board,” said Supervisor Mark Medina.

The tax will apply to the unincorporated areas of San Benito County,

County staff, when asked by the Board of Supervisors to draw up a plan, will tax cultivation operations based on per square footage of growing area, along with a tax based on a percentage of gross receipts.

“It’s very important to establish revenue streams, but cannabis won’t solve all of our problems,” said Supervisor Anthony Bothelho. “Support of the measure would send a message that we’re moving forward with a resolution.”

The Board of Supervisors will retain the right to raise and lower tax rates. They will also include an annual increase based on inflation.

Whatever tax the county implements, state taxes will

still apply. Today, the state charges $9.25 for every ounce of flower and $2.75 for every ounce of cannabis leaf. Should the cost of cannabis drop, the state still has its bases covered when it comes to tax revenue.

“If an ounce of flower sells for $200 the $9.25 tax results in a 4.63 percent tax,” reads the county report. “If, or maybe when, the price of an ounce of flower drops to $100 an ounce, the same dry weight charge of $9.25 is now a 9.25 percent tax.”

The state also charges a 15 percent excise tax on all cannabis activity, in addition to any existing sales tax.

Whether the taxes are or aren't implemented will be decided by a simple yes, or no, of the majority of San Benito County voters. The vote essentially will decide the fate of the cannabis

industry in the unincorporated areas of the county.

While the Board of Supervisors will have the power to adjust tax rates, the ordinance before the voters will sets guidelines on what the county can charge.

The tax per square foot for cultivators will ranch from $3 and $17 and gross receipt taxes on cultivators: 2 percent- 4 percent on distributors, 2.5 percent-4 percent on manufacturers, .5 percent-8 percent on retailers, and 2.5 percent-5 percent on microbusinesses.

The City of Hollister currently charges $7 per square foot and has a 5 percent tax on gross receipts in manufacturing and retail.

During the period of public comment, several county ranchers came to speak in favor of the ordinance.

“It’s never been easy

to make a living off our ground, and in the last several years we’ve seen many of our neighbors sell their land to billionaire nonranchers,” said rancher Lee Scazighini. “We feel that the cannabis industry could be a godsend. With our climate, we could grow some of the best cannabis in the world. I hope you consider this win/win situation.”

Other tax measures

The County Board of Supervisors also approved adding two other tax measures to the June ballot.

Measure, A, the Abandoned Vehicle Abatement Program, would create, if approved by voters, an additional vehicle registration fee of $1 per vehicle and $2 for certain commercial vehicles for 10 years.

This money would be used

to cover the costs of removing and disposing of “abandoned, wrecked, dismantled, or inoperative vehicles.”

The third tax/fee measure added to the June ballot in San Benito County is a 50-percent increase in the Transient Occupany Tax, also known as the hotel/motel tax.

Voters will be asked approve, or disapprove increasing the tax from 8 percent to 12 percent for all motels and hotels in unincorporated areas of the county (outside the cities of Hollister and San Juan Bautista). Funds raised by this tax increase could be spent for unrestricted general revenue purposes, but the county specifically identified county services, such as law enforcement, fire, economic development, roads as top priorities.

Assembly, Senate, judge races are set

The most hotly contested local primary on June 5 will be in the 30th Assembly District, which encompasses all of San Benito County, much of Monterey County, and portions of southern Santa Cruz County, and southern Santa Clara County, including GIlroy and Morgan Hill.

Incumbent Anna Caballero termed out, and is running for the California State Senate, leaving a wide-open race, with six candidates—four Democrats and two Republicans.

California’s primary system send the top two vote-getters to the General Election in November, regardless of party affilation.

The race pits city against city, as four popular local elected officials hope to make the jump to Sacramento, and are counting on their local support to carry the day.

San Benito County Supervisor Robert Rivas of Hollister is one of the Democratic candidates. He is a counselor at San Benito High School.

He has received Caballero’s endorsement.

For the “No. 1” judge’s seat in San Benito County Superior Court, the incumbent, Steven R. Sanders, is running for re-election without any opposition.

In the race for San Benito County Sheriff-Coroner, incumbent Sheriff Darren Thompson is seeking re-election. He is facing one challenger: Deputy Sheriff Bill Hutchison, who qualified March 10.

Thompson qualified for the June ballot on Feb. 12, according to the Registrar of Voters’ website. He has served as the county’s sheriff since 2011.

Suspect dies in Gilroy police custody QUESTIONS OVER INCIDENT SPUR MARCH, RALLY, MEMORIALS Michael Moore Reporter

Steven Juarez—known affectionately by his friends and family as “Stevie”— was a social butterfly, a die-hard football fan and a tattoo artist who inked some of his childhood friends from his east Gilroy neighborhood.

He was also a father, brother, son and friend who was remembered by loved ones at a memorial reception at the San Ysidro Park community room March 8, nearly two weeks after he died in a struggle with Gilroy Police officers who tried to arrest him Feb. 25.

Juarez’ mother, Martha Silos, laughed and cried as she recalled her son’s devotion to his family and his neighbors.

Silos described how Stevie used to “get mad at me” when she used to tell his friends to “keep an eye on him.”

“He loved his mother,” Silos said.

When Silos suffered a broken ankle last summer, her son stopped by her house “every day” to check up on her and help her get around. He bought a new pair of shoes for her, designed with ankle support.

“I wear those shoes every day,” Silos said.

The reception took place after Juarez’ family buried him March 8 at St. Mary’s cemetery off First Street in GIlroy. About 60 friends, family and area activists attended. Some shared memories of Stevie, and others urged those in attendance to keep the pressure on the authorities

while they investigate the Feb. 25 incident that ended in Juarez’ death, and hold the police accountable.

Many of those in attendance wore t-shirts with Juarez’ face printed on the front.

The next day, many of those attending the memorial service would join others in a march and rally through downtown Gilroy, protesting the actions of police officers on Feb. 25.

Juarez was 42 when he died. Authorities are still investigating the cause and manner of death, and whether officers acted lawfully in trying to detain him on the 7400 block of Chestnut Street. Few details of the incident have been released.

“He was a great father, and a great football player,” said Stevie’s sister, Monica Juarez. “He was loved by many. He had a great sense of humor, and he was always helpful and loving.”

Stevie grew up in the previous family home on Polk Court, just a few blocks down the street from San Ysidro Park.

Juarez and his friends and siblings spent a lot of time playing handball in the park growing up, and at the South Valley Middle School athletic field across Murray Avenue from Polk Court. That field was the scene of countless neighborhood football games in which Juarez, a former Pop Warner athlete, was a key player, according to friends who spoke about him March 8. They even used to play in the rain.

Silos also described how Stevie would spend his evenings “making the rounds” in central Gilroy on his bicycle, visiting different friends and relatives to help with chores or to socialize.

Many who shared their memories of Juarez March 8 described him as “outgoing.”

Linette Arias, of Gilroy— a friend who has known Stevie since they were children—remembers seeing him walking up the street with a two-seat stroller when his twin boys, now 6 years old, were infants, “with a diaper bag on his shoulder.” Arias praised Juarez for helping to motivate her daughter when she went to military boot camp.

“He was easy to talk to,” said Arias, who cooked up an enchilada fundraiser

March 2 and 3 for Juarez’ funeral expenses. “My kids really liked him. He had a good heart.”

Raul Maldonado grew up in Stevie’s neighborhood and was friends with his younger brother, Chico, who died in a car accident several years ago.

Maldonado saw Stevie as a mentor who inspired him as an artist. Stevie inked a tattoo on Maldonado’s forearm to honor Maldonado’s son, Brandon, who died at childbirth.

“I thank his mother for bringing such a wonderful man into this world,” Maldonado told the crowd March 8, fighting back tears.

didn’t deny that Juarez had some run-ins with police. He was in jail when he heard that Chico died, and was unable to attend his funeral. But Silos said Stevie had grown out of the “gang stuff ” and other criminal tendencies long before he died.

Activism was another facet of the March 8 memorial event, which was also attended by the family members of other young men killed by police in other jurisdictions. One of these activists suggested that recent reports that Stevie had drugs on him when he died, and that he had a criminal record only serve to deflect blame from the police department. “(The police) will do

everything they can to make him this person who deserved to be executed by police,” said Laurie Valdez, whose husband was shot and killed by San Jose State University police in 2014. “You remember who he was. Make that the narrative.”

Two of Stevie’s cousins—brother and sister Rebeca and Reymundo Armendariz—are also community organizers with the nonprofit Community Agency for Resources, Advocacy and Services (CARAS). They also attended the March 8 memorial event for Stevie, and invited those in attendance to the March 10 protest in downtown Gilroy.

Moore also pointed to other school choices in Hollister, such as the Hollister Dual Language Academy, which shares a campus with Gabilan Hills Elementary School, and the Accelerated Achievement Academy, which is on the Calaveras Elementary School campus.

Navigator students have shared the campus at RO Hardin, an elementary school on Line Street in southwest Hollister, since that school’s inception nearly five years ago. Hollister Prep has 420 students in kindergarten through sixth grade, and is to grow over the next two years to serve seventh and eighth graders.

“We are incredibly fortunate to have a strong relationship with the Hollister school district and being able to partner with them at RO Harden,” Carr said.

“I definitely think being on the RO Hardin campus truly makes us part of that neighborhood and part of a

neighborhood school.”

Gilroy Prep is situated in the former Mexican American Community Services Agency school buildings adjacent to South Valley Middle School on IOOF Avenue. While they are next door neighbors, the two schools do not share classrooms on the same campus as Hollister does. Gilroy Prep is in its first year at full capacity, serving 540 students in grades K-8.

“I would say the relationship between the district and Gilroy Prep is very positive.

What I see happening in the classrooms is pretty exciting.

They are getting really good results,” said Gilroy Board President Linda Piceno.

“The two major issues to look at (when evaluating a charter school) are student achievement and financial budgetary issues, and those are both fine. The kids are making good progress and they have no financial issues we’re aware of.”

Piceno has visited Gilroy Prep and toured the campus on multiple occasions.

She said, “communications are good between the charter school and (Gilroy) district.”

Two Navigator charter schools, Gilroy and Hollister Prep, are up for renewals of their charter school petitions by their host districts. All early indications point to new five-year pacts at both sites.

Gilroy Prep, Navigator’s flagship school, opened in 2011 with authorization from Gilroy Unified School District’s Board of Trustees, which is scheduled to vote on that charter’s second such renewal at its March 22 meeting.

Hollister Prep, which opened in 2013 on the RO Hardin Elementary School campus, is authorized through the Hollister School District and is seeking the same five-year renewal (2018-2023) through Hollister’s Board of Trustees.

“We realize how rare it is to have such strong

relationships with our authorizing districts, but both are very progressive and supportive of charter schools,” said Kirsten Carr, Navigator’s director of community outreach. “We have large parental and community support for both sites.

A huge part of our mission is to make an impact in both communities.”

Both Navigator schools conducted their initial public hearings, mandated in the state charter renewal process, in front of their respective governing bodies. At both hearings, Navigator staff and families spoke to the positive experiences and innovative instruction given at their schools. They will be allowed to be heard again prior to the upcoming votes.

The vote on Hollister Prep’s renewal will take place at the Hollister board’s March 27 meeting, five days after Gilroy Prep’s scheduled date.

“We’ve offered something special to the kids of Hollister by approving (Hollister Prep’s first charter petition). It just gives parents another option,” said Hollister Board President Patricia Moore. “The kids seem to be thriving, and I know that

That was not the case in nearby Morgan Hill, where the Morgan Hill Unified School District’s Board of Trustees rejected Navigator’s petition in 2013. The Morgan Hill teachers union and district leadership also were successful in arguing their case at the Santa Clara County Office of Education, which denied Navigator’s Morgan Hill Prep petition during the appeal process in January 2014.

In addition, Navigator charter petitions were

denied by local school boards at the Salinas City Elementary School District and the Alisal Union School District (also in Salinas).

Even in Hollister, school district officials were initially against the Navigator petition, first submitted in 2012, hiring a law firm to find deficiencies. However, the board gave its conditional approval with a split 3-2 vote.

Carr said that Navigator is working on a petition to open its third charter school, within the Pajaro Valley Unified School District in Santa Cruz County.

SBCOE to serve as Region 5 lead for student support For the second year in a row, the San Benito County Office of Education will serve as the Region 5 lead for the California Scale Up MTSS Statewide (SUMS) Initiative

designed to scale-up a sustainable Multi-Tiered System of Support (MTSS) in schools across the state.

Region 5 is one of 11 county office regions in the state and consists of San Benito, Santa Clara, Santa Cruz and Monterey counties.

MTSS is a framework which organizes and systematizes existing supports for students and provides a system for schools to identify additional ways to help students.

As the regional lead, the district trains district personnel, provides technical assistance and acts as a liaison between the state and the Region 5 county offices of education and each district.

Currently, nine of the 11 districts in the county are working with the county office of education to develop a strong MTSS in each of their schools.

Through the support of the county district, nine of our districts applied for and received a grant of between $25-$50,000 to train staff and develop MTSS at their sites. One final round of grants will be offered to other districts next fall.

ORDINANCE NO. 1153 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OFHOLLISTER ADDING SECTION 5.21.090 REAUTHORIZATION OF STATE FRANCHISE HOLDER PEG FEES TO HOLLISTER MUNICIPAL CODE 5.21 STATE VIDEO SERVICE FRANCHISES WHEREAS, Section 5870(n) of the Public Utilities Code, which was enacted as part of the Digital Infrastructure and Video Competition Act of 2006, authorized the City of Hollister to adopt an ordinance establishing a fee on state-franchised video and cable service providers to support public, educational, and governmental access channel facilities (“PEG”); and WHEREAS, on November 30, 2009 the City of Hollister adopted Ordinance 1054 to establish such a fee and Ordinance 1054 was codified as Hollister Municipal Code Chapter 5.21 State Video Service Franchises; and WHEREAS, Section 5870(n) of the Public Utilities Code states that such an ordinance shall expire, and may be reauthorized, upon the expiration of the state franchise; and WHEREAS, the City’s state-issued franchises were given a term of 10 years, which may have expired. Upon renewal of its state-issued franchise with the CPUC the City must reauthorize its ordinance; and WHEREAS, this Ordinance is exempt from environmental review pursuant toSection 15061(b)(3) of the State Guidelines implementing the California Environmental Quality Act of 1970, as amended.

NOW THEREFORE, BE IT RESOLVED, that the City Council of the City of Hollister does hereby ordain as follows: SECTION 1. Chapter 5.21.090 is hereby added to the Hollister Municipal Code as follows: 5.21.090Reauthorization of State Franchise Holder PEG Fees i. The fee on state franchise holders to support public, educational, and governmental channel facilities in Hollister City Code Chapter 5.21 is reauthorized and shall remain unchanged and in full effect as to all state franchise holders.ii. The PEG support fee in Hollister City Code Sections 5.21.070 shall automatically be reauthorized upon the expiration of any existing or future franchise certificate(s) held by any state franchise holder operating within the City of Hollister.iii. This chapter shall automatically be reauthorized upon the expiration of any existing or future franchise certificate franchise(s) held by any state franchise holder operating within the City of Hollister.

This chapter shall so renew upon the future expiration of any franchise certificate(s) until such time that the City Council takes formal affirmative action to cease the renewals.

SECTION 2. Any provision of the Hollister Municipal Code or appendices thereto inconsistent with the provisions of this Ordinance, to the extent of such inconsistencies and no further, is hereby repealed or modified to that extent necessary to effect the provisions of this Ordinance.

SECTION 3. If any section, subsection, sentence, clause, or phrase of this Ordinance is for any reason held to be invalid or unconstitutional by a decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Ordinance. The City Council hereby declares that it would have passed this Ordinance and each and every section, subsection, sentence, clause, or phrase not declared invalid or unconstitutional without regard to whether any portion of the ordinance would be subsequently declared invalid or unconstitutional.

Section 4. Publication. Within fifteen (15) days after passage, the City Clerk shall cause this ordinance to be published one time in the Free Lance, a newspaper of general circulation.

The City of San Juan Bautista Water System has high levels of nitrate DO NOT GIVE THE WATER TO INFANTS UNDER 6 MONTHS OLD OR PREGNANT WOMEN OR USE IT TO MAKE INFANT FORMULA Water sample results received from 2/1/2018 to 2/28/2018 showed nitrate levels ranging from 5.28 to 9.16 milligrams per liter. While these results do not exceed the nitrate standard, or maximum contaminant level (MCL), of 10 milligrams per liter, Nitrate monitoring results from June through November 2017 showed concentrations above the nitrate MCL. The City of San Juan Bautista is issuing this notice as a precaution because the water provided by the water system cannot be assured to reliably meet the nitrate MCL at all times. Nitrate in drinking water is a serious health concern for infants less than six months old.

What should I do?

• DO NOT GIVE THE WATER TO INFANTS. Infants below the age of six months who drink water containing nitrate in excess of the MCL may quickly become seriously ill and, if untreated, may die because high nitrate levels can interfere with the capacity of the infant’s blood to carry oxygen.

Symptoms include shortness of breath and blueness of the skin. Symptoms in infants can develop rapidly, with health deteriorating over a period of days. If symptoms occur, seek medical attention immediately.

• PREGNANT WOMEN SHOULD NOT CONSUME THE WATER. High nitrate levels may also affect the oxygen-carrying ability of the blood of pregnant women.

• Water, juice, and formula for children under six months of age should not be prepared with tap water. Bottled water or other water low in nitrates should be used for infants until further notice.

• DO NOT BOIL THE WATER. Boiling, freezing, filtering, or letting water stand does not reduce the nitrate level. Excessive boiling can make the nitrates more concentrated, because nitrates remain behind when the water evaporates.

• If you have other health issues concerning the consumption of this water, you may wish to consult your doctor.

What happened? What is being done?

Nitrate in drinking water can come from natural, industrial, or agricultural sources (including septic systems, storm water run-off, and fertilizers). Levels of nitrate in drinking water can vary throughout the year. We will let you know when the amount of nitrate is again below the limit.

The City is working to bring two new wells into the water system so that Well #2 (high nitrates) can be taken off-line. The goal is to have the system back in compliance by November.

Freshman third baseman Kaia Dickens hits sixth, sophomore Julia Woeste is in the seventh spot, junior shortstop Alyssa Ito is in the No. 8 spot and junior outfielder Ariel Mendez in the nine spot. In the first couple of games, Barragan said Monteon and Rodriguez were carrying the load offensively.

“We were hoping Chavarria and Cortez would start clicking, and sure enough in the last game (9-8, 9-inning loss to Concord last Saturday) they did,” Barragan said. “Their bats started to wake up, and that’s what we needed from them.”

Chavarria went 3 for 4 with two doubles, and Cortez finished 2 for 4

with a double. Woeste also had a terrific performance against Concord, going 3 for 4, including hitting two balls that went off the wall. Woeste also pitches whenever starter Amanda Moisa needs relief. Dickens has displayed poise and fielding acumen at third base, Ito has been steady as usual and Mendez tracks the ball well,

has a good arm and is strong defensively.

Then there’s Rodriguez, who has a rifle for an arm behind the dish and is terrific defensively. With a sweet swing and improved strength and power, Rodriguez has the potential to dominate a game singlehandedly. Rodriguez, who also plays for the travel program California Suncats,

credits coach Jenny Barboa for helping her continually develop as a catcher.

“She helps me with hitting a lot and as a catcher,” Rodriguez said.

Rodriguez is not only trying to lead the Balers to another league and section title, she’s honing her game for the college as well.

The San Benito High softball team entered Tuesday’s home game against Alvarez at 0-4, having been outscored by a combined margin of 33-15. Granted, the Haybalers have faced some powerhouse programs—Clovis is ranked 26th nationally and Huntington Beach 30th—but for a tradition-rich program like San Benito, losing its first four games constitutes something out of the ordinary.

Not to worry, says third-year Balers coach Andrew Barragan and catcher Amber Rodriguez.

“We’ll be stronger once we get in league,” said Rodriguez, who has made a verbal commitment to

play at Weber State University. “We just need to have more faith in each other, and we’ll be fine.”

Said Barragan: “I have confidence that the wins will come and we’ll get to where we need to be.”

Barragan should feel that way. Last season, San Benito had a somewhat similar start to the season before it ran off 18 consecutive wins en route to another Monterey Bay League Gabilan Division championship. There’s no reason to think this season will shake out any different.

The Balers return standout juniors Rodriguez and North Carolina-commit second baseman Dominique Monteon. Both players are getting better each season, and the duo lead by example. Along with seniors Noel Chavarria and Chloe Cortez, the four must be as unified as ever if the team plans on making it back to the CCS playoff championship game.

and kind of kept me on the ground for a little while,” he said. “But after a certain point, I thought it was better to get off the ground and maybe lose a season rather than not taking off at all and having no season whatsoever.”

Once Reikowski got healthy last summer, he started working with renowned pole vaulting coach Joe Miyoshi in the Santa Cruz area. The once a week sessions helped Reikowski regain his confidence and shore up some of his technical aspects of the sport he needed work on. Reikowski was going skyward again—and not a moment too soon.

“It would’ve been hard to start this season had I not got to vault for him in the summer,” Reikowski said.

In last year’s Monterey Bay League Track and Field Trials, Peter Reikowski was in street clothes and on crutches, wondering what could’ve been. The San Benito High senior was having an outstanding season until he suffered a severely sprained right ankle that forced him to miss the last third of the season.

Healthy again and motivated, the 6-foot-1, 160-pound Reikowski has plans to go higher than he’s ever gone before. Reikowski hit a personalrecord (PR) of 13 feet, 6 inches two times in a span of three days last season, in a three-way league meet on April 5 and in the Don Bell Quicksilver Classic three days later.

A week later in the Bill Kearney Invitational, Reikowski came down

awkwardly on his right ankle on his landing while attempting 13-3. Just like that, Reikowski’s season was done, as he wasn’t able to suit up for the Trials a month later.

“I thought I could recover for league and make it to CCS, but by the time the Trials came around, I was still hobbling,” he said.

It was a devastating blow for Reikowski, who only took up pole vaulting in his freshman year after watching his older brother, Matt, star for the track and field team. For Peter Reikowski, a return to form was anything but a foregone conclusion. Pole vaulting isn’t for the faint of heart, especially after one suffers an injury like Reikowski did.

Peter Reikowski overcomes injury to soar again ➝ From page 21

National Park. “I grew up in the middle of nowhere,” he said.

Reikowski attended Jefferson School, and his eighth grade graduating class had a grand total of three students— himself included. One can only imagine how Reikowski felt upon entering San Benito High, which at 3,000-plus students is one of the largest in the Central Coast Section.

“It was pretty crazy,” he said. “I was not prepared at all for the start of my freshman year. I went from a school of 17, maybe 18 kids and then all of a sudden I show up on the first day at San Benito with a class of 700 freshmen. I was like, ‘Wow, what is this?’”

Like all athletic disciplines, pole vaulting requires a tremendous amount of technique. Reikowski is trying to work his way up to using a bigger and longer pole, as it will help him launch up in the air. He’s also building up his strength and speed while using the pole.

“It is about form and how technical I can get,” he said.

the injury. Pole vaulting is a really mentally taxing event, and mentally it took a long time to recover from the injury.”

Reikowski is now in a place where he feels comfortable taking off the ground, jumping and not having the fear of reinjuring himself. Mentally, he’s in a much better place than he’s been in a long time.

Reikowski is still feeling his way into the pole vault this season, as he’s gone 10-6 and 12-6 on two occasions in the first three meets of the season. It’s still early, and that’s why Reikowski said his goal is to hit 14-6 or 15 feet by the end of the season. Reikowski’s brother, Matt, had a PR of 14 feet in his senior year in the CCS Semifinals.

“I’m feeling confident again,” said Peter, who just got accepted to Cal Poly.

Reikowski will major in animal science with the goal of starting a ranching business “or something of that sort.” Reikowski was raised in one of the most remote parts of San Benito County, five miles from Pinnacles

Reikowski has big goals for his main event, the pole vault. Reikowski wants to hit the 14 to 15 feet range.

Reikowski also credits San Benito jumps coach Eddie Valencia for helping him develop and improve with each successive season.

“Coach Valencia has worked wonders with me,”

he said. “He’s a really good and dedicated coach, and is helping all the athletes go as high as they can possibly go.”

Reikowski has displayed the resolve and determination necessary in order

to progress and potentially reach his goal of a big PR and a place on the podium at the CCS Championships.

In fact, he displayed some of that grit immediately after he got hurt.

“When I got injured, my first thought was, ‘Hmm, I wonder when I can pole vault next,’” he said.

Reikowski has gone skyward again, intent on going higher than ever before.

for college because it’s right around the corner,” she said. “I’m just trying to prepare myself by getting stronger and faster.

They expect a lot at Weber State from freshmen, so I’m trying to prepare for that level of intensity.”

Speaking of intensity, that is a perfect way

to describe San Benito’s schedule. It’s no accident the Balers have one of the toughest and brutal nonleague schedules around.

“We could stick around here and play the Circle of Champions (tournament),” Barragan said.

“But compared to playing (in the Clovis Leadoff Classic and the Spring

Jamboree in Las Vegas in April), that is not going to help us get better or help us win league and another CCS title.”

Barragan makes a tough non-league schedule so once the team enters league play, it will have seen the best of the best. And the Balers have certainly seen some of the premier

players in the state, as they’ve faced a handful of Division I-bound pitchers.

Barragan said Huntington Beach has nine—count ‘em, nine—players committed to a Division I program.

“We knew what we were getting into when I put this national schedule together,” he said. “Some of our girls are pressing a

lot and have been really tense at the plate. The biggest fear is you don’t want the girls to lose confidence, but most of them play travel ball and are really competitive. I’m hoping my master plan will work, and the girls are really buying into it and not getting frustrated or down on themselves.”

Rodriguez certainly has bought into playing tough teams; after all, she and some of her teammates play tremendous competition on their respective travel ball teams.

“We care for each other as players, and we’ll have to care for each other even more to reach our goals,” Rodriguez said.

ary Jane Green, passed away peacefully Saturday, March 10, 2018.

Wife of the late John E. Green. Loving mother of Sister Bobbi Green of Gilroy and the late Patty Blomgren. Also survived by nieces and nephews. A native of Gilroy.

Age 96 years. She worked for Marionís Dress Shop, Roberts Department Store and Fordís Department Store as a retail clerk.

He will be interred in Colorado. Memorial March 24, 2018 at Ridgemark in Hollister.

Ernie enjoyed fishing, hunting, sightseeing and traveling to wherever the road took them. He shared his time between Blue Ridge and Eagle Lake in the summer and Gilroy in the winter.
